Let me first play for you. Now, there are really
three reasons why this all happened to Hunter Biden, and

I've got to give credit where credit is due. Number One,
it was the Hunter Biden laptop and the fact that
Rudy Giuliani's attorney got a copy of it and it
got released to the public. That is pivotal in this
entire case. Number Two, you got to give credit to
these whistleblowers. And three, you got to give credit to
that judge in Delaware that, you know when planned a

fell apart, which was, oh, we're going we're not going
to charge Hunter with anything, and the whistleblowers spoke out, well,
that then prompted them to do something, and that evolved
into what was the sweetheart deal that the Delaware judge
said to the prosecutors, have you ever seen a deal

like this before in your life? And they had to
admit no, Then why is it happening here? If it
wasn't for that judge, we wouldn't be here. If it
wasn't for the whistleblowers, we wouldn't be here. Justice would
not have been served. And the same with that laptop.
If they didn't get it and get it out publicly,
we wouldn't be here either. Speaking of the whistleblowers, let's

go to Gary Shapley on Hunter Biden being treated differently
than to quote other tax chiefs. Listen to this.

The evidence that we collected that were matched up with
the elements of the criminal violations that we referred in
special agency port. This exhibited to the House Ways and
Means Committee, those elements were met and then some if
the these facts were from the local businessman or the

neighbor next door, they would have been charged. They would
have already probably had their entire sentence. So it's it's
it's a little bit challenging when you know, I'm I'm
you know, I'm pro I R s C. I I'm
pro mission, I'm pro agency. I have a lot of
great I've been a senior leader at this agency. I

have a lot of great friends in senior leadership, and
I believe in what we're doing. But I believe in
what we're doing when we're treating people fairly, and uh,
you know, it just didn't happen in this particular case.

The other whistle blower, Joseph Ziegeler, happens to be a Democrat.
I mean a statement earlier this week excoriating Democrats that
have been attacking him was very powerful. He was warned
that the Hunter investigation we get the irs and how water.
Here's what he said to Catherine herrit Why.

Did you want to interview Hunter Biden's adult children?

So a lot of the business seductions expenses related to
the adult children.

and roadblock after roadblock was put up in front of me.

All right, joining us now, Jay, Secular chief counsel American
Center for Law and Justice is with us also personal
friend and attorney of mine. And let me get the
big picture from you. What you the thing about Jay
that I love, He's so thorough. He's read every page
of this multiple times now, and I'm sure you have

more insight than anybody else. What did you find.
Speaker 7 (05:06):
Well, look, I mean they what they played here was
a case that should have been played three or four
years ago. When I said planned and put in the indictment,
played in the indictment. Not like complete bargain. It's a
basic tax case. And if you look at it, it's
it's nine counts. Six of them are figure to file
and pay taxes. Those are misdemeanors, but three of the
accounts are actually felonies, including false or fraugleent tax returns

and one count of evasion of tax assessment. So you
know it's a serious tax complaint. But you think to yourself,
how did this take you know, three or four years
to work up? This was a tax case. It wasn't
some offshort tax case. And when I say off shore,
you know tax havens and tax treaties you had to

get through. This was a basic tax case. And I
appreciate what you said in the beginning of this, Sean
with you know, if it wasn't what Rudy did, if
it wasn't when some of the others did. But if
those whistle blowers didn't come forward, I don't think any
of this would have seen the light of day. At
the end of the day. I mean, we represent some
whistleblowers right now in actions involving the FBI, and these
(06:12):
are brave individuals that are willing to take on this
agency because they lose their positions. I mean, we're fighting
for one right now with the US Court of Appeals
for the District of Columbia. And you have to understand
that when it's really a fight like this, it's those
whistle blowers that put the Department of Justice into this position.
But here's the problem, and this is this is not
(06:34):
a popular statement, but it is the problem. You now
have the leading contender for the Republicans, Donald Trump, was
clearly going to be the nominee, dealing with four major cases,
two federal felony K two cases that are in federal
criminal court, and then two state court proceedings that are criminal,
(06:55):
and then one civil fraud case. And now you've got
the leading Democratic nominee, the current President of the United States,
who has a special counsel still looking around although it
doesn't appear to be doing anything, and his son now
has a nine count indictment. And you think to yourself,
what is the FBI and Department of Justice doing again
(07:15):
with getting involved in all of this like they do.
This should have been brought three to five years ago,
would have been disposed of by now. I still think
it's going to be pled out. I mean, he's got
a very good lawyer in Abbey Lowe, one of the
best in Washington, one of the best in the country.
Speaker 2 (07:29):
Well, by the way, so you're one of the best
in the country, and Rudy's lawyer, Bob Costello is one
of the best in the country. Great, I'll say that.
But however, I would argue that he doesn't have a
great hand here. And inasmuch as you know, look at
all the money that he's taken in, Look look at
what this indictment says. I mean, they let they lash
(07:50):
out at the extravagant lifestyle he's living and not paying
his taxes like the rest of us.
Speaker 7 (07:55):
But at the end of the day, the question is
did you pay your taxes or you did not? And
he did not. So that's where the you know, all
the other stuff is. It's salacious and tawdry and all
of that, but at the end of the day, they've
got to be able to prove a tax case. Now,
apparently there was an unreporting of income. The question is
going to be is and I think I still think
these cases end up getting pled out. I still believe

there's a plea at the end of the day. But
maybe they try it, but I don't see it. I
got a lot of calls on our broadcast today. Is
the President of the power to pardon the sun? And
the answer to that is yes, the pardon power's plenary,
so of course he could. I politically wouldn't do that
right now, obviously. And the question is that the Democrats
use this to say, you know what, Joe Biden's got
too much baggage now he's eighty two years old. When
(08:37):
if he wins, we need somebody else. I'm going to
ask you that.

By the way, we're going to know next week, won't
we Because the House will vote on the issue of
whether or not there will be an official impeachment inquiry.
And if a lot of Democrats that usually circle the wagons,
Republicans create circular firing squads. But if they circle the wagons,
that'll tell us one thing that they're standing by Joe.

If in fact Democrats defect and they want the impeachment inquiry,
depending on the number that may be the first indication
that Joe Biden is being pushed out. That could be
the canary in the coal mine if Maureen Dowd and
David Axelrod and Van Jones were not the canary in
the coal mine.
Speaker 7 (09:21):
Well, and now, James Carvel, listen, you know this because
you and I talk every day and every night. I watch,
of course, your program every night, but I am always
looking at the other networks.

I have to.

That's my job. And I've noticed even on CNN and MSNBC,
they're starting to raise questions about all this, not about
the kid, not about Hunter, but about his father's fitness
to be president. And again, I'm not trying to draw analogies.
You know that we've got all these you know, we
kind of look like Venezuela here as a country.
Speaker 2 (09:51):
But it's not just his fitness. Jay, he lied to
this country repeatedly. I never talked to my son, my brother,
anybody for that matter.
Speaker 7 (10:00):
I'm just saying the reality is, I'm trying to look
at the legal reality is this is a tax case. Okay,
I handle tax cases. This is a criminal tax case.
It's going to be resolved.
Speaker 2 (10:08):
Are we going to have a fire case on top
of that, are we going to have other charges brought? Like,
for example, let's look at Borisma. What do we know
about Borisma? We know that Joe Biden bragged he leveraged
a billion dollars of taxpayer money to get a prosecutor fired.
The net result of that is his son. Okay, but
(10:29):
the net result of those actions were his son, who
had no experience. But he says it himself on Good
Morning America at a time he's struggling with addiction, is
being paid millions. Then we have a What's app message? Again,
no experience in energy, oil or whatever sitting next to
my father. That implicates his father. We're talking about tens
(10:50):
of millions of dollars what Comer describes as you know,
two dozen or so shell corporations. You've got Joe meeting
with Olive garks like Elena Bout Toreena in at the
Cafe Milano and others. Pictures and emails going back and
forth with the moneyman of the company, Eric Sherwin. Over
three hundred of them we learned this week. I mean,

you know, that sounds to me like it's beyond influence
pedaling Jay.
Speaker 7 (11:17):
Well, but the charge here is not any of that.
The charge here is criminal tax fraud. That's what the
that's the complaint. The indictment is based on tax fraud.
So that's where this case ends up. At the end
of the day. You can't indict a sitting president. We
argue that for President Trump successfully. You cannot indict a
sitting president because of separation of powers. So they're not

going to indict Joe Biden on this. They've now issued
the indictment on Hunter. Could they be investigating other things?
They could, but Sewan, the reality is the statue of
limitations on this stuff is getting further and further away.
So they've done one. You know, look again, if it
wasn't for the whistleblowers and Bob Costello and these others,
none of this would have come to light, no question,
this would have been and a judge, as you said,

that said wait a minute something and smell right with
this play. So you got to put all of this together,
and I just go back to the political equation here.
Did the Democrats use this to move Joe Biden off
the ticket?
Speaker 2 (12:10):
Well, I think that's going to be. I think we'll
get a first indication. However, I think that Joe is
going to be dragged into this legally. By the way,
if he had nothing to hide, why would he be
lying even this very week about the issue of talking
to his son and brother about foreign business deals. We
know he's lied, we have evidence that he lied, we
have photographic evidence that he lied.
Speaker 7 (12:31):
Jay Stration John, I get the frustration. But who's going
to charge Joe Biden. You can't charge him while he's
a sitting president. You can't. It's unconstitutional.
Speaker 2 (12:40):
I agree with that. But however, he can be charged
post presidency. And if the American people are.

Yes, okay, if the American people believe that Joe Biden
took official actions that benefited his family, and they probably
would think in their minds and their mind And I've
asked Comer, and I've asked Jason Smith, and I've asked
Jim Jordan. Is this a bribery investigation of the President
of the United States? And they've all confirmed it is,

because that's what we're talking about here, official actions for
the benefit. It doesn't have to be to the person,
but for people involved with the person, and in this
case that would be Hunter.
Speaker 7 (13:20):
Yeah. So I mean, when they can you know, look
likes you said, they could impeace the president. Could you
charge a president after they leave office as long as
statute limitation hasn't expired, you can?
Speaker 2 (13:29):
Well do Democrats want that person president?
Speaker 7 (13:33):
Sure you can. That's what they're arguing with President Trump.
He's out of office, we can charge them, and they did.
Speaker 9 (13:38):
Yeah.

Do you think in any way with all the charges
President Trump is facing that in a lot of ways,
this is going to negate that.
Speaker 7 (13:46):
I think there's this sense that politically that's Yeah. I
think the Democrats will be saying, well, now that we've
lost the ability to say Trump has got all these
criminal problems, and that's a factor now that Binen's family's
got them. So I do think it negates that. But again,
and I go back to, but did the Democrats use that,
as you said, with Maureen Dowd and all these others
talking that we need somebody else, maybe the guy you

had in the debate the other night, Gavin Newsom. Does
that happen at the convention? Remember, Democrats have super delegates.
They can do anything at that convention.
Speaker 2 (14:13):
Pretty unbelievable times we live in, I'll tell you that.
And I've got to believe they have to be looking
at Farrah violations. Also, don't you think I would have.
Speaker 7 (14:22):
Thought that would have been in this indictment. They may
still be doing investigations on that, but it would you
would think that would have been in this indictment. Was
a speaking indictment.
Speaker 2 (14:30):

here we are charges brought by now special counsel Wiss.
But Weiss was on both sides saying on the one
hand that he did not have the authority to charge
in jurisdictions, and he said something else to another elected official,

and Merrick Garland said he always had the authority and
clearly he did not have the authority, and so it's
a lot of people have a lot of explaining to do.
Speaker 7 (15:25):
Yeah, well he had of bringing it. He brought it
in California because that's where the actions took place. And
you're right, if he wasn't a special counsel, he wouldn't
have had the authority to do that. So I don't
know what Merrik Carland was talking about, but he is
a special council now, so they've done it. Are there
going to be more? I don't know. You know, you
always hear about these superseding indictments. I heard there might
have been one today. Nothing. I've heard nothing since then,

So you just don't know. But the fact is, I
do think it negates that it takes the whole issue
of pending criminal matters kind of off the table politically.
I don't think it helps Biden. It helped Trump. I
don't think it help It's helped Trump, and every time
he's gotten indicted, his number goes up. I don't think
this helps Biden. I do not.

it just goes to show you for example, if you
just played Joe Biden's you know, Blunder of the Day,
you know, you get a lot of kicks and giggles.
People would laugh at it, and they refuse to do something.

my life. It's I look deeper and go, is this
is this? Or do they fear something? Are they being
are they being told well, this comes from the higher up,
so who's running the show at the end of the day.
But it just it doesn't make sense. It makes zero sense.

and it's got a great message.

of it watching it with their kids.

Saw it, and we loved the message of that movie.

It was such a good hearted, loved the whole cancel culture.
It was really good. So once I heard that, and
I didn't see it yet, I still haven't seen at
that point, I haven't seen it yet, so I was
I was super stoked to hear other people bring it up.
So it's definitely hitting people. And whoever watches it likes it.
So it's good. And you are to a credit for that.

Well, I don't know how much credit I really deserve
it all this, I have a minor role. I'm going
to leave the acting to the professionals like yourself, the
comedy to professionals like yourself.

if you can't, they say love is blind, hate is blind,
you can't look at this administration. I go, well, I

that we're all in right now that crushes, the climate
change crushes. And to be honest with you, I never

Well, you know, look, do I think this? I think
the Hunter part is the low hanging fruit. But the
low hanging fruit was out there forever. What bothers me
is they purposely ignored the low hanging fruit. But I'm

say this is the Joe Biden bribery and money laundering

scandal allegations, I say it for a reason because that's
what this is about. And that's where ultimately, if we
have justice will lead in my opinion, based on the
evidence accumulated by the House Waves of Means Committee and
Jason Smith by the House Oversight Committee, and James Comer
by the House Judiciary Committee. And that's of course Jim Jordan.

So that's where I think it's all headed.

I'm just concerned that they won't impeach him. I mean,
you know, they impeach Donald Trump will make it a
phone call. And here we've got a president who is
actually involved in criminality. He's got millions and millions of
dollars that he cannot prove where he got it from

it's just it's distressful to see it happening, and we

know it. He lies all the time about it. He'll
never admit it. He'll never admit it. Even if they
convicted him, he would never admit it. He would say
they were line.
