Speaker 1 (00:00):
Yea ripped up de netd by who you don't have?

Speaker 2 (00:12):
Come run in just as fast as we can. Shooter
is gonna help Come man.

Speaker 3 (00:19):
This is the Troubleshooter Show.

Speaker 4 (00:22):
No Tom Martine, who you're gonna call?

Speaker 5 (00:26):
Someone lied to you, cheated you, ripped you off, exaggerated
sales claims.

Speaker 4 (00:33):
Who are you gonna call? The police?

Speaker 5 (00:35):
Come on, the DA, come on, the Attorney General, come on.
They all do their part. They all do their part.
Better business bureau, they keep track of it. But where
are you gonna get the action from the Troubleshooter. We're
talking about forty five years in Denver, more than fifty
years of you count other places, the longest running radio
show still on the air with the same host. And

(00:57):
thank god, I'm alive, Thank you, thank you, and we're
here to help you.

Speaker 4 (01:01):
So all you have to do it's very simple.

Speaker 5 (01:03):
If you're tuning in for the first time, By the way,
I have a special prize for you, if you're honest
to God, are listening for the first time. I'm going
to send you something. I'm going to send you some
kind of schmooth stuff. I'm going to send you something
I'm not sure just yet what it is, but I'm
going to send you something, so anyway, welcome and we
are here to help you solve. Let me shut that off, okay,

(01:24):
solve problems, answer questions, take complaints. And Logan started his
problem aptly on car Day. I believe it was Friday. No, no,
excuse me, it was yesterday. It was Monday. He had
a problem, and I want to ask deputy our Deputy D,
because he was here. He was here and took that
call with them. Deputy D. Can you tell me what

(01:48):
is going on with that?

Speaker 6 (01:50):
Yeah, Tom Logan called us just as the show is
about to end yesterday and he's got a very interesting problem.

Speaker 3 (01:56):
He's got about a five year old four year old.

Speaker 6 (01:59):
Chevy Tahoe that spent most of the time this year
in the shop for what sounds like dozens and dozens
of problems. Now, the most interesting part of what Logan
told us is that a few months ago, GM had
actually agreed to repurchase the vehicle. And I found that
to be kind of very curious, because, as you.

Speaker 5 (02:19):
Did, we go through the autocap program or anything, I
don't know.

Speaker 6 (02:23):
We didn't get that far because we only had a
couple of minutes before the show ended. But I thought
that was very interesting because, as you can tell, the
lemon buyback period, as long you know, comes ground. So Logan,
now I know that yesterday you came with a huge
laundry list of all kinds of problems. And I was
wondering if you could kind of summarize this for Tom

(02:44):
because he wasn't here for yesterday's show.

Speaker 4 (02:46):
But we where does this stand right now?

Speaker 6 (02:49):
So yeah, we don't need to hear about all the
dozens of repairs. We just want to hear about what
repairs are left to be completed. But more importantly, where
does it stand with GM? How did they come about
to offer to buy the car back from you?

Speaker 3 (03:04):
And where does it stand now?

Speaker 4 (03:07):
Yeah? Was this did you say it was purchase used? Right?

Speaker 7 (03:12):
Yeah?

Speaker 4 (03:14):
Logan, this was purchase used right?

Speaker 3 (03:16):
You bought it brand new?

Speaker 4 (03:17):
Oh, brand new?

Speaker 5 (03:18):
So you've been fighting this thing for four years?

Speaker 4 (03:21):
Yeah?

Speaker 5 (03:23):
And what is it just a lemon? I mean, you
know if you lose if you lose use of that
car for cumulative thirty days, you or it might have changed,
but in any case, there's a cumulative total that if
you lose use of it, you get another car, all right?
I mean, you have to go through the program one.

Speaker 7 (03:43):
Day, but I'm at ninety six days and nothing's happened.

Speaker 5 (03:48):
Okay, but why haven't you filed or gotten an attorney
and filed under the Lemon law?

Speaker 8 (03:54):
Right?

Speaker 7 (03:55):
Honestly, it was trying to get them time to resolve it.
With all of the problems during COVID and proturement of material.
I get that there's delays. It happens in my industry
all the time. But yeah, zero communication at this point,
no clear path forward. Cars doesn't work.

Speaker 4 (04:16):
Very very frustrating, I can see, very very frustrating.

Speaker 5 (04:19):
So where does the stand. Let's just take it right now.
D you asked them to sum up where it is today?

Speaker 6 (04:26):
Yeah, logan, if you could tell us just very briefly,
how many problems are still unresolved and.

Speaker 7 (04:32):
Uh, as of the last communication I received, they had
ordered yet another wiring harness. No specifics on which one
that is, but this is the eighth one they've tried.

Speaker 5 (04:43):
And is that right now? The remaining nagging problem is
the wiring? Is that where we are right? Have we
narrowed it down or are you just having a plethora?
So not a plethora, you're having specific problems with the
wiring harness and they just can't seem to get it right.

Speaker 7 (05:00):
Oh, it definitely was a plethora. I mean the oil
pan gasket blew out a multitude of problems. This is
just the one that they seem unable to resolve.

Speaker 5 (05:09):
Okay, So right now, what are the symptoms of that
problem they can't they cannot resolve?

Speaker 4 (05:16):
What are the symptoms?

Speaker 7 (05:17):
Instrument cluster in the dash is intermittently failing.

Speaker 5 (05:23):
Have you ever tried going somewhere else other than warranty?
You have because there are places that specialize in these
instrument clusters, and we have our own Kevin Caulkin, it
shared in tech that do electrical issues.

Speaker 4 (05:38):
So where have you gone outside? And what have they
told you?

Speaker 5 (05:42):
So?

Speaker 7 (05:42):
I briefly took it to Johnson Autoplaza. The problem is
I had I took it right back. This is before
the electrical problems, because they told me I had purchased
all of the warranty through Autumn Nation like the extended
in addition YEA and covered you for ten years. And

(06:05):
so if I didn't initiate the warranty process through them,
through the dealership that I purchased it at, then it
caused more problems.

Speaker 5 (06:15):
Why I need to know the problem, sir, because for
the Lemon Law, they have to be significant for driveability
and merchant ability of the car.

Speaker 4 (06:23):
Can you just what is the problem?

Speaker 5 (06:25):
Like if you got your car and started using it,
what are the symptoms right now?

Speaker 7 (06:32):
So, the most frequent one that comes up is literally
the instrument cluster on the display. Will it reports a
SIM compatibility or insertion?

Speaker 5 (06:43):
So the whole display is the whole display is overtaken
by an error message or just one part of it, yes, the.

Speaker 7 (06:51):
Entire display, and then that starts a chain reaction of
other errors.

Speaker 5 (06:56):
Well you you can't possibly use that car with the
instrument display is showing an error message.

Speaker 7 (07:03):
No no, and it's I mean it disconnects the GPS,
the phone, everything else that's attached to it.

Speaker 4 (07:11):
This is ridiculous.

Speaker 6 (07:12):
Now, Tom Logan said, this truck has been over at
Autoations for Logan, how long did you say, like forty
days or something like that.

Speaker 3 (07:21):
Seven? Okay, so what are.

Speaker 4 (07:23):
They giving you a car to use?

Speaker 9 (07:25):
No no, I've asked repeated, Well okay, so d yeah,
how much of this did we get out?

Speaker 5 (07:30):
Because he needs to get we need to call the dealer.
I mean uh, Kachina, we need to get Oh no,
see we got.

Speaker 4 (07:36):
We got some of our I got some of my deputies.

Speaker 6 (07:40):
Oky, before we call the dealer, I would love to
hear ridiculous talk about this possible buyback. Logan, can you
can you close in on this mirror going around?

Speaker 8 (07:51):
Mark?

Speaker 7 (07:52):
This had been escalated up.

Speaker 5 (07:54):
And I think they think it's inevitable. Okay, So it's
been escalated and what happened?

Speaker 7 (07:59):
Yeah? They I was really frustrated at around the forty
five day mark and it's like nothing's being resolved. So
at that point they told me that internal to GM,
after twenty one days they could initiate a buyback.

Speaker 4 (08:15):
And who is the dealer, By the way, who is
the dealer?

Speaker 7 (08:19):
Bottom Nation, Chevy North?

Speaker 4 (08:22):
You know, it's not really their problem, you know that?

Speaker 6 (08:25):
I mean, yeah, okay, it sounds like they found that
the manufacturer problem though it's been so long since the
car was new. It sounds like automation may have found
a way to talk GM to buying it back.

Speaker 4 (08:37):
Okay, So yeah, go ahead, what's going on with that?

Speaker 7 (08:41):
So that well, so the dealership became unresponsive to me, all.

Speaker 5 (08:48):
Right, Logan, What I need to know is though the buyback.
Is there a buyback offer that's.

Speaker 4 (08:53):
A yes or no? Is there yes? Okay, hold on,
I want to evaluate. Hold on.

Speaker 5 (08:59):
I want to evalue that offer and go on from
there after a few messages here three oh three seven

I got a quick question for you, and then we're
going to move on to Logan and to find out
about his buyback. But Adam, something I need to ask you.
Adam Wineguard, he's with Best Way Insulation, son of the founders.

(11:20):
It's a family owned and operated business. We love them.
They've been with us for so many years. Best Way
Insulation dot Com. Here's a quick question. You said, rebates
have never been better? Can you please elaborate? Because people
are selfish people when it comes right down to it.
People want to know about money. People want to know
how they can save. So tell me about the rebates

(11:42):
available and are they rebates that are legit? Like who
they come from? Tell me about the rebates. So hold
on there, there you go.

Speaker 3 (11:50):
So the rebates.

Speaker 10 (11:52):
The main company in town that has the rebates available
is Excel Energy, which is most of core metro area.
There are also some rebates through Black Hills Energy, Atmos
Gas some others.

Speaker 5 (12:04):
Okay, so what is the Let's just take Excel that's
the biggest number of people.

Speaker 4 (12:08):
How does it work?

Speaker 10 (12:09):
So what they need is you come out good an
estimate and if you qualify you have a little bit
of insulation in your attic, and you need someone with Excel.

Speaker 3 (12:21):
That's that's in their program.

Speaker 10 (12:24):
They have them verify, and then there's a couple of
different paths you could go.

Speaker 5 (12:28):
Okay, So if it's determined you need insulation, does Excel
come and look at your house.

Speaker 10 (12:33):
So not necessarily them, but one of their contracts.

Speaker 5 (12:36):
So you're one of the contractors that are approved. Okay,
So best Way comes and says you need it. How
much is is? The is the typical rebate?

Speaker 10 (12:44):
So I did one this morning, yeah, before I came
down here. Yeah, and without just adding insulation at their
house was about two thousand dollars.

Speaker 3 (12:55):
And it all depends on your house.

Speaker 8 (12:57):
I get it.

Speaker 4 (12:57):
No, I get it.

Speaker 3 (12:58):
I get it.

Speaker 10 (12:59):
However, with all the stuff that Excel requires air ceiling,
which is another thing we can get into later. You
add those together, that the total of the house was,
I want to say, or the project was somewhere around
forty five hundred dollars.

Speaker 4 (13:15):
However, to bring it up to the standards of Excel.

Speaker 10 (13:18):
However, with the rebates, it actually was cheaper her. After
the rebate, it's going to end up being about eighteen
hundred bucks.

Speaker 4 (13:25):
So that's even cheaper than insulation alone. Yes, so for eighteen.

Speaker 5 (13:28):
Hundred bucks, she gets the whole shooting match. Yeah, you
do the ceiling, and you guys do this all.

Speaker 4 (13:34):
Yeah.

Speaker 3 (13:34):
Yeah, we handle it all week, all.

Speaker 4 (13:36):
The start work.

Speaker 5 (13:37):
It all starts with an approved contractor inspecting the home. Yes,
and even if the home has been around a while,
you don't think you need insulation, most of them do.

Speaker 10 (13:46):
Actually, if your house is older, you probably need it
more than than newer homes.

Speaker 4 (13:50):
All right, now we'll talk more about that.

Speaker 5 (13:51):
But right now, what I'd like to do is, of course,
go back to I want to go back to this
call and find out what the heck on here? Really,
If you think about it, you know a buyback.

Speaker 4 (14:05):
Is the ultimate solution.

Speaker 5 (14:07):
So I'm asking you, sir, what are they offering on
the buy back?

Speaker 7 (14:13):
So far, it's all speculative. I've been told that it's
in progress, it takes a while, and that's it.

Speaker 4 (14:19):
How many miles on this?

Speaker 5 (14:21):
How many miles on the Chevy Tahoe thirty two thousand?
I think?

Speaker 4 (14:29):
Do you only have thirty two thousand miles on this?

Speaker 6 (14:32):
It's been sucking a shop, It's been stuck in the
shop most of its life.

Speaker 4 (14:37):
Holy crap.

Speaker 5 (14:38):
So you bought this new car in twenty twenty one
and you only have thirty thousand miles on it and.

Speaker 3 (14:47):
Okay, and no replacement vehicle, no loan or no service.

Speaker 4 (14:50):
Now this is ridiculous. This is so. So where does
it stand today?

Speaker 7 (14:57):
Still in the shop. I haven't heard from anybody from AutoNation.

Speaker 4 (15:00):
This is this is ridiculous.

Speaker 8 (15:02):
This is week.

Speaker 4 (15:04):
This is ridiculous.

Speaker 7 (15:07):
Wait forever, I guess.

Speaker 5 (15:08):
Logan, I don't mind you. I don't blame you for
being pissed off. You have a new car that you've
literally not been able to use. We had, did we
try to call the dealer directly?

Speaker 3 (15:20):
Yeah, but we should call the dealer.

Speaker 5 (15:22):
Yeah, we got to call the dealer, Kashina, or give
it to one of.

Speaker 4 (15:26):
Let's see who's it. Let's give it to a deputy
dollar in the deputy dollar.

Speaker 5 (15:31):
Do me a favor, sir, call them right now. Just
this is ridiculous. Come on, man. So we talk about
total number of days in the shop as ninety six days,
and look.

Speaker 6 (15:40):
At how many years, Logan, I take it you're still
making four years of payments on this truck.

Speaker 3 (15:46):
Oh yeah, so look at this.

Speaker 6 (15:47):
He's been paying for this truck every month for four
years plus insurance Tom Insurances.

Speaker 5 (15:53):
I know we're sitting in a shop and the truck
is just sitting there in the in the dealership at AutoNation. Okay, look,
hold on, put them on home. We're gonna we're gonna
go work on this. We will work on this. This
is ridiculous. Three oh three seven one three talk seven
one three eight two five five.

Speaker 4 (16:12):
All right.

Speaker 5 (16:12):
We talked about insallation rebates, and I need to know
does Best Way? Does Best Way do their processing of
the rebates?

Speaker 4 (16:23):
Do you help with that? What? How do you How
much do you help the homeowner there? Well?

Speaker 10 (16:28):
As much as we can with certain programs, So for instance,
Excel we handle everything. All we need is their name
and their Excel account number, and we process everything else for.

Speaker 5 (16:41):
You can't ask for more than that, and you can
tell them what's available in that now.

Speaker 4 (16:46):
Now, okay, here's what I want to know.

Speaker 8 (16:49):
Though.

Speaker 5 (16:50):
If the house is insulated and you suggest, well it
needs more, I mean just because more would be better,
would it still qualify? In other words, does Excel say
you have to have a minimum of this? Because I
can't imagine Excel padding the pockets of insulation companies. Now,
for example, Best Way is a great company. I'm not saying,

(17:11):
I'm not suggesting you do anything dishonestly, but you, let's say,
according to the Best Way Way, which I know your
mom's are meticulous about this. If you guys recommend more insulation,
it's not necessarily because the house is under insulated. It's
just not the best way. No, seriously.

Speaker 10 (17:31):
But actually Excel is pretty tight with their rebate, Like
they only rebate certain things, and their engineers have found
out that even even a home, you know, it's all
based off of an R rating scale. But let's say
you're half of what you should be. Yeah, they still
even rebate that. They're still they have like fourteen.

Speaker 5 (17:52):
So but are there cases where the house is pretty
tight and it's okay, but you guys think it can
be better that would not be then you would not
get rebased on that.

Speaker 10 (18:05):
Yes, but the house would have to meet that standard
of the R sixty.

Speaker 3 (18:09):
If you're under that, they'll reach.

Speaker 4 (18:11):
So most homes are not our sixty, right.

Speaker 3 (18:13):
I would say ninety eight percent of the homes out
Now when.

Speaker 4 (18:16):
You say are sixty, are we talking about the.

Speaker 5 (18:18):
Ceiling, the walls or are we talking about the average
that's the attic insulation that's up there above your drywall
and your ceiling area. So the walls, is that the
number one most important area the attic.

Speaker 3 (18:32):
I would say so.

Speaker 10 (18:33):
I mean there's is some debate about that, but I
will tell you this, that area is so critical. That's
what Excel is willing to rebate and their engineers have
gone through.

Speaker 4 (18:42):
So there are no rebas for wall insulation.

Speaker 10 (18:45):
There is if your house was built before nineteen seventy
one and you have zero wall installation, Well, there's a
lot of homes out there that.

Speaker 4 (18:52):
Do all right.

Speaker 5 (18:53):
Three oh three seven one three talk is our number.
We have more coming up on the Troubleshooter Show.

Speaker 4 (18:57):
Listen.

Speaker 5 (18:58):
There are so many things being sold under the name
of insulation that really don't do much. And we're going
to tell you when an attic fan is totally useless.
And that's unfortunately probably most of them if they're.

Speaker 4 (19:12):
Not done properly. So stay tuned for that and more.

Speaker 5 (19:15):

Speaker 4 (20:32):
Hi tom Archino here. Welcome to the show.

Speaker 5 (20:35):
Where we're solving problems, answering questions, taking complaints, making your
life a little easier.

Speaker 4 (20:40):
And there's a lot to talk about, man Antella.

Speaker 5 (20:44):
Insulating your home is probably one of the first foremost
things you can do well. Obviously, you want the equipment
working right right, so you want to clean and make
sure that equipment is all tuned and all that seriously,
but now here's what I want to tell you.

Speaker 4 (21:00):
When it comes to that, then.

Speaker 5 (21:04):
What good is heat in a cooling of place that
leaks like a sieve?

Speaker 4 (21:09):
So we've been talking the.

Speaker 5 (21:10):
Best Way insulation because this is the time of year
a lot of people turn their thoughts to their homes
and also in the cold. And there is also another misnomer,
not a misnomer, it's not misnamed, but it's a misunderstanding,
and that is insulation is really for winter. Let's talk
about that with Adam, with one of the owners of

(21:34):
Best Way. So, Adam, what about summer and winter? What
does insulation do? Seriously? Does it keep the heat in?
I mean in the summer you want to cool your home,
so it keeps the heat out right? I mean, is
that what we're talking about.

Speaker 10 (21:50):
Yeah, so insulation, think of it as as a barrier,
kind of like when you're sitting on the couch and
you're cold, you throw a blanket over you. The blanket
self is not heated, but what it's doing is keeping
your body heat from escaping.

Speaker 3 (22:04):
Okay, and that's what insulation.

Speaker 5 (22:06):
So if you cool your home, it keeps it from
escaping exactly, and it keeps the heat.

Speaker 4 (22:11):
From coming in. So, no matter what you think.

Speaker 5 (22:13):
Of it as a barrier, is either keeping heat out
or keeping cool out.

Speaker 3 (22:17):
Yeah, it's kind of doing both.

Speaker 10 (22:18):
It's keeping the you know, the right from outside from
coming in and keeping inside from going out.

Speaker 5 (22:24):
What's the biggest mistake people do when they look at
insulation at a home.

Speaker 4 (22:27):
I mean, let's talk about that, because so many people might.

Speaker 5 (22:29):
Be thinking their home is fine and they can save
a ton of money. Okay, we have already found out
that there are rebates for almost every program if you
have an approved contractor best way installation is a proof
contractor so in addition to the rebase, let's talk about
the actual insulation. You attack the attic first. That's the
most important, yes.

Speaker 10 (22:49):
And one thing people don't always do, and this is
required for the rebates is you've got to go in
in most cases and do what's called air ceiling to
the attic.

Speaker 5 (23:00):
Before air ceiling as important as insulating, I.

Speaker 10 (23:03):
Would say, it's if it's not number one, it's number two,
and vice versa with insulation.

Speaker 3 (23:08):
When you have an energy assessment, one without the other.

Speaker 4 (23:10):
Is kind of useless.

Speaker 8 (23:11):
Ye.

Speaker 4 (23:11):
So okay, when we talk about air ceiling, we're talking
about I know about insulation.

Speaker 5 (23:17):
Insulation is a barrier in the wall or in the ceiling.
What is the air ceiling. I'm assuming it's around windows
and doors and stuff, but it keeps breezes out.

Speaker 10 (23:28):
Yeah, yeah, and a lot of her doors and windows. However,
the largest area in your whole house, and this is
why Excel gives you money for the rebates, is your ceiling.
So every light fixture that comes down, every wall that
you have that a wire runs up into the attic,
all those.

Speaker 4 (23:46):
Outlets, all of it.

Speaker 5 (23:47):
Yeah, just so you you literally seal around outlets and
switches and light fixtures.

Speaker 10 (23:53):
Yeah, but not in the wall up in the attic
part right right right, Okay, so we get all that
as well, and that's important. Yeah, it's equally as important
as the insulation for sure.

Speaker 5 (24:03):
Okay, now I have one text here. Someone wants to know.
Do you do walls by tearing out insulate a dry wall?

Speaker 4 (24:14):
Or do you go in from the outside? How do
you do walls? Do you blow it in? How do
you do walls?

Speaker 3 (24:17):
So walls is a real tricky thing.

Speaker 10 (24:20):
I would say this the wall insulation needs the best
professional because there can be a lot of things that
go wrong. But but generally what we do, either from
the inside or outside, we try to go from the
outside to eliminate the mess. We take off a rowse siding,
we put in a hole that's about the size of
an apple, about two and a half inches, and then

(24:40):
we run a tube and this is whether it has
insulation or it's completely empty, because a lot of homes
are under insulated in their walls, and we run a
tube up there and compress. And if you go to
our website, we actually have a really neat video that
we show how we.

Speaker 3 (24:55):
Can reinsulate a wall because a lot of people.

Speaker 4 (24:58):
And it's not foam or liquid, no.

Speaker 10 (25:00):
This is is a dry and the and the advantage
to the dry stuff is we can pack it in
very very tight and we don't have to worry about
any mismixing or.

Speaker 3 (25:10):
Any and not drying, and it's it's way less cheaper. Yeah.

Speaker 4 (25:14):
And it's so what is the actual fiber used for insulating?

Speaker 10 (25:18):
So we prefer cellulose for walls. Uh, mainly Uh. And
it's a recycled newspaper. They fire treated with boron or
boric acid. It gives it a Class one fire rated rating,
so it's more fireproof than your dry wall studs.

Speaker 3 (25:33):
That kind of thing, got it? And Uh. Also what's
nice about.

Speaker 10 (25:37):
It too is rodents don't like it nearly as much
as other materials because it irritates their nose and feet.

Speaker 4 (25:43):
So you can press cellulose fiber.

Speaker 10 (25:46):
Yeah, and it's mainly post consumer paper and pre consumer paper,
so recycled.

Speaker 4 (25:53):
It's recycled.

Speaker 5 (25:54):
It's good, right, Okay, So what do you do for
the ceilings?

Speaker 10 (25:57):
So say the same thing. We prefer cellulos. It's a
little less. If somebody is like, I really want to
use fiberglass, that's that's okay. We think the cellulose blocks
out more of the radiant heat. Okay, summertime it works better,
But the walls, definitely, I would never put anything.

Speaker 3 (26:13):
Else in my walls with see people.

Speaker 5 (26:15):
By the way, we are talking about installation, but we'll
talk about anything you want. All you have to do
is call us. And then we have two numbers, the
main number three oh three Martino. You can call twenty
four to seven. Get your name on a list. We
will call you back. Just leave your number, we'll call
you back. Or you can call three oh three seven
to one three talk while we're on the air. So
I have a text here talking about radiant heat barriers. Now,

(26:36):
I know for a while we were getting complaints. People
would come to the door and say, you know, we
can cut down ninety eight percent, or we can, excuse me,
we can increase ninety eight percent your installation. We're going
to go to the attic and we have the space.
They called it space age.

Speaker 4 (26:50):
They really use that.

Speaker 5 (26:52):
Say it's like a solar blanket, a space age blanket
that we put in your attic and it.

Speaker 4 (26:57):
It will rady, it'll radiate the heat, are cold out.

Speaker 5 (27:02):
They're called radiant heat barriers, and they were selling it
as you know, you don't have to blow in insulation,
you don't have to make a mess.

Speaker 4 (27:10):
We're just going to lay down this cloth or whatever.
It is. It's just sheets of reflective material.

Speaker 3 (27:17):
Yeah, it's like aluminum foil.

Speaker 4 (27:19):
So tell us about the sheet. Why don't those sheets work?

Speaker 10 (27:22):
So the issue with radiant heat barriers is they need
to work in climates that have a lot of what
they call cooling degree days, like in Colorado we only
have on average about ninety cooling degree.

Speaker 4 (27:35):
Days or what is a cooling degree day?

Speaker 10 (27:37):
So cooling degree day is where the temperature outside the
home is significantly more than the inside of the home,
and so you need to cool the house otherwise you're
getting you know, heat in from the house.

Speaker 5 (27:51):
So when we talk about a radiant heat barrier, we're
talking about areas where the inside of the house would
be much hotter than outside.

Speaker 10 (28:00):
Or that you're trying to keep the heat from the
outside from coming in.

Speaker 5 (28:04):
Okay, but it doesn't help in the winter to exactly.
And that's so in the summer though, if I had
a radiant heat barrier in the addic will it help?
Will it help lower air conditioning bills? And we'll talk
about that and more coming up, because that's what I
want to know.

Speaker 4 (28:19):
What good is a.

Speaker 5 (28:21):
Radiant heat barrier, if any and when does it help?
Most I have that and more coming up as long
with your calls at three zero three seven to one
to three talk seven one three eight two five five.
And also I want to tell you about frankdarandareal estate

Speaker 4 (29:52):
Hi Tom Martino here.

Speaker 5 (29:54):
Yes, we are solving problems, answering questions, taking complaints, making
your life a little easier. Whatever is on your mind.
So I have this, I had this god. I have
his friend on he's my YouTube moron, one of them,
and he texts me a lot. And you can text me,

(30:16):
by the way, and I want to emphasize this. You
can text me on the iHeart short code if you
want five seven seven thirty nine and put Tom in
there and I'll get your message. Or you can text
me on my Google Voice. Now my Google Voice. I
want to tell you something seriously. That is my cell.
Everything on that Google Voice comes to my cell and

(30:36):
I just put it on a Google number, so I can,
you know, turn it off if I ever need to.
But I get text from people all you know twenty
four to seven and I will schedule first show or
talk to you about Wave eight wealth management, my my
financial advisement firm, or any other topic you have. So anyway,
I have a friend on the Google Voice who's one

(30:57):
of my morons, and he says he's a firm believer
and always sends me pictures of chemtrails, these these trails
across the sky which are which are a natural phenomenon
and and have nothing to do with seating with chemicals.
But there are there's a group there. There's a group
of people on the internet. I mean, honestly, well, listen,

(31:18):
you can find a group of people on the Internet
that thinks poopy is a good supplement for you. But
but so so, it doesn't surprise me that you find
a group who believe that the government is busy seating
our clouds. And they are so absolutely ridiculous that they
believe somehow.

Speaker 4 (31:37):
Now listen to this.

Speaker 5 (31:39):
Our airlines have enough problems getting off the ground, and
I'm really serious now with weight. Their biggest concern is weight,
weight of luggage, weight of passengers.

Speaker 4 (31:51):
The average weights have.

Speaker 5 (31:52):
Gone up the weight of fuel to be airborne and
efficient and to make money. But they somehow believe that
in addition to all of this, they're carrying thousands of
pounds of chemicals and have secret agreements with the government
to seed our clouds and our skies. Now, first of all,

(32:13):
why wouldn't this get out to the public if the
airlines were if they were really doing this, not one person,
not one would have absolute proof and could show us
that there are tanks in these airliners carrying chemicals to seed.
And how do you get the government to persuade airlines

(32:33):
to do it? And what if it's a Republican administration
or a Democrat administration, how do they do it? I,
honest to God, cannot believe there are people who truly
believe that those trails up there are intentional and are
made up of chemicals to alter our environment in some way. Now,

(32:56):
there are all kinds of theories. There's a theory that
says they're seeding those cloudlouds to control the weather. Others
say they're seeding those clouds to control us, or to limit.

Speaker 4 (33:06):
Lifespan, or a plethora of.

Speaker 5 (33:08):
Other problems or solutions that these chemtrails possibly solve.

Speaker 4 (33:14):
What the hell are they talking about now? I truly
want to know if anyone.

Speaker 5 (33:20):
Truly believes that that's going on. And every time you
see these trails across the sky, they come out of
the woodwork and they believe that there is an overall
major kind of a plot. And one of the things
now that they have given us if you look up
this story is about a representative, a Republican from Georgia,

(33:45):
introduced a book bill, federal legislation that would outlaw geo
engineering practices and banning the injection or release of chemicals
into the atmosphere intended to alter the weather, temperature, or sunlight.

Speaker 4 (34:01):
So this woman, Marjorie Taylor.

Speaker 5 (34:04):
Is introducing a bill, and actually to introduce the bill,
you have to believe it's going on to begin with.

Speaker 4 (34:11):
And that's what's happening right now.

Speaker 5 (34:12):
It's a real bill being introduced to stop the government
from seeding the clouds.

Speaker 4 (34:19):
Now.

Speaker 5 (34:19):
I don't doubt there are programs going on where they
experiment with this, but on a mass scale with the airlines,
that's a bunch of bull. I'd like to know your opinions.

Speaker 4 (35:31):
Tom Martino here.

Speaker 5 (35:32):
We've been solving problems in Denver for forty five years,
taking your calls, your questions or complaints, and trying to
make your life a little easier. That's what the whole
show's about. Major Mark, Major and sus are off today,
well deserved, or they're working behind the scenes. We got
Deputy Dollar and Deputy Chopper in the studio. I got

(35:53):
Deputy d with me here at the home studio. I
have a guest, Adam Winegard with Best Way Insulation. We've
been talking about some installation stuff and we'll continue with
that in a minute. I got Jason on the phone,
who wants to talk about hail damage Jason, Welcome to
the show. I'm Tom Martine. What's going on, Jason?

Speaker 11 (36:11):
Basically, I have a home that mentions company said that
I don't have any hail damage, but I've had four
or five roofers that I do have heal damage, and
I have a home inspection so that I have heal damage.

Speaker 5 (36:22):
And Jason, is the hail damage from a particular storm.

Speaker 11 (36:29):
No, it's over several different years.

Speaker 4 (36:31):
Okay, You're not going to get covered anyway.

Speaker 5 (36:34):
In other words, a covered event, A covered event, Jason,
is when you have an event and you have damage.
If you have more than one event and let them
pile up, that is not you're not going to get
covered because.

Speaker 4 (36:48):
You don't have and if you do, here's the problem.

Speaker 5 (36:52):
If you have a recent storm now and they see
that there's old damage combined with the new damage, you're
only going to get partial.

Speaker 4 (37:00):
So here's what I want to know. Is this a
home you've been in for.

Speaker 11 (37:04):
A while, only five years?

Speaker 4 (37:08):
Okay, so you've been in your home.

Speaker 5 (37:13):
For five years and during that five years, how many
storms have you had that you did not report?

Speaker 11 (37:23):
They weren't very big hailstorms that didn't think there was
any damage so maybe.

Speaker 5 (37:27):
So, okay, So you never put in a claim for
any of them. What was the most recent.

Speaker 11 (37:32):
One, right, probably last summer?

Speaker 4 (37:37):
And after that storm?

Speaker 5 (37:39):
Did you contact your insurance after that particular storm, not
until like September? Okay, but you did contact them in
September of twenty twenty four about a storm in the
summer of twenty twenty four. Yeah, and when you did that,

(38:02):
what did they say?

Speaker 11 (38:05):
They came out and looked at it. They said that
it was wear and tear. They's okay, some material lost
in the shingles, but they didn't say there's any hail damage.
They didn't note that there's there's tear, there's a tear
on the ends of the shingles. Like they're kind of
like they're like there's material missings from the ends of
the shingles.

Speaker 4 (38:23):
But I looked at the.

Speaker 11 (38:24):
Pictures and looks like there is other response that there's
damage as well.

Speaker 5 (38:27):
So okay, if you had a storm in the summer
of twenty twenty four that you reported in September of
twenty twenty four, then at the time they here's the problem. Okay,
Now you have a you have a year to contest
this thing.

Speaker 4 (38:45):
You you might be out of time right now. When
in the summer was that storm?

Speaker 11 (38:54):
I don't remember. I'm to be honest with you, it
was probably.

Speaker 5 (38:59):
Like Jason, I'm going to tell you something, bro, there's
probably not a good chance of getting anything covered because
you were not diligent. When you have a storm, you
have to call immediately. How old is the roof?

Speaker 11 (39:13):
It's about five years old.

Speaker 5 (39:15):
Wait a minute, the roof is only five years old.
You've been in the home five years. So was it
new when you Was it new when you moved in?

Speaker 8 (39:24):
Yes?

Speaker 5 (39:26):
Well, then it can't be normal wear and tear. There's god,
there might be something. Oh, you can't have normal wear
and tear that will wear out your whole roof?

Speaker 4 (39:37):
Do roof for say, your whole roof need do roofer?
Say your whole roof needs to be replaced?

Speaker 12 (39:43):
Yeah.

Speaker 11 (39:44):
One said they would give us like a three year
warranty if he did some repairs. But he said that.
All of them said it's wide spread across.

Speaker 12 (39:50):
The whole roof.

Speaker 11 (39:51):
So yeah, most of them say that the whole roof
needs to be very placed.

Speaker 5 (39:53):
You've had enough hailstorms that you did not report on
a brand new five year old roof.

Speaker 4 (40:00):
Shame on you, Jason God.

Speaker 5 (40:02):
I mean you, with every with every storm, you should
have your roof inspected by a roofer, by a reputable
roofer like Excel Roofing. I mean, here, here's the deal.
What do we do now? Well, if you still if
you have damage from summer of twenty twenty four, you
you already reported it, so you're not out of time.

(40:24):
But you got now you have to contest their finding.
The best you can do. The best you can do
is in your policy. There is a place where you
can go through what's called the appraisal process.

Speaker 4 (40:40):
That is where you get it.

Speaker 5 (40:42):
You you tell your insurance company I want to get
into the appraisal process, or look in your policy and
there is a procedure for the appraisal process. Okay, what
that means is in the appraisal process, there's there's a
few steps.

Speaker 4 (41:00):
You notify the insurance company.

Speaker 5 (41:02):
Then you get an expert who outlines the damage and
he has to only talk about the recent damage from
the summer of twenty twenty four. And then they get
an expert to dispute it. If those two experts can't
work it out, it goes to arbitration, which is binding

(41:24):
on the insurance company.

Speaker 4 (41:27):
It's not binding on you.

Speaker 5 (41:29):
So enter the appraisal process another thing you can do,
but usually after the appraisal process. But a good public adjuster.
Do you know what a public adjuster is?

Speaker 8 (41:45):
I don't.

Speaker 5 (41:47):
Public adjusters are just what the name implies. Don't mistake
them for what's called independent adjusters. Independent adjusters work for
insurance companies.

Speaker 4 (41:56):
They're independent, meaning they.

Speaker 5 (41:58):
Are adjusters, and insurance companies hire them during high volume
times like after a fire or a flood or big hailstorms.
They need independent adjusters to help them out. But that
gives that that is a misnomer for people who believe
independent adjuster means you know, he's independent.

Speaker 4 (42:18):
They're not.

Speaker 5 (42:19):
They work for the insurance company. But then there's something
called a public adjuster, and public adjusters are hired by
the public to fight insurance adjusters. So if you believe
that you have coverage coming that they're not stepping up
to do there there, I mean, you can really make
hell for your insurance company. Let's say you call a

(42:41):
public adjuster and they take a percentage of what they
collect for you. So let's say like Matt Over at
Paragon Services, he's on our referral list.

Speaker 4 (42:51):
Look him up.

Speaker 5 (42:52):
I don't have time to do it right now. Paragon
look him up on referral lists dot com. Okay, now
you call him and say i'd like you to review
my claim. If Matt believes there is there are there's
a claim there that's being unpaid. If they don't pay
it and it's legitimate, you can get triple the amount.
But you start with a public adjuster. So I would

(43:13):
do two things. Advise my insurance company I want to
go through the appraisal process. And number two, I would
go to Paragon Services on referra liss dot com and
ask Matt to review your claim. And then I believe
you'll at least get some attention to this. Even though
previous hail damage has been ignored, the most recent hail

(43:35):
damage is still a claim. Now they're allowed to deduct
from that the other damage. So if your roof was
previously totaled, so to speak, and the new claim is
on there, they're not going to cover anything. But you
need a professional to tell you someone who can distinguish

(43:56):
old from new damage, and that's.

Speaker 4 (43:58):
A qualified roofer.

Speaker 5 (44:00):
And then you get a public adjuster to see if
the claim can still be alive three oh three seven

actual name, I never use their name, Kashina. Get Paul

(45:35):

it off the you know, during the break did not
go well, so just get him on the air.

Speaker 4 (45:43):
I got some questions for him.

Speaker 5 (45:45):
We also have Adam with us from what Best Way
Installation and what we've been talking about are there's a
lot of rebates available that can cut down that can
really cut down.

Speaker 4 (45:55):
The cost of your project.

Speaker 5 (45:57):
And the best way to do it is to get
one of the approved con tractors like Best Way Installation
to analyze your house. They'll make suggestions and then look
for the rebates. So really it's one stop shop. And
if you need upgrades in insulation, a good part of
it can be paid for with rebates. So in addition
to rebates, Adam with Best Way Insulation, what else helps people?

Speaker 8 (46:20):
Now?

Speaker 10 (46:20):
Do they get any tax credits? Yeah, so there's a
tax credit currently. Now that can change, but currently there
is a.

Speaker 4 (46:28):
Tax in addition to rebates.

Speaker 10 (46:30):
As an addition I do recommend people contact their account
and talk that over with them. But it's on the
material portion. So for us, when we calculate roughly with
people how much of a tax credit they'll get, it's
usually around half the product projects.

Speaker 3 (46:50):
Sometimes it can be up to like two thirds of
the project.

Speaker 4 (46:53):
Really yeah, holy crap.

Speaker 3 (46:56):
Yeah, so it could be very big.

Speaker 4 (46:58):
Does that have to be in really to a solar
system or not?

Speaker 3 (47:02):
No?

Speaker 5 (47:02):
No, this is completely on its own tax credits. So
with rebates from utility companies and tax credits, there is
a really really good chance that you're getting this stiff
like half price or less. Yeah, less less than half price.
Now we talked about radiant heat barriers or never finished.

(47:23):
Somebody wanted to know about the foil that people sell
to put up in the attic.

Speaker 4 (47:27):
They put it shiny side up.

Speaker 5 (47:29):
It's like this solar blanket they call them in camping
and supposedly supposed to reflect heat out of the house.
Good insulation in the attic will do the same thing.
It'll keep heat from entering the home, and it'll keep
cold from entering the home. It'll keep heat from escaping
the home, and it'll keep cold from escaping the home.

Speaker 4 (47:49):
So it does what it's.

Speaker 5 (47:50):
Supposed to do a barrier that's regular insulation. So what
does this foil do if anything? First of all, what
is it? It's what they call that solar blanket.

Speaker 10 (48:00):
Yeah, so radiant heat barriers is the main term that
there's a lot of companies that make some form of
they're for real though, Yeah, that now they do work.
The problem is in Colorado we only have about ninety
days that they possibly could work, whereas installation works on
about three hundred or so days out of the year

(48:22):
versus you know, ninety days with them.

Speaker 4 (48:24):
Why does it all? I don't understand.

Speaker 5 (48:26):
Why would a radiant heat barrier, if it works, why
would it only work a ninety days a year.

Speaker 10 (48:32):
Yeah, because it has to do with the solar from
the heat from the sun, so that the sun first
of all, is at a different angle over your roof
in the summertime, So that's part of it.

Speaker 3 (48:43):
But essentially it's.

Speaker 10 (48:45):
Days that are over you know, seventy five degrees of
your house.

Speaker 3 (48:50):
So we don't you know, when you.

Speaker 10 (48:51):
Look at it through the year, both during the day
and at nighttime, there aren't a lot of days that
it's over that seventy five degrees constantly in Colorado versus
what do you.

Speaker 4 (49:05):
Mean seventy five degrees?

Speaker 5 (49:06):
Wait, so you're saying that where the attic would be
seventy five degrees hotter.

Speaker 3 (49:11):
Right, well, not hotter.

Speaker 10 (49:12):
So your thermostat in your house is set at whatever
you have.

Speaker 5 (49:16):
Okay, let's say during the summer it's set at seventy seventy.

Speaker 10 (49:20):
So radiant heat barriers will only really help your house
when the temperature gets over that seventy degrees.

Speaker 3 (49:29):
When you are in the winter time and it's ten
degrees outside, they do not help at.

Speaker 4 (49:34):
All with n but they will help some in the
summer they do.

Speaker 3 (49:38):
And they reflect heat.

Speaker 10 (49:39):
Yeah, but areas like Texas, Arizona, Florida, they're recommended as
much or sometimes even more than insulation.

Speaker 5 (49:47):
I see, because you constantly have the solar penetration. But
in Denver it works, it will work during the summer.

Speaker 10 (49:54):
Right, But because of the cost of it, So we're
looking at you don't bas.

Speaker 3 (50:00):
It's it's much less.

Speaker 10 (50:01):
It's about less than a twenty five percent of the
payback that you get from insulation.

Speaker 5 (50:07):
Now I'm not talking about doing it in place of insulation,
but if you did it in addition to insulation.

Speaker 4 (50:12):
There's no harm to it. No, no, it would people
over people.

Speaker 5 (50:16):
Over sold it though they made it sound like instead
of insulation.

Speaker 10 (50:19):
Yeah, and now I do know this as well. When
you install it in your house, two things have to happen.
You have to install it properly, and that means not
create a bunch of holes when you hang it. So
a lot of companies who use like a staple hammer
or staple gun put it up and put all these holes. Well,
now you're degrading that material. It needs to go and
needs to be sealed after you do it. So a

(50:41):
lot of companies don't do it right. That's one. And
then also when you do put in the radio heap area,
a lot of people don't know this. You do increase
your chance of your house getting struck by lightning.

Speaker 4 (50:52):
Why yes, you do. Really is when it's inside the attic.

Speaker 3 (50:56):
Yes, why yes, I conducts or whatever.

Speaker 4 (51:00):
But it's underneath a roof.

Speaker 3 (51:02):
But it's under the roof.

Speaker 10 (51:03):
But where I've seen several cases where people have put
it up.

Speaker 3 (51:08):
I know there was one out in Parker that was done.

Speaker 10 (51:11):
We don't do it just you know, but I was
done and the guy actually called this as like I
had it done last week, the company won't come. I
need it out now because his house got destruck by lightning,
like the week after they put it up.

Speaker 4 (51:24):
So wow.

Speaker 5 (51:25):
So okay, so I don't know that, but your recommendation
insulation and air ceiling are the two primary ways to
help your house.

Speaker 3 (51:33):
Yeah, they're They're the most cost effective for sure.

Speaker 4 (51:36):
Okay.

Speaker 5 (51:37):
And then we talked about attic fans, and I'm gonna
I want to I want to elaborate on this after
a few after some words from our sponsors, but I
truly want to talk about attic fans because what you're
saying is there are a lot of people who are
using or have attic fans that are doing him no good.

Speaker 3 (51:55):
Yeah there are. Yeah, you have to know what you're doing.

Speaker 4 (51:58):
Okay, And we'll talk about that.

Speaker 5 (52:00):
And then what about rodents in the attic You said
there's some scams going around.

Speaker 3 (52:04):
Yeah, unfortunately, we're seeing a lot of this. I got
a lot of calls where Okay, so what do people do.

Speaker 10 (52:09):
So that somebody comes by their door knock, says hey,
I'm just checking there's rodents in the area, and what
do you want to check?

Speaker 5 (52:16):
Or we were at a neighbor's house and they had
a lot of rodents. Yeah, and it can do thousands
of dollars in damage.

Speaker 4 (52:23):
So then what so.

Speaker 10 (52:24):
Then they go up there, they take pictures of things
that could look like excrement and and.

Speaker 3 (52:30):
Say, oh, this is what you have. But I've seen,
for my view, I've seen.

Speaker 10 (52:34):
There has been some yes, but there is definitely a
push for stuff that actually doesn't need to be done. Okay,
like that, like they're they're they're seeing roofing debris not
uh rodent excrement or uh. Another is like they'll take
their finger kind of poke it a hole in say
oh they're burrowing holes, Well, they're burrowing hose. They'd make

(52:58):
holes and there can nest and there would be evidence
of excrement.

Speaker 5 (53:02):
There are a legit guide, there are legit people that
can screen oh yeah for rodents. But definitely, I've said
this before, never ever ever use people who knock at
your door.

Speaker 4 (53:14):
Never.

Speaker 5 (53:14):
Never Excuse me, I shouldn't say that. I'm not saying
never to use on. What I'm saying is, don't let
the knock at the door be the impetus for you
using them. Do not if they knock at your door
and say we're checking for rodents in the area. Your
neighbors have had some attic rodents and it's been really devastating,
and you can catch them or nip.

Speaker 4 (53:34):
It in a bud.

Speaker 5 (53:35):
If you get a question like that, what you say
to them. This is what I always recommend, whether it
be roofing or any other any other kinds of calls
at your door. You say, thank you for bringing this
topic up. I will look into it, and I'll put
you on the list. In other words, they can go
on the list if you on, but don't choose them

(53:56):
just because they knocked on your door.

Speaker 4 (53:57):
And I'll tell you why.

Speaker 5 (53:59):
If you had a fishbowl of contractors two fish bowls.
One are people who knock at your door and the
other are people who who you call. The chances of
being ripped off are mostly in the fish bowl that
knock at your door.

Speaker 4 (54:18):
So I'm not saying that they're all bad.

Speaker 5 (54:19):
I'm just saying it's the universe where people rip you off,
more so than when you go out shopping and do
the proper screening. I've had some questions on odors in
water and other questions I'm going to bring up after
this and Paul at waterpros dot net.

Speaker 4 (54:36):
Will answer them.

Speaker 5 (54:38):

had a question, Jeff hanging on. I'll get to you
next to call her. Paul is our expert with waterpros
dot net and I had a question Paul. Now, more

(55:42):
than ever, I've been getting people when they hear about
you and they know and I always talk about waterpros
dot net, you know, for the best water system's lowest prices.
I've had more than a few that is odd for
me that don't talk about the taste of the well.
I don't know if they talk about the taste of water,
but they talk about an odor. Now, have you how

(56:03):
do I put this? Is this a problem with water?
Has this been increasing odor in waters? And what does
odor come from? Paul doingromwaterpros dot net, go ahead, thanks Tom.

Speaker 12 (56:16):
It comes from two things. If you're in city water,
it's a loramine.

Speaker 8 (56:21):
That's the that uses as a.

Speaker 12 (56:23):
Sanitizing product, chlorine. Part of the chloromine is an oxidizer,
So it could be a musty iron smell because the
well water or the water source that the municipality is
using has a ferros iron that the chlorine oxidizes. That
can create an order. I'm seeing a larger and larger
number of you know, the straight swimming pool chlorine smell

(56:47):
in water.

Speaker 8 (56:48):
Okay, that could be.

Speaker 12 (56:49):
That could be a factor because of you know the
fact that they have to sanitize it. They have to
use levels of chlorine to meet the needs of the water.
And then with well, with all the rain that we've gotten,
a lot of people could see, you know, smelling come
from iron and the water is very common. Solfur h
to US gas. Most likely it's just you know a

(57:12):
lot of iron build up on the air radar and
their faucet.

Speaker 5 (57:15):
Now, is there a way to treat for odors? For example,
one of the most common ones we hear about is
is that egg smell, that hard boiled egg smell, or
if you want to get crewd it's a fart smell.

Speaker 4 (57:27):
I mean, what do you do about that?

Speaker 12 (57:29):
So you know, the first thing we do is we
put a duel tank you know, water filtration system in
and that'll remove it nine times out of ten. It's
it's iron build up. If it happens to be h
two US gas, then you know, a simple backwashing carbon
filter complemented by water software will eliminate that. You don't

(57:50):
want to chlorinate your well. Chlorination is a short term solution,
doesn't solve the problem, but it could create a bigger
issue in the long run because chlorine could eat away
at that you know, limestone or whatever foundation that surrounding
the pump. Chlorine basically like putting peroxide on the wound.

(58:11):
So chlorine definitely could create a bigger issue than what
you had before without chlorination in a well.

Speaker 4 (58:17):
Okay, so Paul, don't authorities.

Speaker 5 (58:19):
I remember one time when I was building a house,
they required me to chlorinate the well.

Speaker 4 (58:24):
Well.

Speaker 12 (58:24):
You have to do that when you put the pump in.
That's that's absolutely you got to say it. When you're
putting a pump in, you sanitize the well because the pump,
you want to make sure that there's no bacteria, you know.
So that's a standard practice. However, a lot of folks
if they do a well water test and they come
back with a bacteria positive on a bacteria test.

Speaker 3 (58:46):
They shock the well.

Speaker 12 (58:47):
But that's only a short term solution, and nine times
out of ten that bacteria is going to come back,
And so you could get a false sense of security,
you know, thinking, yeah, I shocked well, the back is gone.
But that's not necessarily true. But in a new construction, Tom,
you absolutely have to chlorinate when you're putting in your
well pumped.

Speaker 4 (59:06):
Okay, got it now.

Speaker 5 (59:09):
Somebody wanted to know, and I saved this for when
you were on the show, but I didn't get to it.
Someone wants to know if they're buying a new home,
should they do a water test or should they just
simply put a system in. Now, I know you sell systems,
you'd love that they just put a system in.

Speaker 4 (59:26):
But truly, what would we You know a lot of
people have.

Speaker 5 (59:29):
Their home inspected, Paul, they have their foundation expected, they
have all kinds of things expected, But what about the water.
It's amazing to me how many home inspections do not
include a water test.

Speaker 3 (59:44):
No, I totally agree.

Speaker 12 (59:45):
I think in today's world, especially both if you're buying
a home and that has a municipal water supply, you know,
or especially with well water, absolutely get it tested. And
in some cases, tom As you know well water, you know,
some monder writers require you know, water tests to make
sure the water water is possible. But I think it's smart. Yeah,

(01:00:06):
I think it's smart to do. And eventually what's going
to happen. This is something I'll share with you.

Speaker 8 (01:00:13):
There's doctors right.

Speaker 12 (01:00:14):
Now that we had we had someone called doctors are
ordering micropathic tests on patients, believe it or not, because
of the contamination and the water supply. So that's something
that you know, I'm not surprised but we had some
folks call us to express concern because of you know,
possible creating medical issues. And there's a cardiologist that you

(01:00:36):
here in town that's absolutely telling patients that they should
get tested because they're finding the build up in the
arteries of the heart. So that's something that unfortunately the
world do we live in today.

Speaker 4 (01:00:50):
All right, So thank you very much.

Speaker 5 (01:00:52):
As Paul the Waterman, my expert water pros that at
three o three eight six two five five five four.
I'm going to make a recommendation to people. You know,
I was tell people to you know, when it comes
to real estate, you get a home inspection, of course,
and if there's any issue at all with the foundation,
you get a separate structural inspection. And I'm going to
give you a little rundown of how I buy houses

(01:01:14):
and how I get great prices, and I'm going to
share it with you the technique I use, truly want
to I want to share this with you. But what
I want to say about water is, to me, it
should be a standard part of buying a house, absolutely positively. Okay, Jeff,
what's going on with you? Jeff, Welcome to the show.

Speaker 4 (01:01:35):
Hello, hey man, what's going on Jeff.

Speaker 8 (01:01:40):
Well, I bought a truck's twenty eighteen Chevy Silverado from
Carla Elford Automotive in Norvada. I had gotten in touch
with them originally because I have five hundred dollars down.
I was trying to get into something that I could
take to work.

Speaker 5 (01:01:54):
So this is a two thousand This is a two
eighteen Chevy Silverado.

Speaker 8 (01:02:00):
Correct?

Speaker 4 (01:02:01):
How many miles?

Speaker 8 (01:02:04):
One hundred and fifty seven thousand?

Speaker 4 (01:02:06):
Okay?

Speaker 5 (01:02:07):
So you're asking for trouble, no matter what I mean
in other words, And I'm just going to say it
like it is. If you buy anything with over one
hundred thousand miles, you will have problems. If you buy
anything with over one hundred and fifty thousand miles, you
will have major problems. And if you buy anything over
two hundred thousand miles, you're lucky if you can drive

(01:02:28):
it off the lot. So where did you buy this from?
What was the name of the.

Speaker 8 (01:02:32):
Place, Alford Automotive?

Speaker 4 (01:02:35):
Okay? And where is that?

Speaker 8 (01:02:38):
It's in a close by j Okay and Ralston.

Speaker 4 (01:02:44):
And you bought it, I imagine when did you buy it?

Speaker 8 (01:02:49):
A week ago? Monday?

Speaker 4 (01:02:50):
Okay?

Speaker 8 (01:02:51):
Last Monday?

Speaker 4 (01:02:52):
Last week? Okay?

Speaker 5 (01:02:53):
So last week, you bought this, and you bought it
as is, I assume.

Speaker 8 (01:02:59):
Yes, okay, after market warranty on it?

Speaker 5 (01:03:02):
Okay, oh okay, So what kind of an aftermarket warranty?

Speaker 8 (01:03:07):
It's it says it covers everything pretty much I have
to pay for like fluids and things like that.

Speaker 5 (01:03:12):
But yeah, I doubt it covers everything is First of all,
I'll tell you what it doesn't cover, Jeff, any pre
existing condition?

Speaker 4 (01:03:19):
Can we agree on that? Did you look at the exclusions?

Speaker 8 (01:03:24):
Yeah? You're You're right there, and that's where I'm having
some problems.

Speaker 5 (01:03:27):
Okay, how much did you pay for this warranty?

Speaker 8 (01:03:32):
I don't know because it's it was in the price.

Speaker 5 (01:03:36):
Okay, okay, good, hold on and let's come back and
talk about that.

Speaker 4 (01:03:40):
Coming right up. So I want to go over this
because this is we are having more and more and
more and more.

Speaker 5 (01:03:47):
And more calls about aftermarket warranties than any other topic
when it comes to use cars.

Speaker 4 (01:03:52):

(01:04:31):
We left off with Jeff first. Jeff, Jeff is a
on Jeff. I don't want you to hang up, because
we're going to discuss this at length. He bought a
car two hundred twenty eighteen Chevy Silverado last week, one
hundred and fifty thousand miles from Alfred Automotive in Arvada.
He bought an aftermarket warranty, and he's going to talk
about that, But Deputy D wanted to.

Speaker 4 (01:04:50):
What did you want to say, Deputy.

Speaker 6 (01:04:52):
D ted While you were talking with Jeff, I looked
up Alfred Automotive's website and they have about twenty.

Speaker 3 (01:04:57):
Used vehicles for sale.

Speaker 6 (01:04:59):
Every angle one of them comes with what's labeled a
free six month bumper to bumper warranty.

Speaker 1 (01:05:05):
Wow.

Speaker 3 (01:05:05):
Now, the term bumper to bumper warr is that the way.

Speaker 5 (01:05:07):
Is that the one you're talking about, Jeff, that free
one that you got bumper to bumper.

Speaker 8 (01:05:14):
No, that's something else.

Speaker 5 (01:05:16):
Oh so so you didn't you didn't get the you
did not get the free six month bumper to bumper.

Speaker 8 (01:05:24):
I don't believe so, because the truck that they put
me into is not the one that I wanted. And
originally they when I went in with the five hundred,
they changed their mind and said they wanted three thousand.
And they called me back two days later and said.

Speaker 5 (01:05:36):
Okay, so, Jenny, you had the power. You had the
power not to switch trucks. You said, it's not the
one I wanted. Well, why'd you buy it?

Speaker 8 (01:05:43):
Then? I needed a vehicle and they were willing and
there were no.

Speaker 4 (01:05:49):
Other dealers available.

Speaker 5 (01:05:51):
Jeff, I'm not trying to give you a hard time,
and I promise you our ultimate goal here is to
help you, but I also want to help other people listening.
You said you went in for a truck and they
wouldn't give you the one you wanted, and they switched you.
You had the power to walk away, right, okay, So
you decided to go along with this twenty eighteen Chevy

(01:06:12):
Silverado with one hundred and fifty thousand miles. Now, what
did they tell you about this? It was as is,
but they said it comes with a warranty.

Speaker 8 (01:06:21):
They said, yeah, it comes with a warranty. And there
was some service lights coming up on the desh and
they said that, you know all that will be covered,
you know, with the warranty we can continue.

Speaker 5 (01:06:31):
Well, so you mean to tell me you had lights
on the dash before you even bought it.

Speaker 8 (01:06:37):
Yeah, it was minor stuff. I mean, it really is.
There's nothing to do with anything major.

Speaker 4 (01:06:42):
O take good.

Speaker 8 (01:06:43):
They would, you know, get it taken care of and
then and they put that.

Speaker 4 (01:06:47):
And they put that in writing.

Speaker 5 (01:06:48):
The warranty said no pre existing conditions if you read it,
no existing conditions. They said they'll take care of it anyway.
Did you get that part in writing where they said
they would take care of it even though there weren't
he doesn't cover you did put that in writing?

Speaker 8 (01:07:03):
Yeah, they said they told me they would have their
mechanic look at it.

Speaker 5 (01:07:07):
What does that mean? So, Jeff, I need specifics. You
knew that you were buying a warranty. The warranty excluded
pre existing conditions, but they said they would take care
of it, or they would have their mechanic look at it.
What exactly did they tell.

Speaker 8 (01:07:23):
You that they would have their mechanic take care of it?

Speaker 5 (01:07:28):
They they said, we will have our mechanic take care
of it.

Speaker 4 (01:07:32):
Did you get that anywhere documented? No?

Speaker 8 (01:07:36):
Because that was just that was just going to be
here over the last couple of days because I started
noticing you.

Speaker 5 (01:07:42):
No, No, I'm asking people before the sale. They told
you the mechanic would take care of it before you
bought it or after you bought it.

Speaker 8 (01:07:50):
The problems that I noticed before I before I bought it,
they said that the mechanic would take care of it.

Speaker 4 (01:07:57):
And how did you Okay, well did they put that
in writing? Mechanic will fix lights coming on?

Speaker 8 (01:08:05):
No?

Speaker 4 (01:08:07):
What were the lights that came on.

Speaker 8 (01:08:11):
With the trailer brake lights?

Speaker 4 (01:08:16):
That's not bad? Okay, that's minor. What else? That's why
I want to know this. What else?

Speaker 8 (01:08:22):
Right there? It's and then I'm trying to remember what
the other one was?

Speaker 3 (01:08:26):
Minor?

Speaker 8 (01:08:27):
I got all this They were minor outside.

Speaker 5 (01:08:29):
Okay, okay, good, good, So so far we got you
buying a used Chevy Silverado without getting it checked out
with one hundred and fifty seven thousand miles with an
aftermarket warranty that doesn't cover pre existing conditions. Now, tell
us about the big problem, the one you called about.

Speaker 8 (01:08:47):
Okay, well, it's not so much even the service on that.
When I the first day that I went in there
where they told me they wanted three thousand down, they
marked the contract that I signed down with that day.
They call me back last night and tell me they
I have to sign a new contract, and I'm holding
off on signing the new contract because okay.

Speaker 4 (01:09:09):
Okay, good, that's good.

Speaker 5 (01:09:11):
Now there's a reason they told you they need a
new contract, and it's probably because they screwed up.

Speaker 4 (01:09:17):
I want to analyze that for.

Speaker 5 (01:09:18):
You, Jeff, to see if we can help you, because

Man Dix is the Troubleshooter Show. No Tom Martino, Hey.

Speaker 4 (01:10:31):
Tom Martino, Welcome to the show. We got a full house.

Speaker 5 (01:10:33):
We got Deputy Chopper, Deputy Dollar in the studio.

Speaker 4 (01:10:37):
We have Deputy d with me here.

Speaker 5 (01:10:38):
We also have a guest from Best Way Insulation talking
about insulating scams, insulating knowledge, rebates, UH tax credits. The
word is call them and they'll coordinate what the credits
and the rebates are and you'll be shocked at what
it will cost with the reduction. I mean you'll be

(01:10:58):
shocked with your discount in a good way for getting
your house up to snuff. We'll talk about that in
a minute. I want to talking to Jeff right now.

Speaker 4 (01:11:06):
Now. Listen, Jeff, I'm not picking on you.

Speaker 5 (01:11:09):
Jeff is one of oh, I would say at least
twenty people in the last few weeks who have purchased
high mileage vehicles with an extended warranty that doesn't work,
if I wanted to sum it up. So, we're talking
about high mileage vehicles, We're talking about extended warranties that
give a false sense of security. We're talking about promises

(01:11:32):
made that we're never documented, and people ended up with
a problem. Okay, I don't know how to put this,
but it is one of the biggest problems lately. Okay,
and in fact, I'm even making a note that.

Speaker 4 (01:11:50):
I need to post on this. So what happens when you.

Speaker 5 (01:11:56):
Buy a car with these extents warranties? Well, I'm going
to tell you the very first thing. They don't cover
pre existing conditions. Now, I'm going to ask you something.
On a car or truck with one hundred and fifty
seven thousand miles, how many problems would.

Speaker 4 (01:12:15):
Not be pre existing? How many? Probably none? Probably none.

Speaker 5 (01:12:23):
So what are the chances of new new problems coming up?

Speaker 4 (01:12:27):
New problems?

Speaker 5 (01:12:29):
Well, pretty good chance, but most of them will be
pre existing. So Jeff bought from Alfred automotive a twenty
eighteen Chevy Silverado with one hundred and fifty seven thousand miles.
By the way, if you buy a car with one
hundred thousand or more, you're gonna have problems. There's no doubt.

(01:12:50):
In fact, there there's absolutely no doubt. Okay, absolutely positively
no doubt.

Speaker 4 (01:12:56):
You will have problems.

Speaker 5 (01:12:57):
At one point fifty you will have major problem problems,
and over two hundred thousand you will have catastrophic problems.
So there is, and I'm telling you, and I'm probably
more credible than any source there is because I talked
to people on a daily basis and I've been doing
it for more than fifty years. Now, here's the bottom line.

(01:13:19):
He bought it, he stuck with it. Let's help him. Now,
let's try to help him. He talked about the warranty
and he had stuff to add.

Speaker 4 (01:13:29):
So what is going on? Now? This is the problem.

Speaker 5 (01:13:33):
I want to know now, So what just happened or
what caused you to call us.

Speaker 8 (01:13:38):
Jeff, because I'm trying to negotiate with this guy to
get these problems taken care of.

Speaker 5 (01:13:45):
Liking what problems? So you didn't tell me yet what
the problems were? What are the problems? This is what
I want to know. What happened? You bought it last week?
What could possibly happen in a week?

Speaker 3 (01:13:57):
Okay?

Speaker 8 (01:13:58):
The breaks the ape, there's no ABA breaks at all.
When I come up to a stop light and put
the brakes on, it screeches to a stop. That's okay.

Speaker 4 (01:14:06):
But why did you hold on, Jeff?

Speaker 5 (01:14:09):
Why didn't you have it checked out by a mechanic
before you bought it?

Speaker 8 (01:14:14):
Well, because it is hind mileage. I knew I was
going to have problems with it.

Speaker 4 (01:14:17):
And well, look, well why didn't you have it checked out?

Speaker 5 (01:14:21):
So if you knew you were going to have problems
with it, then this abs break problem should be of
no surprise to you.

Speaker 8 (01:14:30):
The problems that I expected to have, you know from
the test drives. I mean, this is over and above that.
And so the guy said that he would take care
of these things, and.

Speaker 5 (01:14:39):
The old oh wait wait wait wait wait wait wait wait, Jeff, Jeff, wait, man,
you go too fast. He said he's going to take
care of these things. Are these things?

Speaker 4 (01:14:49):
Quote?

Speaker 5 (01:14:50):
These things are things you discovered after you purchased it? Right, okay,
hold on, okay, now, Jeff, so far you've told me
one thing that you discovered after you purchased it, and
that's the ABS. What else did you discover after you
purchased it?

Speaker 8 (01:15:11):
It's cutting out when you're accelerating.

Speaker 5 (01:15:13):
Okay, so you have is it stalling or stopping or what?
Where's it hesitating?

Speaker 8 (01:15:20):
It's just cutting out like you're accelerating and then the
acceleration's gone for a couple of seconds and then it
starts back up again.

Speaker 5 (01:15:27):
Is cutting out during acceleration? And this did not happen
when you tried it out?

Speaker 8 (01:15:33):
No?

Speaker 3 (01:15:35):
Okay?

Speaker 4 (01:15:36):
Okay? And what else? Go ahead?

Speaker 5 (01:15:38):
So I got the ABS breaks cutting out during acceleration?

Speaker 4 (01:15:42):
What else?

Speaker 8 (01:15:45):
The only other thing is in I need a gall
I need to buy me a gas cat. That's it.

Speaker 4 (01:15:50):
And what's wrong with the gas cat?

Speaker 8 (01:15:53):
There isn't one? And I did, but you knew that
until I went to a gas and I would. I
didn't see that.

Speaker 4 (01:16:00):
So you mean to tell me I brought it? Jeff?

Speaker 5 (01:16:03):
I want you to let me take some liberties here,
And Jeff, I swear to you, I swear to God
that my desire is to help you. Okay, it really is.
But I'm going to tell you some hard facts. You
did everything stupid. You could buying this car everything. You
could not make more mistakes. First and foremost, it had

(01:16:24):
one hundred and fifty seven thousand miles.

Speaker 4 (01:16:26):
Second, it had lights on.

Speaker 5 (01:16:28):
Third, you never even took it to check out, and
you probably didn't take it even for a good test drive.

Speaker 4 (01:16:34):
What I'm saying to you.

Speaker 5 (01:16:35):
Is, if you bought a vehicle as is, you truly
don't have any coverage unless the extended warranty will fix
these things. And that's whatever the extended warranty says. But
the extended warranty is whatever it says. So now you
have right. Now, let's talk about the major stuff, the
ABS breaks and the cutting out of acceleration. I don't

(01:16:57):
give a damn about the gas cap, you buy your own,
but the acceleration and the ABS breaks.

Speaker 4 (01:17:03):
What do they say about those two problems.

Speaker 8 (01:17:08):
That their mechanic would look at it and see about
taking care of it.

Speaker 4 (01:17:12):
Okay? So what have they done so far?

Speaker 8 (01:17:15):
Nothing?

Speaker 4 (01:17:17):
What do you mean? Okay? Now that's where I said,
going into the break, this might be a route. Why
did they say you.

Speaker 5 (01:17:24):
Need to sid Were they financing you or were you
getting your own financing?

Speaker 4 (01:17:29):
No, they're financing Okay.

Speaker 5 (01:17:31):
Then somehow somewhere you they can't get the loan purchased.
So dealers said it would be three thousand down and
they would find you alone.

Speaker 4 (01:17:42):
Is that what the original paperwork said?

Speaker 8 (01:17:45):
That's what see, that's what they told me. Well, they
told me they would work with me on the.

Speaker 4 (01:17:48):
FI I'm talking about.

Speaker 5 (01:17:50):
I don't want to talk about anything verbal anymore, not
not one thing. I want to talk about the contract.
What does the original contract say?

Speaker 4 (01:17:59):
How much.

Speaker 8 (01:18:01):
Three thousand?

Speaker 4 (01:18:02):
And did you put that three grand down?

Speaker 5 (01:18:06):
No?

Speaker 4 (01:18:07):
Okay, when were you going to put the three grand down?

Speaker 8 (01:18:12):
The deal was I would put five hundred cash down
and they would give me a two thousand dollars dealer
rebate and float me the other five hundred to be
paid this Friday, And.

Speaker 5 (01:18:23):
So you only had to come out of pocket. You
only had to come out of pocket one thousand dollars.

Speaker 8 (01:18:31):
Correct. But what bothers me is after this was all
said and done, they told me that the bank was
going to call to verify the sale and that I
had to tell them that I put three thousand dollars
down on it.

Speaker 5 (01:18:41):
Well, that's because that's what they require in order to
get it purchased.

Speaker 4 (01:18:46):
I know what they're doing. They're lying to their bank.

Speaker 5 (01:18:50):
They're saying to their bank, this guy's putting three grand
down and they're really only getting one thousand dollars because
they want to make you look more credit worthy. You
understand that, right, So hang on. They're lying to them
that much. We know where they're lying to them. We'll
come back and find out if you can get out
of this because of those lies. I'm Tom Martinez. This
thing sucks to high heaven, folks. It sucks.

Speaker 4 (01:19:13):

go back to Jeff when we take a look at
that contract.

Speaker 4 (01:19:56):
Uh, possibly he's done everything wrong.

Speaker 5 (01:19:59):
You can when you buy a car truck and Brittany,
though you have a question about a landlord or an
issue with a landlord.

Speaker 4 (01:20:06):
What's going on? Brittany?

Speaker 13 (01:20:08):
Oh yeah, can you hear me?

Speaker 4 (01:20:09):
Yeah? I sure, Ken, Brittany, what's happening?

Speaker 13 (01:20:12):
Oh? A lot, a lot, a lot?

Speaker 1 (01:20:16):
All right?

Speaker 4 (01:20:17):
Is this a new is this a new rental? Or
have you been there a while?

Speaker 13 (01:20:21):
So we moved in August thirty first of last year,
and since that day it has been a nightmare. It's
been issue after issue after issue consistently.

Speaker 4 (01:20:34):
Okay, so what is what do you?

Speaker 8 (01:20:36):
What? Do you?

Speaker 4 (01:20:36):
What brought the call on today?

Speaker 13 (01:20:39):
So, just because it's it's so many things, reporting any
kind of issues to her results in like retaliation. She asks,
as if we're damaging her property on purpose. She's even
stated this. She's extremely rude and contem sending she was
supposed to renew our lease. Now she's saying she's not.

Speaker 12 (01:21:00):
Well.

Speaker 5 (01:21:01):
Hold on, now, you know about the new laws, right
that she has to have a reason to not renew
your lease.

Speaker 13 (01:21:08):
So now she's saying because she's going to let her
son move in. But you can tell very clearious now.

Speaker 4 (01:21:13):
By the way.

Speaker 5 (01:21:14):
That is one of the exceptions where she can get
rid of you.

Speaker 4 (01:21:17):
That's why she's saying that, right, right.

Speaker 13 (01:21:19):
But if you look at our correspondences you can tell
it because of the issue. So like when we recorded
a problem to her, it was immediately like, well, I'm
not dealing with this anymore. I'm just going to let
my son live there.

Speaker 5 (01:21:34):
Well, did she give you official notice? Did she give
you official notice that she's not renewing?

Speaker 13 (01:21:42):
He did, which is fine, honestly, because we want to
go like that.

Speaker 8 (01:21:45):
We're okay.

Speaker 5 (01:21:47):
So then okay, if you want to go anyway, I
assume it's going to be at the end of August,
right or they at the end. Okay, So if you
want to go anyway, what are you calling about today?

Speaker 13 (01:21:58):
Because I am going to see past damages from her,
I believe I'm trying to see exactly what.

Speaker 5 (01:22:03):
Okay, Okay, let's analyze this. What damages are you trying
to collect?

Speaker 13 (01:22:10):
So since we've been living here, it's been a health hazard.
I have a son who's liver transplant recipient, I have
two small children. We've had plumbing issues to the plant
where our house smeld and.

Speaker 4 (01:22:22):
Brought Yeah, but Brittany. Brittany, we're talking about suing her.
Listen carefully.

Speaker 5 (01:22:26):
You have to have demonstratable, connected damages that are pretty
much permanent.

Speaker 4 (01:22:31):
I'm not because tell me what damages you have.

Speaker 13 (01:22:38):
So the fact of living in uninhabitable conditions.

Speaker 5 (01:22:42):
Yeah, but what are your damages? Okay, if it's uninhabitable,
that is that is contrary to you. You are already
living there. You can't be living there and claiming it's uninhabitable.

Speaker 4 (01:22:55):
You have to have damages.

Speaker 5 (01:22:56):
By the way, Brittany, you might think at the end
of this call, I was a pain in the ass,
But what I'm telling.

Speaker 4 (01:23:02):
You is I will be truthful with you.

Speaker 5 (01:23:04):
For you to bring a damage's claim against a landlord
for any kind of health issue, it's going to take
a lot of evidence. You can't just say we've been
living blah blah blah blah blah. It doesn't matter what
your opinion is. I need to know that you have
a doctor who said living there caused this problem to
your son and it's not going to be cured and

(01:23:27):
he's as a result, he's permanently disabled from it or
something like that. You have to have real, honest to
God evidence. You can't just have your opinion, or it
can't just be that you're pissed off living in those conditions. Now,
if there are things that were intolerable, the question will
be asked, why did you.

Speaker 4 (01:23:49):
Keep living there?

Speaker 5 (01:23:50):
If it was a health problem that damaged your son
or daughter or kids, the question the defense will be, well,
your honor, she kept living there. I know of my
kid's health was at risk, I would have moved or
I would have left. So I need to know. I
want to get right down, Brittany, to what exactly can
you pin on the landlord that is a damage? And

(01:24:14):
I'm making you do this because if not, you're going
to be laughed out of court.

Speaker 13 (01:24:19):
Well no, that's okay, there's so much more, Like I said, like,
that's just one.

Speaker 4 (01:24:22):
Give me, give me, that's what I'm asking for. Give
me the examples of actual damages. Not you're not that
you're pissed off. I want to know actual damages.

Speaker 8 (01:24:32):
Go ahead, right, So, the.

Speaker 13 (01:24:34):
Only thing I can tell you is that since we
have lived in the path, my son has had a
reoccurring eye infection that we don't know what it's from.
She's been refusing to test for mold, and I have.

Speaker 4 (01:24:45):
She doesn't.

Speaker 5 (01:24:46):
She doesn't have to test. She's not required to test
for mold. But you can test for mold if there's.

Speaker 13 (01:24:52):
Active like sewage in the bottom of the house. She
doesn't have to do that. If there's active plumbing problems
and you can sold.

Speaker 5 (01:24:58):
No, she's not required to. But but I'm not saying
that's good. I mean, I think that sucks, but that
but she's not required. There's nothing that makes her test
for anything. Now, if you have active sewage in your
house and I don't know why you're still living there,

(01:25:19):
I mean, have you had any test done, any do
it yourself tests?

Speaker 13 (01:25:25):
No, she doesn't want us to do anything on our own.

Speaker 4 (01:25:27):
Well she can't. She can't.

Speaker 5 (01:25:28):
Oh no, no, no, no, she can't stop you from doing it.
Do it yourself air test inside your house. She can't
stop you. She would never know.

Speaker 13 (01:25:36):
Well, I can call the county inspector and ask them too,
which I kind of planned on doing anyways. But this
has been like a recurring thing. So like the first issue,
you know, it was kind of masked and like you know,
she was trying to brush it under the rug and
staff and then it got fixed supposedly. Then we had
another plumbing issue. So another piece of this is constructive viction.

Speaker 5 (01:25:56):
Brittany, Brittany, there is no constructive eviction. And if you're
going at the end of the lease, a constructive eviction
is when you break a lease.

Speaker 4 (01:26:06):
You're not breaking the lease. You're going to leave at
the end of all.

Speaker 13 (01:26:10):
If we find something sooner than later, we might be okay.

Speaker 4 (01:26:13):
Then here's the Then you have to do it the
right way. You have to do it the right way.

Speaker 5 (01:26:18):
You can't just call it an okay. Here's how you
do it the right way. With a constructive eviction, you
must give the You must give them notice that there
is a specific problem that must be addressed, and you
tell them what it is and what it will take

(01:26:39):
to address the issue, and you give them a certain
amount of time, like ten days to address the issue.
They have to respond to you. If they don't respond
to you, then what you will have. Then what you
will be able to do is you will be able
to then say, as a result of this, we are
leaving on such and such a date and then you leave.

(01:27:00):
Now that's not going to prevent the landlord from coming
after you for the rest of the lease. And the
constructive eviction is what you do. But the constructive eviction
is your defense for leaving early.

Speaker 4 (01:27:16):
And most of the time.

Speaker 5 (01:27:18):
You can win if you keep documentation of what needs
to be done to repair it and the fact that
she turned it down. But you must do this in
writing and give her ten days to correct it.

Speaker 4 (01:27:31):
And then I'm looking for my.

Speaker 5 (01:27:33):
Exact I have a document that I posted on this
actually that can help. I'm just looking for it right now,
and really what you When I find it, I can
email it to you on the steps you take to do.

Speaker 4 (01:27:45):
A constructive eviction.

Speaker 5 (01:27:47):
If you want to leave before August, but it's only
next it's only next month. Tell me when you want
to leave. It's already July eighth. When do you want
to leave? Why would you risk a constructive eviction when
you only have a month left? I actually you have
two months left. When would you be leaving at the
end of July?

Speaker 13 (01:28:07):
Who knows? I mean if we found something sooner than later.

Speaker 8 (01:28:11):
Oh, it's just a mass too, and we have a.

Speaker 13 (01:28:13):
Large family, so it's not like so are.

Speaker 5 (01:28:16):
You inquiring now about getting out early or suing her
because to super damages from what you told me? And
I'm just I'm trying to be honest without hurting your feelings.
You don't have a case unless you can say that
that eye infection was caused by this inside the house
and the landlord knew about it and refused to address it.

Speaker 4 (01:28:38):
What I'm saying to.

Speaker 5 (01:28:39):
You is there's too much burden on you to try
to prove direct damages. First of all, can you even
afford it? An attorney's going to cost you a minimum
of five thousand dollars to bring a damage's claim. Do
you have money to put down as a retainer?

Speaker 8 (01:28:57):
Yeah?

Speaker 4 (01:28:57):
Okay, good good.

Speaker 5 (01:28:59):
I want you to call and I'm going to give
you the name of a real estate attorney who couldn't
do this for you.

Speaker 4 (01:29:03):
His name is Brad O'Brien and here's the number, and.

Speaker 5 (01:29:08):
He would absolutely look at the case and recommend whether
or not to move forward.

Speaker 4 (01:29:12):
So it won't cost you anything for him to look
at it.

Speaker 5 (01:29:14):
But then if he decides to move forward on a
constructive eviction and damages, he will be honest with you.

Speaker 4 (01:29:22):
In fact, we ought to get him.

Speaker 5 (01:29:23):
On right now just to get you a clue without
even if you're willing to hold for a little, I'll
get Brad O'Brien on and maybe he can answer your
questions directly.

Speaker 13 (01:29:34):
Yeah, because I mean, to be honest, we barely scratch
service because it's been it's well.

Speaker 5 (01:29:39):
Okay, but that's what I'm telling you, what to scratch
the surface.

Speaker 1 (01:29:43):
Go ahead.

Speaker 5 (01:29:44):
I'm not giving you a time limit. Go ahead and
scratch the surface. Tell me what you're talking about.

Speaker 8 (01:29:50):
Okay.

Speaker 13 (01:29:50):
So, for instance, right now, with all of the tile
and the kitchen with craft like completely because of water logs,
we're due to a neglected plumbing issue. When we had
stated that to her that when she says, okay, well
I'm not doing this, you guys are going to have
to go so by reporting an issue that's more like
a retaliation type of thing. She recorded me in my

(01:30:10):
home after I asked her, not who which is illegal?

Speaker 4 (01:30:13):
What do you mean she recorded you in the home?
What do you mean, Britney?

Speaker 13 (01:30:16):
Oh, she recorded me. She was arguing with my fiance
about the issue, and I went, what do.

Speaker 5 (01:30:20):
You mean she recorded you? She recorded your audio or
video or both.

Speaker 13 (01:30:25):
Probably both.

Speaker 4 (01:30:26):
She's allowed to do that in Colorado.

Speaker 5 (01:30:29):
You're allowed to videotape or audio tape as long as
she was a party to it. Now, she can't hide
something in your apartment to do that.

Speaker 4 (01:30:38):
But if she's there, she can.

Speaker 13 (01:30:40):
What's that according to the laws that I've read. If
it's a public.

Speaker 4 (01:30:44):
State, that's true.

Speaker 13 (01:30:45):
But in the protected space that's as your home, somebody
else can just come into your home and record you.

Speaker 5 (01:30:49):
Yes, yes, they yes, hold on, yes they can. If
they're a party to it, they can. Let me explain
what that means, Brittany. If I come into your home
and it's your ive at space and I'm recording you,
it's a one party consent. I'm allowed to consent to
it if I'm a party to it, and I am

(01:31:12):
the party doing the recording, so I'm a party to it. Now,
what you can do is ask her to leave your
home because you're renting it and you have the right
quiet enjoyment.

Speaker 4 (01:31:24):
But you cannot ask her not.

Speaker 5 (01:31:26):
To record you because she has a right to record
you as a single party consent state. Now, what she
also can't do, she can't hide a recording device and leave.
In order for you to be legally to legally record conversations,
even without the consent of the other party, you have

(01:31:49):
to be part of it. So if your landlord is
recording you and you don't like it, you can ask
the landlord to leave the place, just leave us. But
she is allowed to record anything she is party to.
So in other words, I know that sounds confusing, but
it's a single party consent state. That means she can

(01:32:11):
be the single party consenting to the recording.

Speaker 13 (01:32:14):
She can't, however, from the.

Speaker 5 (01:32:19):
And as far as the private space goes, I think
you're confusing two different laws. You can't trespass and record people,
but in order to trespass, you would have told her
you're trespassing.

Speaker 4 (01:32:33):
I demand that you leave.

Speaker 5 (01:32:35):
That is totally different than saying don't record me, because
if she's in her home, she can record you. Let's
try to get Brad O'Brien on for her. We do
have him on. We'll talk to him right after this.

Com to list your home with Remax Alliance three oh

I want to bring up Brad O'Brien.

Speaker 4 (01:33:27):
With as law.

Speaker 5 (01:33:28):
He's a real estate attorney and Brad, I just want
to I want to ask you this straight up, because
we get this call all the time and we really do. Okay,
a tenant is in a place and they hate the conditions,
and they might have.

Speaker 4 (01:33:43):
Some legitimate concerns.

Speaker 5 (01:33:45):
I mean, there might be mold, there might be you know,
plumbing issues, there might be this.

Speaker 4 (01:33:49):
Issue or that issue. I'm not disputing that.

Speaker 5 (01:33:52):
Let's say there are issues, but then the tenant wants damages.
That's where I think it gets really difficult. Brittany says
she has a son who's a transplant patient and has
health problems and she wants to sue the land word
for damages. What is involved in something like that. If

(01:34:14):
someone sat down with you and said, Brad, my lease
is up at the end of July or at the
end of August, at the end of August, and I
want to do a constructive eviction and I want to
sue for damages. Tell me what it looks like in
an evidentiary way.

Speaker 14 (01:34:34):
Well, the clearest way to make that kind of a
case is under the Warranty of Habitability statue in Colorado,
in which there has to be some specific reason why
it's not habitable. No heat, no water, mold, termites, that
sort of thing. But you have to pursue each of
those issues independently, and the statue provides the way for

(01:34:57):
the tendant to give the notice to the landlord, and
then then the lennard has a certain amount of time
to respond, and then then if they don't, uh, pretending
to go to court to do a couple of different
things under the statute, want terminate the lease, to keep
the lease, but super damages and also sue for at
the same time, sue for junctive belief or court order

(01:35:19):
forcing the landlord to fix the problem. So that's really
the way to super damages on a habitability issue.

Speaker 5 (01:35:27):
Now, what if you're claiming health problems or consequences or
health damages to your kid's health.

Speaker 4 (01:35:34):
What would what would that require?

Speaker 14 (01:35:36):
Well, that's a little bit out of my area because
that's really personal injury. Uh, that would be a negligence
type of a claim.

Speaker 4 (01:35:44):
You know, if.

Speaker 14 (01:35:44):
Somebody if there's mold in there that was not disclosed
and the landlord actually knew about it, perhaps that's a
good negligence claim that a personal injury lawyer could help
the person with.

Speaker 4 (01:35:54):
Because that's it goes.

Speaker 5 (01:35:56):
Into the mid No, I understand if you made the landlord.
If you made the landlord a way of let's say mold,
and you said I saw mold in the apartment and
the landlord did not address the issue, is the landlord responsible?
Are you responsible to take action? Where does that stand?
I mean, that's a hazy part of the law.

Speaker 14 (01:36:14):
Well, now that's a clear warranty of habitability issue. Mold
is specifically addressed in that statute. In the landlord has
a certain amount of time to first do a mult test.
They're required to the mult test before and after the remediation.
In the middle, have to do the remediation. And in
the meantime, while remediation is being done, the statute requires

(01:36:35):
the landlord to put up the tenants in a.

Speaker 8 (01:36:37):
Hotel with the kitchen.

Speaker 5 (01:36:40):
Now I said, I said, they're not required to test
for anything.

Speaker 4 (01:36:44):
Now, and you're saying.

Speaker 5 (01:36:45):
They are required but that's only after a claim is made.
That's what I'm trying to get at. How would Brittany,
How would Britney start the procedure that would make the
landlord test for.

Speaker 14 (01:36:59):
Britten notification to the landlord that she has a good
faith for reason to believe that there's mold in there.

Speaker 4 (01:37:07):
And that's all it would take.

Speaker 5 (01:37:09):
If she gave written notification that she believes there is
mold in the place, that would require the landlord to respond.

Speaker 4 (01:37:18):
With a test. Yes, okay, And.

Speaker 5 (01:37:22):
She puts that in writing and says, I believe there
is mold here, and I.

Speaker 4 (01:37:26):
Demand that it be tested.

Speaker 5 (01:37:29):
Yes, And then how long does the landlord have to
respond to that?

Speaker 14 (01:37:35):
I can't into the top of my head. It's a
couple of days. It's like two days.

Speaker 4 (01:37:39):
But really okay?

Speaker 5 (01:37:41):
And then, now, Brittany, do you have any written record
where you demanded a test?

Speaker 13 (01:37:47):
I do, and I have photos that we sent to her.

Speaker 4 (01:37:50):
Good. Now when was that sent January third?

Speaker 5 (01:37:55):
Now if she sends something way back in January, can
she use that now?

Speaker 14 (01:38:03):
Yes, there may be a waiver counter argument that she
kind of waived the situation by staying in there so long.
I mean, whatever, somebody calls me on a mold, it's
not really My first response is not a legal response,
it's it's a health response. Maybe you shouldn't be in there.
Maybe you should get out of there right now until

(01:38:24):
the legal aspects can catch up.

Speaker 5 (01:38:26):
So obviously, Yeah, But what I'm saying, can they use
that against her that she notified them in January but
continued to stay there.

Speaker 14 (01:38:36):
Yes, in the sense of perhaps the tenant failed to
mitigate her mitigate her damages. You know, if it got
the mold, if the injury got worse because of the
mold by staying in there for the five months or
six months since January, then you know that may be

(01:38:56):
something where the tenant is partially responsible for the personal
injury that was a cause during that time.

Speaker 5 (01:39:03):
Brittany, And by the way, Brad O'Brien is at seven
to zero three seven zero seventy three eighty eight.

Speaker 4 (01:39:11):
Thank you, Brad.

Speaker 5 (01:39:12):
Brittany, if you have written documentation that you wrote to
the landlord back in January, nothing was done, what I
would do, Brittany is I would look up that statute
and I would say, you got to look up that
statute that we're talking about. Brad what's the name of
that statute? She would look up that requires the landlord

(01:39:33):
to respond.

Speaker 14 (01:39:35):
Colorado Warranty of Habitability statute.

Speaker 5 (01:39:38):
Now, Brittany, look up Warranty of habibility statute and what
I would do again.

Speaker 4 (01:39:43):
I'm not giving you legal advice.

Speaker 5 (01:39:44):
I would say, I informed you on such and such
a date of this situation, and you took no action.
I am therefore terminating my lease on such and.

Speaker 4 (01:39:53):
Such a date. I mean, look at you.

Speaker 5 (01:39:56):
Just look at the statute for step by step and
leave your email. Well, because I did do it. I
did do a step by step a help guide on
this that I want to send to you. We have

All right, I haven't forgotten about Jeff in his contract.
I'm trying to look at that during the breaks and

Speaker 4 (01:40:52):
So Jeff hang on. But Adam right now has to
leave us at the end of the hour with best

Speaker 5 (01:40:58):
And we talked about there are many discounts available through
rebates from power companies. They can help coordinate that. They're
also tax credits available for insulating, so you can save
a ton of money getting your house up to snuff. Also,
we talked about attic fans. They don't always do what

(01:41:20):
you think they're doing. Now, what they're supposed to do
is keep the attic from getting too hot.

Speaker 4 (01:41:25):
That's what they're supposed to do.

Speaker 5 (01:41:26):
But you're saying they don't really work all the time,
and you find this a lot in people's houses. Explain
how attic fans are short circuited or defeated.

Speaker 3 (01:41:37):
So the attic fans themselves work really well.

Speaker 10 (01:41:40):
And now we're talking about between the roofline and the
air outrut.

Speaker 5 (01:41:44):
Right, So they goes along the roof, it goes on
the roof, and what it's supposed to do is supposed
to make convective currents in the attic by drawing air
up through the eves out through the top, it's supposed to.

Speaker 4 (01:41:57):
Keep that attic at even temperature.

Speaker 3 (01:42:00):
Well, what happens a lot, especially with a lot of
these again.

Speaker 10 (01:42:02):
Door to door guys that are going around kind of
selling them, is they don't eliminate the box vents that
are up there or the gable vent.

Speaker 3 (01:42:11):
A lot of roofers put this gable vent.

Speaker 4 (01:42:13):
Across, which is a high vent.

Speaker 3 (01:42:15):
Yeah, and it's right at the very peak of the roof.

Speaker 10 (01:42:17):
Well, the problem is, if you don't calculate your ventilation correctly,
you will pull from the closest, easiest source.

Speaker 5 (01:42:25):
So what you're really doing is with an improperly installed
attic fan with not enough venting in the eves and vents.
Otherwise you short circuit it. So the air comes right
from the right from the top of the roof, back
into the.

Speaker 4 (01:42:41):
Fan and out again. You're you're not really circulating air
in the attic.

Speaker 10 (01:42:45):
No, you really want to make sure you get the
air from those events.

Speaker 5 (01:42:49):
So the events are low in the attic, they're they're
they're even with kind of your ceiling, and the solar
fan should be put upper on the top part of
the roof. So the solar Excel Roofing does an excellent
job of solar fans on the attic. They put in
six in my home and it made a huge difference.
But that's because when Henry came here and analyzed it,

(01:43:11):
he said, if we put these attic fans in, we
need to open up some more vents.

Speaker 10 (01:43:16):
Yes, or even close some that are up there, so
we don't short circuit this.

Speaker 4 (01:43:20):
Right, you don't want a short circuit.

Speaker 5 (01:43:22):
So you want air coming in from low and being
expelled high. You don't want it the other way. Best

Oh three nine nine six nine thousand.

Speaker 5 (01:45:12):
Hey, so we've been dealing with Jeff and I've been
trying to read this contract. I'm having trouble, but here's
the bottom line. I want to recap Jeff's problem. So
Jeff called and said he bought a twenty eighteen Chevy
Silverado one hundred and fifty seven thousand miles on it
never got it checked out. He bought it from Alfred
Automotive in Ourvadi. He said that came with an aftermarket

(01:45:35):
warranty and at the time of the sale there were
warning lights for trailer breaks. After that he discovered abs.

Speaker 4 (01:45:42):
Breaks did not work.

Speaker 5 (01:45:44):
Engine is cutting out during acceleration and there's no gas cap.

Speaker 4 (01:45:47):
By the way, there is no gas cap on that model,
just so you know.

Speaker 5 (01:45:51):
But in any case, there's a problem with acceleration, and
there is another problem with his a Yes, break's not working,
so he wants to know what are they going to
do about it.

Speaker 4 (01:46:07):
Here's the bottom line.

Speaker 5 (01:46:09):
They don't have to do anything because he bought it
as is, But he said, maybe he has another way
out of this thing.

Speaker 4 (01:46:17):
They want him to sign another contract.

Speaker 5 (01:46:21):
Now, for the life of me, I don't know why
they want him to sign another contract, but here's the
bottom line. The original contract calls for him to put
three thousand dollars down right, okay, but he actually only had.

Speaker 4 (01:46:34):
To pay them one thousand.

Speaker 5 (01:46:37):
It looks to me like they're trying to doctor the document.

Speaker 4 (01:46:42):
To show.

Speaker 5 (01:46:46):
That they are that this guy has more equity in
the deal to sell it to the bank. So they
are making it look like he's putting down three grand
when really he's on putting down a thousand.

Speaker 4 (01:47:01):
That's fraud.

Speaker 5 (01:47:03):
That's fraud, Jeff, they were asking you to commit fraud.

Speaker 4 (01:47:09):
Are you there, Jeff? Okay.

Speaker 5 (01:47:13):
I was under the silly impression that he was still there.
So let's move on to another problem.

Speaker 4 (01:47:19):
Henry.

Speaker 5 (01:47:20):
He wants to talk about the recent hailstorms. Henry Bretts
from Excel Roofing, and we were also talking about attic
fans by the way, and I wanted to ask him
about that. Henry, Are you there, sir?

Speaker 4 (01:47:34):
Absolutely?

Speaker 8 (01:47:35):
Tom?

Speaker 15 (01:47:35):
How are you today?

Speaker 4 (01:47:36):
Good?

Speaker 5 (01:47:36):
So listen, man, have there been recent Has there been
hail damage in the metro area?

Speaker 15 (01:47:44):
You know what, we did get a hailstorm, but it
was a little lower down in Colorado Springs. We got
about two inch hail. It's a bunch of tile roofs,
so those can be a little bit more complicated than
asphalt replay stuns.

Speaker 5 (01:47:55):
All right, I wanted to ask you about inspections. One
thing I want to tell people they never have to
sign anything to get their roof inspected. And many of
these companies that come to the door lie to them
about that and they say they have to sign something.
What are some of the tricks they use to get
people to sign things.

Speaker 15 (01:48:17):
Yeah, so absolutely, And what they say is it's an
authorization to meet with your insurance. And what that really
is is it's a roofing contract. And they often have
these big, huge cancelation fees, so that might be a
fifteen twenty. We've eve been cancelation fees as high as
thirty percent of what they estimate your roof replacement's going

(01:48:38):
to be. So at Excel, we have zero cancelation fees in.

Speaker 4 (01:48:41):
Any of our agreements.

Speaker 15 (01:48:42):
And yeah, it's a big thing for consumers to be
worried about.

Speaker 5 (01:48:46):
No, I understand that they trick people into signing saying, well,
you need to sign this and it gives for liability purposes,
so you won't be in trouble if we get hurt
on your roof, and they whatever they say to you.

Speaker 4 (01:49:00):
Here's the bottom line.

Speaker 5 (01:49:01):
You never have to sign ever anything to get your
roof inspected. Bottom line, that's the truth, right, Henry. You
don't have to sign anything.

Speaker 15 (01:49:10):
Yeah, absolutely, and then another thing is, if you think
you have hail damage, don't call your insurance right away.
Have a really good roofing professional, go out there, do
you winn evaluation of the roof, and then foul an
insurance claim based on that.

Speaker 4 (01:49:25):
And you know why we're saying that, go ahead and
get a claim on your record. That's right.

Speaker 5 (01:49:31):
Do you realize if you think you have listen to this, folks.

Speaker 4 (01:49:35):
If you think you have hail.

Speaker 5 (01:49:37):
Damage on your roof, you just think you do because
it was in the neighborhood or in the area. And
you call your insurance company and they check your roof.
Even if there is no I mean no damage, zero
damage and no claim and no payment, what happens. They

(01:50:04):
count it against you. They literally count it against you.
So they call it as a claim. They say it
is a claim.

Speaker 4 (01:50:20):
So, Henry, you've seen.

Speaker 5 (01:50:21):
That happen, So you can go out and tell them
in a few minutes whether they have damage or not.
Now I want to talk to you about something else.
I want to talk about the roof, the ceiling. No
excuse me. The attic fans. You guys did a lot
of them for me, and the purpose of that fan

(01:50:43):
is to draw the air from lower in the attic
and expel it through the excess heat outside. And what
it does is keep air circulating through your attic, and
that's good for both winter and summer because you want
to equalize the air in your attic. So when you
guys install attic fans as part of a roofing job

(01:51:07):
or someone just wants you to do it, how do
you make sure they have the right kind of venting
to make sure it's not short circuiting.

Speaker 3 (01:51:17):
Yeah.

Speaker 15 (01:51:17):
Absolutely, that's a great question. So there's two kinds of events.
There's intake events and exhaust events. And the most important
thing is that you don't have too much exhaust event
or intake event, because if you try to do what
you're talking about one of those attic fans and you
have too much exhaust vent, what will happen is it'll

(01:51:39):
pull the air from the exhaust vent back into the
attic and then push it back through.

Speaker 3 (01:51:44):
So you need to have that.

Speaker 15 (01:51:45):
Suction and that upwards emotion so it pulls in from
the intake vents and then out through the fan or
the exhaust fence.

Speaker 5 (01:51:52):
So sometimes when you install attic fans, you have to
get rid of some of those roof fens.

Speaker 3 (01:52:02):
Yeah.

Speaker 4 (01:52:02):
Absolutely.

Speaker 15 (01:52:03):
Sometimes there'll be some like turtle vents or something like
that that are mounted kind of in the middle of
the roof, and we will remove those just so we
can get those fans installed. And just to clarify for
everybody listening, those attic fans, they're not air conditioning units,
so they're not going to make the house cooler if
your act isn't working, but it will make your house

(01:52:24):
substantially more efficient, and the cooler you can keep your attic,
the cooler your house.

Speaker 11 (01:52:29):
Will be.

Speaker 5 (01:52:31):
Exactly and that includes even in the wintertime. So you
want to do is keep the air moving in your attic.
The insulation in your attic will help as well, but
it doesn't help keep your house cool well. It actually
does by keeping the attic from getting overheated.

Speaker 4 (01:52:49):
You don't get that radiant heat.

Speaker 5 (01:52:51):
But the main reason is to keep your roof living
longer because it's not overheating and does help your house
to be more even efficient. If you're looking to expel
hot air from your house, that is what you use
the whole house fan, which is distinctly different from an
attic fan. An attic fan draws air from the eaves

(01:53:15):
out through the top of the roof. And that's what
an attic fan does. It keeps convective currents in the
attic to keep the attic temperatures even. That helps reduce
heating and cooling bills. But it is not a whole
house fan. A whole house fan takes cool air from

(01:53:37):
below of your house and expels the hottest air out.

Speaker 4 (01:53:41):
But if you have a whole house fan and you don't.

Speaker 5 (01:53:44):
Have proper attic insulation, what happens, Henry, what happens?

Speaker 15 (01:53:51):
You know, the proper attic insulation is just going to
regulate the temperature, so it could still get very, very
hot in the summer and very chilly in the winter.

Speaker 4 (01:54:00):
Yeah.

Speaker 5 (01:54:00):
So, And also if you don't have the proper ventilation
in the attic and you're feeding up says you went
to my house and said you came to my house,
and you said you have a great whole house fan.
But what was your concern with all the air being
sucked out of my house?

Speaker 15 (01:54:19):
Well, my two thoughts were. Number One, when you're pulling
all of that air from your basement all the way
through the house in the attic with that giant fan,
there's not enough ventilation to then pull that air out
of the attic and then back outside. But then also
it's important that that fan, the whole house fan only
runs when it is cooler outside than inside the house.

Speaker 5 (01:54:43):
Right, And really what's important is you can't pull hot
air through the house and out the top of the
attic if the attic is not ventilated. So before you
even consider a whole house fan, you have to be
sure that your addict, your attic is well ventilated. Henry,
thank you excel roofing as an excellent ax c L

(01:55:05):
excel roofing dot com. Jeff back to Jeff right after
this listen. I am trying to help Jeff out. We're
trying to figure out his contract.

Speaker 4 (01:55:17):
Did you see the contract?

Speaker 5 (01:55:18):
Yeah, if you did see, let's talk about it after
the breaking.

Speaker 3 (01:55:23):
I read the whole show.

Speaker 5 (01:55:24):
Okay, good, we're gonna talk about that because I don't
think we can get him out based on the problems
of the vehicle, because he just walked into this. He
walked into this hook line and sinker and bought a
piece of crap. He bought a piece of crap believing
the warrant he was gonna work.

Speaker 4 (01:55:40):
Okay, we have more on that coming up.

Hi Tom Artina here, Rich has a question. We're going
to go back to Jeff promise you. Uh.

Speaker 5 (01:56:26):
Deputy d read the contract over and has some answers
as to why they might want him to sign a
new one. But I want to go to Rich, who
just called in about SIATICA. Go ahead, Rich, what's going
on with you? Oh?

Speaker 12 (01:56:38):
Hi Tom, I've listened to you forever.

Speaker 8 (01:56:41):
I've been having sech you You're welcome.

Speaker 9 (01:56:43):
I've been having ssiatic issues for years and I'd taken
Gaba Petton and the guy wants to do back surgery
on me and says I wouldn't be able to play
golf for a year. So I thought you had an
operation similar to that and it went really well.

Speaker 5 (01:56:57):
Well, I had an operation that was in play of fusion.
You see, the current state of events is or state
of the of the industry is fusion is the go
to where they take anything. Yeah, well, fusion. Unfortunately, here's
the issue. Fusion fails most time. It gives you relief

(01:57:20):
from one to three, and then it fail, and then
you have to do more fusion, and then they fail,
and then basically fusion has its its limitations. Fusion will
immediately give you relief immediately because it's going to fuse
and take away the rubbing of the nerve and the

(01:57:42):
pinching of the nerve, but it will fuse those together
with a cage and you won't have the mobility ever again. Ever,
the mobility will always be lost in those levels of disks.

Speaker 4 (01:57:55):
Then and vertebra.

Speaker 5 (01:57:57):
Then on the a jay scent a facet joints above
and below the fusion have extra strain on them, and
then they start failing inevitably.

Speaker 4 (01:58:10):
In fact, it's not if it's when.

Speaker 5 (01:58:13):
That's the state of back surgery. The thing I had
done was in place of fusion, and what it does
is puts a movable joint in where the bad joint was,
so you have full mobility, full mobility, Okay. So they

(01:58:34):
basically remove the facet joints and and and and disks
in that area and replace it with a titanium silicone implant,
and that implant will never ever ever be arthritic, and
it will never cause undue stress on the adjacent vertebra

(01:58:55):
or the adjacent facet joints because it moves. It becomes,
for lack of a better term, a part of an
artificial spine.

Speaker 4 (01:59:04):
I mean it's an implant.

Speaker 5 (01:59:05):
Okay, it's on the exterior part of the facet joint,
but it takes over for that part of the back. Okay,
it just does, and one hundred percent pain free since
I've had it done. The problem is the Premius Spine
Company and the procedure I had is called tops TOPS.

(01:59:31):
The problem is it is only FDA approved at this
point in America for one level, meaning if you have
three or four levels of bad joints, you can't put
in three or four of these together. They're only approved
for one at a time. So you can put in

(01:59:51):
one lower and one a little higher. But you can't
put them in back to back to say, did you
understand what I'm saying?

Speaker 4 (01:59:58):
You can't.

Speaker 5 (01:59:58):
For example, you can't string along three of them for
three bad joints, but you can put one and let's
say L four L five, and then one up at
a higher you know if you skip a few. Here's
the thing. How many bad levels do you have?

Speaker 8 (02:00:17):
I think it's just L four L five that's.

Speaker 4 (02:00:21):
The number one. That's what I had.

Speaker 5 (02:00:23):
And this TOPS procedure, the TOPS procedure was done for me,
absolutely positively done. Now even though it's FDA approved and
I had my and I had it approved by the way,
I had my surgery approved by Medicare and my supplement.

(02:00:45):
A lot of insurance companies are still calling it experimental,
which is bs by the way, because it is not experimental.
It is a fully approved procedure. So you're gonna you
might have to fight with your insurance. I don't know
what insurance. What insurance do you have?

Speaker 9 (02:01:01):
I've got Medicare and my supplement.

Speaker 5 (02:01:04):
Is you should have no problem. You should have no
problem with Medicare. You shouldn't have a problem with Medicare.
I'm saying, that's what I had now listen.

Speaker 4 (02:01:15):
The problem.

Speaker 5 (02:01:16):
Let me let me tell you something else about it.
First of all, where are you going right now? Did
they did they even know about the TOPS procedure?

Speaker 9 (02:01:24):
Well, I haven't been to the doctor for about a
year and a half. I have to go see him
just to get my GABA pent and renewed.

Speaker 12 (02:01:31):
Next next week, I'm going to see him.

Speaker 5 (02:01:33):
Okay, I'm gonna I'm going to suggest to you that
you look up doctor Joshua Beckman.

Speaker 8 (02:01:41):
B E C.

Speaker 4 (02:01:43):
Beckman b E C K M A n Okay, Okay.

Speaker 5 (02:01:49):
Now he used to be as Saint A's, but they
they moved his practice moved. I believe the name of
the practice, God, I should know this by heart because
he saved my life as far as pain goes. I
believe it's Neurosurgery one is the name of the practice.
I'm going, good, Then you're gonna love them.

Speaker 12 (02:02:13):
Well, I'm going, well, I've been to this guy.

Speaker 3 (02:02:14):
And maybe it's not.

Speaker 9 (02:02:16):
It's not that doctor, but it's it's Neurosurgery one in
Parker that I'm.

Speaker 5 (02:02:20):
Going Okay, So ask him about the TOPS procedure, and
ask him.

Speaker 4 (02:02:24):
About josh and and just ask him.

Speaker 5 (02:02:27):
I mean these guys all work together, and you're gonna
be so you're gonna be so happy, Man Rich, You're
gonna be so happy. Honest to god, it's it's a
Now let me tell you what else that doctor Beckman.

Speaker 4 (02:02:42):
Has been doing, which is ingenious.

Speaker 5 (02:02:46):
So let's say you have more than one level done.
You're excuse me, more level bad, and you need a fusion.
What he's done is fused together. Let's say three facets right,
and take away the failure rate.

Speaker 4 (02:03:02):
Of the fusion.

Speaker 5 (02:03:04):
He has placed the implant above and below.

Speaker 4 (02:03:11):
The fusion. Now, when you think about how ingenious.

Speaker 5 (02:03:14):
That is, you get the fusion you need where you
need it, in multiple levels, but to keep the adjacent
of fit.

Speaker 4 (02:03:26):
Ops above and below it.

Speaker 8 (02:03:30):
Okay, I'm kind losing you.

Put them on hold again?

Speaker 15 (02:06:36):
All right?

Speaker 4 (02:06:36):
Jeff? What did you find out about the contract? Deputy?
What did you find out about the contract?

Speaker 8 (02:06:42):
Tom?

Speaker 1 (02:06:42):
I read the.

Speaker 6 (02:06:42):
Contract and I read another document that's even more important
than this case. But as far as the contract goes,
you know you want to hear about the mop and
glow components of it. There are a couple of them
that stood out. So one of them is a gap
insurance of four ninety five. But do you know what
theft etch means?

Speaker 8 (02:07:01):
Yes?

Speaker 3 (02:07:01):
What is it?

Speaker 5 (02:07:02):
They etched the windshield with a number, and they claim
that if your car is stolen, it helps identify it.

Speaker 4 (02:07:09):
It's really only an added profit center for the dealer.
It is bull crap.

Speaker 3 (02:07:13):
Guess how much it costs?

Speaker 6 (02:07:14):
How much three thousand, seven hundred and fifty five.

Speaker 4 (02:07:17):
That they ripped him off completely? They totally ripped him off.

Speaker 3 (02:07:20):
Oh, on a piece of jump that doesn't run back.

Speaker 5 (02:07:22):
Yeah, so, Jeff, you overpaid for stuff. You paid three
thousand dollars for them to etch a number in your
windshield that helps you get your cruck back if you
have insurance, you don't need any of that. You don't
need any of that if you have insurance. So it's
a bunch of crap. And what, in my opinion, they
did is ripped you off. Why do they want him

(02:07:43):
to sign a new contract though? That's what I want
to address that. What do you think why do you
think I.

Speaker 6 (02:07:47):
Think that I read that's even more important in this
matter than the contract is the credit union that they
tried to finance him through declined to finance him. So
there is no deal, right because the financing fell through.

Speaker 4 (02:08:02):
Well okay, but be careful.

Speaker 5 (02:08:05):
Some deals are written that you buy a vehicle, you
put so much down and there's a balance due. If
they write a contract like that, the balance is still
due even if you don't have contract. There is no
law that says that the contract the financing has to
go through for it to work, unless the contract says that. Now,

(02:08:29):
if the contract is contingent upon financing, then he's.

Speaker 4 (02:08:34):
Out of the deal. Well, the contracts does it say
it's contingent.

Speaker 3 (02:08:37):
I haven't encountered that term yet.

Speaker 6 (02:08:40):
But it specifies an interest rate, and it specifies what
specifies an.

Speaker 4 (02:08:46):
Interest Wait a minute, Wait a minute.

Speaker 5 (02:08:48):
If it specifies financing, then they have to provide the financing,
and if they can't, then the deal would be dead. Jeff,
are you there. Let's go back to Jeff. Now, Jeff,
here's what's important. Hello, Jeff, Yes, hell, we're here.

Speaker 4 (02:09:10):
Jeff, I mean, hey, just take put them on hold.

Speaker 6 (02:09:15):
So it does say that this is a credit sale,
and both Jeff and mister Montemior signed that part of it.
It says that the interest rate will be twenty one percent.

Speaker 4 (02:09:25):
Okay, twenty percent.

Speaker 6 (02:09:26):
It does have a or less right. It does have
a fee. If financing is not arranged in accordance to
your contract and the sale is not consummated, you agree
to pay fifty dollars per day and fifty cents per mile.
So it looks like Jeff might be out of his
five hundred dollars down payment. But this does say here's

(02:09:48):
what happens if the financing is not arranged.

Speaker 5 (02:09:51):
Let me let me just get some reassurance here, because
we were having some technical difficulties.

Speaker 4 (02:09:56):
Dragon, can you still hear us? Fine? Sure can buddy?

Speaker 5 (02:10:01):
Okay, good? What was Jeff having a problem hearing us?
Do you know why he was having a problem hearing us?

Speaker 8 (02:10:06):
It was because of the.

Speaker 3 (02:10:06):
Connection that we had between the studio and you.

Speaker 4 (02:10:08):
But I'm not sure what the issue is right now.
Let's try them again. Let's try them again, Jeff. Let's
just try it again.

Speaker 5 (02:10:17):
Hello, Jeff, I'm sorry, we're having we're having some technical issues.

Speaker 4 (02:10:22):
Can you hear.

Speaker 8 (02:10:24):
Yeah?

Speaker 4 (02:10:24):
Man, this is becoming Can you hear me? Okay?

Speaker 8 (02:10:29):
Yes, I can hear you?

Speaker 4 (02:10:32):
Oh hell, all right.

Speaker 5 (02:10:34):
It looks like it looks like if you don't sign
a new contract. I don't think they can hold you
to that original contract. If you want out of the deal, Jeff,
you got to be strong and refuse to sign anything new.
But you may have to pay for use of that
vehicle while you had it, and they can only charge

(02:10:55):
bailman up to ten days by law.

Speaker 4 (02:10:58):
They can't do it more than ten days.

Speaker 5 (02:11:01):
But Jeff, our suggestion would be, do not sign a
new contract and get out of the deal completely. That's
what we would do if we were you. Just get
out of the damn deal. Tell them you refuse to
sign no matter what they tell you. No matter what
they tell you, ask them if they'll talk to us,
you do not have to sign a new contract. Don't

(02:11:23):
don't let them bully you. They're going to try to
bully you. You tell them that you want out of
the deal, totally out of the deal. Now, if they say, okay,
you don't have to sign a new contract, then we
have to readdress this. If they can offer you what
But I'm telling you this is a ripoff deal, bro
You were totally ripped off. They charge an additional three

(02:11:45):
thousand dollars for this seven thirty seven hundred for this
etching on your windshield a total ripoff. That etching on
a windshield is worth nothing. If you have theft insurance,
you do not need it. It doesn't help you. I
don't get a discount on your insurance. In fact, I'd
love to call you know what, d I'd love for

(02:12:05):
you to call this dealer and ask them, if truly,
why would they need that etching if they have insurance.
I want to see what song and nance they give you.
Just tell him we're inquiring about it.

Speaker 6 (02:12:14):
Well, I mean, I think it's pretty clear, right they'll
they'll say that this is a value added product.

Speaker 5 (02:12:20):
Will they say it's worth thirty seven hundred dollars when
you have auto theft insurance?

Speaker 3 (02:12:23):
Well, of course, what.

Speaker 6 (02:12:25):
Do you think they're going to say, Oh, no, we
just wanted to pad the deal.

Speaker 5 (02:12:27):
By the Well no, but I'd liked him to know
that we know about him. What's that This dealer sucks? Man,
totally sucks.

Speaker 3 (02:12:33):
I got an idea for Jeff.

Speaker 6 (02:12:35):
What if he goes over there he needs to return
the car, Yes he has done it, right now, and
tell them that he spoke with us and we are very,
very very interested in getting a callback from him. Tomorrow
or the day after, after he drops up the car
to tell us how that process went. I think that
might get mister Montemayor's attention over there, Jeff, okay with

(02:13:00):
that idea.

Speaker 8 (02:13:00):
Ok yeah, yeah, yeah.

Speaker 3 (02:13:04):
I think you're better I mean my personally.

Speaker 4 (02:13:06):
Do not sign a new contract though.

Speaker 6 (02:13:07):
Don't let them, don't let them upsell you, move you
into another vehicle or another financing attempt. I think you're
even though you're going to lose the five hundred bucks
you put down, in my opinion, you're better off because
you've got a junkie truck.

Speaker 4 (02:13:20):
Absolutely absolutely paid.

Speaker 5 (02:13:23):
You totally are repaid, and that thirty seven hundred dollars,
in my opinion, was a complete ripoff. So it's good
to talk about this dealer again. The dealer is called
Alfred Automotive in Arvada. Alfred Automotive in Arvada, Chopper, would
you do me a favor? Yes, sir, Call them and

(02:13:46):
ask them what they think that that if you have
complete total coverage, you're just curious about their etch protection.
If you have complete insurance for theft, why would you
need it?

I would love to just hear what they say. I

(02:15:10):
three oh three seven one three talks seven one three,
eight two five five. So people, I want to describe
to you the you know dealers when they sell you vehicles.
There's the price of the vehicle. Then there's what they
call FNI Financing and insurance. But really what that department

(02:15:31):
means is they try to sell you financing or get
you arranged for financing from which they make money. Nothing
wrong with that. If you can beat your own financing,
do it. And then they do insurance. They try to
sell you insurance like credit life disability and add it
on insurance that helps you. And then over the years
they have added to the FNI department and it's become

(02:15:54):
what's called the added profit center. These added profit centers
add on to the car deal profit centers for the dealer.
One would be paint protection, fabric protection. And this new
thing this dealer etch excuse me, this windshield etching where
they etch a number on your windshield and it's supposed

(02:16:17):
to help you if your car is ever stolen to
locate your car.

Speaker 4 (02:16:23):
It's a bunch of crap. You don't need it. It's
total bs. You don't need it. What was it called
officially what did they call it?

Speaker 6 (02:16:33):
Theft etch, theft edge or let's see three fifty dollars?

Speaker 4 (02:16:39):
Can you believe that?

Speaker 5 (02:16:40):
So if you have insurance for theft, why would you
need it? In fact, some people would don't care if
they find their car a truck again, They just get another.

Speaker 3 (02:16:48):
One, especially in the case of this particular truck.

Speaker 5 (02:16:52):
You know, I'm telling you it's amazing what they do
to increase the deal. Now, the Credit Life is the
worst life insurance you can ever buy. Credit Life says,
if you die, the car will be paid off. Why
do you care about that? Tell me one reason you
would care about that? If you die, your state can

(02:17:15):
turn the car back. Who are they going to sue?

Speaker 4 (02:17:17):
No one? No one.

Speaker 6 (02:17:18):
You're dead, well presumable. I guess that depends on how
much you care. Oh and how much you want to
preserve for your heirs.

Speaker 5 (02:17:24):
If any they're not taking any mere state, they would
have to. They would have to repossess the car and
file deficiency judgment in the state.

Speaker 4 (02:17:34):
No one does that. Okay, credit cards don't. Then no
one does that. No one does that. It never happens.

Speaker 5 (02:17:39):
So if you have a car and you turn it
back to the dealer, is the dealer going to say, Okay,
we got the car back and try to sell it,
or are they going to pursue thousands of dollars in
litigation to try to get the.

Speaker 4 (02:17:48):
Balance from you. They're not going to pursue that. They're
not going to do it. Now.

Speaker 5 (02:17:53):
If you're rich, then that's a different story. But if
you're rich, you won't even buy a car from them.
So credit life is useless. It's useless. It doesn't protect
anyone from anything. Now they call it credit life and disability.
Credit life and disability. If you're disabled to make your payments.
The worst cost of insurance you can buy. You can
buy disability insurance straight up cheaper than the credit disability

(02:18:17):
that disability declines and coverage, yet you pay the same.

Speaker 4 (02:18:22):
It's the worst thing you can buy.

Speaker 5 (02:18:24):
There are so many things that they add on to
a car deal that are useless, And I'm telling you
this is one of the things you have to watch
out for.

Speaker 4 (02:18:32):
The f ANDI Department.

Speaker 5 (02:18:33):
It should be called the bend over and screwjob department,
because that's what they do. They take a bad deal
