Non-Compliant Podcast Episode 44: The One with #REPRESENT Consumers

In Non-Compliant Episode 44, Host Jay Edelson, nationally recognized plaintiff’s attorney and Founder of Edelson PC, is joined by Laura Antonini and Harvey Rosenfield of #REPRESENT, a project of the Consumer Education Foundation. Laura is an attorney and the Policy Director of #REPRESENT. Harvey is the President of the Consumer Education Foundation and one of nation's foremost consumer advocates. He founded the nonprofit consumer advocacy organization Consumer Watchdog in 1985, where he presently serves as outside counsel.

To start the show, Jay, Laura, and Harvey discuss the report put out by #REPRESENT, titled Reboot Required: The Civil Justice System Has Crashed (11:29). According to #REPRESENT's website, Reboot Required: The Civil Justice System Has Crashed shows how business goliaths sponsored a fifty-year campaign to reprogram the nation’s civil laws and judicial procedures to favor corporations and the elites .

Later in the show, Laura, Jay, and Harvey discuss reforming class actions, and eliminating abuses to the system (19:44).

Following a discussion on objectors and low claims rates, Harvey asks Jay why he decided to take on Tom Girardi. Jay's response? "This is going to sound glib: he stole money from widows and orphans" (37:00).

To end the show, the group discusses attorney's fees (51:00). While Jay agrees with the issues Laura and Harvey are seeing, he does not agree with their idea of using straight lodestar (multiplying the number of hours reasonably spent by the attorney on the litigation by a reasonable hourly rate) to determine fees (54:00).
