With this breaking news, President Trump's twenty twenty election interference
case in Georgia is now in the hands of a
new prosecutor after Fulton County District Attorney Fannie Willis was
disqualified in the case. Let's get more from our senior
legal reporter, Lisa Reubin. Lisa, how significant is this?
Speaker 2 (00:17):
Well, today was the deadline for Peter Scandoclas, who is
the chair of this prosecuting council in Georgia, to find
someone to potentially replace Fannie Willis after the Supreme Court
of Georgia decided she needed to be removed from the
case because of the appearance of impropriety.

And you see, as per.
Speaker 2 (00:35):
Our reporting this morning, that Peter Scandocalas appointed Peter Scandocalus.
I think it's significant in the sense that there is
or could be some forward motion, but that doesn't necessarily
mean that there will be. Among the options for Peter
Scanducalas of course, is not only reviving the case, but
choosing not to revive the case. And as you and
I both know, earlier this week, President Trump pardoned dozens
(00:58):
of people who were allegedly involved in the fake elector's scheme.
Speaker 4 (01:02):
Many of them defendants.
Speaker 2 (01:04):
And ongoing defendants in this Georgia case if it were
to be revived. So look to see what he's going
to do in the next couple of weeks. If he
does want to prosecute the case, then I think that
he will notify Judge Scott McAfee. I'd like to have
a conference. Let's get this train moving again. But if
he doesn't, he may also make some sort of official
(01:24):
announcement as to why he is wrapping the case up.
Either way, I expect in the next several weeks we'll
hear from mister scandalclus about what his plans are on how.
Speaker 3 (01:33):
Far along was the case.
Speaker 2 (01:35):
The case was reasonably far along, discovery had concluded. There
were many pre trial motions that were decided. In fact,
one of those pre trial motions dealt with some of
the charges around the Rico charge. The main charge here
was a state racketeering conspiracy, but there were other charges
that had to do with Georgia election law and sort
of more straightforward interfering with the process of certifying electors.

For example, two defendants in particular got some of those
charges dismissed. John Eastman, the Trump attorney, and Sean.

Still a Georgian.
Speaker 2 (02:05):
They succeeded in getting those dismissed, saying this is an
inherently federal proceeding. The State of Georgia had no business
bringing state election charges against us for the process of
certifying electors. Perhaps we could see that argument sort of
being revivified if mister Scandouclas goes forward, because that is
the basis on which the administration has justified it's pardons
(02:28):
of folks all across these victor electors' games, from Georgia
to Michigan, to Wisconsin to Nevada.
Speaker 1 (02:34):
But let's say it stays a state state case. The
President couldn't do anything about it, could he.
Speaker 2 (02:40):
If it stays a state case, the president cannot do
anything about it other than to advance the arguments that
he has on the basis for which he made these pardons.
You and I both know that constitutionally, the president has
no power to pardon anyone for a state crime. But again,
his position here is that these pardons are justifiable because
these aren't in fact state crimes. They are federal crimes

for which these folks were never charged and the state
had no right to bring them.

So look to.

See whether or not any of these folks in the
Georgia case or in any of the other cases, as.

They move forward, feel like they need to go.

Back to that and say, hey, wait a second, I
have a new argument that I need to make that
pertains to my defect.

This is the primal scream of a dying regime. Pray
for our enemies, because we're going to medieval on these people.

the people. The people have had a belly full of it.
I know you don't like garing that. I know you're
trying to do everything in the world to stop there,
but you're not going to stop it. It's going to happen.

with you while we were watching the clip because it's
so kind of mind boggling. Donald Trump is still listed
as a defendant. They're still indicating that they're proceeding forward.
It's unclear to me at this point if they actually
plan on prosecuting this case.

The oh they plan on prosecuting it, don't they We
can shut them down. It's a state case. Only the
state attorney general I even know if they are.
Speaker 3 (05:29):

Yeah, Carr, that's another one. I mean, Carr is a
nightmare for the State of Georgia. But Peter Scandalocus is
the executive director I think of the Prosecutor Council for
the State of Georgia. He's the one that took this over.
That indicates to me that there was no other sitting
prosecutor who wanted to actually take this case. He took
it on apparently because there was no district attorney or

ag or anybody else that wanted to inherit this churt
of a case, so he took it. There's a status
conference here in December. First the pleading they came out today,
the order that came out today looked like the case
could be proceeding forward. He's not really a sitting prosecutor,
so there is a possibility that he put himself on

the list to be able to file a motion to
dismiss the case. So that's what I'm hoping happens. That's
what should happen. I don't know. I don't know where
he will prosecute this out of I mean he'll have
to kind of jerry rig and create a team to
do this.
Speaker 5 (06:25):
But oh, they would do that in a second.
Speaker 6 (06:27):
They could before the mid turn to get Trump in
a trial next summer.
Speaker 5 (06:30):
Look, it's not going to happen.

My point is these are the type of fantasies they
keep driving, right.

And it was so unbelievable that as the clip was playing,
I had to verify with you, like, am I hearing
what I'm hearing? Because this is so bizarre that they
would try to do this. But yeah, there are other
arguments to be made though, and in the order that
came out said you've got to raise your motions now
otherwise I'm going to see you don't have any, Like
I'm going to assume that we've heard everything that's going

to be heard. There likely will be other motions raised.

Certainly status conference in December. Could it be dismissed then
or is that when he sets up the process.

To dismiss it.

Either way? It could be either way. And I, like
I said, I don't really know what this prosecutor is
going to do. I was, I was surprised that it
happened this way. I thought I would be dismissed by
paper rather than having a hearing. So they may they
may actually be trying.

To the don't have any possibility of keeping this thing
in the public eye. They remember he tried to illegitimately
steal the twenty twenty election, which we know is opposite.
Two things I want to get to because the Tina Peters,
but particularly when I talk to people, explain the president
is trying to be helpful here, Todd Blanche and the
team Ed Martin, the Pardons team, particularly with these electors.

But everybody's like kind of leaning on their shovel now
because I said, hey, all the electors got pardon. That
has no bearing on this stay case, correct, I mean
in Arizona, and I guess is it Michigan or they're
going to go down.
Speaker 5 (07:59):
They're going to go even harder here, are they not?
Or try to?
Speaker 4 (08:02):
Well, I mean broad brush, I would say it doesn't
really have any bearing on a state case. You don't
the president doesn't pardon state cases. That usually comes from
the governor. That's kind of the traditional talking point on this. However,
the argument to be made with the pardons. Particularly in
this Georgia case, it's a little bit different. I mean,
Michigan's already dismissed, so it doesn't.

Really masters What is it Wisconsin?
Speaker 4 (08:22):
In Wisconsin, Nevada, Arizona's still open, but our indictment has
been thrown out, so you know it's on, it's in
the process.
Speaker 5 (08:29):
Are you still burning up legal fees?
Speaker 4 (08:31):
Oh yeah, I mean as long as the case is
of administratively, it's open, but there's no valid charging, is it?
Speaker 6 (08:35):
Judge Troopas out of Wisconsin. He's going to be in studio.
Speaker 4 (08:40):
Yeah, Troopas is fantastic. One of the guns.
Speaker 6 (08:42):
The Truth is coming to town. He's going to be
in studio Tuesday Wednesday. We're going I want to get
all the stories about these people because they've been tortured
for a couple of years and spend a realmous amount
of money one hundred percent.

And troop is actually in Wisconsin. Prior to coming up
with the alternate electors plan, he actually went to the
Attorney General and they had a meeting, a hearing whatever,
and he said, hey, we believe that we need to
preserve the elector's votes. He went and told them, hey,
this is what we're going to do. Said this to
(09:14):
the attorney general, let us know if you have any
problems with it, because we believe that these steps need
to be taken in order to preserve Donald Trump's ability
to cast these votes later. And the attorney general approved it.
He said, you know, there was a memo somewhere floating
around that that's okay, there's nothing illegal about this, go
ahead and do it. And it was because the attorney
general approved it, the troopers said, okay, this is what
(09:35):
we're going to go forward and do. And then lo
and behold, they turn around and indict Troopis and Mike
Roman and Ken Chestburrow, not even the electors. I mean,
the Wisconsin case reeks to high heaven. But back to
the parton issue, the way the pardons could actually impact
the state cases, if you want to go down that road,
(09:55):
is kind of what they were talking about in the clip,
that these these are not actually state charges. These should
be federal charges. It's a federal election. Federal law supersedes
state law on this issue, and so the pardon. The
bigger issue of what's actually being charged really is a
federal even though there's state charges. It is a federal offense,
(10:17):
and so that pardon would should apply to this case,
to this these state charges. It's an argument to be made.
I don't know, you know, I don't know how who
or how anybody was going to raise it. But normally,
normally a federal part in a presidential pardon wouldn't impact
the state case. But there actually is an argument to

be made here because it's a federal election in the
heart of what they're doing as a federal election.
Speaker 6 (10:42):
But then they would be admitting that they charge you
illegitimately because I mean, the people are in Arizona.
Speaker 5 (10:49):
Are not going to agree with that. The state.

Control, No, the ags and Fanny Willis Is they will
all oppose it. But the judge could agree with you. Yes,
so they it's it's a motion that they might bring
Tina Peters.

Why she's still in a Why is she in the state.

Prison because of the state of Colorado?

But aren't they saying now that the machines are their
problems with the machine you've got. You've got the congressman
from Texas saying that now that some guys bottom that
used to be a Republican state election official, that dominion
machines can be using. Yeah, Crockett's out there saying you

Isn't it time? And I hear that the BP that
Main Justice is told the BOP make arrangements the Colorado
authorities to transfer her to a federal facility, probably to
be a witness potentially in a federal case. But Colorado's refusing.
I hear today that I think.

EPA or somebody sending money to Colorado, should we not
just cut off? So we talked to the president, have
cut off all money to Colorado until she's released. Is
she a political prisoner?
Speaker 4 (11:54):
One hundred percent. She's a political prisoner. They're holding her hostage.
I mean, she's a gold star mom, she's in her
seventy she was an elected official. This was an absolute
sham trial they I mean, they manufactured these convictions in
order to score political points for their base in Colorado.
And a lot of the information that's coming out she

was right, Like you mentioned, a lot of her concerns
about the machines have been proven to be valid her concerns.

And Democrats are saying now, Jasmine Crockett is one of
the highest visibilities exactly, she's thinking a runner for the Senate,
and she's saying, hey, Texas can't use any of these machines.
I'm not sure they using many, but she says the
machines are to be banned nationwide. You got Jasmine Crockett,
the most radical, saying that, how's Tina Peters not sprung
from jail?

No, I mean Colorado should be?

How bad it can't? Is it bad as Arizona?

I think I actually think Colorado's worse. I mean, Tina
Peters is in prison unfairly, you know. Thankfully in Arizona
we don't have that at the moment, although Chris Mays
is working very hard to try to do that. Not
just to us.

She was thrown all it was you and Borised. They
had some high veg targets.

Yeah, and the electors to Tyler Boyer.

Tyler Boyer the head of ballot chasing for Charlie Kirk,
Boris Epstein, the president's lawyer, Rudy Mark Meadow Mark Mark
Meta's former chief of dad, John Eastman, johnny'sman, Christina bob Of,
president's lawyer. They had eight or ten high value ated
targets to take down and put in prison.

Yeah, and she tried she thankfully hasn't been successful. But
it's not just us.

getting a lot of attention now because of the pardon
and some of the information that's coming out. But after
the election it really did kind of go underground for
a little bit. People were like, oh, we won. A
lot of people assumed the case was over. Our cases were.

People assumed the cases over there. That's not you're you're right,
it may help the cases.

Not all the cases are not over. Well, Michigan is,
but no, none of the other ones are over.

Wisconsin's on the judges here next week, Arizona's on Georgia.

She dismissed it. They don't know, but you just saw

on trial in the summer before for the midterms.

do is just throw sand in the gears to one
make sure the Trump administration doesn't actually accomplish its objectives
and doesn't actually fulfill its mandates. And then two just

These people are evil, the demonic. They're trying to come
after you guys, the white hats, the people who have

actual betrayal. What's happening in Indiana.

It's terrible.

What's happening. We have Republicans that still have no idea
what time it is. We're watching Gavin Newsom steel five
congressional seats in California, and the Republican legislature in Indiana
can even do the right thing and do what the
people of Indiana.

Want and district.

It's obstruction that's happening straight from the top. The state
Senate president, his name's Roderick Bray. He's totally weak, he's
totally clueless, and they're going to hurt our abilities to
win the midterms because they refuse to do the right thing.
And so it's time after time. The Rhinos always let
us down. I'm not sure. We're now ten years into
the Donald J. Trump experiment. Donald Trump is taught to

Republican Party how to win, and you win by being ruthless,
and you win by by fighting and showing courage. You
don't win by being a feckless loser. That's the party
of the past. And for some reason that Indiana legislatures
still likes toll live in that.

We're already eight to nothing, correct, we're eight to nothing
in Indiana.

we want that extra seat.

I thought the governor was with us. We had this
huge event a couple of months ago. Senator Banks and
Thin put it on. Raheem was out there. I think

I thought we had this, and then Mike Pence got involved,
and then the state. Why are they telling the president,
I says, because Virginia's just told us they're going ten
to oh. So we want to go nine to oh
in or ten one in Virginia. We want to go
nine to oh in Indiana. Why are they getting weak
now that other states have come in After the Tuesday election, results,
and particularly after the Newsom stole this, stole five seats

in California.

Why are they getting weak?
Speaker 8 (17:24):
Now, that's a great question, Steve. I have no idea
why they're getting weak. And they're so weak. The state
Senate President Roderick Bray, he won't even call a vote
to have.
Speaker 3 (17:33):
Redistricting voted on.
Speaker 8 (17:35):
He doesn't want to have the names of the rhinos
out there who are going to vote.

To obstruct it. It's crazy what's happening.
Speaker 8 (17:42):
And Steve, two weeks ago, we saw on Tuesday, two
weeks ago, we saw that the Republican establishment totally let
down the people of Virginia, totally let down the people.

Of New Jersey, and they still do not know how
to win with dolland Trump not on the ballot.
Speaker 8 (17:57):
And I can promise you that getting weak need redistricting.
When the entire state of Indiana once and I was
just in Fort Wayne on Monday, and we had five
hundred people there, you know, chanting and cheering when I
was talking about how the president is advocating for redistricting.
They want it done, but the Rhinos in the legislature
they are refusing to do it. And so we still

have a really huge Rhino problem. I know you call
it out, Steve, You've never stopped calling that out.
Speaker 3 (18:22):
And I think a lot of.
Speaker 8 (18:23):
People on our side in Washington are waking up to
that once again and realizing that Donald Trump might be
in the White House right now and the Republicans still,
you might be in the House, in the Senate and
in legislatures all across the country, but still many Republicans
are not with us. They fight against us, potentially for
very corrupt reasons. And so we need at least Roderck Bray,
(18:44):
the state Senate President, to call.
Speaker 3 (18:46):
For a vote.
Speaker 8 (18:47):
The people of Indiana deserve to know which senators are
with them and who are against them. But I can
promise you that we're going to be taking a very
strong look at primarying every single Rhino senator that is
stay in our way on this effort.
Speaker 4 (19:01):
One hundred percent that absolutely needs to happen. There's been
this sentiment that I've seen a little bit here in DC,
you know, certainly in Congress, and I think maybe even
in some aspects partly of DJ but it's almost like
some of these Republicans seem to not realize that if
they don't take the opportunity that America gave them with
this huge red wave that happened in twenty twenty four,
(19:24):
If they don't seize that opportunity, clean out the corruption,
accomplish what needs to accomplish. Maybe they don't realize that
the tables will be turned and they will be targets.
I mean, I don't know if they don't understand what
happened during the previous presidential election. But Alex, do you
see that, whether it's in Indiana, I know, you go
all over the country, is there some like level of
(19:48):
a Pollyanna attitude of Oh, they're not going to come
after me. I'm you know, I'm squeaky clean, or I'm
it's like blinded by arrogance. I don't know what it is,
but I see it. I think they don't they don't
realize that they're they're standing in the bullseye of a
target and they're about to arm their opponent. They have
to take this opportunity to disarm their opponents.
Speaker 8 (20:07):
What do you think, Well, I totally agree with you,
and I was going to use the word arrogance. There's
definitely an arrogance among Republicans all across the country and
it's an unfounded arrogance because the Republicans party has not
had success. Donald Trump has had success. The only reason
Republicans are in the House and in the Senate, and
in governor's mansions and in state legislators all across the
(20:29):
country is because of Donald Trump and the Mega movement.
And the Mega movement doesn't owe the Republicans in office
anything to be honest. And so when the Republicans in
office don't fight for the mega voters, when they don't
fight for Republican voters, there's going to be a turnout problem.
And you saw that two tuesdays ago in Virginia. You
(20:50):
saw that all across the country. You're seeing that when
Donald Trump's not on the ballot, you have to have
a reason to get these people out to vote. And
they turn out from the fighters. They turn out for
those who have they don't turn off to those turn
off for those who have weaknees and always capitulate. And
so we absolutely need the Republicans that get smart or
(21:10):
get tough, or we're gonna have some serious problems in
twenty six And.
Speaker 3 (21:14):
Stave I think it's great.
Speaker 6 (21:16):
It's not simply Trump as an individual beers. We know,
we have a terrible time getting out low perpendsity, lowerformation
voters unless prison Trump's on the ticket.
Speaker 5 (21:25):
This is where the midterms is so important.
Speaker 6 (21:27):
But it's also just from a policy or your pitch
in twenty eight I don't care who the candidate is.
Speaker 5 (21:32):
Are we going to say next? This time, we mean it.
This is my point. We have a mandate. We have
the House, we have the Senate. We have a majority.

We have a six to three majority in the Supreme Court,
we have the executive branch.
Speaker 5 (21:45):
You're never ever going to have this moment in time again.
Speaker 4 (21:48):
And a majority of governors and a majority of state ags,
and a majority of state houses and a majority of
state legislatures.

Republicans, hang on, hang on, And if you take the
state party delegations in Congress, we have them.

Had to have a contingent election, you'd win there too.
Speaker 6 (22:02):
We are never going to have this again, Bruce, which
your thoughts, what don't they get about? We got a
mandate you have to execute on the mandate, sir.
Speaker 8 (22:11):
Well, your audience comes in so handy here, Steve, because
you have the heart and soul of our movement that
listens to your show every single day. They pick up
the phones and they call their legislators and they say
do the right thing. And so I guess I have
a call to action to your audiences is identify the
rhinos who in Indiana who are obstructing, Please pick up
the phone and tell them to redistrict and do what

the people want. And when it comes to the Senate,
like the President has been calling to abolish the filibuster,
we have the majority, and we do have a mandate.
Speaker 3 (22:41):
Donald Trump won every swing state.
Speaker 8 (22:42):
He won the popular vote, and not by a little margin,
he won by a substantial margin. There's a mandate to
advance the president's agenda.
Speaker 3 (22:49):
Meanwhile, we have.
Speaker 8 (22:49):
Senators who refuse to get through to end the filibuster,
and it still feels like the Democrats are in charge
of the Senate, which it shouldn't feel that way.
Speaker 3 (22:57):
They were totally rejected in.
Speaker 8 (22:59):
November, and the Senate lets them get the steamroll us.
Speaker 3 (23:03):
And so we need to end the filibuster.
Speaker 8 (23:05):
We need to redistrict, and if we don't, there's going
