A former Speaker of the house is being taken to the High Court for musical torture during the 2022 anti-mandate protest.

A girl from Northland, who was 11 at the time, says Mallard weaponised songs like Disney's Let it Go - causing mental anguish, humiliation and de-humanisation.

Her lawyer, Tudor Clee says blasting someone with music is a military-style torture technique.

He says this is the first time this technique has been intentionally used on children.

The girl is seeking 40 thousand dollars in damages.

Afternoon. Trevor Mallard is being sued by a teenager for
turning the sprinklers on the protests at Parliament in twenty
twenty two. The girl was eleven at the time. She's
accusing him of causing mental anguish, humiliation and dehumanization by
weaponizing baby Shark, and she's seeking forty thousand dollars in damages.
Tudor Clee is the lawyer taking the case and with
us now hate Tudor.

Speaker 2 (00:21):
Good afternoon, Tudor.

Speaker 1 (00:23):
While I love that you're suing him and he absolutely
does deserve this. This is not going to succeed, is it.

Speaker 2 (00:30):
Well? I think it is, and that's why we're taking
the case. I mean, ultimately, it's a case about whether
or not this child was degraded and having extrements slided
into her and being blasted with music is, on the
face of it, my view, degrading. And if it isn't,
then what is it?

Speaker 1 (00:48):
Are you doing this pro bono?

Speaker 2 (00:52):
Yes?

Speaker 1 (00:52):
I am Why?

Speaker 2 (00:55):
Well, I think that we've got to a point where
we can even have consensus about whether or not it's
wrong to flood excrement into children order to blastom with music.
And I think that something has to be done about.

Speaker 1 (01:07):
Just because you said it twice, what do you mean
by by flood excrement into children?

Speaker 2 (01:12):
Well, so there doesn't seem to be any dispute that
Trevor Mallard flooded the Parliament grounds like he told police
that he was going to do it, he did it
the next day, he went at the News and said
he did it. A week after he told Audrey Young
at the Herald that he was aware that there was
excrement in the grounds and that's what he was flooding
the water through it. So the police described it as

a quagmire of quagmire of human feces and mud by
the next day. So again there doesn't seem to be
any dispute about the sanitation issues that were there. And
so the question is that is this how we treat
people in New Zealand? Kind of like that.

Speaker 1 (01:55):
I love that he's getting his come ups, but this
is exactly the kind of long bow that's been drawn
in this case. It would appear that makes it really
unlikely it's going to succeed.

Speaker 2 (02:06):
Well, if it doesn't succeed other then at least we
know moving forward that if you have a protest of
parliament and you disagree with the people, then you open
the sewage and you flood them out. And if that's
how if that's what the case is, then I think
that everyone.

Speaker 1 (02:20):
Look, I'm not a fan of Truva Mallied, but I
feel like you are exaggerating what's happened here. He didn't
open the sewage, did he. I mean he played the
macrena at people like a child and then turned on
the sprinklers, knowing full well that they would likely to
be damaged. I mean, if we stick to the facts,
what he did was was head like a dickhead. Right, Yeah,

(02:41):
I'm not going to argue with that. Sure, Okay, have
you heard from him?

Speaker 2 (02:46):
No? I haven't. I mean, it's it's obviously in a
court process. But so the asway is that it's just progressing.

Speaker 1 (02:53):
Okay, And when is this likely to actually go to court?

Speaker 2 (02:57):
I would say probably about a year to get a
try they realistically.

Speaker 1 (03:00):
Okay, are you worried at all about wasting court time here?

Speaker 2 (03:05):
No? Absolutely not. I think these sollegitimate questions that need
to be answered.

Speaker 1 (03:09):
Okay, you the best of luck. I really appreciate your time.
