Maricopa County Attorney's Office Will Dismiss Marijauana Charges

A week after Arizona voted in favor of legalizing recreational marijuana, the Maricopa County Attorney's Office announced that it will dismiss all pending and unfiled pot possession charges.

This also included "associated paraphernalia charges," the MCAO announced on Monday.

MCAO also said that priority will be given to people who have court dates or who are in custody for marijuana-related crimes.

The state voted in favor of Prop. 207 60% to 40%. Prop. 207 gives adults over 21-years-old the ability to legally posses up to one ounce of pot and grown marijuana with certain restrictions. The income from a 16% tax placed on recreational pot will be used to fund roads, schools and other public services. It is expected to raise up to $300 million annually for the state, KTAR reported.

Prop. 207 will also create a way for people previously found guilty of marijuana-related crimes to have them removed from their record. Arizonans will have to wait until June 2021 before they will be able to have their criminal records expunged.

Marijuana possession will become legal once the election results are certified, which likely won't be until December. March is the earliest dispensaries will be allowed to start selling recreational pot.
