shy or eight or six or fiftyfive KRC the talk station. Happy Tuesday
to you. Honor Flight Tuesday.Try to be able at CVG about eight
eight thirty so you're there when theplane lands at nine and for the welcoming

(00:22):
committee for the Honor flight. Anamazing opportunity for patriotism. You're gonna love
being there. And I always lookforward to this time of the week because
we get the insights scoop with BreitbartNews Today the return of Washington beer chief
Matt Boyle from Breitbart Book Market. You should you'd be glad you did.
Br E I t B A RTdot com. Matt Boyle, welcome back
to the Morning Show. It's goodtalking with you today. It's allays is

(00:43):
Yeah. Great to be here asalways, and a real riveting day yesterday,
first day of Donald Trump's nonsensical prosecutionin New York. It's var deer
and I was just I had ourlegal expert. We've got a local guy
named Steve Gooden who provides legal analysisand you know, being a litigation attorney
by by two raide in my priorjob. Warder is boring, And the

(01:03):
big headlines across the mainstream media was, oh, my god, Donald Trump
fell asleep and Steve admitted he said, at the risk of admitting to malpractice
that even he has fallen asleep orknotted off during wardear. It's boring as
hell. Yeah, I mean, look, they're going through trying to find
jurors, right, They couldn't evenfind one yesterday, right. They take
fifty people out of the pool basedoff the reports that we've seen. I

(01:29):
wasn't in the court room obviously, but but the point is that, you
know, they kicked out fifty differentpeople, and they're they're just trying to
identify who the who could be apossible juror. Apparently there's only three people
from their pool that they had yesterdayleft that they're even possibly still considering that
they might may or may not beon the jury in the end. But

(01:52):
Wardier is just a jury selection, right, So they're going through this pool
of and this is going to takeweeks, by the way, so the
trial really hasn't even started yet, right, right, So like, yes,
technically this is the beginning of thetrial, because this is a you
know, it's not in pre trialmotions anymore. What ere is the beginning
of the trial. But what ereis they're they're they're selecting jurors. So

(02:14):
it's it's a very boring process.No, you're exactly right. That being
said, you know, they didn'teven find a jury yesterday, right like,
so you know, I mean it. Look what they're trying to do
here, Judge Merchan uh and uhyou know Alvin Bragg, the district attorney
there in Manhattan. What they're tryingto do is they're trying to tie Donald

(02:36):
Trump up. They don't want DonaldTrump in Michigan. They don't want Donald
Trump in Pennsylvania. They don't wantDonald Trump in Wisconsin or Virginia or any
battlegrounds in Nevada, Arizona, andGeorgia. Where they want Donald Trump is
stuck in a liberal New York courtroom, right, That's what they want.
That's that's what this is about. They know that their legal case is totally

(02:59):
flawed, they know they have this. They're trying to pre wire the system
to get a predesired outcome, whichis they're going to get a convention,
right, like they're going to picka bunch of liberal jurors. It's pre
wired, it's predetermined. I talkedto Senator Tim Scott last night, who's
being considered for uh, you know, obviously vice President will see you know,

(03:21):
as Trump makes his determinations on thatfront. He says that it's a
prejudiced process, right, So hesays it's prejudiced against Trump. And you
know, Senator Tim Scott, beinga black man, would understand that,
right like, uh uh, he'sarguing that the black community is moving more
and more in Trump's direction because they'rethey understand this, right like deeply.

(03:42):
So that's why you're seeing big numbers, especially among young black men. But
the but the fact is that whatthey want is they want Donald Trump locked
up in a courtroom, right like, for as long as they can.
They don't want him being out there, being able to campaign. They know
that they're they're going to pre wireit to get their convention. They know
that it's going to get overturned onappeal, right, so they're going to

(04:03):
get their headline that they can sayDonald Trump convicted of a felony, right
Like, that's what they want, right, Like they want to say that
jury convicts Donald Trump with felony andthen they hope that that'll that'll end him.
It won't end him because on appealthis will be overturned. Like this
is a very very weak legal case. They they they what they did is

(04:26):
they elevated what would normally be amisdemeanor charge to a felony because the statute
of limitations that already passed passed ona misdemeanor charge falsifying business falsifying business records
is the misdemeanor. So he hasto charge felonies in order to overcome the
misdemeanor statute limitations, which means theyneed to show that he actually committed a

(04:49):
felony when these books were so calledcooked with the intent to commit another crime
or to aid or conceal the commissionthereof. So they have to shoot the
other crime, so to speak, right like that. That is something that
the federal government, the Justice Departmentthat's currently prosecuting Trump, by the way,

(05:13):
on two separate other cases, decidedthat Trump wasn't worth chargers right out
on this. So the point isis that the entire legal theory that Alvin
Bragg is put forward is totally weak, and it's going to get overturned on
appeal even if they stack that Jerrywith liberals because it springs from that.

(05:33):
The the the the payment dis StormyDaniel Daniels was effectvely a donation to Trump's
campaign in excess to federal limits. That would be your felony crime. So
the but I was talking to Steveprior to the year, you're coming on
to to Steve Gooden about this orlegal expert. You know, Donald Trump
is a businessman, a prominent figure. If he wasn't a presidential candidate,

(05:55):
if he was just an executive withsome major corporation like pick a Microsoft or
an Apple who wanted to conceal analleged affair, it will be totally legal
for them to do that. Itwouldn't involve campaign contributions. It would be
perfectly acceptable business expense. You areallowed to pay to buy off or prevent
a story from being It's an armslengths, you know, transaction between somebody

(06:15):
with the information. Don't say anything, here's your money, and you walk
away. That's okay. And hehas that argument. He is a public
figure, he is a business mogulindependent of his being a presidential candidate.
These claims are this money that waspaid could have every bit to do with
him not wanting his wife or hischildren or anybody else to find out about
it. That's an equally plausible reason, right And by the way, apparently

(06:39):
this was a pretty normal practice rightabout the business community for a long time,
and I wouldn't be surprised. I'mnot saying that it's like normal with
Trump, like, but I thinkthat it kind of was, right like.
So I don't know, right like, I've not really talked to him
about this, but like again, this call, it's called like a catch
and capture type of thing. Like, so business leaders do this all the

(07:01):
time, are used to. Idon't know if they still do, right
these days things are a little bitdifferent. But remember Trump's the business guy
from the seventies and eighties, rightlike, and so that's that's kind of
his thing, right like. Andso this was a pretty normal practice.
So I don't know, you know, I don't think he was ever approaching
things through the lens of a politicalthing. And honestly, at that point

(07:23):
in time, during this time inthe campaign in twenty sixteen, the only
person there's only a few people inthe in the political world that thought Donald
Trump was gonna win the election, right. The Democrats thought they had it
in the bag. Right Remember,Hillary Clinton thought Augurt October twenty sixteen that
this election was you know, longover, and that she was going to

(07:45):
be the next president of the UnitedStates and waltson in the White House.
So the I don't even know ifTrump thought he was going to win the
election at that point, right,Like, things were dark, right like.
And so you know, you hadthe Access Hollywood tape that had come
out. That was a big thingthey were arguing about yesterday too. Apparently
they're not going to be allowed toshow it, but they will be allowed
to summarize it or something, sowhatever. But the point is that none

(08:09):
of this is about actual justice, right Like, they are going to lose
this case on appeal, right,So the question is is whether or not.
And that's why this was their processis actually kind of important because if
they can stack the journey with enoughprejudice leftists, right like, you know,
people that dislike Donald Trump, they'regonna be able to get their headline
and their conviction, uh and andand and you know, rate the system

(08:33):
against him, so that way theycan say, and you know, because
what they want is the headline inthe New York Times that says Donald Trump
convicted of felony. Right, that'swhat they want, even though they know
it will get over turned on appeal. Like there's no universe factually speaking here
where this will be upheld. Right, this case will be thrown out.

(08:56):
The question is is when and howthe you know, a jury could do
it or it will happen on appeal, but there's no way that this will
ever hold up in the end.The question is is will the process you
know, you know, play outthat long or not? And by the
way, everyone in that room knowsthat. Bert Merchan knows that. The

(09:18):
judge Alvin Bragg knows that that, you know, every one of the lawyers
at every one of the tables knowsthat. And that's why President Trump is
out there bashing the process. Heknows that this is a sham, and
he's allowed to bash the process. He's just gagged from saying anything about any
of the witnesses, which you know, all of them are public figures.

(09:39):
Again going back to Steve Gooden, just to point out and then put an
exclamation point on it, all thesefolks are considered public figures. You're allowed
to talk about public figures in afar more broadway in public commentary than you
are about a private citizen. SoStormy Daniels is well known to everybody,
and she's obviously a public figure,as are so many others, including Michael

(10:00):
Hohen who's been on you know, outlets and everywhere bashing Trump now for a
long time. So, but DonaldTrump has prevented his First Amendment rights.
And this is a critical campaign issuehere too. I mean, this impacts
the presidential campaign and what people aresaying about Donald Trump as he advised to
get the nomination. Donald Trump's prohibitedfrom responding to these attacks or these comments,

(10:20):
right, And even though Alvin Braggknows that this case will not hold
up in the end, but youknow, again, it's a question of
when it gets blown up, notif it gets blown up, and at
what point in the process. Andeven though Judge Merchon understands that as well,
what they're doing is they're using thiscourtroom process, this whole courtroom Shenanigan

(10:43):
kangaroo court, to hamstring the speechof a presidential candidate, the leading you
know, the actual nominee now.I mean he's the Trump is now the
presumptive nominee for the Republican Party ofuh, they want to limit his ability
to speak publicly. This is extremelydangerous. In fact, this is election

(11:07):
interference. There's no doubt about that. It is. I think they've got
to do something. I mean,we've got to when Donald Trump wins this
election, which I'm pretty confident thathe will, I think we've got to
do something to prevent this from everhappening again, because we're on this really
dangerous slippery slope here in America wherewe're you know, headed towards the Banana

(11:33):
Republic stage. And if we don'tget this under control so that they can't
do this, it's just extremely dangerous. What's happening here. Well, it's
unprecedented, it is, and youknow, represents a threat to really anybody.
I mean, you may take yourselfout of the equation. Well it's
Donald Trump, and you know heobviously he's a magnet for attention, and

(11:54):
of course, being a presidential Canada'regoing after him. But if this was
just some regular Joe and I liketo point this out all the time,
having been a litigation attorney for somany years. It's damn expensive to hire
a lawyer to defend yourself. Anyregular persons, like many of the January
sixth folks have been prosecuted, justdon't have the resources to defend themselves and
ultimately either have to cop a pleaand take some lesser included defense or agree

(12:16):
to some sentence that the otherwise wouldhave been able to defend themselves over.
I mean, at least he's gotthe resources to hire the lawyers to make
arguments on his behalf. Yeah, and he's fighting for us because, by
the way, they could do thisto anyone, yeah, right like,
And that's why I think that thisargument that Senator Scott was making, and
it was our lead story on noton Brightbart, but it's not anymore.

(12:39):
But it's up there now. Youcan go up to Brightbart ge it.
We've got the interview with Senator Scottwhere he's making the case that the black
community is moving to Trump because ofthis because they get it right like,
they went through this. They can'tafford lawyers when the you know, the
police come after them and accuse himof something maybe they didn't do, right
like, And so this is aserious I think what Trump should do.

(13:01):
He should spend every one of thesedays. So okay, he's gonna spend
all day in court. He shouldgo every night to a different community in
New York City and do a campaignevent. Right, So he should go
to Harlem. He should go toBlack Church and Harlem, right like he
should go to Madison Square Garden andthrough all a rally. He should go
to Hispanic communities. He should goall over the city and just campaign and

(13:24):
screw it up. I think thatyou know, I've seen polling in general
election in New York that Trump wasain single digits behind Boe Biden. This
is New York, which is adeeply state. I think if Donald Trump
can cut his lead down in NewYork City, I mean, I don't
think Donald Trump would ever win NewYork City because it's very liberal. But
the point is that Donald Trump shouldspend another evening every every time this trial

(13:50):
is going on, doing more campaignevents. And when as soon as the
polls come out showing Donald Trump winningNew York as the goddamn trial and they'll
say they'll let him go back toMichigan in Wiscon. I hope one of
the Trump campaign folks is listening becausethat sounds like an outstanding suggestion. Matt
Boyle, Breitbart Washington Bureau Chief,It's always a pleasure speaking with you on

five KRC detalk station Daniel Davis deepdive bottom of the hour, What is
