The United States Supreme Court decided not to intervene in
the sentencing in Donald Trump's New York state case. Nine
thirty this morning, the virtual hearing that is scheduled. Joining
us talk about this, our White House correspondent also the
only member of the White House Press Corps who is
an attorney in fact one who can argue cases before

the United States Supreme Court. John Decker, Good morning, John.

Hey, good morning to you, Brian. Not a dearth of
news to talk about it that sures in the past
twenty four hours, right, yeah, you bet.
Speaker 1 (00:46):
And we're going to going to have a lot of
news that is happening all throughout the course of the
day today. So set us up for what we can
expect at nine thirty this morning, well nine.
Speaker 2 (00:56):
Thirty this morning will be that hearing that will be
presided over I Judge Juan Marschon. He's the same judge
that presided over the criminal case in New York in
which Donald Trump was convicted of thirty four counts of
falsifying business records. Judge Mrchon gave President elect Donald Trump
the option of being in person or joining virtually. I

believe he will join virtually, and then he will impose
the sentence. And Judge Mrshon indicated last week that he
would not impose a prison sentence on Donald Trump. He
will impose the sentence of a conditional unconditional discharge, which
is essentially dismissing the case. And I think that factored
into the decision by the US Supreme Court, the five

to four decision by the US Supreme Court not to
intervene in this case and allow the sentencing to go forward.
Speaker 1 (01:46):
And once that happens, you would imagine that Team Trump
will then appeal that conviction, and the United States Supreme
Court also leaving open the possibility that they could consider
that if it got that far upon appeal. Do you
have any expectations for how that process may play out
and how long that process could play out.
Speaker 2 (02:08):
Well, I do expect if there will be an appeal,
Donald Trump and his lawyers have indicated they will exercise
all of their options as it relates to appealing the sentence,
appealing the merits of the case that was brought against
him in the first place. That will be a process.
I can't predict, Brian, how long that process takes, but
it will be a process. And I think that's another

reason that we saw the Supreme Court deciding not to
intervene us because they viewed President Donald Trump as a
person who had not exercised all of his appellate options
as it relates to the case, and he still has
those options even after the sentencing takes place today.
Speaker 1 (02:47):
All right, so Trump to be branded the convicted felon officially.
It had been widely reported since last May, though that
had not been technically true. So he will be once
this goes down, which would seem to be some of
the motivation perhaps behind going to this particular step. Meanwhile,
take a look at another Supreme Court a situation today, TikTok.

So you had the law that was passed last year
that would force the sale of TikTok. Supreme Court going
to hear the case about whether this should go through.
Speaker 2 (03:17):
Tell us about it. Well, I'll be in the Supreme Court.
I'm getting ready to head over there right now as
we speak. The Supreme Court will hear oral arguments two
hours of oral arguments today concerning this case. They put
this on the docket, which surprised some people that it
was put on the docket. But they will have very
little time, Brian to turn around an opinion just nine days,

because the potential ban on TikTok takes effect on January
the nineteenth, and unless the Supreme Court says that this
law that was passed by Congress and a bipartisan fashion
signed by President Biden last year is unconstitutional, TikTok in
the US will be no more.
Speaker 1 (04:00):
It's an interesting thing. Do you have any kind of
an indication of how this might go at this point?
Speaker 2 (04:06):
Oh, I don't know. You know, ask me that question,
and feel free to ask me offline as well. Ask
me that question after oral arguments, because this is a
case that pit's national security concerns. TikTok is a company
that is owned by a Chinese company called byte Dance.
There are those including the FBI, that believe that the
Chinese Communist Party has influence on Byteedance. That been no

fair nefarious intent by the Chinese Communist Party as it
relates to the algorithms that TikTok has and it's national
security concerns versus free speech First Amendment rights that's the
issue that will be at hand today for the Supreme Court.
And you know it could go either way. I mean
you think about cases that the Supreme Court, Brian has

decided in the past that touch upon these very issues,
like the Pentagon Papers case that came before the Supreme
Court in the nineteen seven Is there free speech one
out over national security concern? So we'll see how the
Supreme Court ultimately rules on this particular case.
