a bond, yes the first time. Once they violate that bond, they

can be held in jail until theygo to court again. And we get
people on six, seven, eightnine bonds at one time. And that's
a problem that we have to fixin the courts and with the DA's office.
You try to make sure that thesepublic offenders can't be continued, can't
be continued to roam the streets andvictimize our citizens. Hunt says, suspects

in Harris County may not go tocourt for five or six years. However,
criminals in Montgomery County, just northof Houston are held accountable. Crooks
in this area know the boundary linesof Harris County and Montgomery County. They
don't want to commit crimes in MontgomeryCounty because they know they're going to be
held responsible. Precinct four Constable MarkHerman says his office has been forced to

refile more than four hundred criminal casesagainst accused criminals after they were slated for
dismissal by judges and magistrates. That'sexactly what Rodney Ellis wants. This is

A woman who identified her rapist andeven had DNA evidence collected, yet

will refer to as Jennifer, saysa relative's husband raped her. I felt

did they do that? Jennifer saysher family took her to a hospital and
a nurse collected DNA evidence with asexual assault kit. Once released, Jennifer
says she called HPDs several times tosee where her case stood. We'll get
total, we'll take it up toour superiors. We'll let them know,
we'll get back to you. Iwouldn't get back to so I'd call again.
Within the second or third week.I gave up. How did that

leave you? Feeling like God didn'tmatter, Like my situation didn't matter,
even though I had an eyewitness,that didn't matter. Through communication between the
police department and the Houston Forensic ScienceCenter. We know Jennifer's case is one
of the sexual assault reports where DNAevidence was collected, but HPD labeled the

incident with a lack of personnel codeinstead of investigating. Other cases in this
exact same category include a woman whosays she was sexually assaulted by two males
inside her apartment complex as she wastrying to get inside, and another woman
reported being sexually assaulted at a ninetynine cent store. In some of these
cases, like Jennifer's, the victimwas able to identify the attacker. One

incident even involved a woman reporting herhusband as the suspect. And in most
of these forty nine specific cases,we now have details on the DNA evidence
was tested at the Houston Forensic ScienceCenter and the evidence got a hit in
a national database connecting it to anothercase or a known offender. The Science
Center says, once there's a hit, it sends an email to HPD.

We asked the commander of HPD's SpecialVictims Unit last week if those emails just
sat in an HPD inbox, Sowe're currently reviewing that. I don't have
that immediately, but I have askedfor that information. Thirteen Investigates has also
learned that head of the Science Center, doctor Peter Stout, also brought up
evidence hits potentially being ignored. Inan April third email to HPD leaders,

he wrote his forensic analysts are concernedthat they find themselves having to push pretty
hard to ensure that known hits areactually being seriously looked at. HPD's executive
assistant chief email back saying the departmentis taking this issue seriously. Meanwhile,
Jennifer says no one from HBD hasreached out to her since this scandal started

months ago, even though the departmenthas vowed to reach out to victims.
Do you still want to see chargespursued? If you would have told me
a year ago, I probably wouldhave said, note, but I'm bringing
another little girl into this world.I think that they could go through something
like this. I don't want peoplewho do this to keep getting away.

victim of the crime, and thenyou realize that the city would rather spend
money on murals and travel and nonsensethan tracking the person down and prosecuting.

that. So we are in theprocess of this fire code permit for our
barn. Right and that's something that'sbeen you know, taking a bit of
time. Is the bar is thebarn where people uh mostly sit and eat.

So mostly people are sitting out outdoors. We have a barn where you
can sit, and then we haveoutdoor seating and most people are sitting,
you know, in our outdoor seating. Some people do enjoy sitting in the
barn, but most people are actuallysitting outdoors, okay, And has Harris
County allowed people to sit outdoors?So so no, what we were told

by the inspector of the Fire Marshalthat came out last Wednesday was, you
know, we have to close yourbarn down due to this permitting issue.
And we agreed to that. Youknow, we agreed to to to do
that. And then we understood thatsituation. But we were asking for our
outdoor seating. Right, We'll closedown the barn if we need to,

but we want to have you know, our outdoor seating. And you know,
they told us, well, allseating counts is won since you have
the barn, all of your seatingcounts. What is the permit? What
is I'm gonna understand what is thepermit that they want you to file.
It's a it's a fire code firecode permit, and so you need that
for any structure that you have,you know, people sitting in or or

assembling in Okay. And have youall applied for that now? Yes,
and you had not applied for itbecause you weren't aware you had to apply
for it. No, So weapplied for this a while back, and
then the fire Code came back tous and said, you know, you're

gonna have to have this civil sitepermit, So went ahead and applied for
that back in December, and that'skind of been back and forth. And
then the process is just it's it'sa long process unfortunately. You know it's
a busy county, right but holdon, is it a long process because
once you file the document, theydon't give you a response quickly or is

it a back and forth? Youhave to accommodate, you have to you
have to make these changes. It'sboth. It's both. You know,
with the Engineering department, they areincredibly backed up. So there are times
that you're not hearing back from them, you know, maybe even a month
at a time. Have they givenyou things that they want changed per the

actual civil site permit? Not yet, And that's something that our engineer has
been been working on. They cameback to him with a couple of things,
and he went back to them abouta couple of things. And then
that's that's kind of where we're atnow with that for now. Okay.
But and so so they're saying,you can still you can still boil crawfish,

you just correct, can't have anybodysitting on the site. Correct?
And if we felt yeah, yeah, they said, you know you're where
you're playing the croppish, everything's good. We just don't want people sitting here
because you don't have that permit foryour bar. What so are kind of
for the for the barn. Wedon't have the permit for the bar.

And so that's why they're saying noone can sit on the property at all,
but on the adjoining property maybe.So you know, we don't know
the full rules on that. Thisis a great example of them not giving
a damn. They don't care ifyou go out of business. It's a

seasonal business. What day did youopen? We opened? We didn't up
until February this year, and I'mnot sure if you're aware of it.
We'll we'll be around the end ofJanuary time, Jared, I can't hear

about when we open up our seasonand we go to the first week or

turns out I have heard from thecommander of Post twenty four to twenty seven,
Greg Knox, at the Tomball VFWPost, which I understand has been
there for sixty years or so.They have fundraising events, dances, barbecue
cookoffs, events for the community,and the same fire Marshal came by and

said, Oh, you're gonna haveto pay the fee, the tax,
the per match, You're gonna doall that? Yeah, yeah, this
this is why elections matter, folks. This happens under Lena head Allgo and
more importantly Rodney Ella's and I wouldn'tbe surprised if it's happening by design to
shut these things down. I wouldnot be surprised. I don't know that

for a fact. But this isthe kind of anti business climate that you
get when you allow these people tohold office. Because this is what they
do. So, Hans, y'allare only open. I think what Thursday,
Friday, Saturday, Sunday. Whatdays are y'all open? Yeah,
Thursday, Friday, Saturday, Sunday. You know, Thursday, Fridays five
to nine, Saturday is eleven tonine, and Sunday is eleven to five.

Okay, So y'all were open thisweekend. You just had no seating,
yes, sir. I mean it'speople were just hey, can we
sit and it's just like, man, it's the rules of the rules.
This is what they stated. Youknow, it's kind of absurb over the
whole thing of the barn and theoutside seating, the four acres. He's
saying, all four acres. Theycame sit in the back of their truck.

You know. I just told him, I was like, this is
our this is what we're trying tofollow by. I'm not going to stop
you. You don't want to bringit home. I totally understand that.
Uh but I mean, if youwant to sit here, sit here.
I'll go to bat for you,as y'all went to bat for me.
But uh, yeah, it's theysaid you couldnot sit on the barn or

sit out in the outside seating,but again you're allowed them to park in
a parking lot to come out andpick up the crawlfish. So like,
can we just sit on our tailgate? I said, you do what you
like to do. My dumpsters wereover there, and so we did have
some people this weekend. But otherthan that, I mean we didn't.
We closed off the barn like that. Nobody could sit inside the barn what

we did. So you don't haveany idea when they're going to have your
permit approved, if at all.So so we don't. And that's that's
kind of the fine as county permitis. It's you don't know, and
it's typically a long process, andit's a waiting game. It doesn't have

to be a long process. WhenI was on city council, the number
one request I got was no oneever wanted the inspector to cheat or lie
or violate the rules. They justwanted it sped up. They would say,
we'll do whatever we have to doto comply with your stupid codes,
but could you get them to giveus a response, because we're burning daylight
and losing money. And that's whatI'd do. I'd get on the phone

and I had some reasonable folks overthere at the city. Bobby Oaks is
extremely reasonable, and he would say, let me check on it and get
them an answer and move on downthe road. Because you're you're a seasonal
business. I mean, and notonly are you seasonal, you're a few
days a week during that seasonal.So every day for you is the equivalent
of weeks for a regular business.I mean that that should matter. Yeah,

sure, that's correct. Yeah,And that's that is where we're at.
You know, we want to comply. We want to do what we're
supposed to do. We're not youknow, we're not saying you know,
we're not doing it. We wantto just get everything done, everything done
correctly, So everything's you know,done, and we can just open our
business. But unfortunately it is avery long process. Have y'all checked on

a liemporary, a TCO temporary certificateof occupancy so that you could you could
operate out there, So that's somethingthat we have someone checking on for us.
Yes, and that that's something thatisn't the worst because many times you
can operate outside of that. I'mnot saying you shouldn't be angry, and
I'm not saying that they've been fair. But many times when people come to

me with inspector type problems, Ifind that the person they have working on
their behalf is not being sufficiently aggressiveand they're not trying every route possible.
And you just want to make sureyou're doing it right. Yes, And
that's kind of why we wanted tocome on here today is to you know,

kind of tell other small businesses thatyou you need to advocate for yourself.

I went to your Facebook page,and you have communicated You've built a tribe,

That's how this is supposed to work. You're supposed to sell out a crawfish

just based on people coming up tosupport you because they know that they have

eight bucks a pound. Is thatwhat the crawfish is going for? Now?

that's the quality that they're buying also, and then you're gonna have about the
