Speaker 1 (00:00):
Obviously one of the big stories in our areas. What
took place? I guess this was back in June when
the shooting took place, or was it June twenty third.
This young man was shot by police Homewood in the
parking lot over there at the soccer fields. Was going
to rest him for a drug thing, marijuana or something.
(00:21):
I'm not sure what kind of drugs it was. But
the guy got out of the car. Police officers saw
the gun and then they had a confrontation as they're
talking about all this, and the guy turns around and
goes to get the gun and he gets shot, and
unfortunately the man passed away.
Speaker 2 (00:38):
This went to home with police.
Speaker 1 (00:39):
They gave it to Alah to investigate and can investigate
your own. So Aleah took over and took this case
to look into it and see what's going on. It
lasted a long time, longer than the family wanted as
far as the release of the video. They wanted to
see the body cam video from the police officer on
what took place, you know. For the family. Well, they
finally did get it. And while l' cavan joined just
(01:00):
now state representative who is also an attorney here in
town on this case.
Speaker 2 (01:06):
Want good to see.
Speaker 3 (01:07):
Them, always blessed. I'm glad to be here.
Speaker 2 (01:09):
It's been a minute.
Speaker 3 (01:10):
It's been a minute. You've been on vacation.
Speaker 4 (01:12):
Come back an extra little dark, little tanned look here.
Speaker 3 (01:16):
That's just a little look.
Speaker 1 (01:18):
Okay. But this case interesting from the beginning in that
there were some different statements made. You know, the family
and the attorneys came out real quick and said there
was no gun. How do you make statement like that
if you haven't seen the video. I mean, they got
kind of out there on that.
Speaker 4 (01:37):
Well, first of all, always let me start off condolences
to the family. Regardless of what A child has been killed,
and that's somebody's baby. If I always said, and if
you would allow me to hear the mother, a voice
of a mother saying that's my child, that's my baby.
So my heart goes out to them. The statement never
should have been made that there was no gun. The
(02:00):
statement I stand by my position that it never should
have been released in the beginning because there were ongoing
efforts to get the body cam footage released, and Alia
would have released the bodycam footage based upon those discussions.
That's just factual. I've been working on this every day
since it started. But with regards to where I think
(02:20):
we should be, and I please allow me jt this.
We should be trying to teach people, and especially if
there is a situation in which black people are killed
at a more rapid rate by law enforcement, what to
do when you at a traffic stop, what to do
when the police approaches, how to handle yourself if you
(02:43):
have a gun, just stop. Attorney Danny Carr always says
he and our own panels, you can't win at the
traffic stop.
Speaker 1 (02:50):
I've told my kids that forever you get pulled over,
you yes, sir, your butt all the way to jail.
Speaker 3 (02:56):
And now I'm guilty of it.
Speaker 4 (02:58):
For years, and I finally got to a point because
I would get so mad and I would find myself
in the moment, in the moment, but I had to
also realize, looking at what is going on or what
was going on across the country, that I needed to
maybe focus in on a different type of tone, ten
or demeanor. And as you said, give the driver's license over,
(03:20):
take the charge and deal with it. As Danny Carr
always says to the public in the courthouse, you can't
win at the traffic stop, you can't win. At the
point that the law enforcement officers say stop, you cannot win.
Speaker 1 (03:34):
Amen, Amen, and full disclosure. The officer was a black man.
Danny Carr is a black man. Race is not a
thing in this. I don't believe the situation is what
it is. There was a gun, and then the discussion
broke out what the witnesses have to say and what
(03:54):
about the gun being stolen? And were they trying to
track that down? And that's why that's why I took
longer to release.
Speaker 4 (04:02):
No, there's no one at Aliyah that has taken that
video to take time to alter the video. The body camp,
the dash cam I don't think was on initially is
my understanding, but I definitely do know that the bodycam
was on at the time that the he the officer
(04:24):
approached mister Peeple's The problem with all of this starts
really with the witness, because the witness should have told
the truth in the beginning. The witness should have said
and acknowledged that there was a gun number one, but
the witness lie. So when you get to a point
then you have someone that releases a statement that there
(04:48):
there's the witness who said this. They have done an
investigation for which they had not done yet. They had
not done an autopsy nor a second autopsy. But you
issue a statement and you identify or you stay within
that someone was killed from a shot from the back
of this instance, mister People's there was a witness account
and he did not have a gun. Well, that starts
(05:11):
everything back over because they are Aliah isn't an independent
investigatory team.
Speaker 3 (05:17):
Now, could Homewood have released the tape?
Speaker 4 (05:19):
Absolutely, And my best thought on.
Speaker 3 (05:24):
This, I felt they should have released it.
Speaker 4 (05:26):
I felt if it was a clean shot at that point,
they should have just released it. But I think even
if they had released it, you were gonna still have
these conspiracy theory.
Speaker 2 (05:33):
Not obligated by law to do that. Well, and Aliah
taken over the cases standard operating.
Speaker 4 (05:39):
Well clear on this because folks have been making this
argument about whether or not are they by law there
is a legislation that gets them to a process for
which Danny Carr appreciated me yesterday he called me in
he stated just that, and he went on several shows,
but what he did he tried to stay stay away
(06:00):
from that. But the realization is we had nothing on
the books to even start a process. He really could
have made a decision not to show the bodycam yesterday.
But most district attorneys now, because of that law, once
the tape comes back to them, they're bringing back ninety
something percent of people now in this state are seeing
body cams.
Speaker 3 (06:20):
That's why you're not hearing about it as much.
Speaker 2 (06:23):
Yeah, well, I agree that they should be shown, but
there is some.
Speaker 4 (06:27):
Point United there is a Supreme Court rather ruling that
pending an investigation, if the custodian does not want or
chooses at that time not to show it, they don't
have to. So whether that was written in the bill
or not, it's still the law of the lands.
Speaker 1 (06:43):
See, I think bodycam should be shown. The period now
when is you know, no one's.
Speaker 4 (06:49):
Going to show you bodycam in this country day one.
What we are typically seeing when we have these nationally
send in syndicated but nationally sensationalized cases. Many times when
we see those body cams, the individuals in Bob, the victims,
their families have probably requested it, probably two weeks prior
(07:12):
to we're not seeing body camp with day one.
Speaker 3 (07:15):
So even this case right here, even if it.
Speaker 4 (07:17):
Could be released, unless Homewood just had decided to do
it on their own, it probably still would have been
at least a bare minimum of two maybe three weeks.
Speaker 2 (07:28):
And they can be very inflammatory. No matter what's on
the body.
Speaker 3 (07:31):
It could actually hurt. Yes, it hurts you.
Speaker 4 (07:34):
And that's another thing that we took into consideration because
we want to make sure that everybody gets a fair
shot with the jury.
Speaker 1 (07:41):
And also, you show a dad bodycam day one as
it happened, and this happened to New York. Somebody robbed
a store in New York and killed somebody. The dad
wanted to see it, and ex thing. Now he saw it,
he went out and killed the first.
Speaker 3 (07:58):
He went on.
Speaker 4 (07:58):
And that's another reason why that's why no one releases
bodycam in that instance, because you have to take into consideration,
just as we did in the legislature, who's in that video.
Speaker 3 (08:09):
We have to make sure that there are no.
Speaker 4 (08:11):
Witnesses, that there could be some type of repercussions or
someone would come to, you know, take seek vengeance on them.
And so those are the things you have to think about.
So a lot of folks make this argument, oh, I
want no, you need to be careful. We have a
person right now in the County Jail that is allegedly
has allegedly last year killed over twenty people here in
(08:32):
the city of Birmingham. Why because they could have been
witnesses in many instances. So imagine had that young man,
mister McDaniels been able to go and get body cam
JT and kill and take you know, revenge on anyone,
you know, be's of his gilty.
Speaker 2 (08:47):
There's reasons for going through the process.
Speaker 3 (08:49):
If exactly we should be teaching people.
Speaker 4 (08:52):
I say this every day, teach people what to do
at this traffic stop. Teach people what to do when
the police stop you. You have cops, you have good cops.
But we want to save our young men and women's lives.
That was a very unfortunate situation that happened to mster people's.
Speaker 3 (09:09):
But I also.
Speaker 4 (09:10):
Feel that in this instance we should pray for the family,
We should pray for law enforcement, but we should come
up with a solution so it doesn't happen again.
Speaker 1 (09:20):
All he had to say was, you know the word
comply and then you know, you get you get arrested
for some marijuana or illegal possession of a gun. You
know that's better and risking pulling a gun. I mean,
I don't know what runs through people's minds that think
they can either negotiate their way out of anything or
beat the police and run and get away.
Speaker 3 (09:39):
You just let me say this one last thing.
Speaker 4 (09:41):
I represented a family in Tuscaloosa, lat Well, coming into
yes last year situation where a young man, mister Trisian
Clark was shot. Beautiful family. He was in the back
of a car. He had a gun. However it was
in his chucked in, chucked in. I don't think that
anyone really thought or I know, I didn't appear that
(10:04):
he was going to try to but he touched the gun.
And the law is very clear about if you have
a gun and in the midst of in police whatever,
if you touch that gun, if you move, they.
Speaker 3 (10:20):
Have the right to shoot you.
Speaker 4 (10:22):
And that is what we need to be discussing, and
that is why the gun became an issue. I'm not
the try of fact, but what I am here to
say is that we should pray, we should work together,
and we should come up with a solution. If there
is something in a civil court that this family can recover,
then they'll work with it.
Speaker 1 (10:42):
And it starts in the home and that parents, you
got it stress once again, you started this out. I
want to say to look during the stop is not
the time to argue because it's not going to go
your way. No cop is going to say, oh, all right,
Well I believe you're right?
Speaker 3 (11:01):
Is Danny Carr?
Speaker 4 (11:03):
Since yesterday threats a call to boycott his business. He
owns a club in lake View, very vera well established
UH event club. His credibility has been called into UH
to play.
Speaker 2 (11:19):
That's horrible.
Speaker 3 (11:20):
Danny Carr lost.
Speaker 4 (11:21):
His brother, Yes to a brutal, brutal killing a few
years ago where his brother was robbed, beaten, he was maimed.
He was also decapitated in many areas of his body
by three.
Speaker 3 (11:34):
Young people who were his friends.
Speaker 4 (11:36):
So he knows, not just as a district attorney, he knows.
Speaker 2 (11:41):
Danny Carr is a stand up guy.
Speaker 1 (11:42):
And he came to the conclusion with this was a
clean shoot and cases over so well.
Speaker 2 (11:47):
I appreciate you coming and always.
Speaker 3 (11:49):
Got a conversation. Thank you, thank you,
