all the other great stuff to comeon here to talk about what you got
going on and all the other greatstuff. So welcome to the Walking This

Excuse my voice. I'm a bitunder the weather, but I still
want to be here and let folksknow about election, election season, campaigns,
judges, whatever we're here to talkabout. So I'm happy to happy
to join you and I appreciate itonce again, and let's talk about you
have a very repressive resume. Ofcourse that LEDs you up to this point
(01:27):
where you run for judge. Sogive us the background of who Mark Clayton
is to the point where you're runningfor judge. Now, I know you
have a lot of great experience thatbeing you up to this point, So
take us to the beginning on howthis resonated that came about and decided to
run for judge. Okay, sobeing a lawyer is actually my second career
(01:52):
I started. I went to undergradand I got my bachelor's degree in math,
and I went and worked with retirementbenefits for a while before I went
back to law school. And actuallywhen I went to law school, I
was my goal was to be asports and entertainment lawyer. But when I
got to law school, you learnabout all the different areas of law,
and so family law and criminal lawreally resonated with me, and I felt

like they were the most rewarding areasof the law in that you're helping everyday
people in everyday situations and just beinga voice to the voiceless. And so
that's how I got in this realmof the law. I prosecuted down in
Hood County. I was the first, first and last so far, there's
(02:36):
not been another African American prosecutor downthere in Hood County. But my experience
there was great. I mean,I got in day one and was in
a trial the next week. Thecounty attorney that hired me was really amazing
woman, Lorie Casper, and veryeducational, and so she taught me a
lot. And from there I openedmy own practice and that's what I've doing
(03:00):
since prosecuting. So I litigated familylaw cases and now I'm strictly focused on
criminal defense. And so yeah,that's kind of that's my background in a
nutshell. And I like it becauseyou're doing something that you love to do,
You're doing something that you're passionate about. What is that feeling to wake
(03:21):
up every morning that you're doing somethingthat you love to do and you're not
dreading it, you're not hating andyou're not resisting it. But you're getting
up every morning knowing, Hey,I'm doing something that I'm created to do.
It's a wonderful, wonderful feeling.I told almost anyone that this conversation
comes up, I've definitely found mypassion. This is not again, this
(03:43):
is not anything that I This wasn'ton my checklist as a kid. What
do you want to be when yougrow up? Being a lawyer or a
judge was not on the list.It's kind of come to me just walking
in my path and walking in hisways. But now that I'm here,
I've definitely found my passion. Andit feels great to get up and help
(04:04):
people who are in really tough situations, the most intimate times of their lives,
and you're able to assist them throughthose trials. Like it's just it's
it can't really describe it, butit's a wonderful, wonderful feeling. Right.
And I know what have been oneof the major concerns that you've been
(04:24):
hearing as you've been on this campaigntrail. So the number one concern that's
facing Terran County criminal courts right nowis the case backlog. And it's like
a trickle down effect. So thesecases are backing up. Some cases are
taking three, four, sometimes moreyears to resolve, which is causing a
(04:45):
crowding issue in our jail. Wehave four jail facilities in Terran County.
They're all at capacity. We've spentforty million dollars sending inmates to a private
facility three and a half hours awaybecause our jails are full, and that
in its is a problem because weare putting money in a private jail facility,
which we know those are created topath the pockets of whoever those owners
(05:08):
are. And it's also causing safetyand security issues in our jail. We're
losing a lot of people. Justas of Valentine's Day, we've lost sixty
one people in the past few yearsin the jail, and that number is
pretty high, but it all tricklesdown. It's dealing with the safety and
security issue because there's not enough folksto work the jail. And so if
(05:30):
we were moving cases effectively and efficientlythrough the docket, ensuring that these cases
are being resolved, we can seea little bit more help there in the
jail and making sure that our jailsare not being backed up and crowded with
folks. Right, And I knowthat is a big issue that is going
on with the jails being overpopulated becauseI am in that field. I am
(05:51):
in the facility while working Dallas County, and I know that you know you're
dealing with them on a regular basis. The overpopulating a lot of people who
are with mental health, you know, homeless situation. So we have a
lot of those that are incars rateand their homes and got a lot of
menity issues have that been coming upas well. Absolutely a lot of people
(06:14):
are in jail holding for to upwardsfor two years to go to a mental
health facility. And if you imagineif we actually reallocated the resources that we
have, if we spent forty milliondollars trying to create a mental health facility
here in Tern County instead of fundinga private jail three and a half hours
away that doesn't have the proper trainingor where we ought to care for our
(06:38):
individuals. And so, yeah,mental health people are being jailed for mental
health issues. They're being jailed forbeing homeless or being in poverty, and
that is an issue with our criminaljustice system. We can't punish people for
having a mental health issue or beingimpoverished. And you see that a lot.
I'm running for a felony court,so the type of cases that you
(07:00):
would generally see what those two issuesare missed, probably misdemeanors like a trespass
or something like that, so Iwon't really have a hold or a way
to affect change right there. However, just as a felony judge, I
am able to make sure. Andone thing that I'm adamant about doing is
making sure that I am evaluating bondconditions and making sure that individuals bond conditions
(07:27):
are matching up and their bond amountsor matching up to not only what's written
on the paper, but the presentcircumstances of the situation. And so we
have to be keeping a track.The judge has to monitor his docket,
his or her docket, the numberof individuals that's in jail, how long
they've been in jail. Is itsimply because they don't have the money,
Because we're not supposed to keep folksin jail just because they can't pay to
(07:48):
get out. That creates a disparitybecause if you have money, you can
just be out here walking free onthe street. But if you don't have
money, that you've got to sitin jail. And so those are things
that I am very adamant about ensuringthat I'm taking a closer look at Yeah,
because it is so we have alot of people, honestly, lot.
We have individuals who are sitting there, just be sitting there home.
(08:11):
Uh was it five hundred dollars andthey don't have it and they just sitting
there. And how much are wepaying to keep them there per day?
More than it would cost for themto pay to get out? Right?
Yeah, we we just need morepeople. And that's that's willing to look
past the paper and actually be morelogical in the current situation. Right.
(08:37):
And we know that when there's aa's a problem, there's always a solution,
you know, and a lot oftime interview focus more on the problem,
problem, problem, But you haveto have individual like yourself to bring
a solution that the Theeds can theykilled. I know you mentioned the jails.
You know, no understaff, youknow, underpaid. You know you
have a lot of officers. Iwork in the facility, so I know
(08:58):
how how it deal is where you'redealing with people who are stressed. You
know, it's a dangerous ironmentn't gettingwrong? You know, once I put
that uniform on, I go behindthem walls. You know, my life
is on the line. But butyou have people who are understand we know
it is shortest ain't gonttle. It'sthe shortest of dso it's shortest of the

CEOs within the jails. So you'redealing with a lot of over time.
You're dealing with people who are Idon't want to want to go home,
but can't go home. You haveto have stillity for twenty four hours,
which that's how it is, rightand so it's just compounding your stress,
the stress of the individuals that's injail on top on top on top until
it can busts. And that's theproblem that we need to eradicate it.

Even imagine if we spend forty milliondollars paying our our officers a little more
to do their job right. Mostly, I mean most definitely, because like
I said, it's always work tobe done. And I'm like this,
it's all about twenty in one thousandpercent in which you do. No matter
what you do, I always wantto put in thousand percent. I always
want to have a positive attitude.I always want to be upbeat, always
(10:05):
envisioned. Okay, what I wantto do when when you go to your
place of employment, what can Ido to make change? What can I
do to implemit that everybody could benefitbe edified an upbeat and that's what it's
all about, having an upbeat attitude, that positive mindset, knowing that hey,
I'm here to make a difference,I'm here to change the atmosphere,
(10:28):
and just knowing that I'm just likethis. It's all by putting in one
thousand and what you do and Iknow you're putting in one thousand per cent
and what you're doing as well,and just with the networking mean people,
how has that journey being for you? As you know, you on this
path of greatness? And I saythat loosely. On this path of greatness,
(10:48):
I've been meeting a lot of peoplealong the way. And one of
the things that I do want tobe sure that I'll be incorporating into my
core is the network of individuals whoare out here, who have programs already
getting grant funding to help individuals whomay be accused of crimes, or going
through the criminal justices to help findingjobs at the end of the day,
(11:11):
you know, going through some typeof training or trade. That's the type
of information I want in my court. So it's also a place, so
I believe a court should be theplace of resource and not just punishment.
We're not here just to punish people. We want to try to make people
better see what they actually need,so that we don't have to see them
again. Usually there's something that's creatingthe problem that spirals into this vicious cycle,
(11:33):
and if we can try to eradicatethat problem, maybe we won't see
this individual back in court again.And so I want to be sure that
I'm partnering up with different community organizationsand programs that's able to help an individual
move their life along. So it'sbeen great just meeting people, networking,
showing up. Okay, my dogis crying, but yeah, showing up.
(12:01):
Yeah, because we are dealing withlitterry, repeat offenders on the regular.
It's like we're evolving though, becausedeal with a lot of a lot
of repeat offenders as well. Andthat's why I think one of the major
ones also do what you repeat offenders? Yeah, Orio wants to say hi
hello, All right, okay,but yes, and that's the goal we
(12:24):
don't want. We don't want repeatoffenders. And the reason why people or
I wouldn't say it's always the reasonmajority of the times, the reason why
people repeat is because their circumstances didn'tchange, right, that's true. That's
true. They play plopped right backinto where they were at before. That's
true. And that's and then,like you said, having things implemented in
(12:46):
place, and I know that peoplehave paid the debt to society. You
have people who do want to change. I know, we can't know.
People will put everybody in the samecategory. I don't getting wrong. You
have some buttholes, don't get mewrong. But you had people who did
make up a three sixty who wantsanother change, who wants to take another
chance society, but about things beingon their record holds them back. What
(13:11):
can you say to an individual whowants to make that who has made that
change, want to do things theright way, but there it's kind of
hard because they have that thing ontheir record. Yeah. So that that's
another thing, a part of theeducation that'll come out of my quarts,
ensuring that the individual is aware ofthe collateral consequences. A lot of times
(13:33):
I come across people that think,oh, you know, my lawyer said,
if I do this, I canstill get this off, and it
turns out that they actually can't.So they had been misinformed and so people
with felony convictions. Unfortunately, asthe law stands right now, you'll never
be able to get that off yourrecord in Texas. The law could change,
it is ever changing, but asof right now, you can't.

And so that's a legislature issue.That's where you have to be voting for
legislators who are willing to write billsor submit bills that has something that may
allow you to get that off tenyears, fifteen years, maybe twenty years.
I mean, stuff from the eightiesand the nineties is still holding people
back simply because it's on there andit's not really fair. It's a totally

different person, but you're still beingjudged on what you did when you were
nineteen twenty twenty one now you're fifty. And so that's where we have to
get out and vote for good legislatorswho are willing to not only write and
submit bills, but vote on themand galvanize other legislators to vote on those
(14:37):
type of bills. I'll give anexample. Dwys it had been the law
that you couldn't get a DWI offof your record because it was a conviction.
Well, that law changed in twentyseventeen, you can get a first
time DWI off of your record now, or at least a non disclosure on
it where you don't have to tellan employer or the general public at all
about it. And so that's anexample of how the law could change.

And so it can change. Butwe have to get people down in Austin
that toiling to make that change.Hey, that's it, lady JOm.

out there and make the changes.Don't complain about it. Get out there,
imforment the change. Take that firstup. There's no subtin it.

know it's because these courts are backedup. This is a problem, but

million was spent on guards of thecounty. So I wish I'd been able
to say the forty million makes itmore impactful. But factis facts. It's
out there. But that video,honestly it it turned out so powerful.

I the vision that the script thatI gave him, I could not have
envisioned how that it would turn intowhat he come up with. But I
believe in divine intervention and purposes andthings like that. The way it even
came up with that was kind ofdivine. But yeah, it really lights
me up every time I see it. Well, you know, it's a

blessing, and I applaud you.I give you your roses right now,
thanks for what you're doing. Youknow, I just we had not I
had not met, we had notmet physically, we met on social media.
But I just give you a rosesbecause the Bible said give honest wants
do So I'm just giving you honorfor what you're doing. It takes us
very special individual as yourself to dothis kind of work, you know,

work within the community, dealing withdifferent personality from different walks of life,
and at the end of the day, they come into your courtroom and where
you have to make the decision onwhat the term is their faith that if
that's the correct way to say it, if you want me to say it
that way. So, I mean, what what's go what's gonna make it
different? For you when you putthat robe on. That what people that's

gonna see. That's very different aboutjudge and I said loosely, Judge late,
I receive all of that. Theone thing I want to make me
set me apart from other judges isthe compassionate part of what I said,
especially I said in this video eventhough these these are like the toughest the
(19:22):
dire situations that an individual face.And it makes my skin crawl when I
see a judge the meaning an individualor being disrespectful sarcastic, especially in these
type of situations. They're so preciousto me, and in my eyes,
I'm thinking, you're not putting yourselfin this individual shoes. We've all made
(19:48):
mistakes. The people that come tocourt are the ones that got caught making
their mistake true, and they shouldnot be treated any different than any other
person that steps into the court room. And so that is one thing that
I want to make sure my courtis going to be a court of compassion.
(20:08):
That does not mean slap on thewrist, get out a jail free
card. That simply means treating everyperson with dignity and respect. You can
go on, tick, I justsaw video that I was gonna stitch on
TikTok of a judge, an AfricanAmerican male judge, demeaning an attorney and
(20:29):
then threatening to hold her in contemptafter he repeatedly didn't allow her to answer
the question he asked. And it'sjust the power and authority that goes to
the head, and just because youcan doesn't mean you should. So my
court is not going to have thatthat type of stereotype that people will know
(20:55):
that CDC two is going to bea court of respect, dignity and respect
for all people. Been seen incourt where a person is lost. They
come into the courtroom just trying tofigure out where they go. The computers
are here, a deputy can helpyou. Any person sitting in here with
the computer can help you find whereyou're supposed to be. And they will
turn them away, send them toanother floor the clerk's office to figure out
where they're supposed to be, insteadof helping them when they probably just need
(21:18):
to go next door. Yeah,that's bed. So that those are the
type of things like that is completelyunacceptable to me. And so the court
that I will preside over, thestaff in my court will all exhibit the
same type of heart and compassion thatI am expecting. Yeah, and that's
(21:41):
I'm glad you brought that up.I know. And notice why people ridicue
other people now, I ain't gonnalie. I see individuals who call them
all but the child of God andthe people fish because in a visually has
a simple question, but they'll blameme, blame, blame, blame,
blame, blame, blame, allcrazy to these individuals when they just ask
(22:03):
a simple question. And that's wedon't want people in fear the decisions that
we're making in court is going toaffect their future. They need to understand
the decision. They need to understandwhat they need to do. You don't
need them up there blacked out becausethey're simply scared to just be standing in
front of you. They need tofeel free to ask a question if they
(22:27):
have a question. To make sureall of my clients now they know when
you get up there, if youhave a question, well I ask them
to ask me the question first.But if you have a question, make
sure you ask it. When you'remeeting with probation, make sure you ask
whatever question you have because this isgoing to dictate how your case ends.
(22:48):
Whether you understand everything that's going on, if you're going to do it right.
And so we don't want people infear of taking care of their business.
So yeah, yeah, and well, and I know that it's a
lot of work. It's a lotof work. That this is not an
overnight thing. It's not gonna getcleaned up overnight, and we know that.

But we know it's gonna take timeto get loud things clean up.
And it takes the right interview asyourself to better clean up the things that
need to be cleaned up. Becauselike I said, that's that's a special
seat to be a judge to dealingwith these people's faith, their future and
what they're dealing with with their face. And I know it's I know trouble
(23:30):
is easy to get into, butwe know it's hard to get out of.
And you got people right now whoare fighting for their freedom, not
saying they did anything. You gotsome people who are in got caught up
and with it said or whatever,but they are fighting for their innerges.
Yeah, it happens all the time. I had a case today that was
(23:51):
just gotten hired on it. Thiscase was spiraling out of control unnecessarily and
we were the case today. Itshould have been resolved a long time ago.
You know, I don't know whatwas going on there, but this
particular client was about to have tobe in over his head about three or
four hundred dollars a month or oncondition that did not line up with the
(24:15):
offense that he was charged with.And it was just spirally out of control.
And it's like, who's going tolook and say is this you know?
Does this case warrant this? No? So why are we here?
But those situations happen. And soto your point, when you get in
(24:36):
trouble, it's hard to get outof it. You make one wrong step
and yeah it's good, goes down, Yeah it does. And I know
you got the end of the campaignis going on as well, so I
can though support you. How canit be involved? How can it flood
again? And where can it go? So please follow my social media I

gonna have to vote two to threetimes to get your candidate in because if
there's a seat, which we havea few seats that are contested by three
or more people, has to havea runoff. That old current May and
then you come back and vote inNovember to finally put the person you want

in their seat. So we geta lot of voter fatigue, but please
don't give up. Please stay diligentand keep your eye open for elections and
vote every single time there's an election, go and vote. And that's and

where you have to vote at theone that's by your house, so you

transition who may move here in TarrnCounty who may not know got their information

pluggy. That makes sense when I'mplaying, like go ahead and stuff vote
situated. You wouldn't be able tovote this time. But there's going to
be local local local elections in May, which is a city council, school
board, which they're trying to plaguethose out, So want to make sure
to show up on the school boardand city council elections. That's inmate.

So if you get registered now youcan vote in those and then for sure
you'll be able to vote in November. So yeah, still get registered.

so going to her tournament, andthen my son plays football, so

my family. So just hanging out, cooking out. I was just went
to you, how great, sooh man, But yeah, I'm really
a family friend oriented. So justhanging out with people that no one loved
me. And another thing that Ilove to do for myself, and I
encourage everybody to make sure you're doingself care. So I'm a son.

First, I getting massage, shakeit down off for work, massage,
get your nails done and just relaxed, sleeping, go out to eat,
and just only focus on you,no work and none of that, you

We operate on a different solar system. We operate on the Kingdom mindset

He used everybody, He used Moses, Abraham, he was everybody. Yeah,
