to jail. He'll be convicted andthe convictions will be reversed on appeal.
He'll be convicted in New York onthis Mickey mouse, horrible case that makes

no sense at all, neither asa matter of law or fact. But
it'll be reversed on appeal. He'llbe convicted in Washington, it will be
reversed on appeal. They'll be therehung jury or an acquittal in Florida,
and probably be convicted and reversed onappeal in Georgia as well, although it's
surely to tell whether the case willactually be tried and Georgio will be sent

to the federal courts. We'll waitand see about that. Now, of
all the cases, the all depundancyto think that the Georgia case is the
most serious your opinion, well,it's the most serious in the sense that
it has the mandatory prison term,but it's one of the weakest. When
you use rico or conspiracy, it'susually assigned that you don't have a strong

case. A lot of people arepraising this case as novel, creative,
imaginative. Those are the three wordsyou never want to hear use. If
you're prosecuting the man who is runningfor president against the incumbent. You want
the case to be solid, fullof precedent, you know. Thomas Jefferson
(09:22):
once put it very well, hesaid, for a criminal statue to be
valid, it has to be soclear that a reasonable man, if he
reads it while running while running,has to be able to understand it.
Well, I have to tell you, I've read this indictment while sitting and
(09:43):
I'm not sure I understand that.I think the best way to explain this
indictment is this. Let's assume,hypothetically, you know, I'm going to
use the Talmudic method or what somepeople call the Socratic method. Assume for
purposes of this argument, that Trumpwas right about Georgia, that in fact
there were mis outing of the votesand there were fifteen thousand accounted votes,
(10:03):
and he ends up winning Georgia asthe result of all of his protests.
People would be praising him for it. So the question is was he right
or wrong? But that's not thecriminal law question. The criminal law question
is did he believe he was right? If he believed that the election was
stolen, If he believed it wasunfair, and he did these very same
(10:24):
acts, they are not criminal becausea crime, particularly conspiracy and rico,
are crimes of the mind. Youhave to agree, you have to intend,
you have to believe, and that'swhy it's going to be quite difficult
to prove it now. Of course, in the county where it's being charged,
Fulton County, it's three to oneRepublicans over Democrats, and so it
(10:48):
may be a little easier to provethan it would be, say in West
Virginia, where it's the reverse.So location, location, location is everything,
not only in real estate, butit is as well in criminal trials.
So here, he believed that hethat the election was stolen, and
that's what they're going to have toprove that. If he believed it,
(11:09):
or if he knew it that itwasn't stolen, and he went and said
it anyway, is that really whatit couldn't boiled down to? I think
so let me give you an example. I believed that I still believe that
the Florida election was stolen from AlGore in two thousand. Remember that after
the count he was five hundred andsixty seven votes or something like that behind.
(11:30):
I think that was a stolen election. I thought so at the time.
I think so now, and Itook action accordingly. You know,
I challenged you might remember the butterflyballot in Palm Beach County. We challenged
the hanging chairs. We sought toput up slates of electors. Professor Lawrence
Tribe suggested that we lobbied the Secretaryof State and others to have a recount.
(11:54):
We were wrong, but we allbelieved we were right, and nobody
suggests that we did anything wrong.Indeed, I wrote a book about it,
called Supreme Injustice, which was abest seller and very positively reviewed by
the New York Times. So,you know, you can't make something a
crime based on an honest mistake.And if Trump's belief in his winning was
(12:18):
an honest mistake, he wins thecase. If, on the other hand,
they can prove me und a reasonabledoubt, it would be hard to
do that. He actually knew hehad lost the election, but Jess lied
about it to himself. But speakingabout lying, you know, it's ironic
that this case, which is allabout lying, begins with a lie from
the prosecutor. Remember the prosecutor lookedat in the eye of the television camera
(12:39):
and said, I'm going to trythis case in six months, these nineteen
defendants within ninety five page rico indictment, I'm going to try it in six
months. She knew she was lyingthere's no case in the history of law
as complicated as this one that hasever been tried within six months. If
(13:00):
it's tried within a year, she'llbe lucky. Every single one of the
defendants will make motions, motions tosever from each other, Their lawyers will
make motions, Their lawyers will havetrouble agreeing on dates for the trial,
because when you have forty lawyers withschedules, it's very, very difficult.
So this case will take a long, long, long time to try.
(13:20):
But why would a prosecutor begin acase involving lying with a blatant lying.
She knew she couldn't try this caseto six months, So what's the purpose
then? What's the reason? Politicalof purpose? She wants to try to
get this case, try to beforethe election because she knows she might lose
an appeal, But she doesn't careif she loses an appeal as long as
(13:41):
it impacts the election. Now,the problem for these prosecutors, it's so
far these indictments have been impacting theelection favorably to Donald Trump, at least
among Republicans. Even among general voters, He's in a tie with Biden.
Ella. Remember I'm a liberal Democrat. I don't vote the Donald Trump.
I vote against him. I wanthim to lose the election. But I
(14:03):
care much more about the constitution andabout the rule of law than I do
about any particular election or any particularcandidate. Now do you see anything anybody
orchestrating all this, because there havebeen those that have pointed out that every
time these indictments come down and seeafter there's some negative story Aboudy the Biden,
about Hunter Biden, and they proveit every single time. Do you
(14:26):
see that there's some collusion, there'ssomebody orchestrating to make sure all these things
happen to get the Biden family outof the news and put Donald Trump back
on the spot line. I don'tthink you need collusion. I think all
of the prosecutors have the same goal, essentially to get Trump. That's why
I entitled my book Get Trump,to try to prevent him from running.
(14:46):
They want to deny ask the rightto vote. You may want to vote
for him, I want to voteagainst them. That doesn't matter. Each
of us has a constitutional right tocast the ballot, and no prosecutor,
no judge, no jura has theright to take that away from us.
And so you know, these prosecutions, all four of them, do constitute
election interference, even if they're notintended as election In deference, the effect
(15:11):
is to prevent Donald Trump from campaigning. They're claiming this case will go in
January, February, March, April, just lead up to the convention and
then the New York case, andyou know he's going to be sitting in
court day after day because unlike acivil case, in a criminal trial,
you have to actually sit in thecourtroom and be there, so he won't
(15:31):
be able to really campaign very heavilyif he has to deal with the lawyers.
Is not just sitting in court,just dealing with the lawyers and lawsuits
and conferring with them. This takestime, and energy is Sapp's energy.
So in effect, even if thetrials is pushed off, there's still a
lot of work that he has todo in between. There's no question about
that. And that's why if you'regonna try a president, if you're gonna
(15:54):
put a presidential candidate, the manwho's running against the incumbent president and trial,
you better have the strongest case imaginable. It certainly should meet the Richard
Nixon standard. Where it was obviousthat he had erace tapes, he had
bribe witnesses, and everybody agreed heshould be impeached or prosecuted, even Republicans
(16:17):
and many centurists did. But todaywe don't have that consensus today, Independence,
some Democrats and many Republicans think thesecases don't warrant prosecuting the president.
You know, I was interesting.I was on a TV show just recently
and somebody asked me about the indictment, and I said, it's a very
(16:37):
creative and novel indictment. And that'sthe last thing you want in a case
where you're prosecuting man running for president. You don't want a novel, creative
indictment. You want a simple,basic indictment that is conventional. I put
it very dramatically. I said thatprosecutors should be C students, not A
students. They should be the onesgive the routine answer and nothing new,
(17:02):
nothing creative. You know, whenthey're taking an exam, they can get
the A plus. But when they'rewriting an indictment, it should be a
C indictment. Where when Harvard LordProfessor Emeritus Alan Nave Dorschus's fifty second book
is called get Trump, and hepredicted exactly what is happening. This is

Lord Professor Emeritus Alan Nave Derschus's fiftysecond book is called Get Trump Any to
exactly what is happening now? Youmentioned a few moments ago, Allen that

you know you're a Democrat and youwould like to see Trump defeated. So
if there will be election, helltoday, donald Trump versus Joe Biden,
I guess you would vote for JoeBiden. Correct. I would. I
would do it with some reluctants.The reason I would vote Democrat is because
I support a woman's right to choosewithin a certain period of time, gay
(22:23):
rights. I support separation of churchand state. I support reasonable environmental control,
reasonable gun control, and I supportSupreme Court appointments that protect civil liberties.
And so the Democrats are better onthose issues. On the issue of
Israel, obviously, Trump was excellent. I worked with him closely. I
(22:45):
worked with Ivy Burke Owoods. Iworked with Derek Kushner. I worked on
the peace processes in the Middle East, and I know what a great job,
but they did. I nominated threeof them for the Nobel Peace Prize.
I nominated David Friedman and av Burke, Owoods and Jared Cushner. They
didn't get it, but they deservedit, and so did Donald Trump deserve
it for what he did. Butyou know, when you vote, you
(23:07):
vote on a totality of circumstances.Since nineteen sixty, when I voted for
John F. Kennedy, I've nevervoted for a president who I thought was
perfect or anything near perfect. Iusually vote for the lesser of the two
evils with a slightly better alternative.And here I'm not thrilled with either candidate
running for president. Although they're youngerthan i am. I'm turning eighty five
(23:30):
next week, Happy birthday, Thankyou, they're a little too old to
run the country, and I wouldlike to see younger people in charge of
critical decision making. So I'm notenthusiastic of Addie to candidate. But here's
the thing, though, and Iunderstand what you're saying about. You like
some of the platforms the Democratic Party, But what happening is though, an
(23:55):
erosion of civil rights. And you'refor rule of law and order, and
here you see the Democratic legislators,and you see what's going on with all
these indictments, and the rule oflaw is being thrown out, and civil
rights and attorney client privilege has beentrampled upon. So how could you still
stay at Democrat when these major majorrights? This is what your whole career
(24:15):
is about sedec, sedectur with justices, pursue and justice. It's just the
opposite of what's happening. I agree, but I think the Republicans would do
just as bad they have. Look, some Republicans are now calling for the
impeachment of Joe Biden. He hasn'tcommitted any impeachable offenses. Both sides are
trying to weaponize the criminal justice system. There are people on both parties that
are distorting civil liberties. I remainwithin the Democratic Party to try to get
(24:40):
them to marginalize the people on thehard left, the woke anti Israel people,
and the people who deny civiliberties.My next book, which I'm finished
with that it isn't published yet,is called the New McCarthyism, and it's
about how what's going on today,particularly from the Democrats, is worse than
what the Republicans did during the OldMcCarthy ism. Because the new mccarthyites are
(25:02):
young and their college students, andthey're going to be our future leaders.
So I am very concerned about theDemocratic Party, but I'm concerned as well
about the Republican Party. Right,they're concerned. But the fact is,
though, is that when it comesto rule of law and what's happening with
this using the justice system in apartisan way, and the Department of Justice
especially so that I think has beentaken to a degree with the Republicans haven't
(25:26):
taken it. Well, They've takenit to a degree in a different way.
I mean, the evangelicals who Ilove on Israel would deny civil liberties
when it affects their religious practices,and you know, they're very right wing
in many respects, they would deny. Some of them would deny a sixteen
year old girl who was raped theopportunity to have an abortion two weeks after
(25:48):
she became pregnant. I can't livewith that. I can't accept that.
But you're right, Democrats have thingsthat are in different ways very bad as
well. But you know I havean open mind. I made one mistake
recently. I shouldn't have voted forBarack Obama the second time around. He
talked me into it. He calledme into the Oval office. He promised
(26:11):
me he would have Israel's back.I didn't realize he meant to paint the
target on so I ran can dropa bomb on it, and I wish
I hadn't voted for him. Thesecond time. I wish I had voted
for Mitt Romney. But I'm gonnawait and see what this election holds.
But at the moment, I'm stickingwith my Democratic principles, and I'm going
to try my best to keep peoplelike Elan o'mair and AOC and other radicals,
(26:37):
even from my own state, ElizabethWarren marginalized in the Democratic Party.
I would not vote to the Democratsif Elizabeth Warren got the nomination, or
if Bernie Sanders got the nomination,or if anybody who was anti Israel got
the nomination, that would be forme. If Elizabeth Warren or Bernie sander
Worth to run against Donald Trump,that means we'd vote for Donald Trump without
(27:00):
without a moment's hesitation. Yeah,talk to me, Hunter Biden. Because
it seems that there's a different standardof justice. That plea bargain, that
plea agreement smelled to the high heavens, and the judge unraveled it. But
how could a prosecute even enter intosuch an agreement where you just absolve them
from past crimes. It just seemedlike a whitewash, and it was unraveled
(27:22):
by a judge. It was Ipredicted it that the plea bargain would not
be accepted. The reason is becausewe don't know what the plea bargain was.
We don't know whether it entailed futurecrimes or not. Prosecution said no,
the defense said yes. If itwas only for filling out a false
report on gun ownership and for failingtimely to pay taxes which you ultimately paid,
(27:47):
then the bargain was fine. Butit was done without investigating Barisma and
the payments that were made on behalfof other foreign countries, then it was
really a whitewash and a sweetheart deal. And that's why appointing this guy,
David Weiss to be the special counselwas a serious, serious mistake. Hey,
it's unlawful. You have to beoutside the government, not inside the
government. He's inside the government.And second, you don't appoint the guy
(28:11):
who made that deal, because he'sgoing to try to justify that deal,
both consciously and unconsciously, and tocreate a sense that, oh my god,
it wasn't so bad after all.If they find smoking guns now,
which they didn't find previously, itwill look terrible for Weiss. So he
would be exactly the wrong person.So how can they get away with that.
It's against the statue. Are you'renot allowed to points life and within
(28:33):
the government Congress can hold them toit. You should have hearings. I've
urged that in which Garland is asubpoena, in which Weiss is subpoena,
and let them justify how they couldmake that appointment in light of all the
circumstances. What Garland would say,as well, he's done it for five
(28:55):
years, so he knows all thefacts, and there's the law. It's
just saving it's a time. Youknow, that's exactly the wrong reason for
doing it. The five years resultedin this slap on the wrist. But

from the ACOU. But they're asmall, poor organization. The ASUS made
a fortune from becoming a get organization. Their only goal is to get Trump.
They'll do anything to get Trump,no matter what constitutional rights have to
be violated if it's for purposes ofgetting Trump. The ACLU is on their

side. Now, just shifting beforewe close out is I've done some program
with some prominent lawyers who have statedthat a Hasidic Jew an Orthodox Jew,
goes into a courtroom a federal courtand cannot really get a fair trial.
They should cut a plea agreement becausejuries a bias. There's a lot of
