Speaker 5 (02:09):
Hold on Tom, glad to be Let's go.

Speaker 4 (02:13):
Yeah, man, what brings up the call today?

Speaker 5 (02:17):
It's the fact that, uh, I believe and I have
the proof to show that CPS illegally took my daughter
from the hospital.

Speaker 1 (02:27):
Who is CPS. I'm not Colorado Protection, sir? Is it child? Oh?

Speaker 4 (02:31):
I'm sorry? Is Child Protective Services?

Speaker 1 (02:33):
Right? Yes?

Speaker 2 (02:35):
Sir?

Speaker 1 (02:36):
Oh, this is pretty serious. So let's start at the beginning.

Speaker 4 (02:40):
What happened?

Speaker 5 (02:42):
Well, basically, our child was born with something in her system.

Speaker 4 (02:49):
And now how old is your How old is your child?
Right now?

Speaker 5 (02:52):
She's about four and a half months old.

Speaker 4 (02:55):
Oh, So she's a little muffin.

Speaker 5 (02:59):
They picked it from the hospital.

Speaker 1 (03:01):
Now why was she was? She was born with what
kind of an issue?

Speaker 5 (03:06):
She had a substance in her system?

Speaker 1 (03:09):
Oh, you mean like drugs? Like drugs? So what were
you and the mom on drugs? Are you and the
mom doing drugs?

Speaker 5 (03:18):
We weren't living together? And you know it was a
struggle at the time.

Speaker 4 (03:25):
Do you think here's what I need to know?

Speaker 5 (03:27):
Yes, sir?

Speaker 1 (03:31):
Was uh.

Speaker 4 (03:36):
At the time? Was she doing drugs?

Speaker 1 (03:38):
She must have been, yes, And what was found in
her system?

Speaker 5 (03:44):
Meth amphetamine with.

Speaker 1 (03:46):
Meth And then at that time did they release the
daughter to the mom.

Speaker 5 (03:53):
We were there in the hospital with her for I
believe five days before.

Speaker 1 (03:58):
They So your infant was born with meth in her system.
She was taken after how many days?

Speaker 5 (04:07):
Five days?

Speaker 1 (04:09):
But not after birth, that was after birth. She was
taken after five days, yes, sir?

Speaker 4 (04:15):
And then what did you Where did she go?

Speaker 5 (04:18):
She went with the Child Protective Services and I placed
with a foster family.

Speaker 4 (04:25):
And then what happened?

Speaker 5 (04:27):
And now I'm having to jump through the hoops of
the CPS system and see her only six hours a
week basically, And now I'm coming to find out that
she could have a very serious skin disease.

Speaker 4 (04:43):
Okay, so she is. Now let me ask you something.

Speaker 1 (04:48):
Did the mom get charged with dependency and neglect?

Speaker 6 (04:53):
Yes, sir?

Speaker 4 (04:54):
And did you get charged with anything? No, sir, Now, I.

Speaker 5 (04:59):
Mean to get at the time you were, we were not?

Speaker 1 (05:03):
Okay, Okay. How long ago did the birth happen?

Speaker 5 (05:10):
It was on March twenty sixth of this year.

Speaker 4 (05:16):
Okay. And did you know the mom was doing meth?

Speaker 5 (05:22):
No, sir.

Speaker 1 (05:25):
Usually though, here's.

Speaker 7 (05:27):
The thing, so there was like no priors or anything
on the mother for drugs.

Speaker 1 (05:31):
This is Mark Major, Major, Mark Major, My wonderful but
not good looking co host, Go ahead, Mark, What did
you ask, sir?

Speaker 7 (05:41):
Well, I'm asking if she had any priors, I mean
period end of story. Did she ever get picked up
for meth or any other drugs before?

Speaker 1 (05:49):
Not?

Speaker 5 (05:50):
To my knowledge, No, we've been to I believe around
nine years.

Speaker 1 (05:54):
How bad is her habit? How bad does her habit?
Be honest with me?

Speaker 5 (05:59):
I mean now she's she's doing what she can get
her title back, and she's doing great, you know.

Speaker 1 (06:05):
Okay, you know there's a they say a four percent
success rate getting off of meth.

Speaker 4 (06:12):
Four percent.

Speaker 1 (06:14):
The other the other ninety six stay on meth until
they die. Wow, I think that was read. Now listen,
they should not hold anything against you as a biological dad.
In fact, they should open the way for you to
have visitation. So absolutely, okay, So what's going on with that?

Speaker 4 (06:37):
Did they take away your visit? Did they? Did they?
Are you charged or accused of anything?

Speaker 5 (06:44):
No, I'm actually taking it to trial right now to
prove it.

Speaker 1 (06:47):
But what do you That's what I want to know.
Why did they take away your rights?

Speaker 4 (06:51):
To begin with?

Speaker 1 (06:51):
You had nothing to do with the meth. So tell
me how that happened. The baby was taken and then
put in foster care?

Speaker 4 (06:59):
Hold on?

Speaker 1 (07:02):
And then and then you said I want to visit
my baby.

Speaker 5 (07:10):
Are you still there?

Speaker 4 (07:12):
I'm still here, bro go ahead.

Speaker 8 (07:14):
I think that out a little bit.

Speaker 5 (07:16):
But what had happened was at the hospital they gave
me a list of places so I could do a
UA to show that I was clean.

Speaker 4 (07:27):
Okay.

Speaker 5 (07:28):
The CPS lady sent it to me on the text
message and I could not read it, so I immediately
sent her back and I have all this on my phone.

Speaker 1 (07:36):
Okay, hold on, is the reason for being denied that
you're not supplying a UA.

Speaker 5 (07:43):
That's what they claimed that I missed one, yet I
didn't get the UA.

Speaker 1 (07:47):
Well okay, why then why don't you just go get
another one? If you did a UA? Right now? What
would they do with it?

Speaker 5 (07:54):
Absolutely? Like, I'm I'm on UA's now.

Speaker 1 (07:58):
But okay, So if you're on clean, you hold on.
If you're on clean uas now, yes, why won't they
take the most recent ones?

Speaker 4 (08:07):
Why would they go back to the one you missed?

Speaker 7 (08:10):
Well, that's the thing is like, wouldn't it be convenient
to miss one when you actually are hot?

Speaker 9 (08:18):
Yeah?

Speaker 1 (08:21):
Well, Casey, Casey, listen, here's what we're saying, Casey, here's
what we're saying. How many uas did you have since
the one you missed?

Speaker 5 (08:33):
Well, that's the thing. I never missed it because they
didn't send me the paper it till I don't care.

Speaker 1 (08:37):
I'm talking about the one they claimed you missed. How
many do you have after that?

Speaker 5 (08:46):
Uh?

Speaker 1 (08:47):
Several?

Speaker 8 (08:48):
Okay?

Speaker 1 (08:48):
Then why won't they just then? Why won't they give
you visitation based on the most recent UA?

Speaker 5 (08:54):
Well, I'm allowed to a visitor and I still have
parental rights.

Speaker 1 (08:58):
Then what okay?

Speaker 4 (08:59):
Then, what's the so you're you're not being denied visitation.

Speaker 1 (09:03):
I thought you said you are.

Speaker 5 (09:05):
I have visitation six hours every week and you want more. Well, yeah,
I don't believe they should have took her from me
because I did nothing wrong.

Speaker 1 (09:15):
Can you actually are you in a position right now?
Hold on? I'd like to know if you're in a
position to take her. Hang on, all of you. Hang on, Ron,

Speaker 7 (11:10):
Need to know is, This, tom wasn't there weren't you, Saying,
casey there's a pending case going on right now with.

Speaker 5 (11:16):
You, yes they tried to get me to do like
a plea type thing to say THAT i.

Speaker 4 (11:23):
Was that's my whole.

Speaker 7 (11:24):
POINT i don't care really what it's about until that Criminal,
casey until that criminal case is cleared. UP i don't
think that.

Speaker 1 (11:33):
Protective excuse, me we got to know what it. Is,
casey what were you charged with that they want you
to take a plea deal?

Speaker 4 (11:40):
On what were you charged?

Speaker 5 (11:41):
With, well they they wanted to have me plea to the,
neglect the same.

Speaker 1 (11:46):
Thing oh are they saying that you were part of
the dependency and neglect and their neg they're trying to
negotiate a plea.

Speaker 5 (11:55):
Agreement, yeah And i'm taking them to trial BECAUSE i
FEEL i.

Speaker 1 (11:59):
Was they're taking you to.

Speaker 7 (12:02):
Trial do you have an?

Speaker 5 (12:03):
Attorney i've got like a public defender type.

Speaker 10 (12:09):
One.

Speaker 4 (12:09):
Good, well you know, what then you're in good.

Speaker 1 (12:11):
Shape, uh, listen, seriously if you can't afford an, attorney
it's good you have. One BUT i need to ask
you what is the trial. About you are being charged
with dependency and neglect and you're pleading not.

Speaker 4 (12:24):
Guilty is that in a? Nutshell?

Speaker 2 (12:27):
Yes?

Speaker 7 (12:27):
Absolutely, Okay you're not gonna do anything WITH cps while
that's going. On AND i want you to think about,
something regardless if you're on meth or anything. Else, casey
the fact that a, kid a little kid you're in charge,
of had meth in his system and you're the. Guardian
that's not.

Speaker 4 (12:47):
Good but he wasn't living.

Speaker 1 (12:48):
There, Mark, YEAH i was not.

Speaker 7 (12:51):
There i'm just THEN i hate to go down this rabbit.

Speaker 1 (12:55):
Opens, YEAH i need to ask.

Speaker 4 (13:01):
This when do you go to?

Speaker 1 (13:02):
Trial?

Speaker 4 (13:04):
Yes when do you go to?

Speaker 5 (13:06):
Trial let ME i believe It's september first and.

Speaker 1 (13:12):
Second all, Right Now i'm going to ask another, question
because this happens in every.

Speaker 4 (13:17):
Call why are you calling us? Today i'm calling.

Speaker 5 (13:21):
To see IF i can get somewhat of some advice
from a lawyer about civil.

Speaker 4 (13:26):
Rights, well hold, on hold, on just a couple.

Speaker 1 (13:30):
Questions you said you have an, attorney, Right, yes he.

Speaker 5 (13:36):
DOES i asked him about the civil rights, thing and he,
like literally is not tell me what you?

Speaker 1 (13:40):
Mean tell me what you mean about civil? Rights just
tell me what you.

Speaker 5 (13:44):
MEAN i feel THAT i was wronged and lied to BY,
cps and my child as, well even though she's anything
can't defend. Herself tell me what.

Speaker 1 (13:56):
They did to. You But, casey get right to the.
Point what did they lie? About how did they violate
your civil?

Speaker 5 (14:02):
Rights they told me THAT i had missed THE, ua
BUT i hadn't received their information until The, Casey.

Speaker 1 (14:09):
Casey that has nothing to do with dependency and. Neglect
they said you missed.

Speaker 5 (14:14):
It that's why they took her they're, saying.

Speaker 1 (14:17):
Okay so in the very, beginning so THAT ua must
have been the very first one they.

Speaker 4 (14:22):
Wanted, yes and, okay.

Speaker 6 (14:24):
That they gave me was listen At.

Speaker 1 (14:27):
Casey you do not have to repeat yourself, again never.

Speaker 4 (14:31):
Again you, see here's the really. THING i need people to.

Speaker 1 (14:35):
Know when you tell me, SOMETHING i digest it OR
i ask about it. Again you're saying they never notified. You,
OKAY i get, it but that is not a civil rights. Issue,
okay you're barking up the wrong. Tree the bottom line
is you need to go to court with your attorney
and you need to simply tell the court you did

(14:56):
not get notice and you would have never missed and
you have had clean uas.

Speaker 4 (15:02):
Since that's, It honest to.

Speaker 1 (15:04):
God you know you're wasting a lot of time with
the civil rights. Thing no one will take your civil rights.
Case no, one, okay because you don't have. One I'm Tom,
martinez thanks for. Calling i'm going to go now to.

Speaker 4 (15:17):
Uh Ron. Ron what is going on with your air?
Conditioning thank, WELL i had.

Speaker 11 (15:25):

leak and who came to your?

Speaker 1 (15:34):
House to do a check.

Speaker 11 (15:35):
Up uh Who?

Speaker 10 (15:40):
Swan, Okay, now a lot of companies they do these
checkups because they do want to get, in and you,
know and the good companies want to get in and if.

Speaker 1 (15:50):
You need, work they'd love to do. It bad companies
make stuff. Up so you had you Had Swan plumbing
come in and what did they tell tell?

Speaker 11 (16:00):
You, well they went and did the angle check up
on my air, conditioner and they said THAT i had
lost the food and wasn't, working AND i was going
to need a new, one plus the fact that it
was fourteen years old and it would be cheaper to
get a new.

Speaker 7 (16:15):
ONE i smell a free second.

Speaker 1 (16:17):
Opinion, yeah but did you just tell me this? RON
i want to jump to. This did you have them replace?

Speaker 12 (16:24):
It?

Speaker 4 (16:24):
Yes that's a yes or?

Speaker 1 (16:25):
No no? Good where do you stand right? Now?

Speaker 11 (16:30):
OKAY i called. It let me back up.

Speaker 2 (16:34):
Just a bit on.

Speaker 11 (16:34):
That they gave me the price of air conditioning, unit
and OR i could go ahead and have a heat
sink put.

Speaker 13 (16:42):
In and, hey we put in heat sink.

Speaker 7 (16:48):
In hump.

Speaker 1 (16:51):
Changed, yeah it's a heat pump which reverse CYCLES ac
and heat right right right by the. Way he let
me just say something these are becoming very very popular these, Days,
Mark honest to, goodness they have efficiencies now that are
really top.

Speaker 4 (17:10):
Notch so what is your, Question? Ron, okay the question was.

Speaker 11 (17:15):
He gave me the price and my, Discounts SO i, said,
okay give me.

Speaker 2 (17:20):
That, Right i'm not going to.

Speaker 11 (17:21):
Remember give it to me an email center to. Me he, said,
Okay SO i SAID i need a second, opinion SO
i called it another. Guy he came.

Speaker 1 (17:30):
In who's the other guy you called?

Speaker 11 (17:32):
IN i don't even remember the name of the company.

Speaker 1 (17:35):
You should have. Called you, know Fix it twenty four
to seven has free second, opinions and that's who you should.

Speaker 4 (17:41):
Call what did the second guy tell?

Speaker 8 (17:42):
You, well he didn't even check.

Speaker 1 (17:47):
It the air.

Speaker 11 (17:49):
CONDITIONING i just told him that swance it wasn't, working
so he took the word for. It SO i told
him the swan, asked gave me a price for an
air conditioning unit and for a heat, exchange SO i
wanted to get to get a comparison price on what
their company would. Offer, well, okay the part of his
deal was was that they would sell me one of the,

(18:10):
units BUT i had.

Speaker 8 (18:11):
To buy a new.

Speaker 11 (18:13):
Furnace SINCE i don't.

Speaker 1 (18:15):
Okay what they're, Saying, well hold, on that's not entirely.
Wrong if they're going to do a new, ac it's
ridiculous to do it without putting in the.

Speaker 4 (18:24):
Furnace how old is your? System it was fourteen?

Speaker 11 (18:27):
Years?

Speaker 1 (18:28):
Okay and what kind is it that fourteen years? Is
on The some of them can last fifteen most of,
them if they're, good they're going to last twenty five
years or.

Speaker 4 (18:37):
More so what kind do you? Have i'm all, right
it doesn't.

Speaker 1 (18:43):
Matter, Hey, ron, Listen so did you have this other
company do any work for?

Speaker 11 (18:48):
You, no they didn't didn't do any work THAT i
didn't ask them do any. WORK i want them to
give me a prices et, cetera etcetera on the furnace
and the heat.

Speaker 1 (19:01):
Exchange and, well you wouldn't do if you did a,
furnace you wouldn't do a heat. Exchange you wouldn't do
a heat. Pump so, listen here's WHAT i need to.
Know what are you asking me? Today?

Speaker 11 (19:13):
Okay What i'm asking you is WHEN i talk to
both of the, companies they gave me different quotes on
and on IF i bought the heat exchange and the.
Furnace they gave me different prices on how much the
state gives me back for rebates and how much the
fans give me back and how Much right right gives me,

(19:35):
back and they were there was like four thousand dollars
differences and.

Speaker 6 (19:38):
Prices so, yeah.

Speaker 1 (19:39):
That you know.

Speaker 4 (19:40):
What here's there's a few reasons.

Speaker 1 (19:42):
Why first of, all to offer some of the, rebates
they have to be on an approved, list and some
of them may not be on an approved.

Speaker 4 (19:50):
List one of them might.

Speaker 1 (19:52):
Be the other reason is that they're misreading it or
they simply are not hip to. It so, on let's
just short circuits this whole. THING i want you to
call Fix it twenty four to. Seven they do free second.
Opinions and you, Say Tom martino told ME i need
to get a free second opinion.

Speaker 4 (20:13):
Or or or we'll just call them on the air for.

Speaker 1 (20:15):
You BUT i think you should call them seven to,
zero five, two six thirty, nine thirty. Nine, OKAY i promise.
YOU i know you want to tell me your, story
but right, now if you call Fix it for the
free second, opinion they'll take care of. You you can
call me back if you want or if you need

(20:35):
me to hook you up with. SOMEONE i might even
be able to do, that BUT i What i'd like
to do is for you to call first and just, say,
Look Tom martino, said free second, opinions And i'm getting
a couple stories, here AND.

Speaker 4 (20:50):

Speaker 6 (24:10):
On and they were to diagnose the timing chain.

Speaker 1 (24:18):
And, yeah they.

Speaker 6 (24:19):
Said they did all that and they said it's, now.

Speaker 1 (24:24):
Why did you need a diagnosis on your timing chain.

Speaker 6 (24:30):
Because it was ran on one of the, machines you,
know one of the machine to plug In, Tom.

Speaker 4 (24:37):
Okay got? It, okay it threw a. Code, so so

Wait wait, wait it's been there since it's been there Since, june.

Speaker 6 (24:51):
The end Of june.

Speaker 7 (24:53):
Early how much do you owe them for the? Diagnostics
did you pay them or you're not willing to pay?
Them shed some light on, it, Man, yeah go, ahead thank, You.

Speaker 6 (25:01):
MARK i think it was like one hundred and eighty
bucks for. THAT i haven't paid, that you, know until
after it was.

Speaker 1 (25:09):
Done, well hold, on What i'm saying is right, now
you got a, diagnosis it costs you one hundred and eighty.
Bucks you're willing to pay. It why can't you get your?
Buick we're not hearing something.

Speaker 6 (25:24):
She told me yesterday THAT i had to pay here
at three thousand and seven hundred.

Speaker 1 (25:29):
Dollars, wait whoa, wait whoa wait wait wait wait wait
wait well ho hold you we got to miss a
big part of the, Story. Eric when you took it
in there and they said you had, problems what did they?
Diagnose what did they actually? Diagnose what Did i'm not
asking what you had. Fixed i'm not asking what you agree.

(25:50):
WITH i am asking you when you took it in
in Late. June what did they say was wrong with?

Speaker 2 (25:57):
It?

Speaker 6 (26:00):
YES i needed a timing, chain.

Speaker 7 (26:04):
Well that would probably need an engine and what?

Speaker 1 (26:07):
Else?

Speaker 6 (26:07):
Yes what? Else Did as time went on they said
the engine was was was?

Speaker 8 (26:14):
Blown?

Speaker 6 (26:16):
Okay after they.

Speaker 1 (26:17):
Now did you did you drive it?

Speaker 6 (26:20):
IN i had a toned in?

Speaker 4 (26:22):
Sir, Okay so here's what. Happened, Okay, eric.

Speaker 1 (26:28):
Your chain broke and you have an engine that is called,
interference and it bent some. RODS i, KNOW i know
that's exactly what, happened don't you, Think? Mark ye that
buick and then therefore what happened was you are now
stuck with having you put in an. Engine but WHAT

(26:48):
i don't understand is. This did you give them authority
to do?

Speaker 15 (26:54):
That, no, sir.

Speaker 1 (26:58):
You never told them to do. It so what were
you going to junk the?

Speaker 6 (27:01):
CAR i was going To, NO i was going to
try to get another engine to get it done by somebody.

Speaker 9 (27:09):
Else.

Speaker 6 (27:11):
Because you have the, capacity they don't have the. Capacity S,
well they did.

Speaker 7 (27:15):
It, WELL i still don't understand what the issue. Is
are you barking over the one hundred and eighty, bucks
no market streets that they replaced his?

Speaker 1 (27:24):
Engine, oh he has an interference.

Speaker 4 (27:29):
Engine look, Look, ERIC i have no.

Speaker 1 (27:33):
Doubt that everything happened the.

Speaker 4 (27:35):
Way here's here's WHAT i here's WHAT i believe. Happened
in Late. June your timing chain broke your.

Speaker 1 (27:42):
Engine is. Interference it blew your. Engine you took it
in To you took it in To hotchkiss and they,
said if it needs a timing, chain it's going to
BE x amount of. Dollars then they said they called
you back and, said, no you need an, engine and
it's going to cost about this much. Money by the,

(28:02):
way that's cheap for an. ENGINE i don't know what
they did for three. Grand but but what then you're
claiming you never gave. Approval here's the, Deal, eric you
would have never gotten done.

Speaker 4 (28:13):
Cheaper, ever what did they?

Speaker 1 (28:15):
Do what did hold? On, okay they didn't. Do What
what did they tell? Me what they actually want to
get paid for.

Speaker 6 (28:25):
To get my car out?

Speaker 7 (28:26):
Unrepaired wait a, MINUTE i, Think, Tom, tom here's WHAT i.

Speaker 6 (28:31):
Think, now let's Call jasmine the show club right now
and she'll tell you exactly What i'm.

Speaker 1 (28:35):
Doing so, Wait, So, eric they said to you And,
Mark i'll let you. Finish but they said to, you
you have to pay us three thousand, dollars but we
did not do.

Speaker 6 (28:45):
Anything they didn't repair it at.

Speaker 1 (28:48):
All i'm asking, you what are they charging the three
thousand dollars.

Speaker 6 (28:55):
For to remove my car From?

Speaker 4 (28:59):
Hoshki why three thousand?

Speaker 6 (29:03):
Dollars three thousand and seven hundred dos some?

Speaker 4 (29:07):
Change, Okay, mark go, Ahead what do you think? Happened?

Speaker 7 (29:10):
WELL i, think first of, All, kelly we need to
call Up. POTCHKISS i know THESE i don't know the
owners or anything, personally BUT i know of the shop
and honestly they're pretty. Reputable let's see what they're. Saying
but IF i had to guess what he's, saying he
approved the timing, chain they put in the full bore timing,
chain the kit, did the labor did, whatever and then

(29:30):
found out it needed an, engine which it shouldn't have
been done that way as far As i'm. Concerned but
let's figure out what they're, saying because we got to
figure this.

Speaker 1 (29:39):
Out this is let's try to get them On let's
try to get them on the.

Speaker 4 (29:43):
Airs, okay we gotta do. That I'm Tom.

Two So eric claims that he took his car To

(30:56):
hotchkiss after a timing chain, broke and he said they
went ahead and diagnosed it for.

Speaker 4 (31:03):
One hundred and eighty.

Speaker 1 (31:04):
Bucks now he says they want three thousand dollars for
him to get his car, out and he says he
has no idea. Why he claims they did nothing except
diagnose a broken. Chain And cody is on with. Us
we appreciated from a. Kiss he's the general, Manager, cody

(31:27):
can you shed some light on, this?

Speaker 16 (31:29):
Sir, yeah, Absolutely. So this vehicle came into us after
either a friend or backyard mechanic had put timing chains
on the. Vehicle it came in, sputtering dying, out and
it was just running really. Poorly so he pulled it
in FOUND camac Creator bank one codes misfires on every

(31:52):
cylinder On bank. One we told them what we needed
to do is pull the time and, cover look underneath
there and see if we had a timing chain break
or if we had a cam actuator, failure what was going.
On once we got the time and cover, out which
on this vehicle does require removal of the engine dropping it,
down we found that the chain was off by nine.

(32:14):
Teeth now that's a that's a very big gap from
where it's supposed to. Be and what we were concerned
about is that it could need an. Engine and talking
to some gentlemen down At, buick they told, us that's
kind of a fifty to fifty. Shot you, could you,
know put timing chains on it and it might be,
okay but being off by nine teeth is really. Worrisome

(32:36):
so you should prep the customer that you might put
this all together with new chains and it might still
need an. Engine so at that time we kind of
hit the brakes and, said, hey you, know we should
probably put an engine in this just to be, safe
because we don't want you to be upside, down you,
know timing chains and everything and then still have an.

Speaker 4 (32:54):
Engine that's.

Speaker 16 (32:54):
Bad AND i think that that's where the frustration levels made.

Speaker 4 (32:57):
It so did he say go ahead and do the timing.

Speaker 1 (33:00):
Chain, yes, yeah he.

Speaker 16 (33:02):
Did ask us to pull this, well let me, say
let me pull back from.

Speaker 8 (33:05):
There, no he.

Speaker 16 (33:06):
Didn't he asked us to pull everything. Apart so he
did it request to drop the engine, down pull the covers,
off and see exactly what was going on in said.

Speaker 1 (33:15):
There and so that's where you. Are what point are
you at right?

Speaker 4 (33:20):
Now so we.

Speaker 16 (33:22):
Had we waited for about three four weeks for a
response on what we were going to. Do we actually
had the car down in the bay because it was
just sitting on the cradle.

Speaker 1 (33:35):
With the car up in the.

Speaker 16 (33:36):
Air so we just kind of waited to see what
he wanted to. Do and then he said he was
going to have that same mechanic or maybe a different.
One i'm not one hundred percent sure on, that you,
know put it. Together so we asked, him do you
want us to just to bolt it back up into
place or do you want us to put it back?
Together and so he asked us to kind of put

(33:56):
everything back up together so that the car could be
towed away and taking the southern. Mechanics so what we
have is we've got basically ENGINE r AND r and
timing chain or time and cover labor to try to
pull us all apart and put it all back.

Speaker 1 (34:13):
Together what that makes absolute complete sense to, me and
that IS I i it makes complete. Sense eric's story
has all kinds of holes in. It he said he
took it.

Speaker 4 (34:27):
In he didn't or.

Speaker 1 (34:28):
Never mentioned his friend or a backyard mechanic tried to
do it and screwed it. Up he never mentioned that
he ran that that that that it was nineteeth.

Speaker 4 (34:37):
Off he never mentioned.

Speaker 1 (34:39):
That he did say that you said it would need
a timing chane or an Engine, listen this is really,
unfortunate AND i can see exactly why you're charging for your. Time,
uh for, SURE i can. SEE i don't know where
we go.

Speaker 4 (34:55):
From, Here, Eric, UH i don't.

Speaker 1 (34:58):
Think he wants to pay the three grand he says for.
Nothing did you guys put it all back? Together or
is it still at least a? Part it would be
better if it was a. Part is it together or?

Speaker 16 (35:08):
Apart so as of right, now we've put the, cradle
bolted everything back up into the. CAR i would have
to go check with the technician to see exactly how
far you have to put this thing together to make it.

Speaker 7 (35:21):
Mobile, hey real, quick BECAUSE i hear the, MUSIC i
want to ask you some to. Clarify, basically the thirty
seven hundred is for tear down and inspection of the timing.

Speaker 16 (35:32):
Chain, yeah so, well not say, that but also doing
compression testing on the.

Speaker 4 (35:38):
CYLINDERS i, mean it.

Speaker 1 (35:39):
Was a lot of time they had to take the
whole engine. Out so, listen we're done with. This i'm, Sorry,
eric we can't help. You i'm, Sorry, okay we just

Speaker 1 (37:06):
To phil, now who wants problems with a lightning? Strike,
Phil what the heck? Happened you're In franktown.

Speaker 4 (37:13):
Area what? Happened with, lightning and how can we help?

Speaker 17 (37:16):
You, well did you see the pictures THAT i sent?

Speaker 10 (37:19):
You?

Speaker 1 (37:22):
YES i, Did, YES i.

Speaker 4 (37:24):
Did it was just.

Speaker 17 (37:26):
A strike the. Boy it went a quarter mile to
the northwest of us along the ground and hit another
house and blew up his electric t fench controller and
he put the pictures on next.

Speaker 4 (37:37):
Door BUT i know it's, Crazy it's just.

Speaker 17 (37:40):
Crazy it shook the house big. Time but it looks
like it, burned probably fried and melted the seed line
from the house to the. Barn And i'd send email
them to you guys. Yesterday mark, responded and thanks For
william and sons that come out and take a, look
because it's going to have to be. Replaced but the
big thing is we get an inspection of the house,

(38:00):
ourselves checking all the, outlets and we found a couple
of little black puffs of burn marks on some of the,
outlets so you know it went through the house.

Speaker 8 (38:09):
Too pretty.

Speaker 7 (38:10):
Good you got to have, Them you got to have
the electrician look at all that. Stuff big, time, man
that could. Be you don't want to miss that stuff
in this.

Speaker 17 (38:18):
Claim, No and that's one of the reasons THAT i
called also to tell everybody if they think they got
a lightning. Strike they really need to do that because
it really GOT i mean it want a quarter mile
to another guy's house on the ground and got him
from from our. Barn so we're, lucky.

Speaker 1 (38:33):
But you sure.

Speaker 4 (38:34):
ARE i, mean so what are you calling about? Today?
NOW i Know mark gave you a referral to an.

Speaker 17 (38:42):
ELECTRICIAN i want to thank you for him for, that
but also to tell everybody out, there if you think
he had a lightning, strikeer Like mark, said better take
a good look and get somebody to look at it
because there's some hitt and. Damage i'm sure of.

Speaker 1 (38:56):
That and you know WHAT i heard about a lightning,
strike which is. Weird it can go and it can
selectively knock stuff out on a, circuit but not necessarily.
Everything it like, hops skips and. Jumps but it.

Speaker 17 (39:12):
Did the lights dim and when the when the strike,
hit and then they came right back on. Again and
THEN i heard that loud pop and it was the
searcher breaker that got fried to the, barn which they
need to want them to look at.

Speaker 7 (39:24):
IT i, KNOW i wonder how they even how does
an insurance company look at? THAT i mean like it
sounds to me if he's got some outlets in his
house where he's seeing, issues but other ones Are, okay
how would you possibly trace down the actual? WIRES i,
mean is there a?

Speaker 1 (39:41):
Reason, yes there. Are there are circuit testers that will
take you from the point of origin to the first,
break then you then you connect to the sensor to
that one and takes it to the next.

Speaker 4 (39:53):
Break you have to do it progressively like.

Speaker 1 (39:55):
That there's not one that goes at the beginning and
then goes through the whole circuit and comes back with
the faults because it's stopped by a. Short so when
it gets to the, short then you go to the
short and do the next phase of that. Circuit so
if it's a big, circuit you might have to do
it three. Times that's how THOSE i have one of,

(40:16):
them and they worked really really.

Speaker 7 (40:18):
Well all the gfi's trip or.

Speaker 17 (40:21):
No only the one it was A gfi breaker to the.
Barn every other one we have three. Subpanels none of them.
Trip there's probably another SIX tfi breakers that did not.

Speaker 1 (40:32):
Trip, yeah you're right about it being. Sneaky you need
a complete AND i mean an absolute complete electrical.

Speaker 4 (40:40):
Inspection we know.

Speaker 17 (40:43):
That AND i KNOW i just don't know How like
you said that they can without it if it's a complete,
circuit even though it shows a. Burnmark you, know how
can they check?

Speaker 1 (40:51):
That, well they just the WAY i told. You they
Put they put these these toners or these amperage, checks
or they could be, unperage or it could even be simple.
Continuity whatever they, do this machine does it and they
send it out on each. Circuit so they have to

(41:11):
do each circuit and when they come to the first
short or first bad, spot they go to that spot
and do it from there, onward and they do it
until they get to the end of the.

Speaker 4 (41:23):
Circuit this it's going to be.

Speaker 17 (41:26):
Interesting i'm going to get a couple of contractors look
at it because you, know but you.

Speaker 1 (41:30):
Need to Do there are a lot of people that
aren't thorough in their actual. Inspections they do great, work
but they don't they're not necessarily. Troubleshooters you need someone
who will really take the time and you need a
complete electrical. Inspection in, fact you should tell, Them, LOOK

(41:50):
i have a lightning strike And i've had damages throughout my,
house but it, hopped skipped and. Jumped need to identify
the bad. Spots and fix. Them that's what you tell.
Them then they know what they're in. For some electricians will,
say you know, what we don't really do that NOW
i know. THAT i know that there were two companies

(42:13):
THAT i had in The denver metro. AREA i think
they go To franktown that absolutely used to advertise electrical.
Inspections one was Plumb Line services, plumbing, heating, cooling, electric and.
Drains and then the other one was fixed at twenty
four to seven also, heating, cooling, electric and. Drains and
they and they absolutely and plumbing and they absolutely have

(42:34):
the electrical equipment to do all of your. Inspections, so
and who, knows after WHAT i just talked, about it
might be there just might be better equipment out, there
for goodness. Sakes so.

Speaker 4 (42:52):
It's a couple of.

Speaker 1 (42:53):
Call but As mark, said hold, on make sure you
do that thoroughly if you're putting in an insurance.

Speaker 7 (43:01):
Claim, yeah and when you talk to your insurance company
when the electrician comes, out if they say something like,
hey this is going to take you, know a couple
thousand bucks to diagnose or, whatever make sure the insurance
company's on. Board and if they're not Called paragon and
he'll get them to pay for whatever they should be.

Speaker 1 (43:19):
Paying, Now, well, okay go, ahead go. Ahead what were
you going to?

Speaker 17 (43:24):
Say it sounds like it sounds like the insurance insurance
company will pay for, it and it's dan up to
a good amount of money for repayers.

Speaker 1 (43:31):
Too who is Your?

Speaker 4 (43:33):
Phil who is your? Carrier your? Insurance?

Speaker 2 (43:37):

Speaker 17 (44:04):
Happened in the house about twenty five yards from the?

Speaker 4 (44:08):
Barn? Now did you hear or see anything in your?

Speaker 17 (44:12):
HOUSE i heard that circuit breaker, trick which you shouldn't
be able to hear it in another couple rooms. Away
it was so loud when it clicked, off and it
was a weird.

Speaker 1 (44:23):
Noise it was a pop heard? Something it was a?

Speaker 7 (44:26):
Pop, YEAH i HAD i had plumb line listen to.
THIS i don't think they do it at this price,
anymore but they ran as. Special maybe we can Bug
bob to do it. Again but they came out years
ago and put in a whole house circuit breaker right
on my main panel before the subs the entry point
and back in the, day well the day was only

(44:47):
five years. Ago it was two hundred dollars total, price.

Speaker 1 (44:51):
Oh, mark and then they were doing the whole. House
remember the whole house surge protectors would do about the.

Speaker 4 (44:57):
Same. Yep, So, phil another thing you need.

Speaker 1 (45:02):
To check in addition to the, circuits things that were
plugged in to those.

Speaker 17 (45:08):
Circuits, yes we've been testing everything in good, point including
in the, barn to make sure that wasn't the problem
and everything is. Working it was plugged in the, barn
in in the.

Speaker 4 (45:18):

on with? O'Reilly is there anything new in that? Case,
no there's.

Speaker 18 (47:03):
NOT i JUST i don't know.

Speaker 1 (47:05):
Something was somebody working with you on? This i'm looking
for your original. Call let me look for, this. Sir
was anyone working with? You was this a let's see
when let's go over?

Speaker 4 (47:16):
There it? Is hold, On so go ahead and tell
me where we left. Off we left.

Speaker 8 (47:21):
OFF i was supposed to talk to an.

Speaker 18 (47:22):
EXTRA i think you were going to get the guy
From Honest accurate to talk to AND i think he was.
Busy so.

Speaker 1 (47:27):
Okay so you bought A cv axle correct from O'Reilly
Auto parts In, november but it was twenty twenty, four,
okay Last. November you say the part was. Faulty the
repair bill was five thousand. Bucks you contacted the stores
district manager and the manufacturer said it was improper. Installation

(47:52):
it was not an improper, part now that's. What so
if it was an improper, installation who installed it for?

Speaker 6 (48:02):
You SO i.

Speaker 18 (48:05):
Originally installed it and then the problem. Occurred so THEN
i took it To Honest accurate and they installed it
again and it caused the same. Issue, actually did it
three times before, That so there is so, honest, accurate
honest accurate is saying it is not the, installation, correct
honest accurate says that it's the.

Speaker 4 (48:26):
Part and that's where you stand right. Now why don't
you go to small claim scort on this with that?

Speaker 18 (48:33):
Information, WELL i was working with that district manager and
thought that he might actually do, something and turns out he.
Didn't SO i don't really know that, process and that's
WHY i called, you.

Speaker 4 (48:46):
Guys kmark tell him what to?

Speaker 7 (48:47):
Do, well Small claim, Score BUT i think it's going
to be an uphill battle trying to prove you better
have a good witness that's going to.

Speaker 1 (48:55):
Sell he's got, honest he's got, honest accurate auto who
tried who installed it three different times and said the
part is.

Speaker 7 (49:02):
Faulty, yeah that's. Crazy, yeah take him the small claim?
Squirt what else are you?

Speaker 1 (49:08):
Going so if it's O'Reilly auto, parts what would he
do In Colorado?

Speaker 7 (49:13):
Springs, WELL i would choose whatever story you bought it.
From i'm sure it's all going to be the same
county if It's Colorado. Springs and then basically you fill
out the PaperWorks fifty five bucks and that's all there
is to. It and, honestly how much are you? Seeking
what's the?

Speaker 1 (49:28):
Total it? Was the repair bill was fifty one, dollars right, Man.

Speaker 18 (49:34):
Yeah it's fifty One.

Speaker 7 (49:37):
Yeah but why would they be responsible for?

Speaker 1 (49:39):
Everything, well because the part was, bad which caused him
to have to get it.

Speaker 4 (49:44):
Repaired how much was the?

Speaker 7 (49:47):
Part wait a, minute wasn't the vehicle THE cv joint
must have been screwed up to begin?

Speaker 2 (49:52):
With?

Speaker 1 (49:53):
Yeah, yeah how? Much how much was the NEW cv axle.

Speaker 18 (49:58):
So O'riley's it was around like two hundred and forty eight?

Speaker 4 (50:02):
Dollars, oh wait a, minute that's What?

Speaker 1 (50:05):
Wait two hundred and forty eight dollars is all you
paid for?

Speaker 18 (50:09):
That for the for just the part the Part Honest
accurate put a different brand. In it was three hundred
and eighty one dollars From Honest.

Speaker 1 (50:18):
Action.

Speaker 4 (50:18):
Yeah but But mark has a.

Speaker 1 (50:20):
Point are you're saying that the two hundred and forty
eight dollar part cost five thousand dollars in?

Speaker 4 (50:28):
Damages that's.

Speaker 18 (50:30):
Correct it was machine, incorrectly so it tore up the
inside of the transfer case is the.

Speaker 4 (50:34):
Problem So, mark do you buy?

Speaker 7 (50:37):
That, well that's WHAT i. Said you better have a good.
WITNESS i, mean the witness is going to come. Down
the other THING i didn't think about when you BUY
i guess you don't sign any kind of agreement with
O'Reilly when you buy parts from. Them So i'm gonna
forget about WHAT i was. Thinking but it's going to
be a tough uphill to convince them that this part

(50:57):
created five thousand dollars in.

Speaker 4 (50:59):
Damage he said it tore up the. Inside how did.

Speaker 7 (51:04):
It let's get, honest, like you know What i'd like to.
Do i'd like to hear from honest accurate on. This
let's get them.

Speaker 4 (51:09):
On, yeah that's.

Speaker 7 (51:11):
Good i'd like to hear their. Thoughts they're saying it was. Mismachined, well,
okay if, O'Reilly who sells AND i think every state
are close to, IT i, mean this should be a
big deal if They're if they're mismachining A cv, joint
we would hear this all over the, place wouldn't.

Speaker 1 (51:28):
We, well maybe it was JUST i don't, Know maybe
it was just that one. PART i don't, Know but
let's get let's get On jesse From.

Speaker 4 (51:38):
Honest accurate to talk about, this and.

Speaker 7 (51:42):
Lets be willing to come in and literally say that
could that? Damage for, example And i'm asking the caller right,
now the damage has five thousand. Dollars you're old one that.
Broke how do we know? That wasn't the? Culprit?

Speaker 10 (51:57):
Sure?

Speaker 4 (51:57):
So in other, words was it screwed up before or was.

Speaker 1 (52:00):
That transfer case screwed up before he put.

Speaker 4 (52:03):
The new one? ON i mean the new.

Speaker 18 (52:06):
Axle, no the reason it was replaced because the axles
separated at the, Knuckle so there was nothing inside the
transfer case that was an issue prior to.

Speaker 7 (52:15):
This you know, what here's the other. One let's Ask Jeff.
Vick if we can't get honest on right, around let's
Ask jeff what kind of damage that would do to?
Me it's crazy because it seems like a transfer case
for that. Vehicle is that basically what they ended up,
doing the transfer?

Speaker 18 (52:34):
Case so they ended up taking it out and resealing
it because the sharp edge on THAT cb exle From
a'reiley's just ripped through all of the seals in.

Speaker 7 (52:43):
There let's Get Jeff fick's opinion on, this a total outside,
Opinion Tom.

Speaker 1 (52:49):
Okay but Then i'd also like honest accord to see
if they actually had that. Information, Absolutely, yeah let's do
Both Jeff vick and honest accord all and if you
can Get kaschina to put down the, mimosa she might
be able to do. That, julie what's going on with identity?

Speaker 4 (53:11):
Theft, julie that is really.

Speaker 7 (53:15):
Bad someone stole.

Speaker 2 (58:36):
Did?

Speaker 8 (58:36):
OKAY i did the pickwork in the metro to switch
over then for the, phone and they're. Not that NIGHT
i started thinking about it because they were telling ME
i care about like one hundred bucks a little bit,
left and the price would have went up because you
got paid for the. Phone you're stuck.

Speaker 4 (58:57):
In that's why they're doing.

Speaker 1 (58:59):
It they want to get you in a. Program they
want to get you on a. Contract, yep.

Speaker 8 (59:04):
Yeap BASICALLY i start thinking about. It they say they're
gonna find.

Speaker 1 (59:08):
Them there's nothing wrong with. It if you like, there
if you like the, Network Team mobile is a pretty good.

Speaker 4 (59:13):
Network why are you having second?

Speaker 1 (59:15):
Thoughts?

Speaker 8 (59:17):
No the second thought is the money, wise AND i
started being agh, like NOW i DON'T i don't want
to switch, over so uh, Uh so they'll they send the,
uh the phone to the ups and you cold signed for.
It so they set the phone to me and the,
guy uh and the. GUY i think it was the

(59:37):
twentieth of a couple of months. Ago, uh they sent
me a cap and a guy and THE ups. GUY
i never signed for the, phone SO i, said, NOW
i almost send the phone. Back SO i went to
THE ups store AND i set it back AND i called, them, said,
Uh i'm gonna stay with My. Metro i'm gonna stay
with My. METRO i didn't.

Speaker 2 (59:57):
Sign, NO i.

DIDN'T i didn't activate the phone or. NOTHING i even
open up the. BUM i just sent it back back to.
HIM i, DON'T i. DON'T i don't need, IT i
don't want.

Speaker 1 (01:00:06):
It, uh but you first said hold, on you first
said on the recorded line that you wanted.

Speaker 8 (01:00:12):
It, NO i, thought, no, no not only for.

Speaker 1 (01:00:17):
So why did they send you a? Phone if you,
never if you never ever ever agreed to this, promotion
you're telling me that they just out of the blue
sent you a free.

Speaker 8 (01:00:27):
Phone, no, no, no, no hold hold.

Speaker 2 (01:00:30):
UP i did.

Speaker 8 (01:00:31):
THIS i did WHEN i did the, PAPERWORK i did
it there And messroll got it And. MESRO i did the.
PAPERWORK i did the paperwork with the guy At, metro
AND i had to call them and THEN, i, uh
and NOW i decided about the.

Speaker 1 (01:00:43):
DAY i get.

Speaker 4 (01:00:44):
IT i get, It, okay.

Speaker 8 (01:00:46):
Activated you got to actually. ACTIVATED i get.

Speaker 1 (01:00:49):
It uh so you change bottom line is bottom line
is you changed your. Mind so what's going on?

Speaker 8 (01:00:57):
Now SO i shaved my mind us and noddn't want,
so and now start getting these texts to stand. That,
UH i OLD i canceled it, out AND i old
them they got the phone. BACK i canceled it, out
AND i owe them Money on the, line they give
you two dummy lines ahead of, time like three or?

Speaker 4 (01:01:16):
Three how much do they say you? Owe like how
much to? Stated how much do they say you?

Speaker 8 (01:01:23):
Owe they say at the time for those other, lines
it was like three hundred and.

Speaker 1 (01:01:28):
Something wait a, Minute so to change your mind and to,
cancel they're charging you three hundred three, Hundred, yeah for.

Speaker 8 (01:01:36):
Three hundred dummy line FOR i don't want TO i
don't even want the SERVICE I Wantubert.

Speaker 1 (01:01:42):
Cubert you never have to tell me again you don't
want the. Service we get that part of. It now
we're going to the next part in order to. Cancel
they want they literally want money from, you, Right they
want you to. Pay they're allowing you to stay With
Metro mobile, prepaid but they want you to pay three

(01:02:03):
hundred to get out of that other.

Speaker 4 (01:02:05):
Contract is that?

Speaker 8 (01:02:06):
Correct, yeah basically to get out of that, concept which
WHICH i. DID i never activated the.

Speaker 1 (01:02:12):
PHONE i know you never activated, it AND i know
you don't want, It, OKAY i know that you told
us that ten. TIMES i want to know if what
they want for you to do that is three hundred dollars.

Speaker 8 (01:02:28):
Three, dollars that's that's just one part of.

Speaker 13 (01:02:31):
It that's just what's the other PART i talked?

Speaker 8 (01:02:33):
To SO i talked to a lady. There DID i
had to go to, actually uh The Team mobile, store
did you? Right they, SAID i had the contact of
representative From Team right to get it, right square it.
Away SO i talked to some ladies who said, that,
yeah WILL i HAD i had a call about three
or four times right to get that off. There these

(01:02:54):
are Through gammy line AND i never activated.

Speaker 1 (01:02:57):
And you never used, him and you never approved, them
and you did didn't want, it and you changed your.
Mind get to the point they want three hundred. Dollars
that was the first. Part what's the second? Part the second.

Speaker 8 (01:03:09):
Part about like this WEEK i GOT i kept getting
these technics from this debt, collector so let me call
this depth. Collective SO i thought it was squared. Away
SO i called it and they said THAT i owed
one hundred somethings FROM i, said what discu what was it?
For they said it was routeam boat uh routine Bobil

(01:03:31):
AND i thought we squared it.

Speaker 1 (01:03:32):
Away, now when you let me ask you, This, hubert
this is. Important when you thought you squared it, away
did they agree to take away that three hundred dollars?
Charge oh, yeah, yeah, okay good square away?

Speaker 8 (01:03:46):
You, yeah you. Didn't you didn't activate the. Phone you got, it.

Speaker 1 (01:03:51):
And you didn't approve. It and you didn't want the
two dummy. Lines you never activated. THEM i get. It
so what did the debt collector say that one hundred
dollars is?

Speaker 8 (01:03:59):
For they said one hundred dollars and for of the
phone and uh uh some type of charge and they,
said uh AND i got a text on, there just
forgot to tell. YOU i got a text on them
saying that the phone was. Damaged they we won't send it.

Speaker 20 (01:04:14):
BACK i.

Speaker 1 (01:04:14):
Haven't, okay that's a whole different. Ballgame so are they
saying they want one hundred dollars because the phone was?

Speaker 8 (01:04:21):
DAMAGED i think they they want something out of the
deal because they didn't get me To, uh, well.

Speaker 1 (01:04:29):
What are they? What why are they? Saying? HUBERT i
got one. Question we don't have to go over one
fact in the. Past one question right? Now what do
they say the one hundred dollars is?

Speaker 8 (01:04:43):
Four Uh i'm thinking for the, phone probably for the phone.
Damage what they can get out of.

Speaker 1 (01:04:49):
It, okay now it was, damaged but you never you
never even opened the package on that.

Speaker 4 (01:04:55):
Phone, NOW i.

Speaker 8 (01:04:57):
Said a straight back AND i went straight back to
my ups on a at the back banana want?

Speaker 1 (01:05:01):
It?

Speaker 4 (01:05:02):
Then how can they say you damaged?

Speaker 8 (01:05:03):
IT i don't. KNOW i mean you got some themo about.
THAT i had no.

Speaker 1 (01:05:09):
Idea, okay NOW i know exactly the. Problem you you
changed your, mind sent the phone. Back now they're saying
you owe one hundred dollars because the phone was.

Speaker 4 (01:05:21):
Damaged it all comes down.

Speaker 1 (01:05:23):
To, That Deputy. Doc do you think you can get
Through believe, me you don't have to give any of
these other.

Speaker 4 (01:05:29):
Details he simply sent the phone.

Speaker 1 (01:05:32):
Back they reversed the three hundred dollars in, charges but
now they want one hundred dollars because they say the
returned phone was. Damaged Deputy, doc are you? There i'm.
Here do you think you can make a call to
them and figure out what that damage?

Speaker 21 (01:05:50):

Is fifteen percent of it he's going to.

Speaker 1 (01:08:59):
Get because personally it was last. Year after about three
or four, years diminish value goes.

Speaker 4 (01:09:05):
Away but that's just.

Speaker 1 (01:09:06):
My personal opinion and What i've seen in the. Past
let's just say he does get diminished value of three. Grand,
okay so now three plus one is Four so for four,
grand is it worth hiring attorney which is going to
cost about three or four grand because they literally have
to take file a lawsuit and then file subpoenas for, that.

Speaker 7 (01:09:26):
Which i'd serve him in small claims court for the
four thousand dollars using your.

Speaker 4 (01:09:31):
Numbers he can't find.

Speaker 7 (01:09:33):
Them if he can find, Them that's that's WHAT i.
Said he's sure to find.

Speaker 1 (01:09:37):
Him, yeah, So, PATRICK i don't know what to tell, you.
Man there's no magic. HERE i, mean if no one
can find him in small claims, court can he subpoena
the insurance?

Speaker 4 (01:09:52):
Company, no BUT.

Speaker 7 (01:09:54):
I don't think he'd have. To whoever he finds would
turn it over to their insurance.

Speaker 1 (01:10:00):
If he can find him and he knows he's insured By. Geiko,
no not in small Claims no.

Speaker 4 (01:10:06):
WAY i don't think so.

Happened, Well Ryna, Mercedes.

Speaker 19 (01:13:00):
Tom it's very difficult to, imagine because it turns Out
rick never even bought a lottery. Ticket so So i'm
curious to. SEE i did send an email to both
Wheat Rich police and The DENVER fbi office to let
him know that we're meeting TWO fbi agent, impersonators And
i'm wondering if one or two of these agencies would
like to join us at the meeting. TOMORROW i sent
them the address the.

Speaker 4 (01:13:21):

Speaker 1 (01:13:21):

said make a double or. NOVELIN i never agreed to.

Speaker 7 (01:13:41):
That SO i remember WHEN i remember When tom Said
trump could never ever possibly win the last.

Speaker 1 (01:13:50):
Election, yeah that's. TRUE i didn't think he. Could, no, no,
no that was the first, time not the second. Time oh, no, no, no,
no the second. TIME i knew he was going to get.

Speaker 4 (01:14:00):
In oh, lord oh come, ON i knew he was
going to Beat.

Speaker 1 (01:14:03):
Biden and then at the last minute when they threw
In Kamala.

Speaker 4 (01:14:06):
Harris what are you kidding? ME i never said he couldn't.

Speaker 1 (01:14:09):
Win not why you're saying. This not once DID i
say he could not Beat Kamela.

Speaker 4 (01:14:16):
HARRIS i never say. THAT i did they say that
the first time he ran Against.

Speaker 1 (01:14:21):
HILLARY i did say.

Speaker 5 (01:14:23):
That.

Speaker 1 (01:14:25):
MARK i don't care what you think you. HEARD i
have never once said during his re election when he
was going Against biden and Then, KAMELA i have never
once said he could not.

Speaker 4 (01:14:37):
Win never ONCE i knew he was going to.

Speaker 1 (01:14:39):
Win people were so disgusted with what The democrats were.
Doing but the first time, Around you're absolutely. RIGHT i
didn't think there was a snowballs chance in hell he
would ever be. PRESIDENT i DIDN'T i remember that three
oh three seven one THREE a two five Five corey
wants to talk about A kabella's.

Speaker 4 (01:14:59):
Vote, hey what do you know about? This Did corey
already call in?

Speaker 1 (01:15:02):
Once?

Speaker 7 (01:15:03):
Yeah So suzanne reached out to pr there and within
a couple hours they reached out and picked up his,
boat or at least picked it. Up let's talk to
him retail, Location.

Speaker 1 (01:15:15):
Corey what's.

Speaker 4 (01:15:15):
Happening hey, there how's it going?

Speaker 1 (01:15:18):
Today? Good what's going on with? You?

Speaker 23 (01:15:21):
Man, well you, know SO i got this boat thing going.
ON i bought a, boat and.

Speaker 1 (01:15:26):
Now you bought the. Boat you bought the boat From
cubella's and you wanted to return.

Speaker 23 (01:15:31):
It, well basically they want to take it back to
the factory to.

Speaker 4 (01:15:37):
Do some repairs on. IT i under, warranty in other,
words under.

Speaker 23 (01:15:42):
Warranty so, Yeah i've got sixty thousand dollars sitting in
this boat That i've had no use basically all summer
because of. Problems oh that's the. Dealer about Early, june we, said,
okay let's send it to the. Factory All, june they
did their, scheduling whatever they needed to. Do they, said,
okay first Of, july drop it off at the dealer
to be picked. Up it sat at the dealer for

(01:16:02):
the entire month Of. July they finally picked it up Last.
Friday now that's been a week AND i haven't heard anything.
Again So i'm just basically without a. Boat THAT, i you,
know paid for to use and. Enjoy AND i haven't
had a boat this.

Speaker 1 (01:16:16):
Year did they send your boat to the?

Speaker 4 (01:16:19):
Factory the boat.

Speaker 23 (01:16:21):
Was picked up Last thursday afternoon to return to the
factory for.

Speaker 1 (01:16:25):
Repairs, okay now would you rather that they? So do
you want them to give you a new boat or
not give? You but you, know exchange for a new
boat At. Cabella's that would be the ideal.

Speaker 23 (01:16:36):
Situation AND i mean a refound would be, great BUT
i know that won't. Happen but, yeah in exchange of
just give me the equal.

Speaker 1 (01:16:42):
Equivalent now do you Acknowledge suzanne's the one that got
the ball rolling to get it to the.

Speaker 4 (01:16:46):
Factory how long do they say it's going to?

Speaker 23 (01:16:48):
BE i GUESS i had worked With cabela's to get
this to the, factory and there's no. Timeline WHAT i
hear from people say both of the factory the factory
told me. Months So i'm probably looking at six, months eight,
months nine months BEFORE i See i'll be lucky to
see it for next year's.

Speaker 1 (01:17:07):
Opener for sixty thousand. Dollars you're, right you should be
able To did you just Ask? Cabella's CAN i exchange
it for another.

Speaker 23 (01:17:17):
Boat, absolutely what did they, say, Follower we have to
follow our warranty, process and that, involves you, know taking
it to the, dealer letting them try to fix, it
which they, couldn't and the next step is to send
it back to the. Factory so they basically send a
semi to pick the boat, up they haul it to the,
factory they assess, it they repair, it and then they

(01:17:38):
get it back to me and whatever they consider a timely,
manner which isn't.

Speaker 4 (01:17:42):
WHAT i can. Say you, Know, listen here's the.

Speaker 1 (01:17:45):
Deal we have had hundreds of cases over the years
of warranties not being done in a timely. Fashion AND
i can't think of but maybe one or two times
that the retail establishment stepped up and, said you shouldn't
have to. Wait we will resell. It, meanwhile let's exchange.

(01:18:09):
It and that's only happened a couple of.

Speaker 4 (01:18:11):
Times. NOW i don't know what common law is on.
THIS i don't know what it.

Speaker 1 (01:18:18):
Is in other, words we know there are no statutes on,
this but what about common? Law have people ever sued
for not having their boat for a couple seasons due
to factory warranties and have courts ever granted them a new.

Speaker 4 (01:18:38):
Boat have you ever happened to look that?

Speaker 7 (01:18:40):
UP i think you'd have to look at the purchase,
agreements see what he agreed.

Speaker 1 (01:18:44):
To, yeah that's a good.

Speaker 4 (01:18:46):
Point did you? Sign what did you?

Speaker 1 (01:18:48):
Sign did you look over your purchase agreement about exchanges or?

Speaker 4 (01:18:51):
REFUNDS i did not look for.

Speaker 23 (01:18:55):
THAT i assume that's the warranty THAT i signed and basically, stated.

Speaker 4 (01:19:00):
Well you don't actually actually we don't know.

Speaker 1 (01:19:03):
THAT i mean you may. NOT i don't know if
they always say that in THEIR i don't.

Speaker 23 (01:19:10):
KNOW i would have to go through the fine print
to learn.

Speaker 4 (01:19:16):
That, okay here's the. THING i believe.

Speaker 1 (01:19:25):
That you're not going to be able to make them
do it under the. LAW i don't think you can
unless you sue them and some jury finds this. UNCONSCIONABLE i,
MEAN i don't know if you want to go through
all of, that, WELL i, mean how far are you willing.

Speaker 18 (01:19:41):
To go on?

Speaker 1 (01:19:42):
This?

Speaker 23 (01:19:45):
YEAH i mean it comes to dollars and cents and
what makes. SENSE i guess if you want to sue,
somebody if your lawyers, involved and follow that, ROUTE.

Speaker 4 (01:19:56):
I don't.

Speaker 1 (01:19:56):
Know i'm looking up case Law i'm on a site
WHERE i can look up case. Law what would we
call this for warranty work that takes an exorbitant amount of?

Speaker 4 (01:20:11):
TIME i don't. KNOW i, MEAN i think it's an
exorbitant amount of. TIME i don't know.

Speaker 2 (01:20:20):
What the hell you?

Speaker 4 (01:20:21):
KNOW i, mean are? You are you really believing it
could go past two?

Speaker 23 (01:20:26):
SEASONS i believe they're going to have the boat this entire.
SEASON i think by next season at some Point i'll
have the boat. Back from What i've read on the,
internet people talking about when they've shipped their boats in it's,
three four to, six eight nine.

Speaker 4 (01:20:46):
Months, Well god, ALMIGHTY i.

Speaker 1 (01:20:52):
Don't know what to. Do i'm looking up. This i'm
looking up case law under recreational, Vehicles, okay under common law.

Speaker 4 (01:21:03):
And consumer protection.

Speaker 1 (01:21:04):
Statutes there have been cases they're going to cite them
where new boats or vehicles with excessive warranty repairs people
were given. Refunds now, there now we're actually now these
are actual. Cases you don't care about, It but like
fourteen versus the Ox Bow marina about a, boat another

(01:21:29):
one Uh mexia versus rinker. Boat, specifically we had one roke.

Speaker 4 (01:21:36):
Of v months and.

Speaker 1 (01:21:37):
Ski you. Know here's what we can. DO i can
send this to you by email and you could cite
these to them, saying, look there have been till. Cases
i'm trying to. Find there have been a lot of.
Cases there have been a lot of cases where people were.
Granted you, Know california law actually has repaired deadlines of thirty.

(01:22:02):
Days federal law says unreasonable delays in warranties can violate
The Magnuson Moss.

Speaker 4 (01:22:12):
Act so you want me To i'll copy this to.
You i'll send it to.

Speaker 23 (01:22:19):
You here's here's my biggest problem is short of my
salesperson who just won't talk to me. ANYMORE i don't
even have any contacts That kabela is who to talk.

Speaker 1 (01:22:27):
To there's, well Didn't. SUZANNE i Think.

Speaker 23 (01:22:30):
Susan talk to.

Speaker 4 (01:22:31):
Anybody mark Didn't? Suzanne you said had?

Speaker 1 (01:22:34):
Somebody?

Speaker 7 (01:22:35):
Right, Yeah well she emailed pr after he called last,
week And i'm convinced that's why the boat was picked.

Speaker 4 (01:22:42):
Up so, yeah but here's A i.

Speaker 23 (01:22:44):
Think it might have been coincidence because the DAY i
talked to you was the day they picked it. UP
i don't think they moved that. QUICK i think it's
just it was sitting there a month already the boat
had been sitting there for a month waiting for.

Speaker 4 (01:22:54):
Pickup, OKAY i think.

Speaker 1 (01:22:56):
That here's what we're going to do with. This we're
not going to split. Hairs here What i'm gonna. Do
you're gonna give us your. Email i'm going to send you.
This i'm not saying it'll be, magic but maybe we
can get you the contact number to call or MAYBE
i don't.

Speaker 4 (01:23:12):
Know i'll copy sues on. This maybe she'll send this
to THE pr. Person but they have to KNOW i was.

Speaker 1 (01:23:21):
WRONG i wasn't wrong about our calls ONLY i said
only one or two got refunds or. Exchanges BUT i
got to tell, you, man there's a lot of common
law in your.

Speaker 4 (01:23:34):
Favor.

Speaker 23 (01:23:34):
Corey, okay that sounds.

Speaker 1 (01:23:37):
Positive now that doesn't mean you know it's worth, Suing
but common, law you may even get a summary judgment
BECAUSE i don't think there would be any dispute of.
Facts summary judgments are granted when there is no dispute in.
Facts in other, words you bought the. Boat everyone agrees
the boat was under. Warranty everyone agrees the boat's gonna

(01:24:00):
take x. Amount it's already. Taken how.

Speaker 4 (01:24:02):
Long how long have you been without?

Speaker 8 (01:24:03):
It two?

Speaker 1 (01:24:05):
Months everyone agrees to that it's been out two. Months
everyone will agree it'll take at LEAST x. Amount SO
i think you could get an attorney and do, this
and you may just have to file and get a summary,
judgment which would be much less than the normal. Route
that would probably be ten grand or. Under, so no matter,

(01:24:29):
what leave your email AND i will send this to.
You i'll send a copy To sus and Maybe sus
can get it to THE pr. People all, right so
let's do. That three oh three seven one three eight

(01:25:57):
Problems answer your, question take your. Conplace, julie let's talk
about identity. Theft what's going on with?

Speaker 3 (01:26:02):
You, HI.

Speaker 15 (01:26:06):
I am experiencing identity. Theft, yes my first. Time i'm not.

Speaker 20 (01:26:11):
Excited i'm trying To how did it?

Speaker 4 (01:26:13):
Happen, julie tell me the.

Speaker 15 (01:26:14):
Story, Okay SO i was sitting with my kids Playing
legos on the floor AND i got a text From
dillard's thanking me for opening a credit. Card And i'm, like,
oh that's, silly that's, spam, right BECAUSE i get ridiculous
spam all the. Time and THEN i checked my email
just just BECAUSE i was scrolling BECAUSE i was.

Speaker 2 (01:26:36):
Little.

Speaker 15 (01:26:36):
Kids you, know and they were Playing legos And i'm, like,
Oh i'm getting all These experience alerts like emails and
it's SAYING i have all these hard credit, inquiries And i'm,
like maybe this is. Real SO i logged on AND
i have this list of hard credit inquiries From, Target, Zail, Dillards,
Dicks Sporting's, goods Best, buy always did.

Speaker 1 (01:26:59):
See if you had a free on your? Credit none
of that could have. Happened, YEAH i didn't even know
that was a. Thing, yeah so tell. Me so you
got this text saying thanks for opening. Account then you
got notices about hard credit. Pulls so now what what

(01:27:20):
else did you? Do how did you find out it
WAS id?

Speaker 15 (01:27:24):
Theft So i'm, like, okay this IS i obviously didn't
do any of these hard credit. Pools i'm not opening credit.

Speaker 1 (01:27:31):
Cards SO i was, like, what so go in and freeze?

Speaker 4 (01:27:36):
It did you freeze your credit? Immediately not?

Speaker 15 (01:27:41):
Immediately BECAUSE i had to google it BECAUSE i had
no idea what was?

Speaker 20 (01:27:43):
Happening, Right SO i went on The.

Speaker 15 (01:27:46):
Experience and it was, like is do you want to dispute?
This i'm like, Yes and that's what led me.

Speaker 7 (01:27:51):
To REALIZE i need to where any of the credit lines.

Speaker 15 (01:27:54):
Opened oh, yes So target was. Used they bought A
ps five AND i know that BECAUSE i called.

Speaker 3 (01:28:00):
Them, so but WHAT i did in the.

Speaker 15 (01:28:02):
ORDER i did. It So i'm, Like, OKAY i put
a fraud alert on my account and it goes to
all three credit.

Speaker 1 (01:28:07):
Bureaus but did you also put a? FREEZE a fraud
alert is not a. Freeze, YES i.

Speaker 15 (01:28:14):
Did a freeze on all three credit buros after.

Speaker 4 (01:28:17):
That, okay, good SO i have a.

Speaker 15 (01:28:20):
Freeze so, no there's no extra. Damage But i'm just
trying To i'm trying to fix the damage that has been.

Speaker 1 (01:28:26):
Done, OKAY i don't know what damage has been, done
because all you have to do is notify the ones
where they opened credit and you can find that out
on your credit, report and then you can simply call
them and SAY i have never opened an account with,
you AND i you, know and and if you have

(01:28:49):
an account, Open i'm asking you to close it because
it was identity.

Speaker 4 (01:28:54):
Theft it's going to be that. Easy so and it
does sound.

Speaker 15 (01:28:58):
Easy, Right and it was easy With hard and it
was easy With Dick's sporting's. Good So i'm having an
issue With. Zail Dillard's best Buy they're all Through City,
bank And City bank keeps hanging up on me BECAUSE
i don't have an account number BECAUSE i didn't create these.
Accounts and then.

Speaker 20 (01:29:16):
WHEN i waited on holds for over two, HOURS.

Speaker 15 (01:29:18):
I finally spoke to a person and supposedly they were
the fraud, department but they were basically, like, UH i
don't know if we can help.

Speaker 1 (01:29:26):
You, yeah but, SEE i want to say. Something in the,
end it doesn't. Matter they cannot collect from. You it
DOESN'T i, mean if it's, fraud it's. Fraud they can't
collect from. You they would have to show ultimate proof
it was, you and they'll never be able to do.
It and that's the truth of the. Matter and you
can tell them that straight. Up you can, say, look

(01:29:47):
you can cooperate with me and do, this or you
can be ripped, off but you're never going to get
paid because this was credit. Fraud what were you going to,
Say deputy D. TOM i think the situation is far
more serious than what we just.

Speaker 19 (01:29:58):
Heard the sheet is going to start getting contact from
a collection agency and she is going to get. Sued
she needs to prepare for to be prepared for. This
with a following a police report is absolutely. Mandatory it's absolutely.
Mandatory now the police are not going to do, anything but.

Speaker 1 (01:30:15):
It shows that you, mean that's that's a great. Idea
and then.

Speaker 19 (01:30:18):
Via certified mail with return, receipt return receipt, requested our
caller needs to contact every one of these creditors with
a letter explaining she didn't open the account and a
copy of the police, report even the creditors who agreed
to close the. Accounts she needs to start laying the

(01:30:39):
groundwork for this lawsuit that's coming right.

Speaker 21 (01:30:42):
Now wouldn't wouldn't it be simple if it's all on
the same. Card why is just it's.

Speaker 4 (01:30:47):
Not it's not all on the same. Card they're all separate.

Speaker 21 (01:30:49):
Accounts, Okay, well another, thing there's a site called identity
theft dot gov which lists all the steps that she
needs to go, through which includes a police support obviously
and some other. Things SO i would after you file

vendors are issuing credit cards From City.

Speaker 4 (01:32:12):
Bank, yes, yes, ALL i get, it but that actually
you don't understand, This.

Speaker 1 (01:32:18):
Julie this makes it easier for, you not, harder because
now you have one point of contact for all those other,
vendors and you can reference those vendors in one email
or in one certified a mail or registered actually it
is so you register this mail to them with a
return receipt, requested and it will literally. Help it'll go

(01:32:42):
to each one you can SAY i am aware that
fraudile accounts have been opened with several of your, affiliates,
namely then put them. DOWN i am hereby telling you

that it makes you your job. Easier That City bank
has a number of vendors under. Them that's my opinion.

Speaker 15 (01:33:14):

get in touch with, them And i'm, like it's, impossible
and they don't have an email.

Speaker 19 (01:34:32):
Account, hey there's there's one more thing you need to
be prepared, for which is to start disputing all of
these line items on your credit reports so you can
get the accounts. Closed but that that's not going to
make them leave your credit. Reports so be prepared for
that uphill.

Speaker 1 (01:34:47):
Battle what do you tell your? Marriage oh you mean
when they report bad?

Speaker 19 (01:34:50):
Credit, absolutely they, report they report, inquiries they report new.
Credit and this is going to turn into bad credit.

Speaker 4 (01:34:57):
Reports, no it, will but the credit ratings if she
has the police. Reports and there was some.

Speaker 1 (01:35:04):
Laws The Federal Trade commission did a reversal on kind
some of, this saying that the burden of proof is
on the. Creditor it used to be the creditor would
just put something down and say it was, correct and
the consumer had to go through all kinds of conniptions
to get it. Fixed now the creditors actually have to show.

(01:35:25):
Proof they can't just put it on. There so when
you dispute, it you have more weight than you used,
to although this is going to be a. Battle how
As deputy d, said.

Speaker 21 (01:35:35):
The Consumer Protection, bureau they've always seemed to be really
good at this kind of.

(01:45:47):

Speaker 13 (01:45:54):
Well they have two. Numbers but since we last talked
and discuss my calling you to help, Them i've made
dozens of clums to those two, numbers and they never
answer they.

Speaker 1 (01:46:09):
Are so you're thinking that they are cutting off communications
because of? That, yes, Okay so on that, conversation what
was said about what they? Can what are they what
do they think is?

Speaker 13 (01:46:27):
Happening, well she's told me more than twice in the
last few years that she suspects the same.

Speaker 1 (01:46:34):
Thing what does she?

Speaker 4 (01:46:36):
Suspect what does she?

Speaker 13 (01:46:38):
Suspect, well she gets very little money in cash from
Her Social security check each month because they keep almost
all of. It from what she tells, Me, well they.

Speaker 4 (01:46:50):
They can keep whatever is. Owed, right is that how it?

Speaker 13 (01:46:54):
Works, well she pays. Rent BUT i don't know how
those places operate other than the here's how they.

Speaker 1 (01:47:02):
Operate i'm going to tell you exactly how they. Operate
you put Your Social security check on assignment to, them
and they pay whatever they're, owed and they give you whatever's.
Left and if there isn't anything, left you owe the.

Speaker 4 (01:47:16):
Money, WELL i know there's.

Speaker 13 (01:47:21):
Been stories of nursing homes keeping more money than they
should from.

Speaker 4 (01:47:24):
Patients, Normally, Robert i'm going to tell you the. Truth,
normally there's not much money. Left SO i. DON'T i,
mean the only way to know that is to look
at our, contract, right.

Speaker 13 (01:47:37):
That they won't let me look at, it and she
doesn't comprehend. That, well that's why she's. There she doesn't
have the ability to interpret contracts that.

Speaker 1 (01:47:52):
Complex how much does, okay how much each one of
them is a separate? Case does she believe does she
believe they're taking more money out of each of their
checks or just one of them?

Speaker 13 (01:48:06):
Each BUT i have not talked with her mother BECAUSE
i don't really know her and they're in separate.

Speaker 4 (01:48:12):
Rooms, okay so the DAUGHTER.

Speaker 1 (01:48:18):
I need to know the daughter? Here, now the, daughter
how much does she normally get a? Month?

Speaker 4 (01:48:25):
Total do you?

Speaker 2 (01:48:26):
KNOW i didn't?

Speaker 4 (01:48:28):
Ask do you know what the rent is at the nursing?

Speaker 1 (01:48:32):
Home?

Speaker 4 (01:48:33):
No, Well, robert this is way too preliminary for us
to get.

Speaker 1 (01:48:37):
Involved we can't go fishing for something we think might
be there based on the ramblings of a woman in
a nursing. Home you ought to go over there and
visit her and, say you, know what is how much
do you?

Speaker 2 (01:48:49):
Get?

Speaker 4 (01:48:49):
Total and social you.

Speaker 1 (01:48:51):
Can go online and find that. Out she can go
online To Social security and then find out how much
total they get and how much the nursing home is,
taking and then just find out what the nursing home charges.

Speaker 4 (01:49:03):
EVERYONE i, mean it's not that.

Speaker 1 (01:49:06):
Complicated did she say the amount of money has gone
down that she's?

Speaker 13 (01:49:13):
Gotten but she you, Know i'd known her for twelve years, before,
yes and it's only been in the last maybe three
years or more That i've found out this from. Her
And i'm positive she told me how much she's supposed

(01:49:35):
to be. Getting BUT i can't verify anything now because
they won't answer my.

Speaker 1 (01:49:39):
Call then you have to go over there in. Person
they're not obligated to answer the. Phone they're not obligated
to let her use the. Phone have you ever thought
of buying buying a prepaid phone and going over and visiting.

Speaker 4 (01:49:56):
Her and giving it to, her.

Speaker 13 (01:49:59):
You, know because she has free access to the phone or.
PHONES i, except.

Speaker 4 (01:50:04):
Except you're telling.

Speaker 7 (01:50:05):
Me they don't.

Speaker 4 (01:50:06):
Answer they don't.

Speaker 13 (01:50:07):
Answer WHEN i, call and even IF i block my,
calls they have must have the ability to unblock, them
BECAUSE i know they.

Speaker 2 (01:50:16):
Know they.

Speaker 1 (01:50:16):
Don't, no they. Don't they don't have the. Unbuilding they
don't have the ability to. UNBLOCK i block.

Speaker 13 (01:50:24):
Calls to various businesses or, people and they tell't they know.

Speaker 2 (01:50:28):
What my number.

Speaker 1 (01:50:28):
Is, Okay, robert, Listen, robert, LISTEN i don't know what
you want us to. Do you have some woman who's,
SAYING i don't know how much rent it. IS i
don't know how MUCH i, get BUT i Know i'm
not getting. Enough And robert SAYING i can't talk to
them because they won't answer the. Phone and what do
you want us to? DO i, Mean, robert we don't

(01:50:50):
do magic. Here we look into hard. Cases go over
there and get some. Evidence go over there and at
least talk to. THEM i, Mean, ROBERT i really applaud
you for wanting to help your, friends But i'm not
going to launch an investigation into something.

Speaker 4 (01:51:04):
You suspect might be going.

Speaker 1 (01:51:05):
On and you suspect they're not answering the, phone and
you suspect they're taking too much. Money my, god we'd
be running around all day if we had people in
nursing homes telling us what they.

Speaker 4 (01:51:15):
Suspect give me, Something give me.

Speaker 1 (01:51:18):
Something for, example if she was getting four hundred dollars
a month left over and now she's only getting one hundred, Dollars,
okay but give me, something and you know you're allowed
to go over, there get a power of attorney from,
her and then you can start looking.

Speaker 4 (01:51:33):
Into it, yourself or you can help us look.

Speaker 1 (01:51:36):
Into it with power of. Attorney BUT i thank you
for calling. AGAIN i don't know what you expect us
to do at this.

Speaker 4 (01:51:43):
Point what truly do you? Think you? Know you're telling? Me,
WELL i have a woman in a nursing. Home can't
talk to.

Speaker 1 (01:51:49):
Her they won't answer the. Phone but she suspects that
they're taking more money than they.

Speaker 4 (01:51:53):
Should all, RIGHT i just told you what to.

Speaker 1 (01:51:55):
Do go over and visit, her gather, information and then
get back to. US i mean, again, look, people there
are so many suspicions in life that we think is
going wrong or. Right what we have to do is
we have to take. Initiative you. Know we don't take
the ramblings or the suspicions of people and go hunting

(01:52:19):
for something.

Speaker 4 (01:52:20):
Wrong we just don't do.

Speaker 21 (01:52:21):
That we just.

Speaker 4 (01:52:23):
Don't let's talk about some follow. UPS i think we
have some follow, ups don't?

Speaker 2 (01:52:31):
We did? You oh you?

Speaker 1 (01:52:34):
Had? Okay? FINE i THOUGHT i has. Involved but here's
WHAT i do. HAVE i have some of the STUFF
i wanted to go through on the on our previous,
calls the identity. Theft NOW i got confused over registered
mail certified. Mail so if you wanted to send fraud

(01:52:57):
reports to let's Say City, bank you would use certified.

Speaker 4 (01:53:01):
Mail is that, Right Deputy deputy D.

Speaker 1 (01:53:03):
TOM i.

Speaker 19 (01:53:04):
WOULD i would use certified mail with return receipt. Requests
that's different Than, yeah registered mail is something. Else that's
just high security. Mail we're talking about, proofects high value. Packages,
yeah these two services provide really great evidence of receipt
of these. Letters now what's unfortunate for our caller is

(01:53:26):
she is going to be in court probably a year from,
now having to prove that she did not open these
accounts and she doesn't owe that.

Speaker 1 (01:53:34):
Money that's, why, well you know you'll be in court
to answer. It they're the ones that have to prove.
It she doesn't have to prove the. Negative they have
to prove she opened the.

Speaker 19 (01:53:44):
Account you're, Right BUT i mean that she'll have this
as evidence to support her case, exactly and that she
did her best to notify. Everybody you're trying to address
the issue. Preemptively that's where it's going to. Go AND
i guarantee you none of these collection agencies are going
to pay attention to the police report or to these.
Letters they're just going to try to get a default

(01:54:04):
judgment against her when they take her to.

Speaker 1 (01:54:06):
Court, yeah it really sucks a really identity theft is. Terrible,
craig you're calling for a. Friend what is the issue
we'll get started on A.

Speaker 4 (01:54:17):
Craig, Well i've got a friend.

Speaker 12 (01:54:21):
That went through divorce proceedings a couple of years ago
and the husband did not like the outcome or the
judgment and appealed. It he has since lost the, appeal
but he has continued to file additional motions after. MOTIONS
i think he's up to in the somewhere in the,
eighties and he's represented himself and he's USING ai and

(01:54:45):
he's filed like eighty motions and she has to respond
through a lawyer every. Time and then he filed fraud
charges against her lawyer and the expert witness those just
got dismissed with, prejudice and then he filed fraud charges against,
her and so he has buried her in legal fees

(01:55:06):
to try to defend. Herself she's completely.

Speaker 11 (01:55:08):
Underwater her lawyer.

Speaker 12 (01:55:10):
Has had to take a lean against her. House she
got in the judgment just to cover. Herself and as a,
FRIEND i don't know how would do it hold on
into the.

Speaker 1 (01:55:20):
Call oh, kay let's hold on and talk about this.
Case there might be some stuff she can do normally with.
Sewers we call him. Sewers he's a.

Speaker 4 (01:55:29):
Sewer. Uh there are things you can, do but we'll
talk about that coming.

this buyer real. QUICK i know in some cases judges
have actually ruled that they no longer file. Motions. Bonnie

(01:56:43):
here's what, happened according To, craig who is calling for a,
friend she went through a divorce and the ex husband
appealed the divorce. DECREE i didn't know you can do.
That are there appeals you file against a divorce, decree.

Speaker 27 (01:57:00):
Well against the orders and it depends on whether it
was a magistrate or a, Judge so you, yeah there Are.

Speaker 1 (01:57:06):
Okay he, lost he lost his, appeal, okay and he
has since filed eighty motions everything from fraud to what
are some of the?

Speaker 4 (01:57:20):
Motions, CRAIG.

Speaker 12 (01:57:23):
I don't have them all IN i don't have them
all in front of. Me apologize. AGAIN i was just
calling for a friend to see if it was something
that you would take on in a.

Speaker 4 (01:57:32):
Discussion.

Speaker 1 (01:57:33):
Now but here's what we're, saying eighty. Motions he's representing.
Himself she has to defend herself and it's costing her
thousands and thousands of.

Speaker 4 (01:57:43):
Dollars is that where we are.

Speaker 12 (01:57:47):
Absolutely over like in the hundreds.

Speaker 4 (01:57:50):
Of thousands, well wait a, minute where'd she get the?

Speaker 9 (01:57:52):
Money, well that's why she said lawyer took a lean
against her. House so when she does eventually fell, ouse
that she would repay those legal fees through the sale
of the.

Speaker 1 (01:58:03):
Ouse and then what about what about? Him he's representing.
Himself he is started.

Speaker 9 (01:58:12):
AN ai, company and he is USING ai to file
all of these, Motions.

Speaker 1 (01:58:20):
Bonnie do judges ever take action against someone filing eighty?

Speaker 4 (01:58:24):
Motions For god's?

Speaker 1 (01:58:25):
Sakes.

Speaker 27 (01:58:28):
Definitely there's there's two Ways i've seen it done in
THE i, mean the most common one is every time
he files, emotion her attorneys filing a, response AND i would.
Imagine i'm certain he's also asking for attorney's fees because
the emotion was frivolous or sexationous or something like. That
so you can get attorneys fees for people filing frivolous.

(01:58:50):
Motions WHAT i don't, know and maybe her Friend craig
doesn't know, either is if the, judge when the judge
turns down these assuming these emotions are being, denied they're being,
denied the judge will rule on attorney s, Fee so
he may be husband maybe only why some attorney s
fee based on. THAT i have also seen just a

(01:59:11):
couple of times in my, career But i've seen it
when somebody is excessively filing. MOTION i have seen orders
from the court where the court actually orders that they're
not allowed to file any motion without first doing some
kind of steps like letting the court know they want
to file emotion on blah blah, blah and the court
gives them permission to file it or not file.

Speaker 1 (01:59:31):
It, OKAY i want to ask you, Something. Craig what
was the latest? One you said some about.

Speaker 9 (01:59:38):
Fraud, yeah he pressed charges of fraud against her attorney
and her her expert. Witness those were both last week.
Dismissed is it with prejudice without, prejudice they can't be
brought up? Again but they were totally.

Speaker 4 (01:59:57):
That's with, prejudiced with Prejudice and, yeah.

Speaker 9 (02:00:01):
And now and now he has the same. Thing he's
filed fraud against his ex wife as.

Speaker 4 (02:00:06):
Well now are these big money?

Speaker 1 (02:00:09):
People do?

Speaker 4 (02:00:10):
They does this guy have a lot of? MONEY i
don't think.

Speaker 2 (02:00:14):
So, No.

Speaker 1 (02:00:17):
And he's obviously a very angry. Person has the judge
ever ordered attorneys?

Speaker 23 (02:00:22):
FEES i BELIEVE i believe THAT i.

Speaker 9 (02:00:27):
Read some communication from her shown that there was that
the the attorney's fees for one of the fire were
approved to be moved over to the husband to the
ex husband's responsibility for his ex wife's attorneys for.

Speaker 4 (02:00:43):
Party now, now but.

Speaker 1 (02:00:45):
But most this civil? Case is it outside of the?
Divorce did he literally file a lawsuit against?

Speaker 13 (02:00:55):
Her?

Speaker 1 (02:00:57):
Yes what does he.

Speaker 9 (02:00:59):
Claim that she committed fraud with certain accounting with the
business that over evaluated the business as part of the divorce?
Proceedings Per?

Speaker 1 (02:01:15):
Bonnie what do you?

Speaker 4 (02:01:16):
Do what do you do with something like?

Speaker 2 (02:01:18):
This we'll.

Speaker 9 (02:01:19):
Talk it might be best for me to have her call.
IN i was just trying to see you, guys would
hear that?

Speaker 1 (02:01:24):
Out, well we will hear, it and we can give her.
Suggestions but there's nothing for us to take. On this
isn't a court of, Law. Bonnie what would you do
if you had a client being bombarded like?

Speaker 27 (02:01:35):
THIS i would ask the court to restrict their filing, emotions.

Speaker 1 (02:01:42):
All.

Speaker 27 (02:01:42):
RIGHT i would probably have to talk to some colleagues and, say,
hey who's done one of? THESE i, mean what you,
Have BUT i Know i've seen it done couple of
times where the court literally tied somebody's hands behind their
backs because it got. Ridiculous the court doesn't have time
to deal with that. Either AND i know it's affecting
her curly with her attorney seat that she's also affecting
the court's ability to spend time on legitimate.

Speaker 1 (02:02:04):
Things, yeah you ought to have her calls. Directly and,
again what will you?

Speaker 4 (02:02:09):
KNOW i don't.

Speaker 1 (02:02:10):
Know, unfortunately these things happen when anger enters a. Divorce
but As bonnie, said her attorney may not be taking
the proper steps to shut it, down and we can
we can discuss that with.

Speaker 4 (02:02:23):
HER i got to take a.

LEAST i know of your.

Speaker 4 (02:03:47):
Existence, well Thank, youka thank you very. Much what's going
on with?

Speaker 1 (02:03:52):
You?

Speaker 28 (02:03:54):
WELL i recently. Downsized i've always lived in a house
with a lot of, storage BUT i recently sold everything
and a man that transitions moved into a small condo without,
storage SO i had to store a bunch of stuff
in public. Storage and they What i've noticed, now AND

(02:04:16):
i put in a thing to next, door and that
many people have said the same, thing that they will
will lure you in with a low, price and then
within a few months they start jacking the price up
like fifty, percent you, know not like a small amount
you know you go from.

Speaker 1 (02:04:37):
There, yeah but hold, On, Marjorie, MARJORIE i know you're,
correct but let me explain. Something in the very, beginning
they offered you long, term longer term. AGREEMENTS i know they,
do and then you did.

Speaker 27 (02:04:50):
It they did it all.

Speaker 14 (02:04:54):
RIGHT i in, FACT i asked, them CAN i pay a?

Speaker 28 (02:04:57):
HEAD i MEAN i never just WHILE i was a,
newbie SO i really didn't. Know but they never, said,
hey if you want to sign a long term. Contract
they never, said, oh if you go month to, month
your rates may go. Up AND i wouldn't have minded
a small. Increase but Forty.

Speaker 4 (02:05:19):
Well, here ALL i can tell you is the straight,
answer which is it's not. Fraudulent. Okay ALL i can
tell you, is.

Speaker 28 (02:05:29):
Yeah it's just a bad business. MODEL i think it.

Speaker 1 (02:05:32):
Is, well it is because you get all your stuff
in there and then they jacked the. Price but usually you're,
right held, On you're you're. Right i'm looking at their.
Website they offer month to, month there's no long term.
Commitment they say that that is a benefit to, you

(02:05:58):
but basically they're getting many complaints that once you're in,
there they start hiking your, price and really there's. Nothing
there are no laws against what they're. Doing, Now i'm
not SAYING i agree with, them but you can't stop
them unless you leave. Them and if enough people leave,

(02:06:18):
them they'll stop doing this. Nonsense but but you're absolutely.
RIGHT i just looked at, it and they did not
offer you a long term. Rental they do month to
month on. PURPOSE i. Think, now are you saying that
everyone gets hooked with higher prices or just certain? PEOPLE

(02:06:41):
i assume.

Speaker 28 (02:06:41):
Everyone it's just FROM i, MEAN i can only tell
you what happened to, me BUT i posted it the
next Door i've, Had we'll, say and it's.

Speaker 1 (02:06:53):
How long were you there before they hike the? Price
not even three? Months and how much did they go?

Speaker 28 (02:07:02):
Up about forty plus? Percent a little over forty. Percent,
golly it went from one twenty to.

Speaker 6 (02:07:12):
One eighty a.

Speaker 4 (02:07:13):
Month now do they say how long that one eighty
is good?

Speaker 28 (02:07:18):
For, Nope And i'm assuming, that just from some of
the other Contacts i've gotten that it's going to end
up at three hundred at some.

Speaker 1 (02:07:30):
Point oh my, godness what do you know about this?

Speaker 4 (02:07:33):
Practice deputy D do you know about this?

Speaker 19 (02:07:36):
Practice, yeah it's really common among self storage. Units in,
fact your yours and. Mind mutual Friends Steven kimberly experienced
this just a couple of months, ago really a couple
of years. Ago they rented a storage locker for about
ninety dollars per. Month, yeah and when they moved out
a couple of weeks, ago it was four hundred and
eighty dollars a month for the same storage.

Speaker 21 (02:07:57):
Locker.

Speaker 19 (02:07:58):
Yep, yeah so this is apps common. Now one of
the ways that a consumer could protect him or herself
from it is to sign a longer term. Lease, no
but they don't offer. One oh, well that's what that's
a red. Flag, tom that's why they don't offer a
long term.

Speaker 4 (02:08:12):
Lease.

Speaker 1 (02:08:13):
YEAH i just read where they don't offer to. You
they want you to do month to. Month And, marjorie
you may have come across something we need to look.

Speaker 28 (02:08:20):
Into, yeah that would be awesome because if this is
the same thing somebody's apartments are doing, now it's like customer.
Service what you, know we don't care about long term
people that pay their bill every. Month we just want
you To we're gonna keep raising it till you, Leave,
marjorie get someone else in, There.

Speaker 1 (02:08:42):
MARJORIE i promise. YOU i want you to leave your
information on which public stories you're. WITH i promise you
you have tickled us into doing you have encouraged us
into looking into this Because i'm reading more and more
of these cases online AND i agree with. You. Jan
what's going on with? You? Jan what's? Happening?

Speaker 6 (02:09:04):
Tom?

Speaker 1 (02:09:05):
Hi? Tom what's going?

Speaker 13 (02:09:06):
On?

Speaker 14 (02:09:07):
Jan and can you hear?

Speaker 1 (02:09:10):
Me? Yes?

Speaker 2 (02:09:10):
Sir.

Speaker 14 (02:09:12):
Okay so what's going on IS i signed a monthly
membership plan with a car wash and, yeah you, know
for unlimited washes for the. Month and it was thirty
five dollars a month and that was that was. About
it Was december of twenty three WHEN i signed, up
at the beginning of the, winter And i've been on

(02:09:32):
that plan to current and then the other DAY i
went IN i was having trouble with the card reader
and they, said well'll replace. That when the guy looked it,
up he, says, oh you're on the twenty two dollars
a month. PLAN i, said, No i'm on the thirty
five dollars a month, plan Which i've been charged for ever. Since,

(02:09:53):
well what happened is back In june of last, year
they lowered that plan rate to twenty two dollars a
month and WHEN i went in and asked the attendant about.
This he, said, oh, well, yeah we they lowered the
rate like last, year but they told us not to tell,
anybody so we wouldn't have.

Speaker 2 (02:10:12):
To lower the.

Speaker 4 (02:10:12):
Cost, okay you're not going to like the. ANSWER i
don't have, to but go.

Speaker 1 (02:10:19):
Ahead, okay here's bottom, Line, jan if you signed up
for thirty five and they lowered the, price they did
not have to offer that to. You many many businesses do.
This they have new low prices and they don't go
back and retroactively change. Everyone but they do change you
if you go and. Ask but they won't go. RETROACTIVE

(02:10:41):
i promise, You, jan this is not just a car
wash doing.

Speaker 4 (02:10:45):
This, okay they otherwise.

Speaker 1 (02:10:50):
See this is what they. Do they look at the
market conditions at the time and they go in and they, say,
okay we're going to do, this this and, This but
they don't go back and change.

Speaker 4 (02:10:59):
Everyone they. Don't and it's not, sneaky it's not.

Speaker 1 (02:11:02):
Fraudulent you were happy paying what you were, paying and
now you're not because you found out people are paying.
Less it happens all the. TIME i don't look AT
i would like to SAY i don't like, it But
i'd be a. Liar And i'll tell you. Why in radio,
ADVERTISING tv, advertising in a lot of, businesses rates fluctuate

(02:11:25):
and somebody might be doing a commercial today and somebody
might be on a contract from yesterday on a television
paying a certain amount for a, spot and the newer
spots are going. Cheaper they don't go back and, say
by the, way everyone who's, advertising your rates have just gone.

Speaker 4 (02:11:42):
Down they they just don't do, it.

Speaker 14 (02:11:46):
Okay and the flip, side, sorry the flip side is
if the rate went from twenty two dollars to thirty five,
DOLLARS i would hear about.

Speaker 4 (02:11:56):
It maybe you, would maybe you, would or sometimes they
grandfather you.

Speaker 1 (02:12:01):
In it goes both. Ways but the point is you
don't have a. LEG i, MEAN i understand why it's
putting a bad taste in your. MOUTH i would be
right alongside. You but the truth of the matter is
it does not change the. Facts it just. Doesn't they

(02:12:22):
can do what they want with their. Pricing it's called footballing.
Pricing airlines do. It advertising. Doesn't car washes do, it car,
prices car maintenance does. It and LIKE i, said it
does have a way of making people feel even, insurance

(02:12:42):
you get an insurance. Policy that's Why Compass Insurance group,
says shop your. Insurance Hey, bob you're doing what's going
on with small?

Speaker 24 (02:12:55):
Claims, WELL i was just curious what your opinion. WAS
i was, just you, know with all the craze ABOUT
ai and, everything and whether that eventually will filter down
to the justice system where there won't be a small
claim scort. Anymore but you'd be presenting your facts TO,

(02:13:16):
ai and both parties would give their FACTS ai and
they would come out and render a decision out OF.

Speaker 1 (02:13:24):
AE i think that'll. Happen let's just you, know hold,
ON i never thought of. THAT i don't think that'll
happen because as far AS i know right, now it's
required to have personal service and you're required to file a.

(02:13:46):
Response you can have someone write it for. You BUT
i doubt there will ever be a time when the
boss actually just argue with each. Other hold, on if
you want to talk about. It we got more coming right.

Speaker 24 (02:13:56):
