Welcome to Pretty Lies and Alibis.Let's seek the truth and travel the long
road to justice together. Let youknow, alibiers. Welcome to another episode
of Pretty Lies and Alibis. I'mJigi, good to have you here.
It's Thursday, December twenty eighth.I had to look. Yes the days
are all running together. My kidsare home from school. I've got like

(00:24):
a million teenagers hanging out at myhouse, which is cool. I love
it, but I'm all confused.Didn't get an episode in yesterday because I
spent the entire day going through LuisRivera's proffer as well as some of his
testimony and the different trials that havehappened since everybody was arrested starting back in
twenty sixteen, making some notes reallytrun and nail down a solid timeline of

(00:46):
that day, including phone calls thingsof that nature. But it's been pretty
time consuming and I also need toget in an update episode. Want to
stay current with things. We needto catch up on the demolition of the
house where Ethan, Zana, Maddie, and Kaylee were killed University Idaho murders,
as well as Gypsy Rose was releasedfrom prison today. She is a
free woman really for the first timein her life and some Lori Valo updates,

(01:08):
so look for that soon. Ifyou're watching on YouTube, don't forget
to give the channel a subscribe andhit the like video. Share it with
your friends if you don't mind. It's a really easy way to support the
channel, and I appreciate you.Music Fact of the Day drops to Jupiter
by Train. I think I've donethis song fact before, but you know,
I thought about this song so muchover Christmas. I've really struggled with

(01:30):
grief over the holidays. I misseverybody who's gone, and this year especially
my aunt, who was only tenyears older than me, more like a
sister and a bonus mom, butthis song reminded me of her. Lead
singer Pat Monahan revealed he wrote thissong about the death of his mother.
He went back to his childhood homeafter her death, and one morning he
woke up with the words back inthe atmosphere in his head. He was

(01:53):
beginning a time of healing and hestarted to compose the song. He said,
loss of the most important person inmy life was heavy on my mind,
and the thought of what if noone ever really leaves, what if
she's here but different. The ideawas she's back here in the atmosphere,
and I think that's really beautiful. It's a really good way to look at
it because I totally do not believethose who leave us ever really leave,

(02:15):
and that's a comfort. Let's gothrough a little bit of an arrest timeline.
It took nearly two years for thefirst arrest to happen, and that
came with six Fredo Garcia. Hewas arrested on May twenty fifth of twenty
sixteen. June twenty eighth of twentysixteen, Luise Rivera was arrested. October
one, twenty sixteen, Katie magBanawa was arrested, Charlie Adelson was arrested

(02:38):
April twenty first of twenty twenty two, and the latest to join the club,
Donna Adelson arrested on November thirteenth, just last month. She's just getting
her feet wet there. Luise Riveravery quickly realized to cut a deal would
be in his best interest, andso he played guilty to second degree murder
and was sentenced to seven years inexchange for his cooperation. He's tested to

(03:00):
fy to every trial and back intwenty sixteen when he was arrested for the
murder of Dan Markel. He wasalready in federal prison serving a twelve year
sentence. Now the sentence for Dan'smurder is to be served concurrently with the
federal sentence. He expects to bereleased between twenty thirty two and twenty thirty
three. So at Charlie's trial,Katie testified that the idea to kill Dan

(03:22):
came from Charlie. The first timehe brought it up was on Halloween of
twenty thirteen. One thing I amgoing to do is use some of the
testimony from Katie's retrial and put inhere. It just tells a bigger picture,
and you have two different perspectives ofhow things went down. You have
one of the hitmen, which isRivera, and then you have Katie,
who was the middleman, so sheknew everything about Charlie. To wear Rivera

(03:45):
gave us a glimpse into what happenedwith the failed attempt and the actual murder.
I do think one thing that's reallystuck out to me just in research
in this case is the fact thatthat motion that Dan file waspending in the
courts where he wanted supervised a visitationfor Donna and his boys. You couple
that with Wendy wanted to be backin Miami, and then Donna really wanted

(04:08):
the kids and Wendy back down there. It's like a classic recipe for motive.
And I just still don't think Charliecared. Where have these kids lived,
where Wendy lived. He was livingthe playboy lifestyle. He's super rich,
doing his own thing. I thinkthrough the calls that are on the
YouTube channel, we've seen his dedicationto his mother and their toxic codependency they

(04:29):
have. It was probably just makinghis mom happy while feeling very untouchable due
to his status, his money, whatever it is. But Carrara bus might
be a little delayed, but italways pulls up, and we're starting to
see that now. People are wonderingafter the new year, will we see
Wendy and or Harvey be arrested.I guess we'll wait and see if that
happens. We're going live at Charlie'strial, Katie testified that the idea to

(04:51):
kill Dan came from Charlie and thefirst time he brought that up was on
Halloween in twenty thirteen. They wereboth attending Halloween party and they were going
to leave. He got in thecar with her and asked, do you
know anybody that can harm someone? She said yes, but essentially just left
it alone for the time being. At the time, he did not say

(05:12):
who he wanted to have harmed, and she didn't ask. She knew that.
Charlie said his parents were really stressedand Wendy was having problems with her
husband and also with custody of herkids. She learned later on, and
she said when Sigfredo was arrested thatthe person he wanted to harm was Dan
Markel. She said she never knewhis name before that, which kind of
blew my mind. Did she notwatched news? This was huge news in

(05:33):
Florida in the months after it happened, But Charlie just referred to the person
as Wendy's husband. Really sounds likeCharlie kind of kept her separate from the
family, She said. Charlie painteda picture that Dan was just this terrible
man and making his family go througha lot of custody issues with Wendy.
His mom hadn't been sleeping or eatingand would refer to the stress from Dan

(05:55):
as the cause. She never toldCharlie who Sigfredo was and vice versa.
She referred to both of them asa friend. She said neither one really
wanted to hear the other's names, and Sigfredo just didn't like Charlie because they
were dating. Sig Fredo, asyou know, he and Katie had about
a decade long thing going on,two kids later, so he was a
little possessive all the while. He'sgot somebody too. So Prosecutor Kapelman asked

(06:18):
Katie if she told Sigfredo and Riverathat the murder was being done for a
lady to get her kids back.Katie said she believes that information came from
the envelope that Charlie gave to herto give to the hitman. She was
at his house on a random night. Charlie gave her a manilla envelope that
was sealed. He made really clearto her, don't open it, don't

(06:40):
look in there, leave it inyour bag, give it to the hitman.
He said he did not print thatfrom his office, and also he
put it in a diaper bag thatshe had. Charlie told Katie that he
wore gloves so that his fingerprints wouldn'tbe on there. He also did not
lick the envelope I'm guessing to keephis DNA off. At some point,
sig Fredo got the envelope out ofthe diveer bag, stuffed it in his

(07:01):
pants, and left. She admitsto characterizing the job for someone other than
Charlie because ultimately she thought of Sigfredoknew it was for Charlie, he wouldn't
do it because he wouldn't do anythingto help out Charlie. She does say
she thinks that maybe he knew itwas someone connected to Charlie, but from
October on she said that Charlie wasplanning the seed in Katie's head that this

(07:23):
needed to get done. There wasn'treally a pressure as time passed, but
around June or July twenty fourteen, those are the two months June that failed
attempt. In July twenty fourteen, when the murder actually happened, he was
just more adamant about the job beingdone. She said she never talked to
any other Adelson about the hit.Charlie was the only one handing her the

(07:44):
money, but Donna did sign checksfrom the Adelson Institute even though she never
worked for them. On the screenas a photo in South Beach with Katie,
Wendy, and somebody else. Katiesaid she'd only met Wendy one time
prior to this, at a dinnerwith Wyndy and her boyfriend Jeff Lacasse.
The photo was taken on Father's Day, but aside from Charlie, she never

(08:05):
had any communication with Wendy on herown. All Right, so let's dive
into Luis Rivera's police interviews and histestimony at Katie Magbanawa's retrial. He said
that Sigfredo approached him a few monthsbefore the murderer to go with him to
Tallahassee. Sigfredo didn't say what thejob was, and Rivera didn't ask.
October fourth, twenty sixteen is whenthis videotape proffer was done, and a

(08:30):
little ways into the interview he gavesome insight into why Sigfredo wanted to do
this job. I'm sure the moneywas a driving force, but he also
said that Katie had Sigfredo's had allmessed up. He was in love with
her and he thought it was asituation where Katie was promising to maybe get
back together if he did the job. He tells investigators that he had never

(08:50):
heard of Dan Markel before the murderor anybody with the last name Adelson.
He had never been to Tallahassee beforethe first attempt on Dan's life. Rivera
said he he Rob's drug dealers, and he thought that's what they were going
to do. Now. Regarding thefirst trip that started on June fourth in
twenty fourteen, Sigfredo rented a Nissanthe day they left for Tallahassee. Remember,

(09:13):
the Nissan ended up looking similar tothe car that Jeff drove, which
the theory, at least by Jeffand a lot of people who followed this
case, is that Wendy maybe waspotentially trying to set Jeff up for Dan's
murder. Sigfredo showed Rivera his gun, and the gun was a blue steel,
long nosed tous. Rivera told Sigfredohe was crazy to use that,

(09:33):
so Sigfredo told him to get asmaller gun. Rivera bought a thirty eight
from someone in the neighborhood. Hesaid he paid around one hundred and fifty
dollars for it. The gun wasbought the same day that Sigfredo rented that
Nissan. He gave Sigfredo the gun. Sig Fredo cleaned it with alcohol and
a bandana so it wouldn't have Rivera'sfingerprints on it. The day before they

(09:54):
left, they went to go buybullets. Rivera went inside and Sigfredo waited
in Rivera's merc He bought twelve bulletsfor each gun. He explains to the
agents that the gun shop sells individualbullets and you can buy fifteen bullets for
around twenty bucks. You can buya single bullet if you want. Rivera
said he had two phones on hisperson he always does. Sigfredo had one

(10:16):
burner phone. He thinks Katie mayhave had a burner phone as well on
that first trip. On the secondtrip, she used her personal cell phone.
He knew her number and saw itpop up on Sigfredo's phone. So
on that first trip they both hada gun. Rivera said he was going
to keep one on him because younever know what's going to happen. He
said he really didn't trust Sigfredo, and you didn't know if maybe Sigfredo would

(10:41):
turn around and kill him, sohe wanted to be prepared. And the
investigator stops him and says, yougrew up with them, He's not going
to kill you. Rivera said thatGarcia stays drugged up and he shot the
Prius on the second trip. Nowthat had happened obviously after this first trip
when they both brought their guns. But he was using that as an example
that maybe when Sigfredo is drunk orhigh, obviously could be a little careless.

(11:03):
Rivera said he also thought it couldbe a situation where Sigfredo was worried.
Maybe Rivera would snitch on him andjust get him out of the way
steal all the money. When theywere in the car headed to tyle Hassee,
Sigfredo finally told Rivera that he wasgoing to kill someone. He had
been hired to do this, andhe told Rivera that he would be paid
thirty five thousand dollars. Rivera toldinvestigators he was asked to go because Sigfredo

(11:28):
only trusted him, and also hedidn't want to go alone. You have
to remember they've been friends since theywere kids, around five years old.
So your oldest friend, I guess, if you're going to do a murder,
you take them along. Let's lookat the first trip, they left
around ten pm. They each drovehalf the way. Sigfredo showed him a

(11:48):
collar photo of Dan, which wasthe first time Rivera had ever seen Dan
or heard his name. He believesthat paper also had Dan's address typed on
there that came from that Manila envelopewe just talked about that Charlie gave to
Katie. Rivera told him, nevermind the name, I only need to
see the picture. On the wayto Tallahassee, they stopped at a rest

(12:09):
area and also to get gas.Garcia paid in cash, and he said
they had given him five thousand dollarsand two thousand dollars of that was in
his pocket. He said Sigfredo gotthe money from Katie, who in turn
got it from the lady. Neversaid the name of the lady. At
Charlie's trial, Rivera said that Katiegot the money from the people, Wendy

(12:31):
and the dentist who was her brother. Katie confirmed at Charlie's trial that she
got the money from Charlie. Sigfredosaid he needed money because he was going
out of town, so Katie wouldgo to Charlie or she would happen to
be at Charlie's house when Sigfredo wouldcall and say he needed money, then
Charlie would give Katie money to thengive to Sigfredo for expenses. Sigfredo gave

(12:54):
Rivera five hundred dollars told him tohold on to it in case he ran
out of money, meaning Sigfredo.Rivera said he knew Sigfredo would run out
of money because he would spend itall on cocaine. He said at the
end of the first trip, Sigfredomaybe had six hundred dollars left. He
said he never heard the name ofthe lady who wanted her kids back,
but on the way up to Tallahassee, sig Fredo told Rivera Katie was the

(13:18):
middleman who was relaying everything between theparties. Rivera thought they should just go
rob the lady since, according toRivera, that's who was paying them for
doing the hit, and Rivera saidthat was actually his intention. He said
he didn't know Dan had nothing againsthim and asked Sigfredo why were they going
to kill him. Sigfredo told himthat the hit was because the lady wanted

(13:39):
her kids back. She wants fullcustody because he had all the custody.
This was told to Sigfredo by Katie. When asked if he was guessing about
Katie telling Sigfredo this or if heknew for sure, she did say he
said he knows for sure. Shesaid this. Sigfredo and Katie talked on
the phone. Hey, babebe areyou sure she's gonna have the money on

(14:01):
time? Tell her don't play becausewe will show up at her house.
Tell her she better have that money. Rivera said that Sigfredo kept telling Katie
that he also heard Katie's voice onthese calls. He's known Katie for as
long as her and Sigfredo have beentogether. At first, he said six
or seven years, and then hesays maybe they've been together for ten.
When Sigfredo and Katie were on thephone, she would tell Sigfredo to get

(14:24):
there quickly, make sure you doeverything right, don't do anything stupid,
look at the house, and thenshe told him to call her when it
was done. She told Sigfredo, don't call me so much. He said,
Katie thought it would be done thefirst night they were there, on
that first trip in June. Hesaid they drove through the night to get
to Tallahassee and just really didn't knowthe way, he said. Sig Fredo

(14:48):
was drunk, so they stopped andbought a paper map. They looked at
it threw it in the glove compartment. Rivera said that they arrived in Tallahassee
between five and six am, butRivera got a traffic ticket in Gamesville,
Florida, at nine to twelve amon the fourth. Gainesville is about two
and a half hours from Tallahassee,so clearly they must have got there.
Later in the morning, they seea man that Rivera describes as a crackhead.

(15:11):
His name is Shadrick Nobles. Garciassaid he didn't have any idea on
him and then asked the man torent a hotel room for him, and
that he would pay him twenty dollarsto do so. So the man rented
the room for them. The hotelwas a budget in on Wadsworth at Tennessee.
They stayed in the same hotel roomtogether, never separated during that trip.
The day after arriving, they seesomebody selling drugs and asked for a

(15:35):
forty of cocaine. They kept buyingfrom this guy that night and they met
up with him again, actually thenext month. When they came back,
Sigfredo had his number. Rivera said. They had marijuana, mini bottles,
beer, and he said they chilledall night, go into bed around three
and got up at seven am.Rivera said they scoped Dan out for those
days. They were there to seewhere he goes, what routes he takes.

(15:58):
And at Charlie's trial, Rivera saidthat Sigfredo got out of the car,
poked around Dan's property a bit.He went to the back of the
house to see if anybody was insidethe home. They parked at a place
called Winthrop Park and waited for Danto come out. Sigfredo told him that
Dan drove a black Nissan with notentive windows and told Rivera, you will
see him. When Dan came out, they recognized the car decided to follow

(16:21):
him to the preschool where he droppedthe boys off. They lost him at
the daycare, Rivera said, andwhen they were circling around, Dan was
already gone and they couldn't find him. So they went to Hooters and drank,
and then they went back to thehotel and partied the next morning.
On day two of them stalking Dan, he had the same routine of going
to the daycare. Rivera said hedidn't want to kill Dan over kids,

(16:44):
and at Charlie's trial, Rivera saidhe was not going to kill Dan in
front of his kids. He saidhe actually wanted to rob Wendy since he
thought that's where the money was comingfrom, but Sigfredo said this job had
to be done. The investigator askedwhy were you paid so much just to
be a ride along, and thenhe asked, were you going to be
the trigger man? Rivera said atone point Sigfredo said you should go in

(17:04):
the house and kill him. Theinvestigator asked why Sigfredo would tell him to
go in and kill Dan and askedif Sigfredo maybe thought Rivera had murdered somebody
in the past. Rivera said hethinks that's what Sigfredo thought. Rivera tells
the investigator he's never killed anybody inhis life. The investigator asked if on
that first trip Sigfredo thought Rivera wasactually going to be the shooter, and

(17:26):
Rivera said yes. But Rivera saidhe doesn't have the guts really to shoot
somebody over kids, he said.In the end, they scoped Dan out
maybe a day and a half ortwo days, and Rivera told Sigfredo he
didn't think this was worth it andthat Sigfredo needed to think about this.
Also, the plan was to killDan in the morning, but they lost
him both times at the daycare.Ultimately, the rental car company pinged that

(17:49):
rental car, which was supposed tobe a local rental only. So when
they knew that the rental car companyknew they were in Tallahassee, they went
back to Miami. On the wayback to Miami, Sigfredo kept talking to
Katie, so Rivera told him towait, talk to her in person,
quit using his phone, because thisis how you get caught. He also

(18:11):
said, when sig Fredo drinks,he gets really chatty. Sigfredo told Katie
on the way back to Miami afterthat first trip that nothing had happened and
they would probably come back. Hetold her they would follow Dan and also
that when he was home, hewould park in the garage, so they
didn't know if he was actually homeor not. When they left Tallahassee that
first trip, there was no dateset for them to return he said nobody

(18:33):
questioned them about the murder not happening. He also said that he didn't think
anybody other than Katie knew he wasgoing with sig Fredo for this job.
Rivera said he was worried that Katiewould tell the lady that he went along.
So this is kind of interesting. We're going to get into some phone
call stuff here. Between May oneand July nineteenth of twenty fourteen, Sigfredo

(18:56):
and Katie's phones may contact approximately twothousand, seven hundred times. That's insane.
That's seventy nine days, and y'all, I can't do math, but
if I did the math right onmy iPhone, that's an average of thirty
four calls a day. So let'smove to July first, just seventeen days
before Dan Markel was shot. Ateleven forty seven am, Katie began attempting

(19:19):
to call sigfredo cell phone. Overthe next five and a half hours,
Katie tried to call Sigfredo approximately fortyeight times. Five oh five pm,
she finally makes contact with him,and the duration of that call was six
minutes and twenty two seconds. Iget this at five twenty pm, just
nine minutes after hanging up with Katie, Sigfredo accidentally calls Harvey Adelson's phone and

(19:42):
it goes to voicemail. So Katieexplains this a bit at Charlie's trial on
July first of twenty fourteen. Thissame day, Sigfredo had just picked up
their kids and was eating at acorner pizza place. He just happened to
see Charlie was coming to pick Katyup, and Charlie had jets in tow
when he loaded up the kids andcut her and Charlie off in the backstreet

(20:04):
of where she lived at the time. Sigfredo was screaming things to Katie and
Charlie, but they didn't hear becausetheir windows were up. She said that
Charlie had to do a three pointturn to kind of get away, but
after that, Sigfredo was trying tocontact Charlie. Sigfredo looked up what he
thought was Charlie's work number in Katie'sphone and he called it. It was
actually Harvey's number. It went tovoicemail, and Sigfredo left a very nasty

(20:29):
voicemail thinking it was Charlie's phone.Kapelman asked if Sigfredo knew he was doing
the murder for Charlie, she saidhe may have had an idea, but
didn't know for sure. Most ofyou have probably heard me seeing the praises

(23:07):
Rivera testified at Katie's trial that ultimatelySigfredo called him and said that he needed
to finish this job. On Julyfifteenth, Sigfredo gives Rivera three hundred dollars
and then Rivera in return, rintsthat Prius Rivera drove on this trip.
Sigfredo just kept saying, I haveto do this. Rivera knew it was
pressure coming from Katie. He said. Katie would go cheat on him and

(23:30):
then say, if you want meback, you have to do this job.
Rivera said. On the second trip, he told sig Fredo, all
right, I know you're doing thisfor your wife. They weren't together at
the time of the murder and Sigfredowas actually kind of on again off again
with somebody whose nickname was Shrimp. He said. Sigfredo was drinking a ton
and was doing cocaine due to Katiehaving his head all messed up. At

(23:55):
this time, Katie was living inMiami Beach, Rivera said, just for
context, a week after the murder, Sigfredo and Katie got back together.
So they leave for Tallahassee, arrivingin the early morning hours on the seventeenth,
which is the day before the murder. On the second trip, Sigfredo
had two thousand dollars cash and gaveRivera two hundred of that. Sigfredo ran

(24:15):
out of money and Rivera had togive him the two hundred dollars. This
is something I've had people say theydon't know if it really happened. Wendy
denied it happened, but Rivera testifiedto it and also talked about it in
his proffer, So we're going toput it out there, he says.
The day before the murder, whenthey were scoping out Dan's house, they
see Wendy walking on the sidewalk withher boys right near Dan's house. Rivera

(24:38):
was driving and Wendy looked at thecar, and he saw from his rear
view mirror as they passed that shewas looking at them. Now, at
Charlie's trial, Rivera testified the ladygets on her phone after they passed.
Rivera asked Sigfredo, what's up withthis lady? Why is she looking so
much. Sigfredo says, that's thelady with the kids. That's Wendy.

(25:00):
The investigator asked him if Sigfredo alreadyknew who Wendy was. Rivera said,
Sigfredo did. Rivera's like, what'sshe doing up here? Once they round
the corner, Sigfredo calls Katie. He says, hey, what's going on?
I saw the lady up here.Now. In the interview, Rivera
says Sigfredo did not even have tosay who the lady was, didn't have

(25:21):
to name her. Katie told Segfredo, she's straight. She's making sure everything's
fine. Katie said, make sureyou get this done. This is a
little confusing to me, but Riveraconfirms he heard Katie say Wendy wanted to
make sure they were there. Butat Katie's retrial, Rivera said that Katie
told him to get out of there. The lady just seeing y'all. Sigfredo

(25:44):
told him that Dan was leaving tomorrowmorning, so they have to get this
done tomorrow because he's leaving. Andshe came up to see the kids and
make sure everything was all right withthe kids. She also wanted to make
sure they were up there and wantedto make sure she wasn't paying sik Freto
for nothing. Now, I don'tknow if this actually happened. I've just

(26:04):
read a lot of people doubting itdid, but I don't know. To
me, I think Rivera comes acrossin all the interviews and all the testimony
that's pretty credible, and he's agood reason to be. He got a
very light sentence for what happened, and not only did he go once,
he went twice, even though hesays he didn't want to kill anybody for

(26:25):
kids. But in a plea deal, if they find out you perjured yourself,
well the plea deal's off and youcan be really screwed. So I
think Rivera came across as credible.Let me know in the comments, what
you think. Do you think thatthey actually saw Wendy or do you think
not. At Charlie's trial, prosecutorCapelman asked Rivera if they found out Dan
was leaving town from a blog. This is a blog that Dan helped start,

(26:48):
and he says yes. So Capulmanasks what's the blog? And Rivera
says, Wendy, I don't thinkRivera knew what a blog was. They
were trying to get in touch withthe guy who had sold them the drugs
before. He wasn't answering, butthey happened to bump into him and asked
if he could get them some stuffto get high. The man said to
follow him. Well, as they'redriving, Sigfredo decides he's gonna play with

(27:11):
the gun. The murder weapon,by the way, look discharges in the
car. Well the car was immobilized. Rivera realized they didn't have any gas
and he couldn't figure out, like, why do we not have gas?
So they pushed the car off theroad into a little parking lot. The
guy they met up with told himto come with him to AutoZone. Rivera
said he wasn't leaving the car,but ultimately they found out he shot through

(27:32):
the fuel line, so they hadto go get something to repair that fuel
line. Sigfredo and the guy wentand came back from AutoZone, jacked up
the car and Sigfredo fixed the holesand the car was running. After that,
they followed the guy to a trailerpark and get cocaine, and then
the guy followed them back to thehotel. A side note this very interesting
is that the rental car company ultimatelysold that Prius, but they never noticed

(27:56):
the defect in the car. Itwas fixed. Obviously he did a go
enough job fixing it. That defectconfirmed Rivera's story to investigators. Rivera was
a little bit mad that Sigfredo wantedto hang out with this guy. He
said, he wasn't there to makefriends. He said. They chilled in
the hotel room that night, andthat guy staved for a little bit.
Rivera at one point took a photoof an owl that was outside and posted

(28:18):
it to Instagram. Well, Katiecalls Sigfredo. He needs to take that
down, She asked, Sigfredo. Why would he do that? And you
can't tell anybody where you are,Rivera said, And they talk all day
long on the phone. Why areyou worried about me putting up a picture
on Instagram. So let's look atsome calls from after midnight and see who

(28:38):
called who, because I'm going totell you it really starts to come together
to me when you look at thesecalls. So this is on the eighteenth,
just after midnight the day Dani Shott. Twelve oh one am, Katie
calls Sigfredo. The duration of thatwas over one minute. Twelve oh seven
am, Charlie calls Katie for sevenminutes. Twelve thirty four am, Katie

(29:03):
calls Charlie. That was a littleless than a minute. One o two
am, Charlie calls Donna. Therewas no duration listed. Doesn't mean they
didn't talk. Very possible it couldhave went right to voicemail. One o
three am. Charlie calls Katie fortwenty minutes. Jumping to eight oh nine
am, Donna calls Wendy for thirtyfive seconds. At eight fifty Dan drops

(29:26):
the kids off at pre school. At the same time, Rivera and Sigfredo
are stalking Dan from the preschool tothe gym. At nine to two am,
Dan calls Wendy for one minute. At nine to twelve am, Charlie
calls Wendy for less than a minute. At nine to twelve am, Dan

(29:47):
markel arrives at the gym. Nineto nineteen AM, Wendy calls Charlie for
eighteen minutes. Nine thirty eight am, Charlie calls Donna for thirty seconds.
Then at nine to fifty eight Sigfredosince his last text before that phone is
shut off until after the shooting. At nine point fifty eight, Charlie calls
Katie for over six minutes, andO seven Katie calls Charlie for one minute.

(30:11):
Ten oh eight, Katie calls Charliefor nine seconds. Ten oh nine,
Charlie calls Katie for six minutes. At ten thirty eight, Dan Markelle
is seen leaving the gym, andin a very haunting video, you see
that green Prius following him out ofthe gym, knowing in a very short

(30:33):
while Dan Markell's life would be overas we know. At eleven am Dan's
shot. We're going to backtrack justa second to the morning when six Fredo
and Rivera woke up. I justwanted to get those calls out because it's
really revealing to me if you lookat those calls before the murder, and
then we got some more coming upafter. But when they woke up,
they went back to that Winthrop Parkwhere they could see the entrance and exit

(30:56):
to Dan Street. When Dan cameout of the street, followed him to
the daycare, and Rivera said hewas circling the building. There was a
building across the street, and Riverawas going to park over there, but
as they were pulling in, Dancomes out of the daycare, and then
they followed him to the gym. They waited in the parking lot of the
gym for around forty five minutes toan hour, and when Dan comes out

(31:18):
of the gym and leaves, theyfollow him home. Rivera says he parks
three to four feet away from Dan'scar he was driving. Sigfredo jumps out.
He said Dan was on the phoneand at Charlie's trial. Rivera said
that Dan put his hands up whensig Fredo pointed the gun at him.
Sigfredo choose Dan twice, got inthe car and they left. Rivera said

(31:41):
sig Fredo was really nervous. Heput the gun under the mat on the
passenger side, and then they leaveTallahassee to go back to Miami, and
as you know, their car wascaptured on some city bus cams and traffic
cams. So let's look at atimeline of the events coupled with some calls
after the shooting. At eleven am, we know that Dan was on the

(32:04):
phone with that staff member from theschool where Wendy was looking to enroll their
oldest son Ben. At eleven ohone, that person texts Dan asking if
he's okay. At eleven oh two, Dan's neighbor calls nine to one one.
At eleven oh six, Donna callsCharlie. It was either an attempted
call or a text. At eleventwenty two, Charlie calls Donna for seven

(32:28):
minutes. Now Dan's been shot fortwenty two minutes, and you start to
see this flurry of calls between theparties. At eleven thirty am, Charlie
calls Katie for thirty seconds. Ateleven thirty one am, Charlie calls Katie
for five minutes. Twelve twenty nine, sig Fredo's phone is back online,
and then at twelve thirty pm,sig Fredo calls Katie Rivera can't remember if

(32:52):
this is before or after they dumpedthe gun. When Sigfredo calls Katie,
but he tells Katie it's done andmay make sure you have my money.
Katie says, okay, I knowshe knew it was done, Rivera said.
He asked Sigfredo, like, howdoes she know it's done so fast?
He said, I don't know ifWendy is still up here. I

(33:12):
don't know what was going on.Rivera said. The whole drive, he
was looking in the rearview mirror, just expecting the police to find them.
They were actually more than halfway backto Miami before they stopped to toss the
gun. Rivera was gonna stash thegun back in Miami, he said.
He intended to bury that gun wherenobody would find it, but Sigfredo wanted
to toss it get rid of it. He said. Sigfredo had been trying

(33:34):
to take the gun apart on theway back to Miami, and Rivera was
telling him he's doing it wrong.Yeah, pull this out or whatever.
Ultimately, they dumped the gun ata bridge that went over a river.
At one point in the profer interview, Rivera produces a drawing that he made
that morning trying to figure out wherethe bridge was he did go on a
ride along with investigators. To myknowledge, they never found the bridge,

(33:58):
and that weapon has never been foundto this day. But Rivera said he
pulled up to this bridge and Sigfredogot out of the car, jumped the
concrete and metal guardrail, and thenhe went into some grass. He took
the gun apart and he tossed it. He doesn't know if the gun made
it to the water or not,but he said they could see the water
from the car. He also thinksthis Sigfredo tossed the extra three bullets they

(34:20):
had in the cylinder, so theycame up with six bullets, and that
was it. You had two thatshot Dan, you had the one that
Sigfredo fired in the car, andso he tossed those extra three bullets into
the river. Rivera had also toldSigfredo that if they were pulled over and
that gun was found, he wouldhave to take full responsibility for it because
compared to his Sigfredo had the wighterwrap sheet. They drive home, never

(34:44):
spoke about the murder again and didn'ttell anybody. When they get back to
South Florida, they go to theATM from six forty five to six forty
seven. He says that he mayhave gone to a liquor store, and
he said his credit card statement wouldshow if he did or not. Let's
look at the phone calls and thetimeline for the evening that Dan was shot
of July eighteenth, twenty fourteen, between six forty five and seven forty seven

(35:07):
pm, six Fredo and Rivera arean atm in Miami. Seven oh seven,
Wendy calls Donna from the police station. Seven to eleven, Donna calls
Charlie. It goes to voicemail. Two minutes later. At seven thirteen,
Charlie calls Donna for five minutes andforty seven seconds. At seven thirty six
pm, Charlie calls Katy for twominutes and forty nine seconds. At seven

(35:29):
thirteen pm, Charlie calls Donna forfive minutes and forty seven seconds. Again,
at seven twenty nine pm, Charliecalls Donna for six minutes and thirty
one seconds. Seven thirty six pm, Charlie calls Katie for two minutes and
forty nine seconds. When they gotback to Rivera's house, he was arguing
with sick Fredo about them not havingthe money so Sigafredo calls Katie. She

(35:52):
said not to worry about it,she would have it tomorrow morning, first
thing when the sun came up.Rivera told sig Fredo, I'm going to
the barber shop in the morning, and by the time I get out,
that money better be around or they'regoing to have problems. He said,
you're making me go on a missionI didn't want to do. And then
at Charlie's trial, Rivera said heand Sifredo went to a bar called Big
Daddy's. Katie wasn't there. Soat eight fifty nine PM on the day

(36:15):
Dan was shot, Charlie's eye cloudshowed a message to Charlie from his mom,
saying, outside your house. Lateron that evening, Katie goes over
to Charlie's house. She said Charliewas acting frantic. He had a gun
in his hand, he was wavingit around when she got there, and
he wasn't acting normal. Charlie toldher Donna and Harvey had just left his

(36:37):
residence and left money that Donna hadwashed. Now. At Charlie's trial,
Katie testified she got the money inthe morning after the murder. The money
was received in a ziplock bag thatwas inside of a brown bag, and
the brown bag had a grocery bagover it. The money was damp and
it was stapled in one thousand dollarsstacks right there in the corner, just

(36:58):
a note, she said. Acouple of days after getting the money,
she opened the bag and saw therewas mold on the money. Sigfredo told
her to use a hair dryer anddry the money. Can you guys picture
on Adelson washing some money? Ohlord, I can just see her with
like a big thing of water inthe scene and some dish detergent in her
little rubber gloves washing some cash. She said that night that Charlie gave her

(37:22):
his annex and they both fell asleep. Cell Phone data shows Harvey and Donna
in Orlando at one twenty five amon the nineteenth. Dan passed away between
midnight and one am at that sametime. Katie wakes up on the nineteenth,
the day after the murder, andsays she's got to go. Charlie
told her the money was in thetrunk of her car. She tries to
call Sigfredo that next morning. Riverais at the barber shop, like you

(37:45):
said. He would be. Katiecalled Rivera saying I can't find Sigfredo.
He wasn't answering his phone. Hesaid, who's gonna come get the money?
She asked if he wanted to comeget it, and he said nope.
He said he would try to findsix Fredo. So he calls Shrimp,
the on again, off again flingof his who said Sigfreda was there.
He was drunk Andie was asleep.Rivera says to wake him up and

(38:06):
tell him that Katie is looking forhim. Rivera calls somebody he refers to
as his do boy, go dothis, go do that, to go
pick up Sigfredo. The person takesSigfredo to Katie's house. One thing that
doesn't match up, and maybe I'mjust missing something here. But at Charlie's
trial, Katie said that she droveto where Rivera lived with his girlfriend and
that Sigfredo popped up all of asudden and then got in the passenger seat.

(38:30):
While Rivera was still in the barbershop, his wife, whose name
is Jessica, calls and says thatSigfredo and Katie are there and says Sigfredo
gave her a bag and it's inher hand and it looks like it has
a brick in it. He tellsher not to touch it, don't look
at it, and to tell Katieand sig Fredo not to leave. He
would be on his way home,so he left without getting a haircut.

(38:52):
When he got to his house,he said that Katie was upstairs with his
wife. He says a name,So I'm assuming that they had just had
a baby. Rivera takes the moneyout of the bag, puts it in
his pocket. Rivera asked Sigfredo whathe was doing that morning, and Rivera
said he needed to go back toget a haircut and he was going to
go to the bar. So theyget to the car and Rivera asks,
do I need to count the money. He looks at it realizes the money

(39:14):
is thirty grand. It's an onehundred dollars bills stapled in a corner with
a grand in each stack. Hesaid Sigfredo gave him extra. It ended
up being thirty seven thousand totals,so Sigfredo gave Rivera two thousand more.
After they went to get a haircutand to the bar, they went to
Rivera's mom's house. Her rent wasover two thousand dollars and so he paid

(39:36):
her rent. He went home, took a shower, and got dressed.
He said he met up with somegirl in a bar with sig Fredo and
they all hung out together. Riveragoes home in the next day, which
would have been Sunday, July twentiethof twenty fourteen. He said he slept
until around noon, and around threeor four pm, he goes to see
his ex wife since school was aboutto start back. He gave her five
thousand dollars. He was asked wherehe got the money. He said,

(39:59):
not to work, worry about it, and said why are y'all asking?
He said, just get the moneyand don't worry about it. Sigfredo kept
the Prius for a couple of days, and Rivera said he kept telling him,
like, you need to return thiscar. But here's the thing.
Sigfredo got so drunk he forgot wherehe left the prius. Rivera found it
two or three blocks from Shrimp's houseon a corner. He said the car
was parked by a fire hydrant. He says extinguisher, but I think he

(40:22):
meant hydrant. He said that thecar would have been towed, and then
he would have had to have paidmore money to get it out. Sigfredo
had locked the keys inside, sosig Fredo had to call Triple A to
get the keys out. Rivera forkedup fifty bucks for his drunk buddy.
Rivera and Sigfredo drove the prius backto the rental place and Rivera turns it
in, he said. A weeklater, he took money to his sister's

(40:43):
house in an envelope and asked herto put it away for him. He
put it in a closet. Hesaid he doesn't want to keep money at
his house because when his wife getsmad at him, she gets in his
pockets and takes his money. Hesaid he had stayed with his sister in
the past and had a key togo in and out of that house.
Still, he said, that's aboutwhere the story ends. With the money,
he said about a week after themurder, he went to hard Rock

(41:04):
with sig Fredo. Sigfredo lost seventhousand dollars that night. After the murder,
Katie got paid moved to a betterplace. Sigfredo went to live with
her for a little bit and Riverawent over once. Rivera told Sigfredo that
Katie had him so messed up andshe made him do something he wasn't supposed
to do, Obviously, referring toDan's murder, Rivera said, at some
point after the murder, he wasdrinking and he was just thinking about the

(41:29):
murder and he was getting mad.He said it was hitting him. Someone
called Sigfredo to come over and calmhim down. Sigfredo told Rivera just to
chill out and to stop thinking aboutit. Rivera asked Sigfredo, how can
you walk around like that when Sigfredowas the one who pulled the trigger and
just act like everything's okay. Riverasaid he couldn't sleep thinking about Dan and

(41:52):
his kids, and he said ithurt him to know what they did and
Don's probable cause Affidavid. After themurder, Katie started getting significant amounts of
money. She deposited over thirteen thousanddollars in cash in her banking account,
and in the six weeks after themurder, she deposited more in her account
than she had the entire year leadingup to the homicide. The deposits were

(42:13):
mostly done to ATMs, and theamounts would range from two hundred to two
thousand dollars. Investigators found deposits totalingover fifty six thousand between the murder and
November of twenty fifteen. She alsowas driving a two thousand and one Lexus
that once belonged to Harvey previously wasused by Charlie. On January twenty third

(42:34):
of twenty sixteen, the title wastransferred to Katie, she got a new
license plate. DMV records showed thecar was sold to Katie for one thousand,
seven hundred dollars. I looked uplast night, a two thousand and
one Lexus is still going for anywherebetween five and eleven thousand dollars, depending
on your options. So there's morepurchases, more money where that came from,

(42:55):
and we'll get into that in thisnext episode. But I think that's
pretty much the summary of what happenedthat day. The phone calls in relation
to the murders before and after reallypaint a picture, even though we don't
know the context of those calls, but you could sort of imagine. So
that's it for today. We'll doan update episode tomorrow. Hope you guys
have a good rest of your evening. We'll see soon.
