What is on your mind? Brandy? And how can we help you?
Hello? Brandy, Hi, mydaughter's friends went to the bar on
birthday night in Laramie, and sheleft with a young man and texted her
(03:07):
friends Friday that she made it home. That was the last anybody heard from
her. She Oh my god,Wait a minute, Brandon, Wait a
minute. So she was at abar. Now, I want to ask
a couple of things here. Thisis your daughter's friend. Yes, her
name's Sabrina Geller. Okay, Andit was in Laramie, you said,
(03:31):
yes, my daughter and her friend. They went to the police and told
him she was missing. After acouple of days, the police fold her
she probably went into the woods tocommit suic item to drop it. Wait
a minute, now, I wantto There's a whole bunch I need to
(03:52):
ask, Brandy. How long hasyour daughter known this friend? Since she
grew up with her, since shewas a child. She's now was the
friends suffering? Was the friend's sufferingfrom any depression or any anxiety or life
problems? Sure not that she knows, right? Okay? Did the police
(04:14):
really say she probably committed suicide?Leave it alone? Yes, sir?
Did she really? I mean, does she have proof of that? Yes,
sir? They told her to.My daughter asked, wouldn't you at
least like to go look for thebody so that her mom can bury her.
And they said, we can't rightnow. So my daughter ended up
(04:36):
point and looking for and they wentand searched. Heh, wait a minute,
I need to know some stuff here. The bar that she went to.
Did anyone go to the bar andsay, does anyone know the young
man? Did anyone? Don't tothe bar? She knew the man to
begin with. These are both NationalGuards or her young the young man?
(04:58):
We're both nash? Wait, wait, way, so you know for a
fact the young man she left withwas National Guard? Yes, how do
you know that? How do youknow that her friend? It's her friend.
They went back to the bar. They looked at the videotape. They
saw them leave together. They sawanother videotape of them getting in her car
(05:20):
together. Who did this? Thepolice? No, police won't wait a
minute. So this did this Nationalguardsman she left with? Has he been
identified? I don't believe publicly?Know what I don't mean publicly? I
(05:43):
can't, Brandy, this sounds where'syour daughter right now? Can we talk
to her? No? I'm inNebraka. I actually just got to work.
You guys called me on my wayto work. Okay, good because
you called us. We called youback. Now now, now, Brandy,
I gotta ask a question. Yourdaughter is your order in the National
Guard. No, my daughter wasgoing to school in Laramie. And now,
(06:05):
but was she at the bar?Was she at the bar with the
with the young lady or with theguardsman? Her and her friend were and
went back to the bar afterwards andwatched the video. Kid, Yes,
they are the ones that are allbut they were all together when she left
with this young man. No,they left first and then went back afterwards
(06:27):
to find out what they left her. They left their friend, the woman
in the National Guard. They lefther at the bar and was told friends
from the National arm and her andthey were told she left with a young
man from the National Guard. Correct. And when they looked at the video,
(06:50):
did you did your daughter see thevideo? Yes? Did your daughter
see her leaving with this young man? Yes? Did anyone attempt to see
who this young man is? Yes? And okay, did they question this
young man my daughter has yes?And his story has changed three times?
(07:14):
Okay, Now, this woman, what's her first name? Sabrina? Geller
Uh I said, first name,Sabrina. So, Sabrina. When was
this when did this happen? Thursday? And she Sabrina Geller, has not
been seen from since her body wasfound last night. Oh my god,
(07:38):
well you should I think you shouldhave led with that one. Oh oh
my god. Okay, hold onout. Her body was found and now
does it look like suicide? Idon't know it? No, Okay,
So they found us. Why Iwas trying to tell you, you have
(07:59):
to stopping me. They found hercar. Kep stopping you. You said
your daughter went to a bar inLaramie found and left with a young man
doing They found her car on Saturday, and the cops still told them that's
when they said it's probably suicide. They went up and looked for her on
Sunday, still couldn't find her.On Monday they took out the helicopters,
(08:22):
still couldn't find her. On Tuesday, they found her body a mile from
where her car was and said shewas just underdressed and died of overexposure to
the weather. And her body wasfound last night a mile from her car,
(08:45):
off of the trail with her backpackpropped up and sewed away. Okay,
are people now? Are the policeor is the medical examiner looking into
this. Did they determine a causedeath over exposure to the weather. Over
(09:05):
exposure to the weather, So shewas out and froze to death. No,
no sign of homicide or foul play. That's not what they're saying.
What do you think? And also, at like five thirty, her phone
(09:28):
supposedly sent some random texts to somerandom people saying what sound like thanks for
being such a great friend. YadA, YadA, YadA. It was the
exact same word for word text toten random people, not like ten of
her best friends. Just can thishas made the news up there? I
(09:54):
just looked up. It has,Yes, it has yepring to get On
Sunday, twenty one year old SabrinaGello was reported missing to all Benny County
Sheriff's apartment. Her carvers found aband run. What's that? What news?
It's it's all over. It's everynews outlet in Wyoming. Okay,
(10:16):
because I called yesterday and nothing,no newspaper had seen it, and they
were like, you have the firstWell this one was published a couple of
days ago, so I'm sorry. We're using different googles maybe, but this
one is all over the news abouther. This is terrible Is there a
possibility we can talk to your daughter? Can you give us a number,
(10:41):
We'll call her off. Let megive you her number. Off the air.
Hold on, off the air.Okay, hang on, Kachina,
get this. She's on her wayto work. Let's get this information and
try to call the daughter. Hey, I have a question. What are
our parents doing? I don't know. That's what we have to find out,
doc. But the woman was inthe National Guard, so was the
(11:05):
guy. I'm sure they're questioning her. I'm sure they are. I mean,
but maybe they did. Suspect suicidefor something. But I'm finding this
all over the news, all overthe news. Let's see. So,
Sabrina Galler was found dead February thirteenthin the morning, and it said that
(11:39):
Sabrina Galler was a student and activein rot C, missing since the eleventh,
which is Sunday. Her last knownwhereabouts were Ranger Bar and liquor store
on the ninth and uh. Anyway, that's a sad, sad story.

(12:52):
What a tragic call to start thingsoff. A young woman found dead.
She was missing in Laramie, Wyoming. Her name is Sabrina Geller.
She's all over the news if youwant to google that. I'm not sure
why the mom is calling, orthe mom of a friend. I imagine
(13:15):
they suspect foul play and she leftwith a young man also in the guard
Now I have to believe that they'regoing to investigate all angles of that,
So please give us a call ifyou'd like to talk about that, or
(13:35):
if you know anything about it aswell. Now, today is Valentine's Day
and romance scams are taking advantage.Do you know that at least forty percent
of older women not got ripped off, but we're in touch, have been
(13:58):
in touch, or have been rippedoff. Now not all forty, but
they've either been in touch, arein touch, or been ripped off in
a romance scan. Think about that. It starts out first of all,
with phony maloney, photos and profiles. Now, Deputy Doc, he had
(14:20):
a solution, but I don't knowif it's a fail safe. He said,
do a zoom call, Insist ona zoom call or some kind of
video call. Now, in someof the cases we've investigated, when women
insisted on a video call, ornot insisted but asked for one, the
guy had all kinds of excuses. So Mark, are you doing it?
(14:45):
Tom? Yeah, of course it'sa red flag. But I think they
could fake a zoom call, don'tyou no, Come on, what do
you mean? No? No,you don't think they could fake a zoom
call. Well, I'm not surethat they do that. I mean,
I think one way to protect yourself, and you know, the other thing
is you have to have some senseof your identity. If you're a middle
(15:07):
aged woman and you're fifty or sixtyyears old, a twenty three year old
soldier or oil rig worker, well, then normally, normally, here's what
it is. Here's what it is. Doc Normally, you have someone in
their Women starting at fifty and upare the biggest target, and you have
men who are in their fifties. And see, they don't normally pose as
(15:28):
twenty or thirty year old guys.Interested they're trying to make it somewhat credible.
And the guy might be forty eightto fifty five. That's there,
but there are a lot that aresixty. Let me take Charlie, Charlie,
what's going on with you? Charlie? Hello, Oh Charlie, are
you the friend? Are you thefriend of this missing girl? I mean
(15:54):
yes, I'm sorry and we wentto preschool together and oh my god.
Sorry. Now, now here's whatI want to know. She's she's obviously
dead. Are are you thinking shewas depressed and wanted to off herself or
get lost or what do you thinkhappened? Honestly? Knowing Sabrina, Sabrina
(16:22):
was a very strong person and alwaysencouraged others to get help if if they
were even even remotely, you know, stressed or anything. Sabrina was a
very bright person and a very lightin the world, and she was constantly
talking to people about how they shouldn'tbe ashamed to go to therapy or anything
(16:42):
like that, and she constantly encouragedthose of us who did have any kind
of struggles or issues to go andget help. So personally, I couldn't
see Sabrina going and doing something likethis. Now, is it true,
Charlie that when you went when didyou first go to the police? She
was missing on Thursday night? Shewent to the bar? Is that right?
(17:04):
So she was actually seen leaving thebar. We did see footage from
the bar of her leaving and leavinglike the parking lot. Yeah, so
this was this young was this otheryoung guardsman with her? Yes, in
(17:26):
the footage he did leave with her, but obviously they just left the parking
lot together. We can't say anythingelse. Our main problem is that we
want to push the police to goand they still haven't even gone and gotten
the footage, even though we've toldthem about it, and granted I don't
know about this. Now. Thisis yesterday morning, before you know she
(17:51):
was even recovered and we even sawanything. So, Charlie, don't you
think change? Things will change nowthat there's a body. We're hoping that
just the police are pushing an investigation, you know. We had to push
them to even get a search partyor anything together. We went up on
(18:11):
Monday afternoon, me and a groupof one of her other closest friends,
and my younger sister and my stepsisterwho was also a very close friend with
her, and just our small smallgroup of four girls were up there with
one of our moms and we werethe only ones out there looking for her.
There wasn't even a sheriff's car upthere. And so we came down
(18:32):
the mountain that night, or wecame down from Bedewoo that night, and
we made posts on Facebook and webegged to post them on one Wyoming Missings
person and Missing Persons of America, and we begged and we posted, and
we begged people to share and getthe word out there. And it wasn't
until then, And it wasn't untilwe started pushing and we got the word
out there that suddenly Albany County wantedto get involved, and suddenly the police
(18:56):
office wanted to get involved. Theydidn't even post her as a most persons
on her page until until like eighthours before they posted her sound. Now,
now, Charlie uh it's been fair, Charlie, Charlie, to be
fair, many times they wait twentyfour hours. But I need to ask
a few important questions. When waswhen did you first suspect a problem?
(19:22):
You went to the bar Thursday night? Were you expecting to meet her there?
See? I hadn't gone to thebar personally. That was her other
close friend that we weren't able toget a hold of this morning. And
when did you, guys, orwhen did anyone first suspect anything? I
mean, it's not unusual for ayoung woman to leave a bar with a
(19:44):
young man, So when did yoususpect something might be wrong? We suspected
something would have probably been wrong whenshe stopped answering her phone on Friday,
around five point thirty, she senta message to a couple close friends,
and one of those being the closefriend that was out there yesterday and the
(20:06):
day before with me, And sheresponded instantly like I'm talking within minutes,
and Sabrina didn't answer back, andthat's pretty unlike her when she had just
messaged. Did Sabrina make any mention? Did Sabrina make any mention of going
for a walk in the woods. No? And that was another thing that
(20:27):
was really unusual for us is allof us girls who grew up together and
were really close together. That wassomething that was a big thing for us
because you hear it in the newsall the time, but you never think
it'll be you, but you always, you know, you always just hope
it's not, and so you alwaysstay in touch. You always keep your
(20:48):
location on and tell people where you'regoing and bring another person with you.
It's not like her to just goout in the middle of February for a
hike in the winter. Charlie, how old are you? Your friends?
My birthday is actually tomorrow. Iwas supposed to celebrate my twenty first birthday
with Sabrina. She turned twenty oneabout two weeks before me, and so
(21:15):
we're all about that age, twentytwenty one, Charlie. Does anyone and
we're not accusing anyone or saying anything, but does anyone know the identity of
the young man she left with? No, Sir, I don't know.
Personally. We're trying to get moreinformation. We know a couple of people
who might know him, but youknow, we only certainly maybe probably it
(21:42):
probably wasn't his first time at RangerBar. No, I believe that it
wasn't, but I wouldn't know forsure. Okay, I'm not twenty one,
so I haven't attended. No,I understand, you don't go to
the bar. You're not twenty oneyet. You're twenty one tomorrow. And
(22:02):
what a mixed what a mixed birthdaythis is with joy and sadness and Charlie,
this is a terrible, terrible situationon Valentine's Day to find out your
friend has said, I, whatdo you think went on? What do
you think? Do you think shewas simply going for a walk and was
exposed to the weather that sounds sounusual. Do you think she drank a
(22:26):
little too much? What do youthink happened? I genuinely don't know.
We we have so many unanswered questionsand just so many things that you know,
are still so fresh and we stilljust don't understand, and we're not
getting questions too, and so we'rejust really pushing for resources and just for
the police to have some kind ofinvestigation and some kind of something and not
(22:51):
just push it off as, oh, you know, she laid down.
Oh I can't imagine. I can'timagine they're not investigating you do know it's
all over the news up there right. Yes, they told us they would
be investigating, but we just ohthey are. They're asking for all kinds
of help. I guess it's thesheriff's department. All Benny County Sheriff's Department
(23:14):
is investigating. Yes, we knowthat. We're in touch with them,
and yeah, well you know,so at least you got their attention.
Unfortunately, you feel they weren't takingit seriously right away. Normally they do
wait a while before they sound thealarm when they say someone is missing.
(23:36):
When when someone says someone is missing. Now, what was the last text
she sent that I don't personally haveI was not one of the recipients.
Sorry, Okay, listen, Charlie, if you would do us a favor,
my producer will get some information sowe can stay in touch and you
(23:56):
keep us informed, and then we'regoing to ask anyone who may know anything
about it, or anyone to whoyou know who knows people there or are
are following the case, to keepus informed as well. This is this
is very sad, Charlie. Andby the way, was it unlike her
to leave with a young man ordo we know if they got in the
(24:18):
same car or did they go ontheir separate cars? Do we know?
No, she she was not parkedin the parking lot. So the you
know what we were able to seewas just her leaving the parking lot.
Were they leaving obviously together? Yes, they were. They were you know,
(24:40):
walking together. They had walked throughthe bar together and left the parking
lot together. Okay, Charlie, thank you so much. I know you're
hurting. Happy birthday. I'm sorryto mix this up, but just I
don't know. I'm going to saya prayer for you. But this is
a terrible time for you. Iunderstand it. I lost a friend when

We have Mark with us Mark Conklefrom Probidenergy dot com in the solar business
and they, of course do systems. One of their hall marks as a
(26:11):
system starting at twenty one fully installedbattery backup good for most houses, and
that's after your tax credits. There'salso financing available right in addition to that.
That's out of pocket twenty one,but you can finance that. I'll
go ahead, sir. Colorado renewloan is a great loan right now.
(26:32):
That's through the Clean Energy Fund thatColorado supplies, and that's available to all
solar systems or any of the renewableenergy or what solar solar batteries, yep,
all those things. So you canfinance that through Colorado Renew. Three
credit unions participate in the program, and that's kind of where I've been directing
people. The traditional solar loans. The dealer fees are quite high right now.
(26:55):
Okay, So, last time youwere here, we had a question.
I don't know if we adequately answeredit, but it's a it was
a text question on how much ofthat initial cost do you actually get a
credit on if you add batteries,if you add a generator, or if
you add different things insulation, doesthat all count as part of the system
(27:18):
that gets the credits or do youhave to parse out the solar part of
it. The solar and the batteriesare both a thirty percent federal tax credit.
Okay, But if you spend extrato upgrade insulation and that kind of
stuff, there are some programs inDenver where they'll offset that, and believe
it or not, Excel we'll actuallyoffset some of that with rebates as well,
and we do have partners in theindustry that can do all of that.
(27:41):
Okay. So but really the movenow is to encourage people to do
renewable energy, I mean resolutely, big time air source heat pumps. So
people just doing EV chargers, yes, quite often, Mark, have you
ever thought of doing solar? Forthat? We do. I'm talking Mark
you there. Oh he's not thereright now, No, I'm here.
(28:03):
Oh, I'm sorry. I didn'tsee you there. I'm sorry, go
ahead. What did you think,Mark? Have you ever thought about doing
just for the for the you know, like maybe even the motorhome or the
car? Now they can't. Itjust simply won't power my house? Man,
I would never, I would.I think I'm the worst fit for
solar ever, and I've had multiplecompanies look at it. Oh, I'm
(28:25):
taking you don't think the payback wouldbe there just for the the EV charger?
Well, can't they do many systems? What am I going to spend
seventy thousand dollars? I don't know. I'm talking about an EV charger.
I'm not talking about a house. So for me, everything comes down to
this. In a lot of circumstances, people can spend X amount of money
(28:48):
and get rid of their electric bill. It makes perfect sense. What am
I supposed to drop? How muchdo you come out of pocket to charge
your car? When the car costsmaybe seventy bucks a month to charge?
What am I going to come fifteenthousand out of pocket and make up for
it in fifteen years? That's absurd. I don't know. I'm just asking
what about EV chargers? What arethey running you? Know, it's just
(29:10):
enough solar for an EV charger outout in your driveway or your garage or
whatever. I'm just curious. Fivethousand kilowatt hours, so probably two kilowatt
system. How our solar two threefound? Mark? How fast is let's
get real though, how fast?Six or seven grand with a fifteen percent
kicker? Yeah? The issue withthat Mark is I hear where you're coming.
(29:33):
I'm not trying to sell those,I'm just wondering about it. Yeah,
but Tom, what he's talking aboutwould charge my car in six days?
What are you talking about? Areyou talking about a LoVa? You're
not talking about us big charger then, are you? Mark? Yeah?
You are. That's not how solarworks really, it's an offset of what
you are running. So we're goingto offset your electricity pull from your utility.
(29:59):
And could you make a standalone I'mjust curious. Could you make a
standalone? You could? But youknow, solar is built on an annualized
basis because it doesn't produce as muchin the January, February months, Okay,
summer months, right, so youdo have to have something to help
augment it. Absolutely, that's whyit's meant to be on a system.
To me, solar is so great. And here's why. If I lived
(30:22):
where I used to live in CastleRock, I had sun hitting every part
of my house, I could onepercent offset my electricity bill and cash flow
immediately. That is where solar's great. Forget about the green I just don't
care about that stuff. And peoplecan send hate mail. That's just not
my motivation to get. No.No, no, you wouldn't do it
(30:42):
just for that. No, AndI don't know of anyone who would do
it just for that. My goodness, maybe there are PBEs. Ninety nine
percent of the people are trying tosave money. We have to take this
break, but I want to tellyou, what do you think. We've
talked about it before. The numberone problem with married couples is not cheating

Martino three oh three, six,two seven, eight, four sixty six.
What's cappening, Darlene. I'm tryingto get out of a contract that
I signed unknowingly with a water heaterplumbing company to replace my water heater.
(34:44):
How'd that happen? How did itall start? It started with my water
heater obviously going out, and itwas kind of an emergency, so I
just I didn't do my homework andso I just called the first one that
popped up in Google. And theycouldn't come out Saturday due to the weather,
(35:06):
so they came out Sunday. Andwhen when you said you unknowingly signed,
what does that mean? Well,on the contract, the PDF contract
that he gave me, it isabove the signature box that says subject to
(35:27):
a twenty five cancelation fee. Itwas not mentioned, however, and the
box that I signed that was onthe gentleman's phone was blank. There was
no disclosure or anything on the Seethis is changed nowadays. This is happening
to a lot of people. They'resigning on iPads or phones and they don't
(35:49):
see all the terms and conditions.Darlene, why do you want to cancel.
Just he I did my research afterthe fact, which does not help
the situation at all. But theyhave complaints on Better Business Bureau. And
who is the company? What's thecompany? The company is anywhere Ruter?
(36:13):
Uh huh? Any you know,by the way, I have found that
any company with Ruter in the nameother than one is uh. I found
them all to be ripoffs. Idon't know why, but I have so.
So here's the deal. I don'tknow of anywhere routers are ripoff,
but man, when there's Ruter inthe name, there's usually trouble. And
(36:35):
what I want to know is whydo you want to cancel because of the
complaints or the price? What isthe price they quoted for a water heater
to replace the water heater was twentytwo fifty And what size is it?
Well, it's a forty gallon.It's a forty gallon. I'm not sure
exactly. Well, let me giveyou an exam. If you went to
(36:58):
Europlumbing Colorado dot net, which is, by the way, one of our
companies on referral lists dot com thatI talk about all the time, for
a forty gallon tank, it wouldbe thirteen ninety nine one three hundred and
ninety nine fully installed with the oldone taken out in haul. However,
I want to be fair here,I think, and I'm not. I
(37:22):
don't know this company from anywhere anywhere, Brouter, I don't know them.
But that is not an unusual pricein the industry right now. People are
just charging out rages amounts and Idon't even know if it's outrages. Mark,
what would you think that price is? How much? Was it a
(37:43):
forty twenty two point fifty for afoll? Bad at all? I mean,
as we know, you're old, beat it, but there's a ton
of companies that would commit it overthree thousand without blinking. Yeah. Do
you know what kind it's gonna be, Darlene, I know the brand name.
I just know it's made for propaineversus natural. Guess why is it
(38:06):
made for propaine? Are you obviouslyyou're on propane? Yes, the heaters
are the same. Here's what changes, the orifice changes. It's not really
a big deal. But did youso your water went out? They came
out, gave you an estimate, and they didn't do the work yet.
No, okay, and you decidedyou wanted to cancel. Did you find
(38:31):
another company. Not yet. Iwas on Angie's List. I don't know
how reputable, but they said thatthey could help me find somebody for Angie.
Of course, you just don't learnlessons, do you. Most of
our problems come from Facebook, Marketplace, next Door, Angie's List, Home
(38:53):
Advisor. This is where all ourcomplaints come from. And where else Google?
So so you know, that's whyI have a referral list. It's
called referral list dot com. AndI would say, first and foremost,
I don't know if you should cancel. You may be liable for a penalty.
(39:14):
But if you say you didn't knowabout it and didn't have a copy
and they had you sign a phone, that suspect. But they're going to
fight you for the money. Howmuch do they want as cancelation? They
want the twenty five percent that Iput down, where I put a little
bit more than twenty five, butthey want the twenty five percent and how
(39:34):
much? Okay? So then whatwhat about? Uh? When did this
happen? Sunday? Sunday? Becauseif it was made a sale in your
home, there's usually an automatic rightto rescind that contract in seventy two hours.
If the sale was made in yourhome. Was there a right to
(39:54):
rescind on that contract? Probably not. I would have to read it over
it well if not. If therewasn't, then they broke federal law.
So I mean, here's what I'mthinking. We should have somebody call over
there and tell them. I mean, if they they did not leave you
(40:16):
with a copy of that contract.I did, but it was a kind
of paper copy, just a PDF. That's well on the PDF. On
the PDF. If there is nota three day right to rescind, then
I think they have to give youthree days. I mean, I and
(40:40):
they can't charge you. I can'tcan lession fee. I can't imagine that's
not in the agreement though these guys, most of them all use the same
software. Honestly, Darlene, canyou send us a copy of that?
Yeah, take us, send usthe PDF. We'll look at it over
the break, Kelly'll give you theinformation. I do want to put this
(41:04):
on you te It's actually in yourinbox. Guys. Oh cool? Is
if this they think if this wasone of our referral list members. Now,
granted, they'd most likely let himout of the contract. But let's
say these guys are up and up, and we know nothing about them.
But there's not a lot of badreviews. They don't rip people off.
They go out to the house, they look at it, they give her
an estimate. She agrees twenty fivepercent down. They order the water heater,
(41:29):
they do whatever. I don't know. If they haven't order it,
it's in stock. I don't knowhow that part works. But is it
even fair of us to say orcall over that these guys did something wrong?
No, not at all. No. But that's not why I would
be calling. Why I would becalling is if they did not follow federal
(41:49):
law and give a three day rightto rescind. And I think it's going
to read through this agreement during thebreak. I don't see it here at
all. It's a very simple agreement. I hereby authorize blah blah blah.
If payment is not made as agreat anywhere, router can remove in set
equipment blah blah blah, ten percentfee, blah blah blah, alteration,
(42:10):
derivage a new very prayer. Idon't see anything here that says you have
three days to change your mind orto rescind this contract. All cancelations are
subject to twenty five percent cancelation fee. I can't see how you couldn't have
seen that. But do you thinkthis is the entire Do you think this
is the entire agreement? Is thereanything on the reverse side? I don't
(42:34):
see anything referring to a reverse side. Here's the deal. I want to
make this clear. Contracts do nothave to have a three day right to
rescind, but contracts at home dorequire a right to rescind. So I
don't understand why they would not putthat on there. And if this is
(42:58):
the contract, I would have oneof our deputies call and say, are
you aware that if there's not athree day right to recind, you have
to include that. I mean,I unless I'm missing something, was that
law changed? I don't think itwas, so, So Mark, look
it over a little closer. Aswe get to a break here three oh
three seven one three talk hold onand we'll talk to you, Darlene uh
(43:23):
after the break and we'll talk aboutit. Compass insurance groups still doing insurance
checkups. All you have to dois call them three oh three nine nine
six nine thousand. Make sure you'renot over insured, under insured, paying
too much. Compass Insurance Group threeh three seven seven nine uh so,
no it's not seven seven nine threeoh three nine ninety six nine thousand,
(43:44):

All Right, I want to talkabout this three day right to resin
(44:27):
because I don't want people going nuts. Now I looked it up. It
looks like and again, I amdoing this quickly. We're live on the
air. Blah blah blah blah blah. Okay, So it looks like only
when you're solicited at your home thatyou have a three day right to rescind.
And it's not just that your home, it's or if you meet someone
(44:52):
in a place other than the normalplace of doing business. For example,
if you meet a car dealer ata restaurant, or you meet someone at
a restaurant, you could have again, I say you could have. It's
very fact dependent a three day rightto rescind. Now at your home,
if they solicit you, you havea three day right to rescind. Except
(45:14):
for roofing, you always have aright to rescind. And also with some
other ones here mortgages, health clubs, well, any time mark not just
more anytime you're putting your home upas collateral, and timeshare agreements and health
(45:35):
clubs, whether they're no matter whereyou sign those. So it's very fact
specific to what the contract is.But I think if you call someone out
there for an emergency repair and signsomething, there is absolutely no recension.
I don't think they had to puta three day right to rescind in here.
(45:58):
I think she's stuck. That's whatI think. But I'm not going
to give her legal advice. ButI have a feeling they can probably press
this, Darlene and get a cancelationfee. And as Mark pointed out before,
if they came to your house whenyou called them and they gave you
an estimate and they took a depositand they're ready to install it. The
(46:21):
mere fact that you did research afterwardsshould not be against them. I mean,
in other words, that's your problem, not theirs. And I look
at I'm not sticking up for theseguys. You have to understand this.
I am not telling you these aregood guys or you should go with them.
What I'm saying is it's kind ofnot fair. Did I change the
rule after you signed it? Andyou're gonna say you didn't know about the
(46:45):
cancelation fee. We'd have to seethat signature box and how it was presented.
Really, I just don't know whatto say, but I do know
that these electronics signature of boxes, like even at a doctor's office or a
hospital, they have you sign ablank pad. I mean it's literally a
(47:07):
mousepad, right, or not amousepad, but like a track pad that
you sign and they let you lookon the monitor and that's what they tell
you you're signing. There is noguarantee that that signature is being attached to
that document. I mean it's tome that's one day is going to be
challenged when it comes to responsibilities, rights risks all of that, but right
(47:31):
now people are skating when it comesto these electronic contracts. However, in
your case, I think you're goingto have a tough time. Is there
no way you would even consider lettingthem do it, Darlene? I would?
Is I just want, like sensitivea water heater and having to do
(47:52):
deal with gas. I'm just notsure how professional or if they're like I
don't even know if they're licensed oranything. Well, Darlene, I don't
think they're not licensed. I mean, you can ask for licensing information and
all of that. There's nothing wrongwith asking for that. If you simply
(48:14):
think you're paying too much and youchanged your mind, that's not gonna work.
So you're gonna have to deal withthis because I think that everything looks
plain and clear to me on this. They've disclosed everything. I mean,
I don't see that you're automatically assumingnow, well, maybe they're not licensed
(48:34):
or they don't know what they're doing. Well, for goodness sakes, you
should have thought about that, oryou called hey, can I make a
suggestion? Tom? Yeah, it'sgonna cost if she cancels, it's gonna
cost a five hundred bucks, right, Yeah, So why don't you let
them put the put the water heaterin, and then for a hundred bucks,
have one of our people go inand just check it. That way,
(48:58):
she saves four hundred dollars and shegets on. First of all,
they need to pull a permit sothe city will check it. If they
don't pull a permit, I meanthat I don't know if you have to
pull a permit on a swap doyou not on a water heater? I
don't think so. I don't know, but I have one of our guys
take a look at it, andthen she'll be satisfied. You know,
(49:22):
let's find out. You know, what is it? Permit? I don't
think you'll have to pull a permit? You don't think so. Well.
I'm not saying on some cases youmight have to, but I'm saying generally,
I don't think. But I guaranteewe have a ton of plumbers listening
that know the answer. Three ozhothree martino, let us know or three
(49:43):
oh three seven one three eight twofive five. Yeah. I'd like to
know if in fact it is applicablefor a swapout like for like and Darlene,
what are you doing for hot waterin the meantime, I'm just taking
showers outside of the house and heatingup water on the stove to wash dishes.
(50:08):
And you've been without water since oneday. Okay, Okay, I,
like I said, I would bevery cautious about not going through with
this. So far, I don'tsee what they have done wrong, and
you know, I just don't thinkthat they've done anything wrong. So on,
(50:31):
Thank you very much for calling.Let us know how it goes,
though. Please three O three sevenone three talk is our number, folks,

anything special? What are the warningsigns you're being cheated on when it comes

to money? Okay? You noticenew stuff around the house, or your
spouse or loved on wearing new stuffokay, jewelry, watches, clothing,
or when you bring up the subjectof money, your partner gets defensive.
(51:15):
Hey, I'm gonna share it.Let me share a story about exactly what
you're talking about. Suzanne's got avery good friend, and I will not
mention names her sister, her bestfriend's sister. Listen to how crazy this
is. She had so many creditcards, she had a po box and
(51:35):
most of the credit cards were actuallyin first or second hubby's name, and
she would get all the bills toa po box. This person, for
years and years, built up creditcard dead of well over fifty one hundred
thousand dollars in her own God neverknew a thing until it came unraveled.
(51:57):
And by the way, that's numberthree in danger signs the mail is secretive
or off limits. Number four. You suddenly get at gifts and he or
she says, Oh, I justwanted to do something special for you,
Yet you can't figure out how it'sbeing paid for. What about this?
(52:20):
You notice large cash withdrawals that areunaccounted for. Many people assume it's for
a mistress or for a mister orwhatever you call a man you're cheating with,
But in any case, no,it's not. Sometimes it's just because
someone needs to make payments. WhatMark, you know one of the saddest

insurance. By the way, Godalmighty, you just don't get worse than
Fred Lawyer, do you? Youjust don't get worse? Ray? What's
going on? When you have readFred Layer, you have a problem.
(54:15):
What's going on? No? Idon't have friend lawyer. The person that
rear into me has friend lawyer. That's worse. Yeah. Wait wait are
you are you not getting paid?I'm like, well, that's just it.
I took my card to the bodyshop for the estimate and it comes
out to twenty three hundred dollars Ireceived out of the blue a check for
(54:39):
Fred Lawyer for two hundred and eightysemi dollars, which is far less it's
going to cost me to get myvehicle red here. Wait wait, wait,
did they say it was full andfinal settlement. No, they didn't
say full and final settlement. Whatthey said was when I called him about
the two hundred dollars two hundred dollartech, they're telling me that take it
(55:01):
to the body shop, have themdo a what is it a supplemental claim
or whatever they call it? Yeah, yeah, right, So they're saying,
are they actually saying by their estimateis two hundred and thirty dollars correct?
And that's too coincidental that it looksa lot like ten percent of the
(55:22):
estimate? Are you sure? Areyou sure they say we believe it can
be fixed for two thirty or arethey saying we traditionally give ten percent first
and then they have to submit aclaim. What does it even matter because
they told you that they'll they'll paywhatever supplemental But every body shop that I
(55:45):
go to, reputable body shop, says that they will not deal with for
a lawyer. Well, I don'tblame them. I don't blame them,
they'll do. They'll do the workand they'll take it'll take they'll approve the
supplemental dam. But then it wouldtake eight nine months for them to get
paid. You know they're not lying, they're true, that's true. Well,
(56:09):
you know what I would do.You know what I would do.
I would sue the other driver insmall claims court for the money. They
would have another problem. The individualthat hit me did not have a driver's
license, but they sold him insuranceand he has a he's a residential car
(56:31):
art or conflict card from the countryof Columbia. So he guy doesn't even
have he doesn't even have a validUS. Yeah, but who cares.
He's got insurance. You're going whocares if he's valid or not, long
as he's got insurance and they're willingto pay. Did you tell him your
neck hurt? Yeah? I tellthem all that to you. Yeah,
(56:52):
and that what they say. Well, I have an attorney who's going after
him for the I'm just wor aboutthe property right now. Well, here's
what kills me. If he calledI don't know who your attorney is,
but let's look at it this way. If he called up John Fuller,
he wouldn't have this issue because Johnwould help him with this. But good
(57:13):
news for you, caller. Johnwrote a book, and it's a very
quick ebook on exactly how to dealwith this circumstance, and he'll give it
to you for free. But here'sthe deal man you need. I think
you can probably find a body shopthat might deal with them. Or did
(57:34):
they on the check? Is itmade out to you? This made out
to be. You may have togo to a body shop and sign for
the work and then have them paythe bill. You may have to do
that. You may have to guaranteeit. Ray you always do that anyway.
(57:58):
I have never once gone to shopwithout guaranteeing the work. Okay,
even if you have insurance, theywant you to guarante you sign for it.
They don't. They don't have theother party signed for it. They
have you signed for it. Right, But I would make damn sure you
(58:19):
never signed a thing that said thatwas full and final settlement. Do you
have anything in writing that says theywill pay the claim? No, I
just have their confirmation that they acceptlive ability for the accident. Okay,
that's what I would do. Iwould go to a reputable, reputable body
(58:42):
shop sign for the work, andthen I would have if it's a reputable
shop and you sign for the work, when they get paid, they'll give
it back to you. Okay, they will, but make sure it's a
good body shop and they're not goingto keep the money. Yeah, but
that's my issue here. I don'thave any body shop to say it.
(59:06):
What you're telling me to do isgo aheadside for the work and pay for
it out my old pocket. No, I didn't say to paid for it.
I said, see if they'll billlawyer and if loyal will pay them,
and then you tell the body shopif they don't get paid, you'll
make good as long as they reimburseyou. There's nothing wrong with that,
Okay already. I simply have tofind a good body shop, and we
(59:30):
know of several. I mean, really, they will do it. So
go to Mark. Who do wehave just right off hand referral list?
Well, Michael sold I still thinkyou're a good organization. I don't know
about the new ownership, but I'lltell you this, it looks like the
same people are there that actually workon the cars. So I'm pretty comfortable
saying Michael's in Castle Rock is agood one. Michaels and Castle Rock.
(59:55):
Okay, they are a good organization, although I couldn't do a call back
the area. Yeah, body Works, Murray body Works, they're excellent.
Okay, Well, thank you somuch for you body Works by Murray Motor
Imports. What kind of car doyou have that's a Chevy Tahoe. Yeah,
they can still work on that. You can also try a good Chevy
(01:00:20):
dealer that has a body shop.Don't go to one that doesn't have one.
They're just going to sub it out. But yeah, try body works.
Although I'll tell you where'd you getthe estimate duel collision? And why
don't you want to go there?I do want to go there, but
they refuse to work with for alawyer because of problems they've had in the
(01:00:45):
past with them. But would theydo it if you guarantee it? Oh,
they'll do it if I guarantee youyes, and then you might if
you know these guys, you mightwant to do it. Listen, Mark,
we have to shore up our Wehave to shore up our body shops.
Man, we don't have any wegot I'll tell you what happened to

and that's caliber. They're a bigoutfit over on East Evans, I've

on with you? Man? Hey, thanks so much for taking my call.
I've got two issues. The firstone I had a contractor walk off
the job. I mean could goyesterday, and this person already did a
project for us. And you knowthey have a deposit no money, of
about oh fourteen thousand dollars. WHOAso wait a minute, can I assume
(01:03:31):
AJ? He walked off the jobafter taking a deposit of fourteen grand and
you did not get any value. So a portion of the materials were delivered,
and when I looked him up online, the value of that about five
thousand dollars. And they weren't theentire material list, but they walked off
(01:03:55):
the job because I got frustrated becausethey weren't putting the preventative measures down as
far as the plastic and heartwore andall that stuff down on the carpet and
everything. So I kind of calledthe contractor out there. They have the
initial demo, and we just holdon, hold on, AJ. Some
(01:04:18):
materials were delivered and they did dosome initial demo or not no demo,
just a portion of the materials weredelivered, and it was the first day
of the demo to began. Theyhad already completed a project's basement and they
put all the preventive measures down aroundthe doorway and all the Look, okay,
(01:04:39):
AJ, what I need to knowis this on the basement. I
don't want to mix these up onthe basement. Right, it was completely
done paid for. There's no issue, is that right. They're still an
outstanding credit that they owe us,so approximately let's say fifteen hundred dollars.
But that's the point of matter,is that job was done to a certain
(01:05:02):
standard. No, I get it. I get why you're upset. What's
the name of the contractor. I'drather do that off line or not on
the air, just because okay, and and let me ask another question.
If this guy walked off the job, does he expect to keep the money
(01:05:23):
or is he going to settle up? Uh? The reason they love they
walked off the job is they claimedit was a hostile work environment because I
I lost my cool getting the factthat our family just withdraw this health issues.
No, I get it, Iget it. But it doesn't matter
(01:05:44):
what reason he gave. Is hesaying because it was hostile, it was
a breach and he gets to keepthe money. I didn't say it was
a breach, He just said itwas unsafer? Is for Okay, I'm
going to ask this again, AJ. Does he claim he has a right
to keep your money? They wantto. They send an email to basically
(01:06:11):
say, we want to give youcredit for the material delivered. The reality
is the material delivered he wasn't completeand be and it was marked out for
I'm sure pretty What does that mean? What does that mean he wants to
give you credit for materials delivered? You mean he wants to get credit for
that? Correct? Well, Sin, what does he think he owes you?
(01:06:41):
We sent the response email on Saturday. What does he think he hasn't
told you? Yet what he iswilling to refund correct. That's where it's
all going to lie. Aj Iwouldn't want the guy at my house go

Waterpros dot net now has financing availablefor all their water systems, and
you can get a whole house systemthe full Monty for just ninety bucks a

month for a limited time. Also, I want to tell you you can
get drinking water reverse osmosis at thekitchen sink now more than ever. Did
you see those stupid little filters Denversends out to clean up your water?
Are you kidding me? They're admittingthey can't keep your water safe. They're
admitting it. Denver has gone inthe toilet. By the way, a
waterpros dot net three O three eightsix two five five five four. You
(01:08:35):
remember what a great city we movedto, or maybe you were born here.
I mean, can you believe? Can really can you believe what's happening
to this city in general? Ingeneral? God, I mean, what
a mess? What a mess?You know? I don't even go downtown.
Do you go downtown anymore? Youthink people are gonna go downtown ever
(01:08:59):
only to the theater and then goback home. But even there, you're
right, you can part it andget out. It sucks. Now.
This issue with a contractor, AJsaid he put down some money and the
guy walked away. There was adisagreement. No matter what the reason,
if there's a breakdown in communication,I don't think any contractor should keep money
(01:09:20):
that has not been spent on theproject. In fact, the Contractor's Trust
Act is very clear on that moneyput down for a project has to be
used for the project, can't becross collateralized or cross mingled with anything else.
(01:09:40):
Now, if AJ put for fourteengrand down and they had a falling
out, unless the contractor lost moneyas a result of that and can prove
it. Let's say AJ breached thecontract and this contractor had ordered stuff and
paid for it, well, thenAJ should pay for it. But then
(01:10:02):
AJ should get the stuff that wasordered for him. If there were designs
done, he should be paid forthe designs. The contractor he had mentioned
that about five thousand dollars in materialswere delivered. I think that's what he
said. AJ. Is that whatyou said, were about five thousand dollars
in materials delivered? Yeah? WhenI looked at all the goods that were
(01:10:27):
delivered, you know, the valuewhat I could look online was about five
thousand dollars. Now did the contractor pay Did the contractor order those or
did you pay for them? Yes? The contract Yes, I said,
did the contractor pay for those ordid you pay for those? I paid
the contractor who delivered those goods, and then okay, value that I determined.
(01:10:51):
Okay, So what I am sayingis if you paid him a fourteen
thousand dollars deposit and he gave youfive thousand in goods, he would owe
you nine grand. Yes, Butwhat if I choose to go in a
different direction with the materials and justsay you breached it, you walked off
(01:11:13):
the job, take it all back, give me one hundred percent refund other
than the plans you drew up.I don't think you could do that.
Well, I think you could underthis, says Okay. If you could
prove that he was one hundred percentat fault for breaching the contract, then
I would do Then. I believeyou could unwind everything and say I don't
(01:11:35):
want those materials. But here's whatI think would happen. I think it
would cost you more than that toprove that, and it would be a
mess. I think that you havethe value of the goods, and in
most court cases they would probably ruleI'm not giving you legal advice, but
(01:11:57):
just what has happened in the past, they would probably say. It's something
called quantum Marriott Marriwitt, which meansyou got the you got the value,
pay pay for what you got andany design work. If this contractor could
put together a reasonable amount that hehe he gave you in goods and in
(01:12:19):
services such as design work, thenhe could probably walk away and refund the
balance. So I don't think it'sI'm just saying my my impression. I
don't think it's reasonable to want onepercent of your money back. In fact,
I don't think you'll get it,So I don't think I think it'll
be more of a fight than it'sworth. Well, unfortunately, when my
(01:12:44):
wife signed this deal, the legalramifications there's nothing other than a better Business
Bureau mediator, which I'm not areal fan of, but that's our really
only option. Wait a minute,we're going to agreed to a better Business
Bureau arbitration? Yeah, our familydid, Yes, so you agreed not
(01:13:11):
to sue. Yeah, well that'sgood because a lawsuit in this case would
be useless. But I don't thinkI think the better business brewer. There
are a bunch of morons. SoI mean, if they're a dinosaur that
you know, they don't they haveno function at this point in life.
I mean, it's it's a relicof the past. But if they have,
(01:13:33):
did they say who they provide asan arbitrator and how you do arbitration?
I haven't even gotten that other thanthat's the course of action on a
disagreement. Has the guy offered anythingor is he expecting to keep the whole
thing? What does he want todo? I haven't heard anything since our
(01:13:56):
response on Saturday last week. Theywalked off Tuesday a week ago. In
your response, your response was whatwhat? A response to what? Basically
said, listen, you broke thecontract. You walked off the job.
Yes, a husband got upset becauseyou didn't follow a protocol, was laying
(01:14:16):
you know, things down the carpetand protective measures. But that doesn't just
fly you to break a contract. And secondly, we've asked for our full
deposit of materials given back and youcan come pick the stuff up. That's
where we left it. And wesaid we've taken an inventory of goods.
What is your inventory? Show andspend crickets? Okay, But before you
(01:14:40):
said that, did he send youanything? Yeah? Basically said unsafe,
hostile work conditions. I don't wantto put my staff at that risk.
And we were relieving and we cangive you credit for whatever materials. You
know, Okay, he can payfor whatever those materials, but I don't
(01:15:02):
want to have to pay more.Hold on, hold on, So did
he say though? Did he sayI would refund the balance? It was
a very loose language, well determinedadult, and that's kind of what we've
corresponded as what that is. Well, I think you're unreasonable. He's unreasonable,
(01:15:23):
So you're both unreasonable. So it'sprobably going to end up in court
unfortunate or at arbitration. But Ibelieve that if you are willing to walk
away, I don't what what designdid you get? Did you get a
plan? We did, and that'spart of the fee, and that's fine.
(01:15:44):
We accept that fee. But well, hold on, how much?
How much is the how much isthe plan? A couple of thous of
books? Well, who says, well, that's what that's what they determined
for sure? Who determined, aja, I'm sorry, who determined this?
(01:16:09):
Designer and contractor they established? Didthe designer say they wanted two thousand dollars
for design? I had a certainfee that was agreed upon before the project?
How much was the fee that wasagreed upon? Two thousand Okay,
(01:16:29):
So the way I look at it, there's two thousand in a fee,
five thousand in materials for a totalof seven thousand. So I think you
should ask them or or we canfor you if you want to settle for
seven thousand, get a seven thousanddollars refund and move on. If you
(01:16:55):
want us to do that, wewill. If you don't want us to
do that, good luck and goto the Better Business Bureau. But I
think both of you have to givea little. Zach's got a comment on
this. Go ahead, Kachina, just find out what AJ wants to do,
and we'll let Deputy Doc call overto the contractor and say, look,
you know two thousand for design, five thousand for materials, will you
(01:17:17):
give the other seven thousand back? That's what they should do. Zach,
what do you have to say?Go ahead, Zach Hei Tom. I
think what this guy is trying tosay is the contractor went through his buddy
to buy the materials and he gota markup on it, and he doesn't
think the guy should pay for thatguy's kickback on the markup. That's why
you say I didn't hear it,Well, I didn't hear him say that
(01:17:38):
at all. But if that's thecase, that's not for him to determine.
If he if I mean, itwould be whatever the value of that
material is, that value has tobe discussed. Whatever the value of the
material is. He doesn't just getto arbitrarily say here's the way it's going
(01:17:59):
to be. I want all mymoney back. He's just not going to
get to say that. And it'stoo bad. But it doesn't work that
way. You don't get to dictateyour terms and conditions. Thank you,
Zach, I do appreciate you callingthough. Three oh three seven one three

three oh three nine two zero sixteentwenty two. Hi Tom Martine here,
three oh three seven one three talksseven O three eight two five five.
We have Mark with a smart kunklefrom probid Energy dot com. They do
solar systems. So with solar systemsright now, financing is a bit of
(01:19:09):
a challenge. But you have somegood money through a government backed agent,
go ahead. Colorado renew Loan hasa great, great loan for solar and
batteries. And if you live inDenver, there's some rebates tied to the
heat pumps too, so if youhave a heat pump, you can get
a rebate on the solar. Sothere's a lot of good things happening out
there. People just have to reachout to us and we'll put together a
(01:19:30):
design form. We need to outway is there's no charge to come out
and look and do design. No, not at all. We'll do that.
We can even do it virtually.I just have to provide us with
one of their electric bills and wecan build something off of that. Do
most people have the exposure for sunthat they need to get a system.
Yeah, around here they really do. I mean there's a lot of great
(01:19:53):
sun exposure in Colorado and we're werank high for solar power and there's a
lot I don't have to do.You have to have southern exposure. Southern's
the best. But with time ofuse. Now east and west also works
very well. Now what do youmean by time of use? So Excel
charges you more in the afternoon foryour electricity, So if you're on a
(01:20:15):
west facing roof, you're producing morein that afternoon. So there's a lot
of tricks to the trade and that'swhy we're an experienced solar company. And
now batteries help with demand too, right, Yeah, charge the batteries with
your solar and discharge during the highestprice, which is hey, mark you
and the charge. When Excel chargesmore money because of these smart meters,
(01:20:39):
by the way, people are insane, I would go with direct billing those
smart meters that they're just garbage, and they're thinking of changing that. I
don't know if you guys saw that. They're thinking of instead of whatever it
is now three to seven or whateverthe peak time is, they're thinking of
moving that. They were talking aboutit in front of the PUC. But
where I'm going is when you paymore money for solar, are you selling
(01:21:00):
it to them for more money orfor the same amount or for less money.
How does Excel screw you there?Well, it's it's a per kill
a wat one killowat to one killowattrade, you know, So it's an
even trade with the production. Soit doesn't matter when you're producing it.
You're getting an exact trade on it. Yes, that's my way. When
(01:21:24):
you produce excess and sell it tothe grid. So if you don't they
buy it at wholesale, they don'tbuy it. They store it as a
grid credit. If you do buyit, they pay it back at like
four cents of killo watt three centsago. But the wait marky that was
my whole question. So it doesn'tmatter what the pricing is. So if
all you do is use peak timeand you're paying whatever that is, as
(01:21:46):
long as it's a credit per credit, it doesn't matter the cost. You're
offsetting it with a credit. Correct. Now, there are some examples that
Time had earlier with commercial where they'lloverproduce and have a partnership with Excel,
But very few times will you seethat in residential sitting. No, No,
you won't see that in residential bythe way. By the way,
(01:22:06):
Mike wants to talk about breaking alease, so let's get him in here.
Go ahead, Mike, and anyonecan call. We have some lines
open at three oh three seven onethree talk seven one three eight, two
five five, or of course threeoh three Martino, and you can always
leave a message and we will callyou back three oh three six two seven
eight four sixty six. Go ahead, Mike, Yeah, Tom, this
(01:22:28):
started the first to last month rightabout and then uh, my water in
my bathtub was not going town downwhen I was taking the shower was growth
slow, so I'd ended up settingit in dirty water where I took a
shower. Yeah, first or lastmonth, I told the landler about this,
plus a couple of other small thingsin the apartment. As she said,
you get a fix all month long. I stood in dirty water first
(01:22:53):
of this month. I told heragain. I said, I got actless
slit my skin on my on mybottom of my feet, killing off because
I stand in dirty water every timeI take a shower. TM I,
we get it. Yeah, weget we believe you. This is almost
a month and a half too much, Okay, Now, Mike, that
(01:23:13):
would not be a habitability issue mostof the time. It depends on the
municipality. But what they consider ahabitability issue. Of prime importance is safety
and security, and they consider forexample, heating not air necessarily, but
heating utilities like running water, hotwater. There's certain things that are considered
(01:23:44):
habitability issues. Okay, now I'mseventy years I'm seventy years old. That's
week so sopium. Other than thatshower, I slipped the fount and almost
broke my back. Mike, Mike, that's not considered a standard of habitability.
Okay, I know you're trying tomake it so, but it's not.
I'm not telling you they shouldn't fixit. I'm not telling you that.
(01:24:08):
But I don't think it would bestrong enough to break your lease and
say you had a right to doit because the landlord breached the lease.
Now, what you could do isgo through this. You could go through
the steps of that constructive eviction. You could say to her or him,
(01:24:31):
you need or the management company youneed to fix this for this reason,
and if you don't fix it withina certain amount of time, you are
going to withhold the rent to payfor it. You can't withhold all of
the rent, but you could calla plumber to fix that to you and
(01:24:53):
pay the plumber for that issue. However, you're going to risk an eviction,
and what you would have to dois prove with receipts that you had
to do that repair for health reasonsand that you paid directly the plumber the
money you did not pay in rent. Or you could ask the landlord.
(01:25:16):
Just ask the landlord if they willlet you out of the lease. Do
you think they would let you outof the lease? I don't know,
I asked, I don't know.Now you're telling me you've complained about this
and they've not so much as calledanyone. Did you know a lot of
times you could buy something called liquidplumber. All I'm saying is I tried
(01:25:39):
that and it did not work atall. Uh I would well, well,
like one day it went down alittle bit, a little bit quicker,
but the next day would back tostop again. I mean sometimes it
takes reteat repeated treatments. But youknow, we don't mind, Mike.
We wouldn't mind calling your landlord foryou and just saying, look, you
(01:26:00):
know, you really have an obligationto fix things like this. We could
exaggerate a little, but I don't. If you think do you want to
move, let me ask you that, Mike, do you want to move?
Yes, I'm I can't live thereno more, Tom, I'm in
my apartment fund apartment. They okay, okay, do you have any serious
(01:26:26):
problems that would be habitability issues?Do you have any heat problems or security
problems or anything like that. No, okay, what's the most serious problem
you have? Are you want anysubsidies? The other day, well today,
and I complained about it, andshe took pictures of it. I
(01:26:46):
walked out of my apartment and stillto this date, it's quote ice.
When I walk to my car,it's like ten inches of ice, nothing
but ice. And the other jackNow, I'm stout, almost broke my
neck. So I complained them toher. She went and took pictures of
it, and up to today, the eye is still there. The suddenly
(01:27:09):
hit it. I don't think youalmost broke your neck or you would have
been in the hospital, But wellI did. I did, scratched my
arm up pretty quick, and Ishowed him the cuts I got out my
arm, and uh, she justlooked up because, wow, do you
want us to call? Do youwant us to call the landlady? And
kind of scare her A little intogetting a plumber out there. I was
(01:27:32):
gonna I'll go out ask you tonow the viction, Now, why don't
why don't you do it in anice way? First, here's what you
do. I got an idea,Mike. Why don't you tell her that
you've talked to us, and wetalked to you about constructive eviction where you
(01:27:53):
can get out of a lease ifit's intolerable or unsafe or unhealthy, and
you don't want to have to gothrough all of that. If she will
simply let you leave sounds, callme back and let us know what she
says one way or the other.Okay, I'd like to know. Three
oh three seven to one three talkseven one three eight two five five Mike,
(01:28:15):

Maybe we have to get an experton what's what's the issue with your
insurance claim? Michael? So it'sbasically on my credit report. It's a
negative account because the insurance company tookmore than six months to pay it off.

health insurance claim? Or property orcasualty? What? Was it? Auto?
Auto accident? So what happened?Okay, so full coverage on the
vehicle. Yes, it was myfault. I rere in it somebody,
(01:29:53):
but they, of course agreed topay the claims as it was full coverage.
I owed a balance on the Waitwait, wait your car? Was
your car totaled? Yes? Soyou were ended another car and your car
was totaled? Yes? Okay,go ahead, keep going so I had
(01:30:18):
still a balance on my loan.So the insurance company agreed to pay me
the portion on top of what wasowed. So I got a check for
like a few thousand, but thenthere were still like six or seven or
so thousand on the loan. Theysaid they would have to send directly to
the credit union and not to mebecause it was owed to them. They
(01:30:42):
had a lean on it. So, Michael, I need to know something.
Did you have gap insurance or didit just so happen that the value
of your car exceeded the loan both. I did pay down the loan quite
a bit. I also have GAFFinsurance, so I'm not sure. Okay,
you benefited, Okay, gotcha. So, by all rights, your
(01:31:05):
car should have been paid for.Yes, the issue is it was paid
for eventually, but it took solong the credit union wrote it off.
So now it's like, I don'tknow what they call it. I forget
on my credit report. Yeah,it's a rite off. It's a bad
(01:31:27):
debt, they said. You know, okay, they took just you know,
the credit union did the right thing. They had a right to do
that, and they had a rightto hold you responsible. You know that
right, So it's not the creditunion. Your beef is with the insurance
(01:31:47):
company. How long did it take? How long did it take your insurance
company to pay off this balance. It's been a while, so I know
it was like somewhere around six orinemonths. That's that's unreasonable. I received
my check within a few weeks. But so here's the thing, it took
(01:32:10):
longer. So I started calling myinsurance. I was going back and forth
between the insurance and the bank,be like, why what's taking so long?
What's the problem? You know? And I did this multiple times,
right, and they first they sentit to the wrong place for some reason.
The bank said they never got tocheck. Then I you know,
(01:32:30):
it's just over and over again.I was trying to make sure you know,
I agree it sucks, but Idon't think it really matters to you.
Well, hold on, Mark, technically, he was responsible to keep
making his payments. I find thebandlord and something happens and someone owes me
money, and you know, there'sall kinds of reasons they don't have it.
(01:32:53):
At the end of the day,it doesn't bother me. I just
want my money. Mark. We'renot saying that. I just say that
I just said that his credit uniondid the right thing, and they don't
owe him anything, and they shouldhave reported him late, and all of
that's proper. What's not proper isthat his insurance company took nine months to
(01:33:14):
get it done, and that's whatcaused the damage. However, the argument
may be made that during that ninemonths he should have continued to make his
payments. Would this is what Ineed to know. Did you ever consider,
because you would have gotten some ofthat money back, did you stop
making car payments? Yeah? Idid so. On paper, it looks
(01:33:42):
like you defaulted on the loan.I can't argue with that. So,
but your insurance company should have beenquicker at doing this. This is weird,
man. This is weird because it'spossible that even if they took a
(01:34:02):
month or so, you could havebeen late on a payment or two.
See, this is what this iswhere people get into trouble. I don't
know, man, I think I'dbe very upset if your insurance company took
that long. What does the creditunion say about it? They they're really
(01:34:28):
not taking any blame for it.They're not going to change anything. Well,
they're not going to change anything, but at what point did they say
they wrote it off after how manymonths they didn't? I found out just
because I did one of those annualcredit checks looking over my credit, you
know, and how bad did it? How badly did it affect your credit?
(01:34:53):
Well, it's hard to tell you. Well, I mean, what
was your credit before and what isit now? I couldn't answer that I
didn't follow it the month before andthe month after, you know you did
it was now? Well, letme ask you if do you normally Michael,
(01:35:15):
what do you normally have as aFICO score? It's around six fifty
normal? In other words, theyear before you say, you do your
annual report, the year before, what was your credit score? I did
an annual report at that time.I wasn't really concerned of what my credit
(01:35:36):
score was. Okay, but Idon't think your credit. Hold on,
I'm I'm reading between the lines here. I don't think your credit was affected
that much. If it was sixfifty at its best, what is it
now? Take fifty at right now? What was it at its best?
(01:35:57):
Oh, it's been up to sixnineties maybe, Okay, So what you
have to establish is that it substantiallyaffected you and caused you damage or will
cause you damage. I think,so that's not coming off of there.
So you have an active default onyour record? Is that right? Yeah?
(01:36:20):
Which is bringing my score down regardlessof what it was prior. Well,
no, it's not regardless, becauseif it's bringing your score down,
your score would have had to havebeen higher. They see that burden is
on you. Okay, you haveto show that this is going to negatively
affect you and for how long? And I would seek damages from my insurance
(01:36:43):
company, but you're going to haveto hire an attorney for it. It's
called slander of credit. It's adifficult case and it's going to be expensive.
But do I think they did youwrong? I think they did you
wrong. Do I think you couldhave avoided it? Possibly? But hell,
who would make payments for nine monthson a car that was total?
(01:37:06):
I can see where this happened toyou, man, I can see where
this is dangerous, and it couldhappen to anyone. Who's your insurance company?
It was Bristol West. That's ahigh risk company? Is it that
(01:37:28):
a question? Yeah? Well okay, I've never heard of the company.
It sounds like a high risk company. I want to call our insurance experts.
But I have another question for amiracle. I think it was Farmers
that I was my agent, butthen they pawned off the big policy the
Bristol West. Yeah. When yousay pawned it off, that means that
(01:37:48):
you didn't fall within the normal risktolerance of Farmers. And I believe Farmers
owns this crystal company. But Iwant to check with our insurance experts to
find out a few things I needto know this. How is this affecting
your life? Well? I justhad to recite I'm not refinanced, but

ripped up news. Need that soyou don't have to come running just
(01:40:30):
as fast as we can. Shooter'sgonna help coming. Six is the Troubleshooter
Show. No Tom Martine, HiTom Martine. Here, This is the
Troubleshooter Show. Forty five years goingstrong, the longest running radio show with
the same hostill on the air doingthe same thing. That's right. Well,
(01:40:55):
here's one other show that actually wason longer, but it's not technically
well, it was part music, part talk at one time part music,
then talked then. So I mean, but he's actually the king of being
on the radio the longest he's beenon even though the show changed, So
(01:41:16):
that's a little technicality. Never talkedabout that before. But he can't take
it away from that guy. Nohighest paid radio celebrity of all time ever.
You know what I'm talking about,King of media, baby, Yeah,
I know, yep, he is, there's no doubt, and even
(01:41:41):
more than Rush Limbaugh. In fact, his income dwarfs some Hollywood stars when
it comes to what I'd say, almost all, Well, I don't know
about that. Who knows anyway? You know what you know what I say.
There's one thing that I'm constant inawe of and that is people who
(01:42:04):
produce the highest I don't mean moneyeven necessary, but for their performance.
Like when I saw the super Bowl. You know what, you can say
all you want about how much theymake and all that, but these people
are at such a high level ofperformance. When I think about Mahomes a
twenty eight year old punk that manis so awesome, and then Purty,
(01:42:29):
I mean when you think and Kelseyand all these, when you think of
the the what do you call it? The performance? I mean such a
high level at not only at theirwell yeah, at their age, especially
at their age. But you haveto admire it. I mean, you
know what, it's easy to hatepeople like that, I mean, but
you got to admire performance where peopleare just excellent at what they do.
(01:42:57):
God, I love it when itcomes to music, when it comes to
athleticism, when it comes to youname it, you have to you have
to just say, you know what, those people are awesome and they're inspiring
as well. I think it showsthat anyone can do anything. But then
sometimes you have a tendency to lookat your own stuff, your own kids,
(01:43:20):
your own relatives your own life andthink, God, how did they
do that in such a short amountof time, because they had to have
been geared toward that their entire life. If you look at the McCaffrey family,
it blows your mind. They gotthree sons that are high performers in
football, and then you have youknow, and Christian of course, then
(01:43:41):
Eddie, and even as Eddie's wife, Lisa McCaffrey was a world class of
what she was doing, I wastrack and I mean, man, I
mean, there are just people thatjust they you know, you wind them
up, they wake up in themorning and they blow everybody away. You
could say that for any any occupation. I mean, there are people who
(01:44:02):
are incredible artists, singers, people. I just said that. I just
said, high performers. It doesn'tmatter what field is. And you're absolutely
right, but they just I wasn'ttalking about just I happen to pick a
few athletes as as examples, butyou're right, I mean it have I
mean, look at these research scientists, look at these people who do a
(01:44:26):
high level of anything. I mean, astronauts, for God's sakes. I
mean, we have people that justexcel. But you but think about at
what age do they start getting seriousabout whatever they're getting serious with. I
mean, you know, did deBakey start thinking about surgeries when he was
(01:44:47):
in his teens? Or or arethey just gifted? You know, I
do believe a lot in gifted.I don't mean necessarily what do I mean
by gift meaning that they have aptitudes? They just don't you think doc people
have certain aptitudes, absolutely, AndI think what's interesting is that you have
to find what it is like youtake. Let's say, you know Roger
(01:45:12):
Federer, who's a great tennis player, right, yeah, I'll bet you
that if he had started on anyother sport when he was nine years old,
he would have excelled in that sport. So you think some more attitude.
No, I think it's just peopleare athletically gifted. They have great
Oh I say, yeah, no, I see what you mean. Yeah,
or aiding attitude has a lot todo with it too. There are
(01:45:34):
some people that just can't take thechallenge and they you know, but here's
the worst part. Here's the worstpart about human nature. When people can't
do things or no, no,no, erase that not that they can't
do it, but when people don'tdo things, or don't excel, or
don't push themselves, or are alittle lazy or some for some reason,
(01:45:56):
maybe they weren't nurtured, whatever itwas, and they start disliking those who
do because they're just downright jealous. You know what I'm saying. Yeah,
that's crazy. Well, no,there are tons of people in the world
that they'll hate this, they'll hatethat, they'll do this. They're grumps,
and it's because they don't. Theyjust rather than appreciate what humans can
(01:46:23):
do. If they can't do it, they poohoo it and they just don't
give credit where credit is due. Now, as far as leaders, I've
often okay, let's talk about leaders. You know, to be a politician
and to aspire to an office isa lofty thing. Now, you can
be a crooked son of a bitchand be in the office, yes,
(01:46:43):
but I'm talking about in general,to propel yourself to a public office,
put up with all the scrutiny andget elected. That is one hell of
an accomplishment. I mean, thinkabout that. It is an accomplishment.
I mean, you know when youhave especially when you do a great job
at it, you know, Imean, if you do a poor job
(01:47:04):
at it. It's still an accomplishmentthat you got there. But I often
wonder sometimes what makes someone what theyare? You know, is it true,
like Doc said, would they bewhatever they wanted to be? If
John Elway put his mind to somethingelse? And I'm not talking just athletes,
(01:47:27):
like I'm talking about like if Mahomesinstead of wanting to be a quarterback,
if he put his mind to somethingelse, would he have excelled in?
Yeah, his dad was a majorleague baseball player. I'm sure Mahomes
but would have been a great baseballplayer. I'm not talking about athletics.
I'm talking about what if he wantedto be a research scientist or something.
(01:47:48):
You know what I'm saying, Idon't think. I think. I think
there's a weaning process where people havecertain attributes and they get funneled into those
professions. And don't you think parentshave a hell of a lot to do
with bringing it out? I mean, I mean, if you saw the
story about Michael Jordan, how hismom what his mom did? Oh my
(01:48:10):
god? You know. And andby the way, Taylor Swift was playing
a guitar at eight or nine,I mean, her dad apparently helped her,
and then you had you have allkinds of parents behind these people too.
But yet those parents themselves, wella lot of them have been like
Archie Manning, of course, youknow he has two quarterback sons. But
but not all parents were great. They just made they made great kids somehow.
(01:48:34):
But anyway, so so it's kindof fun to look for the positive
and and and all of the attributesthat people have. Uh. It's also
uh, it's also of course onthe inverse, look at the Oh my
god, look at the monsters, the human the humans have created. I
(01:48:57):
mean, look at the I meanHitler of course, the mind first,
right, it's it's amazing. Anyway, Diane, excuse me, Diane,
welcome to the show. What's goingon? This is a follow up from
yesterday? Yeah, what was thisabout, Diane? Was this wasn't about
your retirement, wasn't? Yeah?Or the red Oh my god, I'm
(01:49:21):
so sorry for you. This realestate investment thing. She has sixteen or
fifteen grand tied up there and can'tget it out because she has to sell
shares. There's no market for theshares. Did we send you to someone
to look at that? Joe?Joe helped me Joe Cano, Joe Canno,
certified planner. What did he dofor you? Well, he helped
(01:49:44):
me. We called the broker andwe just he just educated me on the
whole thing. And okay, whatdid you find out? Tell me what
Joe did and what you found out? Pretty much it's a jump junk.
I ra and uh oh really soyou can't get any money out of it.
(01:50:06):
The only thing I can do is, uh, I guess it's required
by the I R S too thatthey have to take out a certain amount
each year. Yeah, it's it'scalled a minimum required distribution. Yeah,
that's it. That's it. Noware they going to take Are they going
(01:50:28):
to disperse some of that money toyou? Well, you have first have
to apply for it. Yes,they have to. Now here's what I
want to ask you. Did thisguy try double talking Joe? You'd have
(01:50:49):
to he You'd have to talk toJoe. I think I want to talk
to Jock. In fact, let'sget Joe on. I want to find
out what happens. Okay, JoePiano, what did you do for her?
You called up the broker to findout what this was? This?
Let me ask you your your candidopinion Joe, was this a flim flam
getting her into this? Yeah? You know, I believe that one hundred
(01:51:12):
percent. You know, you knowwhy Joe, because you know as well
as I do. As far asrequirements of an invest of an investment advisor,
you have things called fiduciary responsibilities. You also have to be knowledgeable of
risk tolerances. You have to beknowledgeable of the products you're putting people into.
(01:51:36):
And there's something else show that canget an investment advisor in big trouble,
and that is called suitability. Right, that is right? How would
you explain suitability to our listeners?Well, you know, we take that
very seriously, Tom, because youknow, we match the product to the
(01:51:56):
consumer. You know, we wetalked to the consumer and that when are
they going to need the money? Are they going to need the money immediately?
Then we know that a long termannuity or an IRA long term may
not be suitable for them. Ifthey can say, well, you know
what, I have enough money tosurvive for maybe ten or fifteen years,
(01:52:18):
then and IRA with the potential forgrowth that will give them an income for
life, it would be a verysuitable product. And also the risk tolerance,
you know, this poor lady,Diana. I mean, it just
breaks my heart because he went toa broker and then the broker left,
I guess he left the company andanother worker took the place he ques.
(01:52:42):
So Joe, Joe, for justhaving this little amount of money, he
had no business putting her into ared No, absolutely not, because see
that read is frozen. Like Imentioned to you through my emails to you
yesterday. You know, when thered it's a public offering. The company's
(01:53:03):
going to redeem the shares at adiscount rate, So the consumer will take
a loss anyway if they do that. But when we can she get any
money out of this at all?Nothing? Nothing, nothing, nothing.
The only way that she can getthe money out would be if the company
goes out of business and they haveto sell out the property that they invested
(01:53:24):
on, then they'll get whatever theyget. It's a bad, bad situation
for Diane, I mean really totallybad. And the broker that sold it
to her was not be enough fiduciary. I can't tell you that right now.
She didn't care about what her needswere. Tom and Joe. There's
no way to get any money atall out of it. No, not
(01:53:48):
at all. The only way wouldbe, like I said, I mean,
if they sell out the company andthe red dissolves, then they have
to you know, pay out whateverthey have available to each of the investors
on the rate. So they're notgoing to take the fall amount. They're
(01:54:09):
going to lose money. And youknow, I should mention something since you're
already there. What when you teachother advisors? What courses do you teach?
We teach. We teach about onehundred and ten courses a year,
and they deal. What kind doyou do you teach? Like, okay,
(01:54:30):
Joe, do you teach for thedifferent series of licenses or just one
or how many? Now? Weteach actually for the life, accident and
health and also annuities, long termcare. We teach ethics, which is
really important, and we teach suitabilityto the people holding licenses to sell those
(01:54:54):
products. Okay, Okay, that'swhat we teach. So we're pretty well
right Well, Diane, I'm I'mreally sorry that this happened to you.
This this is like it's down thedrain. Do you recall what your original
investment was, Diane, you're theactual money out of pocket? Think?
Yeah, I really can. Yeah, I guess. I mean, like
(01:55:17):
I said, the original broker,he quit on me in them. Yeah,
but what I mean is I don'tthink it's as bad. Well,
here's what I mean. If wehave to pick a bright spot. You
have what they say is a sixteenthousand dollars value. But I don't think
that's what you invested. I thinkthey're giving it a fake number. But
(01:55:41):
Joe, do you think she investedthat much to begin with? Yeah,
I don't think she's made that muchmoney. Tom, No, she didn't
make anything. But what do youcould you? Could you figure out what
she invested originally? I think it. I don't think she invested near that
much. Uh, but no,I think she did. You know that
(01:56:04):
that has not grown, It hasn'tbeen dispersed, nothing has been dispersed basically,
So that means I don't think shehas made any money at all.

I found a car. I don'twant it. It's a twenty twenty
Conig co nin con I segu coninanyway, it's a twenty twenty. I

It's on sale right now if youhurry. It's got fourteen hundred miles for

the wheels on it. They havewheels on it which are fifty seven thousand

(01:58:24):
So let's talk about your problems, questions and complaints. I said, I
was going to tell you about afarmer's wife, And here it is.
On a weekend, the farmer's wifediscovered a gambling site, a real gambling
site. She went on and startedplaying blackjack and then poker, and she
(01:58:47):
started making some ACH's from her accountto a gambling site, offshore gambling site.
Now he had to make some paymentscome Monday and get ready to bring
his crop to market. And Iguess you have to make a lot of
(01:59:08):
payments upfront on stuff and whatever. He didn't have any money. He says,
honey, there's something wrong. There'sno money in the account. She
thought she was going to make enoughmoney. She didn't. In fact,
they lost so much money they lostthe farm in one weekend gambling one weekend.
(01:59:31):
His wife did it online, gamblingonline, couldn't go bankrupt. The
money's already gone, so you can'tstop it, and you can't claim fraud
because they have her online. Andguess what else, they actually have your
camera activated with you gambling, soyou can't say it wasn't you. God.
(01:59:56):
Now this is a few years ago, by the way. Well,
they since made some changes on gamblingsites. But this woman lost everything they've
ever had and their entire farm andhome. Think you about that? Yep,
Jeremy, that that's what I'm tellingyou. You can gambling sites are
very dangerous, Jeremy. What's goingon? All right? Tom? All
(02:00:20):
right, so let me try tomake this easy. So I have a
roommate that I've had there for abouttwo years. He lost his job,
went to jail. I already knewthat he was not going to be able
to pay. I've confronted him andasked him if he's going to tell me
YadA yah. Long story short,he's not going to be able to pay.
(02:00:42):
He's well, what is he?Oh, you didn't tell me what
he owes? So he owes aboutfive hundred and sixty dollars. It's nine
hundred dollars a month that includes internet, water, trash play. The paper,
food, all sorts of Wait, wait, but he only owes you
five hundred. Yeah, correct, because he's only been there for sixteen days,
(02:01:02):
he'll so he's he's moving out supposedlythis Friday, so that'll be sixteen
days that he will have been therewithout paying rent. Okay, that makes
sense, yep, okay, allright. So my question to you is
is it worthwhile to go after himto small claims court to get that if
(02:01:27):
there's no contract? It was allwhen you said he went to jail.
Is he out of jail now?Yes, he's out of jail now?
Is he out on bail? Is? Tell me what his situation is?
So he so he got a DUIand he was driving on revacation and he
got a he got a speeding ticketand they took his license again and he
(02:01:51):
had the deal was that he hadto go to jail because he was already
on probation for a prior to UI. So he had to do like I
don't know, I call it jail, but it really was just some place
in Wells County up in Greeley. And so for a d for a dui,
(02:02:11):
right, for a dui? Sohe's out now, and is he
working now. No, he's beenin my he's been in my basement for
the last sixteen days doing nothing.Well, how are you going to get
him out? How are you goingto get him out? Well, that's
that's the deal. And I'm andmy problem is is that I'm believing him.
I'm having faith in him, whichI shouldn't. That he's going to
(02:02:35):
leave on Friday. That's the supposedstory, is that a friend of his
is coming for you. Well, you better hope he does. You better
hope he does. And here's whatI would he look at. If you
get a judgment against him, it'sprobably worth nothing, right, Okay,
I mean I don't know. Imean you know, it's probably worth nothing
(02:02:56):
for the eviction process. Now,I would be more concerned, see he
leaves voluntarily, because if you startthe eviction process, here's the problem.
If he's gonna think, oh,I got more time. If he doesn't
leave Friday, do you have anythingin writing with him? Nothing? Okay,
(02:03:16):
there's a certain process you have tofollow when you don't have a written
lease. How long has he beenthere? He's been there, he's been
there two years. You're gonna havea little problem. It's not gonna be
as easy as you think to getrid of him. But yes, what
you should do is start the evictionprocess. But you should not serve him
or not do anything or post anythingunless he's still there after Friday. Okay,
(02:03:42):
but you got to do it theright way. If he's been there
two years on a month to month, he has certain there are certain rights
that he has right. Are youfriendly with him? I was up until
this more I mean he was.He was stealing food out of the kitchen
and my wife caught him, andit was all kind of a big debat
(02:04:04):
for this party. We've been We'vebeen friendly for the most part. And
listen, if you feel if yourwife feels threatened at all or unsafe,
you can try to get a restrainingorder, which would get him out immediately.

Hi Tom Martine here three all threeseven to one three talk seven one three
(02:05:12):
eight two five five pro bit energieswith us, Marcus with us. Let
me switch over to my wide camhere. And so you've dropped prices recently,
so why the tariffs have been pulledoff the solar panels? So it's
amazing. So what does that mean? There were tariffs on shipments of solar
panels for quite a while and thosehave been where are they made? All
(02:05:36):
over? I mean China, Taiwan, here, Canada, Texas, pretty
much everyone. So there were tariffsand for overseas shipmentship so they were removed,
YEP. Is that to encourage morepeople to get systems or what I
think? So? I think itall probably ties into the Inflation Cares Act
(02:05:59):
to you know, sentivize people togo solar with that thirty percent federal tax
credit. That helps a ton.Now I want to mention something else.
Nonprofits that don't pay tax. Taxcredits did them no good. But they've
owned big buildings, churches, thingslike that, And now is this new,
(02:06:20):
this direct payment. Now it's agreat opportunity for nonprofits. So what
they're saying is this, even thoughyou can't get a tax credit because you
have no taxes that you pay,we're still going to help you thirty percent
of the total cost of the solarpad. There's still they're going to get
an actual refund of money they haven'teven paid. In correct, it's it's
(02:06:41):
a great opportunity for them to gosolar right now. Well, it's free
money, free money, I meanit really. I mean, well,
it's not free to us, butit's free to nonprofit. So if you're
a nonprofit, to encourage nonprofits todo sustainable and renewable energy, they're telling
them, if you do a solarsystem, even though you don't pay federal
tax, you will get thirty percentof the system costs back in a rebate.
(02:07:06):
Correct, it's a great opportunity forhim to do this. So up
till now that they've been doing havethey been selling their tax credits? A
lot of them had, Yes,they do pay purchase agreements or release and
somebody buys that tax credit, soit's tax credits. That's another thing.
People who can't use tax credits, even people in lower income or middle income,
(02:07:30):
you can sell that tax credit. You don't get one hundred percent for
it, but you can sell it. Correct. In fact, we are
a sun power dealer, so wecan do some lease systems and PPAs for
people that can't utilize that tax credit. They have lower incomes but still high
energy bills, but then they canstill get some of the benefit of a
credit. Yes, through that RWER. So it does right, but it
(02:07:54):
doesn't turn out to be thirty percent. It might be a little less.
It could be, but it's prettyattractive. We can usually do a PPA
for less than what they're And whenyou say PPA, what does that mean?
Paid purchase agreement? It's a lease. So they lease it and then
someone else takes the credit, butthen they get the reduced costs correct.
Yeah, And so how does thelease work? A monthly payment? Monthly
payment You factor that out with basedoff of what their production needs are annually
(02:08:20):
and build a system and that paymentstays fixed. It can grow one to
two percent a year. Or befixed. You pain on how the deal
is structured. And then at theend of a least how long are leases
twenty five year lease? Nice thingabout those PPAs is you have no maintenance.
You're paying for the energy you produce. Really so so they have to
(02:08:41):
keep track of it and fix it. Yeah. Yeah, So you're covered
for twenty five years on a systemthat will be operational and working, and
they send people out to make sureit is. Absolutely That's that's how they
make money. Who is the biggestone that finances these Well, I think
the one we're with right now issun Power. That's probably one of the
largest ones in the nation. That'snot Musk. Isn't Elon, No,
(02:09:03):
no, Musk is. He usedto have what was Solar City and that's
gone and that went into bankruptcy.Musk bought them out and really just through
the label of Tesla on it.So does Tesla Selar still exist? Yes?
Do they do least purchase agreement? That's a great question. I don't
think they do them anymore. Butare they still selling systems? They're selling
(02:09:26):
systems, yeah, okay, Soare the components for let's say a Tesla
the same as most components in mostsystems, are they all basically this?
They're pretty much the same. Teslahas their own battery, branded battery,
They have their own solar panels, but they're all made at the same places,
so it's just a branding thing.Okay. And when it comes to
(02:09:52):
the solar system in general, isthere a lot of maintenance need? I've
never asked this before, but no, what kind of maintenance would be needed?
Something? Really? Just track yoursystem. You might have an inverter
go out, you might have abad panel, but that's about it,
all right. We don't want youup to washing them off either. All
