sentencing of Tina Peters today, obviously Colorado story which is
now a national story as well, and our text start

blowing up on it. Also. I just read the one
Dan nine years for Peters. What did the truck driver
get for crashing into cars on I seventy and killing four?
I address that and then several others along similar lines, Dan,
most people in Colorado only get two to six four robbery.
She got nine for preserving the days and the dominion
voting machine outrages. I don't know the ins and outs

of her case. I don't know the particulars. Didn't follow it.
Our next guest did, though, a.

Couple of quick observations from some texts we had. Dan,
I want to get your thoughts on this. If Donald
Trump wins, does he pardon her? And if so, when wouldn't.

The ability to because it's a state charge, Well then
they can't do that, right, right, awesome table. That's right.
Jimmy Sangenberger kind enough to join us, and Jimmy has
been following this case from the very beginning. Jimmy, you
were in the courtroom today, so appreciate your time. Tell
us all about it.

Yeah.

Speaker 4 (01:19):
Absolutely, it was one of the most fascinating things that
I could have witnessed. I was there for the few
hours that this went on, and I have to tell you,
I really do believe that justice was done here, that
it was handled appropriately, and that let's be clear about
something for folks listening, this had nothing to do with

Tina Peters preserving election records. What she was convicted on
were particularly felonies surrounding the misleading of public officials, people
who worked for the county and for the Secretary of
State's office to get some body named Conan Hayes into

the election a secure election facility to pretend to be
somebody else named Gerald Wood. This is not something that
was just oh, she preserved data. This comes down to
an elaborate scheme that was surreptitious, and the scheme itself
the things surrounding it were illegal. She was not convicted

(02:23):
for champering with election machines. Or with backing up data.
She was convicted for the things that she did to
pursue that, and I think that it needed to be prosecuted.
And this needs to send a message to others around
the country that if you have questions and concerns, addressed
them appropriately, don't go down an illegal path like Tina

(02:47):
Peters Well and Jimmy.

Speaker 1 (02:48):
Let me understand because I have not followed this case.
So what she was convicted of was gaining access, getting
somebody access to a secured under false pretenses. Is that right?

Speaker 4 (03:03):
I mean, it's sort of like that's what it boils
down to. It was multiple felony counts of influencing a
public servant. So there were employees of the Secretary of
State's office and the county Clerk's office, for example, who
were told certain stories about who this guy was and
what was going on, where they even testified in court.

(03:24):
Had I known what was actually happening, I would not
have participated.

Speaker 1 (03:28):
In Why I so sorry interrupt Jimmy. Why allegedly did
she want to get the guy in there?

Speaker 4 (03:37):
Because what she claimed she wanted to do was to
preserve election records that she's supposed to keep under the law. Which,
by the way, everything that she's supposed to keep under
the law was already saved. She did not need to
go about this. The things that she claims she needed
to keep she did not need to keep under either
federal or state law. And she wanted to do this

(03:58):
in a way that had some so called cyber expert
named Conan Hayes to get in there and make the
before and after images of the hard drive before and
after a software update called the trusted build to the
Dominion software in computers.

Speaker 1 (04:15):
Okay, So total sentence is what jimmy, So it really.

Speaker 4 (04:20):
Works down to about eight and a quarter years in
prison and then an additional sixty days to six months
in jail before that. So we're looking at nearly nine
years behind bars, presuming she serves all the sentence. There
was a request for a stay on the sentence that
the judge denied, and you can bet though that her

(04:42):
legal team will file an appeal. But quite frankly, Dan,
I don't see the grounds that she would have foreign appeal.
She's claiming that there was evidence that she was supposed
to be able to present, there was exculpatory and that
she was denied and any evidence that was denied by
the judge was because it was immaterial to the facts
of the case and the charges that she had been

(05:03):
presented with. Because keep in mind, just a final point
to put a pin on it, this was not about
the machines and the data she got in and of itself.
It was about the scheme and some of the things
that she did surrounding that, including an identity theft charge
as well.

Speaker 1 (05:19):
Jimmy Sangenberger with us. He was in the courtroom today, Jimmy,
was Tina Peters taken straight to jail?

Speaker 4 (05:28):
You know, I didn't. I couldn't actually tell. I was
a little so much was happening with the crowd moving
and paying attention, I couldn't exactly tell if that happened
or not, be honest.

Speaker 1 (05:39):
And what was it like in the courtroom? Yeah, just
describe that a little bit. That the perch that we
can't pick up just from the.

Speaker 4 (05:48):
Press, including media. There were over one hundred people in
that courtroom as well as it included some of the
people who gave a victim impact statements or some of
Tina's character witnesses, Tina Peters herself and she actually spoke,
and then families of some of those folks who who
were giving their statements and what have you there, So

(06:11):
there were a lot of folks in there and it
was very quiet. There was some laughter that even someone
texted me saying they were watching the live stream of
the sentencing because it was live stream online and they
could tell that Tina was laughing during some of the
speakers that the prosecution had been presenting, and specifically someone
had said during Scott mcginnitt McGinnis, the now county now

(06:33):
former county commissioner, who was one of those witnesses brought
up by the prosecution, So there was some of that
brought up a board. Scott was brought up as a
former county commissioner to show about the impact that this
had while he was county commissioner on Mason County. Cody
Davis was also brought up he's still a county commissioner,

(06:54):
to show the impact. This costs one point four million
dollars plus so many any other costs that you couldn't
exactly calculate, and so that's why they brought They brought
up Matt Crane, the County Clerks Association executive director, who
spoke about the impact on County clerks and then Gerald Wood,

(07:15):
whose identity was used to get in Conan Hayes and
his wife Wendy also spoke on behalf of the prosecutors
as as a victim impact statement witnesses. Because there are
victims in this crime, they're just not what you traditionally
might see or think about as victims from say like
me being a three time auto theft victim. Your car

(07:36):
is stolen, that's a clear example.

Speaker 1 (07:39):
And where are you driving to right now?

Speaker 4 (07:43):
I'm heading back home is a Denver Grand Junction and
I'm stopped in Vail right now.

Speaker 1 (07:48):
Oh okay, because I was saying, if you're going to Denver,
get ready for number four. But yeah, yeah, So when
you talk about the victims, I assume you're referring back
to Scott McGhie and Crane, et cetera. Who we're talking
about the impact on the county of this.

Speaker 4 (08:05):
Yes, the direct victims that they put up that we
were actually people who had been personally impacted in very
visceral ways, would be Jerry and Wendy Wood, whose families
had been turned upside down. I mean, their kids, electronics
were taken and never returned. There's so much that went
on in that regard, and then of course Tina Peters

(08:28):
had several witnesses that her side had brought up, and
quite honestly, Dan, I don't think they helped the big problem.
And this is what the judge got to when he
did his very just I mean, i'll they pointed and
biting sentencing with he walked through the explanations of what

(08:49):
would be required in order to get probation, and why
she wasn't going to get probation, what's required for prison time,
and why she was going to get prison time, and
he kept hammering home that she showed absolutely zero remorse.
I mean, fundamentally, this is the kid who gets caught
by the parents and punished, their iPad taken away, sent
to their room, whatever, and they're just upset because of

the punishment and have no remorse or consideration for what
they did wrong. That's basically what the judge was calling
out today, and I think he was really right on
that point.

Speaker 1 (09:20):
Quite frankly, Well, Jimmy appreciate the time today. I know
we'll try to get Tina Peters on and see if
she's able to talk. I do have a note from
a Texter who says Tina. Yes, Dan, Tina was taken
into custody immediately.

Okay, that is what I thought, but I didn't want
to say for sure.

Yeah, and I'm not sure it was the case how
all that stuff works. But if she is able to
do an interview, we'd love to get her on and
get her take on all of this. Jimmy, Hey, appreciate

I know you must be going through something tough as

the other night. See so many of these lefties. They
just think that every Christian is an idiot, every Christian's
a dummy, Right like Walls the other night in the
debate quoting the Bible, whichoever you do to the least
of my brothers, you do unto me. Wait a second.

This is a guy who uses has God given talents
and powers to be able to legalize baby slaughter up
to the moment of birth, and in Minnesota you can
kill them after they're born in the sense that you
don't have to give him medical care if they survive
an abortion. And he has the audacity to go out
there and quote the Bible and a debate to justify
as lefty policies. Yeah, people like Walls and Whoope Goldberg

think all Christians are idiots. Hey, yes, I listen. I'm
no biblical scholar, and I'm obviously a work in progress,
and hopefully God is not finished with me yet. But
even a guy like me understands that, yes, resoundingly, yes,
no doubt about it, Jesus Christ wants us to save
these babies. Whoopee? In what world do you think Jesus

Christ would say, now, kill him, kill all the babies
you want. Yeah, I mean she's going to play the
God card. Who do you think is responsible for these babies?
How do you think these babies end up becoming babies?

It's she claims apparently to believe in God, that's the
premise of her comments. But then yeah, well, if you
believe in God, then these are God's children. And you
doubt that Jesus Christ would say, no, I don't want
them slaughtered, save them. That's madness. If her point is
you should also be compassionate to people, well, hey, a,

I agree completely. B I will bet you, as a
guy who was a Democrat for many years and still
has lots of Democrat friends, family, etc. I will bet
you that you have as much or more compassion. And
I think more on the Republican side on the conservative
side than you have on the Democrat side. And I'd

sure love to see Ryan. Would you coll her up
and ask her. I would love to see what be
Goldberg's list of charitable contributions. WO love to see that,
because you see that all the time with these lefties,
right they want to give away all your money, and
they quote the Bible and everything else. But when the
runs ones running for office have to disclose their tax
returns and show charitable contributions, oh yeah, they gave three

bucks over here and five bucks over there. Yeah, so
they want to give all your money away. But then
they talk this big game, but often it's crocodile tiers
from the left. So yeah, I'd love to see all
of Whoope's charitable contributions. You know, if it was not
for and this is certainly not to minimize or disparage
any other religion or faith, et cetera, but if it

was not for Catholics and other Christians, this society would
it would be it would fall apart at the seams.
I mean, for example, if it was not for Catholic
charities in Colorado, Denver would literally fall apart, and other
parts of the state would as well. So what you
got with Catholics and Christians, whoopee, is you got people

who go out there and walk the talk. They go
out there and they clean people who pissed all over
themselves because they're ill or mentally disabled or whatever. While
you sit up there in whatever fern bar and mansion
and smoke or drink or eat whatever you do. They're
down there in the trenches, these Christians and Catholics and
Catholic Christians, they're down there in the trenches doing all
this hard work and then you mock them. Yeah, just

so typical. But you know what, here's the thing. These
Catholics and these Christians, they don't need your approval. And
this is another thing the left just doesn't get, just
doesn't get. And I think it's listen, you got a
lot of very good Christians and Catholics who happen to
be registered Democrats, etc. But what I'm telling you is
what the left does not get, and the secular left

that controls the party, the teaching of Christ is, the
teaching of Christ is, Yeah, you're going to get persecuted
for this. You stand up and you want to save
the babies, and you're going against the culture because the
powers in the culture are kill them all. Yeah, kill
them all, do whatever you want to do. Yeah, you're
going to get persecuted for standing up for the right thing.

Do you say so? Do you think there are Catholics
or Christians out there saying oooo, whoop, be's mad at me. No,
it's like, hey, this is great, woop, be's mad at me.
Because when you're getting when you're getting abused, when you're
getting persecuted because you're doing the right thing. That then
you know you're doing the right thing. That then you
know you're doing what you were put here to do.

It's like Grian what Archbishop Shephew said once, and I
thought it was a beautiful point. Hey, life is not
supposed to be like a first class plane trip to
Europe or something.

Life is supposed to be a battle. It's supposed to
be a battle to do good things and stop bad things,
and there's supposed to be a lot of joy along
the way. Because, as he said, I think he was
quoting somebody else. Actually, there are no unhappy saints. So whoop?
Being the left think that, oh, Catholics and Christians and
you know, people who vote report Republican. They're just going

to go away because of abuse they take. Hell, no,
they're gonna fight even harder because if you do believe
in Christ, Whoopy, then you believe in what he told you,
which is you are gonna get put on blast by
this world. If you stand up for me, if you
stand up for what's right, you are gonna get brutalized
in this world. But that's why people like you Whoopy

and others on the left to mock us and try
to intimidate us and everything else. You're the ones who
are missing it.

You as a Catholic, myself as a Christian, I hear her,
and not only does it ring hollow, but these are
the same people that accuse people like you and me
of trying to man splain to women. And yet this
person who's not a Christian, who's not a Catholic, who
knows nothing about your faith or mine, is trying to
lecture and dictate to us what we should believe and

what she believes Jesus Christ stands for. It's so insulting
on such an infinite level to me, and she just
doesn't even acknowledge the irony.

I will bet you, I will bet your burger that
that within a week of election day, we're going to
see the same line in the New York Times that
we saw after Election Day twenty sixteen, and they're going
to come out and say, you know that the Democratic
Party just doesn't understand faith. But that's why you have
people like what Pee Goldberg doing this. You've got others

on the left doing it. You know, we saw Jared
polus as well do it where he came out just
after he was elected governor and says, hey, you got
to keep your faith out of the public square. Because
what these these leftists understand, no matter what faith they
are or no faith at all, what the lefties understand
is they have to separate. They have to separate people

of faith from their God in order for the left
to win. They have to convince people of faith that
it's wrong to vote their faith in order for the
left to win. So that's just part of what you're
hearing here from Whoopee and others on the left. And
the beautiful thing is it ain't working for them. And

So, Gabe Evans born and raised here in Colorado. Twelve
years US Army and Colorado Army National Guard. Another ten
years in law enforcement with the City of Arvada. Married
with two boys. Two. I stepped away from law enforcement
because crime in Colorado is just out of control as
a result of a bunch of far left progressive defund
the police style policies. We're the third most dangerous state

New York State, Illinois, Washington State, Oregon, and I couldn't
make the difference I wanted to make as a police
officer because it had been handcuffed by some of these laws.
So ran for and won my state House seat. I'm
a current state representative representing from the edge of Commerce
City up to the edge of Greeley and now running
for Colorado's eighth congressional district, basically the same area all

the big cities in Adams County. Adams County have Westminster, Thornton,
North Glen, Commerce City, Brighton, fed Heights up to Greeley
up to and including all of Greeley in Wells County,

Gabe, you know, watching these commercials just saturating virtually every
game I see, you would think, you, Dearra Caravel, your
opponent does sitting congresswoman. You would think she spent her
entire career down at the border personally driving illegal immigrants
out of our country. But what is the truth about
her policies.

Oh, the truth is that she has embraced every open
border and sanctuary state policy out there. One of the
reasons that I was not able to continue making a
difference in my community as a cop is because she
passed the law that makes it illegal for law enforcement
in the state of Colorado to work with her coordinate
with Immigration and custom So we see the gang activity

that's going on in Aurora, it is illegal for the
Aurora Police Department to call up Immigration and Customs and say, hey,
come get your guy into.

Speaker 1 (20:53):
Portom That's suicide. It's insane.

Speaker 7 (20:55):
They're not allowed to coordinate for immigration related cases. She's
voted against funding for border security. She's actually called for
defunding Immigration and Customs and the border patrol. So from
start to finish, you know, she's trying to pull the
wool over the voter's eyes right now because her failed
policies are tearing our communities apart now and people are

starting to catch on.

Speaker 1 (21:18):
Yeah, aimen to that cave Evans. Our guest, My guess
is that the vast majority of folks listening right now
probably already support you. So the big question is as
a practical matter, how can the rest of us help
you win?

Speaker 7 (21:32):
So, I mean, at this point, it's all about making
sure that voters who haven't heard about me, you know,
get a chance to get to know me a little
bit better. So that's things like knocking on doors, helping
a voter outreach. If you can contribute to the campaign
to help keep our ads on the air, to keep
us with our digital reach, with our radio reach, our
newspaper reach, all of the different ways that we reach

out to folks to introduce myself to them, those are
all fantastic things to do. You could donate on my
website elect gate Evans dot com and then you can
also send an email there if you have some hours
to spare and want to get involved with the campaign.

Yeah, see there's I'm no political expert, but I think
this boots on the ground thing is huge. And so
you're saying if people just go to the website, there'll
be a way to let you guys know that they're
willing to come up there and just literally go door
to door.

Yeah, it's door to door, and there's so many other
ways that you can get involved as well. You know,
if you can't walk if you can make phone calls,
if you can do test text, if you can fill
out postcards. We've got the full range of options available
to us to do voter outreach and again introduce myself
to folks and what I stand for.

Awesome, And I know I have a texture on this
as well, but I knew otherwise. You've got this big
rally coming up Sunday five point fifteen, and Thornton Speaker
may be there, right, Mike Johnson.

Speaker 7 (22:50):
Yeah, this is a national always been a national top
ten battleground seat. About six weeks ago, the Libertarian Party
and I were able to come to an agreement. We
sat down, we talked over things. We focused on what
unites us rather than what divides us. We found agreement
on about ninety percent of issues. We want smaller government,

(23:12):
we want more accountable government. We want to make sure
that we're taking a close look at some of the
government agencies out out there and ensuring that their policies
are actually doing what they're supposed to do, things like
auditing the FED. And so because of that, the Libertarian Party,
excuse me, the Libertarian candidate agreed to withdraw from the race.

(23:32):
He's thrown his support behind me. I'm truly honored to
have their support and as a result, this race has
moved from a national top ten race to probably like
a national top three race because of that. Like you said, Speaker,
Johnson's going to be out here on Sunday.

Living crime immigration. This is what I hear when I
knock on doors, and I know how to fix it

as a competent soldier.

No exactly, You've been in the trenches, You've been doing it,
so now it's just a matter of finding a way

didn't mean to do that. No, Obviously, all Catholics are Christians,
not all Christians are Catholics. And if you just joined us,

of the left, and listen, this can be Catholics on
the left, Christians on the left, others on the left.
It's just the left at this point that mocks and
belittles people of faith, especially Christians, and zeroing in in

particular on Catholics, but all people of faith because the
left knows they have got to separate people from their
faith or the Left cannot win. And the beautiful thing is,
it ain't working. It ain't working for the left, and
we have so much evidence so that we are going
to do I think a full segment tomorrow, meaning in
a full hour or so on all of the great evidence.

I mean this is from the polling data, voter registration data,
early voting returns, etc. And of course you don't know
how people voted, but you know how many Republicans or
Democrats did. All of this powerful evidence that Donald Trump
is closing in on a victory and potentially a very
large victory. And it's going to be a fun segment

because it goes beyond just the latest top line poll numbers.
Texter says, uh Dan wam bah bah bah Bah. Are
you accusing what be of not donating to charity? How
do you know? And how is it your business? I
as I said, I don't know if she does or not.
Here's my point though, when you look at these lefties,

the vast majority of these lefties, including here in Colorado,
these elected lefties, when they have to disclose their tax
returns and you look at their charitable giving, Yeah, take
a look at that. Take a look at Biden's charitable
giving or Harris's or Obama's whatever. You know that they
all their crocodile tears and talking a big game and

wanting to, you know, transfer your money to their causes,
et cetera. But what do they give out of their
own pocket? You know that? That's That's what I think
is always so revealing. And am I trying to say
I give enough to charity?

I think I give a significant amount, but it's nowhere
near enough. I can do better, but I do better
in most of these lefties. That's for darn share eight

Jimmy will fill in sometimes when I'm gone, but I
never get to hear it because I'm gone. It's Jimmy
enough for Trump.

that conversation with him. He might be where Mandy Connell
over at KOA is, where she's not crazy about him,
but she's voting for him.

And I think there are a lot of those people,
and God love him, and I respect the how I
heck out of those people because it is hard. It's
hard if you have big disagreements with somebody, or maybe
you just viscerally don't like somebody, it's hard to then
vote for them just because you know their best for
this country or maybe best for you or best for both.
That's a hard thing to do. So I really admire

the people who don't like Trump but are going to
vote for him. Also, I'll ask Jimmy about that next

Peters trial, I will predict he's disappointed she wasn't sentenced

to have some criminal law expert on etc. I don't
know all the ins and outs of sentencing. I'm not
sitting here in any way critical of the court or
the process. What I'm critical of is you look across
America and you see all these places, all these places
where you've got lefties like Hunter Biden, and Joe Biden,
Hillary Clinton who have obviously committed crimes that they're never

held accountable for it. In Joe Biden and Hillary's case,
not at all. In Hunter's case, you know, why isn't
he in jail? And then at the same time you
have a guy like Donald Trump, you know, facing all
of these bogus charges. You're on the Dan Capla.

The way you reverse engineer that too. Let's say, Mike Johnston,
Denver mayor, would they be as enthusiastic going out of
their way to bring these immigrants in if they say
we're going to be like Cuban Americans and vote Republicans?

they thought the folks they were bringing in here, unvetted
right mass numbers from south of the border were more
likely to vote Republican, we'd have the biggest, strongest wall
you've ever seen in the history of the world down there,
right And listen. My point is not that the Democrats
are bringing in a whole bunch of illegal people right

now hoping they vote illegally right now. My point is
that they're bringing in a whole bunch of illegal people
right now, meaning illegally here and then they just wave
a wand as JD said, and give them legal status.
But they're bringing all these folks in with all the
harm being caused to the country in the different ways
you've discussed, because they believe they will eventually become Democrat voters.

Now in the meantime, you think these people on the
left are going to be losing any sleep if some
of those folks vote illgally, No, I don't think they
will lose sleep over that. And I think that's another
reason why you see all this opposition on the left
to requiring voter ID. So here is that so God

an abusive process to try to jail him because they're
concerned they can't beat him at the ballot box, and
with each passing day they're concerned that they can't beat him.
