Last year, I wrote the following opening after it was
announced that Blenda Township officer Grub was going to be
charged with murder. Should officers be accountable for their actions, absolutely,
Should they be held to a higher standard, without question.
But I'm here to say that the overwhelming majority of
people in our society know very little of anything about
what it means to be an officer. After the riots

of twenty twenty, you may think that they need more training,
and like in any profession, most will tell you that
we cannot have enough. But do you know what training
an officer gets every year, what is mandated in order
to keep a commission as an officer? Most do not,
And frankly, that's okay, But it's getting a little old

hearing people speak as if training officers is some new
idea just being tossed around for the first time. Not
many know what comes before every arrest, every interaction, every
life and death decision that is done in nearly a
split second, a decision that will be debated, second guest
and criticized with the benefit of knowing all the facts,

not just the facts the officer knew at the time.
So this is what I said last year. Do you
have rules where you work. You know guidelines on how
you do your job and boundaries you must stay between
while doing that job. Now, most of these rules, I
would assume are more or less company policy policies that,
(01:28):
under the right circumstances, have expectations and exceptions to the
rule that you may or may not have the ability
to deviate from if it benefits the company. And for
the most part, these rules stay the same, or if
they change, you may get an email to introduce the
new guideline. In law enforcement, we have rules and guidelines
(01:49):
we must follow as well, and many of the day
to day mundane tasks are covered by departmental directives or
what is known as standard operating procedures. These are relatively straightforward,
unlike in any business, serve as a guideline on how
to handle many situations. There is, though, one other part
that is rarely talked about in the naive media, and

that is this standard which all law enforcement officers must
follow to protect the rights of the citizens of this
country as laid out under the Constitution. Police officers arguably
have the most difficult job in the world, not because
they face obvious dangers around any corner, but because they
have to navigate those dangers while protecting the rights of
(02:31):
the crook, the criminal, the bad guy, the murderer. Now
you may be thinking, that can't be that bad right.
Take the First Amendment, the right of free speech, the
right to express ourselves. But wait, what happens when that
citizen has the phone out recording a lawful rest on
the side of the road, taunting the officers to make
(02:53):
a mistake. Is that protected speech? It is, But would
you be okay with them recording a lifeless body at
a murder scene to post on social media? It can
get complicated real quick, and officers have to navigate those
waters while oftentimes handling a crime scene or accident. The
Second Amendment protects our rights to keep them bare arms.

It's our right. But under constitutional carry in Ohio, do
you have the right to carry in a school zone? Well? No, unless,
of course, you have an Ohio concealed handgun license. Did
you know that? But wait, rifles are excluded from these rules.
Don't get confused. Did you know a resident of another
state can come here and carry concealed without a license.

But that's not necessarily the case. If you're exercising your
second Amendment rights in another state. And get this. Get this, guys.
If you're an officer and you see a juvenile, let's say,
sixteen years old, walking down the street open carrying a pistol,
has a crime been committed? Prize? Most of the time

it is perfectly legal, and you may have just vitalated
their rights. If you did not know the nuances of
the law. You start to see why it is extremely
difficult for an officer on the street to keep up
with every new law that is binding. Second Amendment laws
in Ohio alone have changed remarkably in the last five years,

and an officer has to know the changing landscape to
uphold our oath of protecting the constitutional rights of all.
And those are just the laws passed by legislators. Case
laws have to also be abided by. Case laws come
from some prior case that has had a precedence set
(04:44):
for a topic. Case laws govern how we arrest someone,
when we can detain someone. It governs prior cases. It
sets forth the parameters for entering into a home without
a warrant, for dealing with the car you stop. This
smells like marijuana. All governed by case law. But you
(05:06):
might say that car that smells like marijuana, Well, hey,
that's legal now, right, Yeah, But you can't be under
the influence of marijuana while driving. But you may be
able to search the car if it smells like burnt marijuana,
But if it smells like fresh bud, that's a no go.
Can you distinguish the difference between fresh or burnt marijuana?

That small detail can determine if you can constitutionally search
the car and if you've k not been trained on
detecting the difference between fresh and burnt marijuana. When you
get on the stand and the defense asks officer, have
you been trained, you better be able to articulate when
and how you were trained. Saying you receive your training

from being at a couple Bob Dylan concerts is not
gonna fly, guys. It gets really complicated sometimes on keeping
case law straight. Being in law enforcement and protecting the
rights of citizens is done so not by some loosely
written or haphazard procedure. Officers are bound by law. Ever,
(06:11):
changing laws and court cases twenty three hundred decisions last
year alone in Ohio district courts that can impact how
we conduct ourselves while protecting society. Twenty three hundred cases
last year alone. We go through constant training to ensure
we protect the rights of fellows citizens. The reason I
(06:35):
spent this time laying this groundwork is to show how
easy it is for officers to react in good faith
but end up in State v. Delbert next year. Now,
when these cases make it all the way to the
Supreme Court of the United States, these cases garner a
lot of attention and are binding to everyone in the country.

Some of the most famous ones that are in great
Officers from their first day in the academy through their
thirtieth year in the profession are ones such as Terry v.
Ohio in nineteen sixty eight that gave guidance to officers
being able to briefly detain someone if they have reasonable
suspicion that a crime has been committed, or the nineteen
eighty five case of Garner Tennessee versus Garner, which stated

that the Fourth Amendment prohibiting unreasonable search and seizure, officers
can no longer now use deadly force in attempting to
stop a fleeing felon unless that person is believed to
pose a threat of serious physical harm to others. A
split second decision officers must calculate, could you differentiate the
(07:43):
correct response if chasing a juvenile running from a stolen
vehicle with a gun in his waist van versus a
juvenile running from a stolen vehicle with a gun in
hand firing at passing motorists versus a juvenile running from
a stolen vehicle with the gun in his hand down
on this side? Could you make that shoot don't shoot
decision in three seconds or less. Keep in mind a
(08:06):
decision with outcomes that are life changing that will be
judged from the comfort of an office or courtroom. These
decisions are relatively easy versus the hundreds of case laws
that must be followed in order to ensure the rapist
or the child molester you just arrested are kept behind
bars or they're let out because you violated their rights
(08:28):
in the initial detention of them. In nineteen eighty nine,
the Supreme Court case was decided out of an incident
in North Carolina that has become the basis for how
we judge any incident in which force was used by
an officer. This isn't a suggestion. This is not something
you can pull in and out of a court case
(08:48):
to help or hurt you. It is a Supreme Court
ruling that every attorney, prosecutor, judge, and law enforcement officer
is bound too bound to follow unless case law changes
it in the future. The ruling says this, an analysis
(09:08):
of an excessive force claim excessive force can be aggressively
handcuffing someone to the use of deadly force, should consider
whether the search or seizure was objectively reasonable based on
how a reasonable police officer would have handled the same situation.
The reasonableness of a particular use of force must be
(09:30):
judged from the perspective of a reasonable officer on the scene,
rather than with twenty twenty hindsight? Did you catch that?
Binding case? Law that governs governs our courts says that
a particular use of force must be judged from the
perspective of a reasonable officer on this scene, and not
(09:54):
by twenty twenty hindsight. Those are the words from the justices.
The calculus of reasonableness must allow for the fact that
police officers are often forced to make split second judgments
in circumstances that are tents uncertain and rapidly evolving. Split
(10:16):
second judgments about the amount of force that is necessary
in a particular situation. The reasonableness inquiry in an excessive
force case is an objective one. The question is whether
the officer's action are objectively reasonable in light of the
facts and circumstances confronting them, without regard to their underlying
(10:37):
intent or motivation. Those are the words from the court.
We are bound to follow as written in that case.
What would a reasonable officer in the same situation have
done if it had happened to them? Lifelong criminal pools
what looks to be a firearm from their waistband and
(10:59):
points it at a who uses deadly force to protect themselves,
only to find out later was a water gun. The
officer can be protected under Graham v. Connor if the
objectively reasonable cause is met. The general public, the protester
on the street, the media, they don't realize that officers
do not work in a vacuum of doing whatever the

hell we want to do. We are sworn to protect
the rights of citizens, and that means we have to
follow case laws. The reason I spent so much time
today on this is because Graham v. Connor continues to
be grossly overlooked as of late in our very own city.
It is overlooked with one intent to arrest and charge
(11:44):
police officers at any chance under this administration. At the
time of this writing, the trial of Blnden Township officer
charged with murder has concluded and he wise moments ago
acquitted on all charges. If you remember twenty twenty three,
the officer had responded to back up a fellow officer
(12:06):
who was confronting a thug, a career thug who was pregnant,
and who had just stolen up to eleven bottles of
alcohol from a local store, not a crime of opportunity,
but once she methodically carried out many times under her
own previously stated profession of career thief. The twenty one
(12:26):
year old had methodically backed into a handicapped spot, made
sure she had no visible tags on her vehicle, and,
when confronted, defied over twelve lawful commands to exit her vehicle.
At some point during the brief interaction, she decided that
escape at all costs was her only way out, and
(12:48):
she accelerated towards the officer now standing in front of
her car, an attempt to murder. At the very least,
imposed serious physical harm by hitting the officer with her
view vehicle hitting him enough where his feet were off
the ground. The video clearly shows his feet off the
ground as she hits him, his handprint denting the hood
(13:11):
of the car, bruises on his shins revealed during the trial.
While certainly in fear for his life, he had to
make a split second decision to use force to stop
her actions or succumb to her unknown, her unknown intentions.
What would a reasonable officer in that same position have done?
(13:35):
The jury got it right. The judge and defense attorney
was able to inform the jury that witnesses can testify
to their own perceptions, but only one standard rises above
all the clutter. But it certainly raises the question what
deception was used with the grand jury to get this
(13:57):
murder indictment in Franklin County last year? Do you remember this?
I am running to put officers away with criminals they
arrest for succumbing to the temptation to shoot someone. I
am running to put officers on notice that we will
arrest them for succumbing to the temptation to shoot someone.
(14:22):
That was the Franklin County Prosecutor's own words during his
campaign before he won his election for prosecutor guys, at
what point do we start holding the citizens of our
community responsible for their actions. Certainly, this was a tragedy
that was avoidable one hundred percent. It would never have
happened if the pregnant missus Young and her two accomplices
(14:45):
did not steal eleven bottles of alcohol from a business.
It would never have happened. If Miss Young would have
complied with multiple lawful orders from the officers, It would
never have happened. If Miss Young did not attempt to
harm or kill Officer Grubb with a two thousand pound vehicle.

Miss Young unfortunately is responsible for what happened that day.
Her actions put those events in motion. Period. If you
want to see this city survive, we have to stand
up and be outraised that we let elected officials with
an anti police agenda rule our courts. Heck yeah, we
(15:28):
want all officers being accountable, but this should never have
risen to this level. Young did not die for stealing
bottles of liquor. She unfortunately died after force was used
against her to stop her actions that could have seriously
harm or killed a young military veteran and dedicated law
enforcement officer who chose a life of service to this
(15:52):
country and community. Did that officer deserve to die because
she decided to break multiple laws that day. We need
to tell segments of our community who continually encourage their
youth to not comply with authority. We have to tell
them it has to stop this nonsense. This has to stop.

Being a lawful, respectable contributor to society is really easy,
and we can fix these communities with one line. One
line is all it takes. If you comply, there is
a ninety nine percent chance you will not die. That's
what I would have on my protest sign, of course,
if I didn't have a job and I had time
(16:34):
to protest. The overwhelming majority of deaths caused by law
enforcement after using force is due to non compliance. Look
at the stats. That's why in my neighborhood there's almost
a zero percent chance of death or serious injury at
the hands of an officer. We teach our kids to
be respectful, to be law abiding, to respect authority. We
(16:58):
teach them that if you comply, you will get your
day in court. That's what a civilized society does. Welcome

jury forgetting it right and not judging on emotion, but
rather on the facts that govern our men and women
in law enforcement. They rely, Oh, they only had to
rely on one question. They has had one question to

be the outcome, and we were just so uh so

worried about that. It was such good news to hear today.

but I tell you, getting it right, but I didn't
have confidence that they would get it right. You know.
It's just you don't know how these these juries are
going to be persuaded by by some of the deception,
and that's what it was you were listening to some
of this stuff and it was pure deception that they
were pushing a lot of times.

Just yeah, I guess prosecutors want to win every case,
but this one shouldn't have gone to court, right, the
grand jury showed it.

news and I because this could have some far reaching effects.
On Tuesday, President Donald Trump nominated Robert Cicada to run
the ATF to become the director of the ATF and
now he's currently the agency's deputy director. Trump appointed him

that in position back in April, but now he's been
elevated as a nominee, so it still has to go
through They go through the Senate and go through the
go through the regular matriculation. But anyway, it would be
really really good. So if confirmed, he'll replace the acting director,
who is Daniel Driscoll. So people aheah, Daniel Driscoll. You
just you hadn't been here that long. Well, he's the
(20:59):
Secretary of the Army.

He's the Secretary of the US talk about.

Having a lot on his plate with everything that's going
on militarily.

Uh so uh.

But but Driscoll himself replaced probably the shortest terms of
a director of the ATF Cash Patel, who was acting.
So he's a director of the FBI. So so Trump
gets in uh dundlebock. Uh the thirty years under Biden
of his anti gun shenanigans. When he left, which was

in January, so ptel was everybody day until they could
get Driscoll to take over. But now they have appointed
as a nominee. This wonderful guy. Sounds like a wonderful guy, Sadeka.
So so who is he? I mean, what do we
what are we? What are we looking for? Well, now
that we can have some some relatively permanent uh direction,

and not the musical chairs aspect. As a matter of fact,
these terms, if he gets it, there are ten year
terms not allow Yeah, so I did not know that,
but it's a ten year term being the director of
the ATF. So who is he Well, he's a career
law enforcement agent. So he's got twenty years of experience
with the ATF already and again as acting deputy director.

As someone said, he's probably been running the agency most
of the time that the Secretary of the Army was
there going hey, you've been here twenty years. Eight has
put me in here. I can only imagine that he
had a lot of oversight in how that was happening.
So he's as an ATF, he was over the divisions
of the cities across many cities across the country, including Miami, Baltimore, Philadelphia,
(22:36):
and before he joined the ATF, he worked as an
anti gang and a swat operations of the New York
City Police Department and also a Florida Police department. I
don't have that city's name, but so he's already he
has a lot of experience. So now that he's here, though,
what does this mean, because the ATF has a great
(22:58):
impact on the FFL, every gun store, every gun owner.
They are enforcing gun law. So what's going to happen, Well,
it's time at the ATF. Even as deputy director, but
even before that, he's worked with industry members and several
of the industry groups have celebrated this nomination to run
the agency. Just for example, the National Shooting Sports Foundation
(23:21):
just said that, you know the status statement, we're encouraged
by his nomination because they respect his experience, his wisdom,
and his confident and they have confidence in his actions.
I love this one that was from Knox Williams, who's
the executive director and president of the American Suppressor Association,
And as quote was because in his role as a
deputy director, we've worked closely with Robert Cicada to ensure

law abiding gun owners have a seat at the table
when shamping policy, which has not happened in many years.
He confirmed that he would actually he said he will
be the first ever truly pro Second Amendment nominee to
head the agency. So that's good news. Anna, he's taking
a wait and see going. You know, we didn't endorse
or not. We're just gonna, you know, we're going to

see what's happening. Although there is the Gun Owners of America,
which is a little feisty group, and they said, we
don't care. They just want to abolish the ATF, so
we don't care who they put in because no one
should be there. I thought that was unusual. But the
Citizens Committee for the Right to Keep in Bare Arms,
which is very active in pro Second Amendment court cases
(24:27):
and hearings and support and there their assistant organization of
the Second Amendment Foundation, which is up on almost every case.
That am the most positive reaction of all the gun
rights groups, so Alan Gottlieb, who's the group's chairman, when
he said that in a statement that when mister Sadaka
was named the deputy director back in April, he received
high praises from many in the fire arms community. He
(24:49):
said he brings considerable experience along with what we believe
are truly pro Second Amendment views and it's going to
be a delightful change from the previous administration.

And anyway, they haven't scheduled center to have the scheduled
here's a confirmation hearing, but looks like it could be
smooth sailing.
