Speaker 1 (00:00):
What's Chinea Alibier's Welcome to another episode of Pretty Lies
and Alibis. I'm Gigi. We are going to break down
the afternoon session in the Brian Walsh trial. This won't
be too long. This was mainly going through items of
evidence with the forensic scientist and what tested positive for blood.
They took items from the house as well as items
(00:21):
from that trash pull. But first we had a very
quick witness, Gregory Dannen. He works for a parent company
of stopping shop. They show a video of Brian at
self checkout and they bring in the receipt showing he
bought three bottles of ammonia. The next witness Matthew Shehan.
He works for the Massachusetts State Police Crime Lab and
(00:42):
on January eighth, he was asked to report to Brian's
home to look for blood evidence. They found a knife
in the cabinet and the screening test for blood was
positive on the blade. In the basement in the back
right corner, he found stains on the concrete floor that
he tested. All of those were positive for blood, but
there were also so other areas that did not test positive.
(01:03):
At the end of the day, the house was secured
and they returned the next day to continue working, and
that would have been January ninth. In the front left bedroom,
there was white residue where varnish on the floor had
been removed, and they removed that flooring. He went back
to the basement for a second exam to make sure
he didn't miss anything. He went to an area where
there were trash bags, and then back to that area
(01:25):
that he tested the day before and got those positive results.
He found a squiggily looking stain on the concrete floor
which tested positive. He submitted the swabs to the lab
for DNA analysis. He explains that some of these stains
had a substance put on them at the crime scene
that can turn the sample purple. That can also mess
(01:46):
with the presumptive positive test, so if a sample had
that purple standing, he would preserve the sample for DNA testing.
He also tested items from that trash pull. Let's go
through what tested positive. The head of the hatchet, a
piece of carpet towels, men's slippers that also had hair
on them. That hair was positive for blood, and then
(02:09):
he preserved those for classification to make sure it was
human and not animal. One of the hairs was classified
as human and the second hair was animal hair. He
also swabbed the inside of those slippers for skin cells
for DNA testing. Also positive, a scrub daddy sponge, a
rug sample and on the hacksaw, the blade on the
(02:30):
opposite side from the handle, and the blade where it
attaches to the frame, the hammer face area, plastic painter sheet,
tissue paper or paper towels, a white towel, a wipe,
a taieex suit, and he also swabbed the interior because
there were stains on the inside and he wanted to
see if he could get skin cells. Some of those
(02:53):
key items were preserved for DNA testing, but not all.
They try to pick items that have the most forensic
relea elevans and what would answer as many forensic questions
as possible. He said, if you tested everything, it would
create a huge backlog in the lab. Now we'll hear
about these DNA results when the DNA expert testifies. And
(03:15):
that was pretty much it for his direct It took
a while because you go through each picture and then
he has to recite the item number. So I just
broke it down and told you what was positive on
cross This dude Holler's NonStop, and he sounds very aggressive
with a very benign witness. And I have to say,
pretty much every trial I've been in, when you have
an attorney who acts like this, the jury typically looks
(03:38):
really uncomfortable and they don't seem to like it very much.
But let's go. He said, there have been multiple officers
in and out of the house for several days who
were not wearing any protective garments or booties. And he
says it's important to maintain the integrity of the home
before collecting samples. When you try to make conclusions about
things taken from different areas at the home, knowing people
(04:00):
have been in and out of the house, you can't
tell the jury how the biological samples were deposited in
certain areas. And the witness says no. He talks about
that white residue on the floor. You didn't see that
on January eighth, which was the first day he was there.
The witness does not recall, and he says it's not
in his notes. The defense says, hm, we'll come back
(04:23):
to that in a minute. On January eighth, were you
in the bedroom where the white residue was No, but
other Massachusetts State Police officers were and the witness says, yes.
The defense, when you went up on the ninth that's
when you first saw the white residue on the floor.
The flooring was dug up where you saw the white residue,
you examined the area after the flooring was removed, Yes,
(04:47):
he said. The reason that they removed the flooring was
to look for biological evidence, but the witness said they
did not find any blood. The defense asked if anything
in the bedroom on the floor had any biolog logical evidence. No.
Did you test the hole in the ceiling or go
in the attic to examine it? No. He asked if
any of the base boards in any of the rooms
(05:09):
were removed to look for blood, and the witness doesn't know.
There were no stains on the bed. But the defense says,
even if you didn't see stains, you can check to
see if there's anything you missed. You have chemicals and
tools to help you detect biological substances. The witness says yes,
and that test can be done on any surface, including fabric.
And that is where we left off for the day.
(05:30):
I had to jack my headphone volume down like halfway
so this defense attorney didn't bust my ear drums. Tomorrow,
join us at nine am. We'll be live streaming Day
seven in the Brown Walsh trial. And again I'll update
midday and then evening session, which may be a little
late because my daughter cheers at a basketball game tomorrow
night and Mama will be there. That's it for today.
(05:52):
I hope you guys have a good rest of your
evening and we will see soon.
