let's start with you give me alittle backstory at what we are looking at
today. Sure, so let mestart at the end and then I'll go
back to the beginning. On Friday, March fifteenth, that's a week from

this Friday, there is a hearingin Rhode Island. Public hearing being conducted
by the Rhode Island Department of Healthas part of their effort to implement a
school mask regulation in the state ofRhode Island. This is the culmination of
a twenty six month lawsuit we filedback in August of twenty twenty one,
(31:22):
when the governor instituted an executive orderthat was mandating all children in all schools
wear masks. When he realized thathe probably didn't have the legal authority to
do that and was going to bechallenged, the Rhode Island Department of Health
came to his rescue and issued anemergency regulation that mandated school masking for all
(31:42):
children in K three twelve in RhodeIsland. And there's some some legal problems.
I think many parents would say thatthat regulation was bad policy that was
unlawfully enacted. There was bad policybecause a lot of parents are had a
full school year under their belts withmasking and had seen the impact that it
(32:02):
was having on their children academically,socially, emotionally in terms of the way
it was impacting their personalities. Sothey knew it wasn't a great process,
and the Department of Health really hadn'tcome forward with anything compelling to prove to
us as parents that this masking measurewould actually do anything to stop the spread
of COVID, And so that's thebad policy part, the unlawfully enacted part
(32:28):
as I lived through earlier. Thegovernor really, you know, by including
his own counsel, really was outover his skis, and it exceeded his
statutory authority by issuing an executive orderon this. And we also argued that
the Department of Health had kind ofmisused the emergency regulations. The emergency regulation
is supposed to be enacted when somethinghappens suddenly and they don't have time to
(32:52):
respond and put a formal regulation inplace, and the emergency regulation is designed
to give them six months to geta permanent regulation in place, and so
there's an immediacy there. What theydid was wait sixteen months after the pandemics.
So if the pandemic started in Marchof twenty twenty, they waited until
April of twenty twenty one to enactan emergency measure unmasking. And so we
(33:15):
argued that they were playing games.They were trying to get around the typical
rulemaking or regulation setting process by pullingthe emergency level lever sixteen months in and
so what they should have done theyhad sixteen months to put a permanent regulation
in place. They never lifted afinger to do any of that, and
so we challenged that. We wenton for twenty six months with them,
(33:37):
and then on the eve of goingto trial, which would have involved going
through the discovery process, which youknow, if you're being sued, is
generally not a great thing because you'vegot to produce a lot of documents and
a lot of testimony, they finallycame to the settlement table and said,
well, what about if we wentthrough the normal regulatory process, did all
the transparency stuff that we're supposed todo, and propose the regulation. And
(34:00):
you know, we agreed that thatwas that would be good enough. And
they now find themselves in the positionwhere they've got to propose this rule into
very stiff public opposition, and wecould use more public opposition, and we
can talk about that a little bitlater in the in the interview. And
they still don't have any compelling scienceprove that masking does anything to stop the
(34:24):
spread of covid RSV, the fluor any respiratory infection. Just clarify,
you don't have to wear masks todayin Rhode Island. I just want to
make sure everybody understands that, sonobody's wearing masks go ahead, please now,
go ahead, risk, go ahead. Nobody has to wear a mask
(34:45):
today. The emergency regulation has expired. What we found during the course of
legal filings back and forth is thatRhode Island Department of Health tried to say,
well, this is not an issueanymore because there are no masks on
the children, and we said,okay, that's great. So you're saying
that there'll never be another mask mandateand they said, oh no, no,
no, well there's no mask mandatefor now. But they were trying
(35:06):
to reserve their right to do itagain in the future without any kind of
formal regulation, but just kind ofby seats or by whatever whim they were
on that day. And we said, oh no, no, absolutely not
want to. You want to dothis again in the future, you need
to put a rule in place,and you need to go through run through
the regulatory gauntlets to make that happen. And that means getting public input and

looking at scientific evidence to prove thatwhat you're doing is appropriate. There's not
one piece of scientific evidence that sayswearing a mask does anything correct. I
haven't seen it, Madelina. Canyou give me your background a little bit
if you don't mind no, notin the elite. So I'm actually a
public school teacher. I teach inhigh school locally and Rhode Islands. I
(35:49):
also have three children in elementary school, so I was experiencing this from multiple
ends. As a teacher, Iwas watching what it was doing to my
students. My own children were experiencingit, so I saw how detrimental it
was to them physically, emotionally,socially in terms of their language acquisition.
I'm a world language teacher, andso I saw the damage it was doing

very quickly, and I realized thatthe Department of Health had absolutely no interest
whatsoever and looking into the effects thathad on children. And as twenty twenty
one progressed, when we saw thefact that our children were not being released
from these mandates even when the restof the state was free, and we
had incredibly low transmission rates. Youknow, back in June of twenty twenty

one, we had a heat waveof ninety five degrees and we don't have
air conditioned school, so our childrenwere in one hundred plus degree weather,
spreading and mass when we had atransmission rate of zero point three percent.
So it was just really alarming thatthis was happening to children, and no
one was advocating for them, andso I wanted to partake in this lawsuit
when I found out about it inthis March fifteenth date. Tell me a
(37:00):
little bit about this, guys,what's the importance of this. So we
are the only state in the entirecountry who's currently attempting to implement regulations for
future masks mandates. So we're kindof the front lines right now. What
happens in Rhode Island is going toaffect this happens in the other states.
So it's very, very important thatpeople show up to represent the opposition to
(37:22):
this and the way it's hurt ourchildren, the lack of science to support
it. Now is the time tofight them, because if we lose and
there's a recommendation, if there's aregulation in Rhode Island, other states will
be more vulnerable to this. Sowhat you're saying is specifically, this entity
wants to decide who, what,where, and why someone or some people
(37:45):
would be forced to wear a mask. Is that correct? That's really the
crux of it. They would loveto have the discretion to do as they
please, when they please, andthis regulation is now you know, if
they put it in place, willbe on the books and they will have
to follow that regulation. This isdesigned to put some controls around what they
(38:08):
can do in terms of masking.And you know, had we not gotten
them to do this, we wouldhave had additional you know, emergency orders
and you know, mass mandates ona whim whenever they felt like doing it
or whatever, you know, ateacher's union, you know, felt like,
you know, they're people needed tobe you know, protected for some
(38:30):
airborne illness. So it's very,very important that people show up and push
back on this. Who makes thedecision, I'm sorry, who who'd make
that decision? The Board of edor who made normal So the normal course
of one of these public health regulationsis they have an idea, they draft
(38:51):
a regulation. That's where we areright now. It's been put out to
the public for review and comment.And so now any in the you know,
in the general public can go pickup a copy of this draft regulation,
read it right in, you know, by an email to say,
look, I don't agree with this, I think it's a terrible idea generally,
or I don't like this aspect ofthe rule, whatever the case may
(39:12):
be. And then we can alsogo to a public hearing to you know,
give our thoughts on the rule.They then have to take all of
that that input that they get,go through it and respond to it,
and where necessary or we're appropriate,they'll make changes to the rules. So
one aspect of this rule, andit's in the draft rule, is that
(39:34):
they will decide what studies they useto determine whether a mask mandate is appropriate
in a given situation. Right,and we all know how well that went
when the CDC was putting out junkscience, you know, to support these
measures back during COVID. They willdecide which with science that they want to
use. They will decide how muchweight to put on different studies, and
they've given themselves enormous discretion in howto how to evaluate this. So one
(39:59):
of the things that I'll be pushingback on is, hey, we need
a lot more guardrails in place,and you need a much tighter process for
determining how you decide which studies you'regoing to use and which ones you're going
to discard. And by the way, what are the qualifications of the person
doing this analysis? Right? Isit an epidemiologist or is it some flunky
intern ultimately, who makes the finalcall, the final decision on this,

It'll come from some unnamed bureaucrat bureauaccountability, so that they can't trace it
to. And that's one of thethings that I want to push back on.

For one thing, they went silent. Our kids just stopped interacting with

kids can't learn language if they can'tsee my mouth. Because these are words
in a foreign country, in aforeign language. They don't know how to
save them in the first place.They don't know how they're spelled. If
they can't see how I'm pronouncing them, They're not going to acquire this language.
They're not going to acquire the termsthat they need. I noticed one
day, the very first day thatmaths came off of our faces. It

was March seventh. I asked thequestion, and I realized three or four
of my very quiet children, whonever interacts with me in class, were
mouthing the correct answers to themselves.And it was the first time I had
seen their faces all year, andI was able to call on kids who
had never interacted before. And youknow, we had I had an incident

just a week ago where I hada student introduced themselves to me. I
had him as a student three yearsago, and I didn't recognize him because
I'd never seen his face. Andso there's so many teachers that they think,
God, that's over, let's nevergo back to that. There's been
no acknowledgment from the Department's Health asto how this affected our children. Even

their own class benefit analysis is strictlyfinancial. They're not looking at the cost
of children for doing this. Yeah, that's amazing what that whole COVID scare
was. Just it's remarkable how wehandle it and how bad we handle it.
