Speaker 1 (00:00):
My name is John Mountson. Yesterday there was a major
landmark decision made by the Supreme Court affirming the lower
courts ruling from Tennessee. Joining us now to talk about
this is Attorney General Steve Marshall. Steve, Welcome to the show.

Speaker 2 (00:15):
Good morning. Yeah, yesterday was a really really good day
for kids across the country.

Speaker 1 (00:19):
And the great thing about this is it makes them
I guess it got let's kids be a kid again,
as opposed to making them political pawns, which is what
they've kind of become in the last few years with
this whole I didn't hear about this, you know, I
was when I was growing up or even ten years ago,
about all these kids getting their gender affirming care. What
has changed?

Speaker 2 (00:39):
Yeah, First of all, I think, you know, if you
look in society as a whole, we have you know,
social media and other influences pushing kids to believe that
gender is some fluid concept, which you and I both
know is completely not the good thing for everyone involved.
Is it. Gender dysphoria, which is a mental health condition,

(00:59):
had the ability for professional counselors that are trained in
that area to provide help for kids that have confusion,
but No, we've seen an absolute enormous jump in those
who claim, somehow another to be confused about their gender.
The trans movement has confused that in a profound way,
and yesterday's Supreme Court decision gives the sanity back to

(01:21):
this issue and allows the twenty seven states now that
have banned kids receiving preewery blockers and cross sex hormones
or even surgeries, giving them the ability to restore like
the kids see.

Speaker 1 (01:34):
One of the things always confuses me is a while ago,
the argument was always that people are born the way
they're born. If they're gay, they're born gay. If they're straight,
they're born straight. They're born the way they're born. But
then on the other hand, you have these gender affirming
things that maybe you're not born the way you're born
and we should address it. Which is it should is
it a mistake or is it the way they're supposed

(01:55):
to be. Why is it that some people think that
this is necessary versus it's just who you are?

Speaker 2 (02:01):
You know, if I could answer that, then I would
really really have some good answers for you, because I
don't get it at all. Look, it's only until recently
that we've even had this confusion where a Supreme Court
justice would get in front of her confirmation hearing and
being able to ask, can you define a woman? And
she says, no, I'm not capable of doing this.

Speaker 1 (02:19):
Well, she said she wasn't a doctor. I believe it
was a Kaitanji Brown Jackson, wasn't it?

Speaker 2 (02:26):
Yeah it was? And yeah, she said, yeah, I'm I'm
not a scientist to be able to do that. And look,
I think it's pretty easy to be able to define
what our gender is. And that's how God created us
a conception, and then from that, uh, everything else has
flowed completely. You know, we we had great success with
Title nine to be able to provide women with greater opportunities.

(02:48):
Even when Left was champion Equal Rights Amendment, there was
never a question of what the term sex meant. It
was defined as God created us as man or woman.
But suddenly, in today's society, we had divided administration try
to enforce this radical gender ideology across the country. The
good thing is the majority of Americans that push back.

(03:09):
We've seen that on girls' sports, and I think we've
also now seen how the data has proven that those
that would proclaim gender affirming care weren't doing it based
on science and research, but instead we're doing it based
on political philosophy.

Speaker 1 (03:24):
Can we change, Steve, can we change that term? I
don't like the term gender affirming care. I feel like
we should change it to something like, you know, science
denine care, something like that. I don't know, but it
doesn't seem like it's the right term.

Speaker 2 (03:37):
No, I think you're right, and probably by saying that,
we're giving in a little bit to the narrative of
the left. But you know, that is definitely what proponent
to have argued that it is. But we have the opportunity,
through mental health and counseling to be able to help
kids that have this confusion. But John, one of the
craziest things I think I've ever seen was a gender
reveal video for a four year old. I mean, that

(03:59):
clearly is wrong, and whether it be the child or
the parents or both that believe that that is an
appropriate way to address issues with kids, shows just how
far many in society have been willing to go.

Speaker 1 (04:13):
You know, you always see it like it at the
birth where the doctor percro you know, turns around proclaims
it's a boy. And nowadays it's more like well, we
can't really say. It's a lot of things I don't know.
We'll let you guys figure it out later on. Let's
just go ahead and get this done with. And now
this case, it came out of Tennessee, right, Alabama, we
already have a law in effect that already bans gender

(04:34):
affirming care in Alabama under the age of nineteen, isn't.

Speaker 2 (04:38):
It we do? And in fact, we were challenged as
well multiple groups on the left. If you recall, they
filed lawsuits and they dismissed them, and then they refiled
them again. Alabama was aggressive and attacking the science and
the research and those that wanted to be able to
set us out Alabama's law. And interestingly, before the Supreme

(04:59):
Court even ruled yesterday, the plaintiffs in Alabama's case dismissed
their actions, which told me very clearly that they realized
that they were exposed. They had no ability to argue
effectively in court that Alabama didn't have a legitimate basis
to be able to protect our kids from this radical treatment.
And happily Alabama's laws in place with no other litigation

(05:22):
pending right now.

Speaker 1 (05:23):
See don't you find it funny that it is the
left that always wants to say that they're the party
of science, that they are scientific, that the right that
they are science deniers. But this seems like when I
took biology in seventh grade. This seems like, as they
would say, settled science. So how is it that they
want a champion being the party of science and then
turn around and deny science in ways like this?

Speaker 2 (05:47):
Yeah, it works one way when they argue for their
vaccine requirements on COVID, But yet when the research and
look Europe led the charge sadly enough to be able
to help the United States move back to a level
of sanity, when you saw something known as the Cast Report,
it came out that condemned those that believe there's any

(06:08):
peer reviewed, appropriate science that is supportive of what the
left was trying to do. But the good thing is
that Alabama stood up in fought. We were able to
demonstrate the fallacy of these regulations and standards of care
from an organization called WPATH, and then we were able
to get into the underbelly of what was going on
at the Biden Department of Health and Human Services, where

(06:32):
Rachel Levine, who was Deputy Secretary, was trying to push
on scientists and doctors this political ideology because they wanted
to be able to advance the transgender movement.

Speaker 1 (06:44):
Don't remind me of Rachel Levine. I would rather I
planned to never have to hear her his to him
that name again as long as I live. Thank you
so much for joining us this morning, Steve to talk about.
This is Steve Marshall, our Attorney General. Where we're so
we're so lucky to have you, Steve, because you are
keeping us safe and you're making sense down there in Montgomery,

(07:06):
and who knows. I know you can't talk about it
on the on your company time and all, but who knows,
maybe we'll be seeing more of you in a more
expanded capacity here in just a few years.

Speaker 2 (07:15):
Here, Ga, thank you. Pleasure to be with you as always.
