Pride Month is just about here and with certain political parties and states attacking the rights of my people, I feel the need to take the time to share stories from my community during June. Angie Zapata was a brave trans woman whose life may have been cut short but that doesn't mean she couldn't do something major for the LGBTQIA+ community. Originally broadcast November 2, 2023.

time this airs, who knows,Pride Month is over. But I still
want to share with you stories ofmy community because they're so important. Never
in my wildest dreams did I everimagine having to use these stories to fight
the Supreme Court. I mean,hello, you helped band abortions on everyone,

including children, and now you're planningon making my marriage illegal. Remembering
season one when I talked about theDudler of San Francisco and how back then
it was illegal to have gay sexbetween two consenting adults and just how absurd
that seemed. Yeah, well wemight just be back to that point,

spin, I mean, he'd probablylike it. Of course, as usual,
I'm getting off topic, right,history and making its subjects proud.
When thinking about today's protagonist, AngieZapata, I was conflicted about how I

wanted to portray her. I mean, she lived very much as a woman,
using she her pronouns and not herbirth name. Angie was all woman.
I considered an approach like The ShareShow, which was a musical I
was privileged enough to see back intwenty nineteen, they bypass SHARE's son,
Chaz, being born biologically female.So do I do that with Angie?

Make her Angie from birth out ofrespect? And then I thought about the
whole point of why I'm doing thisstory. Transgender individuals were once not considered
a group protected under hate crime laws. Angie being born male is incredibly important
to the story because she is transgender. Today's story, as she'll soon here,

and I want it to be superclear that this is not out of
disrespect to Angie or members of thetrans community. I'm telling her story and

The prosecution has not made it clearwhat mister Androwde's intent was if he had

killed Justin. Was it because Justinwas choosing to be a woman, or
was it because he lied to Allenand those comments in prison, Those were
not homophobic remarks. It was misterandrow Day's way of joking with his girlfriend

about the fact that he was injail for something he didn't do. I
think it's important for everyone to knowmister Androwde is not some kind of monster
as some have portrayed. He isa good person and has feelings and he

does care. He does have alot of people who care about him and
he does care about them as well. Please remember that as you deliberate,
and I urge all of you toconsider a lesser charge for this man,
spare him life in prison. Thejury quietly filed out to deliberate. Brandy's

palms moistened as she began to worrywhether her team had done enough to show
the jury that this was a hatecrime. Up until this point, it
seems there had only been one instancean attorney attempted to file their transgender clients
murder as a hate crime, thetwo thousand and two murder of Gwen Arajo
in California. Attempted to make hermurderers guilty of a hate crime, but

although they were found guilty of murder, the jury decided it was not a
hate crime. For Angie and Colorado. If this jury decided that Alan was
guilty of the murder and it wasdeemed a bias motivated crime, history would
be made. Your honor. Weeither jury found mister Allan and Dry guilty

(41:10):
for first degree murder, aggravated motorvehicle theft, identity theft he had used
Angie's credit cards to pay for gasmultiple times, and bias motivated crime.
Thank you mister Andrade, for firstdegree murder, I have to give you

(41:32):
a mandatory sentence of life in prison. But as you know, the prosecution
earlier filed habitual criminal charges against you. This was just in case the jury
found him guilty of a lesser crimethan first degree murder. The prosecuting attorneys

(41:55):
knew that habitual criminal charges would quadruplealan sentence. If they couldn't get him
life, they could come pretty darmedclose. Looking at your records, it
is clear to me that you area habitual criminal, which means for identity
theft twenty four years, vehicle thefttwenty four years, hate crime charges twelve

(42:22):
years. For those counting, that'san additional sixty years. Angie's story is
an extremely important one for us totell, since this was the first time
the murder of a transgender victim wasconsidered a hate crime. As I'm writing

(42:43):
this, it's July of twenty twentytwo. Abortion has been turned over to
the states to decide if they wantto ban it or not, and our
super Christian Supreme Court wants to considermarriage equality this upcoming fall. Now,
I don't know what the future holds. I hope to God that it's nothing
but good things, but right nowit all feels really negative. Right after

(43:07):
Angie's case in October of two thousandand nine, then President Obama signed the
Matthew Shepherd Act into law, whichrecognized gender, sexual orientation, and gender
identity to federal hate crime laws.This bipartisan bill passed Congress in two thousand
and seven, but then President GeorgeW. Bush threatened to veto it if

(43:27):
it passed, and the law wasdropped. Growing up with a super right
wing Republican mama, I didn't understandwhy people thought Georgie Porgie was incompetent.
I get it now. At thattime, groups like Focus on the Family
were basically saying that hate crime lawswould create a special class of victims and
affect people's freedom of speech. Now, I interpret that to mean that they

(43:52):
were afraid hate crime laws would endpeople killing someone like Angie because the murderer
would get a heavier sentence, andthat therefore meant people weren't able to make
a statement of hating LGBTQ plus individualsby murdering them. I could be wrong,
but that's just how I interpret it, and that is disgusting. I

(44:15):
also want to point out just howfrustrating the defense team made me while I
was researching this story. Annett Kundeliushad no shame in using Angie's dead name
or incorrect pronouns, and tried tomake Alan out to be this kind man.
At one point in the trial,her team even went as far as
saying, at best, this isa case about passion. When Justin smiled

(44:38):
at him, this was a highlyprovoking act and it would cause someone to
have an aggressive reaction. This typeof defense tactic became known as the gay
panic defense, meaning the defendant reactedso violently because they totally lost control of
themselves due to the victim's sexual orientationor gender identity. In short, victim

(45:02):
blaming, I suppose a net andgang would also argue that victims of rape
wouldn't have been sexually assaulted if theyjust didn't wear skirts. For those wondering
where this lovely woman is today,don't worry. In twenty nineteen, she
was appointed a judge who presides overdomestic relations, dependency and neglect and adoption

matters in Division two in Weld Countyrad on the plus side. In twenty
twenty, Colorado became the eleventh Stateto ban the LGBTQ panic defense in the
