Ken Belkin joins us now our buddy attorney in New
York City on a couple of things. And before we
jump into the Menendez brothers, ken I got to get
an update for him on what's happening with Mandani, the
crazy socialist mayoral Canada up there, and anything else going on.
As this race is is heating up, and I think
the whole nation is shocked by the fact that this
guy is leading so well.

Speaker 2 (00:21):
Yeah, I mean, it's not looking good.

Speaker 3 (00:23):
And the Democratic vote is so splintered between Cuomo and Adams,
you know, the incumbent running as an independent, so it's
looking very likely he's gonna, you know, get in there
and occupy Gracie Mansion. But you know, it's a debate
even in my household. Who do you vote for in
this situation? Do you vote for the Republican Curtis Sliwa,

who wears a red beret. I mean, he's kind of
a joke, but you know, surely he'd be a better
mayor than Mamdami for sure. Or do you vote with Cuomo,
the disgraced ex governor, or you know, the incumbent mayor
Eric Adams, who has been tarnished by what I would
call a politically motivated prosecution under the Biden Department of Justice.

Speaker 2 (01:07):
Right, So, I really don't know what to say.

Speaker 3 (01:09):
I mean, it's going to be the hardest vote I've
ever had to cast in my life.

Speaker 1 (01:13):
Do most New Yorkers feel that way? Like this is
the best we got here in the number one city
in America? These are the choices? I mean, this is
kind of.

Speaker 2 (01:22):
Well, look, we've got a problem here.

Speaker 3 (01:23):
We've got a closed primary system, so you can't vote
in a primary unless you're a registered member of a party,
and that really allows for you know, kind of anti
democratic forces to manipulate our elections. We also have done
this social experiment in New York, something called ranked choice voting,

(01:44):
So instead of one person for one vote, it's like
a scheme where you rank your top five and then
they put it all together. I mean it really it
sounds like a way to undo the actual process of
an election.

Speaker 2 (01:57):
Yeah.

Speaker 1 (01:57):
Yeah, well, I got to tell you, unless something's change,
it does seem like the momentum is in this socialist
Mundanie's corner right now. And if that happens, I mean,
you think people are leaving New York now to go
to Florida and other places and get out of there.
I think it's going to really ramp up with the
exodus of New York City.

Speaker 2 (02:15):
Yeah, I mean just.

Speaker 3 (02:18):
And I said this to someone recently, not to cut
you off, JT. You know, anybody you can who has
the ability to leave New York City and state is
doing it. It's only the people that either cannot afford
to leave, or you know, are tied here for some
other reason. There are lots of reasons why you could
be tied to the place you live in and not

be able to move. But anyone who is capable of
getting out is getting out.

Speaker 2 (02:43):
That is a fact. Well, I mean I'm tied here.

Speaker 3 (02:45):
I have a law license, so I'm tied to the
state of New York.

Speaker 1 (02:48):
Well you can always get one in you know, sunny
Florida or you know, conservative Alabama.

Speaker 2 (02:53):
Now come on, all.

Speaker 3 (02:55):
Right, I listen, Alabama might happen Florida.

Speaker 2 (02:58):
They're going to make me take another bar. There you go.

Speaker 1 (03:01):
All right, let's talk about the Menendez brothers. I was
a little shocked that they didn't get more consideration for parole.
They were denied, both of them, see us. So I
guess the next opportunity could come as early as eighteen
months from now. But what are your thoughts on that
denial for these guys and what happened in the process
that took it down that path.

Speaker 3 (03:21):
You know, I'm gonna preface this by saying I'm a
criminal defense attorney, so I believe in second chances. But
I also recognize the reality that there are crimes that
one can commit that are so horrific that they forfeit their.

Speaker 2 (03:34):
Right to live free.

Speaker 3 (03:36):
And I think the Menendez brothers committed such a crime.
They brutally shotgun murdered their parents, and have you know,
they really haven't get paroled. You have to show that
you have accepted responsibility for your actions and that you
demonstrate remorse. I don't see that even in their prison photos,

(03:56):
these guys are smiling. I've looked at a lot of
prison photos mugshots in my day, probably thousands.

Speaker 2 (04:02):
Most people are not smiling in them.

Speaker 3 (04:04):
Most people are very morose and upset by the situation.

Speaker 2 (04:09):
They're smiling and look Having.

Speaker 3 (04:11):
A hit in Netflix series is not a criteria for
being released early from prison. And I'm sorry to say
that to my wife, my mother in law, and my
cousins who are at my place this weekend for my
daughter's third birthday, who all think these lovely Menendez brothers
deserve a second chance, But they really don't.

Speaker 2 (04:28):
They've committed one of the.

Speaker 3 (04:29):
Most heinous crimes you commit, murdering the people that brought
you into this world, and by the way, brought them
up in quite the luxurious lifestyle. And look, the reality is, oh,
they've made up these excuses. Maybe they were molested, all right,
maybe they were molested, but you know what, not everyone
that's molested brutally shoots in the face the person who

committed the crime against them. And by the way, the
parents are not around even to defend themselves against these allegations,
which have not been proven anywhere.

Speaker 2 (05:00):
And we're to rely on.

Speaker 3 (05:01):
These two Menendez brothers who murdered their parents that they're
telling the truth.

Speaker 2 (05:06):
I don't know.

Speaker 3 (05:06):
They didn't seem so so crestfallen in the wake of
their parents' death.

Speaker 2 (05:11):
They went out and bought Porsches and Rolexes. I don't know.
Maybe they just needed some retail therapy to get over.

Speaker 1 (05:16):
It, right, right, So well, I mean, the other side
of this is they've spent thirty five years in there
already there were the allegations and I think you know
others that were molested by this guy. Mom backed dad
up in this whole thing. So you know, everybody says, well,
maybe did that happen or is that just all fabricated
by these two brothers that decided to put that together
as the reasoning and their defense and this thing. So yeah,

(05:40):
eighteen months they get another. Look, that's pretty quick to
come around for a second chance on another parole, isn't it.

Speaker 2 (05:45):
Yeah.

Speaker 3 (05:46):
I mean, look, most people are not given parole for
their first go at that, so that's not an uncommon
result here.

Speaker 2 (05:55):
But look, they have the right to go back before the.

Speaker 3 (05:58):
Parole board and as soon as eighteen months and I
think every three years thereafter, they have the right to,
and they should, you know, absolutely pursue it their freedom,
but they've got to demonstrate remorse. They've got to show
acceptance of responsibility and making up excuses for why you
committed One of the most heinous crimes one can commit

is not accepting responsibility for your actions.
