רפורמה בתובענות ייצוגיות
תובענות ייצוגיות הפכו נפוצות יותר ויותר במשפט הישראלי – לטוב ולרע. בימים אלו נידון בכנסת תיקון 16 לחוק תובענות ייצוגיות, אשר שואף לפתור חלק מהבעיות שעולות מיישום החוק בשטח. בפרק זה אנו מארחים את עו"ד נועה מלצר צ'רנוברודה, מנהלת הקליניקה לתובענות ייצוגיות בפקולטה למשפטים באוניברסיטת תל אביב, לשיחה עם תלמידי הפקולטה, איל כנפי והדר שמואלוב אודות התיקון המוצע ועמדת הקליניקה אודותיו. הדיון עוסק באיזון העדין שבין האינטרס במתן פיצויים לנפגעים לבין האינטרס בהפחתת העומס בבית המשפט. הפרק מתמקד בשאלת הצורך בהגנות הניתנות לגופים ציבוריים ולעסקים קטנים שמתמודדים מול תובענות ייצוגיות.
