Der EuGH hat dazu am 22.09.2022(C-120/21) entschieden, dass der Anspruch von Beschäftigten auf bezahlten Urlaub zwar grundsätzlich einer dreijährigen Verjährung unterliegen könne, allerdings müssen Arbeitgeber dafür Sorge tragen, dass die Arbeitnehmer den Urlaub wahrnehmen können. Das bedeutet, dass der Arbeitgeber den Arbeitnehmer in die Kenntnis über Urlaubsansprüche setzen und auffordern muss, den Urlaub zu nehmen. Macht er das nicht, dann kann sich der Arbeitgeber nicht auf eine Verjährung berufen. Das bedeutet, dass auch Urlaubsansprüche die 10 Jahre oder länger zurückliegen noch geltend gemacht werden können.
