Speaker 1 (00:05):
Ripped.

Speaker 2 (00:07):
You need advice when you don't have you come running
just as fast as we can. Show Shooter's gonna help coming.

Speaker 3 (00:19):
Man Dix's The Troubleshooter Show. Now, Tom Martine kello.

Speaker 4 (00:25):
I'm Tom Martino. Welcome to the show.

Speaker 1 (00:27):
Three oh three seven one three talks seven one three
eight two five five.

Speaker 4 (00:32):
What's going on in your life? How can we help you?

Speaker 1 (00:34):
I asked this question every day because we do help
people each every day.

Speaker 4 (00:39):
We we we We're unlike any other radio show.

Speaker 1 (00:42):
We talk about these everyday aches and pains, the things
that make you tick, the things that tick you off.
I'm gonna go right to Ben right now. He said
he has an issue with what is retainage?

Speaker 4 (00:55):
What does that mean? He's working with you? What is retaina? Okay?

Speaker 5 (01:03):
Let me yeah, Tom.

Speaker 6 (01:04):
Ben called us a couple of days ago because he
was a subcontractor.

Speaker 4 (01:08):
For a really big commercial job change. He's a subcontractor.

Speaker 6 (01:12):
Yeah, And he said that the general contractor still owes
him over forty eight thousand bucks. And Ben even sent
me the invoice he sent to the general contractor.

Speaker 1 (01:22):
Now he doesn't believe it's the general contractor's fault.

Speaker 6 (01:26):
Well, hold on his contract is actually with a general contractor,
not the client. So if the client hasn't paid enough
to the general contractor, the GC is still responsible for
paying it leaves right.

Speaker 1 (01:36):
But apparently Eaton Capital, which owns the building, is not
paying their bills.

Speaker 4 (01:41):
Therefore the general can't paign.

Speaker 6 (01:43):
Well, that's the allegation that we got more than second hand, right,
because that's something he heard from somebody who heard it
from somebody else.

Speaker 5 (01:50):
But let's see what happened. Let's see what Ben has
to say about it.

Speaker 1 (01:53):
Now.

Speaker 4 (01:53):
Maybe it's more information, Ben, what's happening.

Speaker 7 (01:57):
Well, I don't know if there's Tom Martinez show, but
you did some calling you and uh uh deputy date
and yeah, okay, they they paid. I got a call
from a friend that's on the accounting side and said, Ben,
we're paying you. So how much?

Speaker 5 (02:16):
How much did they.

Speaker 4 (02:18):
How much?

Speaker 5 (02:19):
Stand up paying you the whole.

Speaker 4 (02:21):
Great man?

Speaker 7 (02:22):
And I had a hundred. I had the paperwork.

Speaker 8 (02:25):
Go ahead.

Speaker 1 (02:27):
And listen, man, it pays. I've said this before. It
pays to listen to the troubleshooter.

Speaker 7 (02:35):
It was a good timing, Tom, and I didn't meant
it was Deacon Capital, so I said Eaton But it
was Deacon Capital.

Speaker 4 (02:42):
Beacon, Okay, but they're down.

Speaker 7 (02:45):
They're down on seventeenth and Lincoln, and uh. But one thing, Tom,
is that their philosophy had changed because they're a DPR
company now.

Speaker 6 (02:53):
They were G. G.

Speaker 7 (02:54):
Johnson bought out by DPR and and between them and
these owner's Deacon, it sounds like they're strong arming the subcontractors.
And so instead of being working out how do we
get these jobs done? Some some subcontractors had uh fallout,
some problems with their with their with their crews. But

(03:16):
they punish everybody and they didn't hold they hold everybody's
money until until everything got solved. And uh, that's not right.
I paid all my subs, Tom, and we went into
deep debt paying subs off just because they it's the
honorable thing to do. But you said a good thing

(03:36):
that that, and I lost the window of getting my
uh my, my uh lean opportunity. You told me something
very interesting that if I go in there and do
a punch list thing, you can you know, and they're
chick something that you can open that lean waiver opportunity.

Speaker 4 (03:55):
The lean window.

Speaker 1 (03:56):
The lean window is four months or one hundred and
twenty days, not necessarily four calendar months one hundred and
twenty days. And if you go back there for any
reason and revive that job, either a punch list or something,
then it then it's not considered the end yet. So
you have four months from the last time you were there.

Speaker 7 (04:16):
The big problem is they typically they don't pay n
till after ninety days anymore, so you kind of get
used to it.

Speaker 4 (04:23):
No, No, I know that, and they do that on purpose.

Speaker 1 (04:25):
They do that because in ninety days you only have
a month left to put a lien on the property.

Speaker 7 (04:31):
Right And you don't want to be the bad guy
the fight you see because you want to work together.
But it's it's a different world. But shout out to
you guys, and Nostalgic Medals has been paid, and definitely
all the other show we.

Speaker 4 (04:46):
Can add that.

Speaker 1 (04:47):
We can add that to our total and I can
use my dinger because that's what we do when we
have a success. Hey, I want to ask you something
real quick, Ben, the economy and your work ahead.

Speaker 4 (04:58):
Are you pretty booked?

Speaker 7 (05:01):
I'm a sole proprietor. I am very booked, but I
get I get them a lot of calls. Do you
have work? So I think the economy is in a
stall position personally, if you do good work, Tom, Nostalgic
Metals is never without work. And I'm an older guy.
I never should have took on this job. By the way, Tom,

(05:23):
and I did want to say you know that this
job I took on was a one point two million
dollar job.

Speaker 9 (05:28):
I told you about this.

Speaker 7 (05:30):
The stains is nothing, but Tom, we did lose money
on the job because I had to pay team members
and other companies to help me get it done. All
right and so so so even though the numbers are big,
watch out what you did.

Speaker 1 (05:45):
Okay, Bro, Okay, thank you for calling again. Deputy B
gets my dinger. Thank it pays to listen to the
Troubleshooter Show. Thank you, Ben, appreciate it now.

Speaker 4 (05:56):
Now Dawn, she has this is weird.

Speaker 1 (06:00):
Her mom had a Facebook page that was hacked and
she tried to get it back and couldn't get it back.
So this person who hacked the Facebook page then went
onto marketplace and started selling stuff and then did not deliver,
so they're going after her mom.

Speaker 4 (06:20):
Dawn.

Speaker 1 (06:22):
Hello, Dawn, how long ago was your mom's Facebook page hacked?

Speaker 10 (06:30):
July of twenty three or June of twenty three.

Speaker 1 (06:35):
Okay, June of twenty three, so how can they And
and that entire time, during that entire time, was anyone
posting to her page.

Speaker 10 (06:48):
No, So she's what they would do is they'd go
on to like marketplace Lakewood or Denver or whatever, just
a general thing, and then they would post up there.

Speaker 7 (06:57):
But it never posted to.

Speaker 10 (06:58):
Her original face. But because it's something she's selling, so
it would just.

Speaker 1 (07:02):
Go to those But in the marketplace, in the marketplace,
it looks like she's the one doing business. Yes, and
people are contacting her saying I didn't get my stuff.

Speaker 10 (07:18):
Well, what they're doing is they're reaching out to family
members saying, hey do you know this person? If you do,
I want you know their information is still in many
from me. So anyway, they've gotten my aunt and my
two of my aunts have called about this. And then
I got one yesterday or a lady that she was
trying to buy a couch and she paid a the

(07:39):
posit of one hundred and seventy five dollars and then
after they got the deposit, they started ghosting her. So
then she started going and messaging everybody on that person's
Facebook scene if she could find out where that person is.

Speaker 4 (07:53):
Did you report it to Facebook?

Speaker 10 (07:56):
We have reported it. The person that contacted me, they
reported it. We've had several I even went and asked
all my family members to report that page to get
it shucked out.

Speaker 4 (08:06):
And it's still up and running.

Speaker 10 (08:08):
And Facebook claims that whoever's running the page, it's their Facebook,
but there's no it's it's you know, they're just all fakes.
So the lady's name isn't right. The person that they paid,
they paid through a chime account, and and on the
Chime account it's a Benjamin Edwards. So then we looked

(08:28):
up Benjamin Edwards.

Speaker 7 (08:29):
Can't find him.

Speaker 10 (08:30):
We tried to call time trying they must.

Speaker 1 (08:33):
Have been What is the fake I want to look
at that. What is the fake page? What if we
all go to the fake page and start posting nasty
notes like, you know, stop the hijacking?

Speaker 11 (08:45):
What I mean you could What is the page?

Speaker 4 (08:49):
What is the page?

Speaker 10 (08:51):
It's Linda And then last name is cha.

Speaker 7 (08:56):
Keeps e l.

Speaker 4 (09:00):
H A pp e pp e L L Chappelle Chappelle. Okay, okay,
and I'm going to Linda Chappelle. Is that the one
with only three friends?

Speaker 1 (09:20):
No?

Speaker 10 (09:21):
I should have a serenity now on her like picture page.

Speaker 1 (09:25):
Okay, I'll try to find it at a different time.
But basically there's a lot of them. I guess there's
a lot of wisdom.

Speaker 4 (09:34):
Did you find it?

Speaker 5 (09:35):
Yeah, seventy eight.

Speaker 4 (09:36):
Friends, seventy eight friends? How'd you find it?

Speaker 12 (09:40):
I just typed in the name, looked out, look for
it's it's not a picture for the picture, it's just
a I stand for medical freedom, serenity, courage, and wisdom.

Speaker 4 (09:49):
Now why did your mom put that up there? I
see it.

Speaker 7 (09:52):
I think I think it was during COVID.

Speaker 4 (09:57):
Okay, so seventy eight friends got now this page. Perhaps
she can't get on this page right now.

Speaker 10 (10:06):
She can go look at it, but she can't sign.
She can't do anything with it like change the password
or delete friends, or she can't do anything. It's just
the page she can look at.

Speaker 1 (10:17):
I'm reporting the profile. Okay, something about this profile.

Speaker 4 (10:24):
Let's see what do we put fake profile?

Speaker 10 (10:32):
Like profile or scammer and pretending to.

Speaker 4 (10:34):
Be a friend. Did you go through all this? You
can go, well, your mom can go on there. Which
who is she? Okay, she's pretending to be Linda?

Speaker 1 (10:46):
I mean, this is this sucks you know, I've heard
of this happening to more and more people.

Speaker 7 (10:53):
Yeah, and Facebook will literally do nothing about it.

Speaker 10 (10:55):
And usually they're the ones that police everybody about everything,
and yet we try to dispute it and get it
shut down and they're.

Speaker 1 (11:02):
Like, yeah, no, I think if a ton of people
go on right now, you can go to the three
dots and report profile. Then you can put something about
this profile and then put down. Then you go down
and it says pretending something where I just had it,

(11:22):
pretending to be someone.

Speaker 4 (11:23):
Else, fake profile, fake profile, that's it.

Speaker 13 (11:31):
And then.

Speaker 4 (11:33):
Then it's pretending to be a friend.

Speaker 1 (11:35):
You put down, and then you put the friend's name
in there, which is Linda, and then you know, that's
that's all you can do.

Speaker 4 (11:46):
And I did it.

Speaker 10 (11:47):
But listen, I had a phone number that she was
sending text messages too, but it just says it's a
private landline. I wonder is there any other way I
can get more information on the phone number. I mean,
I don't know if that's.

Speaker 4 (12:01):
You have a phone number for this phony maloney? Yeah,
I don't. Yeah, but it's a landline.

Speaker 10 (12:13):
Well, I think it says it's the landline on when
I looked it up online. But the lady that was
texting the other lady for the couch, she's the screenshots
of the lady texting and the phone number that it
was associated with, and then the Benjamin Edwards for time.

Speaker 1 (12:32):
You know, when I put pretending to be Linda Chappelle,
it doesn't let me enter it. You know, there's something
weird about this. You're not the first time this has happened.
I don't even know how we post to this profile
to let people know she's a scam.

Speaker 4 (12:47):
The picture on this front page holding that tray, who
is that?

Speaker 7 (12:54):
That's me?

Speaker 4 (12:57):
So you're on there, and.

Speaker 10 (13:00):
That was the last picture she posted of me back
in twenty three.

Speaker 1 (13:05):
And all the photos that I see on here, all
the photos are yours, are your mom's.

Speaker 4 (13:11):
Yep, yep. But she so she's just using it to
get to the marketplace.

Speaker 1 (13:16):
Correct, Okay, man, if anyone has any ideas, give us
a call.

Speaker 4 (13:22):
God, I don't know what to do.

Speaker 1 (13:24):
I'm gonna I'm going to ask some of our experts.
I don't know if they're going to have any answers.
I mean, can't your mom just ignore it?

Speaker 4 (13:31):
Can she can?

Speaker 7 (13:32):
She?

Speaker 4 (13:32):
Why doesn't she just start a whole new page.

Speaker 10 (13:35):
They won't let her. They will not let her do
a page.

Speaker 4 (13:38):
That's why she said, or reason why she was, well,
why why can't she do a page?

Speaker 1 (13:43):
Well, if she tried, there are a lot of Linda
Chappelle's why can't she do a page?

Speaker 10 (13:47):
She did start a new page, and they shut that
down like a week after she started a new page,
and then she just said, screw it, I don't even
want to be on there. So she just forgot all
about it. And then all of a sudden, now getting
random people calling wanting their money.

Speaker 1 (14:03):
Well, we got to find out who has this profile. See,
this is the problem with Facebook. There's no one to
talk to exactly. God, I mean, it's just not right.
You're not the only one going through this crap. I
mean there's so many people.

Speaker 10 (14:22):
Yeah, the only reason why she wanted to be on
Facebook is just so she could see pictures of her
grand babies.

Speaker 12 (14:27):
And that's literally it.

Speaker 4 (14:29):
I wish we could do. You know what I'm gonna do.
I want to talk to one of my.

Speaker 1 (14:33):
Attorneys back east to do class action lawsuits. I will
bet you there's a giant class of people who've been
hacked that Facebook refuses to investigate.

Speaker 4 (14:43):
That sounds like a class action to me. It really does.

Speaker 1 (14:46):
I mean, this woman is being harassed, her reputation is
being ruined. I'm gonna I'm going to look into that.

Speaker 4 (14:53):
I really am. I'm going to look in.

Speaker 1 (14:55):
Don just leave your information for us, and I am
going to look into that. Coming up, Scott wants to
talk about legal advice for defamation and Dana wants to
talk about being scammed by some Harlan Woods.

Speaker 4 (15:08):

Speaker 5 (15:09):
Oh, wait to hear what I found out about Harlan Woods.

Speaker 4 (15:13):
Did you look up Harlan Well, yeah, I've been looking them.

Speaker 4 (16:43):
Scott, what's going on with you? What's happening? Scott?

Speaker 1 (16:47):
Hi?

Speaker 7 (16:47):
Tom?

Speaker 9 (16:49):
Let the show we're showing on with news. I have
a situation where my girlfriends family, specifically her daughner recently
got married about a twenty days ago, and this guy,
he's only been in a family one hundred and twenty
days married, and he has gotten my girlfriend fired from

(17:11):
a job she was that for ten years. He has
called my job and told them that I'm on drugs,
which I'm not.

Speaker 1 (17:22):
Now, hold on a second, why is this new son
in law causing all this trouble?

Speaker 9 (17:29):
We don't know it's we didn't know who was behind it.
We've only recently started to piece together the pieces. But
the facts we know we see contacted our landlord first
and told them that we were doing drugs and dealing
drugs out of the house. And this is sparkpetch we have.

(17:49):
We've got gone and got drug tests every week to
prove it. I mean, it's ridiculous statement. We're fifty seven
years old, were grandparents who we just don't Well.

Speaker 4 (17:58):
Wait a minute, though, what most evaded this guy to
do all this hate? What happened? I mean, I mean,
first of all, when he was dating, when he was
dating your.

Speaker 1 (18:07):
Girlfriend's daughter, did he have problems with the family, Well, no, not.

Speaker 9 (18:12):
Really, he did. My girlfriend and the mother she has
four girls and the oldest one is the one that
got married. She should be coming out in any minute.
But anyway, she had doubts about him, and he comes

(18:33):
through a very very very wealthy family, I mean one
hundreds of millions, and he doesn't work. He's never worked
a day like and he's thirty some five. Anyway, she
had doubts about him and was worried, but her daughter
was in love with them, and I gave the advice
that if she loves them, you have you have to

(18:54):
get behind the marriage.

Speaker 1 (18:55):
And Scott, I have some I have some pulimentary questions here. Yes,
what does what does your girlfriend's daughter? What's her first name?

Speaker 9 (19:06):
Her name is Jade, Jane, Jade. He likes color.

Speaker 4 (19:12):
Okay, Jade.

Speaker 1 (19:14):
What does Jade say about her new husband doing all
of this?

Speaker 9 (19:20):
So she has filed for a restraining order against.

Speaker 1 (19:24):
Wait a minute, she is wait wait wait, so she's
siding with her husband.

Speaker 9 (19:30):
Absolutely she We've learned that she is very motivated by
the money.

Speaker 1 (19:36):
Okay, So Jade and this guy have a vendetta against
the family.

Speaker 9 (19:45):
We don't we don't understand why. But anyways, the mother,
my girlfriend, Carrie, just got in the that came out
from a doctor's appointment, and she can add the story too.

Speaker 1 (19:58):
But I mean, okay, but but but Scott, Scott, here's
what I don't understand. Yes, Jade is dating this guy,
Jade marries this guy, and this guy goes on a
vendetta against the family.

Speaker 4 (20:12):
Why what motivated him?

Speaker 9 (20:15):
So here's what I think motivated on them. There was
a call in which Jade and her mother speak several
times a day the entire life. He's in her thirties
tells thirty three, thirty three years old. They talked daily,
probably five ten times a day, every day, and now
she has a spoken to her.

Speaker 1 (20:34):
In a month.

Speaker 9 (20:35):
So what motivated parent tech was.

Speaker 11 (20:40):
Everything?

Speaker 9 (20:41):
At the time, I came home and she was on
the phone and speak your phone with her daughter, and
we kind of got into a little fight, and Jade
spoke up and together her mother and that was great,
you know, fine, And then a couple of days later
it was a very minor issue. I don't remember what
it was, but it's a couple of days. Here they're
on the secerphone again and I hear something that just

(21:06):
pissed me off, and I thought to myself, well, you know,
she chimed in on mine. I thought I'll shove in
on theirs, and I called this guy basically.

Speaker 1 (21:15):
What did you what did you hear that pissed you off?
What did you hear was he saying something about you? No?

Speaker 9 (21:22):
He left he left her to New York, across the country.
And that wasn't originally what he said he was going
to do. When they first got married, we thought he
was going to stay here. They had a two million
dollar house in Boulder. But then they have all these houses?

Speaker 1 (21:38):
Are they are they living? Is Jade and her husband
living in New York?

Speaker 13 (21:42):
Now?

Speaker 9 (21:43):
Yes, they are in Long Island?

Speaker 4 (21:46):
Okay, So hold on, hold on. I just need to know.
How is this guy?

Speaker 1 (21:52):
Why does this guy take the energy to spread rumors
about you and about your girlfriend?

Speaker 9 (21:59):
I have I have no idea.

Speaker 4 (22:01):
How do you know? How do you know he is
the one doing it?

Speaker 9 (22:05):
Because I have my landlord. Nobody will tell us really
what's going on? That's my landlord, who I've been there
three years, suddenly shows up, does an inspection and basically
wants to fight me and tells me, you guys can
get out at least anytime you want, and when the
least is up, you guys are out. And I'm like,

(22:26):
what is going on? And then they send us a letter.

Speaker 1 (22:30):
Scott Scott, Thank Scott. Let me just talk to you here.
I'm being straight with you. You don't have enough for
a lawsuit. You don't have enough for a lawsuit.

Speaker 9 (22:44):
Well, in writing that, I have the landlord saying that
he talks to them and accuse us of something. They
don't say what, but we get have been at them,
and they have to reveal the contents of the conversations.

Speaker 1 (22:55):
Okay, okay, Scott, Scott, let me ask you without Scott, Scott,
what damages have been caused to you?

Speaker 9 (23:06):
Well, watch my job. She's off a job for ten years?

Speaker 4 (23:10):
Scott. Did she lose her did did your girlfriend lose
her job?

Speaker 11 (23:16):
Yeah?

Speaker 9 (23:16):
Yes, a ten year job?

Speaker 4 (23:18):
And it's okay, will.

Speaker 1 (23:20):
Will the will the uh employer testify that she was
fired due to what this guy said.

Speaker 9 (23:31):
I don't know, still have to say what he said.
And then he called in the first place, and he
called my job to and my job he said specifically
that I'm on drugs, and.

Speaker 4 (23:42):
They said, so what of our does your did your
job tell you that?

Speaker 9 (23:46):
He called absolutely my manager?

Speaker 4 (23:49):
Did okay, did that cause you to lose your job?

Speaker 7 (23:54):
I am?

Speaker 9 (23:55):
I was, I'm out of work and I can't go
back to there and an investigation and.

Speaker 4 (24:02):
Okay, so hold on, let me get this raight.

Speaker 1 (24:04):
So Scott, Scott, what you're saying is you and your
girlfriend have been harmed by this guy. The proof, the
proof that would be involved before you even get an attorney.
You need solid evidence. And I need to ask you
a very important question. How are you going to pay
for this lawsuit?

Speaker 9 (24:26):
I don't have anybody at all.

Speaker 4 (24:28):
Well, what did you think they were going to do
that the lawsuit for free?

Speaker 11 (24:33):
No?

Speaker 9 (24:33):
I thought that there's these people are worth hundreds of
millions of dollars.

Speaker 4 (24:37):
They don't go No, no, the attorneys don't.

Speaker 1 (24:39):
Attorneys don't do defamation lawsuits on contingency.

Speaker 9 (24:43):
Okay, I didn't know if it would if there's a
big case. I thought it just sam my opinion.

Speaker 1 (24:49):
No, no, there is no, no, there is no slammed.
I'm going to be straight with you, Scott. You called
me to be straight. I don't even if you're telling
the truth. The enormous amount of the enormous amount of
fact gathering and time it would take an attorney, no
attorney will ever take this case on contingency.

Speaker 4 (25:09):
First of all, First.

Speaker 1 (25:11):
Of all, what I'm saying, Scott is there are not
enough damages for them to put in the time and
energy because.

Speaker 9 (25:20):
I've ruined my reputation.

Speaker 1 (25:21):
I know Scott have a good day. I think it's terrible.
I think it's terrible. But unless you have fifty thousand
dollars just to get to depositions, you're not going to
be able to find I can't find you an attorney.

I'm at the Mothership. No, I'm not the mothership. I'm
at the satellite ship, my studio with Deputy d and

(26:26):
back at the home ship the mothership, we have Jay
Bretts with Excel Roofing.

Speaker 4 (26:33):
We'll be talking to him in a few minutes. What's
on your mind, Dana.

Speaker 1 (26:38):
Dana says she was scammed by a guy that's been
in the news over the years and is a pretty
famous scammer. Now, Deputy d what are some of the
things before we even hear from Dana? Would give us
some background on this guy, Harlan Woods.

Speaker 5 (26:55):
Tom.

Speaker 6 (26:55):
I found a couple of notable things, and then I
just stopped searching because this seems to be enough. By
six years ago, even Channel thirty one did a story
about It's entitled Denver.

Speaker 5 (27:07):
Family says contractor didn't finish the job.

Speaker 6 (27:09):
And they want to warrant theirs and that that was
in twenty nineteen then, and that was a very easy
to find story. And then I did a search for
current lawsuits. So mister Woods operates a company called MR one,
which is I think it's sense.

Speaker 5 (27:26):
For mold Remediation one or mold removal.

Speaker 4 (27:29):
One or something Old Response one, Mold Response one.

Speaker 6 (27:32):
Yeah, So there is a current case in Jefferson County
District Court for pretty much the same thing. These these
former customers of mister Woods are suing their alleging breach
of contract. They're alleging civil theft. They're also alleging that
mister Woods. Now this is an allegation written in a lawsuit.

(27:52):
These aren't my words, but basically, mister Woods threatened the
customers by saying that, hey, he knows some people who
can take care of them and can take them out
and so on. So that's all spelled out in a
lawsuit too. I mean, this guy really seems to be
just man. Harlan Wood's just full of trouble.

Speaker 4 (28:13):
Okay, now your turn, Dana.

Speaker 14 (28:18):
So I met harln about well, originally I met him
four years with three or four years ago on Craigslist
and I told him a video.

Speaker 15 (28:26):
Game, a skin up video game, and he paid me
for that, and I had for sale on the side
of my truck and it was a two thousand and
five GMC Yukon and I had my phone number on it.
And I ran into this guy at King Supers and
then I clicked in my head and I said, oh,
I remember you.

Speaker 11 (28:41):
I told you a video game before.

Speaker 15 (28:42):
And he was telling me how he was doing all
this great and he's a general contractor and he's got
so much work.

Speaker 14 (28:48):
And mind you, I'm just coming out of being homeless,
like I've just been in a home for three.

Speaker 15 (28:54):
Weeks now, and I was selling my trucks because a
lot of my people that I've met through being homeless
know that my truck starts with any key. And I
got tired of waking up in the morning and the
truck being gone, having to go track it down, and
you know, so, I just really wanted to get me
something that.

Speaker 4 (29:10):
I So you met Harlan Woods.

Speaker 1 (29:12):
He was going, let's just we can just summarize this
by saying, did you sell that truck to Harlan Woods?

Speaker 10 (29:19):
Yes, I sold.

Speaker 14 (29:20):
So I sold that truck on Harlan Woods, and he
gave me a cashier check.

Speaker 4 (29:25):
Put her on hold.

Speaker 1 (29:26):
Please put her on hold, Please put her on hold.

Speaker 4 (29:28):
Please, thank you. Bro, Just explain to Dana when I come.

Speaker 1 (29:33):
Back to her, what the rules are. I want to
wait for our delay to spool up. She said the
SHI word, and I don't want to I don't want
to say it, and I don't mind.

Speaker 4 (29:45):
I don't blame her for being upset.

Speaker 1 (29:47):
I think she's going to tell us she sold her
two thousand and five gmcu con to him, and I
think he hasn't paid her.

Speaker 4 (29:56):
So we'll come back to that and more coming up.
I'm Tom Martinez.

Speaker 1 (30:00):

Speaker 4 (31:04):
Hey, I'm Tom Martino. You're a troubleshooter.

Speaker 1 (31:08):
Dana was telling us that she met this guy Harlan
Woods years ago, ran into him again and sold her
truck two thousand and five. Gmc yukon and he gave
you a cashier's check.

Speaker 16 (31:24):
Yes, he may cashier's check.

Speaker 15 (31:26):
And so the first one bounced and I called him
and asked him. I said, what's going on? And like,
how like the check bounced? He's oh, I forgot to
confirm it when I.

Speaker 11 (31:35):
Got the email.

Speaker 4 (31:36):
How much was the how much was the check for?

Speaker 15 (31:40):
Sixteen dollars?

Speaker 4 (31:42):
Well, only six sixteen hundred.

Speaker 17 (31:44):
How does the cashiers check even bounce because that's in.

Speaker 1 (31:47):
The bank, it doesn't bounce. I mean it was a
fake It was a fake check.

Speaker 5 (31:51):
It was a fake check.

Speaker 7 (31:53):
Yeah, they are fake checks.

Speaker 16 (31:55):
And so I went back and I got another one
and that that one bounced as.

Speaker 15 (32:02):
Well, and I sent him a message.

Speaker 14 (32:03):
I said, Harlan, dude, really, are you really doing this
sumary now?

Speaker 10 (32:05):
Like you know my situation?

Speaker 15 (32:07):
Oh no, no, no, I pulled the money out of there,
out of the bank when.

Speaker 14 (32:10):
It hit, and I'm gonna send you on cash app.

Speaker 11 (32:13):
And I said, okay, why would.

Speaker 15 (32:14):
You do that because that's seventy five dollars on my
account that I asked pay now. Oh no, no, I'll
take care of it. I'll take care of it. Put
me your cash tag and I'll send me a cash up,
send my cash tad never no cash appay.

Speaker 14 (32:27):
Later he sends me a chime payment for two hundred
dollars for a hot water heater that my brother sold
him while I was selling him the truck.

Speaker 15 (32:36):
He sends me two hundred dollars. And then I said,
why are you sending me two hundred dollars when you
owe twenty four hundred because it's sixteen hundred for the truck.

Speaker 14 (32:44):
Eight hundred dollars for the hot water heater. Oh, my
wife's going to take care of it later.

Speaker 11 (32:48):
Blah blah blah.

Speaker 16 (32:50):
Never nothing, not another payment.

Speaker 15 (32:52):
It's just ongoing, ongoing, ongoing.

Speaker 18 (32:55):
And so finally I.

Speaker 11 (32:56):
Called the police.

Speaker 15 (32:56):
I'm okay. So there is tim the situation.

Speaker 14 (32:59):
He's giving me two fragment like complete fate checks and
uh deadwater pops sided with him and at the end
of the day tell me to quit harassing him.

Speaker 1 (33:10):
Wait, wait a minute, Wait a minute, the police, the police,
it is not a civil matter. If you do you
still have those bad checks, of course I do. You
can go to the district attorney. It's not a civil matter.
It's a criminal matter.

Speaker 15 (33:26):
Oh well, they're telling me that the Edgewater cops sided
with him right.

Speaker 7 (33:29):
Away and told me it's a civil matter, Edgewater water.

Speaker 1 (33:33):
Well, that's why the Edge Edgewater Police Department, the whole
city of Edgewater sucks. You need to go to the
district attorney and bypass these idiots. No, I'm serious when
I tell you that Edgewater they're a bunch of idiots.
I haven't heard from them in a long time, but
every time I do, they're idiots.

Speaker 4 (33:50):
They're absolute idiots. Yep.

Speaker 1 (33:56):
So listen, I'm telling you, I'm telling you you need
so Edgewater.

Speaker 4 (34:03):
I hold on.

Speaker 1 (34:05):
I want d to call the City of Edgewater and
ask them if kiting checks is illegal.

Speaker 5 (34:12):
Oh, this isn't kiting checks, Tom, this is so much worse.

Speaker 1 (34:17):
I want you to ask him why why did they
turn her down? We're gonna call hold on a second.

Speaker 1 (35:22):
Tom Martino here, Welcome to the show, and let's go
to the phones. Our number is easy to remember, three
oh three Martino, three oh three six two seven eight
four sixty six. Or you can always call the iHeart
number when we're here. It's three oh three seven one
three talks seven one three eight two five five. But

(35:45):
remember three oh three Martino works around the clock and
we'll call you back. Jeanette, she's having a problem getting
her title.

Speaker 4 (35:52):
Now.

Speaker 1 (35:52):
The law says a dealership has to give you the
title within a reasonable amount of time, but they don't
specify a number of days. But it doesn't surprise me,
as I've said this before. There's not a good car
dealer in Welld County, and this is a greedy car
dealership Greeley, Longmont, the whole area up there.

Speaker 4 (36:17):
They all suck Jeannette story. I'm sorry that you bought
a car there.

Speaker 11 (36:26):
I am too, to be honest, but yeah, myself and
husband bought a car from the Hondai Greeley in April.

Speaker 1 (36:34):
In April, and it was called you bought it from
Hondai of Greeley.

Speaker 4 (36:40):
Hondai of Greeley, And what reason do they have for
not and this was in April, and what reason do
they have for not delivering title? What kind of car
is it?

Speaker 11 (36:51):
By the way, It's a Hondai's Sonata, okay.

Speaker 4 (36:57):
And what reason do they give you not having the title?

Speaker 11 (37:02):
The only reason that they're telling me is that there's
been a typo and the title. They've sent it back
to be corrected. But it's been April, and every time
we call, we're not I can't get through to Stephanie
at the title service, who still hasn't gotten it to
the county Clerk's office as of yesterday. And I can't

(37:25):
drive a car if I don't have pleas on it.
So I guess I'm.

Speaker 16 (37:30):
Kind of like in limbooks.

Speaker 11 (37:31):
I'm not getting enough.

Speaker 14 (37:32):
Information from the dealership either.

Speaker 4 (37:34):
And so well, why don't if you want to listen?
They have to undo the deal. They have to undo
the deal.

Speaker 11 (37:41):
Yeah, so what would be the steps that I would
need to take?

Speaker 1 (37:44):
Maybe to tell them or the dealer licensing board would
do that quickly.

Speaker 4 (37:49):
You know, we could call the dealer for you. But
they're just going to give us a song and a dance.

Speaker 1 (37:54):
I mean, you know if the dealers in Weld County
that you know, and Greeley, Greeley's Wealth County, right, I'm thinking, yeah, yeah, yeah.

Speaker 4 (38:02):
They all suck. They all suck.

Speaker 1 (38:05):
They're all a bunch of liars and cheaters and ripoffs.
It's amazing to me how they all gather up there.
It's amazing. We get more ripoffs coming out of We
get more ripoffs coming out of Weld County than the
entire metro area.

Speaker 4 (38:22):
Think about that.

Speaker 11 (38:23):
So I'm learning about that really is obviously learning.

Speaker 14 (38:26):
The hard way.

Speaker 11 (38:28):
So they under the deal and I traded in a
vehicle that was running perfectly fine, how do I go
about that? Are they just going to give me the
money that was for the vehicle back in casual?

Speaker 1 (38:39):
They well, they have to make you, they have to
make you whole again. That's where their dealer licensing board
will tell them what to do.

Speaker 4 (38:47):
Okay, I mean, what is your car still there.

Speaker 11 (38:53):
At the dealership?

Speaker 4 (38:54):
No?

Speaker 11 (38:54):
I don't think so.

Speaker 1 (38:56):
Well, how did they sell it? They haven't even done
this this? Do you have this car financed? Yes?

Speaker 4 (39:04):
Well, what does the bank say about not having a title?

Speaker 11 (39:08):
I haven't talked to the bank yet about it because
I've only really started the county office trying to get
it to the court.

Speaker 1 (39:15):
Well, I would call two places right now. Really, this
is what you need to do. You need to call
the dealer licensing board okay. And okay, let me find
the phone for them, and maybe you can find it,
do you while we're talking.

Speaker 4 (39:36):
And then you have to call the bank.

Speaker 1 (39:41):
That's really important because the bank will they will put
heat on these people, but not to undo the deal,
but they will put heat on them for getting the title. Okay,
here is the dealer Licensing division you ready?

Speaker 4 (40:01):
Yeah? Three oh three, two zero five five six zero four. Okay.

Speaker 1 (40:12):
You call them and say I need to file a
complaint on a dealer. And what's the name of the dealer.
Did you say it was of Greeley, Hyundai of Greeley, Yeah, yeah,
And tell them that you bought a car in April
and they still haven't delivered title.

Speaker 4 (40:32):
Does anybody feel like calling for the hell of it
and harassing them?

Speaker 8 (40:35):
I'll call it.

Speaker 4 (40:37):
I have a question.

Speaker 8 (40:37):
Where's the is the card the dealership or Janetta? Are
you driving it around?

Speaker 11 (40:43):
Then? We're driving We've had it since April.

Speaker 1 (40:46):
They do they keep giving you? Do they keep giving
you templates?

Speaker 16 (40:51):
Yes, that's the third templates.

Speaker 4 (40:54):
Well, at least they're doing that great hold on go ahead.

Speaker 9 (41:00):
Yeah.

Speaker 11 (41:00):
Oh, I'm going to say they did give me a
ticket to comp I have to take it to admissions
because they didn't have that done either. But I've been
told to wait to take it to missions until the
titling gets done, but that hasn't even been done.

Speaker 19 (41:15):
I'd like to call up to this Undai dealership in
Greeley for you, just to get another phone call to
them see if they can expedite this, because not having
your title since ape are Al is ridiculous.

Speaker 11 (41:29):
It's absurd.

Speaker 8 (41:30):
Yeah, I think they should pull the damn dealer license
by the way all over there for you.

Speaker 1 (41:38):
They should do, but you know what, they'd have to
pull the licenses of everybody in Weld County honest to God,
these dealers suck so much.

Speaker 4 (41:48):
God, they suck. They suck.

Speaker 1 (41:51):
If you live up in Greeley or Weld County, do
not buy cars up there.

Speaker 4 (41:57):
So listen.

Speaker 11 (41:58):
Actually, but yeah, where's a good place to go?

Speaker 1 (42:02):
Well, if you wanted a Hyundai, I would go to
Planet Hyundai in the Denver area. Even a Wrappa hole
Hyundai is not bad. I mean, we have a lot
of good Hyundai dealers.

Speaker 16 (42:15):
I think a Honday we.

Speaker 11 (42:17):
Kind of got into it. We're Honda fans, but we've.

Speaker 4 (42:20):
Wellas a Hundais are good cars. By the way.

Speaker 11 (42:24):
Well, we broke down on the side of the road
not too long ago, and we were told that the
engine I failed because it's a no name.

Speaker 4 (42:29):
What year is it? What year is it?

Speaker 16 (42:32):
Sixteen?

Speaker 4 (42:34):
And how many miles on it?

Speaker 11 (42:36):
It's about fifty four thousand and fifty five thousand.

Speaker 4 (42:40):
Is it certified? Do you still have a warranty?

Speaker 6 (42:43):
Yes? Oh, Tom, it might be subject to that extended
warranty for their engine failures.

Speaker 4 (42:50):
No, I mean, she shit, it's underworn.

Speaker 5 (42:53):
Oh it is, okay, I just didn't hear that part.

Speaker 4 (42:55):
That's good to know. So do you want to keep
it or not?

Speaker 16 (42:58):
Jeanette, I mean, yeah, we need a vehicle.

Speaker 11 (43:01):
We've already traded in their other Honda.

Speaker 1 (43:03):
But yeah, but we're gonna have Bo scare the hell
out of Bow. I want you to really come down
hard on them and tell them what this is all about.

Speaker 8 (43:12):
I'm happy to do it.

Speaker 1 (43:13):
Bo can be very very convincing. Okay, start out with
that Bow anyway, Jenett, hang on, Okay, we'll come right
back to you. Grace has an issue with a contractor.
What else is new? I said, Our top top complaint
getters in the last two years used cars, which we

Speaker 5 (44:43):
No, yipd Dmitri called digwater.

Speaker 4 (44:45):
That's what I meant. I'm sorry, Dmitri.

Speaker 1 (44:48):
Deputy d you called over and said, why don't you
take forged checks?

Speaker 4 (44:53):
Seriously? Yeah, I put it.

Speaker 20 (44:55):
You put it more diplomatically, put it very diplomatically, because
my intent is to get them to do something about it,
not just to put him right on the defensive, you
know what I mean.

Speaker 5 (45:03):
So I was unfailingly polite.

Speaker 6 (45:05):
I spoke with a sergeant who is actually in their
press relations department. But the sergeant and I discussed it,
and it turns out he's currently on a call. So
what we agreed is that he's going to finish this call,
they're going to catch the crook they're chasing, and then
he's going to call me back.

Speaker 5 (45:24):
But I did fill him on the on some of
the details.

Speaker 6 (45:26):
So he's going to research it and then we'll have
a discussion offline as soon as he's done with his call.

Speaker 4 (45:31):
Oh you look good on camera there, I have the
tight shot of you right now. Thank you. Yeah, that's
deep and d for everyone, and want to know what
he looked like. Let the ladies know. So anyway, day mom,
you did say.

Speaker 1 (45:43):
Though we had a specific case where a guy was
forging checks.

Speaker 5 (45:48):
Yeah, I suppose.

Speaker 6 (45:49):
I told the sergeant that this is regarding two counterfeits,
a series of two counterfeit cashiers checks that were written
in passed within his jurisdiction, and I said, it sounds
to me, based on our callers information is the responding
officer may have mistakenly understood.

Speaker 4 (46:06):
This as Oh, I love the way you put that.

Speaker 6 (46:08):
And so the sergeant is going to research this a
little bit and after he got catching his crooks for
the day, he's going to give me a car.

Speaker 5 (46:15):
We'll see if we can help Deanna.

Speaker 1 (46:17):
Excellent, Now Grace did we didn't take Grace yet? Now, Grace,
what's going on?

Speaker 2 (46:26):
Hey?

Speaker 4 (46:26):
Yeah?

Speaker 21 (46:27):
So I was working with a contractor. I was a
contractor selling boring and cabinets and countertops and the carpet.

Speaker 1 (46:38):
So you wait, wait, Grace, are you saying are you
saying you're a subcontractor?

Speaker 6 (46:44):
Yes?

Speaker 1 (46:46):
Okay, and what happened and you're a subcontractor for floors.

Speaker 10 (46:54):
Exactly?

Speaker 4 (46:55):
Okay, go ahead, I'm sorry.

Speaker 21 (46:56):
Along with dry waller's, painters, electricians, plumbers, we were all
working for a contractor that was pulling large draws from
a flipping a house flipping company in Colorado Springs and.

Speaker 9 (47:15):
He basically walked out.

Speaker 21 (47:17):
He kept getting draws from the flipping company.

Speaker 4 (47:22):
And didn't pay.

Speaker 1 (47:23):
Okay, So hold on, So are you saying that you
and all the other subs have not been paid?

Speaker 9 (47:31):
Yes, I know I have not.

Speaker 21 (47:34):
I don't know about the other subs yet because I'm
not in contact with any of them.

Speaker 4 (47:39):
Direct. What's the name of the general contractor?

Speaker 21 (47:44):
Seventh Contracting?

Speaker 4 (47:46):
Seventh?

Speaker 21 (47:48):
Uh huh, Seventh Contracting. It's in Taylor County. But we
were doing flips in the Springs and in Publo.

Speaker 4 (47:56):
Okay, Now, what is their excuse for not paying you?

Speaker 21 (48:05):
Not managing the money correctly?

Speaker 9 (48:08):
I guess.

Speaker 1 (48:09):
And who is the person at seventh contract Who is
the main guy at Seventh Contracting?

Speaker 21 (48:18):
Colton Brody, Colton.

Speaker 1 (48:20):
Man My god, he even has a uh, he even
has a villain's name, Colton Brody. So what does mister
Colton Brody say?

Speaker 4 (48:32):
Did he?

Speaker 1 (48:32):
Is he claiming he hasn't been paid? I mean, what
line of bs is he giving you?

Speaker 7 (48:39):
No?

Speaker 21 (48:39):
So, so I actually knew the slippers very well, and
the slippers had said that they had already paid him
the draws from every single one of the fourteen houses.
And this was back in March of last year that this.

Speaker 7 (48:55):
All blew up.

Speaker 1 (48:56):
And hold on, do they realize, you know, you lost
your ability to put a lien.

Speaker 4 (49:02):
You could have put a lien on the house.

Speaker 21 (49:06):
Well, the house has happened within from November of twenty
twenty three to March of twenty twenty four.

Speaker 4 (49:15):
Why didn't you put a lean? Why didn't you do
a lean? Why didn't you do a lean?

Speaker 21 (49:20):
Because I did not know that he was not going
to pay he has he had a silver tongue. None
of us knew he wasn't going to pay us.

Speaker 4 (49:28):
I get you.

Speaker 1 (49:29):
He was a smooth talking he was a smooth talking
piece of crap.

Speaker 21 (49:35):
Yeah, and fourteen houses later, the houses had already been
sold to another person. Also, So even in that ninety
day period we were fourteen.

Speaker 4 (49:42):
How much are you owed?

Speaker 21 (49:46):
Eighty seven thousand dollars?

Speaker 4 (49:48):
Oh my god, how are you surviving?

Speaker 21 (49:53):
I haven't taken a paycheck in the past year to
keep my business running.

Speaker 9 (49:57):
All right?

Speaker 4 (49:58):
Where can we find this? Milton Brody.

Speaker 21 (50:03):
Seventh contracting Colton Brody. He's on LinkedIn. He also owns
a house and Divide.

Speaker 4 (50:13):
You know, here's what I want to know. Here's what
I want to know. Do you know? I mean? This
could be a crime. This could be a crime.

Speaker 1 (50:22):
You understand that if, of course, we can find a
district attorney with balls enough to enforce the Contractor's Trust Act.

Speaker 4 (50:29):
I am so sick and.

Speaker 1 (50:30):
Tired of lazy, good for nothing government officials when we
have people like Grace getting ripped off for eighty seven grand.
So listen, Grace, when was the last time you talked
to anyone associated? Because a lot of time has passed
right now. The last time you guys were on the
job is twenty twenty four. When was the last time

(50:51):
you talked to any of the other subs?

Speaker 21 (50:57):
I haven't I reached out a few months ago to
the flip guy and he said that he also hasn't
heard from him or.

Speaker 4 (51:07):
Do you know where Coulton is right now?

Speaker 1 (51:09):
I mean, is there a way to find Is there
a way to find Colton physically?

Speaker 4 (51:13):
Where he is?

Speaker 7 (51:16):
Yes?

Speaker 21 (51:16):
There is, because I saw him at Low's last weekend.

Speaker 4 (51:20):
Where is he hanging out?

Speaker 1 (51:22):
Now?

Speaker 4 (51:22):
Is he in Teller County hanging out? Where is he
hanging out?

Speaker 7 (51:27):
Yep?

Speaker 11 (51:27):
Yep?

Speaker 21 (51:27):
He still has his house out there and is still
doing work in Colorado Springs, So I guess I'll pass
Hoteller area.

Speaker 1 (51:35):
And how is he getting work? How is Colton Brodie
used to work on that deed?

Speaker 13 (51:41):
Colt?

Speaker 5 (51:43):
For one thing, he has an a plus rating at
the Better Business Oh no, no.

Speaker 1 (51:46):
That doesn't surprise me at all. We sent people to
prison that had a plus ratings. Anyone who puts any
stock in the Better Business Bureau of You're crazy.

Speaker 4 (51:56):
They they know nothing.

Speaker 1 (51:58):
All they know are complaints file and people responding. They
don't know who's good or who's bad. It's the biggest
sham to ever hit the universe, is the Better Business Bureau?

Speaker 4 (52:09):
Well? I do have his address, okay, in case she
needs to serve him.

Speaker 5 (52:12):
You know, this is one of those cases for sick.

Speaker 4 (52:15):
And tired of people being ripped off.

Speaker 1 (52:18):
Wait you know what, God, I wish it was the
good old days where I could take my YouTube morons.
We could all suit up and get on our horse
and go after these jerks like a like a.

Speaker 4 (52:31):
Like a posse.

Speaker 1 (52:32):
Uh, and let's just get them out of business. Okay,
we really need to do something here.

Speaker 8 (52:39):
Take a phone call over to a Colton Brody. I
have looked up a phone number for him.

Speaker 1 (52:44):
Okay, you know what. I got two of you in
the house today. Let's do well, I'm going back and forth,
so I guess it's your turn.

Speaker 4 (52:50):
Bow. Just do me a favor.

Speaker 13 (52:53):
Bo.

Speaker 8 (52:54):
Yeah, I mean, let him know.

Speaker 1 (52:56):
This is the contractor's Trust Act here, Grace, here's what
I want to know. You really got me fired up here.
I feel sorry if you're honest to God. Eighty seven
thousand dollars, but this is what I want to know, Grace.
Do you think this clown has the money or do
you think he just burns through it?

Speaker 21 (53:16):
I think that he had very poor spending habits and
owed a lot of other people money. Because I had
also heard that he had done something like this in
Pueblo and then moved to El Paso County. But I
think that I know for a fact, he has the
equity in his home.

Speaker 1 (53:34):
Well and by the way, hold on, I want to
do something right now. Do you think he's still on
the deed of his home.

Speaker 4 (53:45):
I believe so.

Speaker 21 (53:46):
I mean that's something that we can find online on
the Teller County Assessor's office pretty easily.

Speaker 1 (53:52):
Okay, Colton Brodie, I'm just getting some stuff here coming up,
and I want to get a picture of him for
the Sleeves Brigade.

Speaker 4 (54:02):
Is he a black man?

Speaker 6 (54:03):
No?

Speaker 1 (54:04):
No, okay, okay, I'm just serious because there are some
Colton bro Well, not are some. There's a Colton Brony
that came up that's a black man. There's also an
Asian man that came up as well, but it's spelled
a different way.

Speaker 4 (54:17):
So do you have a photo of this guy? I
do know you do? Good, send it to me for
the Sleeves Brigade.

Speaker 1 (54:23):
Listen, I don't know if we'll get your money, but
we're sure going to raise hell and grace. You should
go to the district attorney about this. There's something and
when you go, you got to educate them because a
lot of district attorneys are are stupid. You have to
tell them that you're concerned about the Contractors Trust Act

(54:48):
and that he violated the Contractor's Trust Act. It would
be good if we could get some other subcontractors together
with you. Do you think you could make an attempt
to do that that and have them call us. I mean,
if they haven't been paid, I think they would be happy.

Speaker 4 (55:04):
For us to make noise.

Speaker 1 (55:06):
Do you think there's any way for you to get
a hold of them?

Speaker 7 (55:11):
I know of one. Okay, maybe try to get.

Speaker 4 (55:17):
A try to get a hold of them.

Speaker 1 (55:19):
Yeah, I want you to be you're going to be
communicating with Deputy Bow on this.

Speaker 4 (55:24):
I put that we call our people deputies.

Speaker 1 (55:26):
It's kind of a joke because we're out, you know,
we're out gunning for people and we're we're it's like
the troubleshooter and all.

Speaker 4 (55:33):
I hope anyway, Yes.

Speaker 19 (55:35):
Well, to bring out Grace should also get in touch
with the Neil Hollington Law law firm, the construction attorney,
just to get a console because this is a large
amount of money.

Speaker 4 (55:47):
Yeah it is, it is. Yeah, my pay went under Grace.

Speaker 1 (55:52):
I'm going to ask you the sixty four thousand dollars question,
or let's say the eighty seven thousand dollars question. Do
you have any of your agreements with Colton Brody scumbag extraordinaire?

Speaker 4 (56:05):
Do you have any of the contracts in writing.

Speaker 21 (56:11):
I don't have anything in writing besides texts and agreements
to Google calendar to install, you know, install carpets and
things like that.

Speaker 1 (56:21):
See a lot of you guys, A lot of you
guys in the construction business. You guys do like crazy crap.
I mean, you guys do a lot of stuff on
a handshake.

Speaker 4 (56:34):
Yeah, it was.

Speaker 21 (56:36):
It was a rookie business move on my part. It
was the first time I'd ever gotten a contract that
big and worked with somebody and had fourteen houses in
four months with my small business. I was and now
I learned a lot about laws now that I did.

Speaker 1 (56:51):
All right, Grace, hang on, I'm hang on. We'll get
your information for bo. I'm Tom Martine.

Speaker 4 (56:57):
Listen. I don't know what it is. I don't know
what it is. I have been emotionally distraught recently. I
don't know.

Speaker 1 (57:08):
I've always been involved in what I do and care
for people, and I do care for people a great deal,
and I have just been so pissed off lately about
people getting ripped off.

Speaker 4 (57:20):
I mean right to my core. Think about this, people,
think about this, eighty seven thousand dollars you have on
the books. You're hiring people, you're buying material.

Speaker 1 (57:33):
You're saying, hey, my small business has eighty seven thousand
dollars in work, and then you don't get paid. Or
think about think about the used car. You know, you
buy a used car and you get ripped off. Or
think about.

Speaker 4 (57:50):
Dana she was recently homeless, just got a place.

Speaker 1 (57:54):
She was selling her two thousand and five GMC to
Harlan Harlan Woods, And that's scumbag.

Speaker 4 (58:03):
Rights are a bad cashier's check.

Speaker 1 (58:06):
And to make matters worth Edgewater Moron police the moron
Edgewater Police department says it's a civil matter. Let me
explain something to Edgewater Police Department really quickly.

Speaker 4 (58:19):
It's not a civil matter.

Speaker 1 (58:21):
When someone forges and kites bad checks, it's a criminal matter.
Get off your asses, put the doughnuts down, and get
to work. I saw your little website about Edgewater Police
protecting the community. We'll do some protecting you morons. No,
I should never use the term morons. That's an endearing
term for my YouTube people. But as I was saying,

(58:43):
and I swear to God, I don't know what it is,
but maybe it's since my battle with cancer and I
look at people with so much more empathy. I've always
been empathetic. I've always cared about my job, so don't
give me any crap. But there's something different about me
doing the show now. It could be all the crap
I put through my body, the chemotherapy, the radiation, all that.

(59:04):
I don't know what it is, but my brain right
now can't handle this. I find myself saying prayers for people.
I find myself crying for people, and maybe I'm getting
a bit emotional.

Speaker 4 (59:15):
But I'm going to tell you something.

Speaker 1 (59:17):
We as a collective, we have to stop these line
cheating ripoffs.

Speaker 4 (59:20):
I swear to God we do. We have to stop them.

Speaker 1 (59:23):
Please protect yourself, okay, please make sure you not only
get things in writing, but don't pay ahead of time.
And if you're a subcontractor, don't let those bills mount
up that much. We got to all collectively help each other.
You know what I love about this show too, And I.

Speaker 4 (59:42):
Got to mention this.

Speaker 1 (59:43):
It doesn't matter what's going on in politics, it doesn't
matter we as a group listening to this show are
for the same exact thing. It doesn't matter if you're
conservative or liberal. We can't put a spin on this one.
We hate ripoffs. We need to help each other. So
you gotta spread the word about bad guys any way

(01:00:05):
you can. You gotta go online, you gotta do reviews,
you gotta do whatever you can.

Speaker 4 (01:00:10):
We have to make noise. This is the only show
doing it. We gotta make noise.

Speaker 1 (01:00:16):
God loved the other hosts when they preach about politics
and all of that crap.

Speaker 4 (01:00:22):
But that's not what we're doing.

Speaker 1 (01:00:23):
We're saying, eradicate, lying, cheating, ripoffs.

Speaker 4 (01:00:30):
Wow, Okay, we better take a break.

Speaker 1 (01:00:32):
I'm just gonna go on and on and also say
a prayer that these people find some justice.

Speaker 4 (01:00:37):
We got more coming up.

Speaker 1 (01:00:44):
Go with a sure thing Denver's Best Roofer Excel roofing
dot com. You don't pay a cent until you're content.
Time for an insurance check up, free no obligation. In comparison,
call Compass insurance paying too much your coverage had dozens
of insurance companies find out now three all three seven
to seven to one help. You'll think you're his only

(01:01:05):
customer When you choose Frank durand the real estate man
dot com to list your home with Remax Alliance three
all three nine two zero sixteen twenty two. Hey, I
want to talk to Henry Bretts from Excel Roofing. Henry,
you know, I used to joke with your dad that
during the winter he goes to the beach because he
can't do roofing. And of course Henry's taking over. I'm

(01:01:28):
not going to say he took it all over, but
he does most of the work. While Jay is enjoying
the fruits of his loins. His son is taking over
the business, so he has So Henry is enjoying the
fruits of Jay's labor, and Jay's enjoying the fruits of
his loins by having his son.

Speaker 4 (01:01:46):
Why do you find that so? Why do you Why
do you give me a frown? I'm going to say that.

Speaker 5 (01:01:52):
Choice of words.

Speaker 1 (01:01:54):
What I meant was, he has a son who he's
able to give the reins to. Isn't that wonderful?

Speaker 5 (01:01:59):
Eyebrows? That's the opposite of a frown. Oh, this is
a frown.

Speaker 4 (01:02:02):
You thought it was very creative.

Speaker 5 (01:02:04):
I thought it was very creat Thanks, very impressed.

Speaker 4 (01:02:06):
Thank you.

Speaker 1 (01:02:06):
Now, Henry, So I used to joke that he doesn't
do anything in the winter or in the fall.

Speaker 4 (01:02:14):
But you guys have added something to what you do.

Speaker 1 (01:02:17):
And I've always thought by the way that excel Roofing
is such an excellent company no matter what they do.
And I'm really serious, Jay is a genuine, one, genuine guy,
and I swear to God he wouldn't cheat people, even
if it wasn't against the law.

Speaker 4 (01:02:35):
He would never do anything seedy so or shady.

Speaker 1 (01:02:39):
So what do you what do you have the new
activity that people can hire excel Roofing for.

Speaker 17 (01:02:46):
Yeah, Tom, absolutely so. The new service that we're offering,
and I'm going to bring up your camera.

Speaker 4 (01:02:50):
I'm going to bring up the camera. Go ahead, sir,
I got you, now, go ahead.

Speaker 17 (01:02:53):
The new service that we're offering for this year is
permanent holiday lighting. So it's very similar to some most
auducts you see on TV, the jellyfish lighting in all
those different systems, and so you're.

Speaker 1 (01:03:05):
Gonna put these lights up and they will be permanent
and you can activate them. I see that some people
even activate them for Bronco season like with orange and
blue or will they be programmable like that?

Speaker 17 (01:03:18):
Yeah, there are so the lights there are one hundred
percent programmable, so you can change them to Christmas lights,
Halloween lighting, any kind of lighting lights.

Speaker 4 (01:03:26):
Very cool. And the big difference.

Speaker 17 (01:03:28):
About what we have and what we're offering here at
Excel is we have these tracks and so you actually
can't see the lights. They fit into this metal trim
and that goes behind your gutter. So usually these lighting
systems they look like this ugly wire that's tucked up
behind the gut, yeah, or a cord of something exactly,
So this looks like a piece of metal trim. And

(01:03:49):
so what we're offering right now is we are able
to give an online quote. So if a homeowner gives
us a call at three oh three seven sixty one
six four zero zero, we take down the information, we
go into a Google, we measure the roofline, and then
we're able to give him a quote just on the phone.
And we're actually working on a software that'll be able
to do that online, so that will be out shortly.

(01:04:11):
The reason that we're doing that is because, like with
Jellyfish or these other companies, you never quite know how
much you're gonna pay. You know, you want to quote now.

Speaker 1 (01:04:20):
Very cool, and of course you got the backing of
Excel roofing, and what year are you going into now
with Excel is at thirty.

Speaker 17 (01:04:28):
We are at thirty three that we're going You know, your.

Speaker 1 (01:04:32):
Dad and I knew each other when he was starting out,
and he was the very first roofer at referral list
dot com, the very first one. In fact, he was
one of the charter members when I started referral list.

Speaker 4 (01:04:45):
He was one of the charter members.

Speaker 1 (01:04:47):
And they're gonna do holiday lighting and it's permanent lighting,
which really makes sense. You know how much trouble it
is to take those lights on and off and on
and off, and this will be permanent lighting, totally programmable.

Speaker 4 (01:05:00):
I'll bet you do it with your smartphone, right yeah.

Speaker 17 (01:05:04):
It's right off the app there. And so right now
for pricing, I'm even comfortable giving it out on the air.
We're looking about twenty seven fifty per linear foot and
we can do a quote on the phone.

Speaker 1 (01:05:15):
And but that's permanent, one and done, so that's what's great.
And the life span of those lights is something like
hundreds of thousands of hours.

Speaker 4 (01:05:22):
Right yeah.

Speaker 17 (01:05:23):
So the lighting system that we use, our system has
a three year warranty for any of the bulbs or
any malfunctions, and then that's also going to be backed
by our workmanship warranty for installing.

Speaker 1 (01:05:34):
Is this kind of like the filment that's encased in
hard plastic or silicone and then it's put in the
metal trim.

Speaker 17 (01:05:42):
Kind of it's the lighting that we have is really robust,
So each each light has its own individual like circuit
and then there's just there's wires running between each light
and then it fits up into this this metal casing. So,
like I said, it's way nicer than what's on the
market right now, and it's about you know, it's three
quarters of the cost of something like jellyfish, so it's

(01:06:05):
cheaper and better and Excel installs it.

Speaker 1 (01:06:08):
Yeah, Excel roofing dot com three or three seven six
one sixty four hundred. Deborah, let's get started with your
problem on Banfield.

Speaker 4 (01:06:15):
I want to mention something I.

Speaker 1 (01:06:20):
I hardly ever get complaints about vets, veterinarians, or hospitals
or animal hospitals, but Banfield is the one I get
complaints about. Isn't that weird?

Speaker 4 (01:06:33):
Deborah?

Speaker 1 (01:06:35):
What is your problem with Banfield Animal Hospital?

Speaker 16 (01:06:40):
Well, what happened was I took my dog in to
because he wasn't doing the feeling well, he wasn't eating
very much and stuff, and yeah, we took him in
the vet palm and because of my situation, we got
a wellness plan.

Speaker 1 (01:07:00):
Now, what do you mean because of your situation? What
do you mean because of your situation?

Speaker 16 (01:07:06):
Well, right after I took them in and had this
wellness plan done to pay for it over a year's period,
I fell when I worked and I broke my leg
and I've been out of work going on three months.

Speaker 4 (01:07:26):
Now, Okay, with what you bought, do they call it insurance?

Speaker 16 (01:07:31):
They call it an optimum Wellness plan agreement? And do
you pay monthly to cover certain services?

Speaker 4 (01:07:40):
Okay, you hold on, I'll come. I'll come right back
to you.

Speaker 1 (01:07:43):
Okay, it's a wellness plan that you pay a steady
monthly payment for right.

Speaker 4 (01:07:51):
Okay, let's come. Well, let's take a break. We'll come
right back.

sixteen twenty two.

Speaker 4 (01:08:31):
All right, I'm Tom Martino. Let's continue here and round
out this hour. And you know, so, Debra, this monthly
payment that you paid, how much was it?

Speaker 16 (01:08:46):
It's basically seventy dollars for every month for a year.

Speaker 4 (01:08:53):
Okay, and then what happens after a year.

Speaker 16 (01:08:58):
Well, then you can either renew the contract or this
agreement or you can let it drop.

Speaker 4 (01:09:06):
And so for the seventy bucks, what do you get
for the seventy bucks?

Speaker 1 (01:09:10):
And by the way, if we run out of time,
I'm going to continue this because I really want to
get into this.

Speaker 4 (01:09:15):
But what do you get for the seventy bucks a month?
So you get.

Speaker 16 (01:09:20):
Wellness taped up? You can call the vat anytime they
get their shot.

Speaker 4 (01:09:27):
Like what if your dog needed surgery? Were to cover that?

Speaker 16 (01:09:32):
No, it might cover some calf price blood count screening.

Speaker 1 (01:09:39):
All right, hold on and we'll come right back to Deborah.

I'm sorry, but we got to take this break.

Hey, I'm Tom Martino, and I welcome you to the
show this. You know, I just can't tell you how
much this show means to me. That we're able to
come on and help people if we can, But even
those who have been hopelessly ripped off. Even though it
makes me pissed and and I feel so bad for him,
what the good thing about it is it might keep

(01:10:59):
others from falling into the same trap.

Speaker 4 (01:11:04):
This hour brought to you by or One Clear.

Speaker 1 (01:11:09):
Choice Garage Doors. I can't say enough about these guys. God,
they're a great company. They'll come to your home twenty
four to seven. If you have a problem with the
garage door, you know, like you might not be able
to close it late at night, you come home, you
can't close, you can't secure your house. Another thing could
be a broken spring. It could be you want a
whole new door. They do new doors and openers one

(01:11:30):
Clear Choice Doors dot Com. It's one Clear Choice Garage Doors.
But the name on the website is one Clear Choice
Doors dot Com. So Deborah was on a plan with Banfield.
And by the way, I know people who have wellness
plans for their dogs and cats and hamsters or whatever. No,

(01:11:52):
but they have these wellness plans that pay for things,
and they really make in some cases mathematical sense depending
on what you get. Now, Banfield, in my opinion, is
a bad hospital, and we get too many complaints about him,
and I don't know what's wrong with him, But for
some reason, when somebody has a complaint about an animal hospital,

(01:12:15):
I can almost always assure you a Spanfield you were
paying seventy months. Deborah so tell your story.

Speaker 11 (01:12:25):
Okay.

Speaker 16 (01:12:25):
So we took my dog in and had him signed
up for this because we wanted to check on his
health and he needed some shots and stuff, which they did,
and then they offered this with a membership fee, and
I was like, okay, well, you know we could use
some of this because I was thinking of having some

(01:12:48):
dental stuff done for.

Speaker 9 (01:12:49):
Him and whatnot.

Speaker 16 (01:12:50):
Well that was on July eleven, so then he still
wasn't feeling well, and my husband took him back in
on August twentieth and talked to the vet and they
decided to do an X ray of this stomach and stuff,

(01:13:10):
and which we paid for. It wasn't covered, and they
found a tumor in his stomach and said operating on
it wouldn't really solve anything because they probably wouldn't survived
for more than a couple months. And he was older,
he's like nine or ten, and so they just said

(01:13:33):
you should probably just put him down, and we brought
him back home and he's still here, but time has limited.
He's not eating very much, and I know we're going
to have to in the next few weeks probably take
them to get put to sleep. So in the meantime,

(01:13:54):
I tried to call Bamfield Wellness number and talk to
him about it is stop canceling it, which you can,
but you still have to pay the remainder that you
owe for the year. And they won't let my husband
or I talk to anybody about whoever answered.

Speaker 4 (01:14:14):
The phone, and just so wait a minute, wait a minute.

Speaker 1 (01:14:17):
You bought this seventy dollars a month for the first
year or not, or for a year, and you and
your dog is going to.

Speaker 4 (01:14:28):
Die and they still want you to pay it.

Speaker 1 (01:14:32):
Yeah, well, in the purest sense of the word, it's
a contract issue, but in a practical sense and a
humane approach, and just give me a break approach.

Speaker 4 (01:14:45):
What the hell I mean these people are are are?

Speaker 1 (01:14:50):
They're assuring themselves you'll never go back there in a
million years, and you'll tell everyone about them.

Speaker 4 (01:14:57):
I mean, why won't come on?

Speaker 1 (01:14:58):
They can't be that hurting that they won't discontinue the contract.
I'll bet you they told you. Well, wait a minute,
I'll bet you they told you. Wait a minute, you
can transfer it to another dog.

Speaker 16 (01:15:11):
No you can't, it's in the it's in the contract.

Speaker 1 (01:15:14):
Wait a minute, So you can't if you if this
dog dies and you get another one, you can't use
it for the other one.

Speaker 16 (01:15:23):
No, I'd have to sign another contract and start paying
on that one.

Speaker 4 (01:15:30):
This is ridiculous. How are they?

Speaker 1 (01:15:33):
How are you?

Speaker 5 (01:15:34):
How are they charging you?

Speaker 6 (01:15:35):
Are they billing your credit card or are they sapping
money out of your checking account?

Speaker 5 (01:15:39):
How are you paying for this?

Speaker 16 (01:15:41):
I paid with a credit card, so every month it's
coming out of my Discover cards and I and and
the thing is, I understand that I had a very
limited time to cancel it, but it was like within
three a short amount of time, and nobody knew my

(01:16:04):
dog was that ill with this?

Speaker 6 (01:16:06):
Of course, Tom, what do you think if if Deborah
calls her Discover card and says, hey, listen, can you you.

Speaker 4 (01:16:12):
Can stop it on her Discover card easily? Yeah? Easily.
I mean all she has to do.

Speaker 1 (01:16:17):
Is stop it now. Mind you, they may still try
to draw it. That's the problem with credit cards. You
have to kind of almost get a new card.

Speaker 4 (01:16:28):
Okay. And this is something a lot of people don't know.

Speaker 1 (01:16:31):
When you stop a charge in your credit card, it
doesn't stop future charges.

Speaker 4 (01:16:36):
It only stops the one you just stopped.

Speaker 1 (01:16:39):
If you want to stop future charges, coming through in
an automated way, you literally have to cancel the card.

Speaker 5 (01:16:46):
You have to Well, that's not a big deal. You
don't have to close the account.

Speaker 4 (01:16:49):
You just get a rell. Okay, that's funny. Now listen
to this.

Speaker 1 (01:16:52):
Here's what the rules really say, although it can be
overridden by local by their own policy.

Speaker 4 (01:17:00):
But here's what the rules say. Okay.

Speaker 1 (01:17:02):
In general credit card lingo, Let's say you have a
card ending in one two three four and you want
to stop a regular payment coming through on one two
three four. If you now if you lost one two
three four, it would stop any new charges.

Speaker 4 (01:17:21):
From being posted to one two three four.

Speaker 1 (01:17:23):
So if someone found your card, they can't go on
buy anything and use one two three four. But right,
but if you get a new card, the same account,
just a new card, and now it's four five six
seven that card, here's what happens. If someone had a

(01:17:45):
contractual relationship with you under one two three four, it
automatically forwards to the new card. So if she has
a contract, which she does on one two three four,
and she cancels that card and gets a new card,
they will still draft the new card of five six

(01:18:07):
seven eight. The only way to get around it. And
I had this happen. I had this happen on my
Capital One where they said you can't. It was Salesforce.
Those scumbags at Salesforce, they did stuff wrong and it
was terrible. Anyway, I canceled and I said, do not
draft my account any longer. And it still went through

(01:18:27):
on another card. And I said, how did it go
through on a new card? And Capital One said, in
order to stop a charge, you'd have to literally have
a new account. So I had to close down the account,
the entire account, and reapply for a new credit card.
And then I got a new card and they could

(01:18:48):
not attack the new account. They can only go back
to that account where I had a contractual arrangement. So
the account is where the contract is. The credit card
number is just a processing thing. So if she goes
and gets another card, and knowing Banfield, because they're probably scumbags,
Banfield will still try to charge her account no matter

(01:19:11):
what card she gets, she would have to shut down
that card completely.

Speaker 5 (01:19:16):
Tom.

Speaker 6 (01:19:16):
So, you know, Discover Card is known as having pretty
decent customer service reps in the credit card industry. What
about Deborah calls the eight hundred number on the back
of the card and tells them, Hey, I'd like to
shut down this automated charge and can I do it
in such a way that they won't be able to
charge me again, because that's what I did, and they

(01:19:36):
mer men, No, No, you Maybe Discover is better at it.

Speaker 1 (01:19:41):
You know, Deborah, that's the first thing you need to do,
because I don't think Banfield will come after you, and
if they do, I think they'd be laughed out of
court if you said my dog died. All I wanted
to do was cancel the contract. They won't even let
me transfer it to a new dog. So here, here's
the thing, Deborah. Have you talked to just Discover yet?

Speaker 7 (01:20:02):
No.

Speaker 16 (01:20:02):
That's one of the reasons I contacted you was because
I was even willing to negotiate this at some point,
and they wouldn't even discuss that. They wouldn't let you
talk to anybody about that, and I didn't want to
call Discover until after I talked to you.

Speaker 1 (01:20:22):
Okay, My advice is this, First of all, Banfield sucks.
Anyone listening, I strongly urge you never to use Banfield
Animal Hospital. I mean, they truly suck. Look at their
ratings and look at the comments. They suck, so they're
not going to cooperate with you. So the only way
you're going to stop this, the only way you're going

(01:20:45):
to stop it is you got to close the account.
Getting a new card won't be enough unless they tell
you that. But I'm going to tell you no matter
what they say, if you get that merchant blocked, I'd
be shocked because normally they do not block merchants unless
they're a it's a scam, and Banfield is a legitimate

(01:21:07):
hospital even though they suck, So I don't think they will.
I don't think they'll block that merchant. So Deborah, do
you do a lot of things with that Discover card?

Speaker 7 (01:21:18):
Yeah?

Speaker 16 (01:21:19):
I actually do. I've got a lot of medical stuff
on it.

Speaker 7 (01:21:23):
Right now, you're.

Speaker 1 (01:21:25):
Gonna have to shut down that account and open a
new account. I'm serious, I really mean it. So let's
start with that call that I suggested.

Speaker 6 (01:21:34):
Maybe Discover will tell her that they can do it
without her shutting down the account.

Speaker 4 (01:21:38):
That would be nice, but they're not going to. But
I want no, And let me tell you why, Dimitri.

Speaker 1 (01:21:43):
Even if someone on the phone is sympathetic, sure it's automated.
When that charge goes through. It's not like someone says, oh,
this is from Banfield. And I remember Debra said she
had a problem with Banfield. Let's not put it through
what you're suggesting as a blanket blocking of Okay, merchants

(01:22:05):
on I'm talking about in general, you can't shut down
a merchant from your account.

Speaker 4 (01:22:13):
Unless they're a known like like a known scam.

Speaker 1 (01:22:18):
But even if you have a severe disagreement, Listen, if
I didn't go through this personally, I would I wouldn't
say it. But like I said, there's nothing wrong with
calling them. Maybe they have some kind of procedure for
disagreements like.

Speaker 4 (01:22:35):
This, maybe they do.

Speaker 1 (01:22:37):
Okay, but but listen, Banfield will keep trying to collect.
And I'm just sorry you God, how did you what
led you to Banfield to begin with? Because there's such
a terrible they have such a terrible reputation.

Speaker 4 (01:22:54):
What led you to them?

Speaker 16 (01:22:56):
Well, they're close by and okay, I've taken my pets
in there before for just general.

Speaker 1 (01:23:06):
Stuff shots and yeah, yeah, I mean you wouldn't believe
some of the texts I got about them after you called.
They said that Banfield sucks. Oh yeah, yeah, no, no,
they're bad news. Now, I'm not going to say each
and every I'm not going to say each and every
individual veterinarian there is bad, but I'm telling you, I'm

(01:23:28):
telling you that they suck. Now, well, wait a minute,
did we have a comment from somebody else, Kachina or
did you.

Speaker 22 (01:23:35):
Just Yeah, she's a little upset, so kind of the
same thing as Deborah is experiencing. But her dog was
actually struck by a car and killed and she and
Banfield is making her payoff the rest of the contract.

Speaker 1 (01:23:53):
Yeah, so that's Banfield. For those listening, we got to
take a break. I'm Tom Martine. Three h three seven
to one three eight two five five. Go with a
sure thing Denver's best roofer Excel Roofing dot com. You
don't pay a cent until you're content, wait time for

(01:24:43):
three all three seven one three talks seven one three
eight two five five. Jeff wants to talk about Infinity Jeff,
Sorry for the wait.

Speaker 4 (01:24:53):
What's going on, Jeff?

Speaker 12 (01:24:56):
Oh, that's okay. Hey, you know, I've got a WiFi
service actual pretty good. But when I was talking to
them about adjusting a bill or something, they offered me
a phone for free. They said, hey, get this phone
for free, try it per month. If you don't like it,
you can cancel it.

Speaker 7 (01:25:12):
You keep the phone.

Speaker 12 (01:25:13):
It's with the Infinity now, which is their discount phone
line or phone service thing. It's like a subservice thing.

Speaker 4 (01:25:21):
Okay, so this was this is weird.

Speaker 1 (01:25:24):
This was a trial, and they said you get to
keep the phone even if you don't continue.

Speaker 7 (01:25:32):
Exactly, you know.

Speaker 12 (01:25:33):
So I thought, well, what the heck, I'll try it.
So I tried it.

Speaker 1 (01:25:37):
And how how does it differ from regular Infinity cell service.

Speaker 12 (01:25:44):
I think they I'm not positive. I think they use
the same towers, but I think it's a disc discount
program and it's all it turns out in the end,
you know, if they don't have any customer services.

Speaker 7 (01:25:56):
When I found out so discount.

Speaker 4 (01:25:59):
Okay, so so what what is it? Well, it's a disco.

Speaker 6 (01:26:03):
Sorry, okay, did you go personally it's a it's it's
an Exfinity's discount prepaid service free phone twenty five dollars
a month per line and looking up the stuff about
any free phones.

Speaker 1 (01:26:18):
Okay, so they said, and did you get okay, so
you get a free phone.

Speaker 4 (01:26:23):
And how long do you have to keep the service?
To keep it?

Speaker 12 (01:26:28):
They said, I could try it for one month, and
if I didn't like the service, I could can keep
the phone and automatically unlocked in ninety days or something
in every Okay, it was going to unlock. So okay,
I cancel the service because I have a different phone
with the different services I like better. I kept the phone,
and it was supposed to it was supposed to automatically

(01:26:50):
unlocked on August eighteen, you know, a month ago, and
I thought, okay, well, I got the post it to
my desk. It turns out my mom, who's ninety two
years old, and you know, she's got to phone this
you know, eight years old or whatever it is. I'm like, hey, mom,
you own this phone. It's supposed to be unlocked.

Speaker 18 (01:27:06):
And she's like sure.

Speaker 12 (01:27:08):
So I go to look at it and it's still
locked up. So I try to contact Now's customer service,
which they don't have.

Speaker 4 (01:27:16):
So then I call it.

Speaker 12 (01:27:17):
Well, let me call Exfinity because they kind of run it.
So I call Affinity and oh, yeah, we see that's
your phone. It's uh uh, you don't have service on
it right now. It's through Now though, and we don't
do we don't do any customer service for now there.
Let me send you over to now. So I'm like, oh,
I'm gonna get a customer service. So they transferred me
over and I get a computer saying, hey, if you

(01:27:41):
want to do this, push one, if you want to
do that, push two. Yeah, you know all these different things, right,
unlock my phone. I can't talk to anybody. I can't
get anybody to unlock this phone, including I call Excinity back.
They won't unlock it. They just transferred back to Now's computer.
And it's like, okay, I got this phone.

Speaker 4 (01:27:57):
Well, hold on is now a separate is now a
separate company?

Speaker 3 (01:28:03):
It is?

Speaker 4 (01:28:04):
Is that what you're seeing?

Speaker 6 (01:28:05):
So it appears to be owned by Exfinity, but that's
a very fine print. It's like their own brand, their
own company. You know, it's it's a low priced, low service,
you know, bottom of the barriers.

Speaker 4 (01:28:20):
What kind of phone is it?

Speaker 7 (01:28:23):
It's a Motoral.

Speaker 12 (01:28:25):
Stylus five.

Speaker 7 (01:28:26):
Give Moto G is what it's called.

Speaker 5 (01:28:29):
Yeah, it's called Moto G phone.

Speaker 12 (01:28:31):
It's actually not a bad phone.

Speaker 1 (01:28:33):
But I'm shocked that you're even getting to keep I'm
really shocked you're even getting to keep it. But technically,
if it's not unlocked, where is it good only for now?

Speaker 15 (01:28:45):
Or is it?

Speaker 1 (01:28:45):
What?

Speaker 4 (01:28:46):
What system is it?

Speaker 12 (01:28:49):
It's not an Exfinity system?

Speaker 13 (01:28:52):
Now?

Speaker 4 (01:28:52):
What I mean is this? There are there? There there
are I think what is it?

Speaker 1 (01:28:58):
GSM is one and the other one is TDMA or something.

Speaker 4 (01:29:02):
I thought there were.

Speaker 1 (01:29:02):
Certain protocols and the reason you get it unlocked is
to I don't know, it has something to do with
what systems you can sign up for.

Speaker 4 (01:29:14):
What I'm asking is do you even need to get
it unlocked?

Speaker 11 (01:29:17):
What?

Speaker 7 (01:29:17):
What?

Speaker 4 (01:29:18):
Why do you need it unlocked?

Speaker 1 (01:29:21):
Well?

Speaker 12 (01:29:22):
I took my mom's sincard and stuck it in this phone. Yes,
your SIM cards not it's not compatible with this phone
because it's locked.

Speaker 4 (01:29:30):
Got it on now, I'm okay.

Speaker 12 (01:29:32):
So that's why I was trying to unlock the phone.

Speaker 1 (01:29:35):
Okay, And but you didn't pay for the phone. I mean,
so worst case scenario is you didn't pay for it.

Speaker 5 (01:29:42):
Just free phone doesn't work.

Speaker 12 (01:29:44):
I should say, I think I got twenty It cost
me twenty five dollars for them the ship it to me.
I'm like, okay, for twenty five dollars, I'll give it
a shot. So it is twenty five dollars.

Speaker 1 (01:29:54):
It was twenty five dollars for shipping. And did you
how long was the trial period?

Speaker 12 (01:30:02):
A thirty day trial and the phone was released ninety
days after activation, so I think I just back it
up from August. I don't know when that was.

Speaker 4 (01:30:12):
Okay. Did you get an email saying the phone was released?

Speaker 1 (01:30:19):
No, I did not.

Speaker 12 (01:30:20):
I was when I when the salesman was selling the
Vicinity salesman was selling it to me, It's like, oh,
it'll get unlocked automatically in ninety days after you activated.

Speaker 4 (01:30:30):
Is there.

Speaker 1 (01:30:32):
Is there a reason that you didn't keep the NOW service?
I'm just curious.

Speaker 4 (01:30:39):
Yeah.

Speaker 12 (01:30:39):
You know, I've got T Mobile service on my other phone.
It works well for me, and I've also got it
bumbled in with a Wi Fi at my house.

Speaker 1 (01:30:50):
You know, Okay, I'm going to do some I want
you to hang on. I'm going to do some research
on it. Hang on, okay, and I'll come right back
to you. But Brian, real quick, you got to comment
on Banfield Animal Hospital.

Speaker 4 (01:31:02):
Go ahead, Brian, Yeah.

Speaker 7 (01:31:04):
I just got a couple of questions. How much how
many more months does she have left?

Speaker 13 (01:31:09):
She had?

Speaker 1 (01:31:10):
It sounded like she had more than half left. I mean,
she actually did give me an idea. I think her
ten years. They see seventy bucks a month. I don't
know exactly, but it sounded like she had just paid
for a few months, and.

Speaker 7 (01:31:26):
Does it automatically renew her once it's done, it's done.

Speaker 1 (01:31:32):
On this particular case, she said she had the option
of renewing it is what she said.

Speaker 7 (01:31:42):
Okay, so if it gets paid off, then she doesn't
have to go another year.

Speaker 4 (01:31:46):
She can just stop it, right right, That's exactly right?

Speaker 7 (01:31:51):
All right? Well tell her that, you know, I'm feel
sorry for her with her dog and everything. I just
went through a little dog with stomach cancer. And tell
her that pay it the rest of it off for
what that's Can I can afford seventy dollars a month?

Speaker 10 (01:32:08):
Wow?

Speaker 4 (01:32:08):
But that's so nice of you.

Speaker 7 (01:32:11):
I'll go right down to Banfield and I'll pay cash
because I don't want them have my credit card or
anything else. All you got to do is get me
the information.

Speaker 1 (01:32:17):
Okay, Brian, listen, we we really thank you very much,
and we're going to get a hold of her and see.
I hope we have our contact information. So hold on
three all three seven one three A two five five.
We have more coming up on the Troubleshooter Show. You know,

Speaker 1 (01:33:25):
You'll think you're his only customer when you choose Frank
durand the real estate man dot com to list your
home with Remax Alliance three oh three nine two zero
sixteen twenty two. I have some jerk that keeps texting
me about it's not their fault the dog died.

Speaker 4 (01:33:42):
A contract is a contract, blah blah blah.

Speaker 1 (01:33:45):
Listen, they're not losing a dime by letting her out
of that contract. They will never have to do any
kind of service for that dog, So why should they
collect seventy bucks. It's just ridiculous and stupid, and I
think Banfield sucks because of it. Let's talk to Jeff
with this Infinity phone. Jeff, nowhere can we find now?

(01:34:06):
The reason I'm mentioning this is we can't take the
case and tell them, hey, you promise to unlock this phone.
Nowhere in any of the offers for the now trial
do they say you.

Speaker 4 (01:34:18):
Get to keep the phone. Well, you can keep the phone.

Speaker 1 (01:34:21):
But nowhere do they say they will unlock it, which
is kind of weird. But there's nothing we can't force
them to unlock a phone. They would have to do
it out of a courtesy. Have you ever walked into
a store with the phone and just said, hey, I
need this unlocked.

Speaker 4 (01:34:40):
No, I haven't.

Speaker 12 (01:34:41):
I suppose I could try that.

Speaker 4 (01:34:43):
Here's why I found.

Speaker 1 (01:34:44):
I found that Exfinity in the past has been much
more responsive to consumers.

Speaker 4 (01:34:50):
Who show up at the store.

Speaker 1 (01:34:52):
You know, don't make any demands, just say look, I
had this phone on a trial basis. It's now been
really least to me and I needed unlocked, and they
might be able to do it.

Speaker 4 (01:35:05):
I don't know if unlocking a phone what it requires.

Speaker 1 (01:35:08):
It has something to do with the with the EI
N number or the ESN whatever electronic serial number they
have to enter somewhere for.

Speaker 4 (01:35:17):
Whoever has it locked up to unlock it.

Speaker 1 (01:35:20):
I know I had a tough time getting a phone
unlocked one time that I had paid off and I
wanted to sell the phone or get rid of the phone,
and I had the toughest time doing it. You know,
it's first of all, locked phones suck. I I don't
even know why they they lock them to keep you hostage.
But again, I can find nowhere where you're promised an

(01:35:44):
unlocked phone.

Speaker 4 (01:35:46):
But I would go into a store and see what
they do. Yeah.

Speaker 12 (01:35:53):
Interesting, I did google how to unlock a phone and
it was interesting. A couple of places on a couple
of YouTube videos, you know, which is your advertising for
smacific website. So you can go on and give them
the em EI number and you fill us some information
and of course you pay them. It's like the least
ones I looked at were like thirty dollars and they'll

(01:36:14):
go unlock it fully apparently, and send you a code
to do the unlocked. I'm like, okay, well would.

Speaker 4 (01:36:19):
You try it?

Speaker 7 (01:36:21):
You know, no, it's thirty bucks.

Speaker 10 (01:36:23):
I want to.

Speaker 4 (01:36:27):
No, I get it. I get it. Listen, go into
the store and call us back and let us know
what they say.

Speaker 1 (01:36:33):
I look at if they're gonna fuck. There's no skin
off their back to unlock it. I don't know why
they wouldn't.

Speaker 6 (01:36:40):
In fact, Tom, I just found a page of instructions
published by Exfinity itself entitled how do I Unlock my
Exfinity Mobile phone?

Speaker 5 (01:36:50):
And there's a whole page of it over here.

Speaker 4 (01:36:51):
And where did you find it? Well?

Speaker 17 (01:36:53):
Hold on, why would Exfinity publish that?

Speaker 4 (01:36:56):
They did?

Speaker 6 (01:36:57):
I'll be a query, how do unlock Exfinity phone?

Speaker 4 (01:37:01):
And boom.

Speaker 6 (01:37:01):
They published a whole page for it. But now here
are the rules. Your phone must be activated for at
least sixty days. Right, The phone must be paid in full.

Speaker 7 (01:37:11):
Right.

Speaker 6 (01:37:11):
Your Exfinity Mobile account cannot have a past few balance.
Your phone cannot be reported lost, stolen, or involved in
fraudsal activity. Those are their only rules.

Speaker 17 (01:37:20):
I don't understand why they would let the individual out
of that, you know, that locked status, because they lose the.

Speaker 4 (01:37:25):
Ball, hold on, hold on, Henry. They're not letting him
out of anything.

Speaker 1 (01:37:30):
Remember, it's an account where there's no balance, the phone
is completely paid for.

Speaker 4 (01:37:36):
What are they letting him out of? Well, they're not
letting him out of anything.

Speaker 17 (01:37:39):
If it's locked, aren't they trapped in the Exfinity network?

Speaker 1 (01:37:43):
Well okay, but if they don't owe any money and
they canceled their account, what skin is it off their
back if they let them if they unlocked the phone.

Speaker 4 (01:37:53):
I mean, what I'm saying is there's no reason.

Speaker 1 (01:37:55):
To keep it locked, especially in this case. They acknowledged
to the guy to Jeff that he can keep the phone.
So if you're gonna let a guy keep a phone
and he already canceled, why it seems weird to me
that they.

Speaker 4 (01:38:12):
Would keep it locked.

Speaker 6 (01:38:13):
It also says that you must restart the phone after
meeting all of these eligibility requirements.

Speaker 5 (01:38:19):
So has our callways started the phone?

Speaker 4 (01:38:21):
Just You might want to google those instructions.

Speaker 1 (01:38:23):
By the way, Joan, you have a question about excels
smart meters.

Speaker 4 (01:38:28):
What's going on? Joan?

Speaker 23 (01:38:31):
Okay, here's the free background. In twenty twelve, the previous
owner bought solar system from Solar City. In twenty sixteen,
we bought the house and assumed the contract.

Speaker 1 (01:38:45):
And then okay, so in twenty sixteen, you bought the
home and it had the solar system correct, Okay, and so.

Speaker 23 (01:38:56):
The contract came over to us. Okay, right, then Tesla
bought Solar City.

Speaker 16 (01:39:04):
Okay.

Speaker 4 (01:39:05):
Okay.

Speaker 23 (01:39:05):
Now come forward to June of twenty twenty three, and
they started saying that we needed to change out our
meter for a smart meter. This is Xcel that's saying that, right,
And we said we wanted a non communicating meter, and
we managed to make We sent a fact letter to

(01:39:26):
them to make sure they understood we wanted a non
communicating meter because they've kind of been losing some people's
phone calls and stuff about it anyway, Excel, I mean agreed.

Speaker 4 (01:39:39):
Now this was was this This was in twenty twenty three.

Speaker 23 (01:39:44):
Yeah, when they started so all.

Speaker 1 (01:39:48):
You but but hold on, they were switching to smart
meters and you simply said you didn't want one.

Speaker 4 (01:39:56):
Correct, Okay, go ahead.

Speaker 23 (01:40:00):
We've been now for about a year and a half.
They've they've sent out a couple of contract years we've
with a smart meter. We've said no, we want the
non communicating one. They've gone away. So about a month
and a half co he sent another one and he said,
I'm here with a smart meter, and we said, well,
I'm here with a non communicated meter, and we said okay,
and then he says, but you have two meters. And

(01:40:22):
I didn't realize that we had two meters. One of
them is for our use in the house and the
other one is a productive meter that they collect the
amount of electricity that the solar panels put out, and
then they compensators for that electricity, so they buy the

(01:40:42):
electricity from us.

Speaker 4 (01:40:44):
All right, that's called net metering. Okay, then what.

Speaker 1 (01:40:48):
So?

Speaker 23 (01:40:48):
So then we told him we wanted a non communicating one,
and they told us that Tesla will not opt out
of the program and that we have to have two
smart meters and we have no.

Speaker 4 (01:41:01):
Well, you do have to have the meter that system
is it?

Speaker 1 (01:41:05):
Is it paid for, by the way I should have
asked that is that system paid for?

Speaker 10 (01:41:10):
Yes?

Speaker 1 (01:41:11):
Okay, so you're not paying you're not paying Tesla. You
you you own that completely. You do not pay any
kind of power bill to Tesla.

Speaker 4 (01:41:23):
No, we lease it.

Speaker 23 (01:41:24):
So we have a lease.

Speaker 1 (01:41:25):
Okay, under a lease. Under a lease, the less ore,
which is Tesla has a right to want it metered
anyway they want because.

Speaker 4 (01:41:36):
You don't own the system.

Speaker 1 (01:41:39):
Okay, I don't know about the other meter you're talking
about as far as the net meter.

Speaker 4 (01:41:46):
You know, you have two meters.

Speaker 1 (01:41:48):
One is for Tesla to gauge the lease and the
other one is with the power company.

Speaker 4 (01:41:55):
And you're saying they're both smart meters right now.

Speaker 23 (01:41:59):
No, this both old meters. Because we've been saying we
don't want it non communicated meter, and they tell us
that Tesla says they're not going to opt out, so
we've lost our opt out options.

Speaker 1 (01:42:13):
That's right, because because Tesla is the one that's hooked up,
not you, Tesla.

Speaker 4 (01:42:20):
Owns that system. You can opt out of the other one.

Speaker 23 (01:42:25):
You know, we've tried to do that and they say
they have to match that they can't.

Speaker 1 (01:42:29):
Have Oh oh oh oh, I see, I see what
you're saying. But as far as just hold on and

All right, Joan.

Speaker 1 (01:43:19):
I did some more research and apparently the meter goes
with the system. The system is owned by Tesla, so
they can choose which meter they want. But may I
ask you a question, why do you want.

Speaker 4 (01:43:38):
An old meter?

Speaker 1 (01:43:39):
Why do you want a non communicating meter?

Speaker 23 (01:43:44):
Well, I've been hearing an awful lot of things with
us sell and stuff and I'm really connected into the grassroots,
and I've heard about different kinds of happenings with their billings.
I've quart friends who quest go with.

Speaker 3 (01:44:47):
Come six is the Troubleshooter Show. No Tom Martinez.

Speaker 1 (01:44:55):
Hey, I'm Tom Martino here to help you with problems,
questions and complaints. It's really the only show that exposes liars,
sheets and ripoffs.

Speaker 4 (01:45:05):
And today we've had a few.

Speaker 1 (01:45:08):
We had Harlan Woods, a piece of crap, liar, cheater,
snake in the grass who forged checks. He made fake
checks to buy a truck and never paid for it.
He bought it from this woman who needed the money desperately.
He owed her twenty four hundred bucks. One was for

(01:45:31):
a water heater and one was for a yukon, a
two thousand and five yukon. Anyway, it totaled, it totaled
twenty four hundred and he gave her a fake cashier's
check twice. Yeah, twice, that's right, twice. So I guess

(01:45:51):
what I'm asking you is, what have you found out?
She said she went to the police, the Edgewater police,
and they wouldn't do anything. They said it was a
civil matter, you know, that's what they said.

Speaker 9 (01:46:09):
I had.

Speaker 5 (01:46:10):
I mean, so Edgewater Police, much to their credit, did
call me back. We had a couple of conversations.

Speaker 4 (01:46:15):
So what do they mean it's a civil matter?

Speaker 1 (01:46:17):
For God's sakes, a bad check of forged check is
a crime.

Speaker 5 (01:46:21):
Well, it turns out it isn't.

Speaker 6 (01:46:22):
I mean, it turns out, of course it is a crime. No, no, no,
it turns out it's not a civil matter. So they've researched.
They researched this matter for me. Edgewater Police has been
very responsive to me in this matter.

Speaker 1 (01:46:32):
So what are they going to do about this guy
that forged checks in their territory.

Speaker 6 (01:46:36):
Well, they can't do anything because the transaction took place
in Lakewood.

Speaker 5 (01:46:40):
So she wentwater.

Speaker 6 (01:46:42):
Okay, So she went to Edgewater and they said, look,
we can't help you, but you got to go to
Lakewood and file a report over there because that's where
the guy gave you the forged checks.

Speaker 5 (01:46:52):
So I called Deanna or Dina back.

Speaker 6 (01:46:56):
Dana back and left her voicemail and said, look, go
to lake WUID, call us right back and tell us
what they said. So it's not Edgewater's fault in this case. Okay,
Hopefully she'll follow up with lake WUID and let us
know how it goes.

Speaker 1 (01:47:13):
Here's the thing. Many times I have found that how
do I put this? I have found that people put
tell people, police tell people it's a civil matter when
they don't want to take the time.

Speaker 5 (01:47:31):
Absolutely, I've heard it so many times and so many things.

Speaker 1 (01:47:36):
For example, with contractors when they violate the Contractors Trust Act.
What it turns out to be is a crime, but
police don't know how to handle it, and it just
pisses me off, and they just say, oh, no, you
need to take them to court. And they don't need

(01:47:57):
to take them to court.

Speaker 4 (01:47:59):
It will what it is. Well, they do need to
take in the court if police won't do anything.

Speaker 1 (01:48:04):
But I'm just so tired of, you know, people getting
ripped off and police not doing anything. Sometimes police have
to do something about it.

Speaker 6 (01:48:17):
And so it's a really frustrating lame excuse they use
way too often.

Speaker 1 (01:48:22):
Right, And it's because, in my opinion, there are a
bunch of Barney fifes.

Speaker 4 (01:48:30):
And where's my bullet? I keep the bullet in my
top pocket.

Speaker 1 (01:48:38):
Yeah, and they rather at Edgewater sit around and pretend
that they're protecting us. They had a guy forging checks.
And the only reason they're going to get involved. Oh okay,
so it wasn't in their territory, but they said they
would get involved if it was in their territory.

Speaker 5 (01:48:59):
Well, I didn't ask him if he would get involved.

Speaker 4 (01:49:02):
Ay.

Speaker 1 (01:49:04):
She's got to go to Lakewood Police and file a complaint, yes, okay,
and we'll see what happens.

Speaker 5 (01:49:10):
I have a feeling they're going to claim it's a
civil matter.

Speaker 4 (01:49:13):
Yeah, they probably will. Andy. Andy, we can't we can't
do that. We can't do that. We got to sit
on our ass and eat donuts.

Speaker 1 (01:49:23):
We can't really enforce, we can't really take matters into
our own hands when it comes to law enforcement. Joan,
Now I've researched. This is something very interesting. I want
Joan to know, and then I want to know her
thoughts on this.

Speaker 4 (01:49:40):
Listen.

Speaker 1 (01:49:41):
I know a lot of people are resisting smart devices
and all of this because they're paranoid about information gathering
and control. I get it, I really do get it, Okay,
but I think it's that that that that that's far
far too far gone for to do anything about right now.

(01:50:02):
We're never going to put how do they say, the
stuff back, the toothpaste back in the tube, or the
beans back in the can or whatever.

Speaker 4 (01:50:11):
We're never gonna do it right now.

Speaker 1 (01:50:13):
There's just too much information about everyone everywhere. But interestingly Joan,
and Joan is struggling with this because she does not
want a smart meter, and they're telling her, well, you
have a Tesla solar system, and Tesla will not opt out.

Speaker 4 (01:50:29):
Tesla wants a smart meter.

Speaker 1 (01:50:31):
And because Tesla wants a smart meter on the solar system,
which they have a right to demand, then she has
to have a smart meter on her house because they
said you can't have two separate meters, one smart meter
and one old fashioned meter. But this is something I
found out that's interesting. Opting out of a smart meter.

Speaker 4 (01:50:56):
Is not your right.

Speaker 1 (01:50:58):
According to the Public Youth Untilities Commission, it was an
option that Excel gave customers, but it is not a right.

Speaker 4 (01:51:09):
They're not required to do so.

Speaker 1 (01:51:12):
As a provider of power, they are allowed and have
the power. No pun intended the power to demand that
all of their customers be on a smart meter. They
simply can control their system and the meter is part
of their system.

Speaker 4 (01:51:32):
Now, you could opt out of having Excel all.

Speaker 1 (01:51:35):
Together and just do a generator, I guess, but you're
not allowed to opt out of a smart meter if
they don't want you to. So far, they've been giving
people the option. And because they've been giving people the option,
people have the mistake and impression that it's their right
not to have a smart meter. It is not your

(01:51:58):
right not to have a smart meter. It's up to
Excel whether you have a smart meter or not. In
the purest sense of control. But I have a question
for go ahead, Joan, Sorry, I'm go ahead.

Speaker 23 (01:52:12):
They phoned me on Monday, and said, if you don't
schedule this by five days, we'll turn off your electricity.
They will within their palace.

Speaker 1 (01:52:21):
Right right, So okay, Joan, I want to ask you
something though, seriously, what do you have against the smart meter?

Speaker 4 (01:52:30):
I want to know what you said something about billing?

Speaker 23 (01:52:35):
Yeah, And I just honestly, I would like to have
some privacy. I would really like to not let anybody
know that I'm building a nuclear reactor in my house
at two o'clock in the morning. Right, you know, it's
a privacy.

Speaker 10 (01:52:53):
It's you.

Speaker 23 (01:52:56):
Putting a genie back in the bottle. But a lot
of people we really resent it's just another.

Speaker 4 (01:53:06):
I agree with you. I, by the way, I totally
agree with you. A lot of people. A lot of
people don't like it.

Speaker 1 (01:53:13):
You're absolutely right, absolutely right, But there's nothing we can
do about it.

Speaker 18 (01:53:20):
Yeah, it's a monopoly, Well, of course it is.

Speaker 4 (01:53:25):
It's a controlled monopoly.

Speaker 1 (01:53:27):
It's a controlled Whenever there is a monopoly, it's predicated
on a couple things, government control and oversight always. So
in other words, where you have like even cable franchises,
it's a franchise. That franchise is controlled by your government,
and they grant the franchise based on the cable company's

(01:53:48):
commitment to the customers. And when it comes to power,
we're controlled. It's controlled by the Public Utilities Commission.

Speaker 4 (01:53:57):
And what they're saying is, if.

Speaker 1 (01:53:59):
You want to have this power and you want to
provide power to our people, then you have to do
so in a certain way.

Speaker 4 (01:54:08):
However, we have way less control than we think we do.
We really do.

Speaker 1 (01:54:14):
And if they want to require smart meters, they can
require smart meters. There's really nothing you can do about
it except you can refuse if you'd like, you can
refuse to have Excel energy altogether and put a generator in.

Speaker 23 (01:54:34):
Well, I don't think for at that point.

Speaker 10 (01:54:37):
And are you and Joan?

Speaker 13 (01:54:39):
Are you?

Speaker 4 (01:54:40):
Are you on social media at all?

Speaker 1 (01:54:43):
Oh?

Speaker 23 (01:54:43):
Yeah, I have eleven thousand followers on my next door
and that's where I've learned some of the ping.

Speaker 1 (01:54:51):
And by the way you are, it's you're talking about
privacy and you have eleven one thousand followers on nextdoor?

Speaker 4 (01:55:02):
So how do you reconcile that?

Speaker 1 (01:55:04):
Do you realize how much information has gathered from you
every single day? Have you ever read the next store
terms and conditions?

Speaker 11 (01:55:14):
Yes?

Speaker 1 (01:55:14):
I have?

Speaker 4 (01:55:15):
But you know why oh really you have.

Speaker 1 (01:55:17):
Okay, hold on, because I did too, and that's why
I chose not to go on there anymore.

Speaker 4 (01:55:22):
So you have read them, so.

Speaker 1 (01:55:24):
You know about section four, the specifically paragraphs E and F.

Speaker 4 (01:55:29):
You know about that.

Speaker 1 (01:55:31):
Yes, okay, tell me what it says. No, No, I
want you to tell me what it says. I want
you to tell me what it says.

Speaker 4 (01:55:38):
You said, you read it, Just tell me on to
them and that all of it.

Speaker 1 (01:55:47):
Well, then why if you care about privacy of a
smart meter, why would you let next door? By the way,
why would you let nextdoor have total access to your contacts,
your email addresses, your phone numbers, your address, and your

(01:56:07):
web surfing.

Speaker 4 (01:56:09):
Why would you do that?

Speaker 1 (01:56:13):
Because why why would you let.

Speaker 4 (01:56:16):
Nextdoor have all of that data? Why you just told me.

Speaker 1 (01:56:21):
You just told me you were concerned with privacy, And
I'm just asking a logical question.

Speaker 4 (01:56:27):
I'm not trying to be argumentative.

Speaker 1 (01:56:28):
I am asking you you are worried about what a
smart meter will do on your home, and you have
just given you've given next door the power to go
into your computer and know all of those things. So
how do you reconcile? How do you reconcile that, and

(01:56:49):
Exo is.

Speaker 23 (01:56:49):
Not giving me a choice.

Speaker 4 (01:56:53):
Next door.

Speaker 1 (01:56:54):
Hold on, Nextdoor is not giving you a choice either.

Speaker 21 (01:56:59):
Smart meter or nothing.

Speaker 4 (01:57:02):
That's what next door.

Speaker 1 (01:57:03):
Says, hold on, hold on, You're not listening to me
if you don't agree, Okay, if you don't agree to
next door and their terms and conditions, it's all or nothing.
You don't get to choose what you have them give
them access to. So why is that any different than Excel?

Speaker 23 (01:57:26):
Because I chose to get on next door.

Speaker 10 (01:57:31):
And I have not chose.

Speaker 4 (01:57:33):
Yes you did, No, I haven't. Joan out, Joan, you
do not have to be on excel.

Speaker 1 (01:57:43):
You can.

Speaker 4 (01:57:44):
You can provide your own energy. Listen, you know what
right and the truth the matter?

Speaker 1 (01:57:50):
By the way, you do you have cable? Do you
have cable TV?

Speaker 4 (01:57:54):
No?

Speaker 1 (01:57:55):
Well, how do you provide yourself with television?

Speaker 23 (01:58:02):
Why am I on the radio?

Speaker 1 (01:58:05):
All I'm saying is this, Joan, Really, here's what I think.
I think you're losing sleep. I think you're losing sleep
over privacy. And it's totally hypocritical. We have people and
Dragon was bringing this out during a commercial break. We
have people all over TikTok and social media and then
they cry about privacy.

Speaker 4 (01:58:26):
It's really a joke. I mean it really is.

Speaker 15 (01:58:29):
So what's a joke.

Speaker 20 (01:58:31):
A joke?

Speaker 23 (01:58:31):
Is XL saying we're going to spend it could have
been forty million dollars, but we didn't have anything to
do to start that martial fires.

Speaker 1 (01:58:41):
That's a joke, all right, Okay, So was she you're
saying that they should own up to I get what
you're saying.

Speaker 4 (01:58:52):
I get what you're saying.

Speaker 23 (01:58:53):
Hey, right now, we're not going to turn off and
they're not going to control my air conditioning and they're
not going to know. Oh, the smart meter is not
about control. And that might be today, but I don't
know about tomorrow.

Speaker 1 (01:59:07):
By the way, I never said I never said the
smart meter is not about control. It's all about control.
I'm just saying that it's all about control. But we
don't own Excel, so we don't get to.

Speaker 4 (01:59:22):
Tell them what to do.

Speaker 1 (01:59:24):
See, we are, as a really honest to god, we
feel we have way more rights than we actually do.
You know, Excel Energy, Excel Energy can pretty much do
what they want as long as the Public Utilities Commission
approves it.

Speaker 4 (01:59:40):
Our choice is to drop off the grid. So what
I think you ought to do.

Speaker 1 (01:59:45):
Joan is you ought to go up into the mountains
and get a cabin and live off grid and get
off the next door. She told me she read nextdoor's
terms and conditions. Do you want to bet a million dollars?

Speaker 4 (01:59:58):
She did not read them. She didn't.

Speaker 1 (02:00:01):
She looked at him, she may have hit except, but
she didn't read him. She didn't read him. Just like
people that call up and talk about the Constitution and
I said, did you read it? I had one guy
say that, you know it was unconstitutional. I asked him
which section of the Constitution are you referring to? He
had no idea. So more and a lot of people

(02:00:24):
talk about communism, but have they read the Communist Manifesto? No,
they haven't. I read the Communist Manifesto. Oh I've read
it completely, absolutely No.

Speaker 4 (02:00:38):
No, I read it to educate myself, just like the Kuran.

Speaker 9 (02:00:41):
I read.

Speaker 1 (02:00:42):
I read things because people discuss them. They don't know
what they're discussing. They have no idea what they're talking about.
But they talk about communism as if they read the Manifesto,
and they never have. So it's just funny to me
how Joan is on here complaining about privacy, and she

(02:01:03):
has eleven thousand followers on next door, and next door
has the power to go into her contacts and her
web history.

Speaker 20 (02:01:12):
Ooh, even worse, think about that. I am thinking about
it's turning my hair white. People listen, I got to
take a break. I'm Tom Martine. Call with more hypocrisy.
I'd be right here by the way. Dan McKenzie can
do a will for you, can do a trust for you.
He even has creative ways to do an LLC where
you can keep property in it that passes through your death.

Speaker 1 (02:01:35):
It's like a poor man's trust. Dan McKenzie is very
creative and if you need someone to help you with
a state planning. In fact, Deputy Bo went to him
and loved him. I send other people to him and
they give him great reviews. Eight three three co plans
eight three three coo plans Go with a sure thing

Hi Tom Martino, your troubleshooter. My god, what a spirited discussion.
I have Barry Miller with me to keep it up. Barry,
you have a big shoes to fill. We've had a

(02:02:45):
lot of discussions today. So let's talk about being a landlord.
And I want to ask you straight up what do
landlords have to do. I can tell you I'm a
landlord under the Vestera Turnkeyway. And by the way, here's
what's amazing, is uh do we have in the studio?

(02:03:06):
Let me let me bring that camera up, Henry. You
don't mind me.

Speaker 4 (02:03:10):
Mentioning that you bought one of the houses, So did Bo.

Speaker 1 (02:03:14):
So we have three of us right here, Bo, Henry,
myself that have been part of the Vestera Turnkey Way. Henry,
let me ask you what have you had to do?
You do you keep a little set of quick books
or something? Or what do you do anything at all?

Speaker 4 (02:03:31):
Yeah?

Speaker 17 (02:03:31):
I have a file on my computer that will just
keep all the statements from the property manager.

Speaker 4 (02:03:37):
Yeah, but do you have to do anything.

Speaker 17 (02:03:40):
I mean, yeah, I keep books for it, like yeah,
everything lined up.

Speaker 4 (02:03:45):
Yeah yeah.

Speaker 1 (02:03:46):
But in other words, you could literally just take the
statements from the property manager to your accountant at the
end of the year. Also, Bo is part of a
house that he's done with me and Barry. Explain what
the system is. Explain it to someone who knows nothing

(02:04:07):
about it.

Speaker 13 (02:04:09):
The key word for those who know nothing about it
is learn what the process is. I'm going to outline
it here in less than sixty seconds.

Speaker 7 (02:04:20):
But we do the work.

Speaker 13 (02:04:23):
We do all the work, and we oversee any of
the other people's work, like property managers, we oversee them.
We get those reports also, and then we keep them
and you could always call us if there's an issue.
We take care of the smaller issues so you don't
even have to take a phone call that a screen

(02:04:43):
broke and it's going to cost one hundred and eighty dollars.
You give us the okay to handle issues up to
five hundred dollars. But the overall process is it starts
with our massive, massive research. All the time going on research,
we pick home run hotspot economic marketplaces tom As. You

(02:05:05):
know metropolitan areas that are these absolute strongest economically, not
just real estate. Real estate follows the jobs. Real estate.
You don't build homes, and then all of a sudden
a factory is going to go in. The factory has
announced the big plant, the insurance company moving headquarters from Portland,

(02:05:28):
Oregon to Portland, Maine. And now Portland, Maine has all
those new employees coming in. And that's what causes real
estate to happen and build. So we do all that research,
pick the markets where, well you the customer will have
the highest appreciation gain in a secure economic area. But

(02:05:52):
then we hire magnificent fiduciary buyer agents. They drive the
neighborhoods that they are already know and they find the highest,
best home run hotspot neighborhoods, the most popular, those going
up in value, that have positive cash flow. That's the key.

(02:06:13):
There may be a slight negative cash flow because of
the higher interest rates we have for a little while longer,
but only slight. We do not tolerate any negative cash
flow over two hundred dollars a month unless the customer says,
very absolutely will go more. But let us look at
all the numbers ahead of time, but that doesn't happen.

(02:06:34):
Our company policy says we don't want to go above that,
and we don't, and then in the year we'll have
only positive cash flow. Long story. Made sure we do
every element with multiple safeguards for every customer.

Speaker 4 (02:06:51):
Okay, So what are you gonna do for.

Speaker 1 (02:06:56):
Let's say this Saturday, for people who come to the event,
it's a seminar this Saturday.

Speaker 4 (02:07:04):
Attention Morrow, I'm going to be there. Explain what you do.

Speaker 13 (02:07:09):
Okay, We in a solid fifty minutes explain the whole
program pictorially with a handout that you have to take
with you. We at the seminar, you see actual properties
and hear some of the actual numbers that our customers paid.
Because none of our customers are making less than twenty

(02:07:31):
five thirty thirty five percent return per year. Now that's
counting the equity gain. That's the big gain in smart
secure real estate. We explain the whole program in person.
Then you explain your program how there's another way to

(02:07:53):
get at this with much less down payment because you
pool money, which we are able to to do or
do it right, and so that's another advantage. And then
Tom after seventy five minutes of bury in Tom. Then
there's as another hour if people want it for their
own personal, individualized questions.

Speaker 1 (02:08:17):
All right, so I want to tell people how to
sign up my Biggest Return dot com, My Biggest Return
dot Com. If you go there, you can sign up
and show up and there's no obligation whatsoever. You can
ask whatever questions you want. And again, here's what I

(02:08:37):
need to know real quick. What markets do you go into?

Speaker 13 (02:08:43):
Okay, that is confidential only people who signed a non disclosure.
But they're all east of the Mississippi. They're all in
good metro areas where the median price is significantly less
than five hundred thousand.

Speaker 4 (02:09:03):
So we're okay.

Speaker 13 (02:09:04):
Just in any market. We want the best markets with
the highest return and most security because half the people
in America could afford to buy these homes either at
right an investment or as a primary home.

Speaker 1 (02:09:19):
And by the way, my Biggest Return dot com, My
Biggest Return dot Com.

Speaker 4 (02:09:23):
I'll see you Saturday. We have more red after this.

(02:10:07):
Let's talk to Keith about his eight four f four
fifty Wow and eight.

Speaker 4 (02:10:15):
F four fifty. What's going on, Keith?

Speaker 18 (02:10:19):
Well, what's going on is uh I broke down in Shreveport, Louisiana,
and this gentleman that I took it to had it
for a month and he wasn't very communicated or didn't
answer the phone or text. So I told him that
he's had it long enough and that I was going

(02:10:40):
to take it to Ford and tow it over there
and they were going to.

Speaker 7 (02:10:44):
Look at it.

Speaker 18 (02:10:46):
Well, Ford had it for a week and diagnosed it
that there was filinder six and eight, that the pistons
had hairline cracks in it. Well, the gentleman that had
it to begin with, he ended up not putting the

(02:11:06):
truck back together. He had all these wires cut, so
all right, so I needed to get it just back
to Colorado. So I brought it back to Colorado and
I found a gentleman that was able to fix it.

Speaker 4 (02:11:23):
Well.

Speaker 18 (02:11:24):
He gave me an estimate, and then when he started
pulling the motor out to get the new motor in,
he realized that this guy did more damage than what
he's seen, so, you know, cost me another X amount
of dollars. So basically, it's all I want to know
is I can Can I go take this guy to

(02:11:45):
small claims court? Is it worth it?

Speaker 4 (02:11:48):
Well?

Speaker 1 (02:11:48):
Kay, Keith, let's talk what I'm trying to find out
with your eight four point fifty.

Speaker 4 (02:11:55):
How many miles.

Speaker 14 (02:11:58):
Have I had?

Speaker 7 (02:11:58):
One hundred and third?

Speaker 4 (02:12:01):
Not terrible?

Speaker 1 (02:12:01):
Okay, Now the reason I'm asking is this, what was
your original problem you took it in for.

Speaker 18 (02:12:10):
So I was just like I said, driving down the
road highway, came to a rest stop, shut it off,
came back out, and then it wouldn't start back up.

Speaker 4 (02:12:18):
Okay.

Speaker 1 (02:12:18):
Now, the dealer that looked at it after this clown
looked at it. They said, you had hairline cracks where.

Speaker 18 (02:12:28):
On the top of the pistons.

Speaker 1 (02:12:31):
Okay, you're not blaming You're not blaming this guy for
those hairline cracks, right, No, no, no, no, Okay, here's
what you have to discern.

Speaker 4 (02:12:42):
How much added damage did this guy do? Now, let
me be very clear on this.

Speaker 1 (02:12:49):
If you had to rebuild your engine because of those
hairline cracks, then certain things would have been done anyway,
And you can't charge him for stuff that you have
to do anyway. You can only go after him for
any additional damages he did. What additional damages did he

(02:13:12):
do that Your engine rebuild.

Speaker 18 (02:13:15):
Will not fix two thousand seven undred?

Speaker 1 (02:13:20):
Tell me what that is that? What does two thousand
seven hundred represent? Your truck is almost not worth you know,
the whole engine isn't worth that. So I need to
know what are you talking about? Specifically? What for two
thousand and seven hundred?

Speaker 4 (02:13:35):
What did they do?

Speaker 18 (02:13:39):
So they when they were replacing the turbo because they
said the turbo was bad?

Speaker 4 (02:13:46):
Who replaced the turbo? Who replaced the turbo?

Speaker 18 (02:13:51):
The first guy, the first guy that I took it
to in Louisiana.

Speaker 4 (02:13:57):
Okay, he replaced the turbo.

Speaker 18 (02:14:01):
But he replaced the turbole because he thought it was
the turble. Then he went on with the ECM module
and then that wasn't it, but he started report.

Speaker 4 (02:14:12):
Here's here's all I need to know. Here's all I
need to know.

Speaker 1 (02:14:16):
What damage does that twenty seven hundred dollars represent?

Speaker 18 (02:14:23):
Okay, so what it represents is see if I wouldn't
known what all the questions were because the guy who
was working.

Speaker 4 (02:14:30):
On it's there's there's not all the questions. There's one question.

Speaker 9 (02:14:34):
What damn it?

Speaker 1 (02:14:35):
You?

Speaker 4 (02:14:35):
You want to go after this guy? You got to
answer the primary question. What did he do?

Speaker 18 (02:14:42):
So apparently what he was supposed to do. But what
he did is he cut all the hoses, he cut
liars underneath the dash, he cut he just pours part
on the motor.

Speaker 1 (02:14:53):
All right, take him off, got him again, you got
hold on, put a police, put him on hold.

Speaker 4 (02:14:59):
Okay.

Speaker 1 (02:15:00):
Look, here's my comment. If this guy did damages, he
should pay for them. But what I'm getting at is
this only the extra damage. Okay, your engine needs to
be rebuilt, period. Okay, So you go after him for

(02:15:24):
the wiring and all that other stuff you have to do. Okay, yes,
you go after him, and you can take in the
small claims court. But you have to go there to
take him to small claims court. Okay, so you would
file a case and then you'd either fly there or
see if they'll let you do it telephonically. If you
can do it through zoom or through the telephone, you

(02:15:47):
can sue him in small claims court. Like that, all
the laws of Louisiana would prevail. So that's the way
you do it. Yes, you can go after him, but
be careful. When you have an old truck with one
hundred and thirty five thousand miles, you can only do

(02:16:08):
the added damage. I know a lot of people feel like, well,
wait a minute, he did this, this, and this, But
if this and this is going to be handled in
your engine rebuild, then it's silly to try to get
that guy to pay for it.

Speaker 4 (02:16:25):
You have to do it anyway.

Speaker 1 (02:16:27):
You're only going to charge him for stuff you would
not have to do anyway, like those wires and hoses.

Speaker 4 (02:16:37):
We got more coming right up.
