And D23 news begins with DisneyPlus getting Simpsons

Now, while Fox will show mostof the new season, simpsons
execs producers said at the D23showcase that some episodes from
the show's 36th season will airexclusively on Disney Plus.
The episodes include aChristmas one titled O Come, all
Ye Faithful on December 17th,and the stream will also get an
exclusive Halloween-themed shortin October.

Fortnite's new Marvel collabwill be nothing less than
fabulous.
During the Horizons DisneyExperiences panel at D23, kevin
Feige announced that Marvel'snext collab will, unsurprisingly
, revolve around Doctor Doom,but the most surprising thing
about the event's trailer is thenumber of X-Men who popped up.

Toy Story 5 will come out insummer of 2026, and this time
the boys are taking on tabletcomputers as they try to figure

In Star Wars news, daisy Ridleyopened up about her recent
health scare and revealed thatshe has been diagnosed with
Graves' disease.
Last year, the star of the Riseof Skywalker said in a new
interview that she had initiallyattributed the symptoms of the
disease to playing a stressfulrole in Magpie.
Quote I thought well, I've justbeen played a really stressful

role.
Presumably that's why I feelpoorly, she told Women's Health
in a recent interview.
Now, magpie was a psychologicalthriller and she starred
alongside Shahzad Latif andMatilda Lutz.
Ridley said that some of hersymptoms included a racing heart
rate, weight loss and fatigue.
The doctor told Ridley thatGraves was feeling tired but

I was like oh, I just thought Iwas annoyed at the world, but

Being diagnosed with Graves'disease led Ridley to make some

discuss Gina Carano's lawsuitagainst Disney.
Now there has been an updaterecently.
A couple weeks ago, disney losttheir first round bid to
dismiss the suit, so it's goingto trial and so, of course, I
have to bring in someone to sortof set the table, tell us what

we need to know, and that wouldbe Andrew Torres of the Law and

Well, I appreciate

Gina Carano fans may notappreciate what I have to say
this time around.
You know, look, I thought shewas great in, you know, the
first Deadpool movie.
So you know, it's not personal,it's just.
You know she went a littleright wing crazy and you know

Cara Dune, and and at that sametime, this was 2020 that the
second season of the Mandalorianwas airing Gina Carano decided
that she was going to kind ofdrink all of the right wing

things that you know, botherthese folks, which are, you know
, having to use pronouns, andthe the, the far right, has one
joke.
So Gina Carano took to Twitterand was like my pronouns are
beep bop boop.

That's, you know, anti-trans,anti-lgbtq, plus.

And Disney sat back and didnothing for a very, very long
time as she continued toescalate.
She posted, you know, sort ofcrazy truth or stuff about the
2020 election, and you know, I'mjust saying we have to
investigate all the votes, andyou know, and again, right, you
sort of get this sense of.
You know, you're stretching therubber band.

You're stretching the rubberband.
And then, finally, you know,she went on Instagram and said
Jews were beaten in the streets,not by Nazi soldiers, but by
their neighbors, even bychildren, how?
And then you, you know.
And then a bunch of other stuff.
And how is that any differentfrom hating someone for their
political views?
Um, and disney was was notamused by that right and at that
(17:12):
point.
Uh, you know through she.
She worked for the, for thelucasfilm uh subsidiary of
disney, and the president oflucfilm and a Disney rep came
out and said look, she was neveran employee, right, she was
always a contractor and she willbe a contractor for us no
longer, right.
And then Gina filed a lawsuitalleging three counts.

Two are based on discriminationon political activity and one
is based on discrimination onthe basis of sex.
And here and we could talkabout that a little bit, but I
think it's important to sort oftalk about the different
inflection points that come outin litigation, right?
So I've been trying cases forover 25 years and what happens
(18:01):
when a plaintiff sues is there'san early period in which you
can file what are calleddispositive motions, and they
mean exactly what it sounds likeright, like if that motion is
granted, it disposes of thelitigation in its entirety.
So a motion to dismiss is oneof those things and it's the way
to get out quick and cheap.
(18:22):
Dismiss is one of those thingsthat she said were true.
(18:45):
That still does not amount to acompensable injury as a matter
of California law, and thereason that you have to do that
is because, if there's any doubtover what she said is true or
not with respect to materialfacts, then the court says, well
, look like maybe she's wrong,but we're going to go to a
period called discovery andwe're going to let her prove up
(19:07):
those claims.
Right, and and that's what itmeans to you know, have your day
in court.
Right that, yes, even if it'ssuper far-fetched.
If there's any kind ofreasonable construction of your
facts being true the way theysaid they are, then you're
entitled to assume that they'retrue, before the defendant can
(19:29):
say look, we're not going tocourt at all.
This is just, you know,complete and utter nonsense.
And you might.
You might recognize some of thethings that we talked about,
right, like, such as whether shehas a contract with Disney
Lucasfilm, what that contractsays, right, whether she abides.
Those are all facts.
So those were not things thatDisney could rely on.
And instead, what Disney saidwas assuming that we fired you
(19:53):
for political behavior.
We have a First Amendment rightto do that.
And three weeks ago the courtcame back and said we're not
sure that you've met thatthreshold, disney, right,
because one of the things youhave to do in order to assert a
First Amendment defense is youhave to say that I'm engaged in,
in this case in associationalconduct.
(20:15):
Right, that that think aboutthis from from Disney's
perspective.
What they're saying is we arerepresented by the folks who are
our actors, and their speechessentially becomes our speech.
And so when their speech is atodds with the kind of speech
that we as a company want toengage in, then we have a right,
(20:36):
a first amendment right todisassociate ourselves from that
kind of expression.
And the court said maybe, butwe don't know that you've proven
that as a matter of law yet,disney.
So we're going to let her goforward and we're going to let
the case proceed to thediscovery phase and give her the
(20:57):
opportunity to prove no, youdon't really have those sorts of
associational values.
Now, I don't think that that'sgoing to be a hard lift for
Disney to engage in.
Right To say, hey, we arerepresented by the actors who
feature in our films.
Right, and you can think aboutthat in any sort of number of
(21:18):
ways, right, like if you had thelead actor from a movie
wandering around trashing yourmovie.
Disney would probably say we nolonger want to be affiliated
with someone that's like yeah,don't go see the steaming pile
of hot garbage that we just putout right.
So the question is right is thebucket of speech that Gina
(21:39):
Carano engaged in, is that thekind of thing that that Disney
has a right to disassociateitself from?
So that's sort of where we arein terms of the legal landscape.

Okay, now, uh, so she
goes.
Next is discovery, right.
So they have to basically openup their doors, show, show them
what they've got, and she has toshow them what she's got, right

is going to be very one sided

Most of the public, most of theevidence that Disney wants from
Gina Carano are the thingsshe's already done in public,
right?
So her public posts on socialmedia, they're entitled to
drafts, they're entitled to, youknow, correspondence, that sort

of thing.
But basically what happens isyou serve several different
kinds of documents, but the twoprimary ones are requests for
production of documents, right,give me all your emails that say
X, right, and what goes alongwith that are requests to depose
material witnesses, right, andso typically what you do is you
(22:53):
ask for the documents first, andthere are others, but this is
what you're going to see kind ofin the news, right, you're
going to see, I'm sure herlawyers have already served
those discovery requests onDisney.
They do not have to be filedwith the court.
So we don't know what they say.
We won't know what they sayunless and until the documents
(23:14):
show up at a deposition and then, depending on what the
protocols are with respect tothat deposition, we may or may
not get it.
They may or may not be leaked,they they may or may not be
leaked.
There may or may not be aconfidentiality order that you
know protects the production ofcertain documents and things.
But she's going to, she's goingto ask Disney hey, I want all of
this correspondence and I wantto to depose under oath certain
(23:38):
Disney witnesses.
And we know, for example, shewants to depose Pedro Pascal,
right, her, the, the, the starof, of, of, of the Mandalorian.
And you could ask, right, thereis a doctrine called the apex
doctrine, which, which is againkind of what it sounds like it.
It basically says if you areseeking to depose a high ranking
(23:59):
official right Within a company, depose a high ranking official
right within a company, andthere is somebody who equally
has that evidence, uh, who isnot that high ranking person,
then you should get it from theother person instead, right?
So so she's also, you know,sought to depose the ceo of
lucasfilm and some other highranking disney execs, and so
there will be a battle back andforth about what do you want
(24:22):
from this witness, and you knowcan, can we go to that trouble
to date, right, her, hercomplaints to the thing that you
would think were the thingsthat you would think that Pedro
Pascal has an opportunity toweigh in on, seem to be, seem to
me to fall into really twocategories, right, the first is
(24:44):
to be able to discuss what GinaCarano was like as an employee.
Right, what it was like workingwith her on the set.
And again the evidence appearsto be that she was a pleasure to
work with, right, a joy to workwith in terms of, you know,
actually filming and, you know,getting the production done.
(25:06):
And that is relevant to MsCarano's lawsuit, because the
more she can say I fulfilled allthese other criteria that are
important for bringing someoneback as as an actor, the more
she can say so it was solelyright.
My political expression, forwhich you know I was, I was
(25:29):
terminated.
And then the second thing is,again I mentioned, that her
lawsuit asserts has two causesof action with respect to
political activity and a thirdwith respect to sex
discrimination.
That's really a subsidiary.
What she alleges in that thirdcause of action is Disney has
(25:49):
had lots of male co-stars whohave also engaged in political
speech and have also said stuffon social media and have also
referenced the Holocaust.
But you fired me and you didn'tfire them.
And so that fundamental factualinquiry is going to come down
(26:09):
to does a company have a rightnot to associate itself with
public speech by its employees,which it finds counterproductive
, at odds with its corporatevalues.

Exactly Now.
According to the most recentupdate, the attorneys proposed a
start date of September 29th2025.
Yeah, that's the trial dateyeah, and the trial is expected
to last one week.
So between now and then,they're going to be getting
their witnesses together,getting your documents together.

They have, you know, a year tofigure this out, right?

And this is.
This is a fairly typicalschedule and, again, a week long
trial is, by by large,commercial litigation standards.
A short trial Is, by large,commercial litigation standards,
a short trial.
I do not think this case isgoing to trial the procedure
that happens.
You have to pick a date and putit on the calendar, because the
court then uses that to backout all of the other dates.

So if the trial is in September, then what you would have is
probably a discovery cutoff inJuly and you would have a
summary judgment motionsdeadline in August and that both
sides here are going to gatherup all of their evidence and
then prepare and file competingmotions for summary judgment.
(27:35):
And let me talk a little bitabout the distinction between
those two.
Right, because I talked about amotion to dismiss, comes at the
very, very beginning, in whichthere are no facts in dispute
and you, as the party resistingthe motion to dismiss, right, as
the plaintiff, are entitled toall of the inferences and all of
(27:57):
the asserted facts that youclaim in your complaint to be
resolved in your favor.
So example I give all the timeis right.
You sue me for trespass, right,and you say I jumped over your
fence and you know, was on yourproperty on September 1st 2023.
(28:18):
And if I go to move to dismissand say, no, I was never there,
right?
But the court's going to say,well, look, that's what
discovery is for.
Prove it, right, like, maybeyou've got off my footprint in
your front yard, maybe you have,you know, a ring doorbell and
you have video camera footage,who knows?
Then we have discovery and thenwe exchange all of our
(28:38):
information and suppose none ofthat comes about.
Right, there's no footprint,there's no video, there's no
testimony.
And I introduce a flight stubthat shows I was actually the
time you claim I was in youryard, I was on a plane, right?
Well then, we're not going totrial, right?
I'm going to move for summaryjudgment and I say all of the
(29:01):
evidence is now in and there isno material, there's no genuine
dispute as to any material fact,right, nothing that could make
a difference with respect toyour claim.
There's no evidence to supportthe fact that I was ever on your
property and the only evidencethere is and maybe it's
equivocal you can say, well, thestub is torn, but it doesn't
(29:23):
matter If you've got zeroevidence that says I was ever on
your property and I have someevidence that suggests that I
was not, then I'm going to winon summary judgment, and I
suspect so.
There are a lot of things hereagain that we don't know right.
We don't know what the contractbetween Disney and Ms Carano
looked like, right?
We don't know.
If we don't know what thecontract between disney and ms
carano looked like, right?
(29:44):
We don't know if she was anemployee, as she contends, or a
contractor, as disney contends.
We don't know.
Promises and assurances weremade to her that the contract
may contain.
It is, it is Not something thatDisney has yet previewed, so
possibly it doesn't.
But frequently contracts willcontain a morals clause, right?

We'll say, hey, if you engagein X type of behavior, then we
have the right to terminate thiscontract.
Right, go ahead.

So in other words, a
real Mickey Mouse clause.

So look, all of that is goingto come up against the way that
this argument is being pitchedin media, right, and that is
Elon Musk is bankrolling thislawsuit, right, and has publicly
said, yeah, I'll fund and I'llpay whatever, and there was

nothing Disney can do that canmake this expensive enough for
Elon Musk to even notice it.
Right?
I mean, there just aren't thatmany issues in dispute.
There's not an infinite amountof lawyering you can do on a
case like this.
Do on, you know, a case likethis.

So now I will tell you that youknow Gina Carano has engaged in
some high profile celebritylawyers.
She has Eugene Volokh of theVolokh conspiracy, who's written
some frankly crazy stuff inconnection with this case.
So you know they're throwing asmuch money as they can at both
sides.
But you know, for Elon Musk,you know that's not, it's not
even couch change level money,right?

So he's doing it to make apublic statement that says you
know woke companies are outthere discriminating against

That means your employer can'tsay I'm firing you because

firing you because you've saidyou're going to vote, right,
like I'm firing you because youare engaged in political action
and they can't write a contractthat says in order to be a
Disney Imagineer, you must agreenot to vote.
No, you can't do that.

That's discrimination on thebasis of a protected activity,
your civil right to vote.
Your employer can't force youto give that up.
That's very different fromsaying we're going to fire you
if you spread dangerousmisinformation and nonsense that
reflects poorly on the company,even if, right, that what the

company thinks reflects badly onit happens to be to skew highly
, highly on one side of thepolitical spectrum.
Right.
And again, you know Disney isgoing to be aided here by the
fact that there is a coterie,particularly in California, of
anti-vax far left Democrats,right, going, going back 40, 50

So they're going to be able tosay like it's not exclusively
right wing political opinions.
It certainly correlates highlywith the fact that you know,
gina Carano got maga pilled andstarted spouting off crazy stuff

But but you know again, justkind of ask yourself at that

the National Review or theFederalist or something like

Right, then you would expect aright-wing magazine to say you
know what, we're sure you're aterrific writer, Mr Torres, but

They are entitled to not beaffiliated with my crazy

And I continue to be asskeptical as anyone can be of
that proposition.

Now, look, if there are trulyembarrassing documents that are

out there, right, I could see asituation in which, you know,
disney wants to settle thisearly, as opposed to heading to
a motion for summary judgment inwhich its documents, which will
be on the public docket, right,this is a federal lawsuit, so
anybody with a pacer login oryou know who goes to court
listener will be able to haveaccess to to those pleadings.

They will be all over the press, and if there's something that
you know looks embarrassing,then, uh, you could see reasons
why, why disney might, uh feelcompelled to settle.
That being said, I don't knowhow that will interface in the
in the interest between ginacarano, who does not appear to

be gainfully employed at themoment, uh, and and elon musk,
who would like to use her forfor pr, right?
So you know, I mean, she wentfrom, uh, you know, being in the
deadpool franchise to doing,you know, daily caller kind of
indie films for the far right,and that's a pretty big drop off

I would not be surprised I'venever surprised when civil
litigation settles.
I would not be surprised ifthis settles, but I would be
surprised if it goes to trial.

result in a, uh, in a, in aplaintiff's verdict.
