How are you guys doing today?

Speaker 4 (01:17):
Hey Ben doing well? How are you great?

Speaker 2 (01:19):
Thanks for having us, Always a pleasure, always a blessing.
I can't wait to delve into some of these topics.
Let's start it off with Mark Sanchez apparently charged with
a felony in an alter eate altercations. Victim is filing
a civil suit against Sanchez, and Sanchez is facing a

(01:42):
precarious situation.

Speaker 3 (01:43):
Here, give us an update.

Speaker 4 (01:46):
Yeah, if you follow sports and haven't heard of this,
you've been living under a rock because you've kind of
been talked about a lot.

Speaker 2 (01:54):
You know, we were we were hoping he'd only be
remembered for you know, the highs of the USC tenure
and the highs of you know, the New York Jets
Tendre butt fumble and the butt fumble, you know.

Speaker 4 (02:07):
The butt fumble.

Speaker 3 (02:08):
You know what I mean. But now now he's known
for this.

Speaker 4 (02:13):
Exactly I was gonna say, former USC quarterback, really great
USC quarterback and had an okay NFL career, but was
infamously known for the butt fumble. Now he's got something
that's a lot more shade. So this grows out of
an incident at last later Friday night, early Saturday morning,
apparently in Indianapolis, Mark Sanchez is going down the alley,

(02:37):
wants to park his car, and apparently there was a
delivery type truck a guy working there who had some
work there between the hotels and was parked there and
Mark Sanchez approached. By all reports, he approached this gentleman
who was a sixty nine year old gentleman, and there
was some talk and before you know it, the guy's

(02:58):
in his truck and Mark Sanchez is climb in there
pulling him out in an altercation ensued. You know, you
hear the headline says stabbing involving Mark Sanchez. Well guess what,
Mark Sanchez is the guy that got stabbed and also
this guy Pepper sprayed him too. But you know it
sounds like, well, what's going on here? Well, all video surveillance,

(03:18):
all witness testimony indicates that Mark Sanchez was indeed the
aggressor here, that he was the one that started all
of this, that you know, an older man here who
was probably who said I was in fear for my life,
you know. And so a question that came to my
mind is why does this guy got a knife and
why's he got pepper spray? I guess just in his

(03:39):
line of work he might run into some unsavory people.
But since then, as you mentioned, Ben, both of these
guys went to the hospital. If you've seen photos of
this guy, man he is he's beat up pretty badly.
He's got a huge last ration on his face, and
he's got a neck brace on and he's in bad shape.
And Mark Sanchez, by all reports, is still in the hospital,

(04:00):
had several stab wounds to his abdomen and torso well,
he has been charged by the Indiana Indianapolis Police Department
for Originally it was misdemeanor, you know, intoxication climbing into
someone's vehicle, that's one, and an assault, but it has
been upgraded to a level five felony, which could carry

(04:21):
up to I think six years in jail based on
the fact that it involved serious bodily injury to this guy.
So where do we go from here? Well, the Indiana
State or Indiana. Indianapolis Police Farmer says that the investigation
is ongoing. There are reports that both Mark Sanchez and
this guy were both filming each other with their phones.

(04:42):
They had the wherewithal to do that, you know, while
they're both mad at each other and this gawing is
going on. And apparently Mark Sanchez did not show up
in court this week, had his attorneys show up and
enter a plea of not guilty. So from here we'll
see what happens Marx San. As you mentioned, he's got
a nice contract with Fox Sports. He probably has a

(05:04):
morality clause in there that says, hey, you can't do
stuff like that and make us look bad. So I
doubt we'll be seeing him on any broadcasts in the
near future. We'll see what happens here. I doubt it
will be in prison time or jail time. Will be
a plea deal, but we'll follow this along.

Speaker 2 (05:21):
Jeez man, I wish him well, speedy recovery to both.

Speaker 3 (05:26):
Both of these individuals, Mark and.

Speaker 2 (05:28):
The individual that was victimized here as well. Let's move
on to the second decision. Lebron James controversial, you know,
but all in the name of capitalism and making the
dollar right. It ended up being this Lebron James second
decision ended up being an advertisement for Tennessee alcohol.

Speaker 3 (05:52):
A lifelong Lakers.

Speaker 2 (05:53):
Fan apparently is suing James over the announcement.

Speaker 3 (05:57):
What's the latest tier?

Speaker 5 (06:00):
Yeah, when I first heard the story, I thought this
must be the onion. Is this real? But this uh yeah,
this this fan. I mean it's essentially they're claiming, well,
I haven't read the lawsuit, but what I think this
is is this this is going to grow out of
you know, California has some pretty liberal consumer protection laws,

(06:23):
kind of a truth and advertising type of claim. And
so he thinks that Lebron is going to announce his
impending retirement. This fan, the super fan, and so he
goes and buys a couple of Lakers tickets that are
four hundred bucks plus each ticket, and then finds out
right when when the ad finally runs, that it's a
it's a it's an ad for Hennessy. It's not Lebron

(06:45):
announcing his retirement. So he feels like there's been this
bait and switch and he has filed a lawsuit wanting
a wanting his money back. I don't know where this
thing goes. I mean, I don't see how this ad
like induces him in any way to buy tickets. That
was his call and his assumption. I don't see any

(07:05):
sort of legal duty here. This case seems like a
loser and kind of a joke.

Speaker 4 (07:11):
Frankly, my bet is that he shows up at a
Laker game as a guest of Lebron. Lebron is really
an expert at PR. And apparently this was filed in
small claims, which is crazy.

Speaker 2 (07:26):
Pretty insane there, gentlemen, we're talking sports cord here with
Handy and Handy Handy Law Utah dot Com, your personal
injury attorney's big firm experience, small firm attention, and we're
delving into all of the sports and legal drama occurring
right now, speaking of like we were talking about Mark Sanchez,

(07:46):
uh and uh, you know essentially these these big time
uh you know, sports and entertainment individuals. Recently, SVP and
his host went into this particular or this particular topic regarding.

Speaker 3 (08:03):
LSU wide receiver.

Speaker 2 (08:06):
And there's Kyrone Lacey And there's more evidence now that
has been brought forth because of maybe conversations that were
being had on ESPN and other networks give us an
update on the police releasing evidence that they say shows
Kyraen Lazy triggered fatal car accident.

Speaker 4 (08:27):
Yeah, this is grows out of a really sad event
that happened last December. Kyraen and Kieren Lacey, a former
LSU wide receiver, pretty good and potentially had an NFL career.
By some reports, the reports were back in December that
he was speeding, was driving out of control, was driving

(08:47):
in the wrong direction, in the wrong lane. You can't
do that. And by the reports were that as a
result of this, someone had to swerve to miss him
or get hit head on, and by swerving they hit
another vehicle which tragically resulted in a fatality to another driver. Well,
he was charged with vehicular homicide back then, and he

(09:08):
was a sad fact. He was ready to go to
the grand jury where to decide if they're going to
present press charges. And prior to this, he commits suicide. Well,
the reason we're talking about this now is because his
lawyer came out with some statements. They got a lot
of attention. His lawyer came out and said, hey, wait
a minute, all these reports are really staining kyrone Lacy

(09:30):
and are not and you know, claimed kind of maybe
some racial bias, certain things like that, and these weren't right.
He says, hey, he was a long waist from this.
He was one hundred yards from where this thing took place.
And so they got everyone's attention. So the Louisiana State
Police said, wait a minute, you're calling in the question
what we're doing. So they released a video this week
which pretty much shows it's not disputed that Kyrone Lacy

(09:56):
was cruising along, flying along his green charger in going
in the wrong direction, causing all cars to vere and
do this that he essentially did set into to motion
these chain of events that resulted in someone's death. So yeah,
there has been some talk out everyone kind of taking
positions on this with without all the evidence. In the

(10:17):
louis and Louisiana State Police, I think they came to
their own defenses said no, wait a minute, and witnesses
it shows on the video. You've seen the video. Witnesses
are all saying it was that green charge What is
it doing, you know, flying long here, you know, setting
us into motion. So it'll never be adjudicated essentially because
he he is not around to have the charges you know,

(10:38):
brought against him and see what happens there. But that's
why we're talking about it today on sports courts.

Speaker 2 (10:43):
Yeah, what's interesting is SVP's got that pelt. I believe
Pat McAfee as well as Ryan Clark all sounded off
on this prior to receiving the additional evidence, and they
were very adamant and and called out the Louisiana Police
on this, Louisiana State Police. So I guess it's no

(11:05):
wonder that they came, you know, with more evidence here
publicly because they were receiving backlash of their own.

Speaker 4 (11:13):
Yeah, and those Scott van Pelad and Ryan Clark, I know,
they came out with some very strong statements and said, hey,
we apologize for not looking at all the evidence. We jumped,
we jumped some conclusions, and they said that's not good reporting,
that's not all of that. So they I saw a
video with them both saying that, and they pride themselves
on that and said it looks like everything the Louisiana

(11:36):
State Police said is actually true.

Speaker 2 (11:39):
So he begs the question, is journalism true journalism, traditional journalism?

Speaker 3 (11:43):
Is it dead? It seems like you know, us media
members were.

Speaker 2 (11:47):
Having We're always having to apologize for either takes or
not having all the information and coming to our own conclusions.

Speaker 4 (11:56):
Well, I'll let you answer that. You know, it's risky.
You know, this happened almost a year ago, so you
know the reason that's being talked about is because his
lawyer came out with some statements. You know, so without
digging into it, people jumped on that train and kind
of reported it.

Speaker 2 (12:14):
So the sequencing was lawyer came out with his statements
with the assumption that that Karen Lacy was innocent and
that there was some evil doings or bad you know,
bad foul play at hand in the investigation, and then
media members pick it up and they're like, well, this

(12:34):
is our conclusion on it, Louisiana State Police. Then sequence
is that with the full burden of proof and now
we have apologies.

Speaker 4 (12:45):
Oh yeah, and apparently the Louisiana State Attorney General is
looking into it too to kind of clear things up.
But yeah, I mean I think that is I mean,
we would never have been talking about this. I think
the charges would have gone through and they probably would
have dismissed it because he wasn't around to face the charges.
But his attorney came out to try and you know,

(13:06):
support a narrative. And I don't know what his basis
for that, why he had that, but he had a
narrative be put out there, and without digging in deeper
and asking a few other questions, other people jumped on
that narrative.

Speaker 3 (13:17):
Yeah.

Speaker 2 (13:17):
Well, multiple lives are lost, IBus Kyrie from you know,
just reading up on this, and you know he he
committed suicide because of any number of reasons, had an
altercation I think with family, there was a gun shot
fired by himself, and then he took off and I
think there was a police chase and so just just
horrible news all around over the last year for this

(13:39):
particular situation. All right, let's let's get into a lighter
thing here if we can. Nevada, Okay, apparently denies NFL's
request for rehearing on arbitration issue with Gruden. John Grudens
has become you know, he was a villain and now
with Barstool Sports like everyone's loving Rudin again.

Speaker 3 (14:00):
Here give us an update on what's going on in Nevada.

Speaker 5 (14:05):
Yeah, I mean, quick, quick backstory on this Ben and
we've talked about it before, but this whole thing, you know,
Gruden's lawsuit against you know, Roder Goodell in the NFL.
It grows out of his claims that basically, through the
investigation that the NFL launched with the Washington commanders and
Dan Snyder, there was a leak of some emails, and
those emails were really cast John Gruden in a bad light.

(14:27):
They were very you know, racist and homophobic and said
a bunch of things, including some really you know things
that he said disparaging things about Roger Goodell himself. So anyway,
Gruden loses his job and files this lawsuit against the NFL.
And anytime we have these lawsuits among you know, employees,
and especially in the NFL, they invoke an arbitration clause.

(14:52):
And Gruden's been fighting that pretty hard for a few
years now. Doesn't want to have this arbitration held behind
closed doors because if his case goes to arbitration, he
gets hurt by Roger Goodell and he gets to be
judge jury executioner regarding and and yeah, there's there's some

(15:13):
bad blood there. So he obviously doesn't want to have
his case heard by Roger Goodell and doesn't feel like
that's fair. So I mean just you know, it's gone
through the paces here. I mean, a lower court judge
found that the arbitration clause was unenforceable. Then he appealed
it to the Supreme court in Nevada, the Nevada Supreme Court,
and they found that it was, you know, also unenforceable.

(15:35):
They upheld the lower court ruling. And now what the
NFL did is they asked for a rehearing, which is
I don't I'd like to see the stats on how
often a you know, a request for rehearing is is successful.
I can't imagine it's very often. They're basically saying to
the court, hey, don't you want to take another look
at this, maybe you got it wrong. And the court
came back and said, no, we're not. We're not even
going to hear it again. They denied it. So his

(15:57):
case is going to go back to the lower court.
And I mean, he still has to prove his case.
He hasn't quote unquote won anything except to keep his
case out of arbitration for now, great enough, maybe for good.
I don't think it's going arbitration.

Speaker 3 (16:10):
It's not going to go on arbitration.

Speaker 2 (16:12):
Yeah, I mean, I hope the best regrud and I
feel like he kind of got done a little bit
dirty here. Now he's a controversial figure, no doubt. He's
a traditional, old school kind of football coach, but he's
also a dynamic personality that a lot of people in
the football world gravitates towards. So, man, it was tough
to see all this go down, and hopefully it all
works out now.

Speaker 3 (16:31):
Finally a little local update.

Speaker 2 (16:33):
Utah transgender sports lawsuit has been dropped as US Supreme
Court is hearing similar cases.

Speaker 3 (16:41):
Give us an update here.

Speaker 4 (16:43):
Yeah, we talked about this before, and you know, transgenders
in sports is a big deal in legislation and in
legal battles right now. Back in twenty twenty two, House
Bill eleven was passed of Utah that said that biological
males could not participate in female sports in competition in

(17:07):
female sports. Well, as usually happens in cases like this,
there was some There was a lawsuit filed against the
Utah High School Athletic Association in the state of Utah,
claiming that this law was unconstitutional, that it violated equal
protection and certain constitutional rights. Well, for the last few
years it's been going through litigation. We haven't heard a

(17:28):
lot about it because it's going on a lot of
filings behind closed doors, that type of thing. There were
some pretty high powered people fighting both sides of this. Well,
it just reported that the lawsuit the plain offs families,
these families of these transgender athletes, have dismissed the lawsuit. Instead,
it was dismissed with prejudice. That's important because if it's

(17:50):
with prejudice, that means it cannot be refiled. Well, some
of the legislators jumped on this and said, this is
a huge victory for us, claiming, you know, the fairness
and all that, you know the basis for the bill,
you know what they pushed it for. But behind the scenes,
it's speculated that the reason it's been dismissed is because
there are certain state legislations that are further along in

(18:13):
the process, meaning they're going to make it to the
United States Supreme Court essentially litigating and legally addressing these
same issues. So I think it's looked at that these
ones are all the way down the road. Let's not
do this. You know, hopefully the United States Supreme Court
will look at these laws and they will basically set

(18:33):
forth the law of the land on this type of stuff,
you know, And so I think that's the basis for it,
that they're not going to spend any more money and
time on it. They're gonna wait and see what happens.

Speaker 2 (18:42):
Yeah, the whole verbige of like biological sex at birth right?

Speaker 3 (18:45):
Is it state law?

Speaker 2 (18:47):
Is it federal law that that must be stated on
the birth certificate?

Speaker 3 (18:52):
Right and the biological sex.

Speaker 2 (18:53):
Of the baby. I know this is kind of a
a leftfield. I'm sorry, I'm putting you guys in a
tough Yeah.

Speaker 3 (18:59):
Ye, I don't know.

Speaker 4 (19:00):
I don't I don't want to take a stance on
something I don't.

Speaker 2 (19:03):
Know, Okay, Okay, No, No, that that's intriguing to me
because I could see this. I try to take the
like what the opposing maybe view would be and and
where they would kind of try to navigate it anyway,
So that's why I was inquiring. But no great updates.
As always, love talking sports court. That's the uh, that's
