Season One, “Firefly,” was written and produced with the permission and encouragement of my client, Marjorie Orbin, whom I have represented in post-conviction for over ten years. After extensive investigation, research, and interviews, FIREFLY is a presentation of the “whole truth” and not just what the jury heard. Post-conviction practice is a highly specialized area of law that explores fundamental and nuanced aspects of criminal law and procedure. It asks what happened and what went wrong behind the scenes and outside the record after appeals have been exhausted. With over 3,200 inmates nationwide (21 of whom were sentenced to death) exonerated either in full or in part by DNA testing, newly discovered evidence, and newfound witnesses, post-conviction investigation is a vital component of truth and justice. After Marjorie’s arrest, the prosecution’s case was fast unraveling. With several of their jail house snitches, eager to rat on Marjorie in exchange for leniency, the police and State ignore or overlook crucial evidence, some of which it releases to members of the victim’s family before trial.
The police’s investigation heats up and after several curious discoveries, they begin to narrow in on Marjorie’s hot-headed boyfriend. They want to know more about the plastic sheeting found in his car and the mysterious hair on the victim’s remains. They want to know about his guns and the trash bags he dumped at his daughter’s house….
