its kind partnership With Diversified, energy establishing the first financial
assurance fund dedicated to retiring oil and gas. Wells Rusty
hudson is THE ceo Of Diversified. Energy he joined us
On Metro news Talk line this. Morning, Rusty good, morning

Morning So, rusty kind of explain what this public private
partnership is all.
Speaker 6 (03:39):
About, WELL i think you stated it's first of its.
Kind it's really the first time that a state regulatory
agency has entered into this type of agreement with an
operator in the country really of this. Scale you, know
we obviously have significant puct in wells in the state

Of West, virginia and one of our main goals is
not only to produce those wells and the economic development
and impact it has on the, state but also to,
environmentally to be good environmental stewards and to do what's.
Right and one of the things that we wanted to
do was is set up a set this up to
(04:22):
manage what we call the asset retirement obligation of these
wells over a long period of time as the wells
become uneconomic over a long period of, time to be
able to make sure that they are responsibly retired and
that it doesn't become a burden on the taxpayers Of West.
Virginia and we've accomplished that with this. Agreement it's a
win win not only for the state Of West virginia

And diverse, five but for the citizens of the state as.

Well rusty IS i did some reading this. MORNING i
think can the number may be a bit, dated something
like sixty five hundred orphaned wells In West virginia gave
us school, history how did we get, here what, happened
what went?
Speaker 6 (04:59):
WRONG i think the numbers closer to nine, thousand to be.
Honest but you, know those those are typically wells that you,
know keep in, mind we've been drilling and producing wells
In West virginia or in the state Of West virginia
since their late eighteen. HUNDREDS a lot of those early
developed wells were held by companies that didn't have the you,

know the financial ability to manage them over a long
period of time and to retire. Them and, honestly retirement
of wells has just never been a big deal for you,
know for several, years nobody has really thought about, it
and so now it's become more of an upfront. Issue
and you, KNOW i think those wells that the state

would consider orphaned or just wells that were left to,
them you, know by companies that essentially just walked away
from them over a long period of. Time and so
we we, actually through our next level company that we
we own and operate there In, Bridgeport West, virginia you,
know we we actually retire wells for the state through
their Abandoned north for well programs as. Well so it's

a real, issue but this is one way of addressing,
it at least from diversified, perspective and for the wells
that we. Own this is something that will outlast. Me
and that was really important to me as being From
West virginia and loving the state and wanting to do
the right things for the. STATE i wanted this to
be something that not only took care of the, issue
(06:27):
but also outlasted, me outlasted the, governor and even outlasted
the regulatory agency the people that are in that department.

Today Rusty, HUDSON ceo Of Diversified, energy JOINING Us Governor
morrissey announcing first of it's kind partnership With diversified to
retire oil and gas. Wells, rusty what risks does an
old well that's not retired properly?

Pose you, know.

There's a lot the environmentalists will try to pin that
as being a really significant. Risk most of those wells
have have no gas or oil left on, them so
they typically have very low to no. RISK i, mean
there's always an exception here and, there but, overall most
of those wells have very little to low. Risk but

having said, that they do need to be retired and
done in an environmentally, sound in safe, way so the
landowners don't have to deal with, them you, know over
the long. Haul and so you, know very important to
me also is that you, know on my next level
asset retirement company there In, bridgeport as part of this,
agreement we're going to expand our. Capacity we're going to

add really good paying jobs to that area up, there
somewhere between fifty and one hundred new, positions you, know
average salary in that seventy five thousand. Range and so
it's it's a big win both from an environmental perspective
but also from an economic development.

Perspective talk to me a little bit about the structure
that you, mentioned the fact that it was very important
to you that this outlive, view outlive the. Governor talk
to us about how this is structured and how you've
ensured that that will actually. Happen.
Speaker 6 (08:18):
Rusty, Yeah So diverse five will pay in seventy million
dollars over the next twenty years and to WHAT i
call it's kind of like an, ANNUITY i called a reverse.
Annuity that money goes into the, fund it's not. Touched
over that twenty year, Period DIVERSE fid will continue to
plug and retire the wells that we currently do on
(08:40):
an annual basis with our own. Funds this money goes
into a separate. Fund it's backed with reputable insurance. Brokers
it has a guaranteed return on. It anything above that
will continue to add additional monies to. It but over
a twenty year, period that seventy million becomes a big
number because of the compounding effects of the guaranteed. Returns
(09:03):
and then from years twenty one forward you plug a
certain number of wells every year until the wells are completely.
Retired this is an, issue And i've tried to make this.
Clear you hear Environmental let's talk about it all the.
Time oh weld these all these, wells you, know these
non producing, wells these orphan wells that the state. Has
they all need to be plugged. Today even if even

if we had all the money that was necessary to
plug every well in the state Of West, virginia if
money was not an, issue it would take hundreds of
years to retire all of those. Wells the capacity to
plug and retire wells is fully utilized as we sit here, today.
Diversified in our next level, organization we do about four
(09:50):
hundred to four hundred and fifty wells a, year both
of our own wells and external wells for the state
and other. Operators we are at full capacity and we
represent almost fifty percent of the capacity that is represented
in The Appalachian basin. Today so it's it's a it's
an issue that's more than just the. Money it's an
issue of resources and the, ability time and weather and

all these other things that come into. Play it's going
to take, decades up on decades to manage this down
over a long period of, time even if you had
the money. Today so this program is established in a
way that says we're going to continue to produce these
wells and as they become uneconomic later in their, life
there's a there's a financial assurance product there that the

state is a is a designee on the on the.
Account so If diversified gets, sold if it goes out of,
business the money is still there for the.

board Of. Governors, rusty can we switch? Gears got a
couple of w? Questions if you've got a couple more
minutes always all. Right Doctor benson delivered his First state
of The university address this week and included his vision

for the, future which included a goal of being invited
to The association Of American. Universities that's an elite group
of universities leading the way and, research economic, development. Etc
so how can the board support that?

Goal, Well number, one you, know somebody asked me about
this the other day and, said what did you think about?
THAT i, Said i'm all for. It we need to
be setting our goals. High and one THING i love
About President, benson he has high goals for the state
Of West virginia and the, university and we want to
be standing in line as a, board as chair and

as the rest of the, board standing in line to
help him. Succeed and you, know we'll do everything in
our power coming over a long period of. Time it's
going to take, time but it's going to take financial
resources to do, it which we're more than prepared to
make that. Happen it's going to take people, resources it's

going to take it's going to be a lot of,
work but we're up for the. Challenge and you, know
that's one of the things that you, KNOW i said
AS i came in this, Chair, look we've got, big
lofty goals as a, board and we're going to make it.
Happen and you know that that's exciting that he's willing
to step up and say this is a big, goal
but we're going to go for, it and we're right

there with him to make it.

Happen, culturally how do you get people in place for?
That And i'm not accusing anyone AT wv of having,
this but, sometimes AND i think you know you've seen
this throughout your, career sometimes people want to play it
a little. Safe they don't want to, stretch they're afraid of.
Failure how do you combat that culturally AT. Wvu, WELL i.

Think it's leadership at the end of the. Day AND i,
think you, Know President benson is the right type of
leader for. That he just has this era about him that,
says get behind me and follow in, line and let's
go get stuff. Done he AND i talk about.

Time is our you, know our MANTRAZED i would, say
is get stuff. Done let's get stuff. Done we can

my thing is we don't have the luxury to be.
Complacent the world of academia has. Changed it's not like

it was twenty years. Ago we don't have the luxury
of playing it's. Safe we've got to go make some
bold decisions and do what's right Because West Virginia university
is such a big part of the state Of West.
Virginia it's psyche everything that goes on in the state
Of West, virginia and so we've got to be prepared

as a board to make, some you, know some really
big decisions and to drive the. Universities it's an, enrollment
it's goals, higher it's financial capabilities in a better, place
all these, things and, so you, KNOW i think that
anybody who wants to play it, safe they're underestimating what
(14:00):
playing it safe really can know what it can resolve In.

Rusty along those, lines In, september The board Of governor
said that it was going to support the athletic department
at this athletic department was going to be among the
top top funded in The big twelve. Conference and Then
Rinn baker was the last week or two announces one
hundred and forty more scholarships for next, year bringing that
across all eighteen athletic. Programs so speaking of not playing

it safe and, advancing we're already seeing that commitment come
to fruition in the athletic department with the addition of these.
Scholarships it was a, huge huge decision because what that
does for us across all of our sports.
Speaker 6 (14:41):
Programs it's not just about football and, basketball it's about
all of our sports, programs bringing everybody's scholarship levels to
in state, tuition which allows more money to be spread
amongst all of of the athletic. Programs and so that
was step. One we've got lots more steps to, come

but we will be in that top tier of The
big twelve when it comes to funding for. Athletics it's
not only it's not just a, goal it's a, commitment
and we're going to hit.

It, Rusty i'm going to switch gears on you one more,

Dave First energy filed their Integrated resources plan with The
West Virginia commission a week or so. Ago they're going
to build a natural gas fired power plant in their
territory here In West. VIRGINIA i know you think that's
a good thing for the energy, sector for the natural gas.

Sector tell us why that's good for people In West.
Speaker 6 (15:39):
Virginia, WELL i mean think about all the different aspects
that it. TOUCHES i mean number, one And Governor morrissey
has made a commitment TO i think he calls it
a fifty fifty gigawatts by two thousand and fifty or.
Whatever we. Need we have a resource In West virginia natural. Gas,
okay we're one of the top using natural gas states

in the. Country we have significant power needs, coming whether
it be data, centers whether it be new power. Generation
the grid is is massively under utilized or under supplied
right now in terms, of you, know additional power that's
necessary to fund all these new. Projects West virginia can
(16:22):
be at the at the lead of, that you, know
first energy coming. In it will result in needing more natural,
gas which means more wells being drown in the state
Of West, virginia which means more severe tax which gives
the state more funds to go and do economic development
projects across our. State it'll it'll add, jobs it'll add
severn there's a massive it'll adds property, taxes there's all
(16:46):
kinds of things that it that trickles down from something like,
this and it's just it's just good and it gives
us the reputation that we're open for, business that we're
able to do these, things and then it brings more
people in wanting to piggyback off of. That so this
is a big thing for the state Of West virginia
and it's great for the people in our citizens in

that you, know it'll it's a trickle down effect of
all the other things that come along with.

many many, times Because Governor morrissey ignored the fact that
the legislature did not change the state's mandatory immunization law
and instead issued in legally questionable executive order saying you
could have a religious. Exemption because of that several hundred

people have filed for that exemption and gotten, it and
we've ended up with court because state agencies feel, like,
well we have to follow what the governor, says and
they end up with court fights and circuit judges making
rulings on one side or the, other and a lot
of these cases being consolidated In Raleigh county and a
lot of, confusion while at the same time we have

outbreaks of measles across the.

Country, hoppy is this an example of a first time
executive moving too? Fast and, now even if you wanted
to roll this back a little, bit you're so far
into it the politically it would be so. Damaging is
that what happens when you come right out of the

figured when he issued that executive, order which just right
after he took, OFFICE i, believe figured the legislature would

you've already sort of across the. Rubicon so and you're,

right he might feel like he'd look weak if he backed.

children in school children are quarantined because they were exposed
to measles in an area of the state where there

are a lot of religious. Exemptions so if you have
a broad if you Allow West virginia for broad, exemptions, religious, philosophical,
whatever you can bet that one day you will have
measles outbreaks and you will have children quarantined because they've
been exposed to a highly contagious.

is a kind of far right extreme network that pedals
and conspiracy. Theories so that was the only press entity

kind of far right kind of news, networks decided this

was too, Much this was too much report. On So
i'm glad professional journalists are sticking to their, principles even
if the public maybe doesn't quite know the weight of
what's going on at this.

Point pull the curtain back a little bit for. Folks
we have a naturally adversarial relationship with whether it's whoever we're,
covering because our job as news, reporters as media is
to ask, questions sometimes tough, questions to get. Information that
doesn't mean it's a has to be a bad, relationship

No in, fact so you, KNOW i watched all the
news networks and there was a former general On Fox
news who's basically, saying you, know journal journal generals in
his time actually took classes on the relationship between the
press and democracy in order to see the press as

it's that has to be this out of visarial. Relationship and,

look this is an unnecessary policy because reporters are not
reporting on troop movements or giving out nuclear. Codes they
were doing the kind of regular routine business of keeping
The american people. Informed so it wasn't it wasn't anything
kind of uh that that made this. Happen besides this
move for kind of controlling information and not wanting to

Accountable it's part of the reason that maybe this isn't
sparking as much outrage AS i personally think it should
is that everything pops up on social media today in
one platform or, another but that originating media often doesn't

get the credit for what goes into. That so folks are, like,

my favorite social or on this page or that. Page
your thoughts.

There, Yeah, no, Definitely there's been plenty of studies that
still show that legacy media is actually the one to
either start conversations or to fact check those conversations that
are happening. Online so the REASON i think even if
you get your news from social, media the reason you
are still invested in professional journalists existing is they actually
have standards that they have to verify. Facts they are

the ones who can get sued for. Libel they are
the ones who are going to take that extra care
and time to make sure we have a truthful environment
so we can all make the best decisions for our.
Lives so even if social media is where you get your,
news it is these legacy news outlets that are actually
in the room holding the powerful accountable and also have
to verify facts and have that extra standard of their
own accountability to make sure they're getting things. Right SO

i do think the media environment has a lot to
do with, this especially the rate of news that comes.
OUT i, mean this could be another story in your
endless scroll Of oh some journalists are no longer at
THE pentagona, Okay so, YEAH i think the way the
news media works now is it's hard to understand what's
actually important when we have a fire hose of information
that just becomes a part of our kind of endless feed.

lot of. Outrage, yeah it's a nack and neck race
Between congress AND us on who people trust the, least
AND i think that has something to play into, it Doctor.

study the history of, journalism AND i would say that
journalists don't always get it, right and we've been accused
of being elitists and kind of out of touch with,
people AND i would definitely see that throughout. HISTORY i
do think we're in a kind of a precarious moment
when essentially we have an administration that is using that
kind of animosity and lack of trust to drive a

wedge even further between people and quality. Information but, yeah,
No i'm not going to blame. YOU i think most
journalists are hardworking. People you guys are hardworking. Folks you
tell the, truth but there is a certain narrative right
now that makes your jobs a lot more.
