So, what I've been facing is that I have a
hoa that I live in and the neighborhood has kind
of gone downhill for a while now since the new
board has taken over. And how long has that been, Jeremy,
how long has that been that the board has gone downhill?

It's probably been maybe three years now. And so I
used to be part of the board and people report
a bunch of violations to me and things like, you know,
overgrown weeds, people that have paint issues in the neighborhood things.

Yeah, and were you so you were a really good
You were a really good HOI guy, what some people
might call an hoa Nazi. I'm not saying that in
a bad way. I'm just kind of kidding. But you
cared about your community.

Exactly, And so a lot of the neighbors in the
community came to me to report the issues because they
knew that I would actually take care of the problem.

So what's happening now is that it seems like all
of these violations are kind of going unnoticed or or
unuh basically solved. A guy had basically top soil stacked
in his front yard for over a month and nobody
did anything about that. And this is his front yard,
not his backyard where I kind of just ignore it

or turn a blind eye to it, but right on
the front corner of our neighborhood and things like that.
And I see that the board member U currently doesn't
even have her house painted. There's there's pain.

So you basically did you know did you know that
as a homeowner in a COVET controlled community, you have
a right to enforce a right of action to enforce
them yourself.

I have been reporting them to our you know association.

I mean more than reporting that if the homeowners Association
turns a b on it blind eye to something. If
you have an HOA that everyone agrees to with covenants,
that agreement is between the residents and the HOA and
between each and every resident. So if a resident is.

Doing something that you don't like, you literally have the
right to go after them directly.

I just want you to know you have that right.

Yes, if everyone agrees to it, it is a agreement,
a joint agreement between the individual and the HA and
the community and each community member to each other. So
let's say a neighbor of yours puts up this giant
antenna for a HAM radio with lights on it, and

can go after your neighbor for how it's affecting your property.

That how would you go after them lawyers.

In civil in civil well, yeah, that you would start
by saying writing a letter to them saying, under the
rules of the HA, you're in violation. Since I'm a
member of the HA, I'm demanding that it directed and
send it to the HOA as well. Now are these
direct adjacent neighbors? Are they distant neighbors?

That does make a bit of a case whether you
have standing or not. So tell me about that, tell
me about where the neighbors are.

Speaker 8 (05:36):
Well, I guess the real the real thing that I
was calling about is because I really wanted to get
a copy of the violations that are in the neighborhood
so I could actually determine whether the HOA was enforcing
the rules, you know, uniformly across everybody, or if they're
playing favorites.

Because with these neighbors that you're upset with, these neighbors
that you're upset with, where are they in proximity to
your property?

Speaker 8 (06:01):
One is directly up the street, and then one's probably
on the street as I drive into the neighborhood and
I kind of, you know, that's the path that I
take home.

So they're not affecting your property values. They're not affecting
your property values.

Then, No, here's another issue that you can do. There's
in every kind of in every by law, there is
a procedure for going after the board members and changing
them out kind of you know, impeaching them.

So did you look in your bylaws for that? There
are ways to do that, do you have? First of all,
you have to have other homeowners who care, or it's
not going to work. You're getting the idea that a
bunch of homeowners are unhappy with the current HOA.

Well they just come to me with their problem.

Well, I'm asking you they sign a petition. Would they
sign a petition for a recall vote?

They would probably sign that in heartbeat.

You ought to go to your bylaws. I don't mind
helping you, but for us to help you, it said,
we're going to refer you.

a time, get your bylaws and figure out the procedure
for a recall vote or for taking or for be
you know, taking the seat away from these guys. How
many on the board?

get a copy of the records to see. And that's

Well, that's the right. You have a right to all
of those. You have a right to all of those
under FOYA. You have the Freedom of Information Act. You
have an absolute right for everything they do.

So when I actually went and I approached the HOA
with hey, I want to see the violation logs and
when these are occur in what houses they're associated with? Yeah,
they basically told me we can't give you those records.
Why they didn't give me a reason, and I asked
for a reason, and they still didn't respond to me

with the reason of why they can't do this. Well,
they have to under Colorado state law. It says, you know,
one of the Colorado Revised Statutes that they're supposed to
be able to provide this information to me through this
section thirty eight thirty three. And you paid that.

calls and coverage areas and interferences. We've gotten more AT
and T complaints than ever before. As far as Verizon,
we get some Verizon calls.

on other carriers, but it's occasional. Sharon, What is your
problem is with the Is it with the phone or

for a Verizon phone, I got the phone. The young
man told me what my monthly payment was going to be,
which is supposed to be sixty five dollars.

them that the price, they can't buy the house at
that price. It has to be lower.

They're saying it didn't meet appraise those well, they're saying.

No, no, no, this is one of those it's just

they canceled. I'm assuming in that agreement somewhere they can

what you could say. But if you dealt with these
kind of companies that just, you know, buy homes like this.

Yeah, these investors used very They don't use the standard
Colorado real estate contract form. They use their own very short,
maybe two page contract form, and they're typically not very
generous for the seller at all, so they usually silent
on remedies that the seller might have if the buyer
doesn't go through.

And I would I'd like to ask her right now.
Did she get an earnest money deposit?

there is a box to check for specific performance, and
that's usually a favor of the seller.

So I'm guessing this investor contract form doesn't have that.
So I suppose if so long as this investor contract
form didn't exclude that somehow.

Then if what I'm saying is, can you can you
use specific performance on a buyer?

In theory, yes, but specific performance is an equitable remedy,
and equitable remedies are only a backup to cast remedy.
So if there's a cast remedy like suing for damages,
for example, then a court may not let you do
specific performance.

Okay. And most real estate contracts I thought emit everything
to liquidated damages in Colorado.

Yeah, the standard contract form says the seller's only remedy
for buyer default is to take the earnest money, So
sellers really need to get a large erness money deposited.

And then, okay, that's for the seller, and what is
the buyer's remedy? If the seller balks, the.

Buyer has all the remedies.

and accelerated the car like massively hit these two dips
in the road. They're big old gips that you have
to slow down for, but they were kind of deep,
and he ran and he like got out of control

would turn it in my own insurance and let them
battle it it out, because there's going to have to

a trampoline picked up by a horrible storm in Castle

Well, you're you are for sure supposed to have it
staked down. I mean it needs to be a trampoline
needs to be staked down, because that does happen. I

wasn't staked down, there could be some liability there because

insurance showing what happened, and then you bring it to

underwriting and say, listen, this is not a chargeable claim.
Because it wasn't really hers, but it will show up.
It will show up as a claim on her side.

You don't again, you have to be able to provide
documentation to kind of explain it away.

the scenes. But in a nutshell, Fuke reached out to
American Family for commercial insurance on a building. After she
reaches out to him, about ten days later, they call
her back and they take payment for a full year
of coverage on this commercial building, somewhere around thirty three

(01:30:20):
hundred dollars. I saw the receipt myself. Thirty plus days
go by, so now we're like forty five days after
she has talked with them. She canceled her other coverage
on the building. A different insurance company canceled it. Then
there was a hailstorm, and Thuke, I do forget this.
Why did you think you had hail damage? Did you

see a neighbor or did someone think you ad hail damage?
How did that happen?

Hi, Yes, I was there on the hail day, so
I saw it happened.

But yeah, but that and you know, I saw it,

guy was one of my customer and he's.

Also a roofer guy.

So the roofer who's also a customer, went up and
checked it out and saw the roof damage. Yes, okay,
then this I got you hold on. Then she knows
she has damage. A rufer looked at it. She calls
up American Family, not the agent. She calls up American
Family's claim number, talks to him. They give her a

claim number or we thought was a claim number, and
said someone will be getting back with you. Then that
evening that happened during the day. That evening, she gets
a call from the agent who, by the way, I
guess as part of the Vietnamese community and that he's
kind of like the go to in the community, right Thuke,
in order to get insurance, or at least.

You thought so.

Speaker 15 (01:31:57):
Yes, he called in and saying my inshown was a yes.

Speaker 4 (01:32:01):
So he calls, now listen to this. Forty five days
goes by. Since she made a payment in full, she
canceled her other coverage, which she had until what she
thought was new coverage by American Family. Forty five days
then this all happens. They still haven't refunded her the money.
In other words, they took her payment, then they claim

(01:32:23):
they never gave her insurance. So Brian Burns looked into
this for us over at Compass. He has helped us
out with calls like this, not necessarily just like this one,
for years. When I called yesterday, Brian, I couldn't imagine
in a million years why American family, or more in
particular the agent wouldn't be held accountable for this screw

(01:32:46):
up and have to pay for it. But what did
you find out?

Speaker 13 (01:32:49):
So I get and I've been talking with the a
few times. We've already been discussing this. But I called
a contact that I have over an American family, not
an agent, but just someone that works in the corporate area,
and so just ask them if they can look into it.
And they looked based off of the policy number, an

(01:33:11):
account number that I was able to get off of
that application, and they concurred, there's no policy that exists.
And I said, well, here's the problem. I went through
it all. She made a payment on this, and so
I have them. I lodged a complaint with American Family
so that they can look at it. But then I
asked Duke, and she already has she has you know,

(01:33:33):
escalated this through the Division of Insurance. There's a complaint
out the Division of Insurance as well. That case this
could be that could be the nails in the coffin
for American family on that one, because I think this
is one of those few occasions where there's some teeth
to this. Now, I will tell you after talking to her,
she does not own this building. So it's kind of

(01:33:55):
a strange least setup that the landlord is requiring Duke
to ensure his building.

Speaker 4 (01:34:02):
Which is even worse now because now if she would
have to come out of pocket over.

Speaker 13 (01:34:07):
This right, if there's truly dammage. Here's the thing I
told her my recommendation as we're waiting for the Division
of Insurance and then this complaint to ask Lade. What
I recommended to Thuke was that she call someone on
your referral list. I said, maybe Excel Roofing, whoever you
guys would recommend, and have them look at this roof,

(01:34:28):
because I don't even know what this roof is, how
damaged it is. You know, this is somebody that's a
client of hers, but that was just there and said, hey,
you want me to get up on the roof and.

Speaker 4 (01:34:38):
Look what excuse could an agent have forget about the
company now for taking payment and then forty plus days later,
never refunding, never communicating anything to her until there's a
hailstorm in a claim, then saying, hey, you don't have
any coverage. What excuse could they possibly get that the

(01:35:00):
insurance folks would buy here?

Speaker 13 (01:35:04):
You know how I always am trying to look at
the other side of things. This one's really hard because
I mean it is pretty clear cut to me. She
has a receipt with an account number and a policy
number that now once she makes a claim is saying
it's not issued. It looks very bad for the agent
to be d Kelly.

We reached out to this agent yesterday and you told
me this guy was going to come on the air
and tell us all about it.

Speaker 31 (01:35:30):
So basically he was on his way, like literally going out,
and so I said, is it good if I call
you tomorrow morning and I can get you and the
customer on And he said, yes, that would be fine,
give me a call tomorrow.

Speaker 4 (01:35:44):
What happened?

So I called three times this morning and it only
rulled over to the eight hundred number.

If I'm paying my homeowners like I do yearly through

we do have set up with some carriers what's called
an agency sweep where we could say we took your
payment and then they would sweep it out of that account.
It's a separate account that you don't commingle your own
funds in. Obviously, we very rarely use that only if
someone is in a pension just can't you know, doesn't

have a credit card or something. But usually what we
do is any kind of payment someone makes, we'll do
it directly into the carrier that we're working with.

So sude, we assume that American family had this money,
not the agent.

Well, yeah, with the captive, it's a little different. It's
they have a sweep account. So you have an account
basically that you take payments and then the company pulls
it out of that account. It doesn't based off of
what I see, I don't know. It's confusing because he
took a payment, but there's an actual billing account number.

They just bring it to me. But now I say,
I want all the paper works everything you bring to

called him knowing he was on Direct Express and just
Oki doped him.

something that covers drywall in so and it covers of
course her liability if she does something that goes through
the wall and ends up creating damage to a neighbor
or something. But so what happened when you ask for
their policy, the master policy.

Well, it started at the end of May, and I
asked for their policy of certificate of insurance. And I
called every week, and every week I was promised, hope,
I'll send it on to the manager and we'll send
it right out to you. And I never received the
whole certificate. All I received was a certificate of insurance

that just shows the liability for the board.

Can you send a picture of that right now? Do
you have it or do you have it like an
email that you could forward.

I do is send it over to Brian A Compass
to see what that coverage exactly is. I understand when
you read it it only seems like liability. Did you
follow back up with D H O A and say, hey,
I'm assuming this is just liability because I don't see
anything else.

Well I did. I did call my management person over there,
and I was told to send a written letter to
the Alliance Insurance Services in Greenwood Village and they would
send me a certificate of insurance. Okay, okay, So I

wrote a letter. I sent this certified mail return rec requested.
They have not been able to deliver it. Doe to
have that.

They can't actually deliver it to the address.
