Hey, I had a question. My wife and I are
looking at going through divorce. We've been together about nine
and a half years. We're looking to try to keep
this as amicable as possible.
Speaker 6 (11:29):
She basically came to me said, I'm getting a job
and I'm moving out with the question is is if
we can.
Speaker 9 (11:37):
Settle out of court. We have one one child together,
If we can settle on a child's sport outside of court,
ahead of our court, would the state mess with whatever
we agreed upon or will that only happen if she
ends up on state assistance? Or how does that work?
Speaker 6 (11:53):
Yeah? Well, first of all, great, great question, because it
comes up, you know, over and over again. The concept
of being able to settle a divorce in the terms
of a divorce between the two of you is always
the goal, right, So I'm root for that to happen
in terms of the court actually looking over anything. If
(12:15):
you do come to agreement on everything, you can have
documents drafted through an attorney or through a paralegal service
blog to the court as your cost final orders. What
the court will do is they really won't scrutinize whatever
financial deal that you have, meaning division of assets or
liabilities or if there's going to be an espousal support.
(12:36):
What they will look at, though, is they'll take a
look at the terms of the parenting plan to make
sure that they understand who the primary parent is. And
it's a required document, so it's an elaborate form if
you want to call it that, but that needs to
be the part that gets the most scrutiny to is
once they see that parenting plan, they're going to look
(12:57):
at whatever the child support order is and they're going
to make sure that it officially complies with support guidelines.
So I would say this, make sure and educate yourself
in terms of what the expectations of child support would be.
But again and very with your parenting plan. You know,
if you have a fifty to fifty agreement, there's an
(13:20):
argument for child support being significantly less because there's more
out of each person's pocket on a day to day basis.
So two levels of scrutiny. They'll look at the parenting
plan and then they'll compare the supportware.
Speaker 9 (13:33):
Because the reason I asked you is my my scene
to be ex wife is you know, we've both been
married once before, and I know, like one of her
adsus they agreed upon like a couple hundred dollars a month,
and court kept at the entire time. She never went
back into adjust. She doesn't seem like he's trying to,
you know, come after me really, you know, and anything
(13:54):
like that. I think we're gonna be able to keep
it civil. I just you know, if we agreed upon
a certain amount, it was just kind of is the
course's all of a sudden. Oh no, no, we expect
to triple.
Speaker 6 (14:02):
At well they yeah, they are going to scrutinize it.
I don't know what the facts were on her first divorce.
You know, maybe it was in younger days, people making
less money, et cetera. But they will take a look
at that. So if that number is unexpectedly low, they're
they're going to want to see a justification. And that's
(14:23):
where I said, the justification of having a larger amount
of residential schedule really kicks in. And the way they're
looking at it is that you know, they're looking at
it from the perspective of I'm not trying to do
this to put more money in her pocket. What I'm
trying to do is to make sure that the kids
are taken care of, you know, based on the on
the earnings, the combined earnings of the family. So then
(14:44):
that's why they're going to give it a double take.

Yeah, so I wasn't a great husband, but I'm a
great dad. And when I get a divorce, which seems
to be heading that way, Kim, my wife used that
against me. I mean, how I was cheating, lazy husband.
I've never been anything but great to my kids, and
I want to make sure I don't get screwed out
of time with them.
Speaker 6 (15:19):
Yeah. Well, I'll tell you that's one of our passions
is that we get the privilege of working for some
really great dads. So it's good to hear from you,
and it's good to hear that perspective when it comes
to you know, what, does she have any inroads to
try and limit your time? You know, beyond whatever a
(15:40):
normal custody arrangement would be, and there are avenues for
her to seek that they may or may not exist.
In your case, the big ones surround things like drug
or alcohol addictionary abuse, or any sort of history of
domestic violence. Those are the two that she could try
to hang your hat on to be able to say, hey, listen,
(16:02):
you know he shouldn't have overnights or he shouldn't have
full weekends. But then it's really up to you to
be able to defend that either no, there's you know,
not only did it happen, there's certainly no proof of
anything like that that happened. You know, when it just
comes to things like hey it didn't work out. You know,
we argue a lot, or we're just not meant for
(16:25):
each other, or you know, even stepping out of the
marriage like you'd mentioned. Those are not things that are
going to come into play to reduce your visitation.
Speaker 2 (16:34):
So being a bad husband will not affect him getting
any child custody. Like you can't say, oh, well you
cheated on me, so I'm keeping the kid.
Speaker 6 (16:43):
Yeah. Well, I think there's there's a lot of people
out there probably listening that are better, better parents than
their partners.

I'm wondering if that's going to make divorce easier, like
is her stuff different from my stuff if we get divorced?
And I mean, is a prenup going to guarantee if
we split everything fifty to fifty?
Speaker 6 (17:18):
Yeah, we got some really good questions going here this morning,
so thanks, thanks for that. You know, the day somebody
gets married and married, there's there's a paper trail, right,
it's easy to see of Hey, this this was my
account over here, and here's what it had in the
account or my retirement as of you know, October fifth
(17:38):
of twenty twenty five. The benefit of the prenup, though,
it's it's basically putting that all down on paper. So
number number one, it's a refreshing and ability to recall
of where things are are at. It's also an expression
of what your intent was when the two of you
got married. So now let's fast forward ten years, you know,
(18:01):
picking a number, and unfortunately somebody needs to go through
a divorce process. Well, that prenup serves as a deterrent, right,
In other words, somebody looking at that saying well I
don't like the terms of that, Well are they going
to pay an attorney to fight that? And so the
(18:21):
prenup gets challenged are probably a little less. So that's
good already. And then secondly, the prenup is a contract.
The courts, in their somewhat infinite power, definitely have the
ability to choose to either enforce or selectively enforce a prenup,
and we have seen that. But the real issue there
(18:44):
is how much time has gone by, how much the
issues have been clouded, and whether or not it's just
simply manifestly unfair to one or the other parties. So
if you're going into this saying, hey, you know, here's
what I want to do. I want to memorialize what
our intent. I want to memorialize what our expectations are
going forward, then those are all benefits of the prep

don't go away?

Here, Rick, thanks for thankshaking my call. I got a question.
My wife and I have been living a part for
about about five years now. Everything's amicable. I live in
one of our houses and she lives in another one
of our houses. She has a boyfriend, and I'm starting
to wonder if she'll file for divorce soon. How how
(19:45):
does that living situation, me in one house, her in
another house come into play when we file for divorce.
Speaker 6 (19:51):
We are houses that we're in, Yeah, I mean as
of right now. It's it's almost like you're in the
you know, in the middle of a divorce. You know,
let's say the two of you were living together currently
and it was time to hit splits field, but you
had the luxury of owning another property. Well, that would
have been the easiest first move anyways, of one of
(20:12):
you to be in each So the way to look
at your residence in the process of a divorce is
while you're going through it, you know, and tell such
time as the finance side of the divorce is resolved.
It's really just a roof over your head. Don't think
of it as an asset. Now in the divorce process,
obviously it's like, okay, well we have ownership and two properties.
(20:34):
Obviously we have to divvy that up. Can we do
it in such a creative way that allows her to
keep one and me to keep one If that's you know,
if that's something that you desire. If not, then you
go through the process that any other divorce divorcing people
would of saying, okay, does one of these need to
be sold to be able to create enough cash to
(20:54):
make an equalizing payment to make everything, you know, come
out correct on the on the balance sheet. So I
think you're actually in pretty good stead here in terms of,
you know, hopefully buying some time to come to a
reasonable settlement.

Well that's good, and like hopefully both those houses are
worth almost exactly the same. Definitely got time for a

a mess, but I just happen to also be pregnant.

So it feels like that makes things even messier. But
since I haven't had the kid yet, does that impact
who will get custody? Like, since there has been no
custody established, does that make it harder for me to
get full custody? Does it just go fifty to fifty
since there's no primary caregiver yet? Like, I just feel

like I'm so in the darks, I'm so new to all.

Them, And I think over time, how how you know,
the courts do view parenting a little bit differently. It's
no longer just a simple a simple slam dunk based
on gender right where where Mom's historically had, uh, you know,
not not just the upper hand, but just this major,

major assumed advantage. And while that you know, level is
gone to the same extent in your situation, it's gonna
work kind of just the opposite, but very much in
your favor. You know, there's there's certain needs a baby
as being you know, upon u upon being born, associated
(22:35):
with the bonding, physical nurturing, et cetera. And you're the
one that that's absolutely in the best place to provide that.
So when it comes to an infant, and again we're
talking I yet to be born. When it comes to
an the mother almost always has in some really egregious circumstances,
is going to be considered the primary parent. Now, it
(22:55):
doesn't mean that the father is completely shut out from this,
but it does mean that that a normal type of
schedule for an infant would be not you know, every
other weekend and a week It would be more like
two hours every three days, you know, so kind of
a visitation to allow the father not to get away
(23:16):
behind the eight ball in terms of creating a bond.
But but really, this child is going to be with you.

Well, okay, that's good news for Stephanie. We got time

Hey, good morning Andrew. Hey, my dad recently passed away
and uh left me a good chunk of money and property.
Then that right after that my wife that she wanted
a divorce. Does the does the timing matter? Can can
she you know, stake a claim on my dad's stuff? Yeah? Well,

you know this this goes to the issue of defining
the difference between a separate and community property and the
concept of an inheritance is a very very common but
also strong presumption of that being your separate property. I'm
assuming that that your father left it to you as

an individual as opposed to you and her as a community. Correct, absolutely,
just yeah, Okay, the real key that you're at now
is and I hope you've started this already, but make
sure that if there's cash, that that goes into maybe
an account that's newly opened, so that you don't have
(24:34):
any flow, you don't have any you know, checks and
balances coming out of that account. It's simply I picked
up this inheritance and I plopped it down here, you know,
as an investment vehicle. When it comes to the real property,
you know, same same sort of thing. Don't take out
any sort of an additional mortgage on it or a
home loan, because then it starts sort of erasing the

separate quality of it. But you know, frankly, the timing
of for you and the goal of protecting your assets
is actually pretty good because it's going to be really
tough to argue against something you know, so new and
recent that is obviously separate property for you.
