Eğer siz bu mal varlığını fiilen paylaşmadıysanız; yani hangi mal varlığının kime ait olduğunu belirlemediyseniz hali hazırda sizin için miras ortaklığı söz konusu olacaktır. Ve her biriniz bu ortaklık üzerinde eşit söz hakkına sahipsiniz. İkiniz de birlikte karar almanız gerekmektedir.

Ortaklık fesih edilinceye kadar bu mal varlığı ile bir karar alınacağı zaman yetkili kişi bu temsilci olacaktır. Kanuna göre alt soya karşı yapılan karşılıksız kazandırmalar denkleştirmeye tabidir. Sizin mirasçınıza yapmış olduğunuz kazandırmalar onun miras payına mahsuben yapılmış demektir.
Bunu delegeye iade etmesi ya da mahsuplaşılması gerekecektir. Dolayısıyla ağabeyiniz mirası aldığı zaman denkleştirmeye gidebileceksiniz.
