Alibia's Welcome to another episode of Pretty Lives and Alibis.
I'm Gigi. It's Thursday at August twenty eighth. I hope
you guys had a great day finally getting around to
finishing up testimony, and we're going to do two parts.
Part two will be out in the morning, so let's
jump in. We still have a special agent, Patrick Sanford

(00:21):
on the stand. He's bringing in these wiretaps as well
as the Dulce Vita recording with Charlie and Katie, as
well as a few text messages. Charlie tells Donna he
got Wendy to accept a job with a law firm.
Donna says she did no kidding. He told Wendy there
was no time frame for it, and if she changes
her mind, she changes her mind. He said Wendy would

(00:44):
pick up skills she doesn't have, and now isn't the
time to just chill and become a guidance counselor at Miami.
He told Wendy she was overqualified for that. Donna talks
about Wendy not getting hired there in Miami because there's
nothing there. Charlie tells Donna the dean of the University
of Miami called her, and Donna said Wendy didn't tell

(01:05):
her that. Charlie said the job was for her being
an advisor and that would be brainless work for her.
He told Wendy she could make a bunch of money,
but Wendy said it's not really what she likes. Donna says,
but she's never done it, so you don't know. Charlie says,
it's like dentistry. You don't know what it's like until
you practice it, and Donna's like, exactly, he said. Wendy

(01:29):
asked if her boyfriend Dave could come to the house
for Mother's Day, and Donna's like, oh, she asked you.
So Charlie told Wendy to bring him. The more the merrier,
and Donna says, why not, it's fun. Donna said she
wouldn't care if Charlie took her, Dave and their kids
on the boat for an hour, and she said she
and Harvey could hang by the pool, and Donna says

(01:50):
she is super happy. Charlie says Wendy is developing a
brain and Donna agrees. Donna said at this point she
had to walk away so the kids don't hear.

Speaker 2 (02:00):
She said.

Speaker 1 (02:01):
The kids aren't good with hugging and kissing, and it
makes Wendy feel bad. Donna explained to Wendy, they're boys.
Girls are more kissing. Donna told the oldest grandchild. People
who love you hug you and kiss That's why Grandma
and Grandpa always want to get a hug and a
kiss when we say goodbye. I did that with my children,

(02:22):
and I do that with my grandchildren. And the boy said, yeah,
it's like Dave and Mommy. They're hugging and kissing all
the time because they love each other. Donna says, you
can't hide things from kids. They will open up and
tell you everything. Charlie talks about Wendy not knowing how
lucky she is, and Donna agrees. Charlie says, at least

Wendy doesn't see herself as the victim anymore, which is great.
Donna says she's happy to hear that Wendy is spending
more time with Dave. On the next call, Charlie and
Katie discussed an in person meeting. Charlie had left Donna's
condo and went to Katie's work. The witness said they
tried to get surveillance on that. They did get a

(03:04):
photo of Katie and the Lexus that she got for
the dolce Vita recording. This is a restaurant meeting between
Charlie and Katie shortly after the bomb. It's pretty lengthy,
but I did go through and pick out some parts
that I thought were most important. He said, if they
had any evidence, we would have already gone to the airport.

(03:24):
But even if they bug your home or your phone,
you're still not talking about any of this. But how
do you get people to talk? You throw smoke grenades
and then the cockroaches run out. And if that's the way,
it's very smart because my mom hasn't told Dad anything.
Mom knows Dad's gonna flip when he finds out. Charlie said,

(03:45):
this person that approached her knew her routine. Then he
talks about how he carries a gun, and Katie says
she does too. Charlie said, if someone comes up to me,
they better be ready to shoot, because I'm going to
shoot them. If someone comes up to me as asking
for money at my house, when the police show up
and there's an oral surgeon standing there with a dead

(04:06):
gang member in the driveway. They're not going to come
down too hard on me, and I'm not going to
talk anyways. I don't trust them. They didn't go through
the trouble to hand my mom that and go away.
This is happening and it's serious because they're going to
come back. If a badge comes up to you, you
tell them have a nice day, officer. If you want

(04:26):
to charge me, charge me. And then he says, I
don't talk to cops. He talks about how things have
changed a lot with their being cameras everywhere, and then
Charlie says, you go to a cop and say, my
brother committed this crime, and they may ask do you
know the gun that was used or did you see
your brother do it. That's called secondhand knowledge, and it's

(04:48):
not admissible. Even if he said he did it, you
have to prove it. You have to put the person
at the scene. And he goes through this really long scenario.
Then I'll spare you from Katie asked something that's not
caught on the audio. But Charlie says, Tudo's incarcerated now,
and I know you've been helping out Katie and her family.

(05:08):
Now Tudo's family needs your help. Mom was like, I
don't know what you're talking about, and he goes, well,
maybe this will refresh your memory and handed the paper
to Donna. He told her he had asked Donna about
the man, who she described as polite and well spoken.
Charlie asked if he acted like a thug or did
he talk with a thick Spanish accent, and Donna said no.

(05:32):
Charlie says, everybody in Miami is Hispanic, so you can't tell.
He says, I talked to you on the phone, and
it's like talking to some Maria Maria from West Side Story.
He says, you can pay nineteen dollars and find out
anything about anyone online and they'll be back. And whoever
this is knows information.

Speaker 2 (05:53):
He says.

Speaker 1 (05:53):
They did not mention his name, so they only know
part of the story. He asked Katie when everyone was
there the next day, did any of you take any money.
It's not like you're driving around in bent Lee's or
cruising around in a Magga yacht. Katie mentioned the man
being nice dressed, and then that cuts off right there.
Charlie says, if you go and talk to cops and

(06:15):
you didn't witness anything, you got nothing. Then you wear
a wire and get the person talking, and if you
can get them to confess on wires, then you have
something and you're charging them. That's a confession and an
admission of guilt. But outside that, there's no evidence. Charlie
loves giving scenarios, and here it goes. He said, what

(06:39):
if you run a car and I borrow it and
I go rob a McDonald's and Orlando and I come back.
But what if you were out all weekend and you
didn't know I took the car. The point is I
don't have knowledge of what went on, and evidently this
person is either pretending to or does. But I don't
want someone paying visits to my parents. Again, he says

(07:01):
they did not mention him specifically, but they did mention
your son's ex girlfriend. He says, the direct connection is
who was her boyfriend. Let's go talk to him, not
waste your time talking with mom. He said, it wouldn't
make sense that your connection to my family is me
and not my mom. He mentioned Katie working for the

(07:22):
Adelson Institute. He said it's on the weekend, so he
never sees her, but he does trust she works. Again,
he says he does not want these people coming back.
But if it's the cops, he says, I'm happy because
I have nothing to hide. But if they're a bad guy,
there's two ways to deal with it. One is to

(07:43):
contact the Miami Beach Police Department. Then they'll contact this
guy and talk to him. They'll arrange for things to
be set up, and then they'll bring in the SWAT
team and the FBI and they're going to take this
guy down. And he'll prefer for ten years, because we
have you on tape extorting somebody, and the next thing
you know, this person is singing, and then other people

(08:06):
start singing, and as soon as they have him, he
calls your name out, and then there's gonna be police
at your door, at my door, and then you're gonna
have the big boys flying in to see what they
can come up with, and that's gonna make the newspaper.
Charlie says he wants to give them the money, but
he doesn't want to get involved because then next Tuesday

(08:27):
he's asking for ten thousand dollars. He tells Katie he
wants her to call this person and say, I got
a call from some friends who said you mentioned my
name and they want to go to the police because
they had nothing to do with what you're talking about,
and the name of who is incarcerated sounds familiar. So

(08:48):
I'm gonna give you something as charity to help the
less fortunate, but do not contact these people again, or
they're going to the police. Little does Charlie know this point.
Let them know you had to do everything in the
world to prevent these people from going to the police
because they don't know anything, and I don't know anything,

(09:11):
he tells her to say, I was just called at
five point thirty and I'm shaken over this. They're scared.
I tell them let me. We're going to try to
help these people. But that's it. Don't use anything other
than the words help and charity.

Speaker 2 (09:26):
He says.

Speaker 1 (09:27):
If it's the police, they fed up because they can't
take the money. They wouldn't even come to meet you.
He didn't love Bob's Katie and says he would go
to the moon and back for her, and then he
reminds her he's the kind of person that will ask,
isn't your son's birthday coming up? I got you. I'm
the one who's like, I'll sell you the Lexus for

(09:48):
a very good price because I know you're having car problems.
He says, there's no way Donna is going to call
this guy and giving somebody money is not an admission
of guilt. Charlie says maybe he didn't want to scare Donna,
and he didn't, but just his presence caved. Donna diarrhea
all night long and she hasn't been eating, but she's

(10:12):
been up since two o'clock in the morning with diarrhea.
How do you think that feels with my mom at
sixty five years old, up since two in the morning
with effing diarrhea. Charlie says he's going to give her
a bag with the cash in it. The next call
is between Charlie and Donna. She says she's watching the
boys at the tennis clinic and they're having a wonderful time.

(10:34):
She asked about his day and he said it's good.
He is going to grab coffee with a friend. The
next call, Charlie said he met the friend for coffee
to talk about relationship advice. Donna says she may come
see him tomorrow at his office or another office so
he can talk to her more. He says he gave
the friend good advice and she is sleeping on it.

(10:57):
Charlie said relationships aren't easy, and Donna agrees, but he
tells Donna without a doubt everything is fine. He could
talk to her more and says, if you want, you
can always come down to the office as well. But
you're hanging out with dad tomorrow right. Donna says yes,
they are going to be doing a lot of cooking
and getting ready for passover. Charlie tells Donna he's gonna

(11:20):
bring ten lobsters. He also says that Wendy's boyfriend Dave
will not have his kids there, so it would just
be Wendy's boys, and then he just mentions that his
current girlfriend June, is trying out as a cheerleader or
dancer for the Miami Dolphins. In another call, Charlie tells
Donna that his friend is coming to meet with him

(11:41):
tomorrow and sleep on some stuff and then she'll come
tell him how it works. Donna says, do you think
she'll be okay if everything works good for her? Charlie says, yeah,
Like I was explaining to you, with relationships, it'll go
one of two ways. You also mentioned that she hopes
Harvey has a good at the office because he works

(12:01):
long days and needs sleep. Charlie tells Donna not to
worry about absolutely nothing, and Donna says really, and he says, yeah,
I'm telling you I wouldn't. Donna says, if your theory
is correct, you know that'll be good. But we don't
know that. Charlie says, you have to realize something. It
does them no good. At the end of the day.

(12:23):
There's nothing they're going to gain. And Charlie says, it's
not like you've threatened or hurt anybody. He says, the
thing is they're not hiding who they are. Donna said
that's why her thoughts were different. Charlie says, the whole
thing is weird, and Donna agrees. He says, this is
the kind of thing that could be traced. They could

(12:44):
be easily caught, and they'll easily have charges put against
them for extorting people. And that's like up to ten years.
Charlie says, it could be a lot worse, so let
me reference it to you like that. The next day,
April twenty first, twenty sixteen, all between Sigfredo and Katie,
they spend half the call just bickering back and forth,

(13:05):
But the meat of it is that Katie tells him
he's effing her over. You're gonna tell me I'm gonna
make a phone call, are you? Sigfredo says he's not
making that effing phone call. They go back to bickering,
and he says he's gonna take care of the efing problem.
Katie says, what are you gonna take care of? You
don't discuss anything with me, and Sigfredo says, the less

(13:29):
you know, the better, So he tells her to just
stop talking on the phone and that's the end of
the call.

Speaker 2 (13:35):
Another call with the two of them.

Speaker 1 (13:37):
This call is kind of funny actually, because if you
listen to it, Sigfredo is so confused. But she says
that you have to pay for Ethan's clothes. The balance
is sixty five seventy and I wrote down the amount
you're supposed to put. He's like, you can't pay for it.
She's like, I'm not sure if it's six oh five

(13:58):
seven or six y five seven ozh. And by the way,
the last four digits of the cell phone number on
the bump paper was sixty five seventy, So she's trying
to tell him the last four of the number he
needs to call him. Sig Fredo's like, I don't get it,
but Katie says she can't remember if it's one of
those numbers, and then she reminds him again she put

(14:21):
the amount on the piece of paper. And this is
finally when the light bulb goes off in sig Fredo's head.
She says, there's no credit cards I can use in
his school, so it makes no sense.

Speaker 2 (14:32):
You got it?

Speaker 1 (14:33):
Sixth Fredo is like understood. The next call is between
Charlie and Katie. He asks if she wants to come
by his office because he says he has a bond
side tree that needs printing. He told her he would
be there between eleven and three. Katie says she can't,
she's at work and then she has to get her kids,
and she points out money doesn't grow on trees, but

(14:55):
Charlie says, I thought it did. Katie ask if he's
heard from those people, and Charlie says no, but he
will put another call into them. Katie says she does
not think that would be a good investment. She says
she's been looking at properties and she was asking him
who I personally think it. Sigfredo, would it be a

(15:16):
good investment and he said no, it's just stupid. Charlie says, okay,
now I got what you're saying. Katie says he's gonna
look into a couple of properties to see what's going on.
Charlie says, yeah, you just can't jump into properties you
don't even know. Katie talks about it being like fishing.

(15:36):
You see who bites. Charlie says, yeah, you throw the chum.
But they're all gonna come out think about that, and
they talk about it being too high of a price.
Katie talks about her being in real estate and if
someone offers X amount of money, she looks at listings
and hopefully she gets a lead. Charlie asked what he

(15:57):
who I assumed to be Sigfredo, if he was in
shock that this lead came up, and Katie said, of course,
especially for that amount. Charlie says, he's not really interested
in buying that property. It becomes like a duplex. It's
a headache for life. It doesn't stop. Charlie says, is
one or two things. It's a false lead or someone's

(16:20):
wasting her time. But it'll be like a leech that
never leaves you. Katie says that she needs to make
some phone calls to people she knows that.

Speaker 2 (16:29):
Would need help.

Speaker 1 (16:32):
Charlie says, if you need someone to lend you money
to help out, I don't mind helping you out. Charlie
tells her to print out listings of multi unit family
properties that he wanted to look at, and if it's
just a pocket listing, investigated, but don't print anything out
with pictures or anything. I just need to be sure

(16:53):
we're dealing with good people. The next call is between
Charlie and Donna and they talk about Harvey meeting up
with Charlie. Charlie tells Donna he saw a lot of
police everywhere giving traffic tickets today, so be careful. Then
he says, that's what I think it is, without question
for multiple reasons. Now we know they sent that bump

(17:15):
letter that was mailed to Donna and Harvey's residence in
South Beach. That letter said, my phone is not ringing,
So you don't care about Totto and what he did
for you.

Speaker 2 (17:27):
He knows he's fed and soon so will you.

Speaker 1 (17:31):
Moving on to April twenty fifth, twenty sixteen, Charlie talks
to Katie. He tells Katie he's going to be at
the Icon, which is where Donna and Harvey live. He
said he was standing outside talking to his parents about
everything and talking to them about his day. He says
to do him one favor and come down there. She

(17:52):
asked if everything's okay. He says he wants her to
come down so he could see her. He says, you're
already in the car. Then he where the condo is located.
She said it's stupid for her to go all the
way down there from where she is. He said he
still needs to talk to his parents for another five
minutes and then he's gonna leave, and then he would
come to wherever she is. She asks Charlie if he

(18:15):
doesn't get the calls when she calls through WhatsApp. He
says sometimes he does, sometimes not. There's another call with
Katie just a short time later. She's not sure where
she parked, but she says there's a group of people
in red shirts and Charlie tells her he is standing
by a boat in his scrubs. Then she sees him.

(18:36):
They meet in person, but law enforcement did not know
they were meeting up, so there was no surveillance of that.
There's a call after they meet up from Charlie to
Donna and she asked where he is. He says he's
getting into his car. He asked her if she's still
at Wendy's and then asks if she can talk. He
asks if she wants him to drive by Wendy's and

(18:59):
she says, yes, drive by and Dad will go downstairs
and meet you. Charlie said, okay, I'll drive by. She
tells him to meet Harvey at the gate. She asked
if he actually wants to come in, and he says no.
She says, well, instead of going through the gate, make
a U turn and there is a little park on
the side street and that's where Harvey will meet him.

(19:21):
She asked Charlie, if Wendy does come home, are you
gonna say that you were in the area, and he
says yes. Donna says, then I'll say I just went
down to say hello. In the background, Harvey says he
needs the car keys, and then Donna says that Harvey
will drive back and wait for Wendy. Donna says, I'll
meet you downstairs by the green awning. The next call

(19:42):
between Charlie and his girlfriend June. She's already testified at
this trial. Charlie said he tried to call her ten
minutes ago and she's like, it's fine, she'll just talk
to him later. He tells her that he has a
bunch of things with the office going on that he's
trying to soar out. He says, it's just become I'm
a bigger deal than I thought, So keep your phone

(20:02):
with you. The next call is between Sigfredo and Katie.
She said she needed to talk to him about some
things and he says he doesn't know what.

Speaker 2 (20:11):
She wants to talk to him about.

Speaker 1 (20:13):
The previous call cut off, so after that they text.
The text says, need to talk to you about something.
Sigfredo says, whatever is going on with you and your
homie is your business. Y'all work it out, don't text me.
The next set of communications are related to the bump
letter that was sent to Donna and Harvey's. The call

(20:33):
is between Charlie and Donna. He asked if she feels
better about what he told her last night, and she
says significantly. Charlie said it makes a thousand percent sense,
and Donna says I know it does. She asked if
he thinks today those sort of things will get taken
care of, and he says, oh yeah. Donna says, well,

(20:53):
once they are, would you let me know. Charlie says,
the more he thinks about the letter, when someone writes
down you don't care, you know what, it sounds like
a girl. That's exactly how they sound. Donna asked, Charlie,
have you ever gotten a note from a girl or
a girl saying to you you don't care? Charlie says,
that's the first thing they say. He says, guess what,

(21:16):
I don't care about anyone I've never met. Charlie says
he actually knows how these things are done, and it's
not like this. Charlie says it's forty eight hours and
Donna says, yes, just enough time. Another call Donna and Charlie.
Donna asked Charlie if he checked the phone number she
gave him last night. He tells her yes, everything's fine,

(21:38):
and then he asks about Harvey. Donna says he's not
feeling well because he didn't go to sleep until five
thirty in the morning. She got up an hour later
at six point thirty and Harvey looked at her and said,
I can't. So she goes through how he rescheduled appointments.
She can't remember a night. He didn't go to sleep
until that late. He can't function like this. Charlie asks,

(22:03):
did you tell him what I told you yesterday? Donna says, yeah,
it sounds like it'll be fine. He says, what you
worry about is when you don't know, and Donna says,
it sounds like this company usually fixes those bridges pretty quickly,
so they should be And then Charlie interrupts and says,
stop with the effing nonsense, because I really don't want

(22:26):
to come down there anymore. I need to distance myself,
and Donna says right. Charlie says, if you know who
it is, it's a very easy one. But you guys
are notorious for always getting worked up over everything. As
long as I've known you, everything's a big deal. You
gotta get worked up about everything. This is no different.

(22:48):
But I'm telling you to stop because it's not anything more.
And Donna says, okay. He tells Donna, you didn't do
anything wrong. Somebody's fishing. Let them fish. They I know
you don't have nothing to do with anything. Donna says,
as long as you tell me this is being taken
care of, I'm fine. Charlie says, as best I know,

(23:10):
it's being taken care of. He goes back, you get
yourself all worked up and all effing crazy and it
has to stop. Donna says, okay, well I just had
to talk to you, didn't I I mean, was it
that important that I contact you. Charlie says, but you
were like, Dad's not going to work today, and Donna says, well,
he said he was after we spoke last night, and

(23:31):
then he never went to bed, so that was the problem.

Speaker 2 (23:34):
Charlie tells Donna she.

Speaker 1 (23:36):
Is getting a little better in time, but she got
Harvey all worked up. Donna says, I'm trying. I'm not
a kid, and then she says, I mean you probably
watched too many movies. Charlie says, it's not like we'll
get one of them and then the other will just
start paying. It's the stupidest thing I've ever heard. It
doesn't work like that. And Donna's like, I know you

(23:59):
told me all this yesterday. I know I understand what
you said, and I got it. I got it. He
says there's nothing to be concerned about. Everything is so traceable,
especially with electronics and the other thing. Charlie says, I'll
let you in on a little secret. If someone doesn't
want you to know what they look like. They wear

(24:21):
a hat, they wear a glasses, they put on a
beard from a five dollar costume store. You can go
buy an Abraham Lincoln beard and put that on. You
would wear gloves and a hat like everybody else on
South Beach because it's really sunny outside. You didn't do
anything to anybody. They're not going to go through the
amount of planning and stress and logistics and risk because

(24:45):
some things generally have happened. There's nothing you have to
worry about. This is being looked into. And Donna said
it was important enough that she needed to speak with him,
and Charlie says, yes, I spent my whole effing night
down there live night. Dona's like, I get it. I
just want you to go home and have some peace tonight.
