It's a big, big news weeks here on my beat.
But happy to be spending I'm just happy to be
spending a little bit time with you.

Speaker 3 (01:14):
Hey, Always a pleasure talking litigation house settlements with you.
Give us an update, man, this was the day April seven.
It's supposed to be the day when everything was approved
and the student athletes would would be paid TV revenue
distributed by the athletic departments of the respective athletic departments.

(01:37):
What's what's the latest on the house settlement?

Speaker 5 (01:40):
Yeah, I wrote about this a couple of days ago
that more people that have argued in front of this
judge and have been around these kind of cases, you
know what, we're trying to reset expectations to ads and
other folks, like, hey, today's the day of the hearing,
but probably not.

Speaker 2 (01:57):
Going to be the day that there's a final decision.

Speaker 5 (01:59):
And then Judge Wilkin one of the very first things
she says in the hearing as there's you know, a
thousand reporters crammed in on zoom and slowing everything down,
is I'm not going to rule from the bench today.
So they're all still talking, right, now, but there's not
going to be anything completely done and dusted today. The
ruling could come at any time.

Speaker 2 (02:18):
No man knows the hour right.

Speaker 5 (02:19):
It's probably going to be in like the next two weeks,
and and typing everything up and issuing decision that could
be in two days, could be next month, probably going
to be in the next twoish weeks. And the expectation
remains that even though there were a lot of people
that objected to this settlement and the judge has some
meaningful concerns, the most likely outcome is that this is

(02:42):
still approved. Athletes start getting checks in July, and then
we have other people suing in. This process will begin
again a couple months after that.

Speaker 3 (02:52):
Yeah, it's kind of crazy. What's going down. Do you
think that this is going to be approved? Do you
think it's going to move forward? Do you think there's
going to be something different? And it seems like the
judge is I think I read up on like six
or seven different tenets that she's put out. It seems
like she feels like collected something that we've talked about
collective bargaining agreements should be executed rather than something like this.

(03:14):
A ten year agreement is a little bit too long
that locks in the current student athletes and even the
most immediate student athletes in the future, to an agreement
that may be changed.

Speaker 5 (03:28):
I think one of the most important things I've learned
as a non lawyer who has found himself writing way
more about law and antitrust than I could have ever
expected when I started. I think one of the most
useful things I've learned is like when you go to court,
sometimes you win and sometimes you lose. You can't completely
always predict exactly what.

Speaker 6 (03:49):
A judge or a jury is going to do.

Speaker 5 (03:52):
But this is Judge wilkins last case before retirement. If
there were some really existential concerns with the settlement, it
is more likely that those.

Speaker 2 (04:02):
Would have been addressed earlier.

Speaker 5 (04:04):
And even though there were lots of europe Right concerns
raised about how long this settlement might be in effect
or athletes that are currently in fourth grade may be
bound to this in some capacity. With collective bargaining be
better or easier, Yeah, but you can only rule on
the agreement that's in front of you, and there's I
think some limited flexibility about what can be approved and

(04:27):
what can so As best as I know, as of
right now. You know, talk to me again in three hours, right,
But as of right now, I still believe the most
likely outcome is that this has approved but invites further litigation. Right, Like,
if you are an ad or a commissioner, and your
hope was that once this thing's approved and finalized and
the checks start printing, that we're done with this and

(04:48):
we could just focus on sports.

Speaker 2 (04:50):
Now, that's not how this gon go work, my friend.
This is going to invite lots of other litigation.

Speaker 3 (04:55):
Yeah, there's the money component, which is maybe the most
important element in all but also I'm intrigued by the
roster cap, and without a ruling here, it seems like
the one oh five is not going to be in effect.
It seems like without a ruling, at least for the
time being, there's no roster cap.

Speaker 6 (05:18):
Yeah.

Speaker 5 (05:19):
So even even with the ruling, if you don't have
to get to one oh five for football like tomorrow, yeah,
I believe you.

Speaker 1 (05:25):
Have until pretty late in the summer.

Speaker 5 (05:28):
That is the centerpiece of a lot of athlete objections,
and Judge Wilkin even kind of mentioned over the course
of the conversation today that you know, maybe it would
have been better or it would be better if there
could be a grandfather clause where existing walk ons don't
have to be terminated, and then you just don't admit
new ones, and so in a year or two or three.

Speaker 1 (05:48):
Everybody's down to one oh five.

Speaker 2 (05:50):
And to me, I think that's the most sensible.

Speaker 5 (05:53):
I don't view these roster limits as the cornerstone of
this agreement in the NCAA Council apparently agrees, well, we'll
we'll have to see the chances of Wilkin not clarifying
or issuing a ruling until like June are extremely small.

Speaker 2 (06:11):
You know, if if.

Speaker 5 (06:12):
We're likely to get some kind of you know, answer
this month about what's happening with the house settlement, Matt,
I would I would expect I would expect a one
oh five roster limit as the most likely outcome.

Speaker 3 (06:26):
Matt Brown, college football insider representing extra Points here on
ESPN the Fan. Matt, what else have you been working
on over at extra Points that you could lay on
us right now? I know this has been taking up
some of your bandwidth, but you've been delving into a
number of of uh OF I would say minutia driven

(06:47):
uh college athletics topics that you typically do.

Speaker 5 (06:51):
Yeah, so I think I think there's two things I've
been working on that may be of interest in this market.

Speaker 2 (06:56):
You know, one of them came out today. I want
to careful of my words. I don't want people to
scream at me here in Utah County, but this drops today.

Speaker 5 (07:05):
I think it's important for fans and consumers to realize
that if federal trade policy is changing dramatically and we're
throwing thirty forty percent tariffs on everyone, that is not
just going to make coffee and bananas more expensive, or
potentially automobile is more expensive. It will absolutely impact college athletics,

(07:25):
which I think, on the surface, sounds like it would
be counterintuitive, right because college sports happens in the United States,
it doesn't happen.

Speaker 4 (07:32):
In Japan or China.

Speaker 5 (07:34):
The events are all here, most of all the universities
are here. But you know, as somebody who has to
go through people's budgets and their financial.

Speaker 4 (07:43):
Garbage for a living, I think people.

Speaker 5 (07:46):
Need to realize how many other components that make the
industry work come from overseas. Right, you have an athletic
apparel contract with Nike or under Armour or Adidas. Almost
all of those shoes, almost all of the T shirts
and the performance where that's manufactured in Asia, mostly Vietnam,

(08:06):
also China, also Bangladesh, also a couple of other countries.
Those things will become more expensive because they can't be
immediately shifted here. If you're building a new arena, if
you're renovating a locker room, making changes to a stadium.

Speaker 2 (08:19):
Many of the materials that are.

Speaker 5 (08:21):
Used in raw construction come from overseas, particularly lumber or
the lumber that's more from Canada, but they come from
outside the country. The cost of those raw materials will
go up, or some of the industrial machinery needed to
actually build huge things like stadiums become more expensive. It
can become more difficult to fundraise if you're in a

(08:42):
market that is tied to one particular industry. So I
say all of this is like, there's a lot I
don't know if BYU was planning on doing, but a
lot of other P four markets before tariffs were signaling
we're gonna raise ticket prices because we've got to pay
for all this house stuff. We gotta pay for revenue sharing.
We're gonna slap the ticket surcharge on you. If we're
still doing this tariff stuff in two months.

Speaker 2 (09:05):
I would expect.

Speaker 5 (09:06):
Ticket prices and a lot of college sports stuff to
become meaningfully more expensive before the start of the season,
to supplement the holes and athletic.

Speaker 2 (09:15):
Budgets that are happening.

Speaker 1 (09:16):
Like that's we can.

Speaker 4 (09:17):
Debate whether that's good or bad.

Speaker 5 (09:19):
That's fine, but we should also be cognizant of the costs,
and there are going to be costs in college sports.

Speaker 3 (09:26):
Indeed, there will be Matt Brown extra points here on
ESPN the Fan talking some college athletics, college football. Matt,
couple last things before we let you go, appreciate you
spending some time with us today to delve into all
the knoks and crannies here.

Speaker 4 (09:41):
I want to talk BYU for a moment.

Speaker 5 (09:43):
Now.

Speaker 3 (09:43):
You came down to BYU this past season to take
in all the sites, the sounds, got a feel for
where BYU's heading in the athletic world. BYU's nil health
in basketball has been pretty bust. They just made it
to a Sweet sixteen. It sounds like they're willing and
ready to go all in on athletics to a degree,

(10:06):
at least their donor bases welcoming in a g de Bonsa,
and it seems like BYU football is not going to
be too far off. They just received a commitment from
Brock Harris tight End out of pine View. Give me
your thoughts, your commentary, your opinion on where BYU stands
in the in the greater athletics world, and how they're

(10:29):
trending to be a team that wants to maybe use
athletics as at least their donor base, and maybe even
the institution itself as possibly an ambassadorial tool for their institution,
and maybe as an extension of that the LDS faith.

Speaker 5 (10:48):
I think what is really what's more fascinating to me
about BYU and nil is, and I don't believe BYU
has said this in public yet or even if they will,
is how they tends to break down their twenty or
so million dollars that they can distribute as part of
this house settlement their institutional salary cap, if you will,

(11:09):
And most commonly what other A four P four schools
are doing is generally setting aside seventy five percent of
that budget for football, fifteen percent or so for men's basketball,
five for women's basketball, and then everything else gets split up.
But the calculus has to look different for different schools,

(11:29):
especially given what sports they actually sponsor, and given that
BYU has is competitive in lots of different sports, and
a small amount of revenue sharing could.

Speaker 4 (11:40):
Potentially go a pretty long way.

Speaker 5 (11:42):
Given how cheap tuition is at BYU, I wonder if
there's not going to be maybe a little bit more
money invested in, say volleyball, or in other sports, and
maybe a little bit less in a place like baseball,
where bus historically it's probably probably further away from being competitive,
then maybe then they aren't some other sports in the

(12:03):
Big twelve and reshuffling that.

Speaker 4 (12:05):
I think that's interesting.

Speaker 5 (12:06):
I've had this conversation with a couple other schools, like
as an example, there's there's a you know, Wisconsin in
the Big Ten is going to set aside some of
that money to pay for their women's hockey program, which
just won the national championship and has been elite. Their
women's volleyball program, you know, it brings in ten thousand
fans a match, and as very very very competitive, They're

(12:30):
gonna spend less money on women's basketball, which is probably
gonna be hear in the bottom of the Big Ten
to pay for those things South Carolina is not going
to be spending money on women's volleyball because Don Staley
needs all that money.

Speaker 2 (12:40):
And that's not a criticism like.

Speaker 5 (12:42):
I give that money to Dawn too.

Speaker 2 (12:44):
She's competing for.

Speaker 5 (12:46):
Championships with it, right So, I don't know what that
calculus looks like at BYU. And I think it's an
interesting question about like, does your recruiting pool for football
change that much if you give sixty five versus seventy
five percent of that money to football, given that you're
kind of limited with the people that you can be

(13:06):
going after here.

Speaker 2 (13:07):
Anyway, I don't know the answer to that question.

Speaker 5 (13:09):
And and the tricky thing is nobody really knows right
now to what extent donors are going to be able
to step in over the cap. And and that's going
to depend on not just the settlement, but who enforces
this and and and all right now everybody can just
sort of guess.

Speaker 7 (13:30):
Yeah, Matt, I wanted to ask you about, you know,
collective bargaining. You know, is that illegal in some states?
And if so, then how would the NCAA be able
to work around those laws in this house versus NCAA
court case? Utah, I know is trying to outlaw collective
bargaining agreements or amongst the government workers.

Speaker 2 (13:49):
Right now, I'm just interested in that.

Speaker 1 (13:52):
It's it's a it is a very good question.

Speaker 5 (13:54):
So and you're right, there are a handful of states
that do not allow for collective bargaining for public employees.
I've seen Utah moving in this direction. South Carolina is
one of these. You generally find that states in the
Southeast are much less union friendly, particularly for non police
officer public employees, than states in the upper Midwest and

(14:18):
the Northeast.

Speaker 2 (14:20):
A possible workaround to this is.

Speaker 5 (14:22):
In a world where athletes could collectively bargain and were
deemed employees, but we're not deemed employees of the school,
were deemed employees of a conference or of a third
party athletic association, So then they wouldn't be public employees
and get participant in collective bargaining, just like players on
the Utah Jazz can't collectively bargain with the NBA for

(14:42):
labor rights because they're members of a private company. But
the dynamic that you're describing is one of the many
reasons why trying to build labor peace in college sports
is extremely complicated. It's not just a question between the
athletes and the NCAA. It's a question for fifty different

(15:04):
state houses of very different labor laws, who have federal
labor laws, of higher education laws. And also there's no union,
so there's no one, there's no one to negotiate that
CPA with right now. None of the athlete advocacy organizations
have you know, more than a couple of hundred members.
There's there's ten, there's ten thousand plus FBS football players alone.

(15:25):
Couldn't you couldn't win a union election with it with
such a small membership. So the long answer to your
very good question is I don't know, and anybody that
really does know is not telling the truth because there's
there's there's just a lot of unanswered questions.

Speaker 2 (15:42):
Matt.

Speaker 3 (15:43):
The most important question that you can answer for us
right now is who will be the next athletic director
of Brigham Young University?

Speaker 4 (15:51):
And why? Will it be internal? Will it be external?

Speaker 3 (15:53):
Higher? What's your gut tell you? What do you hear
and out there in uh me, Yeah.

Speaker 5 (16:01):
I have, I I you know, I've I've I've turned
it down, I've gotta, I've gotta it works as a
three days double here right now. Uh, and in beautiful,
beautiful Chicago, I've probably you know, have some beverages in
the garage freezer that would probably you know, from being
considered to.

Speaker 2 (16:18):
Be totally honest, to be to be honest with.

Speaker 5 (16:21):
You guys, I have not heard very much about this
over the last couple of weeks, which is not surprising because, uh,
the sponsoring institution is one that's usually pretty good at
keeping secrets despite us nosy people here. What I know
is pretty similar to what I know from from the
last time. Right, You've got you've got three internal people
that have the credibility and have the experience and the

(16:44):
potential interest in this role, and you have a mandate
to also talk to a very expansive list of people
that not only do not work for by U, but
do not currently work in college athletics. If I had
to bet, which I think would be kind of ironic,
heading on who's gonna be the ad at YU, like
that should put you on a federal watch list.

Speaker 2 (17:04):
But I think I think it's the most.

Speaker 5 (17:06):
Likely person is probably Santiago, But it would not surprise
me if I get a press release in my email
sometime in the next eight weeks, and it's a name
that I absolutely have never heard of in my life
from somebody that worked in entertainment law or corporate law
or professional sports or I don't know, like the Hinkley

(17:28):
Law Firm or something, or not not Hankley, the Maconukeey
Law Firm or something.

Speaker 4 (17:32):
I don't know.

Speaker 5 (17:34):
There's a lot of people I don't know. I only
know the people in college sports, and that's that's not
a very big list from people who could take this job.

whenever an LDS recruits chooses.

Notre Dame or USC or Oregon or one of these high.

Level institutions playing really good football, right high level football,
the rhetoric that they're gonna make a greater impact at
that particular institution with their high level of play and
their their ability to intersect and integrate into that community.

I think there's a strong argument for that, But I
also think there's an extremely strong argument for going to
BYU and representing the institution that as an extension is
an extension of the Latter day say faith, and so
being capable of being able to have a platform to
discuss these things, I think is powerful and I think
the world will end up seeing it.

You know, Chase's is my faith and my testimony is
nothing without the mention of the name Jesus Christ. He
is my everything. There is a part of this section
that I was reading, and.

It was just so beautiful.

I don't know if I'll be able to find it,
you know, and for the sake of time, I don't
need to go look. But his understanding supersedes my own,
and I don't understand it a lot of the time.
But I know that, similar to these men, if I
just go and do and I have faith on his name,
I'll be enough. And it will be enough because I'm
trying to.

Again, I love that scripture that you pointed out. Connor
of you know whatsoever we will doing his will, he
will guide us and give us the comforter to go
forth and to live. A lot of people know my story,
but it's hard to give them the depth of it.
I didn't understand why I was coming to be yu.

I did it.

Speaker 6 (23:01):
I wanted to stay at the U. I fought with
my fiance and argued with her and was contentious, and
I was like, this is what I've always dreamt of,
and this next year is gonna be my you know,
such a huge year, and I get to represent the
school that my dad played for. I wanted that, and
the Lord said, you're right, it can be great. But
I have something. I have a work and a wonder

(23:23):
that you don't understand. And I want to bring to
pass your ability to be more than a football player,
to find ways to add value to my gospel, to
the opportunities of me bringing to pass the immortality and
eternal life of man. And that is my testimony that
I am nothing without him. There's nothing in my life

(23:44):
anymore that I'm trying to maintain within my life that
is not connected to my testimony of the Savior and
the will of the Father. That's all I want to
live for now. The money is nice money, championships. I
want the championship for BYU, but it my goal is
how many lives can I truly bless here? How can

(24:04):
I be the best version of me in the will
of the Father and testifying of the Savior, because they're
everything to me and they will become everything to you know,
to this world in a matter of time. But if
I can get people prepared before then, then that's my
my goal. I love my Savior and and that's who
my testimony is in the name of Jesus Christ, name man.

Look, I think.

Speaker 3 (24:31):
Navas at Utah had a platform, did he not?

Speaker 2 (24:34):
Was he his team captain? Yeah? He had a platform.
His team captain.

Speaker 3 (24:38):
Team captain could say and do what he needed to do.
He could lead how he wanted to lead. He can
podcast how we wanted the podcast. Now, I'm not saying
that that he didn't bear testimony. He didn't you know,
bear witness of of his uh you know his convictions, right,

but but uh, I do think that there's a there's
one of the main reasons why he came to be
is because he wanted to be himself. He said he
felt like he needed to embrace who he was.

At a deeper level.

Speaker 3 (25:14):
I think this is part of it, like being able
to like just comfortably just bear testimony without fear of
like misalignment secular versus versus versus religious and having UH
an institution of higher learning that does embrace the spirituality
and you want to ReLit Christ, it helps.

Speaker 4 (25:38):
It helps.

Speaker 3 (25:38):
So look, I don't I don't feign to believe that
that b y U is for everybody and not at
Bay is perfect for every LDS recruit, but or LDS
football player, basketball player, or student athlete. But I will
say that if you if you have a conviction of
your faith and you really want to be able to

(26:00):
express it without fear of repercussion, it's it's a good
choice because you're gonna be embraced by the greater UH
BYU and LD's population because of it.

Speaker 4 (26:11):
They're going to celebrate that for the most part. Some don't.
Some don't want that anything, don't want anything to do
with it.

Speaker 3 (26:18):
But I are you seeing You're seeing I I've talked
about this before. You're seeing not only a resurgence, a
resurrection if you will, of faith centered rhetoric, Christ centered
rhetoric in the sports world. Right You're seeing that everywhere
I mean you're seeing that in the NBA. You're seeing
the NFL more so mostly probably in football more so

(26:39):
than even the NBA. I would say it's more so NFL.
It's college. You're you're seeing this this uh frank and

of the best LDS athletes in the country, and by
the way, many of them are here in the state

running back, chose by over Cala, s U, Iowa State, Kansas,

day Saints starting in January twenty twenty six setting his
arrival on provo for the summer of twenty twenty seven

dynamic pass catcher. He can also be an inline tight end.
He's a pro prospect in the making per twenty four

to seven Sports there at the Polynesian Bowl. This was
the scouting report on him. He showed some of the
best hands at the Polynesian Bowl, said analyst Greg Biggins.
He can make tough catches in traffic and has length
hands and advanced route running ability. Harris is the highest
rated tight end commitment in the Kalani Sataka era and
gives BYU serious momentum on the twenty twenty six recruiting trail,

Clark left that hey, like this, that was the wrong decision.

keeping Dallon over Dawson is because Dallon can run an
offense and proved already and showed that he could run
Kevin Young's Dophins doing that. When I saw Dallen Hall
and Yegor getting foul trump and turnovers Dawson, that was

a lot to ask him to put on when that's
not his skill set. And that happened for like a
minute and a half, Thank goodness, it was just that.
But I have seen them try to I've seen Dawson
try to run they even going back to Jackson Robinson,
I've seen Dalla Hall and Yegor be able to do
that because the skill set is different. Now, this is
what makes Dawson the lead. When you can put a
Yego or a down on the floor who can take

that ball pressure and set it up and control and
run the tempo. Having Dawson come out picking rolls pinndows
because when they went on the running Wisconsin downand was
on the floor with Dawson, Dawson doing that in the
pick and roll foos.

we gonna do? Do we want to trap?

the maybe the skill set Dawn didn't have in the tournament,

he didn't score well and that hurt them. And that's
what Kevin Young is going to get, right, And this
is just a factor. Like he airballed in the game
in Alabama. No boy from dyall love him. He's had

to get these scoring guards because if you can put
that with Dawson, Baker and these guys who can pass
and draw this attention, right, and then Dawson can be
left open, that just makes it more difficult, right, Imagine

if Dallan was giving you been ten to thirteen a
game every single time, b Yu. I'm not gonna say
Alabama game changes, but it makes it more competitive. If
forces a coach to switch, what do all just tell you?
With the basketball football force a coach to make an adjustment,
there was no adjustment that ever needed to be had
because with the pick and roll, you take foos out
the game.

Okay, Dalla Hall, what is he gonna do on on one?

And I think that is where boy's gonna succeed this
next season is changing the skill set of Okay, now
you got a guard in potentially if it is this
kid that comes right and Mason who he could score
and grab boards. Okay, so what are you gonna do?
You can't double him because he got Dawson. Kevin Young
wants to have everybody be an elite scorer and an
elite what is it, an elite passer of the basketball

because they like to share it. And if you get
this kid, this only enhances Dawson's ability because I mean
it's Ben Dawson. Baker is like one game away from
having like a thirty piece and then I think he
breaks it like right, and when I say he could
become the next Jackson Robinson.

I truly believe that Dawson Baker is the guy. When
