Speaker 2 (00:07):
You didn't need advice, Well you don't have.
Speaker 3 (00:12):
Come running just as fast as we can.
Speaker 2 (00:16):
Shoot's gonna help.
Speaker 4 (00:18):
Com Ma Dix's The Troubleshooter Show.
Speaker 1 (00:22):
Now, Tom Martinez, Hey, welcome to twenty twenty six. Holy crap.
I thought by now we'd be on hovercrafts. According to
the World's Fair, we were all gonna have hovercrafts where
we're all over the place in personal flying machines, and
(00:43):
we lived in saucer types buildings like on the Jetsons,
and then we had personal robots. Well, some of this
is coming true. Welcome. You know, I gotta say, get
it out of the way. What a difference in year
makes Last year when I opened the show, I had
cancer and spent most of twenty twenty five fighting it.
(01:04):
And by the grace of God and strength and help
and prayers, they say I beat it, you know, I mean,
you know, they don't like saying beat cured. They like
saying remission. But I am cancer free. Welcome, and I
have Major Mark Major back at the studio. Let me
bring him up also on our streaming platform, where you
can also see his pretty face, Mark Mark. You're so,
(01:30):
what is on your mind todayl I love it.
Speaker 5 (01:33):
We're going to be producing oil there very shortly. We're
going to run that country. Hopefully it becomes a territory,
and I hope the Colombians are watching their asses and
quit shipping cocaine to our wonderful country.
Speaker 1 (01:52):
So you buy the argument? Now, do you think it
was oil or no? No, no, I'm asking if you
buy the argument that it was done to stop the
illegal trafficking of drugs or was it done to get oil? Well,
it was done for all the above.
Speaker 5 (02:05):
Let's not forget Chevron owned all that stuff and what
happened years ago.
Speaker 1 (02:10):
They decided screw it.
Speaker 5 (02:11):
We're kicking the US and all those companies out, and
we're stealing all this equipment.
Speaker 1 (02:16):
That's our equipment. Yeah, well, okay, let's go to the phones.
What do you say we take ed Eduardo, who is
the first call of twenty twenty six. He has an
issue and we've had this on the show before. Appliance
Factory outlet. What's happening at DWARDO. I bet it's a
(02:38):
warranty issue. Let's find out what's going on, sir.
Speaker 6 (02:42):
What kind of warrant to show? I bought an open
box and they delivered it and then some I heard
loud noise go and we're vibrating my house, kicking a
house and everything else.
Speaker 7 (02:57):
I tell him that.
Speaker 1 (03:00):
What was it that? You what? What kind of an
appliance was it?
Speaker 6 (03:02):
Again, it's to bring you a LG. It's all in
one's watching combo.
Speaker 1 (03:11):
Okay, got it? And yeah, that's really so anyway you
understand And Mark explain how they work at Appliance Factory Outlet.
Speaker 5 (03:20):
Well, a lot of the times, I'm not sure about
your particular one, but most of their open box stuff
there is absolutely zero manufacturer's warranty. The warranty is provided
by Appliance Factory Outlet.
Speaker 1 (03:33):
And why is that, Mark? Are they scratching dent or
what are they Why?
Speaker 5 (03:37):
It could be a builder like Leonard that bought five
hundred ovens and for whatever reason didn't pick them all,
but but they got delivered and sent back, so they
it's a second sale.
Speaker 1 (03:49):
So you're buying technically a used appliance.
Speaker 5 (03:55):
Well, yeah, well it isn't. It isn't because it's open boxed.
I guess to the manufacturer a lot of time it's used.
But the bottom line is they still do give you
a warranty most.
Speaker 1 (04:06):
Of the time, right, So in your case at Eduardo,
what is wrong?
Speaker 6 (04:13):
Oh, it came damaged, So I mean there's a broken
and even set on top of it. Damage on delivery.
But that gets from now from the last people they
had it or something, right, but they saw it to
me as an open box, not as a damage unit.
And LG still came out and looked at it. I
(04:35):
have six technicians.
Speaker 1 (04:36):
What is LG. Well, first of all, you're tongue. What
do you mean by damage? Damage on the outside doesn't
necessarily mean damage on the inside. So what do you
mean by damage?
Speaker 8 (04:47):
Well, they someone had written DA on top.
Speaker 6 (04:51):
When the last technician came, he pointed it out.
Speaker 1 (04:54):
It says DA.
Speaker 8 (04:54):
I go, what does that mean?
Speaker 6 (04:55):
He goes, damage on delivery?
Speaker 1 (04:57):
So, but what's wrong with it? Does it operate? Yeah,
nflg's not fixing it.
Speaker 5 (05:04):
What does appliance factory say?
Speaker 6 (05:09):
Well, they're gonna give me my money back, and they're
oh good, Well that's great, but yeah, but vibrating my vibrating,
my health, my walls, I'm crashed in an area.
Speaker 1 (05:20):
You're you're not gonna you're not gonna get that covered?
Speaker 9 (05:22):
Wait?
Speaker 1 (05:23):
Wait, wait, how does it.
Speaker 5 (05:24):
I don't understand how that's even possibly cracked your wall.
Speaker 6 (05:28):
Yeah, the vibration because they had a broken shock.
Speaker 1 (05:32):
Yeah. But but Eduardo, if you're getting your money back
for the appliance, that's great.
Speaker 5 (05:38):
You know, I want I kind of disagree with you there, Tom.
If it's true he plugs it, what was it a dryer?
Speaker 1 (05:43):
What did he say? Wash your dryer combo?
Speaker 5 (05:46):
So you plug it in and it vibrates so hard
it hits and literally cracks the wall.
Speaker 1 (05:51):
He's not gonna get covered. I think that's small claims
all day long. Well, it could be small coach is
going to say no to that if he's got actual Yeah,
but it could be. It could have been such a
I just think that getting those consequential damages are really
(06:11):
is really difficult. I think Marcus saying, if you're a
bard in their ass, if you if you go after
him in small claims court, they may say, let's just
pay it, But I mean, let's just get right to it.
At Eduardo, how much damage? How much damage are you
claiming it did? How much money are we talking about
to get the damage fixed?
Speaker 6 (06:34):
A couple of hundred?
Speaker 1 (06:38):
How much at Toardo? How much I mean it all
comes down to that.
Speaker 6 (06:41):
Now, I don't paint, I don't f it's cracks.
Speaker 8 (06:44):
I don't know the damage could costs.
Speaker 6 (06:46):
That's a big crafts in the wall.
Speaker 1 (06:48):
But could you send us a picture of these cracks?
Speaker 10 (06:51):
Man?
Speaker 8 (06:52):
Yeah?
Speaker 6 (06:52):
But it took six technicians. I called from the beginning.
I go, there's something wrong with it, and they go.
They kept sending technicians out. Nobody would open the back
to the last one. The last one opened the back yeah, yeah,
as a broken shock and she started to smell like
smoke or burn something. So I hadn't been able to
use it. I mean I've been not Wait.
Speaker 1 (07:15):
I get it, I get it, But I mean it
all boils down to this. You bought a defective appliance.
You're getting your money back. The question is do they
owe you for additional damage. My guess is they don't
because there's so many factors that could be. It could
be your house is old, it could be that that
it wasn't set up properly. It could be a leveling problem.
(07:35):
I'm not saying, Eduardo, we don't want to help you
get it. I'm not saying that. I'm just saying that
there are so many variables in this thing that it's
it's not going to be a walk in the park
to try to get them to pay for a damaged
wall from a used open box appliance. I just and
I'd be interested in your original paperwork if it references
(07:56):
every anything at all about as is or whatever? Did
you you first of all, did you know when you
bought it that you may not have a factory warranty?
Did you know that? No?
Speaker 11 (08:07):
I didn't know that.
Speaker 6 (08:08):
Any ansatisfy that I thought I had a warranty.
Speaker 1 (08:10):
Well, it sounds like he did. It sounds like LG
is honoring their warranty.
Speaker 12 (08:15):
Righty, LG.
Speaker 6 (08:17):
The tanation came out yeah and said, hey.
Speaker 1 (08:19):
Good, so will LG. Would LG replace that appliance or
are they just going to read who's refunding your money?
Appliance Factory outlet.
Speaker 6 (08:29):
Applying factory outlet? But LG said that it's not repairable.
Speaker 1 (08:34):
Okay, now did a factory appliance?
Speaker 13 (08:37):
Did?
Speaker 1 (08:38):
Did you ask appliance factory outlet if they would pay
for your damaged wall?
Speaker 6 (08:45):
I just did today because they said, I said, when
am I getting my money back? And it goes we
pick the machine, will you'll get credited that day. It
didn't make sense. They know that the machines, we just
don't send me my money and pick up the machine
later because I can't find another unit to that that
So that's space come open, right.
Speaker 14 (09:09):
So Edward, when are they gonna When do they plan
to come over and pick up the voice?
Speaker 15 (09:13):
You hear?
Speaker 13 (09:13):
Go ahead?
Speaker 1 (09:14):
Thank you?
Speaker 14 (09:14):
Tom When when did they plan to come over to
pick up the defective equipment?
Speaker 6 (09:19):
Tomorrow?
Speaker 1 (09:20):
Oh, so you'll get your money back tomorrow.
Speaker 5 (09:23):
That's the first step. Let's get that done first. Well,
that's that's going to happen. I think you just serve them, man,
I mean, you take them to small claims court.
Speaker 1 (09:31):
It's mark. Would you sue? Would you sue LG Or
would you sue appliants? Factory?
Speaker 5 (09:36):
Out the clients factory? They're the ones that sold it.
It was damaged. It's evident it was damaged. Make sure
you take a picture of the box that says DA.
It would be nice if you had one of the
technicians or something in writing saying it was damaged with
the bad shock and there's all your evidence along with
your pictures. I mean to me, it's a no brainer.
If I buy a brand new car and I park
(09:56):
in my garage.
Speaker 1 (09:57):
It wasn't in an open box. It wasn't it was
an open box. It's brand new to him from factory.
Speaker 14 (10:04):
Eduardo is going to need a little more than that.
He's going to need to have a repair estimate, and
then he's also going to have to somehow show that
there was nothing wrong on his launcher to begin.
Speaker 5 (10:14):
We're not talking about fixing it. What we're talking about
is the shock was broke on it. When he plugged
it in, it hit the wall so hard it broke
the wall.
Speaker 14 (10:23):
Yeah, but my point is if a Eduardo wants to
recover his repair costs, he's going to need a legitimate now.
Speaker 5 (10:29):
Repair cost you mean for the wall, right, I thought
that's what we were talking about.
Speaker 1 (10:33):
Yeah. I think that's one of his other problems is
that he wants to let you have to go. You
have to get an estimate. You call Steve the painter.
Speaker 5 (10:41):
Steve the painter, probably right off the pictures, we'll be
able to give you an estimate of how much to
fix the dry wall and how much to fix or
paint it.
Speaker 1 (10:49):
All Right, So at Duardo, you know, if you need
help logistically to file that small claim. We'll have a
deputy d call you and tell you what you're gonna
need to go into court.
Speaker 13 (11:03):
You will be illegal, man.
Speaker 1 (11:05):
Yeah, Tom, all I can really do is share with
people what I do. That's what I mean. Yeah, Yeah,
that's what I mean. You're not gonna get legal advice,
but you're gonna give them logistical help. And most of
it can be done online, right except for the service.
He has to have somebody serve.
Speaker 14 (11:19):
Yeah, and with you know, in my experience, the small
claims courts that that I went to actually offer service
by mail.
Speaker 1 (11:25):
That was a really nice service. Good, Okay. Waterpros dot
net the best water systems, the lowest prices. Start out

(12:32):
Martino here, Welcome to the show with Major Mark Major.
We're talking about life, liberty, and the pursuit of happiness.
Anything on your mind, Phil, Welcome to the show. I'm Tom.
What's going on? Phil?
Speaker 13 (12:47):
Hey? Tom?
Speaker 9 (12:47):
How are you?
Speaker 1 (12:48):
Good man? What's going on with you? On twenty twenty?
Go ahead.
Speaker 15 (12:53):
I just wanted to call and say thanks to your program,
and I've a longtime listener, first time calling.
Speaker 1 (13:00):
Yeah, we're going on a lot of years here, man.
What can we do for you?
Speaker 16 (13:04):
Well?
Speaker 15 (13:04):
Nothing, I don't know your station call me and I
just thought maybe I would seek a volunteer opportunity with
you guys.
Speaker 1 (13:12):
Yeah, you would call the station and we weren't. Were
you calling? And then we called you back? As our
promise is we call you back. So were you calling
to find out how to be a deputy?
Speaker 10 (13:23):
Well?
Speaker 15 (13:23):
I think so I might need to be deputized.
Speaker 1 (13:27):
Okay, you know what, we could probably use another deputy,
and we love deputies that have skills in life. What
did you do for your career or your job or
what are you doing? Phil?
Speaker 15 (13:43):
You know I didn't prepare to be on air, but
you know I was a pier partter for thirty three
years and wow, I we'll love serving the public and
you know I'm retired and just look for something to do.
Speaker 1 (13:54):
You know, Phil, you would have a ball doing this.
We would love to talk to you about it. More so,
what we'll do do it off the air. We'll take
your we'll take your information we have but of course
and then uh maybe uh deputies, not deputy but sues.
Our producer will will reach out to or or Mark
or myself. Phil. What's the most interesting thing did you
(14:16):
encounter as a firefighter for that long? Phil? I'm interested?
How what what if you look back on your career,
what is the most interesting thing? You know?
Speaker 15 (14:28):
You know, what's kind of odd is probably the ultimate
team sport for the noblest of causes. I mean, you
go out there, you make these lifelong connections and friendships
that are forged in fire. And the bottom line is
you see things that other people only see on television,
and it gives you a sensitivity in life that other
people will never have. So I'm very grateful and fortunate
(14:49):
to have had that opportunity over there.
Speaker 1 (14:50):
Have you ever had the get dead people out of there?
Speaker 13 (14:53):
Man?
Speaker 1 (14:53):
Have you ever been showed up and people are literally cooked?
Speaker 10 (14:56):
Yeah?
Speaker 15 (14:57):
Have you ever heard the term bloated?
Speaker 8 (14:59):
You know?
Speaker 13 (14:59):
Have you ever heard that?
Speaker 17 (15:00):
Now?
Speaker 1 (15:00):
What does that mean? With fire?
Speaker 15 (15:02):
Decomposed off gas and uh?
Speaker 13 (15:05):
There?
Speaker 15 (15:06):
Trust me, once you go into one of those scenes,
you will never forget that for the rest of your life.
Speaker 1 (15:10):
You know. You know that recent fire on Leadsdale and
Holly of a big giant apartment complex that was nearly completed.
Are you aware of that fire that we had just
a few few days ago television?
Speaker 15 (15:25):
Yeah, I very fortunate didn't turn into a major tragedy
or comfortation did a great job, but it's really just
a surrounded round operation here. I had to do much
put that thing out with interior firefight, that's for sure.
Speaker 1 (15:38):
You know, that's too bad. That was a brand new facility.
It's gonna probably have to be rebuilt from the ground up.
Speaker 15 (15:46):
Without it, they're gonna have to scrape it.
Speaker 1 (15:48):
And how do fires like that just start? That sounds
to me a lot like arson or an accidental fire
from somebody probably squatting or living in there. What do
you think?
Speaker 15 (15:58):
Well, you know, the bottom line is it's very questionable.
I'm sure it's center of severe consideration, But the bottom
line is, for that time of Dave, that rapid fire spread,
something seems a little bit hot.
Speaker 1 (16:10):
Yeah, well, thank you very much for calling. We'll be
in touch with you, Tom guy. What's that both?
Speaker 18 (16:16):
Thank you mention for Phil?
Speaker 1 (16:18):
Oh, go ahead, quickly, go ahead, Phil.
Speaker 19 (16:20):
I've always wanted to know what's the difference between a two,
three and fire?
Speaker 18 (16:24):
Five alarm fire? What does what do those numbers mean?
Speaker 1 (16:28):
Does that mean they call out for help? What does that? Yeah,
that's a good question. One alarm fire, two alarm, you
hear five alarm? What does it mean?
Speaker 15 (16:36):
Well, you know, all departments have mutualate agreements that whatever
you become overwhelmed, the resources become greatly diminished by the operations.
You can call in alternative jurisdictions for help, And when
you get into a multiple alarm of fires like that,
it's the number of apparatuses for the reps.
Speaker 1 (16:51):
Okay, okay, so it's the different department. So if you
have a two alarm fire, your department shows up and
then you call a neighboring for help.
Speaker 15 (17:00):
Yeah, exactly, Okay, aren't warlong?
Speaker 1 (17:04):
All right? Man?
Speaker 13 (17:05):
Thank you?
Speaker 1 (17:05):
Okay, Joe, okay, Man, thank you very much. Happy New Year, Joe.
You have an issue with Comcast? What's going on?
Speaker 13 (17:12):
Joe?
Speaker 15 (17:13):
Yeah, Hi Tom, good morning. Yes, sir, I live in
the neighborhood that's right behind where that apartment fire occurred,
and we haven't had internet since Friday, uh, and just
trying to get some more details from Comcast. Is this say,
fixed in the next day or two or fixed in
(17:34):
the next week or two.
Speaker 5 (17:35):
The people that answer the phone don't have the answers
to those questions. They don't, of course, not unless if
someone's updated it in their system as soon as possible.
Speaker 1 (17:47):
Do you think did it happen as a result of
the fire?
Speaker 13 (17:50):
Oh?
Speaker 15 (17:50):
I'm sure yeah, And they they do say it's damaged equipment.
Speaker 1 (17:58):
It's related, no doubt.
Speaker 15 (18:01):
And if it's a node or something big that's going
to take a while, it'd be nice to know that.
And so I could go get some back up in
the interim.
Speaker 1 (18:10):
But you know what, let's have Deputy Bow. Let's have
Deputy Bow drop a dime over there and see what
he can find out for us. For us, we we
have some people over there. I think we can call
behind the scenes and find out I imagine a lot
of people.
Speaker 5 (18:25):
Actually, Suzanne's got a connection behind the scene. That's what
he does is fix the issues, the big ones. Okay,
let's do that.
Speaker 1 (18:36):
So Deputy Bowsanne's listening. She'll email him, do you think okay? Good? Good,
and we'll uh well, we'll talk about it.
Speaker 5 (18:46):
We'll talk about it. Heyna. I want to throw this
in there. That is the nicest part about Starlak I have.
I don't know, it's not an infinity, it's a century
link or whatever they call it these days. But when
it goes down, I just throw this little thing outside
in Bam. I'm connected anywhere in the world. It doesn't matter.
(19:07):
It is the coolest thing ever.
Speaker 1 (19:09):
Now, why don't you know I want to In fact, good,
I'm writing a note here. I'm going to ask you
about starlink. You wouldn't believe the inquiries we've gotten about starlink,
and also I have some questions about it. Joanne. I
want to get started with you and then take a break,
but we'll finish with you, Joanne, what is going on
with your car port?
Speaker 20 (19:31):
Well, tom Over. A year ago, one of our members
of our condo, his truck broke down, so he called
State Farm and they sent through their subcontractor, pros Toeing LLC.
Now this time company had a large flatbed and they
(19:53):
came through and put his the vehicle that was damaged
on their truck and attempted to drive through our car
pork and they damaged the top of our owner's truck
and they damaged our car pork. And now they are
claiming they were never here.
Speaker 9 (20:12):
So why.
Speaker 1 (20:14):
Wait wait, they're literally saying they were never there, right
they were.
Speaker 20 (20:20):
They're literally saying that's what they pulled their insurer and
so they're insure saying, well, they were never there, even
though the claim got paid through State Farm for the
damage to the top of the truck. And we have
I went in file A on behalf of our hoa.
I went and filed at and run claim and the
(20:42):
police said yes, in fact, that belongs to the owner
of Pros Towing Ink.
Speaker 1 (20:52):
Hold On a second, Okay, let's give this some thought.
I think I don't know how they did either being there.
If they paid for the truck, they're going to have
to pay for the carport. Hold on and we'll talk
about it. We'll we'll toss that around. Jan I'm Tom
Martino three o three seven to one three. Talk with

an announcement to make. I made an adjustment here, and
I believe I'll be able to take a call here

beginning of a system we can implement and I can
take him and I believe Mark at a remote location
will also be able to talk to the caller shocked.
(22:22):
I hope it works. Let's see, man, I think it might.
I've taken some time to do this and we'll see

Is this an h O A thing or is this
your thing? The cart work for people listening. The carport
was damaged by a tow truck. So here's the bottom line.
They owe you or they owe the HOA. Whose property
is that carport?
Speaker 20 (23:11):
The HOA I'm calling on behalf of the HOA.
Speaker 1 (23:14):
Okay, Now what did the HOA do in order to
get it paid for? So far? What have they done
so far?
Speaker 20 (23:25):
Well, it's been a rabbit hole. Tom, Yeah called uh,
we were called State Farm. Their agent Brett CARLINI.
Speaker 1 (23:34):
Now who's state is State Farm? Your the HOA insurance
or is it the toe company?
Speaker 20 (23:40):
It's the State Farm. Is the owner of the vehicle?
Who is a member of our condo association?
Speaker 13 (23:48):
Yeah?
Speaker 1 (23:48):
But I don't think they would be responsible. I think
it's the Toe company. I don't think the consumer has
anything to do with this. Who called the toe company? Really?
I don't. I don't think even though they were there
for that consumer, I just don't think what did they?
But out of curiosity, what did State Farm say? You're saying, hey,
(24:12):
you're insured called a toe company? The toe company did
damage to our carport? What did the toe What did
State Farm say?
Speaker 20 (24:22):
They said, Well, they were not very helpful. They gave
me a list of people to call.
Speaker 1 (24:29):
Well did they did they deny liability? Because I don't
see where they would be lived. I think I understand
where Joanna's going with this.
Speaker 14 (24:36):
Go ahead, State Farm is the insurance company who dispatched
pros toeing.
Speaker 1 (24:41):
So I believe Oh wait, wait wait, that is that
what happened when he called his insurance company.
Speaker 14 (24:48):
Ah, exactly, so contracted with the toe company. Yes, So,
through the principle of agency, Joanne apparently believes, and I
tend to agree with her, that is a different farm
needs to take some responsibility for sending out a dirt
bag or allegedly a dirt bag towing cost.
Speaker 1 (25:06):
Okay, that changes things. If it was State Farm who
actually hired the toe company, that is a good point,
Thank you. Okay, so go ahead.
Speaker 20 (25:20):
Uh well, state Farm contracted, they had a subcontractor, and
the subcontractor was a Garrow.
Speaker 8 (25:28):
A g U E R O.
Speaker 11 (25:31):
Right, But who actually those.
Speaker 1 (25:32):
People who actually damaged the car port? Was it a
Garro or pros towing pros toeing? All right? Well, I think.
Speaker 14 (25:41):
If we follow your chain of logic and I agree
with it, then State Farm is still still bears some
responsibility in this matter, regardless of how many subcontracts are.
Speaker 1 (25:51):
Yeah. I guess you said law of agency, and what
d is referring to is Normally, when you hire someone
and you take the responsibility to pick that one to
do something, you're responsible for what that somebody does. And
since State Farm is the one that sent the toe company,
even if they sent it through the TOE company who
(26:13):
sent a sub technically State Farm took responsibility for this.
Technically it doesn't always work. It depends on so many things.
But I'd like to know did State Farm ultimately say, hey,
we're not responsible? Did they actually what did they say
about the situation?
Speaker 20 (26:36):
Well, they gave us a list of people to contact.
Speaker 1 (26:39):
What does that mean? Like, what does that mean? A
list of people to contact? What does that mean?
Speaker 20 (26:45):
Well, they said the AHOA had to contact a GERO
because they were actually the people that sent out the
tow truck company pros Towing OK to call it and
so yes, and they said that they weren't responsible because
we had to call narrisk the actual ensure of the
(27:10):
prose towing. They were post towing, they're there the person
I mean, And then we called anar risk and they said, well,
our client, prost Towing is denying they were ever there,
and so we're not paying either.
Speaker 1 (27:27):
Well, they say they weren't their meaning there's there to
sound like a broken record.
Speaker 5 (27:32):
But this is another one small claims court. I mean,
if literally no one's doing anything, serve them and make
them prove it, you know.
Speaker 20 (27:41):
And that's I'm so there with you and we're ready.
Speaker 1 (27:44):
To do it.
Speaker 20 (27:45):
But okay, so who do we?
Speaker 1 (27:46):
Who do we?
Speaker 5 (27:47):
Tell me directly, Kelly, You'll give you my email and
I'll send you my cheat sheet.
Speaker 14 (27:52):
I think Mark, she's asking whom should she sue the
total created the damage?
Speaker 1 (27:57):
Not not who. Here's what we're going to marked two people.
Mark wants to say if he was doing it, this
is what he would do. Go ahead, Mark, Yeah, that's
exactly what I do. I'd probably go ahead and pick out. Now,
I'd sue just a tow truck company. That's it. They're
the rest caused the damage. Yeah, and you would let
them worry about who's going to pay for it? Yeah, exactly.
Speaker 5 (28:19):
I mean who else would pay for it besides whoever
did the damage? I mean, I understand the connection between
the HOA calling and the insurance company get involved, but really,
who ultimately owes it is going to be the tow.
Speaker 1 (28:32):
Truck company, which is pros towing pros Towing.
Speaker 19 (28:35):
So, Joanne, did you just write did you I'm reading
your review that you wrote about the company.
Speaker 18 (28:42):
Did this happen over a year ago?
Speaker 20 (28:45):
What on December thirteenth, twenty twenty four?
Speaker 1 (28:49):
Okay, hold on, how long does she have to sue
for this? It's twenty fours? Oh, it's it's it's only
a little over a year ago.
Speaker 14 (28:57):
I think she's well with them't you write on your
review you mentioned pro Toeing LLC, But before that you
put the word not in ot in parentheses before pro toeing.
Speaker 1 (29:10):
What are you trying to say there?
Speaker 20 (29:11):
And they're not they're not pro they're not pros.
Speaker 1 (29:15):
Oh that's funny. Good, I get it.
Speaker 18 (29:17):
Okay, good point.
Speaker 1 (29:18):
Oh I get that's that's a good play. All right.

(30:47):
seven one three talk three oh three seven one three
eight two five five. Welcome to the show. Let's talk
to Joe as a question on moving and Joe, I
hope it is a question prior to you doing anything,
because more than not, Here's what I'm going to say.
Most of the time, there's some chance of being ripped
(31:09):
off in the moving business. In moving, though, there's almost
a certainty you will be ripped off unless you're proactive.
What I'm saying is there's more of a chance of
being ripped off than not being ripped off. Like when
you got to buy a car, there's not more of
a chance of being ripped off than not being ripped off.
(31:31):
There is simply a chance you're going to be ripped off.
But with moving. Okay, he didn't like what I said. Joe,
is Joe there or did he hang up? I mean,
because I do want to hear it. He dropped I'm
not sure why so he did. Okay. By the way,
since he brought up a question of moving and it's
passed the first year and a lot of people think
about moving, just let me just say that, do not
(31:52):
go to the internet and try to find a mover
based only on the internet. Never, I'm going to tell
you something else, never ever, ever, ever hire a mover
out of South Florida. Ever.
Speaker 5 (32:06):
He's back up, Okay, biggest The biggest thing is make
sure you're dealing with an actual mover, not someone that's
kind of farming it. Out to the first person to
raise their hand and pay for the lead.
Speaker 1 (32:18):
Right is Joe back?
Speaker 13 (32:20):
Yeah?
Speaker 1 (32:21):
All right, Joe? What is your question on moving?
Speaker 13 (32:25):
Sir?
Speaker 7 (32:27):
Well, it's really about financing, Okay, Oh all right, I am.
I'm moving out of state, and in my when I move.
Speaker 13 (32:39):
There, I'll be retired, Okay, Okay.
Speaker 7 (32:45):
I have net worths of two plus Okay.
Speaker 1 (32:49):
Two plus meaning two million or two hundred thousand. I'm sorry,
two million million, Okay, go ahead.
Speaker 7 (32:57):
Uh, but I won't have any income, and I mean
I won't have good income. Yeah, I have the little
I'm working part time now both yeah, and I are working. Yeah, yeah,
we have income. So really my question is, uh, how
should I finance this upcoming move if I don't have
(33:19):
the cash?
Speaker 1 (33:21):
Well, when you say you have a two million plus networth,
tell me what that consists of.
Speaker 7 (33:29):
A home paid in full?
Speaker 1 (33:31):
Seven hundred that's the home is seven hundred. The home
is seven hundred of that, yes, okay, and and the
rest how much do you have You don't have any cash,
you can just pay for it or not.
Speaker 7 (33:47):
For the new house.
Speaker 1 (33:49):
Oh, you want to know how to finance the new house?
You're okay, Well, why I'm going to ask the obvious question.
If you have a home now worth seven hundred g
and you're going to sell that home, why don't you
just use that money for your new home?
Speaker 7 (34:07):
Because we want to custom build where we're going and
so yeah, I won't be able to sell this for six, nine,
twelve months, but.
Speaker 1 (34:18):
You should say okay, And you're wondering, and so are
you going to custom build a real custom build or
are you going to build through a builder who has
like modified, you know, models and you're going to change
things around? How custom is your new custom home going
to be?
Speaker 7 (34:35):
Good question? I don't have an answer yet. Okay, I'm
literally just starting this process.
Speaker 1 (34:41):
All right. I have plenty of I have plenty of
thoughts on this. So I want you to hang on
because what you're doing is you're wanting to know without
disrupting a lot of things, how can you move to
this next city or at least start the building project,
finance it without tapping into or or having to sell
your prematurely All of that coming up on the Troubleshooter Show.

two thousand So by the way, I'm experimenting and I'm
going to take a Google call. I'm going to ask
my friend on one of my YouTube morons, I'll ask
(36:46):
him to make a call to my to my Google
voice to see if I can put that on the
air and if Mark will be able to talk to
him right now. Though Joe has a moving issue, of
moving issue is she's not really a moving issue. Joe
wants to finance a new project. He wants to retire
in another city out of state, and he owns a
(37:08):
home free and clear, and he wants and he has
other investments. He has about a net worth of total
of about two plus two million plus and he wants
to know what's the best way of financing this construction.
Mark brought up a good point and a great product
by our friend at CMG Finance, and he does what's
(37:29):
called the all in one loan. Joe, have you heard
us talk about what I often called the liquid loan?
Have you heard about that?
Speaker 15 (37:40):
Yes?
Speaker 7 (37:40):
I have, Yes, I am familiar.
Speaker 1 (37:42):
And since you have a home that is paid off,
if you put it put an all in one loan
on that, you would have basically a line of credit.
Mark about eighty percent of that could be line of
credit eighty percent. So let's just take a million, make
it easy.
Speaker 5 (38:00):
If it's paid off, you'd have eight hundred thousand you
could just write a check off of and it would
be like a construction loan, but cheaper because one it
would be simple interest, and two the rate's just going
to be lower.
Speaker 1 (38:13):
Yeah, and you can pay it down at well, So
you'd have in your particular case, you'd have five hundred
and sixty thousand dollars available in a line of credit.
And by the way, it's such a cool idea. So
once the house is completed, then the house is paid for.
Of course, you sell your house and pay off the
(38:34):
all in one loan, or you can have an all
in one loan on the new house and keep a
line of credit if you want. Yeah.
Speaker 5 (38:41):
And then, unlike a lot of loans out there, they
can actually do a lot of it off of assets.
So if you're retired and you're not taking in a
ton of cash flow, but you do have some pension
money or whatever, you do have some money out there,
they'll look at your other assets. You said you had
two million dollars in assets, so I doubt it would
be a problem.
Speaker 1 (39:01):
So, and he said that's CMG CMG Financial. Yes, kay, yeah,
but you want to call John. He's like he's the
top dog, he's the guy.
Speaker 5 (39:11):
Yeah, we's three oh three eight eight two six' six
seven nine And kelly can give that to you again.
Speaker 15 (39:17):
Two six six seven nine.
Speaker 1 (39:19):
Exactly, yeah that's a great. Product by the, way it's
a great. Product thank you for Calling, joe appreciate. That
three oh three seven one three eight two five. Five,
christy what is going on with a? Contractor? Christy what's?
Speaker 17 (39:32):
Happening, WELL i uh had him come out to look
at my deck project THAT i needed to. FINISH. I,
YEAH i needed a few boards put on and fashion
board around the deck and railing put.
Speaker 1 (39:48):
Up so was this an existing deck that you needed?
Speaker 17 (39:53):
Improved, YES i was just. PUTTING i was replacing the
boards on it BECAUSE i had a treated wood on
there that had damaged and.
Speaker 1 (40:02):
Twisted oh, really, Okay so you hired a contractor to
fix up your deck and what?
Speaker 17 (40:09):
Happened, WELL i had most of it. DONE i was
hiring him to finish it and he flat bit it
originally verbally at six, thousand AND i told him that
that was too, much THAT i couldn't afford to put
another six thousand into, it.
Speaker 1 (40:24):
Well six thousand just to do what was he was
that materials and? Labor what was that?
Speaker 17 (40:30):
For that was to cut in a couple of forty
five degree angles where the deck transitioned around the. Corner,
yeah and to turn a very small section of the
deck so that it the boards so that they mentioned
the other boards because they, were you, know.
Speaker 1 (40:50):
Turning so he was he basically putting down the new
part that you walk. On was he doing the whole
floor or was he just What i'm trying to get
a picture of what he was doing for six? Grand but.
Speaker 17 (41:05):
So there was a very small section of boards that
were laid the opposite.
Speaker 1 (41:10):
Direction, OKAY i got.
Speaker 17 (41:12):
Eighty square, feet AND i, asked, OKAY i take those
boards up and turn them so that they, matched put up.
RAIL i got it around the whole, deck and then
there was a very small section in back that hadn't
been laid. Yet it was approximately two hundred square, feet
AND i had him lay that and put up the
fashion board around The.
Speaker 1 (41:35):
Okay the Facial, Okay now on the sixth grand that he,
bid you said at, first did you balk at? That
did he change. It tell me what.
Speaker 17 (41:44):
HAPPENED i told him THAT i couldn't afford to put six,
grand and, then so what did he? Do he then
offered to do an hourly, rate telling me that it
would be cheaper IF i did. THAT i was apprehensive about.
It he kept. Talking eventually he, said, BOOK i just
(42:06):
want to help. You i'll even lower the hourly rate
THAT i have to IF i have. TO i just
want to help. You and when he said, THAT i, said, okay.
Speaker 1 (42:16):
Okay so what was? This so what did it turn
out to? Be and you were you keeping track of?
It was it in our? Contract this hourly? Rate tell
me what.
Speaker 17 (42:26):
Happened everything was, verbal there was no written. Contract he
builled me four, thousand four hundred the first time for
a first, bill and at that POINT i reminded him
that he said he would lower the.
Speaker 1 (42:42):
Rate, yeah but four, thousand four hundred is less than six,
Thousand so what were you expecting it to?
Speaker 17 (42:50):
Be, well WHAT i was concerned about is where they
were at with the. Project AND i reminded him that
he said that and kept telling me not to worry about. It,
EVENTUALLY i just wrote him the check for the four,
thousand four. Hundred SO i paid him, that. Okay then
later on in the project he sent me another bill
(43:11):
for fifteen, thousand six.
Speaker 21 (43:13):
Hundred why, way wait wait wait fifteen, thousand six. Hundred,
yes hold, On so if you take the fifteen, thousand
six hundred and the four, thousand you're up north of
twenty grand on something.
Speaker 1 (43:31):
That you said six thousand would be too. Much, yes,
well that's unconscious of time.
Speaker 5 (43:39):
Scope i'm SORRY i missed. That what was he going
to do for six? Thousand he was going to do.
Speaker 1 (43:45):
Some decking mark without her going through the whole, thing
suffice it to say he was going to do some,
decking some additional, decking some relaying of decking and, railing
just basically. That so she said six grand is too,
much so he, said let's do it. Hourly he built
her forty four hundred. Bucks she paid it, later he
(44:06):
built her fifteen, thousand six. HUNDRED i don't understand HOW
i mean if you have nothing in writing, anywhere do
you have emails or texts or anything at?
Speaker 12 (44:16):
ALL i have.
Speaker 17 (44:19):
A text message from him where when we were arguing
back and forth about the fifteen thousand dollars, bill where
he said that his flat bid was seven, thousand not six,
thousand but it didn't include any of the extras that
he was calling. Extras but that's kind of.
Speaker 5 (44:35):
WAY i asked what the scope was Because i'd be,
curious like What Mark schamansky would, say like if we
had a picture of what he actually. Did it's kind
of late right. Now seven. Grand it's kind of late right.
Speaker 1 (44:49):
Now but WHAT i don't understand is, This, okay she's
got no matter how she looks at, it she's got
a bill right now and she's got to deal with.
IT i mean this fifty, thousand six. Hundred if if
she got value here and there's no true a, CONTRACT
i don't, know. Man so so basically the entire bill
(45:11):
comes to if you pay, it that will be twenty
thousand dollars twenty, thousand and you told him six thousand
would be too. MUCH i don't get. It what does
he say about that when you say?
Speaker 5 (45:25):
It let's just call him and ask. Him maybe he's
got a good side to the. Story let's ask him
And christy what does he?
Speaker 1 (45:32):
Know but we will call. HIM i just want to Ask, Christy,
christy what when you bring this? Up obviously you must
have brought this, up and you, said, LISTEN i didn't
want to pay six grand and it's going to be twenty.
Grand what does he?
Speaker 17 (45:48):
Say he says THAT i knew, everything and THAT i
kept agreeing for them to continue to.
Speaker 1 (45:57):
Work and what did you did?
Speaker 17 (46:00):
You one, time he sarcastically asked, me after they had
tore everything out on the west, side leaving me in
a worse position THAN i was, before BECAUSE i wasn't
sure why they did. That he sarcastically asked me IF
i wanted them to be pulled off the, Job and
that happened one, time AND i, said, WELL i mean,
(46:22):
no why you guys are leaving me in a worse
spot THAN i was BEFORE i hired?
Speaker 1 (46:26):
You well what were you, expecting? Though but, see you
have to take some responsibility, Here. Christy you basically gave
them the go, ahead and if he can justify that.
Price by the, way to rebuild a whole deck for
fifteen six is not bad for a big, deck but
it depends ON i don't get. IT i just we
(46:48):
do have to call him and get his side of the.
STORY i mean that that is. Mandatory but right now
you have paid him, everything but the fifteen six, Right,
Chris and what is he? Doing how long ago did
he complete? It when did you get that bill for fifteen?
Speaker 17 (47:06):
Six, well the deck isn't even. Finished he built me
fifteen six back around the middle Of. October, okay now.
Speaker 1 (47:17):
Will he will how much does he say it'll cost
to finish the? Deck is there still more money owed
if he? Finishes is this fifteen six to complete the?
Job or is this fifteen six for what he's done so?
Speaker 17 (47:31):
Far what he's done so? Far evidently because he is
doing a stree. Hourly but he's also charging for all
the mistakes that they've made and to fix some of those.
Speaker 1 (47:44):
Mistakes and like.
Speaker 17 (47:45):
What, mistakes, well like when they put in the, BLOCKING
i bought a bunch of brand new treated what for
them to use for blocking to put in for the railing?
Post right? Right they took off the two front boards
of the deck three different. Times the first. Time i'm
not sure what they.

understand what you're calling. BACK i thought you just said
you're on the. Hook you're on the hook for the.
CARS i don't understand if they're paid? For? What are
you on the hook for the for the?
Speaker 17 (50:59):
Insurance i'm? Sorry, Okay so the agent for my insurance
told me it was illegal to take me off BECAUSE
i was trying earlier before the divorce was finalized to
get my.
Speaker 5 (51:12):
Name i've heard of an insurance person saying it's illegal
to take you.
Speaker 1 (51:17):
OFF i do not Get. Megan let's just get some basics.
Here these cars are are you? Driving are any of
these cars? Yours in other, words do you have any
of these cars in your? Possession, well the.
Speaker 17 (51:33):
Divorce is now, finalized AND i have one. Car the
rest of them are. His.
Speaker 1 (51:37):
Okay the one car that you, have is it titled
in your? Name? Yes it, is and you don't mind
paying insurance for that, car right? Correct, okay but but
how how do you know you're also on the bill
for the other.
Speaker 17 (51:57):
Cars, well when the divorce was finalized In, MARCH i
called them up to try to separate the insurance and
they told me that my exit called in and the
underwriter for the insurance company had retroactively taken his name
off of our insurance back To, january which left me
(52:19):
with the bill for all of his vehicles From january To.
Speaker 1 (52:22):
March, OKAY i don't when you say his, vehicles the
vehicles that he owns right, now are they titled in his?
Speaker 16 (52:31):
NAME i would assume they.
Speaker 1 (52:34):
Are, well you're not on the. Title so let me
get us. Straight you have one car you're on the
title for and he has how many? Cars he?
Speaker 19 (52:46):
Has?
Speaker 17 (52:46):
Two and AN?
Speaker 1 (52:47):
Mpv okay are they in his? Name are they in his?
Speaker 17 (52:53):
Name they should be by?
Speaker 1 (52:55):
Now? Yeah, Okay well then all you need to. DO
i don't even under stand what that. Means they should
be by. NOW i don't understand what that. Means they're
either in his name or they're not in.
Speaker 17 (53:05):
IT i MEAN i don't have or divorced, now SO
i don't have any way to know what he's done
or not, done if that makes.
Speaker 1 (53:15):
Sense? Ok, Okay so son the, divorce so did at
one time they were all under one? Insurance is that? Correct?
Speaker 8 (53:25):
Correct?
Speaker 1 (53:26):
Okay and all you want to do is take the
car that you owned and ensure. It why can't you
just do? THAT i don't. Understand they can't bill you
for his. Cars they simply. Can't SO i don't know
what it means when you say you're on the hook for?
Them are they billing? You what are they?
Speaker 17 (53:43):
Doing so when the divorce was, finalized they separate at
our insurance right and from the date of divorce, on
of course it's been separated in our own.
Speaker 1 (53:58):
Name when was the dev Final.
Speaker 17 (54:02):
March of twenty, okay.
Speaker 1 (54:03):
Five, Okay so when the divorce.
Speaker 17 (54:05):
Was, reactively they retroactively took his name off back To
january of twenty twenty. Five, yeah leaving me with his
vehicle bills From january To. March And i've gone around
with them and they just, okay all, Right so.
Speaker 1 (54:22):
From, january From january To, march if you guys had
a household policy and you were both on the, policy
you should be responsible for some of, it and so should.
HE i, mean because you. Weren't your divorce wasn't finalized.
Speaker 17 (54:39):
Yet, right but they left me with the whole of the.
Speaker 5 (54:42):
Bills she's saying in the, decree that's just how they
cut it, out and she must have agreed to.
Speaker 1 (54:47):
IT i don't know if it's in the. DECREE i
didn't hear her say. That, So, megan are you saying
the divorce decree names you responsible for all of those
cars for the first three months of twenty twenty.
Speaker 17 (55:01):
Five, no What i'm saying is the divorce decree doesn't stipulate.
Speaker 1 (55:06):
Who, okay that's WHAT i. Thought, okay who.
Speaker 17 (55:09):
Belongs who the vehicles belonged?
Speaker 1 (55:11):
To, Okay so In, march In January february And march
of twenty twenty. Five were you on the title for
those other vehicles or what kind of? Policy did you
guys share an insurance policy for those first three?
Speaker 17 (55:26):
Months we were supposed to have had a way to
separate them at mediation basically or shortly. Thereafter but because
my agent told me THAT i couldn't take my name off, legally, WELL.
Speaker 1 (55:45):
I don't need this legally. THING i don't even. Understand,
WELL i think what they're saying is if you if
you had a joint insurance, policy you guys both are
responsible for. It there's no legally or. ILLEGALLY i, mean
did you when did you ask to be taken off
(56:05):
of the? Insurance did you ask After march or Before?
March when did you actually ask, THEM i want our insurance.
Separated when did you ask?
Speaker 17 (56:16):
That Probably october because we.
Speaker 1 (56:22):
Are october of What october of twenty twenty.
Speaker 17 (56:26):
Five twenty twenty.
Speaker 1 (56:27):
Four, Okay so you wanted you wanted to be taken
off of his insurance almost, immediately almost immediately with your,
separation and they did not take you off Until march
when the divorce was, finalized, right that's when They, okay.
Speaker 17 (56:49):
Told, ME i wasn't allowed to do, that all.
Speaker 1 (56:51):
Right, well it's too late to go back. Now it's
just too, late because you it wasn't illegal to get.
Off you could have gotten off the insurance at any,
time so long as you had your own insurance and
you transferred your car to your own. Insurance it's impossible
to go back now and, say wait a, minute she
(57:12):
was supposed to be off that insurance Effective january twenty twenty.
Five they're going to, say but she was still married to,
them and they had a joint. Policy SO i don't
see how you would ever make them retroactively go back To.
January they've how much money did that come to for
(57:32):
three months of JOINT i, mean did he pay for?
It did you pay for? It did you both pay for?
It who paid For January february In? March who paid
for those?
Speaker 17 (57:40):
Months they put it on my. Bill so, SEE i
kept the house SO i kept the, insurance and they
gave him new, insurance and they left me with all
of the bill for all of his vehicles for that.
Speaker 1 (57:54):
Timeframe for that, timeframe because you guys had because you
guys had a household bundling, policy bundled with the, Cars
and why did they cancel it In? March did the
policies come Doing march or did they cancel it In.
Speaker 17 (58:11):
March, no they canceled it In march because the divorce was,
Finalized but they just actively took his name off of
it back To.
Speaker 1 (58:20):
January it just doesn't make sense to.
Speaker 5 (58:25):
Me but if they took his name off of it
back To, january why would you owe anything on his behalf.
Speaker 1 (58:34):
Because it was already, paid.
Speaker 16 (58:36):
Because it was both of Our, well it wasn't already.
Paid they made me pay.
Speaker 1 (58:39):
It, well and why did.
Speaker 9 (58:42):
You pay it on my?
Speaker 22 (58:43):
Vehicle?
Speaker 1 (58:43):
Though why did you pay?
Speaker 16 (58:45):
IT i still have to have vehicle?
Speaker 1 (58:46):
Insurance well you could have had it from another, company
you chose. It how much you? Paid you paid for
his insurance For, January February, march and now you're SAYING
i shouldn't have done, it but you did. It how
much did you pay him? Off why is it even?
There they took him off the. Policy the policies were
(59:10):
still There, mark and she paid for, them but they
took him. Off IT'S i don't THINK i don't think
she has an accurate understanding of what. Happened, TECHNICALLY i
really don't because it doesn't make sense to.
Speaker 5 (59:24):
Me if he owned the, vehicles why They Maybe brian
can shed some light on.
Speaker 1 (59:29):
This, So, megan how much so In, January february And
march did you pay on his vehicles and on? Yours
or were they all on one?
Speaker 17 (59:40):
Policy they were all on one. Policy they removed his
name and left his vehicles for that timeframe on my.
Speaker 1 (59:48):
Policy, okay how much extra did that cost you For,
January february And march for his? Vehicles how much actual
damage did you you?
Speaker 16 (01:00:00):
Incur about one thousand?
Speaker 1 (01:00:02):

(01:01:10):
i think you're gonna have a tough time. NOW i
can't go back in time and figure out why someone
told you, this and if they're even going to admit
they told you it was illegal to get off the
policy or what kind of policy you. Had it's possible
you had a household policy and everything was bundled into one.
BILL i. Can't we can't go back in time and undo,
(01:01:32):
that and you're not going to get a refund from
the insurance company and they're not going to bill your.
Husband but one THING i do know in a, DIVORCE
i have seen this happen where the two people are
supposed to take care of certain bills and they, don't
and you can go after the other for their. Responsibility
SO i believe you could sue your husband in small claims.
(01:01:56):
Court your ex husband in small claims court for one
thousand dollars claiming that you erroneously paid for his insurance For,
January february And march. Period that's the easiest way to do,
it because if you can show that you actually paid
the premium and they were on his, cars then he
(01:02:21):
should be responsible for. It that's going to be the
easiest and most direct. Way going back to that insurance
company saying she shouldn't have been billed, in you, know
and she shouldn't have done this and she should have
been off it in the prior year is going to
be too. DIFFICULT i, MEAN i just don't see how
(01:02:42):
especially they're going to say they took you off In
march because that's when the divorce was, settled and you're
going to, say, WELL i shouldn't have paid, it but
you did pay, it and they're going to ask why
you paid. It SO i think it's a waste of
time trying to get the insurance company to unravel. This
the simplest thing is to go for damages that you
(01:03:05):
incurred as a result of you paying something you shouldn't have.
PAID i think that'll be. Easy do you have a
way to serve your, husband your.
Speaker 16 (01:03:18):
Ex you, Know i've never been through that, process SO
i don't really know.
Speaker 17 (01:03:23):
How to do.
Speaker 1 (01:03:23):
That it's not going to be. Difficult you go to
the county website where you guys you know resided or
where you, resided and you simply fill out a. Form
you fill it out in. Triplicate the directions are. There
it's really not that. Difficult but the reason you're suing
him is. Simple you were, divorced you were, separated and
(01:03:44):
you erroneously paid the insurance on his. CARS i, mean
that's that's the only way you can do. It what
does the insurance company say when you call them and
tell them you should have never paid? That what do they? Say,
WELL i.
Speaker 17 (01:04:01):
Get a lot of run, around not a lot of.
ANSWERS i was able to get some documentation showing when
he was taken off and which vehicles were paid for
by whom, when and that kind of, thing SO i
was able to total up the. Amount but basically they, say,
(01:04:22):
well you were both on the.
Speaker 1 (01:04:23):
Policy that's, right and that's that's why time's.
Speaker 5 (01:04:27):
Right this is a deal between you and THE. X
you got to take him to court for, That riz And.
Bucks it's not right that big of a.
Speaker 1 (01:04:33):
Deal it really is because as far as far as
the insurance company, goes it was a bundled. Policy you
both were on, it and and that's just the way it.
Is we got a break. Man, yeah we got to

Danny you are the one that worked On christy's. Deck
according To, christy she balked at a contract that was
around six, grand and you, said, well we'll do it,
hourly or somebody at your company said we'll do it
hourly and you'll save. Money and now she says her
bill is going to be over twenty grand and she's already,
(01:07:35):
paid you, know forty four hundred and she was just
built fifteen, thousand six hundred and that still doesn't complete the.
Deck what is she talking? About we don't understand.
Speaker 22 (01:07:48):
It, yeah let me let me let me clarify a little.
Speaker 1 (01:07:52):
Bit, sure so this.
Speaker 22 (01:07:53):
Job had already had had somebody kicked off of it by.
HER i don't know what happens with. That I'M i
suspect that they probably didn't get paid and she was
looking for a way to get the job.
Speaker 10 (01:08:04):
DONE i don't.
Speaker 22 (01:08:05):
KNOW i don't want to, speculate but we did a
great job for. Her at the start of the, JOB i,
SAID i don't know What i'm getting myself into. Here
IF i was doing this job from the, start i'd
give you a flat. Rate AND i have no idea
what's going to happen IF i open up the. CHOICE
i have no idea how much stuff you're going to
want fixed on this good?
Speaker 13 (01:08:24):
Point you?
Speaker 22 (01:08:25):
Know this could, yeah, Absolutely and it's just really hard
to decipher, that you. Know AND i, SAID i could
give you an estimate for WHAT i can, see but
that's only for WHAT i can. See AND i think
that was at like seventy five hundred bucks or something like.
That and that was throwing things back. Together and once
we opened up, everything everything that was done was, Incorrect
(01:08:47):
like there was nothing that was done correct on this at.
Speaker 5 (01:08:51):
All AND i you mean according to her or you're
saying the last, contractor.
Speaker 22 (01:08:56):
The last contractor didn't do a good. Job it was
it was it wasn't good out. Correctly and so WHAT
i did WAS i decided that the only way to
do this would go on stages so that she wouldn't
know where she was at with her, time so that you,
know she could, say, hey we're getting too much on This,
BILL i don't want to go to the next, stage
you know WHAT i?
Speaker 8 (01:09:14):
Mean?
Speaker 22 (01:09:15):
Yeah, Yeah and so through this we went through the
stages and every TIME i go there and, say, hey you,
know do you want to do? This because you know
where we're. At you, know she's there all. Day she
knows how many guys are, there and she knows how
much the hourly rate, is so she's aware of all of, this,
Right and so we'd finish this, SECTION i, say, hey
do you want to go on or do you want
us to do? This do you want us to fix?
(01:09:36):
Everything and every single TIME i went out, there she, said,
nope but you all needs to be, done correct and
AND i want you to keep. Going AND i, said, okay, like,
okay you know it's getting pretty pretty, high are you?
Speaker 1 (01:09:47):
Sure?
Speaker 13 (01:09:49):
Yeah, Absolutely, Hey.
Speaker 5 (01:09:50):
DANNY i hate to Do, DANNY i hate to do
this to, you but we're up against the.
Speaker 1 (01:09:54):
News we really want to hear the rest of this
where you're going to have to hold on just so,
pease Please. Dan we always know there's another side of the.
Story she wanted to know why did the estimate go
from six or seven to over twenty thousand and did
saying because when they opened it, up they realized everything
had been done. Wrong we're gonna talk about this and

(01:11:58):
Oh three martino when we're on. The air you can
also call three zero three seven to one three talks
seven one three eight two. Five five christy called basically
AND said I was i wanted to hire a contractor
to fix. MY deck i had a DECK and i wanted.
IT redone i wanted some of the would replace on
the decking so all the wood is going the. Same
(01:12:20):
DIRECTION and i also wanted to add some extra DECK
and i wanted to fix. THE railings i hired a
contractor and the contractor said it's going to be about.
Six grand, She, claims ah that's way, too much and, he,
said okay we'll do it by, the hour because we
(01:12:42):
don't know what we're going, to encounter. He said when
they got into, the job which by, the way, he
said would have been about seven thousand at. First site
but once they got into, the job they discovered that
base sickly everything was, done incorrectly and it was going
(01:13:04):
to have to be done basically from the. Ground up
and he kept getting approvals for his work orders as he.
Went along and she paid forty four hundred dollars. Without
problem and then she said she was billed another fifteen
(01:13:25):
thousand some, odd dollars which would bring total bill to
up to. Twenty grand and, she said oh, MY god
i thought six thousand was. Too much WHY would i
ever agree to? Twenty grand, Danny, said look she knew
what we. Were doing we were on, the job we kept,
(01:13:47):
getting approvals and we want to. Get Paid, SO danny
i have a question for you before we get into the.
Nitty gritty. She paid she paid forty four hundred dollars.
To guys so far she was billed, fifteen thousand. Six,
hundred additionally that brings the total bill To twenty, she
(01:14:07):
says the deck is still, not completed will she in
addition to the twenty if you were to finish this
deck as it should, be done would there be more
billing on top of the?
Speaker 22 (01:14:20):
Twenty, grand, well yeah of course. There would but here's
the thing is that the job is pretty. MUCH done,
i mean she's talking about a couple of little tiny
details that. Aren't done and the thing, is IS like
i didn't even charge her for. MY time i was
compassionate for. This woman, you know she's going through a
LOT and i, understand that AND so i wanted to
like help. Her OUT so i didn't charge her for
(01:14:42):
any of. My time, YOU know i, TOLD her, i said,
YOU know i Told her i'd help. You out i'm
not going to charge her for any of my time,
on this. You know and here's. Another THING while i
was going through these changes and asking her if she
if she wanted us to, keep going she decided to
add extra square footage onto. Her death so we ended
up building the deck out.
Speaker 1 (01:15:00):
FOR her, i, mean NOW can i ask you something this, Original,
deck danny how old was this? Original deck if?
Speaker 22 (01:15:07):
Brand new she just had, it built and she she
fired the guys that were.
Speaker 1 (01:15:11):
Built it like this was us.
Speaker 22 (01:15:13):
Coming and taking over a job that somebody had just
got kicked, off.
Speaker 1 (01:15:15):
Of and it was a. Bad job it was literally
nothing could. Be, salvaged no.
Speaker 22 (01:15:22):
That was some stuff that could, be salvaged but it
all had to. Be redone, you know all the boards.
Were on she, wanted everything wanted all, to be, you know.
Speaker 1 (01:15:30):
In line so, All Right, so christy what do you
have to Say about danny what he's telling us? So far,
just basically let's try to confine ourselves to what we're
talking about. Thus far, Danny, SAID look i had no
IDEA what i was going. To find the whole deck was,
done Improperly and i'm doing THE best i can. For
(01:15:52):
her what do you have to say, About?
Speaker 12 (01:15:53):
That, christy well the deck was actually built in, twenty nineteen,
first off but, the project as far as lay in,
the boards was almost completely finished by THE time i
got Ahold.
Speaker 17 (01:16:09):
Of danny the other guy was paid. For everything danny
was the one that came out and said that it
was all done wrong and.
Speaker 16 (01:16:19):
Screwed, UP okay, i say.
Speaker 1 (01:16:23):
Do you doubt what he? Was saying do you doubt
what he?
Speaker 17 (01:16:26):
WAS saying i questioned some. Of it some OF it
i agree with as far as. Add ons that small
section was twelve foot by. Three foot it took, their
guys his guys a couple hours to. Do it it
wasn't that big of a deal and everything, they so
(01:16:49):
the whole east side was, completely laid the whole south
side was, completely laid and half of the west side was.
Completely laid all that was left was the other half that.
Needed LAID and i did ask them while they were
when they, DID it i did ask them to turn
the boards on the east side on that.
Speaker 1 (01:17:06):
Small, lead yeah we're getting into. The weeds we don't
have to. Get into Here's what. I'm, saying basically what
he is, saying, is look we did this by. The
hour you got value for every hour. We spent and
this is what it's going. To cost it's even going
to cost more to. Finish it how do you feel?
About this.
Speaker 17 (01:17:27):
That wasn't what we? Agreed? On berkeley and as far
as him and why?
Speaker 1 (01:17:32):
Didn't you Why do how are you gonna how are
you going to? Prove, THAT.
Speaker 17 (01:17:38):
Well i think a better question would be how can
he prove that.
Speaker 1 (01:17:43):
He doesn't have? To do he doesn't, Have to he doesn't.
Have To and i'm going to tell. You why i'm
going to tell you why because we handle a lot.
Of these here's what. It is he's been on the
job and that's why he doesn't have to. Prove anything
you were there while he was doing, the job and
he doesn't have to. Prove anything he.
Speaker 17 (01:18:05):
Was only out at the site once, maybe twice he.
Speaker 1 (01:18:08):
Was, not No what i'm, saying is Here's what. I'm
saying he was on. The job you had him on.
The job he doesn't have to. Prove anything. You got
it's called a quantum quantum marrowit meaning you, got merit
you got something for. Your money you were there the.
(01:18:29):
Entire time you can't say that he didn't have authorization
to do it because you kept giving. Them approvals there
is nothing that said he agreed it wouldn't be more
than a. Certain amount when you, said verbally what tell
me what your understanding was of what this whole thing? Would,
cost verbally what did you think this whole thing would
(01:18:54):
cost according to your memory of the verbal contract.
Speaker 17 (01:19:00):
It would stay under, six thousand and that he would
lower the hourly rate if.
Speaker 1 (01:19:04):
He had you thought the entire job of rebuilding this
deck you thought would be under six, thousand dollars including
the add on part that.
Speaker 8 (01:19:13):
He, did.
Speaker 1 (01:19:16):
NO, and, i well That's what.
Speaker 5 (01:19:18):
Tom's asking what does your brain say the total job?
Is worth at, this POINT.
Speaker 16 (01:19:23):
When i did the, BILLING dispute i offered him a
grand hole of almost eight thousand dollars for EVERYTHING because
i did detail the add on of that twelve foot
by three, foot SECTION and i put that all in the.
Billing dispute as far as rebuilding the, whole deck he
did not rebuild the. Whole deck he's not being honest.
(01:19:46):
About that he only DID what i have detailed in
THE paperwork i.
Speaker 17 (01:19:51):
Sent.
Speaker 1 (01:19:51):
You, Guys okay i'm going to tell you something you're
not going to like. To, hear christy they did about
twenty thousand dollars worth, of work how because that's what.
Things cost they that job for six grand would have
never been, done, ever, ever, ever ever if you don't
have any proof that he didn't contract for, six grand
(01:20:15):
you have no proof. Of, that yeah and, for me it's.
Speaker 5 (01:20:17):
Even easier it comes down to the hourly how, many
hours how, many guys and then just do the math
because that's what you. Agreed to so maybe he, Is
overcharging but what did how do you? Calculate, that.
Speaker 17 (01:20:31):
Well every contractor that was out here that made the
job at, five thousand he claims that he put in
a total of two hundred and eighty seven hours into
doing what.
Speaker 1 (01:20:44):
Was, done oh here's here's. Hold on so you're telling
me if we sent out one of. Our experts they
would look at this job and they would value it
at about five. Thousand dollars is that what you're saying?
Speaker 17 (01:20:58):
EVERY contractor, i, okay, Yes okay so how would we?
Speaker 1 (01:21:04):
Do that because, hold on, HOLD one i, understand That,
but mark but people can look at it, and say
here's what it would have cost we. We could, You
Know mark schumansky would be honest. About it he would
look at that, And, say okay here's what this job
would have COST if i. Did it THAT'S all. I
want how many contractors did you actually come out and
(01:21:25):
have that come out to look? At? It christy?
Speaker 12 (01:21:27):
How many about three quarters of?
Speaker 1 (01:21:30):
A dozen three quarters of? A dozen let me let
me do the math. On that three quarters of? A dozen?
A dozen now was that a base straight? Up dozen so,
hold on so you, had nine you had nine contractors come,
out there and, they said, they said the sum total of,
(01:21:51):
that work if they, did it would have been about. Five.
Speaker 17 (01:21:54):
GRAND correct i even had one look at it, and
say any any grand to work? Out, there danny what
do you think?
Speaker 1 (01:22:02):
About that they're saying that you only did.
Speaker 22 (01:22:05):
Fun to go, out there and because that deck is
worth way more than TWENTY grand i will tell you
she got to steal that add so much value to.
Her house please have someone go out there and look at.
Speaker 1 (01:22:14):
That, job, Yeah.
Speaker 5 (01:22:19):
Okay, so danny out, of curiosity if someone, comes out
someone we trust and where is, you know has no
dog in, this fight but knows the decking business inside,
and out and they say it would have been probably?
Ten grand then what just out? Of curiosity then well you?
Mean ten what about five or five or fifteen OR what?
Speaker 1 (01:22:37):
I mean then what Is what? I'm saying and the
same question goes to you the?
Speaker 23 (01:22:42):
Call, HER.
Speaker 22 (01:22:45):
Well, i mean why we have somebody go out there
and to say what it's worth and see if? WE will,
i mean if the price, goes up she. Pays it
if it, goes, Down off i'll. LOSE it I mean
That's where. I'M at i don't know how much that?
Speaker 13 (01:22:55):
Dog?
Speaker 1 (01:22:55):
Costs wow? How much now listen to what he. Just,
said now what do you say? To that?
Speaker 8 (01:23:00):
To me that?
Speaker 1 (01:23:01):
Is, Incredible.
Speaker 17 (01:23:04):
Well i'm fine if one of your guys comes, OUT
here i have been more Than he, no, no.
Speaker 1 (01:23:08):
No no, no, no no that wasn't.
Speaker 5 (01:23:09):
The question the question is if our guy goes up
and the price, goes up you. Pay it if the price,
goes down he'll eat whatever.
Speaker 1 (01:23:17):
It, is now here's. THE deal i want to, Know.
This christy when the people went out to evaluate the work,
he did how did they know what work he did
and what work was still was there when he? Got
there that's how did they trying to say about sending?
Somebody out showed.
Speaker 17 (01:23:32):
THEM all i showed them all the pictures of what
the deck looked.
Speaker 1 (01:23:35):
Like, before, okay, good good good. Bee, good okay it wasn't?
Speaker 17 (01:23:42):
All, redone well whatever?
Speaker 1 (01:23:44):
Was redone how? About this if you, Have, pictures danny
you'll agree whatever was redone. Was redone whatever wasn't redone was.
NOT redone i mean it's. Not that it's not, brain
Surgery for. God's. Sakes, Yeah simple it's.
Speaker 22 (01:23:58):
Very straightforward it's a very easy job. TO calculate, i
mean you guys super profession Out there sti'll know exactly
what he's. Looking at don't know exactly how much time,
it takes, ALL.
Speaker 1 (01:24:08):

gonna get off the hook and only pay. Five grand
if it goes up, to twenty you're gonna owe? Him
twenty are you good?
Speaker 13 (01:24:31):
With that might go up?
Speaker 22 (01:24:33):
To forty?
Speaker 24 (01:24:35):

Extra work, is needed any, add on any.
Speaker 8 (01:28:05):
Difference in the scope of work that we had, agreed
on would be paid by that contractor. As well because
it's not in the current scope of work that we
had a. Contract.
Speaker 25 (01:28:16):
With yeah so with that, Being said i'm about ninety
days out, of completion having been paid a total of
twenty five.
Speaker 8 (01:28:26):
Thousand dollars and then on top, of THAT because i
just looked over the, CONTRACT again i saw the clause
about the extra work and anything extra that.

footage or because of extra costs or? A combination.
Speaker 8 (01:29:03):

a minute we don't owe you twenty. Five grand, they're
saying we'll pay you when we. Get, Paid.
Speaker 8 (01:29:45):
Yes but in the contract that we made between each.
Other's companies he was supposed to pay me every five.
HUNDRED feet i didn't have a contract with the person.
Speaker 17 (01:29:57):

soon as you.
Speaker 5 (01:30:48):
Lean it as soon as you, lean it the homeowner
or the business owner is going to.
Speaker 1 (01:30:52):
GET involved i. Get it what first, and foremost let's talk.
About this was it for a private? Residence? For where was?
It commercial what was the? Fence for what kind? Of,
properties okay so?
Speaker 8 (01:31:05):
Commercial property it was a security fence and closed?
Speaker 9 (01:31:09):
A property?
Speaker 1 (01:31:10):
Got, it now the question is why aren't you why
didn't you take a take out a? Lean already.
Speaker 8 (01:31:22):
Because to, my KNOWLEDGE and i was trying to be
Fair because i'm a new contractor with both of. These
companies the major company said they pay out in. Sixty,
days yeah so as of. SIXTY days i was trying
to be fair with them because that's what.
Speaker 1 (01:31:40):
They Promised And, Stixon Stones stixon stones is working for
the general contractor and you're Working For, stixon, stones, right, yeah,
yeah okay so really.
Speaker 5 (01:31:55):

a notice and intent to and you gotta do. It
soon you are coming out on some really important deadlines that.
Speaker 1 (01:32:05):
Don't, move yeah you got to do a. Lean man
as soon as you.
Speaker 5 (01:32:10):
Lean that, commercial property they're gonna go running and screaming
to that contractor and you're gonna end up getting paid
and they don't have a defense.
Speaker 1 (01:32:18):
To it get. IT fence i.
Speaker 8 (01:32:21):
Understand that that's that's that's Currently what. I'm, getting, READY
good i guess my question, is yes because of all
the damage that has happened from that point in time,
to now like what kind?
Speaker 13 (01:32:35):
Of damage.
Speaker 8 (01:32:37):
So my business insurances have lapsed both my life.
Speaker 1 (01:32:41):
Now you're not you're not going to get them to
pay any. Extra, damages man that that's not Gonna be
you're you're saying because you weren't paid, on time you
have a number of, different damages that that's never. GONNA work,
i mean, you know, because hey what kind of fence?
Was it just out of CURIOSITY and i agree with
(01:33:02):
you one.
Speaker 5 (01:33:02):
Hundred percent time you lap at you you last lapsing
on insurances and there's.
Speaker 1 (01:33:08):
Nothing there but what kind of fencing? You do all
fencing or what.
Speaker 8 (01:33:14):
CHAIN leading? I?
Speaker 1 (01:33:16):
DO security? I do how let me ask. YOU that,
i mean so you're saying this one job kept you
from paying? Your bills is that what it boils?
Speaker 8 (01:33:24):
Down, to, well YEAH because i haven't Been able i've
been waiting for.
Speaker 13 (01:33:30):
A payment i.
Speaker 1 (01:33:31):
Understand that but. It's presumed it's assumed. In business it's
assumed in business that you have the wherewithal to pay.
Your bills and if, you ever business. Couldn't exist if
businesses were held responsible for the domino effect of not paying,
a bill it could never happen because it's assumed that
(01:33:55):
you have enough money to conduct. YOUR business.
Speaker 8 (01:34:00):
I, understand THAT and i Guess what i'm saying IS
because i thought THE contract.
Speaker 13 (01:34:06):
I get what.
Speaker 1 (01:34:07):
YOU'RE saying i get what. You're Saying but i'm saying
is you're Gonna waste you're gonna waste money trying to
go after damages for. Non payment i've never even heard.
OF that, i mean really, and truly you need to

Five Five so anne has a problem with a goat
(01:35:24):
farm and what the heck is?
Speaker 13 (01:35:26):
Going?
Speaker 1 (01:35:26):
On, hi anne what's?
Speaker 26 (01:35:30):
Going on, MY husband i have a goat dry and
we've been having some issues with the Color of.
Speaker 1 (01:35:36):
Apartment Of, public health, what like what's going on?
Speaker 26 (01:35:39):
With it they when we had a grade, day license
they would come to the farm and take milk samples,
every month and one month they told us one of
the items that they test for that we were over. The,
limit well What is we have done our own independent
testing for ten years now and it just, so happened
(01:36:00):
and that we had sent our test out about the
same time that they came and took.
Speaker 1 (01:36:04):
Their samples and and who is, they again what's the
agency that governs? Goat farms it's for.
Speaker 26 (01:36:11):
Us as the color Out a Department Of.
Speaker 16 (01:36:13):
Public health and then tests.
Speaker 15 (01:36:15):
They did.
Speaker 26 (01:36:17):
They take samples, of milk and they do, bacteria, testing
okay test, for coliforms and they do somatic. Cell counts isn't.
Speaker 5 (01:36:25):
It possible that they would take their sample that could
be high and you took a sample from another goat
or from somewhere else and it's low.
Speaker 26 (01:36:35):
And it comes out of the, bulk tank so it's
all okay from all. Them together so.
Speaker 1 (01:36:40):
They say that the bacteria or whatever they were, checking
for you were over, the limit and what what? Is
it what is the what is the consequence?
Speaker 26 (01:36:50):
Of that, they basically at, the time we were sent
a notice of intent to suspend our license and we
were told to fix it or they would shut.
Speaker 1 (01:37:02):
Us, down yeah.
Speaker 26 (01:37:05):
So that so the consequence would have been that we
lose our livelihood because this is this is a sole
income for.
Speaker 16 (01:37:15):
My, family okay so what Did you what.
Speaker 1 (01:37:18):
Are the steps you take to lower the? Bacteria count, so.
Speaker 26 (01:37:23):
Well there There wasn't it wasn't. The bacteria it was
a sematic.
Speaker 25 (01:37:26):
Cell, count okay what does?
Speaker 1 (01:37:28):
That mean just tell us what. That, means basically it's.
Speaker 26 (01:37:31):
Basically an indicator of, animal health like if an animal has,
mess sitis they're going to have.
Speaker 1 (01:37:36):
A high smel and it's Called, somatic okay somatic? Cell count?
Speaker 13 (01:37:40):
Got?
Speaker 26 (01:37:40):
It okay so this this after, This happened so we
gave them the results from our. Independent lab they told
us that they would, Have nothing they wouldn't look. At
it they didn't want to have anything to do with
it because it WASN'T an fda Approved lab and they
(01:38:01):
told us their law doesn't. Make mistakes by.
Speaker 1 (01:38:03):
The way by, the way and it's not unusual for
places to have this kind of conflict where they have.
Their own it happens sometimes with water and other things
where the state will say, one thing and, you hire
and you hire, your own but they don't have to accept. Your,

Speaker 1 (01:39:56):
DRUG test, I mean i don't find it surprising. At
all you're right that they won't, accept, it right they
don't have to. Accept it for, my gosh they're they're.
The state but what what can? She? Do now that's.
The thing where where do you stand? Right now and
did they do you have a license? To operate what
do they take away if you fail? A test what
(01:40:19):
what is it that?
Speaker 17 (01:40:19):
Your license we?
Speaker 26 (01:40:21):
Are licensed.
Speaker 27 (01:40:22):
We have did you lose?
Speaker 15 (01:40:24):
Your?
Speaker 1 (01:40:24):
License no we, Did, Not okay so where does it stand?
Right now so here's.
Speaker 26 (01:40:31):
What happened we have we found our inspector helped us
FIND an fda. Approved lab so every month he pulled,
split samples he took one back to.
Speaker 17 (01:40:41):
The state we sent one.
Speaker 26 (01:40:43):
TO an fda approved lab. Every month our results are
three times less than what comes out Of The.
Speaker 17 (01:40:48):
State lab so why how's?
Speaker 1 (01:40:50):
That possible?
Speaker 17 (01:40:51):
Full?
Speaker 26 (01:40:51):
Time now for, cow milk they have, a machine they
put it in, a computer it does it? Go milk
they cannot use that machine for they have to. Do
it the tech has to do count the. Slide themselves
and we were The only grade eight. Goat dairy so
there's nobody else to, compare to nobody else for them, to,
(01:41:12):
say hey maybe we have. A problem so they just
put it all.
Speaker 1 (01:41:16):
On us so do they refuse to acknowledge that they
are doing? Something wrong why does your independent lab which
IS also. Fda approved let me get that, straight right
YOU'RE Independent fd now does the state TAKE that fda
approved lab?
Speaker 26 (01:41:36):
Or not now let's kind of go fast Forward to
july of. Last, year june the manager who is the
one that we've had the issue with all, this time
the one that told us he was going to shut,
us down he actually came to collect our milk samples
and he admitted to us while he was here that
(01:41:57):
the state lab results.
Speaker 17 (01:41:58):
Are inaccurate, all right so what?
Speaker 1 (01:42:01):
About it what's where does? This? Stand, well.
Speaker 26 (01:42:05):
So when this initial thing happened and we were threatened
until we were going to get shut down. By them
we immediately started giving half of our. Animals antibiotics we
had to dump milk until the antibiotics cleared from. Their
system we have our Vet, and bault we have all
these antibiotics. We're buying this whole thing just cost us
(01:42:28):
so much money and lost us so much money in
products sales because we were dumping milk from half of
our hurts for.
Speaker 22 (01:42:34):
A month.
Speaker 26 (01:42:36):
We just want to know if there's any way for
us to get reimbursed for what they.
Speaker 22 (01:42:42):
Say since they would not listen.
Speaker 1 (01:42:43):
To, us well let's ask you this to. Begin with
do you still have to do that or are you
finally within limits with the? State? Test wait so we only.
Speaker 26 (01:42:53):
Had one failure even though, there results even though their
results are always three times higher.
Speaker 17 (01:42:59):
Than us a long time we Had a.
Speaker 26 (01:43:00):
Grady license we just had that one issue and that
was not an issue with us that.
Speaker 1 (01:43:06):
Was there so you want, To know i'll guarantee, you
man without even Looking the state's not they're immune. To
prosecution he plays a part in that. Big time if

Tom martino here the show three oh three seven three
three seven one three eight two. Five five what's going
on in? Your, Life well i'll tell. You what we
got a situation here where a woman owns a gold
farm and said that the state lab was showing, some
erratic uh some testing that, was inaccurate causing her to
(01:44:53):
be in danger of losing her certification. Or license she
had an independent lab say the. State's wrong, she said
she went through considerable expense trying to satisfy, the state
and she wants to know can she sue the state or?
Recover EXPENSES and i looked up the state website and.
Absolutely not they're governed by all state labs are covered by.
(01:45:17):
Sovereign immunity and they said even negligent testing, is covered
meaning if somebody did something negligently and caused her tests,
to fail they would not. Be, liable however if it
was malicious and, they, said hey let's take her, license
(01:45:38):
away let's do something really bad that might. Be actionable
but and From everything, i'm reading it's truly going to
be almost impossible to collect damages from the state for
their lab and why their lab shows different than your,
independent lab and why it just started happening, THIS year
(01:46:01):
i don't understand it or last. Year late and that's
the public health.
Speaker 5 (01:46:05):
And environment these are the same people that mishandled so
many rate test kits and other Things. In, colorado toime it's, absolutely.

going to do anything. About it that's the probest. GOAT thing,
I mean, i mean, you KNOW and i didn't mean
anything by That except i'm just saying that what difference
does it make what the test? Results were it. DOESN'T matter,
i mean if she told us it was a hair
or if she told us, it wasn't it. Doesn't matter
(01:48:09):

Not true that's, Not True, chris night ninety. Two hours that's, Not, True.
Chris okay there is a way to do it the,

act and if you don't do, it exactly if you
don't do it exactly the way it's, laid out there
is no clock, that starts and they can, evict you
(02:00:49):
and most likely in, mold cases they're going to evict you.
Right now renters have a hell of a lot of
rights in, this STATE and i suspect because of the
way the, date is they're going to eventually attack this
mold problem because so many people complain, about mold but
there is no standard for mold. Right now there is
(02:01:10):
no standard of habitability, for mold and there's no way
to say if you're right or if, they're right or
if you're wrong and. They're wrong so it's going to
be A big it's going to be a. Big Fight,
but chris you can expect they're going to probably. Evict, you.
Speaker 7 (02:01:26):
WELL so i.
Speaker 11 (02:01:27):
Had already this is actually. What happened tom is through
communications over a thirty day period with, my landlord HE
started R and r and he actually started to negotiate.
With me, he said you can keep the thousand dollars
you kept for Rent in December in june toward toward
that you don't know us. ANY money i got that,
in writing and then it give me another thousand dollars
(02:01:50):
to vacate within twenty four hours because he said. He
couldn't he was going to switch me to another Unit
while i'm still in hotels and, he said you're determining
that he couldn't guarantee my health would improve in any.
Other unit he offered me another thousand dollars to sign.
A release i refuse to sign. The release he put
(02:02:11):
the onus for testing the unit with.
Speaker 9 (02:02:13):
Mold, on me we'll.
Speaker 11 (02:02:15):
TEST him i got the results back after all of.
THAT period. I yead i looked at. THE statute i
figured he owed me hotel expenses and.
Speaker 9 (02:02:25):
Per damn well.
Speaker 1 (02:02:26):
He doesn't, he doesn't. He doesn't he only owes you
if you went through the. Entire, process chris what you're doing,
is excellent by, the WAY and i am actually very
encouraged that the landlord negotiated. With YOU if i, were
YOU and i don't know why you wouldn't sign. A
(02:02:48):
release what's the? BIG deal, i mean you're not going to?
Speaker 11 (02:02:52):
Find release, and WELL because i have asthma DIAGNOSIS that
i never had before until?
Speaker 1 (02:02:57):
Too, Much, okay chris then you're gonna have to go.
See it then then you're gonna have to go see
a personal. Injury attorney what's happening is exactly what. Should
happen they offered, you money you decided you didn't. Want
it now you're going to have to go to a
personal injury attorney and see if they'll take.
Speaker 11 (02:03:13):
THE case i didn't sign.
Speaker 9 (02:03:15):
THE release i took.
Speaker 11 (02:03:16):
THE money i just didn't.
Speaker 1 (02:03:17):
Sign, them oh, hold on you took, The money so
now you're out of. The lease is? THAT right.
Speaker 8 (02:03:24):
I took.
Speaker 11 (02:03:24):
The money they ended the lime out of.
Speaker 21 (02:03:26):
The.
Speaker 1 (02:03:26):
Lease good, but okay so then what so what are? You?
Calling so what are you calling? About now then if
you got paid and you're out of, the lease that's
that's more than most. People, Get chris i'm going to
tell you that, right now what do? You so what
are you calling?
Speaker 25 (02:03:42):
About now i'm CALLING about i.
Speaker 11 (02:03:44):
Put him i'm taking them to small. Claims court The
court gator is In februarycause i'm looking for the rest
of the per diem and. Hotel, EXPENSES okay i had
you incur while he kept.
Speaker 1 (02:03:54):
Screwing around and you, know what you're just gonna decide this,
is good this. Is good you're doing the. Right thing
so what is your question? For us because if we
want to know how?
Speaker 2 (02:04:05):

Speaker 1 (02:04:05):

receipts receipts.
Speaker 1 (02:04:27):

you you're going. To win i'm not telling you it's.
A guarantee but because all this guy has to say
is it wasn't. That dangerous it, Wasn't this it. WASN'T that,
i mean do you have the, mold count the mold.
SPORT count?
Speaker 8 (02:04:45):

in the in the state statute about ninety two dollars
a day.
Speaker 7 (02:05:45):
Per diem but here's.
Speaker 1 (02:05:46):

statute but don't tell the. Judge that but you. REALLY didn't,
i mean you didn't take the. Proper steps there were
a whole bunch of steps you were supposed, to take and,
you just first, of all you left ahead of time
and stop paying rent ahead, of time and you're not
supposed to. Do that but don't tell a. JUDGE that
(02:06:08):
