بعد از پیروزی انقلاب دو مشکل بزرگ ذهن انقلابیون را به خود مشغول کرده بود باید قوانین جدیدی نوشته می‌شدند، قوانینی که ضمانت می‌کرد حقوقی که توسط رژیم پیشین نقض شده بودند دیگر نقض نشوند.این قوانین باید به مدت طولانی مورد وثوق و اطمینان مردم باشند یعنی مبنایی داشته باشند که فقط به درد نسل فعلی نخورند بلکه برای نسل‌های آینده هم مورد استفاده باشند. مشکل اینجا بود که این قوانین مشروعیت و مرجعیت خود را از کجا باید می‌گرفتند؟ و از اینجا بود که دو مسئله مشروعیت و مرجعیت قانون ذهن انقلابیون را به خود مشغول کرد.
