I wouldn't be opposed to joining TikTok. Honestly, even if

deal was we didn't follow the law. We just ignored
law for how for what year was? Any year?

stop by. I'll talk a little Mountaineer. We'll get ready

earlier this morning, TJ and I we actually got in
a bit early today. Next Era Transmission released its preferred

route for the mid Atlantic Resiliency Link. That's one hundred
and five mile transmission line running from Pennsylvania to Virginia,
traversing four counties along the way. Four counties in West Virginia, Montagelia, Preston,
Mental Hampshire Counties. This route that was selected comes after
some public pushback, county commissions that have come out and
publicly opposed the plan and public but members of the

public who have come out in opposition to the route.
So earlier this morning we came in to talk to
Caitlin McCormick, Next ERA Transmission senior director, about how the
route was selected and its possible impacts. Join us this
morning as senior director with next ERA Transmission, Caitlin McCormick. Caitlin,
good morning, Thanks for joining us.

Speaker 5 (04:20):
Good morning, Thank you for having me today.

Speaker 1 (04:22):
So next ERA has decided on its preferred route for
the mid Atlantic Resiliency Link. Of course, that's the high
voltage transmission line running from Pennsylvania to Virginia, crossing four
West Virginia counties. How did you arrive at this proposed route?

Speaker 6 (04:40):
So we have done quite an extensive amount of external engagement.

Speaker 5 (04:45):
And research with the community, working.

Speaker 6 (04:48):
With external agencies, whether that's at the state or federal level,
and holding eight open houses where we had nearly twelve
hundred attendees and we received over twelve hundred comments between
in person at ten needs at those meetings or an
online survey that both the company the open houses and
the earlier online survey about the study corridor.

Speaker 3 (05:10):
Caitlin, what's your process for notifying land owners of this
final proposed route that you'll take to the commission for approval.

Speaker 6 (05:17):
So we have a team of land agents that's working
across the project area and they are reaching out to
individuals to have a one on one conversation with them
about their property and the proposed route. And we're going
to continue to have extensive conversations with them, and they'll
have a single point of contact that they can reach
out to individually.

Speaker 1 (05:36):
How much of the proposed route follows existing high voltage
transmission lines?

Speaker 5 (05:43):
Probably about I don't have the number right in front
of me, but about sixty to seventy percent is within
a thousand feet or so of an existing transmission line.
Roughly half of it parallels and abuts existing transmission line corridors.

Speaker 3 (05:55):
Why is that important for this project?

Speaker 5 (05:59):
So we to this proposed route to do a couple
of things.

Speaker 6 (06:02):
The first is to minimize impacts to landowners, to minimize
impacts of communities, and to minimize environmental impacts. And by
paralleling and abutting existing transmission lines, You're going to minimize
the visual impacts and minimize any sort of new disturbance.

Speaker 5 (06:16):
In an area.

Speaker 1 (06:18):
Senior Director Next Area Transmission Caitlin McCormick joining us here
on Metro News talk line. They have chosen the company
has chosen its proposed route preferred route for the mid
Atlantic Resiliency Link. What is the benefit to West Virginia
counties along this route to be Montagelia, Preston, Hampshire and
Mineral counties. What's the benefit to those counties along the route.

Speaker 5 (06:40):
Yeah, there's a couple of benefits.

Speaker 6 (06:42):
First, landowners individually will be compensated for an easement on
their property at or above market value. The second is
there's a substantial tax benefit to each of the county
is located along the route. In West Virginia, up to
four hundred million dollars in tax revenue would be coming
into the state. And of that, and it varies by county,
about sixty five to seventy percent of that would go

into the public school district in the schools which would
help fund teacher salaries, maintenance, or whatever priorities those districts have.
And third, there's electrical benefits here. First, the line is bidirectional,
and that means it's going to go in both directions.
And while West Virginia does export energy every year, there

(07:23):
are periods during the year where it does import energy
into the state. Additionally, anybody could apply to interconnect. It's
a network line. We've had a couple of misconceptions that
it would subscribed, there was no capacity. It's part of
the system, and there's ability for future interconnections there.

Speaker 3 (07:39):
So let's double click into that for a second. So
the fact that there will be additional capacity on the
line if there's a large scale economic development project, one
would assume that if it has a large energy need,
it would be able to work with you and work
with other regulators in order to procure energy from that line.
Is that accurate.

Speaker 6 (07:58):
Yeah, So there's a multi step process that go through
working with US and the local utility that they get
their electric bill from, and then depending on the size
of the user, they needed an additional study with PJM
to make sure that there's not any unintended consequences on
the system that affects some other users.

Speaker 5 (08:14):
That's already there.

Speaker 1 (08:16):
Talking to Caitlin McCormick, next Era transmission the mid Atlantic
resiliency link the one hundred and five mile transmission line
from Pennsylvania to Virginia. Are there any plans for additional
substations along the line so that would directly benefit say,
Montingalia or Preston County.

Speaker 6 (08:33):
Yeah, so we are looking at options. PGM has its
bid window open right now and we're looking at some
opportunities there depending on how they choose to proceed based
on their over one hundred submissions, that could potentially include
an additional substation in Preston County, West Virginia.

Speaker 3 (08:50):
What are the chances that this proposed route will actually
end up being the final route and how will you
continue to work with stakeholders as a shoes that may
not have emerged yet start to emerge.

Speaker 5 (09:04):
So we go through a lengthy process with each of
the states.

Speaker 6 (09:07):
In West Virginia it's the Public Service Commission, So this
route is what we're intending to submit with our applications.

Speaker 5 (09:12):
Later listenear to the West.

Speaker 6 (09:13):
Virginia Public Service Commission and the equivalents in the other
states where will have facilities. Throughout that process, they may
make adjustments or modifications to that. There's opportunities for stakeholder
input on that process and for individuals to engage.

Speaker 5 (09:27):
We expect that process to take about one to two years.

Speaker 1 (09:31):
How did you take it? You said you take into
consideration the public comments and concerns of the residents. Can
you give some specific examples how you address concerns of
residents who don't want this line coming through their property.

Speaker 5 (09:44):
Yeah, we've got extensive feedback.

Speaker 6 (09:46):
We looked at quite a bit of different areas throughout
the route, and not everybody's feedback was the same. Trying
to balance the environmental impacts, landowner impacts, and impacts to
communities and throughout the entire process, we had extensive stakeholder
input and what we're going to do is present all
that in great details part of the robbing study filed
with the CPC and application.

Speaker 3 (10:08):
I want to circle back to the need for the
line for just a second. Many folks, this can get
very complicated, Caitlin, As you know, it's a process, but
this I don't think it's fair to just say this
is a line next stra wants to build. There's a
reason that you're coming forward to build it, and someone
has identified that cause. Walk us through that origin and

(10:29):
how this came to be and why the need is there.

Speaker 5 (10:33):
Yeah. PJM is the regional transmission organization and they're the
ones who operate the electric grid in this region and
their job is to make sure electricity is getting from
where it's produced and it's serving all their sixty five
million customers throughout the region. As part of that long
term planning process, they put out their electric system modeling
and they did that in twenty twenty three and we

responded to that solicitation, and that was based on increased
power demand throughout the red as well as changing patterns
of generation, whether that is new generation coming on or
retirements happening throughout the system. And as part of that,
we and others responded to that and they selected our
mid Atlantic Resiliency Link as part of a portfolio of
solutions that they had in order to long term keep

(11:17):
those lights on and pretent prevent the potential for our
brownouts or blackouts in the future.

Speaker 1 (11:22):
Talking to Kaylein McCormick Next Era in Next Era Transmission
talking about the mid Atlantic Resiliency Link, sell me, if
I'm a property owner at Montegalia, Preston, Mineral Hampshire Counties,
I'm a farmer. It's family owned property. Had it forever.
Sell me on why this is a good idea.

Speaker 5 (11:41):
So, this is going to be an investment in West
Virginia and in the region, and it's going to provide
increase access to lower cost generation sources throughout the region.
It's going to strengthen the regional electric grid and that's
going to benefit everyone, and it's going to enhance reliability
for homes and businesses and support economic growth throughout three
including here in West Virginia.

Speaker 3 (12:03):
If I'm hearing you this morning and I'm listening now,
is there a website? Is there some resource I can
go to perhaps to learn more if I would be
an affected property owner before you reach out to me.

Speaker 6 (12:15):
Yeah, we have a website. It's at mid Atlantic resiliencylink
dot com. We've got the updated route map with our
proposed route that is along the line.

Speaker 5 (12:24):
It's there.

Speaker 6 (12:25):
We look forward to having conversations with any landowner along
the route.

Speaker 5 (12:29):
We've already started reaching.

Speaker 6 (12:30):
Out to those individuals and have made an effort to
reach all of them, and we'll be talking with them
about compensation for the easement on their property.

Speaker 1 (12:39):
Why not build a transmission or a build a generation facility.
If Virginia needs power. Why are we not building generation
facilities over there? Why are we cutting a highway through
West Virginia.

Speaker 6 (12:49):
So part of this project is to serve West Virginia.
I can't comment to Virginia and what is happening there,
but PJAM has identified a need for more transmission to
strengthen electric grid and help bolster the economy here. West
Virginia has an anticipated growth of about ten percent additional
energy demand in the coming years, and there are times

(13:10):
of the year when West Virginia imports power, and this
line is going to be bidirectional and help serve West
Virginians here and support the West Virginia energy economy.

The opportunity to be here.

We've had extensive engagement as part of our effort to
select the proposed route. We appreciate everybody that participated in
our open houses and provided feedback. Our proposed route does
minimize the environmental impacts, impacts to communities, and impacts to landowners,
and we are really happy to be part of bolstering
the energy economy here in West Virginia and increasing access

to lower cost, reliable power, strengthening the regional electric grid
and supporting homes and businesses in the region.

the marl Maral I hate that name, the Middlelantic Resiliency Link.

Speaker 3 (16:00):
I think at the Marlborough Man every time I hear it.
At any rate, Look, not everybody's going to be happy
with this. There's no way to make everyone happy. I
know some of the opponents of this have talked about
efforts in the past, and they have been successful in
stopping lines like Path was another one back twenty years

(16:21):
ago that was going to be built that people didn't like.
Here's the difference. At that time, you didn't have the
kind of load demand on the system that you have
now with AI quantum computing, everything that's coming. We just
do not have enough energy in this country. If I
were asked to handicap it, I would say, this line
gets built. There's just no way this gets stopped. I

(16:43):
understand the Commission has to approve it. There are compelling
interests as to why this gets done. Your question about
she didn't want to comment on it, I can appreciate that.
I can comment all day long. Your question about why
not build a plant in Virginia? The inser of a
date on this line answers that they need this by
I think it was twenty twenty nine, twenty thirty. It

(17:04):
needs to be in date. You can't build a plant
that quick, and the grid, like it or not, is interconnected,
and people are like, well, let Virginia black out. Here's
the problem. Remember that tree back in what was it
South northeast Ohio got on a transmission line, caused outages
all the way it blacked out New York City. That's
how interconnected the grid is at the transmission level. So

(17:28):
if there's a demand issue, you got to fix it,
and if you don't fix it, it can affect a
lot more than just where that issue and where that
load is located. My two cents on it, for what
it's worth, I'm probably not making people happy either with
my comments.

Speaker 1 (17:42):
Well, I think next Era deserves some credit. It certainly
responded to the public comments that it is received, because
that route has changed from the last time I'd seen
a proposed route, specifically in Montingalia County. It has changed
quite dramatically from where that was going to come through
Cheap Lake and part of that area of Montegue County.

(18:05):
So credit to that for listening. You're right, you cannot
make everyone happy. Somebody is going to be impacted and
they are not going to like that. I understand that.
If it's coming through my land, if it's my family farm,
or if it's my family, you know, Christmas tree business,
I totally get that. So get a little bit of
credit there for responding to the comments. This still has
to go through the Public Service Commission and what is

(18:26):
it four states?

Speaker 9 (18:27):
Three?

Speaker 3 (18:27):
Four states? Yeah, every state it touches, the local commission
will have to approve the route. Yeah.

Speaker 1 (18:32):
So this has a long way to go. It may
it may change again between now and then. But I
am on the same page with you. There is there
is a need for it for the grid overall, and
there's interest here in West Virginia. If we're going to
be this energy leader, I don't think you start off
by nixing an energy project, do you fair? That's not

(18:56):
a good look, right.

Speaker 3 (18:57):
No fair? Point that fifty to fifty plan that Governor
Morrissy is talking about to build all these merchant plants, Well,
these developers are keenly aware and watch how states and
other jurisdictions react to transmission Because if they can't get
their product to market and they need transmission lines to
do it, they'll build it somewhere where they can easily
get those transmission lines permitted. Capital will go to the

(19:18):
point where it is least restricted and most able to flow.
It's like any other business anything else, and so it
sends a bad signal to your point.

Speaker 1 (19:26):
Let me pose a question to you, j If okay,
we want data centers in West Virginia, we want microgrids, right,
Does this help or hurt West Virginia's pitch to locate
data centers here. If we've got this transmission line going
from point A to point B and you can put
your data centers over on point B in Northern Virginia

(19:48):
at the end of this line, does it help or hurt?
Or Am I over thinking a very nebulous question.

Speaker 3 (19:53):
No, I think it depends on what you want to do.
If you're building a micro grid solely to power your
out of facilities and you're not interested in selling access
back to the grid, or you want to sell it
at a local level and not necessarily put it on
the wholesale market, then I don't know that you're worried
about transmission one way or the other. If you do
want to take your access energy that you're not using

(20:15):
and sell it at the wholesale level, very much matters.
And here's where a project like this also comes into play.
Now that you have that capability, Let's say someone wants
to put a data center somewhere in mad or Preston County,
and they've got the available land and it happens to
be near that transmission line. She talked about interconnection. That's
one hurdle down. You can tap into that line and
get access to the wholesale market. If you're an economic

development person, you like that because if you've got land
but you don't have high voltage electricity, and this is
going to give you high voltage electricity, you just got
another selling point to being able to develop a piece
of land for economic development purposes. So again that doesn't
make everyone happy. Everybody has different motivations. Back to your
point about the family farm, totally get where those people
are coming from too. Just depends on what perspective and

what kind of opportunity you see or don't see in
these kinds of developments in these lines.

We know in Rich's offense, you've got to have some
semblance of a running game to loosen up the defense
and allow you to try and throw the ball with
some success. So it's got to start with the running game.
And given if it's going to be any of those

(26:41):
three guys, I just named you get some more running
ability at the quarterback position, but really the running back
itself has been so decimated with injuries. We need to
see what that looks like tomorrow. Is ty Edwards able
to play and give it a go. If he does,
as we saw during the pit game, that changes that
offense significantly. What's going on on the offensive line. You
have three different guys that were dinged, one still showing

(27:03):
up on the injury report. What does their health look like? So,
for me, the biggest key for this team, I feel
like the defense is going to show up and be solid.
You feel like you've got a receiver in Cambaugh and
you can go to and Grayson Barnes if the passing
game can come along, But all of that is credicated
on the running game working and finding some level of success.

Speaker 1 (27:23):
Is the defense enough to carry this team until the
offense can figure it out?

Speaker 9 (27:26):
Brad?

Speaker 1 (27:26):
The defense gets pressed from the quarterback, it creates turnovers.
I like the defense, Brad, but can it keep the
offense in the game.

Speaker 9 (27:35):
Yeah, I think there's degrees of that, Dave. So I
do think yes, that's going to be the key for
the rest of the season. I think we've seen that
this defense is going to have to play well and
keep West Virginia in it, but the offense has to
do something to help you out. We saw at Ohio
you and the KU games, that offense just stalled so
much that you really were never able to break through,
especially in that Kansas game. So yeah, I think the

(27:57):
defense will show up and play, especially at home. I
think the whole unit, every unit will look better at home.
That's just how the Mountaineers usually react home in a way.
But yes, I think the defense is the critical component
for this group moving forward, but the offense has to
do enough to take advantage of the opportunities that the
defense gives it.

Speaker 3 (28:15):
Brad, I'm struggling on the call with Edwards. It's still
pretty early in the season. No one knows where he's at.
I'm not inside the locker room. You're more inside than
I would be. But you bring him back too early
and your risk further injury for the rest of the season.
I'm not sure that's a tough call to make.

Speaker 9 (28:31):
Yeah, I just think it's one of those teaj you're
either cleared or you're not cleared, and if you're cleared,
you got to go, and you got to play right.
The players have to be on the field, and I
think at that particular position, you don't have the luxury
of not playing him. So if he's able to go,
he's got to be in there. That's just a difference
maker in terms of running back. With the size and
speed we saw and given the struggles we've seen from

(28:52):
that offensive line, is it's still finding its way as
it's still getting some experience under its belt. You've got
to have a running back that can create its own
hole or get through the holes are around the corner.
Edwards showed an ability to do that, So I just
I think that's a big part of this offense is
getting him back and available.

Yeah, I'm interested to watch this team because you don't
know exactly what you're going to get a lot of
people had them as one of the preseason favorites to
win the league. They lost a tough one last week
at home two Texas steps in what was an early
preview of what many thought could be the Big twelve
championship game. What's their health coming into this game? And
I think you start there. They have a talented transfer
quarterbacks and Devin dan Pierre can throw it and can

(29:42):
run it. Was nursing an ankle injury in the game
last week. How far has he progressed this week? How
close to one hundred percent is he? Because if he
is limited a little bit and you have an opportunity
to pressure him and he can't scamper like he normally does,
obviously that helps West Virginia. The best thing to watch
with these youths is the off defensive line. They have
two tackles that are projected as first round NFL picks,

(30:04):
one of them projected at the top fifteen picks. So
you mentioned that defensive one of the best in the
country so far, and getting pressure on the quarterback and
turning those into sacks. Are they able to do that
going against what many feel is the best offensive line
in the country. Your hope is, guys, again West India
playing better at home and a team in Utah that

(30:25):
is taking this travel stuff. Really seriously, they were so
worried about this trip. They came yesterday in a decade
with a team coming into Morgantown a day before. You
normally do so long trip Utah. Hopefully you get them
off to a slow start and you can jump out
in front of these guys.

Speaker 3 (30:41):
Did they have to take multiple planes? I mean, I
don't know.

Speaker 14 (30:45):
It was odd.

Speaker 9 (30:46):
Again, you haven't seen it since Oklahoma State in twenty
thirteen came in with Mike Gundy. They arrived on a Thursday,
and Gundy was complaining about the trip the whole time,
and they made it a big deal. Wester Dinia ended
up knocking them off that day, the Cowboys who came
in as nearly three touchdown favorites in that game. So
maybe that's can we get a little history repeating itself
with this trip.

Speaker 3 (31:07):
You never know, you never know. Hey, I'm looking at
some stats here that that Jed Dranning had online. When
it's third down and they've got one to three yards
to go, makes up forty percent of their overall third downs,
they're eighty three to eighty seven percent successful. I mean,
that's that's powerful.

Speaker 9 (31:23):
Yeah, they're number three in the country. TJ and average
distance to go on third down, and that's been part
of their success. West Virginia on the other side, so
that they're averaging about four and a half yards per
third down to gain, so they're in great shape.

Speaker 14 (31:37):
They've got their whole playbook available.

Speaker 9 (31:38):
West Virginia's offense, on the other side of that, is
about eighty eight to ninetieth nationally in average third yard distance.
They're averaging closer to eight yards per third down. So
you can see why those third down success rates are
different between the two teams. It's based on how many
yards you have to go in third down. West Virginia
has been in way worse situations than you has so far,

(32:01):
so that's critical here for zach Ally's defenses. Can they
keep Utah in check on first and second down, creating
a longer third down, giving you an opportunity for some pressure.
So that's certainly a key to this game will be
third down performance. There's no doubt.

Speaker 1 (32:15):
Brad how mentioning Sports three guys before the game mentioned
new sports line joining us. I just want to get
your thoughts, sir, Brad before I let you go. You
mentioned Mike Gundhy. He's now unemployed. Did did it just
fizzle out? I mean, Oklahoma State's bad this year? Brad
go up to Oregon get thumped like that. Had the
stick just worn itself out? What's going on at Oklahoma State?

Speaker 14 (32:35):
Yeah?

Speaker 9 (32:35):
Obviously I'm not inside that program, but I think outside
looking in. You start with guy had an unbelievable run
for twenty years plus in that program, and that just
doesn't happen anymore. And we know times have changed, and
we've seen a lot of coaches of Gundhy's age and
experience just say all right, this, I'm not dealing with
this transfer portal anymore. And that crosses over into basketball
as well, and it seems like that's just what happened.

(32:57):
Was slow to adapt to the nil world in the
trans for portal was Oklahoma State, and ultimately looks like
it caught up to them because the last couple of
years something was clearly wrong. Last year they brought back
enough guys they should have not been as bad as
they were last year, and then it continued on to
this year. So I think it was clear they just
needed a change, and it was. It was a heck
of a run for Mike Gundy, but time for replacement

(33:19):
there in Silwater.

Speaker 3 (33:20):
I threw you another curve. We haven't had a chance
to talk the Virginia Tech situation. What were your thoughts there.

Speaker 9 (33:25):
Yeah, again, they've got to get it right on this
next round. And you see what happens if you go
through a couple hires and it doesn't work. Now, they
received the benefit of the school jumping on board now
and dedicating tens of millions of dollars, almost fifty million
dollars into the athletic department budgets to help with some
of those things to help get the NIL and the
portal stuff under control. So that'll certainly help. That was

(33:47):
not what they had been doing previously. But yeah, this
next hire is critical for Virginia Tech to get.

Speaker 1 (33:53):
It right, Brad. In today's modern college football, Virginia Tech
is going to be a tough place to recruit where
that there's no major business located down in Blacksburg. I
think NIL and I think fundraising is going to be
tough in that part of the country, down in Blacksburg,
and that's just an unfortunate reality of this world we
live in.

Speaker 9 (34:10):
Well, I think that's why you're seeing universities become more
involved not just athletic departments. When we've seen out at
West Virginia, the board here has jumped on and said listen,
they're dedicated to making sure West Virginia is in the
top four or five of the Big twelve in terms
of spending tech. Now doing that, I think that's just
the part that's coming.

Speaker 3 (34:27):
Well.

Speaker 9 (34:27):
You've got more cooperation between universities seeing how visible athletics
are and how much it makes sense for the universities
from a branding and pr perspective to have good teams,
especially football, and that's what it's going to have to do.
You're going to have to get some university help because
the money is just so big.

Speaker 3 (34:43):
Now, I think, do you make a good point, Brad,
You've waited on this too. I'm thinking about Ronoke. I mean,
I think it's Ronoke, but not necessarily a metroplex, no
large airport. I mean, if you're coming to WVU, you
can fly in Pittsburgh and be there in an hour.
You don't really have that option in Blacksburg. Wonderful community,
great place, but it's just it's an infrastructure game too.
I don't know how you make up for some of

(35:04):
that stuff.

Speaker 9 (35:06):
Yeah, and some of that, guys, is it gets the point.
That's that's why the winning just becomes critical and what
comes first the money or the winning. But you've got
to get back to wins and that's what changes brands
and that's what attracts players in there. So now with
the ability to pay and there is some sort of
salary crab structure in place that now some of that

(35:26):
stuff is about the brand and the winning, but you've
got to have that that comes with it, or the
money's not going to help you as much. So that's
why it's just critical. They've got to get it back.
And un listen, we've seen teams all over the country
be able to compete in those environments. So before and listen,
people were paying, paying even though you don't want to miss,
and they were able to figure out how to win
at a really high level. So it's not like they

(35:48):
can't get it back. But man, you've got to make
a really good hire because you've been down for a while.

grand jury on two counts to lect false statements within
jurisdiction of legislated branch and obstruction of a congressional proceeding.
Fox News Radios Jared Halpern has the latest from Washington
and he joins us on Metro News talk Line. Jared,
good morning, Thanks for joining us.

Speaker 17 (38:04):
Good morning.

Speaker 1 (38:05):
So what's the latest. James Comy has been indicted and
reactions have been rampant across the spectrum.

Speaker 17 (38:12):
Yeah, I mean, listen. I think that obviously a lot
of the reaction is going to run down partisan lines.
That's not unexpected, and this is a case that now
will go through the regular process. There will be an
arraignment that has been set for October ninth. We don't
expect much between now and then, but certainly is raising
questions about the very public pressure that the President put

(38:34):
on the Attorney General. The Justice Department, the US Attorney
in the Eastern District of Virginia to bring a case
against not just James Comy, but against other people he
is publicly named, like the New York Attorney General Letitia James,
like the California Senator Adam Schiff. He was asked just

(38:56):
a few minutes ago, as he was a boarding marine one,
who is next on his list? And he said, well,
there's not necessarily a list, but there'll be others. That's
my opinion. They weaponized the Justice Department. There will be others,
so we'll see.

Speaker 14 (39:10):
I guess what.

Speaker 17 (39:12):
You do with that information. But listen, I think when
you look at the case against Comy, certainly there have
been allegations for a while that he lied, he misstated
the facts when he had this congressional hearing back in
twenty twenty, by the way, and that's notable because the
statute of limitations was fast approaching on bringing charges against Tomy.

(39:34):
This was a hearing that happened nearly five years ago.
There is a five year statute of limitations that would
have expired I think on Tuesday of next week. Earlier
this week, there was a big shuffle in the Eastern
District of Virginia. The US attorney either resigned or was fired,
depending on who you ask, but largely over a disagreement

(39:54):
about bringing some of these charges. There are reports that
career prosecutors did not think that there was a strong
enough case to seek an indictment against James Tomy. The
new US attorney brought in by the President disagreed with
that assessment, brought that indictment to a grand jury, and

(40:15):
yesterday that grand jury handed up an indictment on two counts.
It's unclear how many counts maybe had been sought, but
the indictment is on two counts. It deals with the
same statement, the same answer that the former FBI director
gave to Ted Cruz at that hearing over whether or
not Comy authorized the leak of information, and go.

Speaker 3 (40:39):
Deeper on that statement to Cruise, if I have it right,
Andy McCabe had said one thing and Comy said another,
and Cruz was pointing out the difference. Is that correct?

Speaker 17 (40:49):
That's no, that's exactly what it is.

Speaker 18 (40:51):
Right.

Speaker 17 (40:52):
Andy McCabe had sort of said, well, this was authorized
to be released by.

Speaker 2 (40:58):
Tomy.

Speaker 17 (41:00):
Me said it wasn't. And I think the the question
that tried to be nailed down by Cruz was have
you ever authorized the leak of or release of unauthorized
I don't remember exactly how he phrased, but basically it was,
have you ever authorized the leak of information? Income We

said no.

way it's going to be? I mean, from from here
on out, I'm going to come after you.

I mean, listen, this was something that that the President
Trump and others kind of warned about, right the President
didn't make secret on the campaign trail, uh, that there
was retribution that was going to be had, accountability that
was going to be had. He even talked today that
the question was asked to the president, Uh, well, you know,

do you worry now that you know a democratic administration
may charge your FBI director, may charge your officials with crimes?
And he said, they already did it. They tried to
put me away. So yeah, I mean, it certainly seems
like this door has been opened and it will take
one side or the other I guess to close it.

(42:18):
But I think the President's correct in his assessment that
we can anticipate former Biden and Obama administration officials facing
charges over the next several days, weeks, months, perhaps years.

Speaker 3 (42:35):
I mean, is it fair to say the political optics
are just completely out the window too? Because you mentioned
that former district attorney US attorney in eastern Virginia, you know,
fired that person didn't get what they want, called out
Pambondi on Twitter, and now we're seeing what we see.
It just it seems like there's not even I mean, hey.

Speaker 17 (42:52):
Yeah, I don't know enough about whether or not that's
like a legal art. I would imagine that if you
are Comey's legal team, you present that to the job
and you file a motion to the Smiths. You know,
the Trump team tried to get cases the smith saying
that they had been politicized, that Letitia James a campaign
on getting Trump, and that the civil suit brought against

(43:14):
him was political. That case was allowed to move forwards.
So now that it's kind of in the hand of
a judge, I imagine these arguments don't fall down political lines,
but largely on legal lines and kind of the burden
that has to be met to bring a charge, and

(43:35):
the burden is a grand jury has to agree to
bring charges at least twelve members of a grand jury
in the federal system, and that has happened. It's not
My point is it's not as that there is just
a unilateral decision by a use attorney that says we're
charging this person. You still have to bring that to
a grand jury. And a grand jury the burden of

(43:56):
proof is not nearly as high as it is in
a trial, right, but there is a hurdle that has
to be that has to.

county commissioner somewhere here in West Virginia, and I understand
that prosecuting attorneys in this state, in these counties that

county commission Can you imagine the uproar in this state

if a prosecutor refused to bring charges against someone that
a county commissioner did not like and thought there should
be charges brought. If a county Commissioner were to try
to unseat and put a new prosecutor in because of that.
Can you imagine the uproar that we would have here, Yes,

be through the roof. So the optics of this, and
I was trying to bring that up with Jared as well,
the optics of this in a normal situation I think
would infuriate people. They don't now, I mean, the White
House doesn't seem to care about those optics. To your point,
I think they make a strong defense in court. I'm
not a comeopologist. If he broke the law, he should
face the consequences. And oh, by the way, that's why

they had to do it so quickly, because he's up
against the statute of limitations, or that infraction is up
against the statute of limitations. That into business I think
today it was. But yeah, the optics are just horrid
that you would replace a prosecutor that did not want
to bring charges, a USA United States attorney that didn't

same time publicly on social media call out the Attorney
General for not taking action on ABC individuals. It just
it seems an American to me. But in this day
and age in which we live, political damage today is
worth more than political damage tomorrow. And it's all about

But the problem is Democrats don't do it, Republicans don't
do it. One of these days, maybe we will have
someone on one side or the other that will take
the high road and stop this cycle, but they ain't today.

it seems if one side takes the high road and

But if one side's doing it, the other side is not.

details on who this person is. Respected, smart, conscientious, wants
the best for all people. And this person said to me,

of fenalty embezzlement. In exchange, additional charges against them were dismissed.

part of their plea, Hatfield has to repay just over
two hundred and forty five thousand boa os just over

one hundred and twenty seven thousand. Sentencing for both will
be in November next. Era Energy Transmission has picked the
route it prefers for construction of the one hundred and
seven plus mile mid Atlantic Resiliency Link or MARL transmission line.
The route comes after the company held a number of
