Speaker 1 (00:05):
Ripped off, news, need advice, who you don't have?
Speaker 2 (00:12):
Come, run in just as fast as we can.
Speaker 3 (00:15):
Shooter's gonna help.
Speaker 4 (00:18):
Come man, This is the Troubleshooter Show.
Speaker 5 (00:22):
No Tom Martino, Welcome, Welcome, my friends to the only
show of it's kind. We're here to solve problems, answer questions,
take complaints. Our golden life is to make your life
just a little bit better. The show's very simple. If
you've been ripped off, or if you got a problem,
We've getten a lot of landlord problems lately.
Speaker 6 (00:40):
Any problem whatsoever we want to hear from you.
Speaker 5 (00:42):
The phone number is simple three oh three seven, one
three eight, two five five or three oh three Martino.
And that second one three oh three Martino works all
the time, day night.
Speaker 6 (00:54):
Sometimes we answer the call when we're not on the show.
Speaker 5 (00:57):
But no matter what, you can leave a message and
I've promise we'll get right back to you. A couple things.
Number one, I want to talk about this real quick.
We had to call her yesterday and I forget her name, Kelly,
who was the lady with the said she had two
squatters a net, so a net called yesterday, I received
(01:20):
an email from this person and I'm trying to pull
up the email and basically, this person I guess is
who they were talking about. I'm not going to use
his name, but he goes on to say, blah blah blah.
Speaker 6 (01:37):
You know, she's lying.
Speaker 5 (01:38):
A net Gonzalez is doing nothing but lying, lying, lying,
And I'm kind of paraphrasing, but he says, let me
be clear, this is not a case of a squatter.
This is a documented case of a landlord who has
failed to legally evict a lawful tenant. Now what's interesting
(01:59):
about this? As I started looking up this address and
a couple things. One, it doesn't look I can't find
who owns this house, which is crazy.
Speaker 6 (02:11):
And there was also a foreclosure.
Speaker 5 (02:14):
Listed on this house at one point, but I actually
have the auction number. It was going to go to auction.
That's how far it wasn't the foreclosure. But all of
a sudden, there is no auction. That auction that was
listed is no longer there, the actual auction idea is
not there. So I'm a little perplexed on what's going
(02:36):
on with this. So I would love to figure out
with the NET why she called in and left out.
Speaker 6 (02:44):
All of this other information. Kelly.
Speaker 5 (02:46):
To me, this is absurdity at its best. She actually
called in now listen, I'm sure there is some dispute here,
but it sounds like, at least according to county records,
she doesn't even own the damn house right now.
Speaker 6 (02:59):
Whether or not it's in foreclosure, I really don't know.
Speaker 5 (03:04):
I have a lot of things I found, and I'm
talking just research on the Internet that says it's in foreclosure.
But when I go to the actual auction site where
it's supposed to be listed, it actually has an auction ID,
but it's not there. So I'm just blown away. But
once again a case where we get a caller in.
You should have heard her yesterday, Brian Burns Compass Insurance Welcome,
(03:26):
but my goodness, this woman was like, oh, they're keeping
me out of my house.
Speaker 6 (03:30):
I don't even think it's her house.
Speaker 5 (03:32):
I honest to god, I don't know if she's trying
to get belongings out of there, But talk about leaving
out information. I mean, this might be the worst case
of that I have heard of in a long time.
Speaker 6 (03:44):
Mark, Yes, since you someone get a restraining order on
her too.
Speaker 5 (03:48):
Yeah, whoever's in there, I think got a restraining order.
Speaker 7 (03:51):
Now.
Speaker 5 (03:51):
Listen, I'm not saying whoever's living in that house should
be there.
Speaker 6 (03:55):
I don't know. I simply don't know.
Speaker 5 (03:58):
And I would love for them to come on the
air and give their side of the story.
Speaker 6 (04:03):
But reading the email, I don't think he wants to.
Speaker 5 (04:05):
But you know what, I think I'll give Kelly the
information and see if he does want to come on.
Speaker 6 (04:10):
You know, you don't have to come on.
Speaker 5 (04:12):
And your idea of a legal notice to us is
just absurd. I can have an opinion on any damn
thing I want.
Speaker 6 (04:19):
Yeah, maybe, well hold on, maybe that really sucks for you,
whoever you are.
Speaker 5 (04:23):
And I'm not even going to use your name unless
you want to come on. But some kind of weird,
threatening thing is crazy. Why don't you just say, hey,
that lady's full of it.
Speaker 6 (04:33):
That's it.
Speaker 5 (04:33):
That's pretty simple to say, and it appears as if
she is.
Speaker 6 (04:37):
It's kind of crazy.
Speaker 8 (04:38):
Mark.
Speaker 7 (04:38):
I think with someone hears from a radio show like this,
it kind of gets scares them.
Speaker 6 (04:42):
They get on the defensive.
Speaker 9 (04:43):
You know.
Speaker 5 (04:44):
Well, I'm sure they do, but my god, I do
believe them. I do believe them. He's basically saying, this woman,
Annette is basically lying. He's saying, I'm not a squatter,
and she did she attempted to.
Speaker 6 (04:59):
Do some kind of improper eviction.
Speaker 5 (05:01):
I assume the court saw it his way, and truly
the house is off the market. I have no idea,
uh if the I don't know who owns this damn house.
I can't put it any other way. And I would
love to get to the bottom of this. So we
are going to try to reach out to this person
off the air and see if they'll share some damn information.
Speaker 2 (05:24):
Bo.
Speaker 5 (05:24):
Maybe I'll have you make that call off the air
over to him if I got his phone number. If not,
we'll have to email him. But I'd love to get
that information. That's what we do here. We get both
sides of the story and we try to get all
the information out.
Speaker 6 (05:37):
But I would love to know what the hell is
going on, because she was so adamant, so adamant that
it's her house and blah blah and everything buddy's against
me and blah la la la la da. We've heard it.
We've heard it a.
Speaker 5 (05:50):
Thousand times, all right, Brian Burns, Compass Insurance is in
the house. Two lines open three oh three seven one
three eight two five, five, three oh three, Martino. I'm
gonna jump right to the phone. Hey, Colleen, What is
going on with you?
Speaker 6 (06:03):
Colleen?
Speaker 10 (06:06):
Yes, I have some neighbors that live right across the
street from me. Now they got a restraining order saying
that I'm arresting them. The choes on the opposite foot,
they are the ones that stood in the harass.
Speaker 11 (06:17):
Especially the sun.
Speaker 10 (06:18):
I cannot sit out on my front porch love at
jokes I see on the ray on my phone, work
in my yard without them being a moles. I've been
arrested four times just for calling them cowards and liars.
Speaker 6 (06:31):
Oh my god, four times. You've got to tell me.
You have to tell me a little more.
Speaker 5 (06:36):
Like Okay, First of all, you brought up jokes. You
brought up You're out on the front porch, either listening
to jokes or telling jokes. Give me an idea of
the jokes. Do they find them offensive? Is it more
of a political right versus left thing?
Speaker 6 (06:51):
What is it? I mean, give us some real information.
Speaker 10 (06:55):
You know, TikTok's got these old folks jokes.
Speaker 11 (06:59):
Yeah, have you seen them before? I haven't sitting out
of my book.
Speaker 10 (07:03):
I'm sitting out on my front porch and stuff, and
I'm looking at them and I'm laughing because I'm trying
to keep from losing my temper. I'm seventy six years old,
almost seventy seven. The two neighbors that are giving me
prober father and son. The father is in his sixties,
the sons in his forties. The son's grabbed his crotch
in front of me, you know, did like the finger
(07:25):
across the throat, like you know the knife routine, pointed
a little pistol at me, which turned out to be
like a little pellic god, and shot my windshield out
of my car. I'm not sure it's them because I
didn't have cameras at the time. Now I've got cameras
and they don't do it, but they're still harassed me.
Speaker 5 (07:43):
Hey, Colleen, why are they harassing you? And I want
you to put yourself in their shoes? Where do you
think they're coming from? I really want to have some
kind of understanding of where this feud began.
Speaker 10 (07:55):
This feud began when now the father went and told me,
he said, because I've lived here before they were but
I guess they lived.
Speaker 11 (08:00):
Here before me.
Speaker 10 (08:02):
And the father told me and stuff that when he
lived here before, people looked at him as the mayor,
and he told them what to do and they abided
by his rules. I said, don't look at me, I said,
you know, I'm on my own. I'm n the roads
of an exttructor.
Speaker 4 (08:15):
Where is this?
Speaker 6 (08:16):
Is this like, Colleen? Colleen? Colleen?
Speaker 5 (08:19):
Is this like a apartment complex? Is this a neighborhood
like with single family homes? Described? Describe the distance?
Speaker 10 (08:29):
Okay, it's it's a trailer like a trailer park.
Speaker 6 (08:33):
Wow, I would have never guessed that.
Speaker 10 (08:36):
Yeah, I know, it's hard to believe tailor trash can
act this way, but they do.
Speaker 2 (08:41):
So.
Speaker 6 (08:41):
I mean, so you're out.
Speaker 2 (08:43):
What was so?
Speaker 6 (08:44):
You said something that scares me a little bit? Here?
Speaker 5 (08:47):
They were out and arrested you four times. So police,
that would make most people listening think that you're the problem.
Speaker 10 (08:57):
Well, see that's what they're trying to get people to believe.
Speaker 5 (09:00):
I'm talking about the police. So what was the last
time the police showed up? And what happened? Why were
they called? Who called them, and what ultimately happened?
Speaker 6 (09:10):
Tell me that. Let's start there.
Speaker 10 (09:13):
Okay, Now, there was a community of garage sale up
at the little grocery store we got in this time.
Speaker 11 (09:18):
I live in Buyer's, Colorado. Got it, And I seen
all the intention.
Speaker 10 (09:23):
When I was going up to get me some stuff
from the grocery store, and I drove through, you know,
outside of all these kents rats.
Speaker 9 (09:31):
To say what it was.
Speaker 10 (09:33):
Well, I rather in and got my groceries that I
wanted left out of there.
Speaker 11 (09:38):
Came mom down, you've got my hubs off.
Speaker 6 (09:41):
You've stopped yourself. Listen.
Speaker 5 (09:43):
I know I asked you to tell me the story,
and here I am interrupting my bad but you stopped
two times and hesitated. Hold on, hold on, hold on,
hold on, Colleen, you start listen to my question. You
stopped two times during that story so far. And you
were going to say, I went to the store to
get and you stopped, and then you replaced it with
groceries twice. What were you getting?
Speaker 10 (10:07):
I was getting some vacant for my breakfast.
Speaker 6 (10:09):
Okay, fair enough, you.
Speaker 11 (10:12):
Know, And anyway I was took.
Speaker 10 (10:16):
I went and took my dogs for a run and
dropped them up. Went back over there because I've seen
some stuff at this little garage type thing, got it
that you know I wanted to check out.
Speaker 11 (10:27):
Well, I go to those things Tuesdays and Thursdays as
far as old.
Speaker 10 (10:31):
People are learning how to diet right and exercise and
finances and stuff like that.
Speaker 11 (10:37):
With the job.
Speaker 10 (10:38):
One of the girls, one of the girls that's in
my costs, was there a man who started talking and
we were walking through the base well. All of a sudden,
father comes up to me and he said, get it
in one hundred feet of us. You can't be here.
Speaker 11 (10:50):
We're having you arrested.
Speaker 6 (10:51):
Oh my goodness.
Speaker 5 (10:52):
Wait wait, wait, because they already had the restraining order
at that point, right, yes, okay, hold on, I gotta
take this break. I'm dying to know why they originally
got a restraining order. I think I probably said what
happened last time. I wasn't thinking that it would be
restraining order related. I want to know how we got here.
(11:13):
Did you threaten him? Did you pull a gun on him?
What actually happened to begin? This is what I want
to hear when we get back. Everybody, Hold on, this
is important.
Speaker 12 (11:27):

But real quick, I got to tell everybody out there.
Frank Durand the real estate Man. He is the best
realtor I've ever met in my life. He got us
much more for our model home in Red Hawk Castle
Rock than you could ever imagine. He did such a
(12:19):
great job. He got a bidding friends. He going, we
made more money on that house, or I should say,
sold it for more than that same model anywhere else
in the neighborhood. Then he negotiated so well on the
new helm we bought in frank Town it was unbelievable.
Check out Frank Durant Holmes dot com. He sells more

(12:41):
Now I'm gonna go back to Colleen. She's got a
big problem. Basically, she has a restraining order against her. Colleen,
let me ask you this. On the restraining order, is
it temporary or did you end up going to court
and they have a permanent restraining order on you?
Speaker 10 (12:57):
I really don't know how long the thing is. Show up,
be truthful with you.
Speaker 11 (13:01):
Oh, I know the other time I turn around, Like, listen.
Speaker 6 (13:05):
I really we got to focus a little bit. I
really want to help you.
Speaker 2 (13:09):
One.
Speaker 6 (13:09):
Do you have a copy of the restraining order?
Speaker 12 (13:13):
No?
Speaker 10 (13:14):
I got the paperwork that the cart gave me.
Speaker 6 (13:16):
Yes, can you send that to us?
Speaker 5 (13:19):
Do you have a way to email that to us
so I can look at the court order?
Speaker 10 (13:25):
Tom Now, I'm terrible when it comes to computers.
Speaker 2 (13:29):
Yeah.
Speaker 10 (13:30):
Now, if you said, like your email address, does it
have like a little thing in the corner where I
can send the picture?
Speaker 6 (13:37):
Yeah?
Speaker 5 (13:38):
So we're gonna work on that. In fact, we're going
to work on that in a minute. I'm gonna have
Suzanne deal with that. We're going to try to get
a copy of that. But I'm going to assume right
now you have a restraining order that is past temporary status.
So what originally happened here?
Speaker 6 (13:52):
How did this?
Speaker 5 (13:53):
What was the initial problem where you guys got into it?
The cop showed up and he ended up with a
protection or.
Speaker 10 (14:01):
Well, first it started out, now I want to take
my dogs for a run.
Speaker 11 (14:05):
The sun was in his forties, drove up. Why he
grove up.
Speaker 10 (14:11):
There, I don't know, because he's got.
Speaker 11 (14:12):
Nothing to do up there, and.
Speaker 9 (14:14):
He blocked the road.
Speaker 10 (14:15):
Well I want to go around him. At finally got
around and picked my dogs down when them came back.
Next thing, I know the cops ahead to meet.
Speaker 6 (14:23):
This, So listen, we got to get him.
Speaker 5 (14:26):
Listen, bro, I just had to blank out the last
ten seconds.
Speaker 6 (14:30):
Of all of our lives because you use the sah word.
You're on public airwaves. You cannot do that.
Speaker 5 (14:37):
If you do it again, I'm not going to be
able to help because I'm not going to tolerate it.
Speaker 6 (14:41):
Are we on the same page?
Speaker 10 (14:44):
I think I know what words you're talking about.
Speaker 6 (14:47):
Well, I would hope. So it was the cossword you used. Huh, Colleen, Colleen,
let's go back to it.
Speaker 5 (14:58):
So basically they're saying, while you were walking your dog,
you got in front of the guy's car.
Speaker 6 (15:02):
Is that what they're saying.
Speaker 5 (15:04):
I still don't understand why the cops would come out,
and you're saying they came out that day and gave
you the restraining order. Yes, so it simply doesn't happen
that way. It doesn't happen that way. It doesn't happen
that way. You don't walk your dog and basically someone
calls the police saying you're impeding them and a cop.
Speaker 6 (15:26):
Shows up with the restraining order. It doesn't Colleen, it
doesn't happen that way. How did it happen? Why is
your restraining order?
Speaker 10 (15:38):
This is what I'm trying to tell you. And I
didn't I wasn't walking my dogs. I was driving my
dogs up to take them for their run.
Speaker 6 (15:46):
Colleen, I don't care. A cop does not have a
restraining order in his pocket.
Speaker 10 (15:52):
Mister Martinez, you know as much about this.
Speaker 11 (15:55):
As I do.
Speaker 10 (15:56):
I don't know why.
Speaker 6 (15:57):
Okay, listen, listen, here's the deal.
Speaker 5 (15:59):
I have to have Colleen's I have to see something
from the police department.
Speaker 6 (16:04):
For whatever reason. She's making no sense.
Speaker 5 (16:06):
I could call the cops right now and say Deputy
Doc assaulted me and they show up. They're not going
to have a restraining order in their pocket. I'm just
trying to help you, Colleen. Believe it or not, me
screaming and yelling?
Speaker 6 (16:20):
Is that a frustration? For God's sake? I want to
know what happened. I really do.
Speaker 5 (16:26):
Then we actually have attorneys, Colleen, We actually have attorneys.
It might get involved if you're in the right, but.
Speaker 6 (16:33):
I have to know what the hell happened. Police officers
do not carry blank temporary restraining orders in their pocket.
There must have been something that happened before that.
Speaker 11 (16:48):
It went through the courts.
Speaker 10 (16:49):
I don't know why it happened.
Speaker 5 (16:51):
Okay, here's what we're gonna do. I know what if
it went through the courts, this is going to be easy.
Cheezy Suzanne. Yeah, hop on Colorado courts and all the records. Kelly,
get all the information from this guy or this girl.
Speaker 6 (17:04):
I'm sorry, first and last name and date of birth. Kelly.
Speaker 5 (17:07):
Well, yeah, Colleen, hold on, We're going to help you
figure out why you're in this mess.
Speaker 6 (17:12):
Okay, we're going to help you figure out.
Speaker 5 (17:14):
Kelly's going to ask you for some information and we're
going to reach out to an attorney. We're going to
reach out to the courts, and we're going to figure
out what's going on. So, I mean, that's where we're
going to go with that. Now, NICKI, what is your question?
Speaker 6 (17:32):
Hey?
Speaker 7 (17:32):
NICKI, Oh, I'm so sorry.
Speaker 14 (17:34):
Didn't hear you say my name?
Speaker 6 (17:35):
No, no problem, what's going on?
Speaker 14 (17:38):
I had reached out to you guys actually at the
recommendation of my brother in law who has worked with
Tom Martine I guess in the past, and I was
reaching out to see if you guys any recommendations or anything.
My heater ac unit is dying on me. I think
it's original to this house, which I think was built
in eighty three.
Speaker 11 (17:58):
Oh my goodness, I know, and honestly it's truper.
Speaker 14 (18:01):
It's really it's it's trying. But in the you know,
in the summer, it just freezes, it doesn't could the
house down very well. And now that I turned the
heat on, I think it was Monday when it was
kind of chilly, and it just the heat would not
kick off and running.
Speaker 6 (18:15):
Yeah, okay, so we had go ahead.
Speaker 14 (18:18):
Oh sorry, I was Unfortunately, we had somebody come out
and look at it and he said it's so old
at this point kind of just needs to be replaced.
Speaker 5 (18:26):
Oh my god, did you get your money's worth out
of that or whoever bought it, I mean nineteen eighty three.
That's that's actually remarkable. Did they give you a bit
on a new one? Whoever came out?
Speaker 14 (18:37):
Well, my husband I had had someone come out like
five years ago, because we knew eventually it was going
to go out, you know, and they had told us
back then it was around like thirteen thousand.
Speaker 4 (18:46):
Yeah, which you have ever conditioning too, Yeah.
Speaker 14 (18:50):
It's a dual thing. Yeah, and I unfortunately lost my
husband back in October.
Speaker 6 (18:54):
Oh my goodness.
Speaker 14 (18:56):
Yeah, and so and then I have like a special
needs child. So like right now, financially, I just I
simply cannot afford a fifteen thousand dollars unit.
Speaker 6 (19:02):
Well, let me ask you this. How's your creditor? Can
you afford payments on it?
Speaker 14 (19:07):
No, my husband actually filed bankruptcy right before he took
his own life back in October of last year.
Speaker 6 (19:12):
Oh my god, I'm sorry to hear that. Did you did?
Speaker 5 (19:17):
I'm not trying to just okay, let me ask you this.
Were you part of the bankruptcy?
Speaker 7 (19:24):
Yes?
Speaker 15 (19:24):
I was?
Speaker 6 (19:24):
Yeah, And when was it? You said?
Speaker 9 (19:26):
When we filed it?
Speaker 14 (19:28):
And we are sorry we had to refill it because
seven because he had lost his job last year.
Speaker 6 (19:36):
So what is your credit report right now?
Speaker 7 (19:39):
Oh?
Speaker 14 (19:39):
I honestly, I'm not even sure.
Speaker 5 (19:41):
I haven't really well, I mean since the bankruptcy. I mean,
I assume you haven't accumulated any more debt on credit
cards or what have you been laid on thim?
Speaker 14 (19:51):
No, I have a car payment that we had bought
because they needed because I had the car got taken
because of the bankruptcy. You know. Yeah, so I have
a car payment, but that's up to date. That's the
only thing I have payments on though.
Speaker 5 (20:01):
Was everything up to date on that? In other words,
have you been that was after the bankruptcy? So have
you made every payment on time on that?
Speaker 11 (20:11):
Oh?
Speaker 2 (20:11):
Yeah?
Speaker 6 (20:12):
Was there any credit cards you've used that you've done
the same with?
Speaker 5 (20:16):
No, I don't think your credit I don't think your
credits as bad as you're thinking. I'm trying to think
who I want to call on this for financing. I mean,
you're not going to get a free furnace. I don't
know of anybody that's going to give you a free furnace.
Speaker 14 (20:31):
But oh yeah, no, And I know I didn't know
if you guys maybe had some recommendations or anything on
how to kind of.
Speaker 16 (20:36):
Get that going.
Speaker 6 (20:37):
How much do you make a month? How much could
you afford for a payment, maybe like.
Speaker 14 (20:42):
One hundred or one hundred and fifty dollars. I don't
make very much.
Speaker 6 (20:45):
You know what. Let's get on. Here's who I want
to get on. Hold on a second.
Speaker 5 (20:49):
I want to get on somebody from fix It twenty
four to seven. So let's get on. Who should we
get on from over there? Suzanne, Hannah Hannah. Let's give
Hannah a heads up though. I want her to understand
what the question is and the circumstance this woman's dealing with,
and whether or not she can get her financed.
Speaker 6 (21:11):
We can get Hannah whatever information.
Speaker 5 (21:14):
She needs, but basically we need to reach out before
I get Hannah on the air to talk about it.
We've got to give her the circumstance. So here's what
I want to do. Kelly, get that Lady's get Nicky's information.
Free up that line, Nicky, hold tight. We're going to
make some calls and figure something out. So let's just
we're going to call you back when we have a plan,
(21:35):
or a plan of action at least, so everybody hanged tight.
Hopefully after this break we have an update from Susanne
on Colleen. We'll see how quick Dad goes. And then
we've got a problem with mister Electric. For goodness sake,
I have no idea who that is. And then John
has a tax question that and a lot more. Everybody
hold tight.
Speaker 12 (21:59):
With a sure thing Denver's Best Roofer Excel Roofing dot com.

Speaker 5 (22:34):
All right, three o three seven one three eight two
five five. Hey, we had a caller, Doug saying they
might be able to help Nikki out, and then they
dropped off.
Speaker 6 (22:43):
I would love to know what that was all about.
We would love to get her some help, especially because
of the situation she was in. So Suzanne did some
research on Colorado coourse dot com. Let me pull Colleen
back up. Colleen, Wow, so it looks like January. What
was the date, Susan.
Speaker 7 (23:02):
January twenty eighth was the day the harassment charges were filed.
Speaker 5 (23:08):
So what happened back in January? What was the harassment?
I don't know, Colleen, you must.
Speaker 7 (23:16):
Have so much state it was January twenty first.
Speaker 5 (23:20):
So on January twenty first, something happened. I highly doubt
your neighbor just called the police for no reason whatsoever
and ended up with the restraining order against you.
Speaker 7 (23:32):
It's yeah, it says you had harassment, insults, taunts, and
challenges charges against you.
Speaker 6 (23:38):
Colleen, Yeah, so.
Speaker 5 (23:39):
Be straight, like what were you saying? And then the
other thing. I'm just going to come out and ask you.
So if this isn't politically correct, I apologize. But you're
you're on there twice one on a lot of the
charges back in January.
Speaker 7 (23:53):
No, no, not in January. But last year there was
some protection orders and at Stayed she was a may.
But this year at Stays you is a female in
your charges. So I was just a little confused. If
there's two of you out there, are we looking at
the same person.
Speaker 5 (24:09):
Did you transgender or why is your two different sexes listed?
Speaker 10 (24:14):
I haven't the fogus notion. I'm seventy six years old.
I've been a woman all these years.
Speaker 6 (24:21):
That is so weird.
Speaker 5 (24:22):
Maybe it's a completely different person, same name, same birthday,
same birthday, same name, no ways or addresses.
Speaker 7 (24:30):
I guess it's possible bio mark, or I'm.
Speaker 6 (24:33):
Reading the document wrong. Is probably I'm the typo. Probably
that's incredible.
Speaker 5 (24:38):
So she had Colleen, So last year you had issues
with the restraining order as well, Susanna.
Speaker 6 (24:44):
Is that correct?
Speaker 4 (24:46):
Yes, it's showing for a while.
Speaker 6 (24:49):
Yeah, it's showing.
Speaker 7 (24:50):
There was a protection order, two different protection orders last
September twenty twenty four.
Speaker 6 (24:56):
But that you said those were dropped, it looks like it.
Speaker 7 (25:00):
It looks like they were drop mark but these were
The wording is kind of confusing. And then there was
some protection order violations, and then there was I guess
it's kind of showing them not in chronological order. But
then there was a harassment charge in January, and then
protection order violation.
Speaker 5 (25:20):
It happened in January. It doesn't sound like you went
over and punched anybody, Colleen. It sounds like you might
have been using racial slurs or some form of slurs.
I mean, there's got to be something whether or not
you did it. Why do you think they're accusing you
of it.
Speaker 10 (25:37):
One of my neighbors came up to me and said,
these guys are what.
Speaker 17 (25:42):
They call it.
Speaker 6 (25:45):
Watch your p's and q's.
Speaker 10 (25:47):
Yes, I am, I am?
Speaker 11 (25:48):
I what did we call the Klan?
Speaker 5 (25:53):
The KKK? Yeah, there's a white supremacists.
Speaker 10 (25:59):
People will say that the supremacist. I keep telling him.
I said, dah, I hear you guys are supremacists. I said,
you know, neighbors are telling me this.
Speaker 6 (26:08):
So you basically said hey, So basically you wait a minute,
you're basically saying, hey, other neighbors told me you're part
of the KKK or white supremacist.
Speaker 11 (26:17):
I mean, no, I didn't say that KKK.
Speaker 10 (26:20):
I was trying to finding the word supremacist, okay, but
that you were supremacist I did. I didn't say anything
about the KKK. Now what I hear you you're a supremacist.
Speaker 5 (26:30):
Now, what was the relevance of that, Colleen, What was
the relevance of saying that?
Speaker 6 (26:35):
Though? What did the neighbors tell you? Like, I mean, do.
Speaker 5 (26:38):
These folks have swastikas on their forehead. What are we
talking about here?
Speaker 10 (26:43):
No, just I guess the neighbors that got it offered
out the internet on what Craig was saying about, you know,
his background, and they said, yeah, he's a supremacist. And
I had six of my neighbors tell me that.
Speaker 5 (26:57):
Okay, So then you asked them, Okay, hold on, I'm
understanding now, Colleen. So you kind of asked them about
it or told them about it in your way. So
what happened after you said that? Did they get in
your face or what happened?
Speaker 10 (27:12):
No, they never said a word to me. It was
later on after they filed the restraining order that they would,
you know, the sun would do like the knife across
the throat, the thing, you know, figure, we just swiping
across your throat like you know you're gonna get knife
and pointing the gun at me and Dinny Brunn and
Hyde the minute I'd grab my phone to take a
(27:33):
picture of him, and I'm call him cowards.
Speaker 11 (27:34):
And liars and cry babies.
Speaker 5 (27:36):
Okay, hold on a second, let me let me get
up our attorney. I I I got to go to
the next level on this. Hey, Joelzera. Wow, Wow, I
need your help on this one, man.
Speaker 13 (27:47):
So here's I need more.
Speaker 5 (27:49):
Yeah, Colleen, you got a zipp it or I got
to put you on hold. So, Joe, here's the bottom line,
or somewhat of the bottom line. We looked up Colleen's
criminal record because she has no idea why there is
a restraining order and it's not a TPO.
Speaker 6 (28:03):
It looks like it's in place.
Speaker 5 (28:05):
And the most recent thing that happened, Suzanne, she broke
the restraining order?
Speaker 6 (28:11):
Or when was that?
Speaker 7 (28:12):
Well, the most recent protection order violation was September twenty
ninth of this year at twenty seven.
Speaker 5 (28:19):
Yeah, so like a week and a half ago. Joe,
she breaks the restraining order. I assume she's got a
court case that'll be coming up for that. But she says,
I have no idea why this went down in the
first place, and getting the story out of her always.
Speaker 6 (28:34):
Circles back to what I just said.
Speaker 5 (28:36):
But what we can tell is something in January twenty
first happened, and Colleen said she was basically telling them
they're white supremacist or other people. She was quizzing them
about that. I guess there was kind of a verbal altercation,
and eventually shortly after that a restraining order was put
on her, and then there's been violations. Colleen, how far
(28:58):
away do you live from these neighbors across the street.
How many feet are we talking about? It's a trailer
part to Jo, to give you an idea.
Speaker 10 (29:07):
Yeah, they're just a little dirt road, which is a
Cheyenne street. They're just this little dirt road and that's
about as far as it goes.
Speaker 5 (29:16):
Okay, So, Joe, Joe, here's what happened on the twenty Joe,
here's what happened on the twenty ninth of September when she,
you know, basically broke the law. She went to check
something out in town. I don't know if it was
a flea market or whatever, and these people happened to
be there as well, and they called the police and said, hey,
(29:37):
we have a restraining order Colleen's here, and then she
had the violation. So two questions for you, without getting
too much more into the weeds, And Joe, I hate
to do this to you. I am right at the break.
Can you hold for a minute, please, sure? Yeah, And
let me give you the questions to ponder though. How
can she get rid of this restraining order. And if
a neighbor has a restraining order for one hundred feet
(30:00):
two hundred feet, what do you possibly do when your
trailer's next to theirs. And then the third question is
what kind of remedy can she seek in order to
get rid of the restraining order? Because according to her,
I mean, we're really talking a free speech thing, although
I really doubt it. So everybody hold tight. We're gonna
find out what our attorney has to say. Right after this.

Speaker 5 (30:56):
All right, three oh three seven one three eight two
five five one line. Oh been, Joe Lazara, Please, I
asked you the questions what are Colleen's options now? She
broke her restraining order rules. I kind of told you how,
but it doesn't matter. It just happened a week ago.
What can she do now?
Speaker 1 (31:14):
So if she has a criminal charge for violation and
protection order, that they're going to have her restraining order
in effect from that criminal case, so she can try
and modify the terms. Obviously it's going to allow, you know,
the ability to enter and exit your premises. Sure, and
if you're living within her you know the one hundred
(31:36):
yards that they typically prohibit with regards to a civil
protection order. She should have you know, that person should
have been served, had the opportunity to appear at a permanent.
Speaker 6 (31:47):
She didn't show up. She didn't show up.
Speaker 5 (31:50):
Just looking at the court record, what happened was there
was some kind of altercation on the twenty first of January,
and then around I think it was to twenty eighth,
the restraining order was put in place the TPO. I
don't know when the permanent was done, but considering it's
been what you know, nine months, I assume they got
a permanent or at least how does that work? Is
(32:12):
it usually permanent or is it usually like a one
year or what.
Speaker 1 (32:17):
Usually, once you served a temporary protection order, two weeks later,
you have a hearing. At that hearing, it's generally made permanent.
The court has the ability to extend it on its
own motion, but generally it's made permanent at that point
in time.
Speaker 5 (32:31):
What do you think she's facing with breaking that restraining order?
Speaker 1 (32:36):
Curi's potential jail?
Speaker 16 (32:37):
Absolutely?
Speaker 5 (32:38):
Oh my god, Colleen, Colleen, you could be facing time
for violating that order a week ago.
Speaker 6 (32:46):
You could be going to jail.
Speaker 10 (32:49):
Yes, I know. May I interrupt.
Speaker 5 (32:52):
You for just Colleen, Well, let's just talk reality. You
could be going to jail. You need to get an
attorney at this point.
Speaker 6 (32:59):
You can't just go in there calling you about Okay,
this is scary stuff. I'd be terrified if I was you.
Speaker 10 (33:08):
Mister Martius, may say something.
Speaker 11 (33:10):
Please, Yes, now, what what I'm calling.
Speaker 10 (33:13):
You for is, yes, I do need to get an attorney. No,
I cannot afford an attorney. The problem is is that
I can't stand out of my front porch. I can't
work in my yard without them harassing me. I've told
him stop harassment.
Speaker 12 (33:27):
That's it.
Speaker 5 (33:28):
Joe, Joe, Okay, so Joe, you heard what they said
or what she said. So now what, I don't see
any difference in what she just said from the circumstance
at hand.
Speaker 6 (33:38):
But maybe I'm not listening with my ears.
Speaker 1 (33:43):
Yeah, I mean, unfortunately, Colleen is prohibited and prohibited from
having any violation of that protection or she can't violate that.
But the other side could look at her, make gestures,
do whatever. She just can't respond. Obviously, she can call
the police and report that.
Speaker 16 (34:01):
But otherwise as a kid, yeah.
Speaker 5 (34:04):
It doesn't do any good because you're the one that
has a restraining order, Colleen. Now they're gonna give you
an attorney. They're gonna you can request an attorney. You
better do it, and you better show up before they
put a warn out for you.
Speaker 6 (34:16):
You're in real trouble.
Speaker 10 (34:19):
I show up every time.
Speaker 5 (34:21):
You told me, okay, when you showed up to fight
the restraining order, the temporary restraining order, what happened.
Speaker 10 (34:31):
They just said, go me ahead of Tenney's classes, which
I did. It turned around at it. They start running
their mouth again, especially the side.
Speaker 5 (34:42):
So I understand where she's hold on. I understand where
she's coming from, Joe. I mean, basically, she's saying she
goes out. Now they have the restraining order. She's saying.
The kid looks over and you know, brings his finger
across her neck and makes gun gestures.
Speaker 6 (34:56):
I mean that sucks, but I mean I don't.
Speaker 5 (34:58):
Know what she possibly does if she's facing the violation,
not him.
Speaker 6 (35:02):
Hold on, that's the music. I have no choice.
Speaker 5 (35:05):
If Joe can stay, I would love if he could
stay and talk about it. But if he can, I understand,
and Joe, I promise how I'll give out your information.
He's one of the best criminal attorneys in the state
of Colorado, and I appreciate his time. Hopefully he can
hang on, but I have the music here. We get
a lot coming up.

oh three seven one three eight two five five.
Speaker 12 (36:29):
Uh.
Speaker 5 (36:29):
We got some updates we're gonna do in a minute.
But I got to hop back to Joela's era.
Speaker 6 (36:34):
He was kind enough.
Speaker 5 (36:34):
Joela's aire is one of the best criminal defense attorneys
out there. In fact, I always say this in his
uh ass Joe, I always say, put his phone number
in your phone now, because the last thing you want
to do is end up arrested and have to google
attorneys near me.
Speaker 6 (36:50):
That would be insane.
Speaker 5 (36:52):
But just to recap real quick, the bottom line is
Colleen has a restraining order against her. She violated it
last week. She's going to have an up and coming
court date. She can't afford an attorney. She's very pissed
off that she goes out in front of her trailer
(37:12):
and the people with the restraining order, that live across
the street, make gestures, scream at her and everything else.
Speaker 6 (37:19):
So what can she do if anything? At this point?
Speaker 1 (37:25):
You know, the best hope she has is she can
videotape it, she can call the belief, but the likelihood
of them actually doing something is small. And unfortunately she's
a prisoner. Why the restraining orders in effect?
Speaker 6 (37:39):
And she said she went to classes? Is that normal?
Speaker 5 (37:42):
In other words, if something happens here's an altercation and
it's the first time and basically I get a restraining
order against me, I go to court, they can give
you classes.
Speaker 1 (37:54):
It sounds like that's from the criminal.
Speaker 5 (37:55):
Case I got it, So that's nothing to do with
what's going on here. But because she violated the restraining order,
even if it was civil, that becomes a new criminal case.
Speaker 1 (38:08):
Yeah, it almost sounds like there's a prior criminal case
that she led to or was convicted in a new
criminal case.
Speaker 6 (38:15):
Oh my goodness, Colleen's going to be in big trouble.
Speaker 5 (38:18):
I really feel bad for If the facts are what
she's stating, How hard is it to get a restraining order?
Could I simply call up right now and get a
restraining order against Deputy Bow for example.
Speaker 1 (38:32):
Well, it definitely gets sim but in reality, h you
have to not only show somebody you've been armed or
assaulted or threatened or stalking and without the restraining order
being placed in the fact that do you need that
restraining order to prevent it from happening in the future.
Speaker 6 (38:52):
Ah, this is crazy. I mean yeah, so, Colleen, I
don't know really what else to say. If if you've
got another question for our criminal defense attorney, fire away,
But I mean, really, you're just going to have to
let this court play out now.
Speaker 10 (39:10):
Well, you know that's what I call it was because
I wanted to get a restraining order against them.
Speaker 11 (39:15):
So if they stop harassing me, which.
Speaker 10 (39:19):
In my agency, I'm not going to stit there and
have somebody you don't make comments to me without saying
something back. I mean, I put up with it for
so long, but I want them to quit harab.
Speaker 6 (39:30):
Hey, Colleen, you're but you have to do it.
Speaker 13 (39:33):
Colleen.
Speaker 5 (39:33):
You've got to understand you're being your worst enemy right
now if they're making gestures that you've had. Yeah, but
you don't want another violation. My god, before this one, Joe,
have you ever seen that happen someone violates, it's suppending,
it's appending court case, and they violate.
Speaker 1 (39:50):
Again absolutely time it's a neighbor.
Speaker 6 (39:56):
Colleen, listen, can she called?
Speaker 5 (39:58):
Do you think they would give her a restraining order
against them at this point?
Speaker 6 (40:03):
Or no way?
Speaker 1 (40:05):
I think it's possible, especially with some of the gesters.
It's enough of battle, but I think it's as well
try it.
Speaker 5 (40:14):
Yeah, the local police, whoever's responding out to that trailer
park Colleen just doesn't believe you for whatever reason. So
once again, I mean, you know, I hope everything works
out for you, but I don't know where else to
go with it. I mean, it's a horrible circumstance. I
think you're bringing a lot of it on. I have
never shouted out to my neighbor. Are you a white supremacist?
(40:35):
That's probably not the neighborly thing to do. So you
probably threw a little gasoline over the period of time
to get this rolling. But it is what it is
right now. Any other thoughts on it, Joe or that's
about it?
Speaker 10 (40:50):
Yeah?
Speaker 1 (40:50):
I would video date. But number one thing if there's
an issue, just going side.
Speaker 5 (40:55):
So if someone could afford an attorney like you, And
I'm not saying you're super high price. That's not that,
but Colleen can't afford a pack of cigarettes. So what
I'm really asking you is these are kind of cases
you take all the time.
Speaker 1 (41:11):
With violation protection order?
Speaker 5 (41:12):
Absolutely, And then is this something you would do flat
rate on? How does it generally work? We know on
a lot of DUIs you'll do a flat rate cost.
Someone gets in trouble, you call them up, you help
them with the DMV case, you help them with the
criminal case.
Speaker 6 (41:26):
I get all that, and you'll do a lot of
that at flat rate.
Speaker 5 (41:29):
But something like this where you actually are going to
end up in a courtroom, it sounds like, how does
that work?
Speaker 6 (41:35):
You do flat rate on that? Does that revert to
an hourly No.
Speaker 1 (41:40):
We flat rate everything. Every criminal case. It's flat rate
is single day.
Speaker 5 (41:45):
So if somebody out there gets into an altercation with
their wife, domestic violence or child abuse or virtually murder
or anything literally, you will come up with a flat
rate and a payment plan. Yes, that's incredible. Why do
you do that? I'd never heard of that. You always
hear of like thousand dollars an hour or whatever. What
(42:07):
is your motivation for that?
Speaker 6 (42:09):
Just to be a little more affordable or let it
or let yet, really, what's your motivation? I love it well.
Speaker 1 (42:16):
I think the number one thing it gives a client
and expectation. This is what might bee is whether we
go to court one time or a hundred times, it's
the same fee, and so they know what they can
count on. And at the same time, we're not spending
a lot of time billing clients for you know costs. Hey,
I read an email and billing it for ten minutes
(42:37):
of time.
Speaker 6 (42:37):
That's crazy.
Speaker 5 (42:39):
Any of us that have dealt with attorneys, I haven't
really dealt with a criminal defense attorney, but I've dealt
with a ton of attorneys. They charge for every phone call.
I mean, really, everything is clocked. They have software out
there that does nothing but track billing time for attorneys. Joe,
I absolutely love that, and I hope everybody really understands
more criminal Yet, most criminal defense attorneys charged by the hour.
Speaker 6 (43:03):
In other words, the dui.
Speaker 5 (43:04):
If you want to go to court and fight it,
that could be thirty five thousand dollars, where if you
want them just to cut a deal, it could be
five thousand dollars. But Joe's saying, hey, no matter what,
we're gonna talk and I assume the initial consultation is
one hundred percent free.
Speaker 6 (43:22):
Absolutely, and then they're gonna talk to you, right, They're
gonna talk to you the attorney.
Speaker 1 (43:27):
Yeah, absolutely, we want to talk to him. We sit down,
we go over everything with him, and then if they
want to retain us, we get started on our days.
Speaker 6 (43:34):
I love it.
Speaker 19 (43:35):
Can I ask a question, Yeah, Joe, what would it
cost approximately for Colleen to hire you to get a
protection order or restraining order against the neighbor?
Speaker 6 (43:45):
Oh?
Speaker 5 (43:45):
My god, he'd have to have so much more information
than that, bough. I mean, okay, I mean really he
has to look is this her second offense or third offense?
Speaker 6 (43:53):
Is she up against jail?
Speaker 5 (43:55):
I mean really, does she have any evidence like videos
of them flipping her off and through their life with gestures.
Speaker 6 (44:01):
I mean there'd be a million things. Am I crazy?
Speaker 2 (44:04):
Joe?
Speaker 4 (44:06):
Yeah?
Speaker 1 (44:06):
I mean obviously we want to get a feel for
what we're getting involved in, and for us getting at
civil restraining order. I don't necessarily do that. She can
do that on her own, but there are attorneys that
will assist in that. And then as far as the
criminal case, we sit down, we kind of gauge it.
Speaker 16 (44:22):
We have an idea.
Speaker 1 (44:22):
It's simply because we've been doing this thirty two years.
Speaker 5 (44:25):
Yeah, once you have the true conversation with Colleen, then
you would have a good idea of what it's going
to cost, how much time it's going to take in
the outcome.
Speaker 6 (44:34):
I mean really that that's from experience.
Speaker 11 (44:37):
It is.
Speaker 6 (44:38):
Yeah.
Speaker 5 (44:38):
Hey, so Joe, I really appreciate you coming on, coming
on everybody out there. I'm going to say it once again,
like I do in the commercials, put his phone number
in your phone. Most of us aren't in trouble all
the time, but if something does happen, please have the
right person.
Speaker 6 (44:54):
He has been our.
Speaker 5 (44:55):
Legal expert for criminal defense for fifteen years. Bo three
four two nine sixty two hundred.
Speaker 6 (45:03):
Put in the phone. Joe is there?
Speaker 5 (45:05):
Three oh three four two nine sixty two hundred. Uh John,
let me see who's up here. Next we can free
up Colleen. So let me do this. We're gonna have
two open lines three oh three Martino three oh three
seven one three A two five five, Hey John, and
then uh John, with the tax issue. You'll be right
after this, John, Hey John, what's going on with mister
(45:27):
electric and who is.
Speaker 9 (45:28):
That Hi, Dan, Thanks for having me. Yeah, Miss Electric
is just an electrical company in the Springs. Apparently there's
different versions. There's a mister Electrical Danger and mister Electrical COOLK.
Speaker 6 (45:41):
Yeah, I got it. So it's some kind of franchise
I assume.
Speaker 9 (45:45):
Yeah, I believe so.
Speaker 5 (45:46):
Yeah, there used to be something similar was Mister Sparky,
and they were in all kinds of different states.
Speaker 6 (45:52):
So what's going on?
Speaker 9 (45:54):
Well, I h hadn't give me a quote to fool
Electrical to a garage I was having built, and actually
the garage that built, and on August twentieth they started
doing the work as in one hundred and twenty feet
of trenching from the back of my house yep, up
the driveway.
Speaker 16 (46:13):
To new garage.
Speaker 6 (46:14):
Yep, they got a trench. Hey.
Speaker 5 (46:16):
By the way, where were they running it from, John,
your initial power source like in the cul de sac or.
Speaker 6 (46:22):
In the front of your house? Where are they running
it from?
Speaker 9 (46:25):
They're pulling it from the lower end of my house
on the basic where the main break.
Speaker 6 (46:29):
Oh, they're actually pulling it from your house?
Speaker 16 (46:32):
Correct?
Speaker 6 (46:33):
How many what kind of amp service are you putting
in there?
Speaker 9 (46:38):
They put in for what I could see, one hundred
amp service.
Speaker 5 (46:41):
All right, So they ran one hundred amps off of
your actual house over to this garage and they had
to do about it, you said, one hundred, one hundred
and twenty feet of trenching, and then of course they
got a back fill it and they have to have
inspected and all this.
Speaker 9 (46:55):
So what happened, Yes, sir, so they've done all of that,
and you know, we have some hacups, but finally the
inspector came by the last time and approved it. Okay,
so okay, and now the part of the trenches are
washing out, all right?
Speaker 5 (47:11):
Hold on a second, hold on, that's curious. The trenches
are washing out. I wonder if that's going to cause
a problem though, and I wonder if mister electric is
responsible for that. Was it caused by a storm? Did
they not pack it right? I mean, let's find out.
Speaker 12 (47:28):
Hold on, go with a sure thing Denver's Best roofer

durand the real estate man dot com to list your

Speaker 5 (48:02):
We're gonna have some pretty cool updates coming up, hopefully
on this show. That person that wrote us the letter
not to talk about cotton. It wasn't Colleen, wasn't a
NETS issue reached back out. Did you see that, Susan No,
I did not. It says I'll come on, so they're
gonna come on the radio. Basically, a NET called yesterday
(48:24):
and made these horrible accusations and apparently not true that
there was two squatters living in her house.
Speaker 6 (48:32):
They changed the locks, would not let her in, and
the police won't do anything stuff like that. So you know,
I address that the first hour.
Speaker 5 (48:41):
You can go to YouTube dot com look up Troubleshooter Network.
You can hear what I had to say about He
kind of said us a nasty Graham, and I understand why.
You know, he didn't get an opportunity, I guess, although
we always give people an opportunity to give his side
of the story. But honestly, it looks like she doesn't
even own the damn house, which is remarkable that she
(49:02):
called up with that kind of misinformation. So we're going
to get this guy on. His first name is Nick.
I don't know if that's going to be today, hopefully
or maybe tomorrow, and then we're going to read drill Anette.
I really want to know why she called up and
left the fact out she doesn't own it, or does
she own it? She got out of foreclosure and the
(49:23):
paperwork's not done. I have no idea, but there's a
lot going on there. It's a lot different than there's
two squatters in there. That's a lot different. Now I'm
going to hop right back to John. So he has
a problem with mister Electric in Colorado Springs. He hired
this company. When you run a new he had a
(49:44):
garage built or a barn built, something that's detached, and
he had to run electric from his main residence or
his house or his building for that matter, over to
the detached garage. Generally, you dig like a three or
four foot trench, they lay the cable, then you have
an inspector out. And this is very important because John
(50:04):
said the inspector came out and they actually look at
the run before you can actually cover it back up.
They look at the actual run, make sure it's the
right cable, make sure everything's done right. Then after the
inspector signs off on that, then you can of course
compact the dirt and then you know, go from there.
Speaker 6 (50:24):
But you're saying how long ago was that John?
Speaker 9 (50:28):
They started on August twentieth, and they actually filled it
on the second of September.
Speaker 5 (50:35):
And how bad is this trench now? If I was
to look at a picture of it, how much is
washed out?
Speaker 9 (50:42):
Well, it's about a total fifteen feet. It's two little
too areas to get It's about fifteen feet and it's
about two feet deep.
Speaker 6 (50:49):
And what does mister electric say about it?
Speaker 9 (50:53):
He said in his emails and apply to my email
said nothing I can do. I'm not a soil expert. Okay,
Well that blew me away and nothing else washed out.
The only thing washed out were he strangest, And he
says he can't do anything.
Speaker 5 (51:09):
Well, when you say nothing else washed out, you mean
the dirt that has been compacted for years, right right?
Speaker 9 (51:16):
Righty?
Speaker 6 (51:17):
Hey, Brian Burns, hold.
Speaker 5 (51:19):
One John, interesting enough, Brian Burns compass insurance and we're
going to be talking to him about Oh my goodness,
homeowners workman's comp everything going up.
Speaker 6 (51:29):
It's getting crazy.
Speaker 5 (51:30):
But thinking of homeowners, I mean, there's no way he
could put this through his homeowners if he's having these
big washouts after the kind of work he had done.
Speaker 6 (51:41):
I don't see anything there, No.
Speaker 20 (51:43):
Because homeowners aren't going to cover soil in general. I mean,
you know, really, it's it's more directed completely to the house.
Speaker 6 (51:51):
What do you think though?
Speaker 5 (51:52):
So the guy makes a trench and to me it
sounds like it wasn't compacted properly putting it back together.
If it's washing out. Did they do it themselves or
did they call someone in?
Speaker 9 (52:06):
They did it themselves. The guy who did the electrical
was also the guy who was shoveling the dirt back in.
Speaker 5 (52:12):
Do you have do you have a copy of the
contracts you have with mister Electric?
Speaker 11 (52:18):
Yes?
Speaker 7 (52:18):
I do.
Speaker 5 (52:19):
Does it say they're going to dig the trench then
cover it back up? I mean, does it actually show
the scope of work we're discussing.
Speaker 9 (52:25):
Let's see labor materials charge to trench and then refill
the dirt is needed for the project. Six inch win.
Speaker 5 (52:33):
Twenty four and they're leaving you. They're leaving you hanging
now right right, all right? So two things. Here's what
I really want to do. Can you get me a
copy of that contract. I want to look at that,
Tam Susan. I want you to reach out to Scott.
He's the guy that did all of our dirt work.
Speaker 6 (52:52):
Oh yeah, yeah, yeah, okay.
Speaker 5 (52:54):
I want to try to get Scott out, Scott on
and ask them why this would happen. I mean, this
guy knows more about dirt and compaction than anybody I
ever met.
Speaker 6 (53:04):
So John, I'm going to put you on hold.
Speaker 5 (53:06):
It are you've never been to our house, Brian, But
we had a detached garage built. They had to bring
in close to one hundred a hundred loads of dirt,
huge dump trucks to build up about a lot of dirt.
It was so much and Scott literally did it all.
And let me tell you, they come out and do
soil tests, compaction tests because the county, Douglas County wouldn't
(53:30):
sign off unless if it's like ninety nine percent compacted.
Speaker 6 (53:34):
So I want to get an idea from.
Speaker 5 (53:36):
Scott what these people did wrong and how to rectify it.
Speaker 6 (53:41):
And I also want to look at that contract.
Speaker 7 (53:43):
John.
Speaker 5 (53:43):
That's pretty important because I want to see if you know,
in my opinion.
Speaker 6 (53:49):
At least if they need to do this again, well, then.
Speaker 20 (53:52):
Did they warranty it in any way?
Speaker 6 (53:54):
That's I want to look at that.
Speaker 5 (53:56):
And then Kelly, I want you to see if you
can get mister a Electric on so we can talk
to them. Whoever mister Electric is all right three oh
three seven one three A two five five if you've
been ripped off or taken advantage of we have two
lines open. John, I promise I'm gonna come to you

Speaker 5 (55:08):

is your tax issue? What's going on?
Speaker 2 (55:18):
Hi?
Speaker 21 (55:18):
Thanks for taking my call.
Speaker 6 (55:20):
For sure.
Speaker 21 (55:21):
I thought to party because we used to be neighbors
and friends with Mike and Laurie Bassett.
Speaker 6 (55:26):
Oh you know what I'd like to know.
Speaker 5 (55:29):
Whatever happened to Mike. He disappeared on some island. We
haven't heard from him forever.
Speaker 21 (55:36):
Last I heard he's living in the Caribbean.
Speaker 19 (55:39):
Yeah.
Speaker 5 (55:39):
Last I heard he was on an HBO documentary about
uh drinking.
Speaker 6 (55:46):
But anyhow, keep going.
Speaker 21 (55:48):
Yeah, yeah, my wife is really good friends with Lauria cool.
So any yeah, anyway, the reason I'm calling I've really
screwed him, Tom.
Speaker 10 (56:01):
I have.
Speaker 6 (56:04):
Major I R S issue. What's a major issue? Give
me an idea of a major issue.
Speaker 21 (56:09):
Okay, I have a lean on my house for about
a quarter of a million dollars.
Speaker 6 (56:13):
This is a major issue.
Speaker 21 (56:14):
And yeah, that's major.
Speaker 6 (56:17):
And how did you get into this circuit? How did
you get into this circumstance? Was it payroll taxes? Was
there a bankruptcy involved? Give me a little of the
stuff in the rear view.
Speaker 21 (56:29):
Negligence on my part?
Speaker 6 (56:31):
What do you what do you.
Speaker 5 (56:32):
Mean by negligence on your part? Well, you had the
money but decided not to pay it or what?
Speaker 21 (56:38):
Well, I didn't really have the money. I used to
make pretty good money and then I lost my ability
to make money. I got hurt, and so I I
just can't can't you know? I'm living on Social Security essentially.
I've got a small pension about one hundred and six
(57:00):
month from a cold job. I had a King supers
and that's that's my income. I make about twenty month.
Speaker 6 (57:07):
Well, you're probably the perfect You're honestly probably the perfect candidate.
If you have no income? How much? How much is
your house worth?
Speaker 21 (57:18):
About three hundred and how.
Speaker 6 (57:21):
Much is the lean two fifty? And do you own
the house outright at this point?
Speaker 21 (57:27):
Yes, yes I do.
Speaker 5 (57:29):
And the lean is two fifty. I do have a
question on the equity when it comes to the irs.
You know, we have an attorney that knows everything about this.
Let me try to get him on, but I want
to understand a little more of your situation.
Speaker 6 (57:46):
How much did you owe in taxes? And when did
you stop paying?
Speaker 21 (57:52):
About two thousand amerriage, And I'm.
Speaker 6 (57:54):
Just curious, why is there a parrot in the background.
Speaker 5 (57:57):
Why why don't I just talk to that person because
they're answering the questions.
Speaker 11 (58:02):
Oh that's my wife.
Speaker 5 (58:04):
Yeah, let me talk to your wife, because I mean,
I don't know why we're doing it this way.
Speaker 21 (58:08):
Oh now she just left the room, So.
Speaker 5 (58:12):
Okay, Well did she seemed to know the answers. I'm
not trying to be Rutie. I'm just saying she was
answering the questions.
Speaker 6 (58:18):
So, so how long ago.
Speaker 21 (58:22):
Two thousand and Marie?
Speaker 2 (58:24):
Two?
Speaker 6 (58:24):
Oh my god? So in two thousand and nine you
started falling behind. When did they place the lian on
your property?
Speaker 21 (58:32):
I think about three years ago, maybe two?
Speaker 5 (58:35):
Have they leviaged your bank account? Have they wiped out
your bank accounts?
Speaker 21 (58:40):
No, not at all. But I found about the lean
I was going to refinance the house. I kept calling
down to the irs and they said I didn't know anything.
And then I was going to refinance and I found
out I have a lean. Actually it's two hundred and
twenty one thousand and three.
Speaker 6 (58:57):
Have you talked to any attorneys at all?
Speaker 21 (59:01):
I haven't. Okay, the I R s on the sixteenth,
next Thursday.
Speaker 5 (59:07):
Boy, you better be really careful. You better be really
careful there. I want to get our expert on, I
really do. I want to get our expert on and
basically ask him some of these questions. But I think
you are a perfect candidate to basically take a deal
with the irs. The important part is you only get
(59:27):
one shot and you don't want to miss it. So
doing something yourself might not be the smartest option out there.
Speaker 6 (59:35):
You're only going to get one.
Speaker 5 (59:36):
Stab at it, so we've got to kind of figure
We've got to truly figure that out. So let me
do this. I'm gonna get you. I'm gonna put you
on hold right now. I've got two calls we do have?
Is that Scott?
Speaker 6 (59:49):
Is he up? It's yours?
Speaker 9 (59:51):
Mark?
Speaker 5 (59:51):
Oh my goodness, let me do this Suzanne, while I
have you right there. I really want to get on Steve.
I know he's no longer with Larson.
Speaker 6 (59:59):
He's over it. Steve Harris.
Speaker 5 (01:00:03):
I really need to get Steve on attorney Steve for
the other John online.
Speaker 6 (01:00:08):
For it's imperative.
Speaker 13 (01:00:09):
I'll text him right now.
Speaker 6 (01:00:10):
Yeah, this guy could be losing his house. He's got
a meeting with the irs.
Speaker 5 (01:00:14):
I don't want him to put his foot in his
mouth and make his situation worse. Plus, it's great information
to get out there for all the listeners. Hey Scott man,
what is shake and bacon?
Speaker 6 (01:00:27):
Hello? How are you doing? Man?
Speaker 5 (01:00:29):
We have not talked for a while. In fact, last
time we talked, we were thinking a meeting up I
believe in Moab and jumping out of a plane together.
Speaker 6 (01:00:40):
It was a while.
Speaker 7 (01:00:41):
Okay, Mark, Yeah, probably you're talking to Scott with mister
Electric online six Scott Shepherd is online one.
Speaker 6 (01:00:50):
Sorry, but I just I wanted to straighten out there. Well,
thank god this Scott Scott. Now I can I can
say we never were gonna meet in and jump out
of a plane. I'm talking to the wrong Scott. This
is Scott, mister electric that worked with John. Scott.
Speaker 2 (01:01:07):
Let me do.
Speaker 5 (01:01:08):
Let me finish up this other one real quick and
I'll come back to you. You understand why your this
is insane? So I have caller John dealing with Scott
and I have caller John dealing with Scott.
Speaker 7 (01:01:23):
No, no, no, no, Yes, you have one John dealing
with both Scott's. Oh my, so you got John who
has the elect mister electric issue in the Springs. Yes,
I have Scott Sheppard online one as an expert for
the trench dirt work.
Speaker 6 (01:01:38):
Okay, hold on, I've got Scott with mister Electrical find
six for Okay, Okay, I got it. I got it, Scott, Scott,
hold on one second. I'm going to come right back
to you.
Speaker 5 (01:01:47):
Scott Shepard, the guy I've known for years, the guy
we were going to jump out of a plane together with.
You did all my dirt work when I had that
garage built over in Franktown.
Speaker 6 (01:01:59):
Yes, sir, ye let me ask you something. Man.
Speaker 5 (01:02:02):
So John hired mister Electric. They're an electrical company in
Colorado Springs.
Speaker 6 (01:02:08):
They basically did the exact thing that I had.
Speaker 5 (01:02:11):
I forget what electric company I use, but they dug
a big trench and they ran the power line basically
from this guy's house to his new detached garage. And
then the inspector comes out. They look and make sure
the ditches the right depth, They make sure the cable's right.
They the inspector signs off on it. Then you put
(01:02:35):
the dirt back on and recompact it. So after this
company did it, and we, like I said, we're going
to hear from the owner of that company in a minute.
They had some rain, they had other issues, and basically
fifteen feet of this if I recall and John, you
did say about fifteen feet washed away?
Speaker 6 (01:02:57):
John?
Speaker 9 (01:02:58):
Oh, yes, yeah, yes, I think see the trains and
collapsed and actually started digging under the road also from
the bottom of the washed out trains, so Scott would
just stick under there and there's no resistance.
Speaker 5 (01:03:09):
So Scott, from a dirt expert, what do you think
went wrong?
Speaker 22 (01:03:13):
Did they trench or cross a drive or a road
of some type?
Speaker 9 (01:03:20):
Correct or into my house? They trained from my house
to a part of my fame in backyard and then
went into the driveway and then straight up to the
other building.
Speaker 6 (01:03:30):
Did they go under the driveway.
Speaker 9 (01:03:33):
Well through? Yeah, they trained through the driveway, so along
the driveway.
Speaker 5 (01:03:38):
So after they did that, though, did you have someone
was your driveway dirt?
Speaker 22 (01:03:44):
Yes?
Speaker 6 (01:03:45):
Okay, go ahead, Scott, I'm sorry.
Speaker 22 (01:03:49):
Okay, Well, it sounds like the install and everything was good.
It was just a matter of you know, when they
backfuild up they use a trench or a lot of
the times the trench or doesn't get the dirt backfield
completely and compacted. And I you know, I've seen that
a lot of times where people will backfield with the trencher,
(01:04:10):
roll compact it, you know, just run over it with
the trencher. But that's not really getting the dirt down
into the bottom of the trench on top of the conduit.
And eventually, if rain comes down that drive, you know,
it'll go into that trench and then eventually wash out
through the bottom of it if it's on a slope
or something in those lines.
Speaker 5 (01:04:32):
So really you would have and I'm just asking this
gap because I watched you work in my house forever.
Is that something you would basically get the jumping jack
out for?
Speaker 22 (01:04:42):
Yes, yes, backfill you know, half a fill, you know,
half the trench. Jumping jacks through the trench. They've got
a small one if they use the trencher, just fits
the four inch trench line and then backfield the remaining
soil on top and then jumping jack and then smooth out.
Speaker 5 (01:05:01):
Now now fifteen feet if you were to go out Scott,
I'm just saying, if you were to go out and
compactice and make it to where it's not going to
wash away. I mean, honestly, what kind of cost are
we looking at? I know you're not looking at the
scope of work, but what I'm trying to figure out
is this a real big deal. They don't have to
like start over from scratch or anything, right.
Speaker 22 (01:05:23):
No, I wouldn't imagine so, And I would just guess
that this washout happened at the end that they started
the backfill from. Because a lot of times as they're
back filling, a lot of the dirt, you know, gets
pushed in one direction. So just to repair that would
(01:05:46):
be a matter of if there's remaining soil that can
be used again with the trencher trench blade, take it
the other direction, fill that back in and then jump
and jack compact it. You might not have any costs
other than labor or if you don't have the compactor,
rent of a compactor.
Speaker 6 (01:06:03):
But it's not a massive deal.
Speaker 5 (01:06:06):
You don't go out, okay, guys, So here's what I
gotta do. In fact, I apologize to Scott the owner
and mister Electric I assume as the owner he worked
with John there so basically, I have to take this break.
That's the bottom line. I have no choice but to
take this break. I'm hoping everybody can hold on and Scott,
I'm going to go to you Scott from mister Electric
(01:06:28):
when we get back and Scott Shephard Scott's Backo Services.
I personally use this guy if you need dirt work done,
anything you can imagine. This guy's the best out there.
He's got all the equipment. I'm talking. It's like watching
Bob the Builder when you're three. He's got jumping jacks
up to these these machines.
Speaker 6 (01:06:48):
That are earth movers. He's got everything you need.

All right, three O three seven one three A two
five five. I want to go directly to Scott, the
owner of mister Electric. Scott, I think we got a
good picture some of the uh, some of the trench
basically has watched that washed out. Here are you guys
willing to do anything for John? Or where do you
guys stand on this?
Speaker 8 (01:08:00):
Yeah, just real quick, a little background, so obviously I
appreciate Scott's back home given advice. Pretty small company, just
a couple of reviews. We've got to over eight hundred
reviews between my two companies, Mister Handyman Mister Life. We're
about at four point eight on Google. We've tried to
help John repeatedly. What's not being disclosed on the air.
(01:08:25):
John refused payment for a couple of weeks because he
didn't understand the agreement he signed, and there's some disclaimer
there that it started off on the wrong foot. We
actually did go out even though soil is not warrantied
under our services. It's clearly stated we unfortunately really can't
control mother nature. He lives in Florisa. He didn't have
(01:08:48):
a soil sample. I don't think Scott at the other
Scott should talk too much about normal procedures without a
good soil sample, unless he's a soil engineer. Unfortunately, in
John's case, he has a lot of erosion because of
where he lives. He lives on a country farm on
a dirt road and lots of washout. And after we
(01:09:09):
did our work, we had some pretty significant weather.
Speaker 6 (01:09:12):
He said, nothing else washed out? Scott, he said, nothing
else washed out?
Speaker 8 (01:09:18):
No, let me finish, please, because again history matters, So
his first concerns. We went back and we did some
more work on the trench, even though that's truly not
in our warranty and it's fully disclosed that we can't control.
Speaker 6 (01:09:32):
Most He said that damage is caused by I'm sorry
you said that already. I get it.
Speaker 8 (01:09:38):
Yeah, but again, so we did make an attempt the
first time. He had concerns, and then more weather rolled
in and it got worse. He has to accept responsibility.
He lives on a farm with a lot of already
washed out dirt along his property lines, and that damage
isn't being caused by our work, and.
Speaker 7 (01:09:59):
They've tried to fix it once already. It would have
been nice to know that from the caller. Mark.
Speaker 6 (01:10:04):
Well, I don't know. I don't know why I even
care about that. I'm simply asking you, Scott, are you
guys gonna go finish that job so it doesn't wash
out again? Or you're just simply gonna blame mother nature? Sure, well,
let's talk business. Censor show. Well, I got already done
more I tried.
Speaker 5 (01:10:21):
I was told you had to go at noon, so
I have a break. Like literally, I have no choice
but to take right now. I would love to finish
the conversation with you, is why I was trying to
hurry it. But at this point is you can hear
the music in the background, Scott, I have no choice.
So hopefully you stick around and I'd be happy to
(01:10:43):
allow you to finish. But really, I just want to
know if he needs to go out and get someone
else to fix it. If you're not willing to do
anything to me, it sounds like there is a problem.
I realize you don't warrantye the dirt, but that doesn't
mean I want to look at that contract. Hit me

Speaker 5 (01:12:01):
We're here to solve problems, answer questions, take complaints. You
know I got a little riled up over that guy.
I'm going to put up a poll. Please join us
on YouTube. By the way, if you've never done it before,
it's kind of behind the scenes. You can hear us
talk and stuff. But that guy from a mister Electric.
Let me tell you, I disagree with him on a
(01:12:22):
lot of points, but I thought he was kind of cocky.
He couldn't stay past three o'clock or I'm sorry, three minutes.
He made that very clear during the break, so I
wanted to get right to the issue, and he spent
time saying our experts sucktor should watch his p's and q's.
And then on top of that, and that's a guy
I've known forever, Scott. That's all he does for a
(01:12:42):
living is dirt, and he does it better than anybody.
He's worked for Comcast, He's worked for some of the
largest Fortune five hundred companies you can imagine. So, mister Electric,
I don't even know what to tell you in your
eight hundred reviews.
Speaker 6 (01:12:56):
Now to jump to this though, looking.
Speaker 5 (01:12:58):
At the contract, and this is a legal opinion, but
I'll tell you what this is where I go. Looking
at this, you were responsible for performing a twenty four
inch deep trench one one hundred and twenty feet long,
in refilling it with dirt as needed for the project.
This to me implies they must ensure the trench is stable.
(01:13:23):
That's pretty straightforward to me. Now I see what he's
talking about.
Speaker 6 (01:13:27):
He's basically saying, uh, the agreement states that the quoted
price does not include any additional or unforeseen task or
materials which might be necessary to complete the job, meaning
the homeowner be responsible.
Speaker 5 (01:13:42):
So he's basically saying, we need to do more in
order to do it right. So therefore the homeowner should
have to pay more money. Now what I'd like this
guy what was his name against Scott the owner.
Speaker 6 (01:13:55):
With mister Electric. Yeah, Scott. I would like Scott with
mister Electric to also think about this.
Speaker 5 (01:14:00):
That estimate is a fixed price estimate. Okay, it's fixed price.
You're saying you're going to do this for that. So
you thinking this contract that you wrote up is you know,
simply he has no place to stand. I'm sorry, I'm
getting worked up over this. You're absolutely crazy. An attorney
(01:14:21):
would love this. I don't know which way a judge
would ultimately come out, but me looking at this, I'm
telling you right now, this could be read either way.
This is a fixed price estimate you gave him to
do this job. The job was not done properly. You're
trying to blame mother nature, which is crazy. Brian Burns
once again here's the contractor. You're with an insurance company
(01:14:44):
nothing to.
Speaker 6 (01:14:45):
Do with this. But this guy's argument is mother nature
caused it, even though this didn't happen anywhere else. So
let's go back to homeowner's insurance. Would homeowner's insurance cover this?
Speaker 2 (01:14:55):
Oh?
Speaker 20 (01:14:56):
Okay, because again we're talking about it, we're talking about
it being dirt land. Yeah, and you're always going to
see exclusions on homeowner policy.
Speaker 5 (01:15:04):
For landscaping for anything. Okay, So he has no out there.
Here's the bottom line.
Speaker 6 (01:15:09):
I totally disagree with him, and I got to say
in my opinion, in my opinion, listen to me, Scott,
it's my opinion. And yes, even though I'm on the airwaves,
I can have an opinion. And we're in Colorado Springs
on KRDO. I would never use you based upon simply
your arrogance on here.
Speaker 5 (01:15:27):
You wouldn't even stick around to say if you were
willing to do anything.
Speaker 6 (01:15:30):
You came on and told everybody you have eight hundred
great reviews. Well you also have a customer on right
now that doesn't think you're great.
Speaker 13 (01:15:40):
You didn't do anything for John.
Speaker 6 (01:15:42):
I want people's opinion. I would like a contractor to
call me up an electrician, anybody I want to hear
if you would be hanging your hat or the owner
of mister Electric in Colorado Springs is hanging his hat.
Screw the consumer. You said you were gonna do the cable.
Speaker 5 (01:16:02):
You said you were gonna backfill it and make it right,
and it's washing out and you're not doing anything. I
got a certain place in hell for people like you, man,
and I'm sorry, I'm probably going a little overboard, and
I'm doing that for a reason. I think, really you
coming on like that and kind of downing our expert
(01:16:24):
and on top of that not doing anything. Even more importantly,
for John, I think you do owe it to fix it.
Speaker 6 (01:16:31):
And I'm gonna talk about this a lot. Hell, I
might talk about it tomorrow, mister electric, mister Electric, I
got eight hundred reviews. Oh, my company's so great.
Speaker 2 (01:16:43):
Oh.
Speaker 6 (01:16:43):
I see that small guy you have on only got
a couple of reviews. But my guy eight hundred reviews
And I'm great. So the caller must be wrong because
I'm so great. You know, it's mother nature, mother nature
making that stuff wrong. Ah, you're a jerk in my opinion. Yeah,
it's all my opinion listen to that. In my opinion,
(01:17:03):
you're a jerk. Now, I got to take a deep breath.
I apologize. I apologize, and I mean that.
Speaker 5 (01:17:12):
We have another John that called he's got a horrible
tax problem. So in two thousand and nine, John, in
two thousand and nine is when.
Speaker 6 (01:17:20):
Your issues started. You started falling behind on your taxes. Correct,
that's right.
Speaker 5 (01:17:27):
You didn't realize you owed any money, although you acknowledge
you were falling behind. Have you filed every year from
nine to present? Even if you haven't paid taxes, have
you filed or no?
Speaker 2 (01:17:41):
No?
Speaker 6 (01:17:41):
Okay? Then what happened? And I'm recapping for the listeners.
Speaker 5 (01:17:45):
And Steve Sizzeck, he is our expert when it comes
to tax problems. He's with the Harris Family law firm.
So I'm going to bring Steve up.
Speaker 6 (01:17:54):
Steve in two thousand and nine, this guy falls behind,
he owes. Listen to this, it's stagger fast forward to
right now. He tried to refinance to take some money
out of his house. Steve, by the way, welcome to
the show. How are you doing man?
Speaker 16 (01:18:09):
Hey Mark, I'm doing good man. How about yourself?
Speaker 6 (01:18:12):
I'm doing all right.
Speaker 5 (01:18:12):
I have Suzanne running down to grab my blood pressure meds.
Speaker 6 (01:18:16):
But other than that, I'm doing great.
Speaker 16 (01:18:18):
So I would love here and you bring me in
because before it's always entertaining. You're doing.
Speaker 6 (01:18:23):
Good job, Thank you. Well.
Speaker 5 (01:18:24):
So here's the deal man. So this guy John these
tax issues. Now he went to refise how he found
this out. The irs has a lean on his primary
property for two hundred and twenty one thousand dollars. He
has been behind on taxes now for whatever fourteen fifteen years.
So my question to you is, first of all his income,
(01:18:46):
how much.
Speaker 6 (01:18:47):
Do you guys make a year?
Speaker 5 (01:18:48):
And there's a reason I'm doing this, John, Steve needs
some of this basic information.
Speaker 6 (01:18:53):
How much? How much do you guys make?
Speaker 21 (01:18:57):
Twenty nine hundred month?
Speaker 5 (01:18:59):
Twenty nine hundred a month, Steve, I think you know
where I'm going, so ask him the questions that are
pertinent to this conversation.
Speaker 16 (01:19:08):
You know, have you I guess the first thing you
need to do is file these returns. Do you have
you know ten ninety nine or W two income from
from the last twenty years.
Speaker 21 (01:19:20):
I did, but I haven't worked for since I think
twenty fourteen.
Speaker 6 (01:19:26):
This guy got hurt or something. Did you get hurt?
Speaker 21 (01:19:29):
What happened, John, Yeah, I was tell cunning and I
failed on a mountain and hurt my back.
Speaker 6 (01:19:35):
That's okay, That's that's all we need there.
Speaker 5 (01:19:37):
So he hasn't worked for eleven years, Steve, Where does
that income come from?
Speaker 6 (01:19:42):
John?
Speaker 21 (01:19:43):
It's just so security and I have a small pension.
I work for King Sous.
Speaker 6 (01:19:48):
How much is the pension?
Speaker 21 (01:19:50):
It's one hundred and fifty eight eight m.
Speaker 6 (01:19:52):
Or okay, so I mean that's almost nothing. So he
gets one hundred and fifty eight The rest is Social Security.
They have this tax lean on them.
Speaker 5 (01:20:00):
My understanding, just from discussions with you in the past,
he might qualify for you to go in negotiate this
debt down to virtually nothing with payment arrangements. He has
a upcoming meeting with the IRS, and I thought there
was only one shot at this tell us about that.
Speaker 16 (01:20:20):
Well, I don't even think in this particular case he
needs to negotiate with IRS. He just needs to file
his returns. He's not going to owe anything, you know,
based upon what he indicated, he's below the level we
are going to owe any taxes. And so if he
goes back and actually files the returns or shows up
with this agent at this meeting with the completed returns,
they can process those and then those will those zeroed
(01:20:41):
out returns will basically override what has happened with the
IRS is what they've done is they've substitute filed a
return on his behalf. So that's do that. They throw
the book at you.
Speaker 6 (01:20:50):
Where did they come up with it?
Speaker 16 (01:20:51):
Where that comes from?
Speaker 6 (01:20:52):
Where do they come up with two hundred and twenty
one thousand?
Speaker 16 (01:20:56):
Well, if you think about twenty years of returns, even
ten thousand dollars owde for each year without doing interest
in penalties is gonna you know even you know that's there.
There you go, there's are two hundred down right. So
literally they've filed returns for him because he never filed.
There were w twos filed by King see persons. So
eventually the IRS got, you know, one of the fact
that he had saught his returns. They assessed the return
against him for all those years without any deductions and
(01:21:19):
out any credits and no COVID you know, refunds or anything.
So if he goes back and files all these returns,
odds are it's going to be a zero balance O.
They can to remove the Leane. And so by the way,
he might get a refund for the past three years. Hey, John,
given him money.
Speaker 5 (01:21:32):
John, before you had your l cunning accident. Those five years,
how much was the income in the household? Just just something, man,
give me something.
Speaker 21 (01:21:45):
I was making a lot of money. I was making
about three hundred thousand a year until I got hurt.
Speaker 5 (01:21:51):
Steve, does that change and you owe taxes for those years?
Speaker 6 (01:21:57):
That was only two years?
Speaker 5 (01:21:59):
Okay, that's fine, that six hundred thousand did you pay
taxes on? No, Steve, does that change your story? And
let me ask you this, that would is there a
statute of limitations.
Speaker 16 (01:22:09):
Insurance file there is? You would still want to get
the returns filed. I guess we would. You know my advice,
And this would be a case if you were making
that amount of money back then if you would probably
want to engage with counsel because we want to find
out what years they actually assessed the periods against you.
If they were older periods, the IRIS can only actually
collect on any debt for ten years. And so let's say,
(01:22:31):
for example, the periods that were assessed against you were
twenty fourteen. I would say, don't file that return because
guess what, they can only collect on that return for
another year, and it might be why this agent wants
to meet with you soon because they're running out of
time to collect. So it would be in your best
interest to, you know, higher counsel, have them review the
you know, essentially the account transcripts, determine what they've assessed
(01:22:53):
you with and how and why. If it was for
those periods where you made all that money, well, then
we would want to determine what the strategy would be
for either filing the returns and reducing the debt, or
there's also some other strategies for trying to you know,
set up payment arrangements and things, especially if you don't
have any ability to pay right now. We could set
something up where it's like one hundred dollars a month
(01:23:13):
to get you to that that date in the future
where they can no longer collect on that greater bout.
Speaker 19 (01:23:18):
So can I ask, yes, So his wife's income have
anything to do with this because I heard he was married.
Does that affect it at all?
Speaker 16 (01:23:28):
Yeah, don't, don't, Jimmy. You can file jointly essentially with
your spouse, and so depending on her income, you know,
during the periods in question, and now we would want
to have to look at that full financial picture. And
you know, knowledge is power when it comes to do
with IRS, and it sounds like we don't really have
a little bit of you know, much of either, and
so we'd want to dig into you know, current income, Steve,
previous income, what the IRIS has filed and all the rest.
(01:23:50):
It's it's actually a fairly complex case, Steve.
Speaker 5 (01:23:52):
If he calls you, of course affair and wants to
engage with you, I assume the first thing you do
is get basically a pasur of attorney and pull all
the documents from the IRS, his transcripts as long as
they go back, and actually figure out where the hell
he's at, because he has no idea where he's at exactly.
Speaker 16 (01:24:11):
That's the first the first part of any negotiation IRS
is understanding their position because it right now all we
know is that there's a lean bit of file.
Speaker 6 (01:24:18):
So to get to that, so to get to that,
figure that out, So to get to that position with you,
how does that typically work on a cost fee? In
other words, just to get to anything another word, just
to understand the situation, what does that typically run with you? Guys?
Speaker 16 (01:24:37):
I mean we we typically will engage for like a
twenty five hundred dollars retainer, right, and then we'll work
off of that retainer to figure out what's going on.
A lot of times that's it. It's like we figured out,
we give advice and then get you can get taken
care of. Other times, obviously things are more expansive, and
we have to file appeals and we have to go
to hearing, we have to produce financial documentation. But if
(01:24:57):
you're gonna save two hundred thousand dollars, then our fees
are obviously worth it, and our goal is to pay
for ourselves, not only in the reduction of the debt,
but also the reduction of the brain damage. As you know,
Mark is dealing with the IRS. It's horrible, just like
taking attack cammer to your forehead. No, they owed me,
I'm letting for punishment.
Speaker 6 (01:25:14):
They owed me.
Speaker 5 (01:25:15):
This one's crazy. This is a very true story. In fact,
Steve helped me with this years ago. The IRS very
strange circumstance because no one ever, really, no one's ever
in this circumstance. They owed me over one hundred thousand
dollars and it took me two years to get it.
But they did pay interest on it, Steve, they paid
seven eight percent interest, so it doesn't matter. It's done,
(01:25:36):
But it's crazy dealing with them. You stay on hold forever. So, John, honestly,
the best advice I could give you is call up Steve.
Speaker 6 (01:25:44):
And talk to him. Man, he's a real deal. He's
an attorney.
Speaker 5 (01:25:47):
He's not one of these He's not one of these
guys that aren't an attorney that want to engage with
the IRS on your behalf and try to cut a deal.
Speaker 6 (01:25:55):
I mean, this guy knows the rules. So I mean,
I don't know what if you can afford. I don't know.
Speaker 5 (01:26:01):
Much about that part, but you need help. Does he
truly only have one shot at it?
Speaker 6 (01:26:06):
Though?
Speaker 5 (01:26:06):
If he goes in and that negotiates not knowing what's
going on, I would think they're going to roll over
him if they're showing he made six hundred thousand bucks
in two years.
Speaker 16 (01:26:17):
Yeah, it's never a good idea that, you know, go
into an IRS meeting without the knowledge you know about
what's going on with your case, because then they're going
to use that against you.
Speaker 6 (01:26:25):
Right, So, John, I'm not sure you want to figure
that out. John, you have.
Speaker 5 (01:26:30):
You've got fourteen years of taxes to deal with, and
you could possibly be in a very, very, very bad situation.
I truly suggest you call up Steve, but you have
any other questions real quick, because I got to go
to break.
Speaker 17 (01:26:46):
No.
Speaker 21 (01:26:46):
I just need some help.
Speaker 5 (01:26:48):
Okay, here's what I want you to do, Steve Sizzick.

that won't let.
Speaker 6 (01:29:13):
Me in they changed.
Speaker 5 (01:29:14):
The locks. THEY'RE squatters i can't get rid. Of them
and that was basically. The call and she made it
sound like she owned this house and these people she
rented a, room to or rented, something something maybe the basement.
Speaker 6 (01:29:30):
Or rooms i'm not. Even sure she didn't get. Into
that we never got a copy of, the lease which
we kind of asked. Her about but, bottom line here's where.
It went you ready.
Speaker 2 (01:29:39):
FOR this.
Speaker 5 (01:29:41):
I get an email last Night from kelly came in
through help at troubleshooter dot com Or.
Speaker 6 (01:29:47):
Through susanne we checked that email all, the time.
Speaker 5 (01:29:50):
And basically, nick, says, hey, hey hey there's a completely
different side to. This story, in fact she doesn't even own.
Speaker 6 (01:29:57):
The HOUSE so i went OUT and i started doing
some research, last night and, SURE enough i can't affirmatively
say that she owns. A house i can't find any information.
Speaker 5 (01:30:08):
ON it i did find information on a, foreclosure though
a bank foreclosure from not that.
Speaker 6 (01:30:15):
Long Ago but nick.
Speaker 5 (01:30:17):
Is one of the people that has been accused of
squatting in her house that we don't even know if.
She Owns so nick was gracious enough to come on
and shed some light onto. This, story nick what can
you tell us about? This situation is it true you're
squatting in this house or what is?
Speaker 6 (01:30:37):
Going?
Speaker 23 (01:30:37):
On, hi tom thanks for having. Me on the truth
is we are. Not squatting a net quit paying her
bills Around around november of. Last year we didn't, Know
this so we move into this house. SHE gives i
rented out a basement. From her she was renting out
other rooms to. Other people and the truth is we go,
(01:31:00):
in here we're paying rent and the whole time she's taking.
Speaker 24 (01:31:02):
Our money and she's not paying.
Speaker 23 (01:31:04):
Her bills So around may we didn't know this at,
the time But around may the house went.
Speaker 24 (01:31:10):
Under foreclosure we didn't find this OUT.
Speaker 17 (01:31:13):
Until i think a couple, months ago and the.
Speaker 24 (01:31:16):
Whole time we've been fighting.
Speaker 23 (01:31:18):
In court so, let me let me try to try
to clarify some things a. Little bit so she filed
an eviction on us during the period that the house was.
Speaker 17 (01:31:27):
Under foreclosure so when a house goes, under foreclosure.
Speaker 23 (01:31:30):
The landlord at that point loses all. Their rights so
she was filing evictions, on us she's filing protection orders.
On us she's having subcontractors come to the house and
break into. Our places she has my internet being cut and.
Cut off she had somebody come into the house and
cut she can't.
Speaker 5 (01:31:49):
See even if she did own. THE house a lot
of that stuff you. Can't do you can't cut, off
power you can't cut. Off utilities you simply can't do.
That stuff did you guys actually have a lease with
her or is this a handshake which would of course
just make it a thirty day.
Speaker 6 (01:32:03):
A deal what was the? Actual lease so this.
Speaker 24 (01:32:07):
Actual lease was a month to month.
Speaker 23 (01:32:09):
Lease with some long term stuff. In it, got, it
now this was a verbal.
Speaker 17 (01:32:13):
Lease that we have brought to the.
Speaker 23 (01:32:14):
Courts, already Yeah and i'll just let you know when
we took this stuff to court and we went for.
Speaker 6 (01:32:20):
The eviction we won. The, eviction well apparently, you're THERE
so i mean you. Weren't, evicted yeah. That's correct out?
Of curiosity is it? Right now were? You paying were
you paying her at? The time was?
Speaker 5 (01:32:32):
The eviction why did she if she's losing, her house
what did?
Speaker 6 (01:32:36):
She care if you guys were.
Speaker 5 (01:32:38):
In there it seems to me there had to be
something else, going on like a rift inside the home
if all of you were.
Speaker 6 (01:32:44):
Living THERE can i tell?
Speaker 17 (01:32:47):
You something and this is gonna absolutely.
Speaker 6 (01:32:49):
SHOCK you i doubt it not, AFTER today i doubt
it could. Go, ahead well you.
Speaker 23 (01:32:54):
Uncovered SOMETHING that i am absolutely trying to expose, right
now and you did it. On air you looked up
this house and SAW what i call the housing. Shell
game so what they're doing is this house has. Passed
hands the title has has transferred hands for zero dollars
a couple times in. THE past i don't know what's
(01:33:15):
going on with, this house but you are witnessing the
shell GAME that i am trying to bring to federal court,
right now along with all the harassment that.
Speaker 10 (01:33:24):
We're.
Speaker 6 (01:33:24):
Facing, nick.
Speaker 5 (01:33:26):
Nick you're renting how much were? You renting was it
just a room you were renting in.
Speaker 6 (01:33:31):
THE house.
Speaker 23 (01:33:33):
I was renting. The downstairs that very. Good deal she had,
some yeah how much?
Speaker 6 (01:33:38):
Was it how much?
Speaker 24 (01:33:39):
Was it so my part was was eight.
Speaker 23 (01:33:42):
Hundred dollars the other roommates in the house for every
room she was renting for six.
Speaker 24 (01:33:47):
Hundred dollars so she had at.
Speaker 23 (01:33:49):
ONE time i think three separate roommates paying. Her rent
and this is all during the.
Speaker 6 (01:33:55):
Time she's so would, you say, Hold, on, NICK though
i want to understand kind of.
Speaker 5 (01:33:59):
Your endgame so you're talking federal court, ensuing er what is?
YOUR endgame, i mean if can you afford to purchase?
THE house I mean i'm a little confused on what
you're trying to.
Speaker 6 (01:34:10):
Do, Now.
Speaker 17 (01:34:12):
Okay so at, this point, YOU know i know we're
kind of.
Speaker 23 (01:34:15):
Rushing this there's tons of things that have taken place
since Me and i'm talking, multiple violations multiple civil.
Speaker 24 (01:34:23):
Rights violations we're going to.
Speaker 23 (01:34:26):
Federal court and when somebody falls, under foreclosure if there's
any tenants in, the house you fall under a. Foreclosure,
law yeah you got, that, Foreclosed, NICK nick i understand.
Speaker 6 (01:34:35):
All that, in fact you've got to deal with.
Speaker 5 (01:34:37):
The bank usually whoever's foreclosing would reach out and make
you a cash offer to exit the property so they
can get it ready. For sale so but that doesn't
seem to be the case right now because the auction
that was going to be coming up in the foreclosure
has seemed. TO disappear i don't know what's going on
with the state of the house and who, owns it
(01:34:57):
just like. You don't BUT what i am interesting is
what is?
Speaker 2 (01:35:01):
Your?
Speaker 6 (01:35:01):
Endgame though if you do take her.
Speaker 5 (01:35:03):
TO court i don't think she's got a nickel to, give,
YOU so, I mean i don't even she's in Foreclosure for.
Speaker 6 (01:35:09):
God's sake so what are you? Trying to what are
you trying? To achieve a place? To?
Speaker 23 (01:35:14):
Live understood So what i'm trying to achieve at this point.
Speaker 17 (01:35:19):
Is we're standing up for. Our rights if we.
Speaker 23 (01:35:21):
Continue to let people stomp on our rights and take away,
our rights we are going to lose.
Speaker 24 (01:35:26):
Our rights, Right now i'm.
Speaker 23 (01:35:28):
Protecting under, federal law and the net convalves needs to do.
Speaker 24 (01:35:31):
This legally they're refusing to do.
Speaker 17 (01:35:33):
This legally and they're trying to constructively.
Speaker 24 (01:35:36):
Evict me so they're breaking in.
Speaker 6 (01:35:37):
THE house i don't.
Speaker 5 (01:35:38):
EVEN know i agree with you one. Hundred percent she
can't break into. The house she can't turn your. Electricity
off but, once again we're not even looking at not
only the.
Speaker 6 (01:35:48):
BIG picture i.
Speaker 5 (01:35:49):
Get it this is some moral battle, with YOU which
i don't even want to pretend to understand because it's
going to cost you a lot of money. For nothing
but regardless, of that, to me it's it's like you
just want to live in the house for.
Speaker 6 (01:36:01):
A while BUT what i DON'T what i really, don't
GET is i don't even know if she has the
power to start. AN aviction i don't even know if
she owns the.
Speaker 5 (01:36:09):
Damn house like she, said yesterday it's definitely not in.
HER name i gotta take. THIS break i hope you, Hold,
on NICK because i really would like to know your endgame.
To be to be all in all honesty. WITH you
i don't understand it unless you just want.
Speaker 6 (01:36:23):

opinion this is probably not his first rodeo on something.

based upon the conversation we, JUST had i have no
(01:37:22):
idea what his.
Speaker 6 (01:37:23):

Hung up?
Speaker 7 (01:37:35):

Speaker 25 (01:37:35):
What, uh well we got, a, call yeah from somebody
else who lives in the house Nice and annette refuses
to come on anymore because she WENT and i guess
has a litigation against one of the quote.
Speaker 6 (01:37:53):
Unquote squatters the, other person.
Speaker 25 (01:37:55):
So he sent us an email he can't come On
because norman won't.

read it. REAL quick, I mean i have. No idea what's?
Speaker 6 (01:38:08):
Winded, name okay then. Let's, readkiss basically my Name.
Speaker 7 (01:38:12):
Is norman i'm writing in response TO a net recent
call in regarding the Property In. Fort collins i'm not
able to discuss this matter publicly or over the phone
because of a mandatory protection order that resulted from a
wrongful arrest based on false claims made BY. A, net
okay so a. LOT reason i must explain everything, in.
Speaker 5 (01:38:32):
Writing so which, Is Great and i'll tell you what,
he's doing absolutely the. Right thing if he has a
restraining order, against him he should not be talking about this.
Speaker 7 (01:38:42):
On.
Speaker 6 (01:38:42):
Air period and so. We're, done yeah so. We're done there.
Another update i'd love to know what the hell's going
on in. This house let me, tell. You guys so
Here's what i'd really like, to know And, Then kelly
i'll get to.
Speaker 5 (01:38:54):
That UPDATE but i want to know where it all.
WENT south i want. TO know i Don't think nick's
and that's just, my opinion. MY guess i don't know
if he is, or not but it doesn't sound like.
He does and he keeps quoting some federal law or
something that, he's saying when a house is, in foreclosure
nobody's got to. Pay anything and that's simply. Not, true
(01:39:16):
brian you did a, little research what did?
Speaker 20 (01:39:18):
You, FIND yeah, I mean i'm guessing what he was
referring to As The protecting Tenants At FORECLOSURE. Act ptfa,
generally speaking if you're getting foreclosed on and you're running the,
HOUSE out i don't care the, FIRST bank i don't
care who is the lender. That's foreclosing you can't kick the.
(01:39:38):
Tenants out there's a lease, In place they've got to. Continue,
paying generally what a bank will do is, they'll, say,
hey look we really want to take this. House back
this guy can't.
Speaker 5 (01:39:48):
Pay for it anymore of. This girl we'll give you
fifteen thousand cash to move. Out now so they basically
buy out the lease so they don't have to deal.
Speaker 20 (01:39:56):
With it but they have to be. Paying well and
that's exactly. My POINT and i didn't never Hear from
nick if he was or. He wasn't but if he's,
not paying you no longer are are protected By that
act in.
Speaker 5 (01:40:10):
The requirement in my, humble opinion he sounds like A
pro really you hear him quoting these laws in section.
Speaker 6 (01:40:18):
FOUR seventeen i don't have to PAY if i don't.
Want to he had a lot, of stuff, Right, though
nick you had a lot of stuff right landlord's. Out
there you can be mad they're. Not paying you can't
go turn off, the.
Speaker 20 (01:40:30):
Power right Can't do there's certain things that you have
to still follow.
Speaker 6 (01:40:35):
The protocol we, Had.
Speaker 5 (01:40:36):
One tenny you know what. They did they killed the
gas in winter because they people. Weren't paying they got
in a lot. Of trouble you can't. Do that you
can't do anything. LIKE that i would love to Hear
a net if we could reach out there one. More
time she probably HEARD because i saw her on the
line for a While what nick had.
Speaker 6 (01:40:53):
To say so at, this point after talking To a
net Yesterday and, NICK today i am just as LOST
as i was. LAST night i truly do believe at,
one point in, my opinion he was. A squatter.
Speaker 5 (01:41:05):
I do he might have not, been PAYING but i
don't even know IF a net owns.
Speaker 6 (01:41:09):
A house, i mean. It's crazy i'm gonna do a
federal lawsuit. For what how are you gonna pay? For
that you're renting a floor in a house for eight
hundred a month and most likely.
Speaker 5 (01:41:19):
You're not, paying that but you're gonna fund a. Federal

she had gone in to bankruptcy with. Her husband her
husband lost, her jaw, his job.
Speaker 6 (01:45:03):
And oh it's just horrible she has. No heat he.
Speaker 7 (01:45:05):
Committed suicide she's got a little six year old boy
and has. No heat let me tell. YOU something i
talked to her off, the air and it's really heartbreaking
to listen. To her we have fixed it twenty four.
To seven you, know them our, Core Friends. Hannah, george
yeah they're looking into trying to. Help her but the
good news is even if for some reason they're not,
(01:45:28):
able to we have a couple of other options in
the pipeline. For her so stay tuned for an Update.
On nikki oh maybe next week. Or something we should
have more answers.
Speaker 10 (01:45:38):
For her the.
Speaker 5 (01:45:39):
Bottom line is we've got three or four things in.
The hopper she's going to have HEAT that i have
no DOUBT about.
Speaker 6 (01:45:45):
I, Think, so yeah, for sure.
Speaker 5 (01:45:46):
We're trying to get her a, new system either at low,
monthly prices which is a good possibility so she pays
for it, over time or get that one repaired. Comre scenario,
In fact i'm kind of offered.
Speaker 7 (01:46:01):
That, and mark don't, kill ME but i kind of
gave her a heads up that we were helping, her
regardless ONLY because i didn't want her to lose. Anymore
sleep we it's smart enough to, worry about so she
KIND of i, just, said look if this doesn't, PAN
out i know we have other options.
Speaker 6 (01:46:15):
To help so just let's just going to be a
little bit of. A process, you know.
Speaker 5 (01:46:20):
This show's been pretty. Wild today i'm going to go
Back to kelly in. A second we HAD mister i
always want, to Say, mister Sparky.
Speaker 6 (01:46:27):
Mister Electric, mister Electric.
Speaker 5 (01:46:29):
MISTER sparky i THINK they're i Think mister sparky's. Still
around but they were basically electricians that were kind of
tied to a. National FRANCHISE but i Assume mister electric is.
As well we had a caller, call IN and i
really do want to, recap this but the caller called in, and,
(01:46:51):
said hey THESE guys i, hired THEM and i have
a contract that says they're going to. Do this the
guy sent me the CONTRACT and i looked at it
and it is pretty straightforward. The contract in, my opinion
they should do the. Job right that's. My opinion it's
not a, legal opinion but based upon the fact they
don't break, down, parts materials or. Anything else it's a
(01:47:14):
fixed price contract saying we're gonna dig, A trench we're
gonna lay the cable for, new service new electrical service
from your house to. The garage we're gonna do, all
that and then we're gonna cover it. Back, up well
they did, all that and everything was great till. It
rained then when, it rained according to, the caller fifteen
feet of it.
Speaker 6 (01:47:34):
Washed away and we've got one of our experts that we.
Speaker 5 (01:47:37):
Brought on his Name is He's With scott's Bacco and
i've known this. Guy forever all he does is, dirt
work and he does it for massively. BIG companies a,
well trusted best guy you'll, ever. Meet period he's a
friend of MINE and i met him because he was
working for me doing our garage and he just does a.
Perfect job so this guy From mister electric come on
(01:48:01):
and says he can only talk for.
Speaker 6 (01:48:02):
Three minutes he told us that, Off.
Speaker 5 (01:48:04):
AIR so i go right to the question and basically
he spends those three minutes telling me.
Speaker 6 (01:48:10):
How great his.
Speaker 5 (01:48:11):
Reviews are and, you know they're a, great company and
my expert doesn't have that. Many reviews but, you Know
mister Electric In, COLORADO springs i do want to make
sure everybody knows.
Speaker 6 (01:48:21):
Where is just the best.
Speaker 5 (01:48:24):
Electrician ever so he spent three minutes and then basically
doesn't say anything about the problem and hangs up because
he said he could only do.
Speaker 6 (01:48:33):
THREE minutes, i mean. It's RIDICULOUS and i thought he
was being pretty damn cocky the, whole, time, like, oh
why how dare YOU say i did? Anything Wrong because
i'm mister electric and we have eight hundred reviews. Or
whatever he said it. Was, absurd, well Okay, MISTER electric
i have a guy that you just did work with
and the work is not good in, my opinion and
(01:48:55):
it's definitely not good in. His opinion, And yes i'm
allowed to have. An, opinion now what did Mister? Electric
scott yes say so.
Speaker 25 (01:49:08):
You're not going to be shocked. By this he thinks you. Slandered,
him yes and you're going to be hearing from his luc.
Speaker 5 (01:49:15):
That's, great well, GUESS what i have, an Opinion and
i'm going to tell, You. SOMETHING scott i hope you're.

before we had an expert on saying it's not even
that big of.
Speaker 5 (01:50:06):
A fix you basically go out there with the jumpin
jack and get. It done but instead you want to
dig your.
Speaker 6 (01:50:12):
HEELS in i have no.
Speaker 5 (01:50:13):
Idea WHY and i sure appreciate you have eight hundred
great reviews and if YOU'VE noticed i said that.
Speaker 6 (01:50:19):

it's the way, it.
Speaker 2 (01:50:24):

Speaker 6 (01:50:24):

the caller your customer that has a big problem, With
you and on top of that my opinion and comments

Speaker 6 (01:51:05):
Like crap on.
Speaker 5 (01:51:06):
The air, In fact i've got a poll if you
go to our YouTube channel and Put In. Troubleshooter network
we ran. A poll eighty five percent of people listening.
Speaker 6 (01:51:18):
Thought you. Were Cocky now i'm going to. Drop That
Brian Burns. Compass, Insurance, Welcome, Welcome. Welcome welcome it's been a.
Crazy show generally we're. Talking insurance we're going to talk.
Speaker 5 (01:51:31):
Definitely insurance but people that have homeowners, coming up any kind,
of renewal they're going to be in, for it. AREN'T they,
i mean is at the bottom line or is? THIS
year i didn't think we had a lot. Of, hail
no is it bad?
Speaker 4 (01:51:44):
Or?
Speaker 20 (01:51:44):
Not no I'm what i'm seeing is, with renewals it's
not So much i'm seeing the. Prices skyrocket some people's are.
GOING up i don't mean to say that's, not happening
BUT what i see is that coverages are.
Speaker 6 (01:51:57):
Gargling down and.
Speaker 5 (01:51:58):
Explain that in, other words a lot of people remember
the good old days where you'd have one thousand, dollars,
deductible right and a hailstorm would come and you get
a brand, new, roof right either for free or for one.
Thousand bucks those days. Are over those days. Are over
MY deductible, i believe is seventy five hundred or.
Speaker 6 (01:52:17):
Five thousand now.
Speaker 20 (01:52:19):
That might even, be more but that was because, your
request because you have a. Hailproof, roof no, of course,
BUT yeah i would say the norm is one percent
of the. Dwelling limit that's.
Speaker 6 (01:52:30):
The, Norm now so what is that put?
Speaker 5 (01:52:31):
One percent and let's say the, average house According to
Frank dur and the real, estate man is about six
hundred and. Fifty thousand so you have a sixty five
hundred dollars deductive no matter what on wind.
Speaker 6 (01:52:41):
And, hail yeah and that's on.
Speaker 5 (01:52:43):
A house really using, that price that median price that's on,
a house it's probably got a roof that costs maybe
twenty to twenty three thousand for a, Basic ROOF so, i,
mean really you're paying a quarter of the price of
the roof.
Speaker 20 (01:52:57):
Out, of pocket right and on top of the at
a lot, OF carriers i would even say most carriers
are going to an actual cash value or a scheduled
roof is what, it's called once the roof hits. Ten
years so if a roof is over, ten years you'll
see on your policy at renewal with a lot of
(01:53:18):
carriers that it's now going to be a. Scheduled roof
you know what?
Speaker 5 (01:53:23):
Kills Me and i'm, Being, SERIOUS judy i would have
WENT to, i APOLOGIZE but i really wanted to Talk
to brian. About This, so judy if you, Call back
i'll jump right on that, call forhere she's got a question.
On Investing, but brian a lot of people when they
call up to get, a quote and let's take a
Company Like. State farm my son was calling around. Getting
(01:53:44):
quotes you know what. They do they try to sucker
you in with the lowest. Possible coverage, they, say oh
you should get, you know we can get you insurance
for twenty five thousand dollars or that would be your
covers twenty five.
Speaker 6 (01:53:55):
Thousand, dollars well that almost.
Speaker 5 (01:53:57):
COVERS nothing, i, mean really if you ever get hurt
in that car wreck or someone hits you and all
they got is twenty five and all you have is,
twenty five.
Speaker 20 (01:54:06):
It's, horrible well and even more, than that you know
YOU'LL get i. HAD myself i got a letter in,
the mail an advertisement from an insurance carrier, that, said
hey we can ensure you're home for, you know two
thousand dollars. Or something it was, incredibly low AND so
i just just, FOR fun i wanted, to, see yeah what,
(01:54:27):
it was see what this. REALLY was i CALLED and
i asked for. THE quote, i, SAID well i got
this quote for two grand from. THIS house i just
wanted to get a firm quote. On that and by
the time they did the actual Quote and senate, to
me it was seventy eight.
Speaker 5 (01:54:41):
Hundred dollars i'm going to tell you something that's even worse.
Than that, and people you've got to listen. To this
it's imperative a matter, of fact because it happened. To
me BUT luckily I, know brian so our last renewal whenever,
it was it wasn't that, Long.
Speaker 6 (01:54:56):
Ago august it's. Always, on no that was for the cars.
And stuff when was the home it was It. WAS
august i got.
Speaker 5 (01:55:04):
A Quote From state farm pretty much apples, to, apples
yep Compared, to safeco who you have me with apples,
To apples and they were about fifteen hundred.
Speaker 6 (01:55:17):
Bucks cheaper maybe a thousand our homeowners is. Pretty expensive
i'm not even going to. Sugarcoat it. It's CRAZY so
I called brian UP and, I, said brian here. It
is what do?
Speaker 5 (01:55:26):
You think and he gave me the best. Advice ever,
he said you, know what, that's lower it's the. SAME
coverage i go. With it that's what he. Told me
and He goes but and this is where you saved.
My Ass and I've used brian in compass now over
ten years and they're. Very honest if they can't, beat
it they're simply going to tell you we can't. BEAT
(01:55:47):
it i mean as simple. As that you guys will
also make sure they have the, proper coverage which we'll.
Get into but this was the trickiest. Damn thing This Was.
State farm, in fact the office was the one In
Elbert or so if, They're listening i'm.
Speaker 6 (01:56:01):
Still pissed so here's. WHAT happens, i. Said OKAY so
i go. To them brian told me, that's fine just
don't cancel the One with safego. Right now don't. Cancel
IT and i didn't realize this at. The time WELL actually.
Speaker 5 (01:56:15):
I did but even if you don't cancel, it Instantly
the State of colorado is going to mandate they refund
me from the.
Speaker 20 (01:56:22):
New Policy, RIGHT like i could backdate the cancelation as
LONG as i can prove you. HAD coverage, I could
and THAT'S what i was. TELLING you i, was like
you'll be out money temporarily and then you get it
all bat.
Speaker 6 (01:56:32):
All.
Speaker 5 (01:56:32):
Back YEAH so i go ahead and sign Up With. State,
Farm okay and we talk about these guys all. The
time there's always Problems With. Stay farm. It's crazy but
because of the, price difference and on top, of that
all my other insurance was going up. On everything i'm
trying to save some money and you, were, LIKE yeah i.
Speaker 13 (01:56:47):
Do it so here's.
Speaker 5 (01:56:49):
What happens they send, someone out, they, say okay. You're
coverage your policy's. In effect someone's going to be doing a.
Walk by you don't need to. Be there so about
three weeks goes by AND basically i get a call
saying we're not going to.
Speaker 6 (01:57:02):
Cover you.
Speaker 5 (01:57:04):
Got to go find other insurance because you live out in.
The woods, i'm, like yeah you've had, the address you
know EXACTLY where. I live you literally know EXACTLY where.
I live they're acting like they had no IDEA who,
i WAS where, i lived or.
Speaker 6 (01:57:18):
Anything else it. Was crazy so basically they canceled. THAT
coverage i. WAS covered i guess for those. THREE weeks
i was still Covered, through, safego right but they had
the ability explain how they.
Speaker 10 (01:57:29):
Do.
Speaker 20 (01:57:29):
That, yeah so and this is a, common Thing and
i'm not just Saying With state farm but with a lot.
Of carriers they will do an inspection of your house
and when they go, out there especially if you're in
an area that's considered a little bit higher, fire risk
they can require you to cut down trees allready right
now and do any.
Speaker 6 (01:57:47):
Of that, they said we're not gover said no. To
you but a lot of times they, will, say, okay
well how does the Agent in elizabeth Tell me. I'm
covered that's what.
Speaker 20 (01:57:56):
Is confusing THAT'S why i felt a little bit better
about your situation because you actually we're dealing with an
agent that knew, the area but it doesn't matter that
they're not the. Ones inspecting and so with, state farms
since their, inspector out they come out and, they, say
yeah this is.
Speaker 5 (01:58:10):
Too risks, or not and you can see itself actually
has what some kind? Of binder, OH yeah, i am
BECAUSE if i, did DROP if i Did, DROP SAFECode
i would have had insurance up until THEY said i, don't.
Speaker 20 (01:58:22):
Rite and then you've been scrambling because there's not carriers
lining up something in FIRE and i would.
Speaker 6 (01:58:28):
HAVE never i couldn't have gone back. To safegoat, hell,
no yeah they. Would have they would not have, taken
IT so i could.
Speaker 5 (01:58:34):
Have BEEN likely i could have been paying, triple right.
It's incredible don't fall for. That crap, in fact we'll
touch on that, Real Quick tim tim From, uh tim
what's your comment on mister electric Real?
Speaker 6 (01:58:46):
Fast, Mark, okay oh by, the way how are you

Speaker 5 (01:59:46):
At, Dad, hey kelly what's your question for our? Forensic, Compass, okay.
Speaker 15 (01:59:52):
So long, story short my homeowner's insurance was getting ready
to RENEW and i noticed that it had jumped by
about eight. Hundred, Dollars OKAY so, i, Decide well i'm
going to call around, a little, you know and do.
Some shopping and, they, said whoa you've, got this this
(02:00:13):
and this you have to fix because you had. A
Claim and, i'm like we didn't have.
Speaker 6 (02:00:18):
A claim so, you're, Saying, well kelly you're saying the
clue report is where the claim. Report is it's, not
direct it's, Not, Correct okay and here's.
Speaker 15 (02:00:30):
What happened it's kind of. Complicated, bit no.
Speaker 6 (02:00:35):
It's not so far it. Makes sense so?
Speaker 15 (02:00:37):
What, happened Okay last november we had that really. Bad,
snowstorm okay let me preface this BY saying i Live. In,
buyers yeah this is kind Of, an kelly, just ironic.
Speaker 6 (02:00:52):
Like literally just move on with. The problem did you? Have,
coverage YES yes. I did did you put a claim
in after the Snowstorm?
Speaker 7 (02:01:01):
And?
Speaker 6 (02:01:01):
Buyers?
Speaker 15 (02:01:03):
Okay CALL what i DID is i called the it collapsed.
Our shed we had a aluminum shed in the backyard
and it collapsed.
Speaker 6 (02:01:13):
Our shed This, Is, KELLY kelly i already understand where,
you're going and this is a lesson for. Everybody listening
you called and basically decided not to put the claim.
Speaker 7 (02:01:23):
In?
Speaker 13 (02:01:23):
Correct correct why?
Speaker 2 (02:01:25):
Did?
Speaker 6 (02:01:25):
That, wait, wait, Wait, please kelly this is for. Everybody
listening why does that? Penalize people if you, call up
you tell them, There's damage brian like that shed, just
collapse but then you decide not to do anything.
Speaker 20 (02:01:39):
With, Insurance, so kelly my guess is that you called
the insurance company and had, this discussion not, your, AGENT correct.
Speaker 6 (02:01:52):
I DON'T Think i if it's on the, CLUE report i. Would.
Speaker 20 (02:01:55):
Assume Yeah so in, other words whenever people, do this
they don't realize when you called the, insurance company you
are filing. A claim you are filing it right then,
and there so even though you later.
Speaker 15 (02:02:06):
Seen, a question but simply just asking. A question but.
Speaker 20 (02:02:10):
That's why you want to have, an agent because an
agent can answer questions the. Insurance company you're, talking, to
uh someone that works for the, insurance company and they're filing.
A claim that's what. They're doing I'm, assuming kelly that's.
What happened is that who's your?
Speaker 6 (02:02:24):
Insurance?
Speaker 15 (02:02:24):
Company progress It's Through progressive and do you.
Speaker 6 (02:02:28):
Go Direct with progressive or do you have an agent there?
Speaker 15 (02:02:32):
YOU go i called?
Speaker 20 (02:02:33):
Them, direct, Yeah okay and so what happened is you
told them about this situation that the weight collapsed it
and then what do?
Speaker 15 (02:02:40):
They say, they, said okay that they can have an
injustor come out. And look and then the more my
HUSBAND and i talked, about it we wanted to upgrade
our shed anyway. And STUFF so i called BACK and, i,
said no we don't even want to mess.
Speaker 20 (02:02:55):
With, it yeah and so when you, did that they
closed the. Claim out so that first part of that
story is you filed a claim that that's. What HAPPENED
now i get after, the fact YOU said i don't,
want THIS and i am totally, With. YOU kelly i
wish what would happen is they would withdraw the claim
like it would never.
Speaker 6 (02:03:13):
Show up so on her clue report now it shows
that it shows.
Speaker 20 (02:03:16):
That claim now there are some carriers not.
Speaker 15 (02:03:19):
Only that not, only that it shows because THE company
i talked to SAID that i have to have, something
repaired some water thing repaired before they'll even talk, to
me and like it had nothing to do with water
or in the house or.
Speaker 20 (02:03:37):
Who's telling you you have to do this WITH the
i don't understand that part of. The story what do,
you mean are you trying to get quotes from? Another? Carrier, yes, okay.
Speaker 15 (02:03:46):
Yes and it was it was the very FIRST person
i called that said they've made me aware. Of this
AND now i tried to call, THAT adjuster i guess back.
Speaker 7 (02:03:57):
And what he wrote for, My, call kelly reopen the, Claim,
now brian you KNOW what.
Speaker 20 (02:04:02):
I can i can. HELP you i can, Help. You
kelly let's see if we CAN get i can't make
the claim, go away BUT what i can't do is
is figure out what it's showing on the report and
what really needs and, and yes AND then i can
have conversations with the writers. About, that kelly we can
help you.
Speaker 15 (02:04:19):
ON this i would love to Talk to, compass too because.
Speaker 6 (02:04:23):
That is who you're.
Speaker 15 (02:04:23):
TALKING to, I okay i would love to talk.
Speaker 6 (02:04:30):
To, You Okay, But, kelly kelly you brought up SOMETHING
that i think you just we shed a lot of
light on something people.
Speaker 5 (02:04:37):
Don't know if you listen to, this show, You yeah
so HERE'S what i want you. To do i'm gonna
put HER. ON olkus i got to take, a break
Make sure brian has. Her info brian's gonna have someone,
reach out or he, Reach, out kelly but he's going
to be able to help you, with this and then
he can shop twenty or thirty other companies and make.
It right but one of the things you might, think About,
and brian give me quick thoughts. ON this i this
(02:05:00):
is already, penalizing her and you can find her. New
insurance why not go back and actually have them pay for.
Speaker 6 (02:05:07):
The damage is it?
Speaker 20 (02:05:08):
Too, late well way to snow is a very good
opportunity to say it might not be covered anyways, because
collapse because of which they might. Haven't, excluded yeah and
that's why.
Speaker 6 (02:05:18):
It's important you always call Someone like. BRIAN first, i mean.
Speaker 5 (02:05:21):
That's it if she Didn't call, progressive directly it wouldn't
affected her, clue report which wouldn't infected all these other
quotes she's.
Speaker 7 (02:05:29):
Getting, Now, so brian if you call your insurance company
for some damage like, she did and let's say it's
it's not covered and that's and then they close, the
claim is she still responsible for fixing it going forward
to get future insurance or if they say it's, not
Covered then kelly, can, SAY fine i was going to
build a new. One.
Speaker 20 (02:05:49):
Anyway yeah it just depends on the kind. Of loss
that's why the water thing doesn't make sense a lot
of time with, water claims they want to know it's
repaired because they don't want to continue it if they don't.
Cover it even if they do and cover, that claim.
Speaker 6 (02:06:01):
And they can force you to repair it.
Speaker 20 (02:06:03):
In order to want to ensure.
Speaker 7 (02:06:05):
That.
Speaker 6 (02:06:05):

Speaker 26 (02:07:14):
My, MARK so i had a my old insurance company
called me yesterday and basically saying that they had they
had gotten acclaim filed against me for being in a
car ACCIDENT which i was. Never in there were apparently
two people involved in an accident near, my home but
(02:07:36):
somehow they GOT my vin number into the mix of
this accident, that Occurred and i'm wondering how did? That
happen AND should i be worried and just a case. Of,
fraud well for the.
Speaker 6 (02:07:47):
Life, OF me i have no idea how that. Would, Happen, brian.
Speaker 20 (02:07:51):
WELL yeah I mean ven number of. All things maybe
your license played and then they tracked it TO the.
Ven number maybe your car was parked outside your house
and for some reason it got thrown in. The mix
but how were you?
Speaker 5 (02:08:03):
Even INVOLVED well. I, wasn't, no, no NO what i,
Mean yeah But what i'm, Saying, is okay they HAVE your?
Speaker 6 (02:08:11):
Ven number who? Has it are they trying to get money? From?
Speaker 10 (02:08:14):
You?
Speaker 18 (02:08:14):
What?
Speaker 26 (02:08:15):
So no so APPARENTLY the i was Called By State
farm insurance saying calling me, about acclaim and after looking,
INTO it, i, said well, that car that car literally
sits in. MY garage i don't drive it. Very often
there's no damage. To it i'm the owner, of it
and no one else was.
Speaker 6 (02:08:36):
Driving it is there, a report.
Speaker 26 (02:08:39):
There's no, police report there's no license Plate.
Speaker 6 (02:08:42):
WITH well I simply i simply wouldn't talk to. Him
anymore it's. A scam first. Of, ALL well i don't
know if it's, A SCAM but i just if.
Speaker 5 (02:08:50):
Nothing happened AND what i mean by, A scam i
mean maybe someone's trying to go after him, for SOMETHING
but i don't even.
Speaker 6 (02:08:57):
Know what how would a scam look?
Speaker 19 (02:08:59):
Like, that well they're trying to probably trying to get
him to pay some money rid of.
Speaker 6 (02:09:03):
The claim but they're Saying They're.
Speaker 19 (02:09:05):
State farm well they could say there anything that would.
Speaker 5 (02:09:09):
Be a hell of a. Perplexing scam. But Maybe, but
keith why are you don't even engage?
Speaker 2 (02:09:14):
With?
Speaker 6 (02:09:15):
Them wait do You Have?
Speaker 8 (02:09:16):
State?
Speaker 26 (02:09:16):
Farm, well well my CONCERN is i used to have
a Policy With. State FARM but i did actually talk
to Someone At state farm just, to, say hey this
definitely isn't me and. The claim the person in charge
of this claim basically did some research and, he said
it looks like the other insurance company is what is
(02:09:38):
REPORTING your, ven number which WOULD be i can't remember
the name, of it but it was a different insurance
agency that said this is the other vehicle that. Was
Involved and, i'm like how WOULD they.
Speaker 5 (02:09:49):
I Don't think, ONCE again i don't Think any i'm
just gonna let our, expert TALK but i don't even
know why you're talking. To him if you weren't in,
an accident, NOT involved i wouldn't even give them anything to.
Speaker 6 (02:10:01):
Talk About, but, Brian.
Speaker 20 (02:10:02):
Please i'm, With, you KEITH but i get it's concerning
whenever someone's GOT your ven number and they're asking questions
about an accident that you know. Nothing about, But yeah
I'm with mark on. THIS one i just wouldn't. Engage
them if for some reason it escalates and it gets
to your insurance or you're getting a call from someone else,
LIKE that i WOULD probably i would ignore it unless.
(02:10:24):

Speaker 6 (02:10:36):
Correct, okay yeah he actually called state farm doc and talk,
to him and they do have some kind of open
claim or something. GOING on i wouldn't even deal.
Speaker 5 (02:10:45):
With Them like, brian said if it comes down to your,
own insurance talk, to, THEM say i have no idea
what they're. TALKING about i wasn't in. An accident that's
not you putting in. A claim that's not going to affect. You, Whatsoever,
right yeah, just, really man don't talk. To him that
is the BEST advice i. Can give now here. We
go we're gonna try one more time to See what

Speaker 18 (02:11:39):
Compact. It yep they should have just used pea gravel
or pro tip For. Mister electric just go back there
with some, pea gravel dump it in the trend and.
Fix it cover the top of it with top soil
and be done.
Speaker 6 (02:11:54):
WITH it i agree one. Hundred percent it couldn't be.
Said better why they don't just make? It right the
guy's not ask for a new trench and a. New

Speaker 5 (02:12:02):
Fifteen, feet basically you throw dirt, on it you go
out there with a, jumpin jack and you do. It
right whether or Not mister electric cares about. THEIR customer

Five times mark and.
Speaker 5 (02:12:20):
THIS guy i think listens to the show all, the
time which is even. More Amazing, john eli you're umber in.
A minute but You call brian and the gang. Over
there we do it.
Speaker 6 (02:12:28):
Every year every year they're going to make sure that
they have the right coverage in place. For you i'm.
Speaker 5 (02:12:33):
Not kidding how many different companies do you deal with
when it comes to, you know residential and it comes.
TO commercial i mean you must deal with thirty.
Speaker 20 (02:12:41):
Forty, companies yeah when you start looking at the, commercial
side there's just so many carriers you can work with
on that side. As well, so yeah there's lots. Of companies,
but yeah what really what? We're different we have an
entire renewal TEAM staff yep that reviews every renewal. Coming
up why we love IT so i MEAN most I
just i'm not trying to toot our own, horn honestly
(02:13:02):
but independent agencies they don't. Do that it's just they.
Renew it they just. Renew it SO do ca.
Speaker 6 (02:13:09):
They have no other people to, go to.
Speaker 20 (02:13:11):
So we spend the money on having an entire staff
that will look at every renewal and bigger.
Speaker 6 (02:13:16):
Than that when you do to turn in, a claim
if you have one like heal damage or a car
wreck or something and you're having problems with whoever they
got you Insurance through Progressive or safeco or whoever, it
is they're going to go to bat. FOR you a
lot of these people don't go to bat because they
ultimately get paid by the. Insurance company brian And the Gang,
OF compass i am telling you they go to bat,
(02:13:37):
for YOU and i know, that personally they're going to
check make sure you have the, best coverage the. Proper
coverage that's probably even, more Important.
Speaker 20 (02:13:44):
Right yeah because people don't understand. WHAT endorsements, i mean,
you know you get a quote and half the things
that you want in the case of a loss. Aren't
there you.
Speaker 6 (02:13:53):
Know what the biggest THING that i know we've harped
on this in, the past but think, about this people
listening when it comes. To Insurance that boulder fire we
had there was hundreds of. Homes destroyed how many of
them were? Under insured brian.
