Investigating Autopen Use

Former President Biden insists he made all the decisions as investigations into autopen are underway. Fox News Radio's Tonya J. Powers joins us with the details.

Former President Biden doubling down yesterday saying I made the
decisions on the story. Tanya J. Powers with Fox News

So full disclosure. President Trump says he's used auto pen.
I used it yesterday with my mother who's selling her house.
But the idea of his cognitive decline is the subject
of a deep look from Republicans. Where do we stand.

Well, you're right about about the order that the President
has made ordering the Justice Department and the White House
to investigate former President Joe Biden's mental state while he
was in office. He did double down on that, like
you said yesterday, accusing him of not really running the country,
saying that AIDS used his auto pen to create policies

and things like that. Former President Biden has issued a
statement that said, let me be clear, I made the
decisions during my presidency. I made the decision is about
the pardons, executive orders, legislation, and proclamations. Any suggestion that
I didn't is ridiculous and fault. He called the wholding
a distraction, you know, by the President and the congressional
Republicans to keep people from you know, focusing on the

bills that they're trying to pass that would cut programs
like you know, Medicaid and things like that. This is,
you know, what he's basically saying is you know, this
is what they're this is what they're trying to keep
you from from looking at. So, the House Oversight Committee
Chair James Comer has issued a subpoena as of yesterday
to President former President Biden's physician, doctor Kevin O'Connor. He

wants him to come in for a deposition on June
twenty seventh. It is not clear yet on whether he
has responded and will you know, we'll be there for
that deposition or not.

Listen, George Clooney did not help when after the first
debate he said, this isn't the same Joe Biden that
we elected the first time around. Is that pretty much
the basis.

Of this thing? Well, I mean that the President Trump
has talked about the autopen stuff before. You know, I
don't remember how far back he has talked about it.
I don't know if it was after the Clooney comments
or not, but you're right, I mean between the Claney
comments and you know the fact that former President Biden
dropped out of the race that debate, the books by

Jake Tapper, I mean, none of it paints a good
picture obviously. The as for the auto pen stuff that's
actually been used for a long time, there's you know,
there's President Trump has used on open uh. You know,
it has been it's been a thing for for quite
a long time. I believe under President George W. Bush,

the Office of Legal Council back in two thousand and
five did a review of whether a president could legally
use the auto pen, and the Office of Legal Council
found that the president need not personally perform the physical
act of a fixing his signature to a bill to
sign it within the meeting of Article one, Section seven.

I mean, I don't want to get in the law
weed to but that's kind of the you know, the
edge this is all on is you know, if you
if you kind of do the logical thinking on this,
if the Justice Apartment of the White House investigate and say, well,
he used an auto pen, you know and these that
means that this is this stuff is that he signed
is not legal. That would you know, potentially include pardons,

and then you know, the logical explanation from there could be, Okay, well,
if we don't believe that pardons were legally issued, then
are they valid. If they're not, let's you know, bring
people to you know, let's let's charge people, bring people
to justice. Whatever that you see where this could could go.
I mean, so it's not a small thing that he's

talking about the auto pen, but it's also you know,
could come back to haunt him because he even said
President Trump even said in recent weeks when he was
asked about signing the you know, the order that you
know invokes the alien enemy Zach to deport people to
you know, elestavad or in other countries, he said, I
didn't sign that. I don't remember signing that, but it

has a signature on it. So there's there's going to
be quite a bit of pushback on this if this
goes anywhere.
