walked right on out the door.She said, excuse me, and I'm

Tulsa area, and you know,we help with individuals experiencing homelessness. So

we do a lot of community outreach. Is that something that was a is
a passion for yours or did youjust kind of fall into it and have
really enjoyed giving back to the community. Oh, it is absolute a passion
of mine. I I have alot of lived experience, So I myself
have experienced homelessness. I I wasa drug addict. I have been in

recovery for five years now. Iyou know, I've been hungry, I've
I've been the single mom, youknow, needing diapers and needing assistants.
And so when I was able toget back on my feet, that's what
I wanted to do. I wantedto be the person that could help individuals
that were in my situation. Iwanted to be the person that could help

me out. If that makes itabsolutely does talk about being homeless. How
were you homeless through my drug addiction? I, uh, yeah, just
ended up you know, being homeless, living living in my car, losing
losing custody of my daughter, livingin my car, and then living in

a burned out house at or atPine and so yeah, I did experience
that not very long. So youknow, these individuals that are experiencing chronic
homelessness that have been out for ayear longer. I don't know how they
do it, Oh my gosh.And so that's why I want to help
those individuals. Because I made ittwo weeks, I don't know how these

individuals make it longer than that.So I would love to help how I
can. What is the thing thatconstantly surprises you about homelessness in our metro
That individuals will choose every day.They will choose to stay outside in their
cars in the streets because there aren'tenough shelters that take their animals. They

will stay in the rain fleets nowwith their animals instead of go to a
shelter and be separated from their animal. That's a really interesting point that I
never thought about, because some ofthe reasons people don't go to shelters is
crime. They have to give uptheir stuff. But pets are one thing

I never thought about there because thereisn't very many. And so you're saying
that those people that are homeless,there's no way they're abandoning their friend.
You know, that is much morethan their friend, as their family members,
their security guard, to their emotionalsupport animal. I mean it is
everything to them, and so absolutelythey every day we see it, they

do not. They refuse to goto shelters or anywhere, you know,
to get services for themselves because theydon't want to be separated from their animal.
But luckily, the Tulsa Dacenter actuallyjust broke ground on some i think
ten new kennels so that individuals canbring their animals there. Now, well,

that's I think that's good work thatyou're doing there. Just to give
back and especially working through your sobriety, I'm sure that is something that is
an important part of your sobriety isgiving back. Oh yeah, absolutely that
That is what drives my recovery,is giving back to individuals and just you

know, just making it full circle. I did so much bad for so
long, and so when I wasable to get on my feet get clean,
I really wanted to you know,pay it back, and you know
the cliche of making turning something badinto something good. I did want to
do that, but I also wantedto help the individuals that were still living

in those situations. It says herethat we're going to jump right into a
pretty heavy thing. It says yousurvived a double homicide home invasion. How
old were you when this happened.I was nineteen when that happened. And
were you living by yourself or wereyou still living at home? No,

(01:03:54):
I was. I was living bymyself and my best friend was living with
me, and we had a littleduplex, and three individuals came in and
shot and killed my two friends infront of me and then left me,

(01:04:17):
just left me there and they left. Why did they spare your life?
Uh? That is a question Istill ask myself. That's the question that
the detective at the Tulsa Police wereasking me that night, because they didn't
cover their faces and so they wereidentifiable. And still to this day,

(01:04:44):
there's not an answer to that.And you know, maybe through my work,
that is what I'm trying to figureout in this life, is why
I did, Why I did survivethat? And you know, because I
did survive that, I was ableto help bring justice to one of the
individuals that came into my house thatnight. So they found one of them,

(01:05:08):
yes, one one and done.The other two are go out there
and that person's just not saying whothey are cooperating No, no, he
he he took it all the waydown. Two life sentences consecutively, so
hopefully he will never get out.But nope, he didn't. He would

(01:05:30):
not say who it was. Didyou have to testify? Yes, yes
I did, which was just astraumatic as surviving the actual incident. Uh,
the testifying was brutal. Yeah,you had to have been terrified.
Yes, yeah. So when theystarted the court proceedings, the very first

(01:05:56):
thing they did, uh, theygot me on the stands sworn in,
and they said, we're going toplay the nine one one tape. And
on the nine one one tape,it's me calling nine one one and you
can hear my friend in my armsdying. I did not know they were
going to play that tape, so, you know, and then when this

(01:06:17):
happened, I'm still just in thethrows a PTSD and trauma out the wazoo.
So when they played this tape,I I got up, I hopped,
I hopped the little barrier, andthey found me, I think,
three floors down in a men's bathroom. I ran out of the courtroom.

(01:06:40):
I could. I couldn't take itbecause you just you mentally went back there.
Yes, yeah, because I II didn't know they were going to
play the tape. I hadn't heardthe tape, and for the last year,
for that year and a half,I had been trying to escape those
sounds that I had heard that night, the sound of you know, people

and bodies dying, and that isexactly what I heard on the tape.
And so yes, I heard that, and my brain just you know,
fight or flight, and I thefirst time, I decided to fight and
stay in the house, and thistime I decided to flight and I ran.
I ran out of the courtroom,ran down the stairs, and I

think my mom and the prosecutor foundme in a men's bathroom on the floor.
That's insanely traumatic. I'm so sorrythat you had to deal with it.
That sounds like that was really hardand it probably you probably still relive
a lot of it. Yeah,yeah, I do, especially you know

when there's safety concerns. But alot of it I've I've lived to or
I've learned to live with it.And you know, time, time is
a really healing thing. And youknow, through through time, I've I've
healed and I wouldn't say I've gottenused to it, but I have learned
to live with it. And youknow, I see a counselor, and

you know, all the mental healthstuff for uh, to keep my mental
health good, get good self care, all of that kind of stuff.
So I have learned to live withit and and move on with my life
without carrying that guilt. Not thefirst time you've dealt with loss, though,
right, that No, because whenI was thirteen, I had I

had I had a brother overdose anddie when I was thirteen. And then

celebrating their twenty fifth wedding anniversary.And that was actually the last call I
did to my my bonus mom.I'm just gonna for this sake, I'm

just gonna call her my mom.Uh. The last phone call I had
with my mom is she They weretalking about their lake plans. They're so
excited to go out and celebrate theiryou know, twenty fifth anniversary. A
quarter of a century they've been together, and you know, they're so excited.
And uh, it was that Sundaynight they had been drinking, so
it was my dad's fault. Butthey were drinking on their jet ski.

(01:09:36):
The light was not on and aboat hit them and killed them when they
were on the way back to themarina. Wow, I'm so sorry.
How does one find out in prisonthat a loved one has passed? So?

(01:09:57):
Uh that it happened pretty late atnight, and a guard came into
my cell and woke me up.I would stay around like midnight, and
I should have known something was upbecause they were being nice to me.
They were being nice and offering toget my glasses in my shoes, and
that doesn't happen in jail. Andthey actually walked me down to the captain's

(01:10:20):
office and I gave it to themiddle of the night. There's no one
there, and I opened the door, and I, I have no idea
what this is about. I hadgotten into an altercation earlier in the day,
so I thought maybe I was gettinga middle of the night reprimand of
some kind. So I had noidea what was going on. I get

(01:10:43):
down to this captain's office, openthe door, and I see my mother,
my my biological mother, sitting there, and you know, she's just
got to look on her face,and so I immediately think of my daughter,
who at this time was one,and so you know, I said,
is my daughter okay? And andshe said yes, that I could

(01:11:06):
tell, and she didn't. Imean, she's got out with it.
And she said, I'm so sorry. There was a voting accident. Your
dad and Kathy died, and aboutall I remember at that point. I
know, we sat there and Iscreamed for a little bit and they let
me. They were very nice aboutgiving me some time. But the part

(01:11:28):
that was more traumatic is so whenyou get news like that in jail,
they automatically will put you on suicidewatch, and that means going to a
cell with twenty four hour fluorescent lights. You were stripnecked, put in a

(01:11:49):
turtle suit so that you can't harmyourself. And I begged them, I
said, I am, I'm notsuicidal. Please don't get Let me go
back to my sale and just domy comforting thing please, And know they
they decided that after being traumatized oflearning that my parents died, that I

(01:12:13):
needed to be stripnked in the middleof the hallway and yes, yeah,
yeah exactly and made delay under afluorescent light. Yeah, as a sun
rose. I just I'll never forgetthat. I just it was the most
that that traumatized me, almost asmuch as hearing that my parents died,
was that I had to be stripneked in front of a mail guard and

(01:12:38):
I was humiliated. It was itwas pure humiliation. So do you do
you think it would be in hindsight, would it have been better to not
find out until you were were released? Well, in my situation, no,
because I was actually I had alreadysigned time to go to actual prison,
so I wasn't going to be leastfor about eight months anyways. So

(01:13:04):
uh, i'd been going for thoseeight months wondering why they weren't getting me
a call. Uh, you know, So now it is one of the
things. It was better to justrip the Bay of eight off and and
you know, and and get itdone with and so I was able to,
you know, go through my mysentence. Okay, but it was

(01:13:25):
really hard getting out because it wasalmost like losing them again because you know,
when I got out, well,the last time that I was in
the free world I had. Ihad my parents, you know, and
I had this whole other life thatno longer existed. And so getting out,
getting out of prison was just likelosing them all over again, because

(01:13:49):
then I got my phone and Ihad all the text messages, and I
could see all the text messages mydad had sent me while I was in
jail, you know, if himjust sending in couraging texts, and you
know, and still till the dayhe died, he would even when I
was in jail, he would stilltext me every night. Love you,

(01:14:09):
baby girl, Love you, babygirl, Love you, baby girl.
So getting out getting those text messagesthat was really really really hard. That
was almost harder than losing them injail. So sorry, that's that had
to have been traumatic on top ofeverything else. Why were you in prison?

(01:14:32):
Uh? A little tom foolery withassault and discharging a firearm, Just
little little stuff like that. Now, I made a mistake in my drug
in my drug addiction, made amistake, got in a fight with a
friend, and yeah, I decidedto discharge a firearm and quickly and promptly

(01:14:55):
learned my lesson on that. Giveme a little more detail. That's a
pretty uh broadt. I discharged aweapon with a friend, So give me
what were you arguing with a friendand you pointed a gun at them and
then shot at the ground, Likewhat happened? Yeah? Pretty close.

(01:15:15):
Yeah, we were arguing. Welived in the same apartment complex. It
was like an eight plex apartment,so we lived in the same building.
Basically, we lived in the samehall. We were two doors away from
each other. And we had justbeen just little, stupid, twenty one
year old stupid fights and we weregoing back and forth fighting and my brother

(01:15:39):
came over and I do remember theystarted to make fun of my brother.
That's where I got really mad.I pulled out my gun. They were
in their apartment. I went totheir door and I I was trying to
get them out of the apartment tojust have a good old fashioned fight.

(01:16:00):
They wouldn't open the door. Theystarted making fun of my brother. I
pulled out my gun, fired aroundinto the wall, and that was it.
And they didn't give you. Hadyou been in trouble before that?
No, or I mean if youcount possession of marijuana and bartles fill but

(01:16:21):
I mean if you had a record, that would be in trouble for sure.
Uh, yeah, because it feelslike a pretty intense penalty for discharge.
Yes. Yeah, so the thereckless reckless conduct of the firearm that
was the my count too, thatwas a misdemeanor. The felony was assault

(01:16:43):
with intent to commit a felony.Mm. Yeah, that's that's a little
bit different than discharge. Yeah.Yeah. I want to back up one
thing, just to understand the timeline. Did your drug addiction start because of
witnessing what happened to your friend orwas that already happening? I so the

(01:17:12):
way I said it, I wasdefinitely like a substance user. I was
using substances. But my addiction,uh definitely came after surviving the shooting.
Absolutely. Yeah. Last thing Igot here because it's a pretty awesome one.
It says you can fly a helicopterkind of if there's a pilot in

there, Well, that's man,that's that's not flying a helicopter. Girl,
That that's someone else flying and you'rejust holding the stick. Well okay,
So my dad was a helicopter pilot, Okay, and so my whole
life we flew helicopters and and that'sthat's what we did. We had a
family country who flew helicopters, Andso my dad did teach me, you

know, to fly. Now,I don't know how to take off.
I don't know how to land,but you know when we are up in
the air, Yes, I am, you know. He would let me

you said they've been I think it'said in a year, Now that they've
been separated, anything that they've doneduring that year on their own and their

no children involved, right, therehas to be a period of at least
eleven days that have passed from thedate that you file for a divorce before
a judge can sign a decree.So you file it on the first of

May, the judge can't sign thedecree until the eleventh of May. Now,
if you've got children involved, there'sa ninety day waiting period or ninety
day cooling off period that is requiredthat in that sense, and it's the
same as the eleven day you know, if you file on May first,
ninety days and has to pass beforethe judge can sign that decree. Now,

(01:41:40):
there are there are some counties thatdo wave the ninety days. Some
are very good about waiving it andno others are not, So it just
really depends on which county you're in. But the law says there's a ninety
day waiting period unless it's waved bythe court in some way. Stax says,
my husband took the guns out ofthe house and hid them. I
have pictures of all them. CanI use the pictures in mediation? Absolutely?

(01:42:03):
Absolutely. And the good thing abouttaking pictures is, you know,
assuming you can know what kind ofgun it is, and of course gun
collectors as a general rule, willhave a list of what those guns are
so they can have a value onthem. But you're basically the good part
about pictures is you can say,look, I know for a fact that

(01:42:24):
you had a you know, aMossberg rifle, or you had a you
know, Smith and Weston AR fifteenor whatever it may be, and I
know for a fact that based uponthe market research, it's worth this amount
of money. So it's good tohave simply because that way you can start
listing all the things that can bedealt with in the mediation that requires a

(01:42:47):
certain monetary amount. So you know, if the picture shows twelve guns,
in the safe, and the otherside is saying no, no, I've
only got five. You could say, well, actually, there's the picture
that I took before you took allthe guns, and there's actually twelve in
there. So you know, it'sa very good thing to take pictures of
anything in your house, especially whenit comes down to things that are in

(01:43:10):
collections, like you know, gunsor coins or anything that you collect.
Those are great to have. Thatway, the other side can't say,
well, you know, actually there'sonly this amount, and you say,
well, actually, I've got apicture that shows that I took right before
you took everything, that shows allthese things. So it's very wise actually
to take pictures. And I encourageall my clients to take pictures of those

(01:43:32):
sorts of things so that we canuse them in the case itself. So

big mixconception, especially when you're talkingabout a very expensive ring, okay,
that the individual that bought it isentitled to whatever portion they think they're entitled

to, fifty percent or otherwise.Wedding rings are considered gifts, period.
So if you choose to buy yoursoon to be new wife a fifty thousand
dollars ring with the you know,yellow canary diamond and in or whatever it
may be, that's a gift.You're not getting that back. So that

(01:44:41):
that's how the judges, and that'show most everybody handles rings. Is their
gifts, whether you like it ornot. So you know, if she
wants to sell it, that's upto her. That's her gift from you,
and it's not something that will bedivided in the marital estate. Jennifer

you. I mean, if youdon't have any other place to go,
then yes, that's that is anoption for you to do. Are the
kids grown a Are they still underage? But yeah, they're still elementary types?
Were all we got one on atschool? Now one? Yeah?
Okay, but the okay, Igot you. The reason I ask is
is that if you are going toleave, because you find some place that

you can go live, whether itbe with a family member or friend or
whatever. You know, I alwaystell people to be sure and you know
you want to take your children withyou, all right now if you can't
afford to go anywhere else, andthen you know you'll stay in that same
residence, unless, of course,you know, if there is a factor
of abuse or you know, somethingof that nature, you can always feel

(01:46:11):
free to get a protective order ifit rises to the level of protective order
for physical abuse or something of thatnature. So you know, if a
protective order is granted, then hewill right. You can't get a protective
order for that that that's why theprotective order statute is not contemplated for those

(01:46:35):
sorts of things. They're more forphysical and harassment and stalking and things of
that nature. But my point ofit is, if for some reason it
got to that point of physical youcould get a protective order, at which
point the protective order can require himto be kicked out and forcibly removed from
the home. So that's the onlyreason I bringing that up. Does he

(01:46:56):
have somewhere he can go? Isthere a family member close for him or
anything like that. I think it'sjust we've both lived there for so long,
and it's just neither one of usor wanting to leave. But at
the same time, you know,we've just been on this road of not
getting along for so long. Iunderstand, and this is something that a

(01:47:18):
lot of families have to deal withand contemplate because the cost of obviously running
two households or two homes is veryexpensive, and so a lot of times
people will stay in the same residencesimply and they just you know, stay
in different rooms and they stay awayfrom each other during the process. Is
the do you own the home?Is it rented? Do you what interest?

(01:47:39):
Do you have no home? Weown the home, but I mean
we do have the shop that hecould but but that's I think why we
survived this long because he's got thislike maintave that he can go to,
right. So you know, unfortunately, the court can't force anybody out until
there's a temporary order. I mean, if there's a ten preorder that says

(01:48:00):
that you're awarded the marital residents andhe needs to leave, that is obviously
an option, and that is somethingthat can happen. But again we've got
to file for divorce and get infront of a judge on a temper order.

Just an example of divorce can bea simple thing, but it can
be quite complicated, and they're allso different. Absolutely, I mean,
no two divorces are the same.As you've heard it said so many times
throughout the years we've done this Corbyn. People will say, well, I've
talked to my friend who you know, his case is exactly like mine.

(01:48:45):
Nope, well it's not. Andthe reason being is because every human being
is different. All of our personalitiesare different, how we handle situations are
different. So every single divorce iscompletely different than your friend, your family
member, or your brother or yoursister or whatever it may be. Every
case is different and that's why youwant counsel is because every case is different.

(01:49:11):
This tex says, my oldest isten. Her bio dad hasn't been
in the picture at all since shewas one. If my wife and I
decide to file for adoption, isthere any way he can throw a wrench
in the process. What do youthink, Jeff, No, I don't
you know. The requirement of theadoption statute says, when you're doing an
adoption with that consent meaning the individualwill not agree to the adoption, then

(01:49:33):
you have to prove A or Beither A they have failed to maintain a
substantial relationship in twelve of the lastfourteen months from the date that you file
for adoption or b they've failed topay child support in that same timeframe.
So that's hurtle number one. Youknow, those are typically they go hand

(01:49:58):
in hand. If somebody hasn't hada relationship, that typically have it page
on support, although there are exceptionsto the rule because people do work and
they do intercept cash and that sortof thing. But the first hurdle is
the a WOP for adoption without consent, which is what those requirements are,
and then you know the next stepis the best interest. Now. The
only wrench that could ever be thrownin sometimes is when you're dealing with an

(01:50:18):
Indian child the case, so whenyou're dealing with a Native American child,
you deal with something called IQUA Ic WA, the Indian Child Welfare Act,
and that act has a specific requirementthat says that there have to be
substantial efforts to try and you know, reunify the child with that parent.

(01:50:39):
Now, you know, obviously there'slots of caste on this, there's lots
of lots of things. Is theidea that the Native American tribes want to
keep Native children with Native parents ifpossible. Obviously, the tribes are pragmatic,
They understand that that's not always thecase, but there is this extra
step, so you know it maynot be a monkey wrinch per se,

(01:51:00):
other than to say, you know, there's an extra step involved if if
it's a Native American child. Butyou know, if the guy has been
off the radar and you don't knowwhere he's at and he's not seen the
child, he's not paid anything,and you've tried to reach out throughout the
years to try to get him tosee the child or whatever, and he's
just ignored. You know you've doneyour due diligence at that point and there

(01:51:21):
shouldn't be any issues. Jeff Fensley'sjoining us from Hensley and Associates And Jeff,
this question has to do with theadoption. Where do married couples start
the adoption process as first time parents. If I'm understanding that correctly, it
sounds like a filing issue. Imean, the requirement for marriage in the

(01:51:44):
state of Oklahoma for an adoption isthat the people have to be married for
at least a year. Doesn't matterif you're a homosexual couple or if you're
a heterosexual couple. The requirement isto be married one year by the time
that the adoption is completed, allright, so we would file a petition
to get that started. And aslong as you've been married at least a
year by the time that we finish, that meets the requirement of the statute.

(01:52:08):
And there's no issues. As faras first time parents, I'm not
sure I understand that portion of thequestion, other than to say, you
know, there's no state required classes. There's no state funded classes that I'm
aware of for parents who are adoptingand becoming first time parents. I mean,
as we all know as parents ourselves, that there's no manual that's handed

(01:52:30):
out with each baby that pops outso that we know how to handle and
raise them and that sort of thing. We kind of have to muddle our
way through it. And luckily,there are great resources out there for any
parents, whether it be first timeor others, for classes on dealing with
children and different age groups and thingsthat that nature. A lot of those
can be done through Family and Children'sServices here in Tulsa. There's some that

(01:52:54):
can be done through the DBIS grouphere in Tulsa as well, But there's
no manual phrasing children than these classes. So you know, the step one
is to call us so that wecan get the petition filed and get everything
rolling for you. When you're goingto adopt, do you just call a
service out of the blue or shouldyou go through an attorney? Well,

(01:53:16):
you remember, there's different types ofadoptions, and what I mean by that
is this. There are step parentadoptions, which is the bulk of what
we do, okay, where somebodyhas remarried and the other parent has disappeared
or is not involved, and sothe new spouse wants to adopt that child
as their own. It's a stepparentadoption. And then you've got, you
know, a regular open adoption ora regular adoption where any somebody gives birth,

(01:53:42):
a lady gives you know, alady gives birth to a child,
and somebody wants to adopt that child, whether it be a married couple or
a single individual or whatever it maybe. You know, and then it
gets down to is that an openadoption? Is it a closed adoption?
These are all things that have tobe considered, but really those are the
two is step parent and you knowopen adoptions. There are adoptions too where,

(01:54:05):
for example, a child has beenremoved from a home in a deprived
child case and has gone into thefoster system that a foster parent wants to
adopt. But did answer your question. I think I may have straight a
little bit there, Corbin. Iapologize. I was trying to just kind
of cover all the kind of adoptionsthere are. Yeah, I think I

(01:54:26):
think what I'm really asking is,if me and my wife go we want
to adopt somebody, we want toadopt a child, how do we start
that process. Is it best togo through an attorney first, or do
we just cold call up a fostercare service? Well, you know,
it's always it's always best to gothrough an attorney, I think in my
opinions, and I don't say thatbecause you know that's what I do for

(01:54:46):
a living. I think there's anadvantage to be done in the sense that
you're going to deal with somebody whois going to help walk you through the
process from start to finish, sothat you can have that happen. Now,
a lot of times people will comein and say, Okay, I
know this young lady and she's wantingto give up her child for adoption,
and my wife and I want toadopt, and and that's when we start
looking at those adoptions. You know, and of course if you want to

(01:55:11):
adopt it. If you're from outof state and you want to adopt an
Oklahoma child, then obviously we candeal with that as well. Then that's
dealing with the interstate compact rules andthat sort of thing. But you know,
you always, I think it's alwaysbetter to call an attorney, especially
to get your questions answered before youstart the process and understand exactly how things
are going to go, as opposedto kind of just muddling through or trying

(01:55:31):
to do your own research on theinternet. Because remember, whatever's on the
internet is not always correct, benot specific to your case, and see
it's not always the best information.So you know, that's why you wouldn't

talked throughout the years many times,and you said it over and over,
it's fine until it's not. Youknow, it's it's uncontested until it's not,
and it's usually when it's caught onone thing and that's when it all

blows up. And so it's alwaysgood to have for that reason. But
also too, you want to makesure the documents that you're you know,
trying to file out the court arecorrect. I mean, I've talked to
the court liaison several times throughout,you know, over the years, or
a number of times over the years, and the amount of papwork that they
get that is incorrect because what theydon't have lawyers is problematic in the sense

that you know, uh, youmay take it in to get it signed
by the judge and they'll tell youit's wrong and you'll go back. I've
heard as many as six or seventimes before you may finally get it right
over a period of months, whereasif you hired an attorney, you could
get it done right the first time, one time only, and then you'd
be done. So you know,uh, it's not wasting money. It's

money well spent in the sense thatyou're making sure that everything is correct,
the paperwork is correct, the procedurescorrect. You know the judges, we
know the courthouses, we know theclerks, we know all the things that
are required. So it's definitely notwasting money in any way shape or Jeff

anything per se. I mean youwould think that if he wants out,
he would have filed as well already. But with that being said, there's
no jeopardizing. I mean by steparating, you've now delineated exactly when that separation

date is. And that separation date'simportant because when you're looking at any debts
that have been incurred, or anythingelse that's been purchased, or anything done
after the data separation, that's onthat person individually, rather than on the
marriage itself. So you know,however long you said they've been, I
think it's said in a year nowthat they've been separated. Anything that they've

(02:02:24):
done during that year on their ownand their own names and everything is on
them solely. So she's gone outand blown twenty five thousand dollars on credit
cards or whatever it may be,that is all on her and not on
him, So it's not really hurtinganything in any way, shape or form.
If there's a house that's involved,that it might get interesting in regards

(02:02:44):
to dealing with the equity and thosesorts of things. But again, even
then, anything that's done after thedata separation is one of those things that
is going to be solely on theindividual that has the house. So said,
I don't think it's a there's anyharm and anything at this point.
Again, you've already delineated everything.You've made a hard fast data as to

(02:03:08):
how we need to divide things up, so it's not necessarily a bad thing
at all. You've mentioned before thatthere's a cooling off period, and I
don't recall the parameters, but thereare parameters for a cooling off period when
you get divorced. Right, Soin state of Oklahoma, there's two cooling
off periods. If there are nochildren involved, right, there has to

(02:03:29):
be a period of at least elevendays that have passed from the date that
you file for a divorce before ajudge can sign a decree. So you
file it on the first of May, the judge can't sign the decree until
the eleventh of May. Now,if you've got children involved, there's a

two divorces are the same. Asyou've heard it said so many times throughout
the years we've done this, Corbyn. People will say, well, I've
talked to my friend who you know, his case is exactly like mine.
Nope, it's not. And thereason being is because every human being is

different. All of our personalities aredifferent, how we handle situations are different.
So every single divorce is completely differentthan your friend or your family member,
or your brother or your sister orwhatever it may be. Every case
is different, and that's why youwant counsel is because every case is different.

(02:11:35):
This Tex says, my oldest isten. Her bio dad hasn't been
in the picture at all since shewas one. If my wife and I
decide to file for adoption, isthere any way he can throw a wrench
in the process? What do youthink, Jeff? No, I don't
you know it. The requirement ofthe Adoption Statute says when you're doing an
adoption without consent, meaning the individualwill not agree to the adoption, then

you have to prove A or Beither A they have failed to maintain a
substantial relationship in twelve of the lastfourteen months from the date that you file
for adoption, or B they've failedto pay child support in that same timeframe.
So that's hurdle number one. Youknow, those are typically they go

(02:12:22):
hand in hand. If somebody hasn'thad a relationship, they typically have it
pay child support, although there areexceptions to the rule because people do work
and they do intercept cash and thatsort of thing. But the first hurdle
is the a WOP for adoption withthat consent, which is what those requirements
are, and then you know,the next step is the best interest.
Now, the only rent that couldever be thrown in sometimes is when you're

dealing with an Indian child. Okay, so when you're dealing with a Native
American child, you deal with somethingcalled IQUA ICWA, the Indian Child Welfare
Act, and that Act has aspecific requirement that says that there have to
be substantial efforts to try and uh, you know, reunify the child with

that parent. Now, you know, obviously there's lots of caseeal on this.
There's lots of lots of Things,says. The idea is that the
Native American tribes want to keep Nativechildren with Native parents if possible. Obviously,
the tribes are pragmatic. They understandthat that's not always the case.
But there is this extra step,so you know, it may not be
a monkey rinch per se, otherthan to say, you know, there's

(02:13:26):
an extra step involved if there's ifit's a Native American child. But you
know, if the guy who hasbeen off the radar and you don't know
where he's at, and he's notseen the child, he's not paid anything,
and and you've tried to reach outthroughout the years to try to get
him to see the child or whatever, and he's just ignored. You know
you've done your due diligence at thatpoint and there shouldn't be any issues.

(02:13:48):
Jeff Fensley's joining us from Hensley andAssociates and Jeff, this question has to
do with the adoption. Where domarried couple start the adoption process as first
time parents? If I'm understanding thatcorrectly, it sounds like a filing issue.
I mean, the requirement for marriagein the state of Oklahoma for an

adoption is that the people have tobe married for at least a year.
Doesn't matter if you're a homosexual coupleor if you're a heterosexual couple. The
requirement is to be married one yearby the time that the adoption is completed,
all right, So we would filea petition to get that started,
and as long as you've been marriedat least a year by the time that

(02:14:30):
we finish, that meets the requirementof the statute. And there's no issues.
As far as first time parents,I'm not sure I understand that portion
of the question, other than tosay, you know, there's no state
required classes. There's no state fundedclasses that I'm aware of for parents who
are adopting and becoming first time parents. I mean, as we all know

(02:14:52):
as parents ourselves, that there's nomanual that's handed out with each baby that
pops out so that we know howto handle and raise them and that sort
of thing. We kind of haveto muddle our way through it. And
luckily, there are great resources outthere for any parents, whether it be
first time or others, for classeson dealing with children and different age groups
and things that nature. A lotof those can be done through Family and

Children's Services here in Tulsa, there'ssomething that can be done through the DVIIs
Group PARENTSULSA as well, but there'sno manual phrasing children other than these classes.
So you know, the step oneis to call us so that we
can get the petition filed and geteverything rolling for you. When you're going
to adopt, do you just calla service out of the blue or should

(02:15:39):
you go through an attorney? Well, you remember, there's different types of
adoptions, and what I mean bythat is this, there are step parent
adoptions, which is the bulk ofwhat we do. Okay, where somebody
has remarried and the other parent hasdisappeared or is not involved, and so
the new spouse wants to adopt thatchild as their own. It's a step

(02:16:00):
an adoption. And then you've got, you know, a regular open adoption
or a regular adoption where any somebodygives birth, a lady gives you know,
a lady gives birth to a child, and somebody wants to adopt that
child, whether it be a marriedcouple or a single individual or whatever it
may be. You know, andthen it gets down to is it an
open adoption is a closed adoption?These are all things that have to be

(02:16:22):
considered. But really those are thetwo is step parent and you know,
open adoptions. There are adoptions towhere, for example, a child has
been removed from a home in adeprived child case and has gone into the
foster system that a foster parent wantsto adopt. But did answer your question.

I think I may have strayed alittle bit there, Corbyn. I
apologize. I was trying to justkind of cover all the kind of adoptions
there are. Yeah, I thinkI think what I'm really asking is,
if me and my wife go wewant to adopt somebody, we want to
adopt a child, how do westart that process. Is it best to
go through an attorney or do wejust cold call up a foster care service?

(02:17:05):
Well, you know, it's alwaysit's always best to go through an
attorney, I think in my opinions, and I don't say that because you
know that's what I do for aliving. I think there's an advantage to
be done in the sense that you'regoing to deal with somebody who is going
to help walk you through the processfrom start to finish, so that you
can have that happen. Now,a lot of times people will come in
and say, okay, I knowthis young lady and she's wanting to give

(02:17:26):
up her child for adoption, andmy wife and I want to adopt,
and and that's when we start lookingat those adoptions, you know. And
of course if you want to adoptit, if you're from out of state
and you want to adopt an Oklahomachild, then obviously we can deal with
that as well. Then that's dealingwith the interstate compact rules and that sort
of thing. But you know,you always, I think it's always better

(02:17:46):
to call an attorney, especially toget your questions answered before you start the
process and understand exactly how things aregoing to go, as opposed to kind
of just muddling through or trying todo your own research on the internet.
Because remember, whatever's on the internetis a not always correct, be not
specific to your case, and seeit's not always the best information. So

nearly thirty years after this guy killedhimself, he was on the run from
authorities. They've been trying to gothrough this eighteen acre property and they have

unearthed ten thousand pieces of human remainsoh oh wow, mostly crushed and burned
skeletal fragments of teenage boys and youngmen whom they say he had abducted and
murdered in the eighties and nineties.The corner has announced that the remains recovered

from the farm have been positively identifiedas a couple of individuals, one of
them, Jeffrey Jones, went missingin nineteen ninety three. They believe he's
the third victim to have been identifiedin the recent months. There's additional DNA
profiles found on the property, butthey have not been identified, bringing the
total number of victims to twelve sofar. Quote Because of the many remains

were found burn and crush, theinvestigation is extremely challenging. The team of
law enforcement forensic specialists working in thecase remain committed. This dude was a
businessman and married father of three,and he hunted gay teens and men in
central Andyana beginning in the late eighties, and he's believed to have killed at
least twenty five people. And heused a fake name named Brian Smart when

he targeted young gay men at bars. Jones was the third victim identified by
the coroner's office recently. Before him, they identified Alan Livingston, who went
missing in ninety three, and ManuelRascindez, who vanished in ninety six.
This guy moved into the farmstead withhis family in eighty eight and they had

apparently like a big area where hehad been disposing of these decomposed remains,
and his teenage son discovered a skulland took it to the mother. The
wife blocked law enforcement from searching theproperty initially. She later divorced her husband

as more evidence began to pile upagainst them. Authorities eventually searched the property
when he wasn't home and found thebodies of several victims. He was forty
nine at the time. He fledto Canada, Canada, and after a
warrant was put out for his arrests, he killed himself. He was never
charged with the murders, and hedid not admit to any of the crimes

in a suicide note. They weremany and identified bones and bone fragments had
been sitting in storage till it wasdecided to open That reopened the case in
ninety six. Uh oh about missingpersons. The County Corner's office, along
with the FBI, State Police Laboratory, and the Biology and Anthropology department at

the University of Indianapolis, and DNAexperts from a Texas company all working to
identify all the victims. I mean, ten thousand pieces of human remains could
just be a few people. Yep, right right, you hear ten thousand
pieces. That sounds and it isa lot. Ten thousand of anything is
a lot. But I mean,if they're tiny, little pieces, it

could really only just be one person. Yeah, you know, but by
the sounds of it, he wasjust going after these gay men, killing
them and then burying them in thebankyard for being gay. That's what I
was trying to figure out. Washe doing it because they were gay?
Or was he attracted to him andlike doing things and like got caught and
then killed him, or was helike another Well what does that mean?

Like because he had a thing forthe gay men and then he would eat

I would suspect there's no way ofknowing. He was probably someone who was
suppressing his feelings and decided to punishothers for those feelings as well to try
