It’ll be a “fight like hell” if President Donald Trump nominates a Supreme Court justice to replace the late Ruth Bader Ginsburg, Sen. Sherrod Brown predicted.
The Ohio senator predicted that Republicans controlling the Senate, including Republican Leader Mitch McConnell, “can put another pro-corporate special interest judge on the Supreme Court.”
Brown feared that the Supreme Court nominee selected by Republicans would get rid of Affordable Care Act restrictions barring denials of insurance coverage to patients who have pre-existing conditions, as well as the landmark Roe v. Wade decision, cleveland.com reported Wednesday (September 23).
“Trump and McConnell couldn’t get this done legislatively, to wipe out the Affordable Care Act, but they can do it through the court system, and they’re about to do it as this nominee goes through,” Brown said in a conference call with journalists. Instead, Brown erred on the side of waiting until after the November election to select the next Supreme Court justice, which Ginsburg said she wanted before she died September 18.
Although, cleveland.com noted, Brown also said it was “markedly different” when Justice Anton Scalia died in 2016. That was in February, months before the November election and before either major political party selected a nominee, he said.
Trump is expected to announce a Supreme Court pick on Saturday (September 26).
