new homes, they require the fan the minimum exhaust airflow
must be a certain amount. Some codes allow for lowest
continuous exhaust rate if the fan runs permanently.

It doesn't say it has to, but if.

It runs permanently, there is a minimum CFM they require
in multifamily or tightly built homes, whatever the hell that means.
With tighter envelopes, there is an increasing emphasis on indoor
air quality amending, and some are wiring fans to run

But I see nothing that would require it.

you guys have been saying off air, how many people
are pulling out of this market with Reynolds purely because
of all the changes?

Right, Yeah, we have a lot of owners that have
called us and want to sell properties because they don't
want to deal with all the new laws.

Speaker 10 (37:20):
They just want to get out and Brad, you deal
with You.

Speaker 4 (37:22):
Give me an idea, Tasha, Tasha, give me an idea
of one of the laws that would comes up a
lot that people don't.

Speaker 5 (37:29):

Speaker 19 (37:31):
So Denver landlord licensing is one they just fiil. The
government push on that and.

Speaker 5 (37:36):
Then and what is that all about? What is it?
What do they require?

Speaker 19 (37:41):
So they have to do an inspection and then if
whatever doesn't pass, they have to fix that, and then
they have to renew it every couple of years, and
if they don't, there's haf de fines associated with that.
It's not necessarily a bad thing to have properties that
are in good condition. I think it's more the feel
that the government control. And then the next one would
be the non renewal law that they just put in place.

Speaker 5 (38:02):
Where talk about that. What is that about?

Speaker 19 (38:05):
Yeah, So if a tenant isn't a property and you
know they pay their rent their quote unquote a good tenant,
you have to renew to them. And the only way
to not renew to them would be under a certain
you know, there's a certain stipulation you're selling the property
of family members moving back into the property if they've
been late on payments. But the consistency with that is

(38:26):
you have to serve a demand three times and if
they fulfill the demand, then that's not even a qualifying factor.
So if I mean basically you're forced into renewing, and
we have a lot of owners that don't see eye
to eye with certain tenants. We had one that put
in over twenty thousand dollars of damage and.

Speaker 4 (38:44):
Work for way way Wait, wait, is that wouldn't be
a reason to get rid of a tenant if they
damage the property, you still have to renew them.

Speaker 19 (38:51):
Well, you have to send certain forms to them in
order to do that. So yes, there's just a lot
of hoops to jump in order to do so. Now
you can't just say I don't want to renew to
you and we'removing on.

Speaker 4 (39:04):
Okay, Brad O'Brien, are you getting a lot of increase
from landlords or would be landlords.

Speaker 20 (39:09):
Well, the recent changes in law have made it really
tough for landlords to get rid of tenants and whenever
they're in court more often, and if they get in court,
it's more expensive, so it's just tougher to be a
mom and pop landlord.

Speaker 5 (39:24):
Now yeah, and also.

Speaker 7 (39:27):
It's you know, it just costs everybody. You know, it's
going to raise the cost of everything.

Speaker 5 (39:34):
Well, of course, of course it is.

Speaker 4 (39:37):
I mean, whenever the government gets involved, it's going to
raise the cost.

Speaker 5 (39:40):
Now, Tasha, I heard you talking.

Speaker 4 (39:43):
About something else off air that I think was a
really something about fees or costs and disclosures, and I
think I was thinking we should be talking about this
on the air.

Speaker 5 (39:56):
Do you recall the discussion I'm talking about?

Speaker 21 (39:58):
No, I don't.

Speaker 4 (39:59):
Okay, Well, it was like maybe less than an hour ago.
I heard you talking off the air about having to
advertise certain fees or there were ways that.

Speaker 21 (40:12):
Yeah, sorry about that.

Speaker 19 (40:13):
Yeah, So the new laws require you to have the
fees very bold letter in your lease, so there's no
weird fees associated with like hidden fees, which we've never
done as a company, but there have been other property
managers that have like admin fees and everything like that.

Speaker 5 (40:32):
So now, yeah, Or you see.

Speaker 4 (40:33):
A big sign outside of a big building saying, you know,
two bedroom condos twelve ninety five, and then when you
get in there you find out there's a whole bunch
of other fees on top of that, making it more
like sixteen or eighteen hundred bucks.

Speaker 19 (40:48):
Correct, yep, So they've changed that, which again I don't
think necessarily that some of these things are bad, but
again yes, we're it's just creating a lot more work.
And then there's they did away with if you can't
charge utility fees, so that this is a big one,
is that if you have like we have an eight plex,
so they're not on separate meters for water, they're not

(41:08):
on separate meters for the boiler system. So what thing
have always done is separate per unit. There's eight units
in there, so we divide the whatever that bill is
by a add it to the tenants leap port to
pay with rent. You can no longer do that anymore.
So no, no, So if it is not a separate meter,
then you cannot charge the tune a fee for utilities

(41:32):
any longer.

Speaker 21 (41:32):
And the problem is, well, then.

Speaker 4 (41:34):
How does a landlord collect for them then so or
do they have to build it into the rent.

Speaker 21 (41:39):
They have to build it into the rent.

Speaker 19 (41:41):
The problem is though that they the laws take effect
in the middle of the year, so we renew ninety
percent of our leases in June, and now this takes
a fit effect January one. So we have owners that
if the tunant aren't willing to sign a lease saying
hey we're transitioning over to where it's a one rent payment,
they're going to be out thousands of dollars for six months,

(42:01):
and how we can then integrate that into their new lease.

Speaker 7 (42:03):
These are all things that the government doesn't think about
time when they pass these laws, or they don't care.

Speaker 4 (42:10):
Okay, so Brad O'Brien, you know what she's talking about. Right,
So in other words, they can't divide up the utility bill.
You cannot charge utilities unless it's a separate meter. That
is an absolute law right now, or it's going it's
going to be January first.

Speaker 20 (42:28):
Yeah, this has this has to do with House Bill
ten ninety that we talked about when I was in
here about two months ago. Yeah, where service providers now
starting January first, have to in bold on the first
page of their you know, advertisements or contracts, state here's
what it's going to cost to you consumer in one
number for this transaction. So the for leases, I guess

(42:50):
it's an annual number.

Speaker 5 (42:52):
And so you can't have.

Speaker 20 (42:53):
Utilities costs which change on a monthly basis. You can't
reduce that to one number for a year. So the
way to resolve that would be landlord just have to
build that into the base leaves or have the tenants
pay the utail to dress.

Speaker 4 (43:07):
How would you even know? How do you even know
how to build it in? That's what I want to know.
I mean, guys, you manage properties. I mean, you're going
to have to estimate high so you don't get burned.
If I'm a landlord and i have eight tenants and
I'm not allowed to charge individually, I'm not allowed to
divide it up. I have to kind of estimate what

(43:29):
I'm going to be paying in utilities, am I? And
just charge more rent. That's the bottom line.

Speaker 21 (43:34):
Right, Yeah, that's exactly it.

Speaker 19 (43:36):
And then the problem is is that, yeah, there is
no way, I mean, you can get an estimate, but
there's also no incentive to the tenant to not leave
their light on all day long. Where before it was
like we could send them and say, hey, the utility
bill was this, you know, just keep an eye, or
they got a bill that was like oh man, it
went from fifty dollars to one hundred and fifty.

Speaker 21 (43:54):
I need to try right off the lights.

Speaker 19 (43:56):
But now, I mean there's no incentive for them to
have any sponsibility. Let's turn the acon and open up
the window, you know.

Speaker 1 (44:03):
And that water.

Speaker 5 (44:04):
I bet water is a big part, a big thing.

Speaker 20 (44:06):
It can run up the bill on correct, Yeah, more
the electricity.

Speaker 5 (44:10):
So wait a minute.

Speaker 4 (44:10):
So so landlords to get around this would have to
put in separate meters, is that right?

Correct?

So unless each unit has their own meter, which again
I mean you're talking thousands and thousands of dollars to
do that for especially some of these older places. I mean,
we have one that we're looking to take over that
as a forty units in it, and the owner is like,
I don't even know what to do with this.

I am losing.

Speaker 19 (44:35):
And if the tenant won't voluntarily sign this addendum and
their lease doesn't renew for another six months, eight months
or whatever, you're out that money.

Speaker 4 (44:45):
So so then once they renew, their rent is obviously
going to go up because utilities will be included.

Speaker 5 (44:54):
Correct. Once a tenant.

Speaker 4 (44:55):
Hears utilities included, they're going to run the hot water
all day, or they're going to run the heat. They're
going to grow soap, or they're going to turn on
the air conditioning and open the door they want, they
don't care. Are in fact, some landlords used to do
it by square footage.

Speaker 19 (45:15):
Yeah, yeah, we have all different formulas. I mean we
managed I think this is affected at least thirty of
the properties that we manage, and so we had different formulas.

Speaker 21 (45:24):
Yeah, some were on square footage.

Speaker 19 (45:25):
If they were all the exact same square footage, all
with like one occupant or something like that, it was
by you know, just that. So there's definitely different formulas,
but all have been you know, fairly divided.

house bill?

It was House Bill twenty five, ten ninety.

we find out?

and like contractor didn't do it, nobody did it. There's
like five layers of wrapping. There was clear wrapping. There
was a white blanket and all of this around it,
and if you got through that, it is indeed outside

And just out of curiosity when I sent you a
very detailed email saying the reason it probably appears white

the money back. He claims that he counted out the dollars.

He counted them out in.

Front of a deputy, and the deputy took the money
and gave it back to the consumer. He said the
bodycam footage would clearly show this. In fact, he went
one step further and he said, if you look at
the bodycam footage and I'm lying, you can ruin me
and you can ruin my business.

Matthews the consumer.

We told Matthew and we told Anthony both. Anthony is
the vendor with I believe it's AMG Customs. But they
both claimed the body footage would vindicate them. Okay, so
what happened when you looked at the bodycam footage? What happened?

Here's what I want to know. Who looked at it?
I didn't look at it. Mark's not there. Mark did
look at it? Did Mark look at it?

And then the second video was actually at Anthony Yorke's house,

went up and tried to get him out of the house,

knocked on the door a few times. Eventually he did
come out of the house. They asked him about the
thousand dollars.

and nothing really got resolved.

his doorstep talk to the officer, said that he did
