What's going on in your life? Major? Mark Major?
Speaker 1 (00:33):
Back at the home studio. What's going on, Sir oh Man?
Speaker 5 (00:36):
Good day, great day today plan. We got dimitar in
euro Plumbing. He brought along one of his sales guys
and they do stuff. Tom, I didn't even know they didn't.
We'll dive a little bit into that. But the government's
open back up. That's a good thing, wouldn't you say?
Speaker 1 (00:53):
Yep, yep, Yeah, we're gonna We're gonna have a lot
of money being doled out, a lot of people be
back to work, a lot of people for the holidays.
Speaker 4 (01:02):
It's good now.
Speaker 1 (01:03):
Listen. I came across this real estate real estate thing,
and I talked to Frank drand in the real estate
man this morning about it. What is he wait? He
waited on I'm going to bring up Dan. Dan brought
it to my attention. He was one of many people
who got nabbed. Well, I can't say they got nabbed
because they didn't go through with it all. So let's
just talk about that. Dan, explain what happened? You had
(01:27):
your house listed for sale? Is that right?
Speaker 6 (01:30):
Yeah, that's correct?
Speaker 1 (01:31):
Okay, And what happened? What tell me about this strange
phenomenon because many other people are experiencing it. People, if
you have houses for sale, listen up, go ahead.
Speaker 6 (01:41):
Dan, Yeah, essentially, you know with how getting into two
ends of the weeds on it. You know, we have
a luxury home in the South Metro area. It's been
for sale for a while. We had somebodycome books showing.
They provided a lender letter, which is typically what we ask.
They came to the showing here for about twenty minutes.
(02:02):
We didn't really think much of it. The real estate
agent contacted our agent said, hey, they're highly interested in
your house, but they're currently under contract with another home,
and they're under contract with that home, but they have
some issues with the inspection and she felt like it
was going to fall through. Two days later, they scheduled
to come to another showing at our house, but then
(02:24):
canceled and said, hey, we're going to go ahead and
make you an offer. They made us a full price
cash offer, but their condition was they wanted us out
in two weeks. So they want us out right before Thanksgiving. So,
needless to say, you know it, usually you get about
thirty days to move. So we rapidly we accepted the offer.
We said, hey, let's get after this, we start packing
(02:45):
up our whole home. We start fire sailing some things
because they didn't want They hit all things that you
would want in a house.
Speaker 5 (02:53):
What was their earnest money? Out of curiosity?
Speaker 6 (02:56):
Yeah, so there was earnest money. They provided their account
information to the mortgage company for their earnest money. The
problem is is that nobody checked whether the earnest money
came in. So meanwhile they schedule an inspection of our house. Unfortunately,
our real estate agents reached out and he said, hey, listen,
(03:17):
we have an inspection tomorrow and I just want to
make sure the earnest money came in.
Speaker 7 (03:22):
They look at it, they.
Speaker 6 (03:23):
Don't have enough information, and so they reach out to
the buyer because there was no earnest money and the
buyer has just completely vanished. So we start digging in more.
This is where it gets really suspicious. And find out
that the house before hours they had actually gone through
inspection and it backed out, but they had provided a
(03:45):
check for earnest money which had insufficient funds. So we
start looking at it, going, this is something that we
don't know what's.
Speaker 4 (03:53):
Going on right exactly though, I don't get it.
Speaker 1 (03:57):
I asked Frank drand the real estate man, because we
are getting a number of inquiries, and Dan said, these
people probably tied up ten properties. I talked to a
broker down south who said that they tie up properties,
and I said, what is their game? What what good
is tying up properties?
Speaker 4 (04:14):
Okay?
Speaker 1 (04:15):
One one said they want to gain access to the
home eventually without their broker or without a broker, where
you're going to trust them. You're thinking, this house is
the sale is going through, and then they they clean
out the house or they they rob you.
Speaker 4 (04:31):
That's one scenario. Another one is.
Speaker 1 (04:34):
They're they're they're literally shopping and trying to keep people
off balance and then at the last minute, accepting one Dan,
when you talk to your when you talk to your guy,
what did they or woman the broker, what did they
say they thought was going on?
Speaker 6 (04:53):
Well, you know, Mike broker, actually he was concerned that
it was a scenario like you said, where he maybe
they tie us up in some kind of legal h
to where they end up having some kind of ownership
of the house or they you know, where there's a
fight over the home. He also was concerned that just
in the weird climate that we're in politically, that it
could be just somebody that is, you know, out to
(05:15):
get people with luxury homes.
Speaker 5 (05:17):
And you know why, I just for the life of me,
I can't wrap my head around why someone would waste
all this time. It's crazy, Frank says, he gets them
all the time. They tie up a home for where
they go, Well, we think access, that's what we think.
Speaker 4 (05:34):
To go in and rob it, to rob it eventually.
Speaker 1 (05:38):
Yes, or to yeah, or to gain access or to
gain access to it or gain knowledge about it for
the next owner.
Speaker 4 (05:45):
But it's some kind of casing.
Speaker 5 (05:47):
And Dad, you met these people, you were actually you
met him at one point or never?
Speaker 1 (05:52):
Yeah? Were they at the house? Did you know?
Speaker 2 (05:55):
No?
Speaker 6 (05:55):
I did not meet them. They were you know, we
we kind of thought it was fishy because you know,
we had to pack quickly, and so we told them
that during the inspection we were going to be in
the home, but then we would stay out of their way,
we'd stay in the garage.
Speaker 5 (06:08):
See that's the other thing though, I think of what
he just said, Tom. He basically said, they wanted them
out quick, within a couple of weeks.
Speaker 4 (06:15):
So they're getting all their stuff out of the house.
Speaker 5 (06:18):
What the hell are they going to robber his identity?
Speaker 1 (06:22):
Theft?
Speaker 4 (06:23):
You know, Well, whatever it is, it's happening.
Speaker 1 (06:26):
It's so weird. And that's why I had him on
because I talked to Frank. Frank says they get squirrellly
increase all the time. Now Frank has a system where
he pre qualifies get information or broker information on the
phone right up front, and never ever, ever, will will
fall into this, because he said he's had other people
(06:50):
who've had listings tied up. They tie it up sometimes
for sixty days. You think in your house is sold,
and then all of a sudden they disappear and they're
tying up several properties.
Speaker 5 (07:02):
Hey Dan, are you pissed off at your guy or
your gal because they didn't check on that earnest money.
Speaker 4 (07:07):
I'd be pissed.
Speaker 6 (07:10):
No, I actually I was really happy with my realtor
because they did check before they were allowed to have
access back to Oh.
Speaker 4 (07:17):
That's right, you said that. But the last pople they
did the.
Speaker 6 (07:20):
Other realtor, well, the other realtor I'm upset with because
they brought them to our house after they had basically
fraudulently tied up another house. It's the same realtor.
Speaker 1 (07:30):
Yeah, think about that. They're just tying up houses. And again,
if anyone knows what this game might be, Frank Durand suggested,
possibly they're just trying to find the best deal and
they're tying up houses and then negotiating the best deal
and they have several going at the same time. Or
he said, in some cases, people want access to a home,
(07:51):
and after you get down the line a little, you
relax your requirements to have the broker there. And sometimes
the buyers or the straw buyers can ain't access to
a home and possibly steal and then as Dan said,
when they get into the house, it could be they're
going through paperwork and stuff to do identity theft, whatever
it is, there are a lot of phantom buyers. That's
(08:14):
the message I wanted to give that you have to
get your broker. Your broker has to be able to
screen these people up front, and Frank has a system
of doing it. And also for showings, there's a showing
service that Frank uses and he says a lot of
real estate people use it. And this showing service verifies
everything about the listing broker excuse me, the buying broker
(08:36):
coming to see the house, and verifies the license number,
verifies the person their office address, and then you know
somebody's coming. Legit. Never grant access to your home without
a broker. And if you do have a broker come
and take a buyer, it's always best to have your
representative there or be there yourself.
Speaker 5 (08:56):
Hey, Dan, I assume the lender or the the letterhead
or whatever from the lender was total BS.
Speaker 6 (09:05):
Yeah, yeah, we believe it was BS now and phony.
Speaker 5 (09:08):
I mean, did anybody actually call that lender and see
if that's a real name or anything like that?
Speaker 4 (09:13):
Yeah?
Speaker 1 (09:13):
Did your real estate person broker check them out?
Speaker 6 (09:18):
Well, yes, so they tried to check them out and
couldn't get anywhere on it. So that's a practice that
our real estate agent is changing too, right, is making
sure that calling and verifying all of that ahead of time,
not just saying, hey, this is a letter We've got
another broker that trust so straight, and hey, let's make
the call.
Speaker 2 (09:36):
It is.
Speaker 4 (09:37):
It's very strange.
Speaker 1 (09:38):
It's very strange, says we're all trying to figure out
the scan. I know, Dan, Thanks crazy, Thanks for letting
us know. If you find anything else, I'll give us
a call. Three h three seven to one three talks

They got a forty gallon installed fourteen hundred bucks installed.
Speaker 1 (10:09):
I mean, it's insane.
Speaker 5 (10:11):
He did mine about a year or two ago, and
then a fifty gallon is fifteen hundred.
Speaker 1 (10:15):
And I didn't realize. Tom.
Speaker 5 (10:17):
You know these guys a euro they do so much wholesaling.
It's basically like dealing with a wholesaler. They do a
ton of installs for big boxes. They also if you
ever see pecks advertised on TV whole house repipe, these
guys are probably the ones doing it. So it's like
dealing with a wholesale company. That's how they simply have

they do was plumbing. Same with sewer line repairs. Cheapest

Speaker 9 (13:22):
Hello? Could you hear me?
Speaker 4 (13:23):
I Ken?
Speaker 1 (13:23):
Natalie? What's going on with you?
Speaker 9 (13:26):
Okay? Not a whole lot, not very good things lately.
Speaker 1 (13:30):
Uh. Oh, tell me about this experience with this store?
Is it Famous Footwear?
Speaker 9 (13:37):
Yes?
Speaker 4 (13:38):
What happened?
Speaker 9 (13:40):
So we were in their shopping for a pair of
shoes for my boyfriend. His sister passed away, she was murdered,
and oh my god mother asked him to wear something
nice to her funeral and to wear purple crecker with
her favorite colors, which I gotta tell you were the
hardest thing to look for for a man. And it
was just a frustrating day. We had a very frustrating day.
(14:02):
And the last thing we were trying to find him.
Was a pair of shoes to go with this outfit
that we find you found for him? Yeah. So a
friend that was with us noticed that the worker chip
following us around everywhere and racially profiling us.
Speaker 4 (14:18):
So are you are you black?
Speaker 1 (14:20):
I'm assuming then I'm not black.
Speaker 9 (14:24):
What consumer racial profiling is is when a business will
profile you, like as a shoplifter.
Speaker 1 (14:33):
Yeah, but why But usually when you say racially profiling,
most of the time they don't do that with white people.
Most of the time they do that with people of color.
Speaker 9 (14:43):
That's why I asked, right right, Yes, yes, I'm Hispanic.
Speaker 1 (14:47):
Okay, got it? Got it? Okay. So you think they
were following you just because you were Hispanic?
Speaker 9 (14:56):
Yeah, and they approach you, don't you leave me up here?
Speaker 2 (15:01):
Yeah?
Speaker 9 (15:02):
They pressed us several times and asked us if they
could help us, And I'm like, dude, if we need
your help, we'll go and ask you, okay. And I
just felt like it was very rude of him to
just continuously ask us, like this store is only so big.
If I really need help, then I will come and
ask you.
Speaker 1 (15:20):
So what ultimately happened? Did anything transpire, did anything go
on wrong? Or tell me what happened.
Speaker 9 (15:26):
Yes, yes, it went all wrong. So our friend that
was with us, she called him out and was like, dude,
why are you profiling us? And she was like, we
can't even shop in piece like back up right, And
he was like, well, if you don't like it, you
could f and leave.
Speaker 1 (15:43):
Wow.
Speaker 9 (15:43):
So she was like, well, wow, I shop for my
best frind a pair of shoes and we're not going
to leave until we get them and we legitly were
going to pay for them. And the way their profiling
us was just unreal and uncomfortable.
Speaker 4 (15:59):
Did they if you leave the store when they asked you?
Speaker 1 (16:04):
What was that?
Speaker 4 (16:05):
If they asked you to leave the store, which is
what I thought I heard?
Speaker 1 (16:08):
Did you guys leave the store? Well? No, he said
if you don't like He said, if you don't like it,
you can f and leave. God, he didn't say you
got to leave right, Yeah. So after he said that.
Speaker 4 (16:20):
What did you do?
Speaker 9 (16:22):
So I was just like listening to them, bigger back
and forth. And then after that he looked out my
boyfriend and said, and if you're with her, you can
leave too. He didn't tell me nothing, but he was
like more than too, and he was like, and if
she was like, you did.
Speaker 1 (16:40):
You ask to talk to a manager or something? Natalie?
Did you ask, maybe, hey, talk to a manager?
Speaker 8 (16:46):
I did.
Speaker 9 (16:47):
I did ask to speak to the manager. And at
that point the worker done hit the shoes, the two
pairs of shoes that my boyfriend had in his hand,
hit him out of his hand. And then what him
out the story?
Speaker 1 (16:59):
Why? And then what? What was the last part?
Speaker 4 (17:02):
Pushed him out of the store.
Speaker 9 (17:04):
Yes, pushed him out of the store, physically pushed him
out of the store.
Speaker 1 (17:08):
Oh, there's something. We're not hearing something here, Natalie. This
sounds weird. I mean, I believe you. I believe you
on the surface, but are you saying you guys did
nothing wrong except shop around. Your boyfriend had two pairs
of shoes in his hands. This this retail clerk, the
sales associate knocked him out of his hand and.
Speaker 4 (17:28):
Threw him out of the store.
Speaker 9 (17:30):
Correct.
Speaker 1 (17:32):
What did you do then?
Speaker 2 (17:34):
Oh?
Speaker 9 (17:34):
At that point I told my boyfriend like, let's go, dude,
Like I told I told our friend that was with us, Like,
why do you even say anything, dude?
Speaker 4 (17:41):
Exactly?
Speaker 9 (17:42):
They're all they want. Let him call us all they want.
We know what we're there for and that's all all matters,
you know, And uh.
Speaker 4 (17:49):
So what happened? Did the cop show up?
Speaker 1 (17:51):
What happened?
Speaker 9 (17:53):
Well, the cops did not show up because the worker
obviously did not call the cops. If he thought we
were shopping flifters, you would think that was their first
right objective to do. What to call the police? Take
notes of what kind of.
Speaker 1 (18:07):
Okay, I believe I believe you, Natalie? Where was this
famous footwear? Where was it? Or where is it? Stapleton? Okay?
Do you want us to call there? What do you
want us to do? Because I believe you, I really do.
Now are you sure your your boyfriend didn't start bad
mouthing this guy?
Speaker 4 (18:27):
Where they having words?
Speaker 1 (18:29):
Come on?
Speaker 5 (18:29):
And how could a retail store last like that?
Speaker 1 (18:33):
Listen?
Speaker 5 (18:34):
I believe her too to a degree. But something just
doesn't add up. I mean, okay, granted I'm not Hispanic
or black, or I don't think I've been profiled, but
my god, I'd never heard of anything like that.
Speaker 4 (18:46):
Okay, Natalie, worst.
Speaker 9 (18:47):
Guys, Oh my god, what gives you? A month later,
we're posted on Fox thirty one News for what of
the Trio Robbers? For my my twenty five year olds

Speaker 1 (19:03):

Speaker 4 (19:06):

the surveillance, and the pictures were pretty clear. And DPD
knows me by faith and name why as Wallers my
boyfriend just because of some proper when we lived up

and I did bond out on a two hundred cash
only bond, and my boyfriends were said at ten thouars, And.
Speaker 1 (23:01):
How about the third and who's the third person?
Speaker 9 (23:05):
The third person, to our understanding, Shoe was also arrested,
I guess a day after in Jefferson County somewhere.
Speaker 1 (23:12):
But did you guys actually steal anything? I mean, I
know there's a joke that no one, no one who
gets arrested is guilty and everyone's innocent. But I have
to hear your story. They have pictures of you. Did
you steal from that store?
Speaker 9 (23:26):
Absolutely not?
Speaker 1 (23:29):
Then what are they getting you on that store? Or
are they saying you have a chain of robberies? What
are they saying? I want to know, Not what you agree,
not that you agree with it, but what are they
saying about you? What are they saying about you?
Speaker 9 (23:43):
So they charged they charged us with class or felony robbery.
I've been into trouble with the system for fifteen years
or more.
Speaker 1 (23:52):
But what does that mean? Are they saying honor about
a certain date? You lifted these shoes or something. I mean,
are they are they eyeing it to a specific crime somewhere.
Speaker 9 (24:03):
Just that one and it wasn't even what they put
it out to be.
Speaker 1 (24:07):
But wait, it doesn't make sense.
Speaker 5 (24:09):
Even if they thought you were stealing some shoes, then
right he would all end up in jail. Exactly are
they saying you walked in there and like stole money,
waved a gun?
Speaker 1 (24:20):
I mean, what are they saying?
Speaker 2 (24:21):
Yeah?
Speaker 1 (24:22):
In other words, the way you described it, you guys
just left. He knocked the shoes out of his hand,
and you guys left. So are they saying you came back?
What are they saying?
Speaker 9 (24:33):
So the detective said that he didn't even mention nothing
about my boyfriend being assaulted. He didn't mention nothing about
him knocking boots out of his town. He didn't mention
nothing about what what all started the altercation?
Speaker 1 (24:47):
Okay, well what did the officer? What did the officer
say in his report? Then tell us what the officer said.
Speaker 9 (24:54):
Oh, what he showed me was a picture of me
and my friend traces Jenna at the door, challenge the
girl the worker to not touch my boyfriend because they
have a no house policy and they're not supposed to touch.
Speaker 4 (25:07):
Okay, and then what and then what and.
Speaker 9 (25:10):
Then it just shows my boyfriend like trying to get
away from her because she keeps brushing up again.
Speaker 4 (25:16):
And this was on this was on the on the tape,
on the video.
Speaker 9 (25:22):
Yeah, yeah, just screw pictures of the of the surveillance.
Speaker 5 (25:26):
But please, please please please hold hold, hold on, hold on, Natalie,
Please help me with this one question. Yeah, I I
need help to What are they accusing you of? It's
not shoplifting at this point. What are the charges? Are
they saying? Armed robbery for example?
Speaker 9 (25:42):
Yes, robbery, thank you.
Speaker 4 (25:45):
That's a lot different than shop They have to have evidence.
Speaker 1 (25:48):
What evidence do they have? What evidence do they have?
Speaker 9 (25:52):
None that I know of? None?
Speaker 1 (25:55):
And you think it all started because you're.
Speaker 9 (25:57):
Brown, pretty much racially profiled us.
Speaker 1 (26:03):
If we now, let me ask about your boyfriend. What
kind of a record does your boyfriend have? Just let's
spill it.
Speaker 9 (26:11):
He has some open cases, she does?
Speaker 1 (26:14):
What open cases from shoplifting or for what?
Speaker 9 (26:19):
Well? A couple of them are for domestic violence while
they were closed by the courts or whatever.
Speaker 1 (26:27):
Yeah, Tom, here's what I'd like to listen.
Speaker 5 (26:30):
Hold on, Natalie, we got a break coming up, Kelly
get I want her first and last name, and let's
get her boyfriend's first and last name, and let's see
what charges her up against.
Speaker 4 (26:42):
And maybe we'll get a criminal attorney on and let's
look at it that way. Let's let's try it up against.
Speaker 2 (26:50):
Yeah.
Speaker 1 (26:50):
Yeah, let's let's hold this and we'll get you some
free advice from a criminal defense attorney. We'll try to
get Joe Lasara on here. I think it's worth exploring. Look,
I know a lot of times we roll our eyes
and we make snide comments like, oh yeah, everyone's innocent.
Oh yeah, sure, they never did anything wrong. But I
do believe, I truly do believe people get caught up
(27:12):
in the system. I do, and I would hate to
have that happen in this case. Now, Mark, what.
Speaker 4 (27:20):
Is going on?
Speaker 1 (27:21):
You have a question about purchasing a car. I want
to get it in under the wire here and we'll
ruminate on it during the break. Mark.
Speaker 4 (27:28):
What is your question, sir?
Speaker 10 (27:30):
I would like to purchase a car for a family
member who lives in another state. Okay, go there, and
I purchase the vehicle for cash and they title it
in her name. Do I retain any liability in the
eventually has an accident with that vehicle.
Speaker 1 (27:46):
Okay, good question, and you're going to be surprised at
the answer because it can go both ways. But I
want you to know why and you can prevent it.

going to get a defense attorney on to talk about it,
but you got to.
Speaker 4 (28:55):
Hang on and wait for that.
Speaker 1 (28:56):
Now, Mark the caller Mark has a question about purchasing
a car. Now, Mark, you want to go to another state.
You want to buy the car and sign it over
to your relative. Is that right?
Speaker 10 (29:09):
That's correct?
Speaker 1 (29:10):
And is this your as long as it's not your spouse?
What relative is this? What did you say?
Speaker 4 (29:15):
A sister?
Speaker 1 (29:16):
A daughter? Oh?
Speaker 4 (29:17):
Daughter?
Speaker 1 (29:17):
Okay, Now the short answer is and by the way,
this answer gets controversial, meaning people don't always agree with
this answer. But from a negligence point of view, simply
buying her the car and turning it over to her,
you should not be in any trouble if she is
(29:39):
negligent at all.
Speaker 4 (29:41):
Okay, it's her car. You simply bought it.
Speaker 1 (29:45):
Now, there is something people believe is negligent entrustment, meaning
that since you provided the means for her to have
a car, you're somehow responsible for the negligence. But our
attorney has told us that as a stretch, and that
doesn't happen. Our insurance guy says, oh, no, you should really,
(30:05):
you should really insure yourself for that. But as far
as actual cases, they they do try to find as
many people as they can to go after, and they
look for the pot, you know, the big pot. Of money.
And if your daughter has nothing and they see that
she owns the car, I personally doubt that they will
(30:27):
look as to who bought it for them.
Speaker 4 (30:29):
Mark, what do you think on that?
Speaker 1 (30:31):
If you're listening or he might be researching something else,
what do you think? Because I believe that they would
have a big hurdle if they tried to come after you.
Speaker 4 (30:42):
Were you told differently than that?
Speaker 8 (30:44):
Hold on?
Speaker 1 (30:45):
Mark had to step out just a bit?
Speaker 4 (30:46):
No, no, no, I'm talking to Mark our caller. Mark.
Speaker 1 (30:50):
Were you were you told you could get into trouble?
Speaker 10 (30:54):
No? Not necessarily. I was wondering, you know, is there
a better way to structure this? Do I send her
the monk?
Speaker 2 (30:59):
Well?
Speaker 4 (30:59):
One thing say for sure?
Speaker 1 (31:00):
No? The best Okay, you could gift her money. There's
no tax on that. You could gift her money. That
is a really, in my opinion, the best way to
do it. When you gift your money, she can buy
whatever she wants. Now, if you bought the car and
transferred it to her, you may have some stickler who's
saying you should have never transferred that car to although
they would never prevail. So if you buy a car
(31:21):
for your daughter and and you know you sign it
over to her. You're you're all right, but I would
I think gifting the money is better. And then on
top of that, just make sure she has pretty good insurance.
What kind of insurance or what state are you talking about?
Speaker 10 (31:39):
North Carolina?
Speaker 1 (31:41):
Okay, they they have, don't go with their minimums. But
is she planning on getting pretty good insurance?
Speaker 10 (31:52):
I don't recall what her limits are, but yeah, I
think so.
Speaker 1 (31:58):
Okay then, but that's really that's really what you're going
to have to do. You're going to have to make
sure she's insured. Well, not because there's a sudden danger.
I just feel like it's safe for her too, because
you don't want her to face a judgment. That's not
that they'll come after her personally. She can always bankrupt
(32:19):
out of it, but really, why take the chance now?
I just looked up her previous case we had, and
our attorney, John Fuller, said, you generally cannot be sued
for negligent and trustment based on something she does unless
you gave her the car knowing she was unfit or
dangerous to drive. That is a high standard for somebody
(32:41):
to try to prove. So if she had any decent insurance,
they would simply put an acclaim with the insurance. What
is the legal liability? Hear my notes from that previous
call the cars. You got to make sure the car
is properly titled and registered in her name. Always better
if there is no chain of time where you didn't
sign it over to her. So your idea of gifting
(33:03):
her money is a great idea. And you do trust
her to buy the car, right, and you should still
help her buy the car.
Speaker 4 (33:10):
And please, you've heard enough nightmares here.
Speaker 1 (33:13):
Get her not only to you know, look at certain
makes and models, but have them checked out. And when
I say certain makes and models, what is she looking for?
Because I have some great advice on used car buying.
What is she looking for?
Speaker 10 (33:30):
Basically, we're looking at a new car and probably that's best.
Speaker 1 (33:34):
That's that is you know what? In my opinion, a
new car is best. Are you getting one with a
great factory warranty? Which one are you looking at? Okay, man,
you're doing everything right. Toyotas are the best new car
values because they hold their value. They're the worst used
car values because they hold their value.
Speaker 4 (33:54):
For the same reason.
Speaker 1 (33:56):
American cars good American cars are excellent use car values
if they have lower mileage, because you get more of
a car for the same money as if you've bought
a foreign But right now you're on the right track
buying a new car. Give her the money, let her
do it, put everything in her name and you'll be
pretty safe. And then make sure she has good insurance.

Hello, I'm Tom Martino. Welcome to the show. This hour
brought to you by Dan McKenzie McKenzie law. If you
want a will, a simple will, a complicated will, a trust,
a combination of a will and a trust, or even
an LLC that can actually be a family partnership that
can survive death of one or the other. He's very
(35:41):
creative McKenzie. I'm using McKenzie law right up up front.
I'm going to tell you that to do my estate plan.
And I think you'll love the way they do business.
They're small enough to give you individualized attention, but they
have large enough to execute everything you do. Eight three
three co plan Dan mackenzie A three three co plans. Okay,
(36:07):
you know we did some searching on rap sheets, racially
profiling and other things. So Natalie says she was at
a famous footwear with a couple of friends, her boyfriend
and another person, and the clerk kept following him around
and they felt like they were being haunted here because
(36:30):
they're Hispanic, and that the retail clerk got a little
testy with him and kept asking what can I do
to help you?
Speaker 4 (36:38):
What can I do to help you?
Speaker 1 (36:39):
But at some point it got weird because the clerk
knocked shoes out of her boyfriend's hand and pushed him
out the door. The police never came, Natalie, is that correct?
Speaker 9 (36:58):
That is correct?
Speaker 1 (37:00):
So the way I get it, you had words about
racially profiling, he was following around. The guy lost it.
He knocks the shoes out of your boyfriend's hands and
pushes him out the door. Then you hear nothing, no police,
no charges, nothing. The next thing you know, you see
the three of you on their security footage and Fox
(37:24):
thirty one is reporting that there is a theft trio
on the loose. Is that do I have that so far?
Or were you arrested before?
Speaker 4 (37:36):
Okay? A trail of robbers? Okay? So that were you
shocked when you saw that?
Speaker 9 (37:43):
Absolutely? I didn't even see it. My mother, my twenty
five year old daughter, called my mother and said, why
is my mom on the news?
Speaker 2 (37:49):
What the f?
Speaker 9 (37:50):
And my mom yeah, me in straw, like, daughter, you're
all over the news, what's going on? And she's like,
grandma's crying. Everybody's crying, like, what's going on with you?
Speaker 1 (38:00):
And so did you call the police right now? If
I saw if I saw myself up on the news
saying I'm wanted for something, I would turn myself in
or at least go talk to him with an attorney
or something.
Speaker 4 (38:13):
What did you guys do?
Speaker 1 (38:14):
The three of you after this appeared on the news
and they said, you guys were on the loose, What
did you guys do after that?
Speaker 9 (38:22):
Well, it wasn't us, guys, all three of us. It
was actually me and my boyfriend were living our own
lives normally. Because we didn't think that it was going
to be all like that. We left and pushed him
and violence was going to get worse. So we just
left and I told my boyfriend, let's go back and
call the cops. She assaulted you, Like, no, right, right,
(38:44):
that's a salt period.
Speaker 4 (38:46):
You're right, So what happened? You didn't go back?
Speaker 9 (38:52):
No, we didn't go back because the other girl that
was with us in the trio supposedly she didn't want
to go doctor. She was the driver of the vehicle
that we were in.
Speaker 1 (39:02):
Okay, the getaway gain it?
Speaker 4 (39:05):
Yeah, So what did you do then?
Speaker 1 (39:08):
I mean, how there was absolutely nothing else done, and
all of a sudden you show up on TV. But
why did it take so long to show up on TV?
Are they alleging that you did more than just this
one job?
Speaker 4 (39:23):
Are they saying you've done a number of jobs.
Speaker 9 (39:26):
No, they're not said. That's how they posted it on
the news, but when we spoke with them, that is
not what they said.
Speaker 1 (39:33):
Like, okay, okay, what did they say? Why?
Speaker 9 (39:36):
I'm confusing myself and that's why I need help.
Speaker 1 (39:38):
I need No. No, We're going to try to get
you some information for sure, But I just asked these
nippicking questions because that's what they are. So let me
get the straight. After you guys left the store, how
long after that were you on the news?
Speaker 4 (39:56):
Was it a day or two or that night or what?
Speaker 9 (39:58):
Thirty days?
Speaker 1 (40:01):
See? Mark, That's the thing I find crazy. Thirty days
after being kicked out of the store the surveillance footage
from that store is posted. That's what I don't understand.
What happened during that thirty days? And why did Famous
Footwear wait thirty days? Did you get any answers to
(40:23):
those questions, Natalie, No, I.
Speaker 9 (40:26):
Did get no answers, absolutely none.
Speaker 1 (40:30):
Mark, What do you think is going on? I mean,
why would they wait? That's the one thing we need
to find out. Why was it thirty days later? I
don't know?
Speaker 5 (40:39):
But Emilio has multiple theft cases open right now, okay,
and is rap sheets a mile long, and Natalie, your
rap sheets pretty damn long too. The only thing you
have currently opened, it looks like, is this deal from
October of this year. I'm not even sure what we
would do to help her at this point. I mean,
(41:00):
you're going to end up getting an attorney if you
can't afford one.
Speaker 1 (41:04):
But what we're gonna do is, I'd like to ask
our attorney, who's tied up right now. He's in court,
but I would like to ask her options, because truly
there I think she has. They have a good defense
if in fact they said that these guys are on
the loose, they waited thirty days and nothing was actually taken.
Natalie is famous foot We're saying, you guys left the
(41:28):
store and had merchandise with you. Natalie.
Speaker 9 (41:35):
We're saying that that's what they were saying surveillance footage.
Speaker 1 (41:40):
They're actually saying that you took some stuff with you
when you left. That was the theft. They have to
have some video or something on that mark. I mean,
this sounds crazy to me, Well, it really sounds crazy.
Speaker 5 (41:52):
We saw the stills from it, but but.
Speaker 1 (41:57):
No, what I mean is this video of them leaving
with merchandise. According to Natalie, the guy the clerk.
Speaker 5 (42:04):
Knocked the shoes out of his hand with the cops
show up, and Fox thirty one actually runs a story
on man, I don't know.
Speaker 4 (42:12):
Some kind of video of something. I mean, there must be.
Speaker 1 (42:17):
I wonder if they're saying this that he was on
his way out the door with the shoes but in
the clerk.
Speaker 5 (42:23):
That doesn't end up on Fox News. It doesn't. You
did news forever, my dad? Is that a story someone
tried to steal a purple pair of shoes?
Speaker 1 (42:32):
Mark, Locky Mark, You hit the nail right on the head.
Speaker 4 (42:36):
It is absolutely not a story.
Speaker 1 (42:38):
The story that three people the trio are on the loose,
they gotta find him. It's crazy because are they saying, Okay,
this is another sixty four thousand dollars question, Natalie. Are
they saying that you also robbed other places?
Speaker 4 (42:57):
Are you charged with any other incidents?
Speaker 9 (43:00):
That is what No, I'm not, but that is what
the news said, that let's catch them before they hit
other places.
Speaker 5 (43:06):
Well, and it basically it says according to Metro Denver
Crime Stoppers, the trio hit a location on East forty
ninth Place in Denver's Northfield neighborhood on September twenty seventh.
When I hear hit a location, that doesn't mean stole
a pair of shoes.
Speaker 1 (43:22):
I mean what that.
Speaker 5 (43:23):
Generally means, like armed robbery or something. Got it does.
Speaker 4 (43:29):
And when you're saying there.
Speaker 9 (43:31):
Was no weapons involved at all, well I didn't.
Speaker 1 (43:34):
Yeah, okay, wouldn't be arm around now. And I need
to ask some touchy questions here. Okay, in the were
you going to other shoe stores or other stores as
a trio?
Speaker 4 (43:45):
Were you visiting other stores?
Speaker 9 (43:47):
Relutely not? Absolutely not.
Speaker 1 (43:51):
So you're out shopping with your boyfriend and a friend
and this turns into a trio on the run, Mark,
and it's thirty days later, So what triggered what triggered
that news story? I want to call the shoe store?
Speaker 4 (44:07):
Yeah, Famous Footwear. We're what is it North glenn Is
at the right address.
Speaker 1 (44:12):
With my story or Northfield? Yeah, it's where Stapleton. You know,
it's the Stapleton area. But here's the deal. Mark, tell
them that you know it's public records, so it's not
like they're doing anything wrong by talking to us, But
we just want to know why was there a thirty
day lag after they left the store that day, and
(44:35):
then the news story shows up, and I'd love to
ask Fox thirty one, I mean really they reported this, like, like,
did they realize that the encounter was thirty days before
they put the story on? What what I want to
know is what sparked that story. So they're shopping around, right,
(44:58):
they get kicked out of the store for lack of
a better term, they're kicked out because they look suspicious.
Then thirty days later, their pictures show up on TV
as the trio on the run Robley right, yeah, well
that sounds crazy, right, whatever you know robbery treill. So, Natalie,
(45:19):
after it showed up on the news, what happened? Then
you said you didn't turn yourself in, So what happened?
Speaker 9 (45:27):
So I reached out to you. I sent you an
email and reached out to you to further investigate this
situation because families were in distraught with meaning my friend
right and my children, Mike got my thirteen year old,
I'm disappointed in your mom, like that ain't even what
it was, daughters. I have to explain this to my children,
my grandmother right, right, crime Like I'm out there just
(45:48):
committing crime. No, I'm not doing that.
Speaker 1 (45:52):
God, this is crazy, and so after God, but after that,
so you're explaining to your family, I have no idea
what's going on. How did that turn into an arrest?
Did they show up at your house one day or what?
Or did you walk in to find out more? How
did it turn into an arrest?
Speaker 9 (46:12):
So let me tell you. Okay, So these officers, this
group of officers, there are like four, four of them,
two in each car. They know us by name and face. Okay,
they are contact with us at the hotel, okay this,
and okay that they've seen us in the Sulton vehicle
the day before. So they're definitely messing with us and
harassing us and trying to.
Speaker 1 (46:33):
Do what place is this Denver? Are we talking about
Denver Police?
Speaker 9 (46:39):
Yes? We are, okay, and I got moans and everything.
Speaker 1 (46:44):
But but you said, you said two officers in each car,
two cars. Did they come and get you at your
house or were you out shopping? When were you arrested?
Speaker 9 (46:55):
We were riding our bikes of Cofax and there was
a cop at the stop side and I thought, you know,
like I was just crossing. I didn't think nothing of it,
and he just stayed right there. So I'm like, oh wow,
really needs Okay, that's out on the road a little bit.
So I turn go through the back to go around
him through the back because I don't want him.
Speaker 2 (47:13):
To hit me.
Speaker 9 (47:14):
Maybe he didn't see me or whatever. So I go
around and he comes out running after me, and I'm like,
hold up, dude, like you ain't got a rush on
me like that?
Speaker 1 (47:22):
For one, we got to take a break.
Speaker 9 (47:24):
It's falling off, all.
Speaker 1 (47:24):
Right, all right? This yeah, this mark, I just don't
understand it.
Speaker 5 (47:29):
I mean, I'm going to call over to the shoe
store and see if I can get any information.

We'll get to him and I'll tell you Natalie's situation.
I'm just going to tell it like it is, and
I want people to weigh in on what they think happened.
Natalie and her boyfriend and another friend. They were shopping
for shoes, famous footwear. What happened was they were followed around.
(49:17):
Natalie thought she was racially profiled Natalie had a few
words with the clerk. The clerk would back off and
then show up again, so they felt bugged by all
of this. Finally, the boyfriend has two pairs of shoes
in his hand, and this whole thing culminates with the
clerk knocking those shoes out of his hand and throwing
(49:40):
him out of the store. So the three of them
leave the store. Then Natalie said nothing else transpired. Nothing
until thirty days later, they see on Fox thirty one
a story about the robbery trio or whatever. They're calling
him on the loose, and Natalie's saying, we're not on
(50:03):
the loose. We didn't steal anything. We were shopping and
why didn't they arrest us? What tells the police never
even showed up, and now they're saying we're on the loose.
She's confused as hell. And then it all ends up
with all three of them being arrested and they're being arrested.
But they said they never took anything. It's not that
(50:26):
they took it, and it's a misunderstanding. They say they
never took anything. Mark, who did you try calling? Well,
I called the actual store and I talked to someone.
Speaker 5 (50:36):
They didn't give a name, and they definitely acknowledged they
knew about it, but they are giving zero information. I
even said kind of on the wink wink, like, well,
can you acknowledge it was more than trying to steal
a pair of shoes? I mean, they ended up on
Fox thirty one and they're like, we cannot talk about it.
Speaker 1 (50:55):
I okay, So something happened from the time they were
kicked out of the store to the time this news
story came out.
Speaker 5 (51:05):
Now usually whether at Julius's input, real quick, okay, you're
not used to the show, you've heard this call. Just
make sure you hit the on button on your mic.
What what do you make of it? Just put together
what you think of this show?
Speaker 2 (51:20):
Yeah?
Speaker 1 (51:20):
Yeah, yeah, Like you're sitting home listening to the show
or in the car.
Speaker 4 (51:24):
What do you think? What are your first impressions?
Speaker 12 (51:29):
Well, it seems a little odd that three grown individuals
have to go into a shoe store at the same
time to shot for one, maybe two pairs of shoes.
Speaker 1 (51:37):
You never thought of that, Okay?
Speaker 12 (51:39):
And she stayed at that herd and her mom were
standing at the front talking to the worker, which clearly
kind of gives thee.
Speaker 4 (51:45):
Not her mom, but her friend. I don't think her
mom was with.
Speaker 1 (51:47):
Her yet her her friend.
Speaker 12 (51:48):
It clearly gives the impression of maybe more of lookouts.
Speaker 4 (51:53):
Yeah, and I see what you're saying.
Speaker 12 (51:55):
Yeah, it just doesn't really add up. And she stated
that she knew the policy, that no hands policy, and
I don't know about anybody else, but I don't know
the policies of what is that?
Speaker 4 (52:04):
What is that hot? What do you mean no hands policy?
Speaker 12 (52:07):
She stated on the very beginning of her call that
she that foot locker, that that store has a no
hands policy.
Speaker 1 (52:13):
So they can't. Oh, they can't, they can't do anything
to the people.
Speaker 4 (52:16):
Yeah.
Speaker 12 (52:17):
Yeah, so people that are aware of that hands policy, right,
those those avenues.
Speaker 1 (52:21):
So that's sobation. That is your gut telling you, Julius,
Is your gut telling you that they were there for
no good? I'm just asking for your gut, not not.
You know, obviously, we don't know what is your gut
telling you.
Speaker 12 (52:37):
We've all worked most of us have worked in customer
service long enough, and we know that we're not going
to just put our hands on a customer for no
odd reason, especially when your job is in question. So
I do believe that something provoked them.
Speaker 1 (52:51):
They're mostly method information. And then the part I don't
understand is how she got arrested. She was on her bise.
Speaker 5 (53:01):
And and the arrest that part I was on the phone.
But so that's how she ultimately got arrested. She's biking
down the road, Natalie, is that the way you were arrested?
Speaker 1 (53:13):
By the way, just so you know, Natalie, we have
to explore all avenues we we just this sounds just
so strange to us. If it happened the way you
said it, my immediate question would be, this is my
immediate question. What triggered the arrest? What triggered it thirty
days later? What was the news story about thirty days later?
(53:36):
I mean, you know, was it about a recent theft
or because you know, I doubt Fox thirty one or
any TV news would simply go on and say about
a month ago, you know, this trio was at the store.
Speaker 9 (53:51):
Did youth?
Speaker 1 (53:53):
Interesting?
Speaker 2 (53:53):
Though?
Speaker 5 (53:54):
Hold on, I do want to bring this up for everybody.
The only case she has opened right now, it is
October twenty twenty five. It's what we're talking about, and
it is a theft case. I mean, I don't think
you were arrested on robbery? Were you or was it theft.
Speaker 9 (54:11):
From one from October twenty four? Yeah, I was arrested
on October thirty first or thirty right data in October?
Speaker 1 (54:22):
For God's sake?
Speaker 4 (54:23):
Was it theft or robbery?
Speaker 1 (54:24):
There's a big difference.
Speaker 9 (54:27):
Two, there's two counts of robbery.
Speaker 1 (54:30):
Wow.
Speaker 5 (54:31):
I don't know if I'm I'm going to clarify with Susanne,
but I don't think that's what's on her sheet right now.
Speaker 4 (54:37):
The other person, Emilio, very possible.
Speaker 9 (54:42):
Is it going to tell you something? I'm gonna tell
you guys something real quick.
Speaker 1 (54:45):
Kay.
Speaker 9 (54:45):
Let me okay this so you get a picture of
a case.
Speaker 1 (54:48):
Okay, go ahead.
Speaker 9 (54:48):
When they officially formally charged us, it says that menli
Alvarado unlawfully poi fello or whatever that word is. Yeah, okay,
took something of value, namely boot Okay, in the presence
of Jared Williams, by the use of force, stress or intimidation.
(55:09):
I didn't take nothing from nobody, and the counting.
Speaker 13 (55:12):
Will show all of that.
Speaker 1 (55:15):
Do you have a defense attorney? I hope you guys
have an attorney.
Speaker 9 (55:19):
I have an attorney, but apparently they're not returning my calls.
They're not trying to defend me, and I got four
coming up on December first.
Speaker 5 (55:28):
You know, maybe this really did just get out of
hand and they possibly overcharged her on it. To be honest, Natalie,
it sounds like you guys walked in there to shoplift
and I'm just telling you what I think.
Speaker 1 (55:39):
That's my opinion on it.
Speaker 5 (55:41):
I don't know why it escalated to this point unless
if Amelia really pissed off that other.
Speaker 1 (55:47):
And the bigger question mark the bigger question, why did
all the arrest and stuff take place thirty days later?
Speaker 4 (55:55):
Was it?
Speaker 1 (55:56):
Are they saying they hit another store? Are they saying
they just found them?
Speaker 5 (56:01):
Why they just found them? They ran the news story
because they didn't know who they were. They put up
pictures of them, but they ran it thirty days later.
Speaker 9 (56:08):
Doctor who we are? Let me tell you something. They
know exactly who.
Speaker 14 (56:11):
We are because you said that a lot.
Speaker 1 (56:13):
It's almost like you wear that is a badge with us.
Speaker 9 (56:17):
We were the same officers that were just in contact
with us maybe a month prior to that.
Speaker 5 (56:23):
Okay, from the bottom line, you're gonna I would love
to have her back on with Joe Lazara of course
when he gets seven hours or something.
Speaker 1 (56:31):
But let's get her some hell on it. Let's get
her at least some advice. Listen, she called the show.
She trusted us to give her advice.
Speaker 5 (56:39):
I want to help her out, but I mean, we're
at a standstill till we get a damn attorney.
Speaker 4 (56:42):
On and and again.
Speaker 1 (56:43):
If anyone, if anyone can help me understand why would
an arrest? Why would it happen thirty days later? With
their pictures? Were those pictures the ones taken at same
as Footwear from their surveillance cameras?
Speaker 5 (56:59):
And Suzanne just told me the open case is robbery.
It is not theft, it's robbin.
Speaker 1 (57:04):
Okay, meaning they forcibly took it. Now here's what I
want to know, though, big difference. I want. I want
to know something from from Natalie. Natalie those pictures that
were on Fox thirty one, And I'd love to talk
to Fox thirty one on what triggered that story. But
those pictures are they from your visit to Famous Footwear
a month earlier?
Speaker 9 (57:26):
Yeah?
Speaker 4 (57:27):
Okay, put her on hold.
Speaker 1 (57:29):
And Natalie, we're going to work this and get you
some information. She deserves information. Let's face it now Monica
from Yes.
Speaker 5 (57:37):
We asked our guest and I gave my opinion. I
want to know what you think. Now, what do you think?
Speaker 4 (57:44):
Okay?
Speaker 1 (57:44):
Do you think they just were there and they here's
what I looking for shoes?
Speaker 4 (57:49):
Here's what I think. I think.
Speaker 1 (57:51):
I'm going to tell you exactly what I think, and
it's not based on anything except a hunch. I think
the three of them went in there to shop and
to look around, okay, and I think they looked very
suspicious because there were two people probably talking to the
clerk or talking to somebody walking around, and another guy
walking around separately. I think they looked suspicious. Okay, we
(58:13):
can talk about racially profiling later, but after looking suspicious,
what I think is is that the clerk was pissed
off and tried to knock the shoes out of the
guy's hand, and he left with the shoes. Now, this
is just my gut, because you don't have a robbery
charge on nothing. And I think the surveillance footage, well,
(58:38):
although they had that surveillance footage of him leaving with stuff,
you think they would have used it in a story.
That's one scenario, right, they're walking around, they look suspicious,
they get into a scuffle with the clerk, and when
the guy leaves, he's just so pissed off he takes
a pair of shoes or two with him. Now Natalie's
going to say, no, that didn't happen. I understand, I'm
(58:58):
not accusing you. I'm just giving my gut feeling because
this is very, very strange. Now listen, please all hang
on the line. We have to take this quick break.
One Clear Choice Garage Doors. The name says it all.
They should be your clear choice. They do everything on

(01:00:14):
what a what a weird series of events. But I'm
going to go to someone else.
Speaker 4 (01:00:18):
I have to.
Speaker 1 (01:00:19):
We have people waiting, Monica, thank you so much for waiting.
You called about asbestos, as I remember you have a
renter's policy, and we examine this policy. But in the
renter's policy, she has personal belongings insured against loss, and
she also has liability if she does harm to others.
(01:00:40):
And what happened was one of her appliances developed a leak.
It caused damage to floors and stuff, but it also
caused the downstairs ceiling to basically cave in, okay from
the wetness, and it disturbed asbestos which was in the ceiling,
(01:01:01):
and the asbestos got on all her stuff. And to
clean that takes about well, it takes a lot of work,
and she had it done and it costs about thirty
thousand dollars or something to clean all her stuff. So
she wants to know what's going on her insurance says
(01:01:21):
you're not covered because it's asbestos, and asbestos is not covered.
But we had an insurance expert on by the way,
Brian Burns Compass Insurance, and they said many times, if
something is covered and it causes a problem with something
(01:01:45):
that's uncovered, the resulting damage could still be covered. In
other words, if it all started with something that was covered,
like a water leak, then any subsequence quint damage should
be repaired because of the water leak.
Speaker 4 (01:02:05):
Except as Mark found out.
Speaker 1 (01:02:07):
Yesterday when he was exploring exclusions, they have gotten way, way,
way smarter the insurance companies on turning down these kinds
of claims. Mark, do you have that exclusion in front of.
Speaker 4 (01:02:19):
You by any chance?
Speaker 1 (01:02:22):
He may not, may not have that, But in any case,
here's the bottom line.
Speaker 4 (01:02:28):
It says, basically, I'm just gonna sum.
Speaker 1 (01:02:31):
It up that if there's a forbidden or excluded substance
or coverage anywhere in the transaction from the beginning to
the end, if it shows up anywhere, they're not going
to cover it, nor are they going to cover any
damages as a result of that.
Speaker 4 (01:02:50):
Mark, are you are you there?
Speaker 1 (01:02:51):
Marketing? Okay, you really did you you did a lot
of experiment. I'm not experimenting research on this. Do you
have that in front of you by any chance? Hold on,
let me give me keep talking. I'll find out time
and let me explain something. There's two ways exclusions work.
Exclusions can work where this is excluded if it's the
(01:03:12):
direct cause of the loss.
Speaker 4 (01:03:14):
Okay.
Speaker 1 (01:03:15):
In other words, if all of a sudden, you know
you have a problem with asbestos, it's not covered. But
what if it all starts with something that is covered,
For example of a sewer backup, and during the sewer backup,
they're taking off the drywall and they notice when they
took off the drywall there's asbestos. You can make the argument,
(01:03:35):
Wait a minute, this is not an asbestos claim. It
is a sewer backup claim, and the asbestos just happens
to be in there, so it should be taken care of.
And that's what Monica believed, That's what I believed. And
then Mark, you research these exclusions which have gotten way
more sophisticated.
Speaker 4 (01:03:52):
Go ahead, Let's not forget. This is a renter's policy.
Speaker 5 (01:03:55):
So I would like to look at my own homeowners
and see if there's anything like this in it.
Speaker 1 (01:04:00):
But here's the exact language. It's crazy.
Speaker 5 (01:04:03):
So it goes over different contaminants in pollutants, and it
actually names all kinds of them, including asbestos, lead, fumes, acid,
all kinds of stuff.
Speaker 1 (01:04:14):
Sure so, but this line says it all.
Speaker 5 (01:04:17):
It says this exclusion applies regardless of weather and otherwise.
Covered peril is the initial cause of the contamination or pollution.
It just doesn't matter no matter what they do, not
cover it. It could be in any place in the chain,
and it's not covered exactly the chain of loss. It
(01:04:40):
could be anywhere, and if it's present, anything to do.
Speaker 4 (01:04:44):
With it not covered.
Speaker 1 (01:04:46):
Did you read it the way we did, Monica, once
you looked at it, I.
Speaker 9 (01:04:52):
Well, I didn't.
Speaker 15 (01:04:53):
I read it that because of the water damage caused
this festus, that it was a covered pair.
Speaker 4 (01:05:00):
Now where did you want damage is a covered peril? Yes?
But where did you Monica?
Speaker 1 (01:05:05):
I'd like to see the wording that you read that
gave you the impressionists covered.
Speaker 5 (01:05:09):
This is right out of your policy. It's page fourteen.
I mean, it's literally page fourteen. We do not ensure
under any coverage for any loss consisting of one or
more of the following excluded perils, regardless of the cause
of the excluded peril, any other causes of the loss
that may have contributed concurrently or in any sequence with
(01:05:32):
the excluded peril to produce the loss, whether the loss
occurs suddenly or gradually, involves isolated or widespread damage, or
occurs in the result of any event.
Speaker 4 (01:05:43):
Or third chance, you don't get more thorough than.
Speaker 1 (01:05:46):
That Monica in them saying that that asbestos is not covered.
Now the question is what do you do? So hold on,
because we got to talk about that. What do you
do when you have thirty five thousand dollars looking at you?
Speaker 4 (01:06:00):
Another thing I may ask.
Speaker 1 (01:06:01):
As a side note, at what point do you decide Mark,
I'm not going to spend thirty five thousand to clean
stuff that's worth ten thousand.
Speaker 5 (01:06:09):
That is that I don't understand. That is a whole
different circumstance. But we're past that with her. She owes
thirty five thousand dollars.
Speaker 1 (01:06:18):
Yeah, we do have to take this break. Hang on, folks,
we'll come back and talk about this. It affects everyone

(01:07:05):
with Mark Major, and we are talking about everything on
your mind. So, Monica, basically you're you're really got a problem.
I mean you really do you authorize cleaning of all
your stuff? May I ask how much was the stuff worth?
If cleaning it was thirty five thousand at some point,
(01:07:29):
doesn't your pollow what's that?
Speaker 15 (01:07:33):
I don't think it was worth thirty five thousand, but
I wasn't you know, I mean I did when they
first started this process. Well, first of all, it says
up to three hundred and twenty hours to clean it,
and when they first started the process, they was my
understanding that they don't clean things in drawers, you know,
(01:07:55):
inside coupboards, things like that, and they took everything out
of my home.
Speaker 1 (01:08:01):
Okay, but Monica, Monica, who picked this company?
Speaker 15 (01:08:06):
The question is, I'm sorry.
Speaker 1 (01:08:09):
No, go ahead, go ahead with your thought. I'm sorry,
go ahead.
Speaker 15 (01:08:13):
Well, you know, I mean it wasn't the items they.
Speaker 14 (01:08:18):
Got rid of, the big items, right, they got rid.
Speaker 15 (01:08:21):
Of couches, chairs, requiners, that kind of thing.
Speaker 4 (01:08:27):
And were you reimbursed?
Speaker 1 (01:08:28):
Were you reimbursed for those the things that were total losses? Oh,
of course not because it doesn't cover asbestos. Okay, So yeah,
how much of a bill do you have right now?
Speaker 15 (01:08:43):
Thirty five thousand dollars and I have nothing, you know,
I'm missing, you know, all kinds of items in my home.
Speaker 1 (01:08:52):
Let's kind of get right to this.
Speaker 5 (01:08:54):
I mean, you don't own a house because you're renting,
so you don't have any equity in a house. I mean,
how much are you worth as bankruptcy an option if
this guy comes after you.
Speaker 1 (01:09:03):
I don't think you're good, Monica. I think we have
to start looking at that. It's not covered. I don't
think you're gonna make an argument to get it covered.
Paying for this, it's right in our own policy. It's
very plain you're not covered. Now we got to figure
out what to do. Go with a sure thing Denver's

The Troubleshooter Show Now, Tom Martinez, Hey, hey, hey, give
your family the ultimate Christmas gift.
Speaker 1 (01:10:21):
A whole house water system to soften the water, take
out chemicals, take out total chlorine, uh, take out pharmaceuticals,
drinking water at the kitchen sink, and water softening for
your plumbing, all for forty six ninety five, an incredible price.
I love talking about water pros because of these deals.
(01:10:43):
I love talking about all of our sponsors because of
these deals. Waterpros dot net three zero three and by
the way, it's it's eight six two five five five four,
but it's also waterpros dot net. Paul the Waterman. Now
speaking of deals like we have dimitar A kosterrev On
on from Europlumbing Colorado. Nobody beats them for water heaters.
(01:11:04):
You see our recurring theme. You know, Mark and I
take a lot of reaction from people and quality and
ethics and getting the job done right is important. But Mark,
but Mark, But but price prices? We can't it is
and it's not just the price but the value. But
(01:11:26):
you can't call it a see a lot of people
use that word value to sneak in extra expensive stuff.
All I'm telling you is we have made it so
incredibly easy for you to shop at referralis dot com
and to compare. And it's good to have even our
members competing for your business because they're great people. So
(01:11:48):
Europlumbing Colorado they're doing a water heater. Now, what are
you kidding me? A forty gallon for how much? Fourteen bucks?
You want to fifty? Come on, man, and they've got the.
Speaker 5 (01:11:58):
Those insta hots or whatever they called, you know, starting
around about three thousand bucks. Most companies are seven eight
grand on those. And I'll tell you what they do,
and they do it better than anybody. In fact, they
do it most likely for all the other companies out
there that advertise it. And that's whole house repiping. And Tom,
(01:12:18):
I was asking you this during the break. How long
do you think it takes to go into a house
if you're Euro plumbing and redo all the plumbing in
a house?
Speaker 1 (01:12:28):
Oh, I said, I said, on an average house, you're
going to be there at least Monday through Friday. So
you're going to be there one.
Speaker 5 (01:12:34):
Week, no, at least if he if he goes in
on a Monday, his crew knocks out all the plumbing.
Speaker 1 (01:12:40):
Monday, it's one hundred percent done.
Speaker 5 (01:12:42):
The next day they've lined up the inspector to come
in sign off on it. Then as soon as the
inspector's done, because you have to keep it open to
inspect everything, then they come in and finish the drywall
and paint that day.
Speaker 1 (01:12:55):
So okay, I have this. I have a lot of
questions that I want answered, but not write this minut
I want to go to some callers, but I want
him to start thinking. I want to know exactly what
the process is because I can't even imagine. I'm looking
at my house here, where would you start? How many holes?
Is it all of.
Speaker 4 (01:13:14):
The dry wall or you gutted? And then and then
stuff in there?
Speaker 1 (01:13:18):
Yeah, there's a lot, Yeah, all that stuff, all that
stuff like and what kind of pipe do you use?
Is it better pipe than it was to begin with?
And then okay, So there are just so many questions.
And by the way, the other question, the obvious one.
Who needs repiping? Why do repiping? So we'll talk about
all of that.
Speaker 4 (01:13:37):
Just hang on. I know Dematar and Julius are saying.
Speaker 1 (01:13:40):
We got the answers. We've got the answers.
Speaker 4 (01:13:42):
Let's go to Monica.
Speaker 1 (01:13:43):
Because Monica, I don't know what to do. We have
to explore the downside. You're you're not going to get
coverage for this. They're going to keep after Monica. There's
no there's no withan or butts about it. And even
our public adjuster agrees this language is flat out denial.
I mean, the exclusion is rock solid. There's no argument
(01:14:08):
to be made that they should cover it. And frankly,
it's a waste of time to try to get them
to do it. You're going to have to try to
negotiate with this company or maybe do a bankruptcy or
something serious.
Speaker 4 (01:14:24):
Monica, you called us for help, and.
Speaker 1 (01:14:26):
We took a lot of time looking into this, so
we're not This is not a knee jerk reaction.
Speaker 4 (01:14:31):
Your policy is not going to cover it.
Speaker 1 (01:14:34):
And this, by the way, everyone needs to be aware
of this because these restoration companies, whether you own a rent,
if you have insurance, they come in and start working
right away. And it's amazing to me that they did
not get full authorization before starting.
Speaker 15 (01:14:52):
I had think this restoration company was at was negligent
in the fact that they did take all of my
belongings and put him in the garage and then opened
up the bags. And then the state came in and
discovered now that there's an asbestos in the garage. And
they did tell me that they would replace, you know,
(01:15:14):
everything in the garage that was from them, but they
you know, and I do have that in writing.
Speaker 1 (01:15:19):
Who wait, who said who said they're going to replace
everything in the garage? Who said that? I mean the
insurance company or the contractor. That's the contractor, and why
did he say, Well, what did they do? In other words,
when they took your stuff and put it in the garage,
they exposed it to asbestos?
Speaker 13 (01:15:41):
Correct?
Speaker 1 (01:15:43):
In other words, if they left the stuff So there's so, yes,
the asbestos in the garage. Yeah, I know the asbestos
in the garage. Where did it come from? And how
was it disturbed? You're claiming that some of your stuff
was not was not asbestos polluted until this company put
(01:16:07):
it in the garage. How did it get polluted in
the garage.
Speaker 15 (01:16:13):
Well, what I'm saying is they put all of my
personal property that was in the house that had asbestos
on it, They put it in the bag until they clip.
Then they moved it all to the garage.
Speaker 7 (01:16:24):
So okay, I.
Speaker 15 (01:16:25):
Don't know why they did that. And then they opened
a bag in the garage and then the asbestos from
what was inside of the bag then leaked out into
the garage.
Speaker 1 (01:16:36):
I got it.
Speaker 15 (01:16:36):
Amon did an inspection that day, and they got it
for five or six days.
Speaker 1 (01:16:40):
Yeah, okay, now my question that okaykkkk. But listen, Monica,
the stuff that was in the stuff they put in
the bags and took out to the garage they did
no harm to that stuff. That stuff was already contaminated. Okay,
So what what additional damn did you have in the garage?
(01:17:03):
Like what other stuff was exposed that had not been
exposed before? Like what was the new damage when they
opened up the bags in the garage. By the way,
that was a stupid thing to do.
Speaker 15 (01:17:15):
Thirteen thousand dollars worth of things that was in my
garage ski boots, skip ski boots, sea helmets, goggles, camping gear,
paddleboard gear, bike.
Speaker 1 (01:17:26):
Oh, tools such.
Speaker 5 (01:17:30):
So what did they say about all that when you
talk to the company, I mean, tell me it sounds like, well,
hold on, is it.
Speaker 4 (01:17:37):
True you owe them thirty or forty grand?
Speaker 1 (01:17:39):
Right?
Speaker 15 (01:17:40):
Right?
Speaker 4 (01:17:41):
And now you're saying they owe you fifteen?
Speaker 1 (01:17:43):
Right?
Speaker 5 (01:17:44):
What if they do an offset? Are they willing to
do an offset? Just like Tom just said, good idea? Yeah,
well do you even have.
Speaker 1 (01:17:54):
That money to pay? Though?
Speaker 4 (01:17:55):
Do you have the money to pay?
Speaker 1 (01:17:57):
Do you have any money?
Speaker 15 (01:17:59):
If they put me on payments, they might do that.
Speaker 1 (01:18:03):
Rather they wouldn't, Yeah, because they can't lean the house.
Speaker 4 (01:18:07):
It's not her house.
Speaker 5 (01:18:09):
Well, so listen, Monica, Actually, actually I'm not so sure
about that.
Speaker 1 (01:18:14):
If they did work.
Speaker 5 (01:18:15):
In that house, on the house, on the house, Yeah,
I mean the work they did on the house, why
couldn't they lean it?
Speaker 1 (01:18:22):
Well, they could. But the owner, the owner isn't going
to have He's not going to have a problem with
I don't think with this unless he does. I mean,
he might have the same exclusion for did you get
a look at your own policy market, not that you
don't have to worry about it because your house is new.
Speaker 5 (01:18:40):
Enough in them that I'm just curious because there's a
lot of people out there.
Speaker 1 (01:18:43):
I mean, this is new information.
Speaker 5 (01:18:45):
I just when I heard that they denied it, I
wanted to really dig through our policy.
Speaker 1 (01:18:50):
And figure out why.
Speaker 2 (01:18:51):
And we did.
Speaker 1 (01:18:53):
Yes, these exclusions owners a portion of the claim they did. Okay,
so what is the landlord getting done?
Speaker 15 (01:19:04):
Well, they cleaned, They cleaned all of the you know,
every walls and whatnot. We're cleaned twenty five thousand dollars.
And now it's the rebuilt part where they have to finish,
you know, finish the ceiling, repair or replace on the
basement and then repair the flooring in the main house.
Speaker 1 (01:19:26):
Man, did the landlord did the landlord ever hint that
he might have some coverage for your other stuff. No, okay,
And by the way, we have to remember the original
loss was because of you, Monica. Here's something else I
want to tell you about. You understand that their company,
(01:19:49):
this landlord's company, is going to come after you for
the damages.
Speaker 4 (01:19:52):
Right, That's what I'm worried about more than anything. It's
called subrogation.
Speaker 1 (01:19:57):
What that means is, if you cause the problem, your
insurance will cover you, But will they cover the landlord
because the landlord's policy, you said, is covering everything. But
let's say they let's say the landlord's policy put out
eighty five thousand dollars. I'm taking a number A are
(01:20:18):
going to want to subrogate for that eighty five thousand.
So they're going to look to come to your insurance
company and come to you. Have you ever had a
talk with your insurance company on how they're going to
handle subrogation.
Speaker 13 (01:20:34):
No, I've never even heard that word.
Speaker 1 (01:20:36):
Okay, you need to because in a loss, you have
your direct losses, which are covered by your insurance company.
If you have the right policy, then you have liability coverage,
which covers other people's property. It's suffice it to say
you are the one that caused the problem. Therefore, your
(01:20:57):
liability coverage should be bring the landlord of it. If
his coverage steps in and fixes things based on the
fault of someone else, they're going to go after that
someone else. In this case, you to be made whole.
So that's what insurance companies do. So, Monica, in addition
(01:21:20):
to the thirty five thousand dollars you owe for restoration
or cleaning of your stuff in the basement, they're.
Speaker 4 (01:21:29):
Also going to come out.
Speaker 1 (01:21:31):
You're also going to have about I can't see it
being less than one hundred grand.
Speaker 4 (01:21:35):
Oh my god, more than that, there's no doubt.
Speaker 1 (01:21:38):
So, Monica, you really do have to consider a bankruptcy
or something.
Speaker 4 (01:21:42):
It's important.
Speaker 5 (01:21:43):
I want to give you some advice, and I don't
know your financial and I don't want to dig into
that during this show at least, But do not pay
anything related to this until you.
Speaker 1 (01:21:54):
Know everything you're going to have to pay.
Speaker 5 (01:21:56):
Don't start making payments of a five hundred year, seven
hundred here, because you might be just throwing all that
money out.
Speaker 1 (01:22:05):
That's right, it might be throwing good money after badesty.
Speaker 15 (01:22:08):
Don't make a payment agreement on the thirty five thousand.
He'll know if his insurance company is.
Speaker 1 (01:22:16):
Gonna subrogate come after you, that's right, and they'll.
Speaker 5 (01:22:19):
Go after you, and they'll garnish you. They'll do whatever
they can do to get paid. If you've got a normal,
you know, a W two job. But here's here's the
reason you don't make any of those now, because it'll
get to the point where if you're getting garnished at
work and you're making these payments and all these other
bills are coming up, you might not be able to
afford it. And all that money you paid prior to
(01:22:41):
filing for bankruptcy, and you'll.
Speaker 1 (01:22:43):
Never go back, You'll never get it back. I would
hold off on all payments, and I would consult a
bankruptcy attorney. Monica, I hate telling you this, but you
really need to consider it. A bankruptcy attorney. This is
what bankruptcies are made for. It's so one mistake doesn't
change someone's life forever.
Speaker 5 (01:23:01):
And but let every I would go fold, let it
all unfold to you know where you're at.
Speaker 1 (01:23:06):
But shouldn't she talk to Mike Wink now? Do you
think absolutely?
Speaker 5 (01:23:10):
I would talk to Mike Wink now the consultations free,
tell them what's going on. But a bankruptcy will stop
all of this, every single bit of it.
Speaker 1 (01:23:19):
It will go away. Yeah, it will go away. So
Mike Wink get that number for her Kaschina so she
can call Mike the Wink law firm. He's on a
referral list at referraless dot com. Let lender break.
Speaker 5 (01:23:35):
And then we've got I'm dying to hear about this
speeding ticket. I mean, you know, Danny's got an issue
with the speeding ticket.
Speaker 4 (01:23:41):
What could the issue be? Right, It's like you were
speeding or not? Okay, more on that After this, go
with a.

Okay, let's talk to Danny.
Speaker 1 (01:24:39):
As a Well, you know what, listen, I know we
should talk to Danny, but because we are talking about
asbestos and we're on that line, let me just ask
get Mike's question in real quick, then we'll go to Danny. Mike,
Sorry for the switch up, guys, Mike, what is your
question on asbestos?
Speaker 7 (01:24:57):
Yeah, well, not a question, no question. The insurance company
isn't going to cover it, but right to me, thirty
five thousand dollars, she isn't screw this that once you
look at the contract during her and you expressed this
abatement company, and then I wonder if your abatement companies
also join in.
Speaker 1 (01:25:19):
Well, even if we here's here's the sad truth, though, Mike,
even if we reduced it to let's say five or
six thousand, she doesn't have the money she was depending
on her insurance coverage.
Speaker 4 (01:25:31):
But I get what you're saying. I mean, you you know,
I think.
Speaker 1 (01:25:36):
I think restoration companies in general come in and take
advantage of people.
Speaker 5 (01:25:42):
I do, Yeah, I agree, but most of the time
it's an insurance pay so it really I know it's
like two people, two bad guys, robbing each other.
Speaker 7 (01:25:52):
Oh, that's not the correct She got to the insurance,
the urance.
Speaker 1 (01:25:57):
My got it.
Speaker 4 (01:25:57):
You're like on a magic jack phone.
Speaker 1 (01:26:01):
But Mike, what Mike? What good would it be? Why?
Why do we care if she doesn't have the money
to pay?
Speaker 4 (01:26:08):
What? Why do we care?
Speaker 1 (01:26:09):
Do you think we'd get it down to a price
she can pay? She can't pay five grand. It's going
to be at least five grand. You know, she told us,
She told me, She told us, and.
Speaker 5 (01:26:22):
The insurance company, Mike, and my company is going to
come after her.
Speaker 1 (01:26:27):
Yeah, Mike, it's not just that. What about the subrogation?
When his insurance company goes after her, where's she going
to get that money?
Speaker 7 (01:26:40):
Oubrogation? Who's going to subbrogate? What?
Speaker 4 (01:26:44):
The landlord? The landlords? Listen?
Speaker 1 (01:26:47):
Listen, Mike, Mike, can you listen. The landlord's company. The
landlord's company wants to be reimbursed. So that's called subrogation. Yeah,
the landlord. She rents this place, and her landlord had
severe damages as.
Speaker 4 (01:27:06):
A result of this loss.
Speaker 1 (01:27:08):
The loss was a result of one of her appliances.
They're going to come after her for subrogation, Mike. Just
just Mike, Mike's into transmitting, not receiving. Just let's cut
them off. Right, I'm done. I'm done.
Speaker 4 (01:27:21):
What he's saying is right.
Speaker 1 (01:27:23):
If you can negotiate a price, if truly you're being gouged, negotiated,
But why negotiate it if we're never going to have
the money to pay. Ever, she's never going to have
the money to pay, not the subrogation and not the cleaning. Danny,
what's going on with your speeding ticket? Danny?
Speaker 4 (01:27:39):
Welcome to the show?
Speaker 1 (01:27:44):

Speaker 4 (01:27:45):

Speaker 4 (01:27:50):

Speaker 1 (01:27:51):
Oh, we'll check him in. We'll check him in a second.
All right, Charla, Charlot, real quick? What are you talking about? Charlotte?
Affordable housing? Not in Colorado? Hi?
Speaker 4 (01:28:02):
Tom, Hi Charlotte. What's going on?
Speaker 13 (01:28:06):
I have a Denver affordable housing home. So it's home.
You buy it a discounted rate.
Speaker 1 (01:28:13):
Yeah, and you have to and you have to keep it. Yeah,
you have to right keep. What happens when you go
to sell it?
Speaker 13 (01:28:20):
Well, I'm not going to sell it. But my tax
my tax evaluation this year was full was for the
full market value of the house.
Speaker 14 (01:28:31):
Oooh in forty three thousand, but I can only get
like one hundred If I sell it for three hundred
and forty.
Speaker 13 (01:28:40):
Three thousand, I can only keep about one hundred and
sixty five thousand of that and the rest.
Speaker 1 (01:28:45):
Right, what did you pay? What did you pay for
the home?
Speaker 4 (01:28:48):
Charlotte?
Speaker 13 (01:28:50):
I paid one hundred and four thousand back in twenty thirteen.
Speaker 4 (01:28:55):
Okay, now what program was it?
Speaker 13 (01:28:57):
Called Denver Affordable Housing?
Speaker 1 (01:29:01):
And okay, okay hosts now this Denver Affordable Housing? How
long do you have to keep it before you can
keep every dime you sell it for? Or do you
always have to pay back?
Speaker 13 (01:29:15):
You always have to pay back?
Speaker 4 (01:29:17):
All right, hold on and we'll come right back to you.
Speaker 1 (01:29:19):
Okay. I want to explore this to see what we

Hi Tom Martino, you're a troubleshooter three oh three seven
one three talk seven one three.
Speaker 4 (01:30:08):
Eight two five five.
Speaker 1 (01:30:09):
So we have the speeding ticket guy, and then we
also have Charlot. Let's go back to Charlo, and then
I'll go with Danny was disconnected. But Charla, right now,
you're in affordable housing. Mark, you looked it up. And
when you're part of this affordable housing program, because you
get it at such a deal, they don't want you
selling it two or three years later and bankrolling yourself
(01:30:32):
on the taxpayer's dollar. So she paid, She paid one
hundred and four thousand dollars for this home. I just
need to ask something. Then I'll let Mark take over here.
But Charlotte, let me ask you. At the time twenty
thirteen you bought this home for one hundred and four
what was that home?
Speaker 4 (01:30:50):
What would that house normally sell for?
Speaker 14 (01:30:56):
Well, like my tax valuation this year three hundred and
forty three thousand.
Speaker 1 (01:31:02):
Okay, do you know what it would have sold for.
What would it have sold for? What kind of a
discount did you get? Just roughly probably about two hundred thousand, right,
you probably got it for half price? Yeah, yeah, I
think you got probably half off anyway. Mark, what happens
when people take advantage of this affordable program? And what
(01:31:24):
do you have to do to qualify?
Speaker 4 (01:31:26):
Well, the qualification is basically all income.
Speaker 5 (01:31:29):
I mean you still have to have a job, of course,
and you have to have decent credit and all that
stuff like that, but usually fifty to one hundred percent
of the average or the medium income okay, okay qualify.
So if you're if you're there, you can qualify. It's
pretty interesting though. They use a deed restriction and from
(01:31:50):
what I can see, it never goes away. So when
she sells it, generally they'll give you three to five
percent of an increase per year maximum, but she can't
sell it for more than that. So even though it's
been ten or twelve years, she can only sell it
for probably like one hundred and eighty one hundred and
seventy wherever it is, even even though it's worth three
(01:32:10):
hundred and forty.
Speaker 1 (01:32:11):
But what where does the rest of the money go
when she sells it.
Speaker 4 (01:32:16):
Well, she's got to sell someone that qualifies.
Speaker 1 (01:32:19):
Oh you mean she can't just sell it on the
open market's affordable, always affordable.
Speaker 5 (01:32:25):
She's got to sell it to somebody in her position.
I mean, yeah, absolutely, so that deed restriction never goes away.
Speaker 4 (01:32:32):
But she brought up something I never thought about.
Speaker 5 (01:32:34):
And the reason I know so much about this years
ago I was looking at some Renolds and Stapleton and
one of the ones I happened to look at was
one of these houses, this low income and I didn't
know it. It was a brand new one, and the
one right next door to it was it. So, in
other words, the exact same house one right for low
income one wasn't. But this is crazy, Tom, You pay
(01:32:59):
when it comes to taxes, She's gonna pay taxes going
forward on the value of that house.
Speaker 4 (01:33:05):
So if that house on.
Speaker 5 (01:33:07):
Her assessment is three hundred and forty, she's paying taxes
on three hundred and forty, even though she can only
sell it for oneint eighty or whatever she can sell
it for.
Speaker 4 (01:33:16):
And that I just verified, And that is crazy.
Speaker 1 (01:33:20):
Now, you don't think there's any way to protest that
valuation mark based on what.
Speaker 5 (01:33:25):
No, the valuation, I mean one hundred percent here it
is right here. Taxes are not reduced or adjusted for
deed restricted houses. Property tax assessors value all homes, including
deed restricted low income at their full unconstricted market value.
Speaker 1 (01:33:43):
Wow, so you owe the money? How much did yours
go up?
Speaker 5 (01:33:46):
And everybody out there that voted for a mayor Mike
and uh, well, I don't even want to say Hick
and Looper. I guess it would be polish now, but
I forget. I think it was Polis that got rid
of Gallagher, wasn't it.
Speaker 1 (01:33:59):
I thinkyeah, it was under his rule, under his rule.
So really, how much are your taxes going to be?
And how much did they go up? Yeah?
Speaker 13 (01:34:08):
Well, in the past year, my tax valuation has always
been based on the amount I could keep.
Speaker 4 (01:34:15):
Really, really, then why did it?
Speaker 2 (01:34:18):
Wait?
Speaker 10 (01:34:18):
Mark?
Speaker 4 (01:34:19):
Did you hear that she said it was?
Speaker 1 (01:34:21):
It was at one time based on what she would
have made. When did it change? I think it was.
Speaker 5 (01:34:28):
I think they simply it was a loophole or something.
I don't think they did that on purpose. I think
she got lucky. Yeah, she made a mistake.
Speaker 1 (01:34:35):
I mean they made a mistake, not her, But listen,
let me ask you something, Charlotte. The fact that you
bought let's just look at it for what it is,
the fact that you bought this home for half its
value when you first bought it, and you have way
less of a payment because of it. Is this tax
burden going to be that much? I mean, isn't it
(01:34:56):
really still a bargain? For God's sakes? I mean, think
about it.
Speaker 13 (01:35:02):
Well, it's going to increase my house payment. Uh, it
could be as much as two hundred and fifty dollars
a month.
Speaker 1 (01:35:08):
Wow, Wow, a ton of money and what And I
guess the argument she's making is she's paying on phantom
value that she'll never realize.
Speaker 5 (01:35:18):
And I just verified that stuff. It's always listen to this.
The property taxes in Denver have always been calculated on
the full unrestricted market value period.
Speaker 4 (01:35:30):
You just got lucky as hell, That's all it comes
down to.
Speaker 9 (01:35:32):
Well, well, I checked.
Speaker 13 (01:35:34):
I was able to check my neighbor's tax you know,
valuations also, and then based on what they can, like,
what they can make on the house around their's is
based on that too. Mine is one of the few
that went up to the full market value. So I
(01:35:56):
protested my tax valuation twice.
Speaker 1 (01:36:00):
Wait a minute, why are your neighbors Your neighbors are
still paying on the discounted amount.
Speaker 13 (01:36:06):
Yes, so I've been trying to contact Demver Affordable Housing
for since.
Speaker 5 (01:36:13):
You listen every thing I'm seeing, I mean, from everything
I'm seeing, your neighbors are just lucky.
Speaker 1 (01:36:21):
You were lucky.
Speaker 5 (01:36:22):
You're supposed to be paying the full ride.
Speaker 13 (01:36:26):
Okay, I never knew that. I was never called.
Speaker 4 (01:36:30):
You said you challenged it.
Speaker 1 (01:36:31):
So you challenged it?
Speaker 5 (01:36:32):
And what did they say? Did they come back and say, nope,
you owe it on three forty.
Speaker 13 (01:36:38):
Yeah, well yes, basically yes.
Speaker 4 (01:36:40):
And did you tell the person?
Speaker 1 (01:36:42):
Did you tell them during the case, did you tell
them during the zoom meeting or however you did it?
Speaker 5 (01:36:48):
Did you say, wait a second, you know I have
a deed restricted house?
Speaker 16 (01:36:54):
I did?
Speaker 1 (01:36:54):
And what did they say?
Speaker 2 (01:36:55):
They did?
Speaker 13 (01:36:57):
They said, I need to contact Demver Affordable Housing, which
I've been trying to but nobody will get Nobody will
get it.
Speaker 5 (01:37:05):
We owe it tour, we owe it tour to double
triple check. So let's put some somebody on it. Tom
to reach out to dent Real five. I would like
I would like Deputy Dollar to look into this. He's
into numbers, and yeah, can probably make He's feeling pretty
spunky today, So yeah, that's an inside joke.
Speaker 1 (01:37:25):
Yeah, okay, I'll tell you what. Hang on, Charlotte, we're
gonna get you hooked up with Deputy Dollar. Let me
mark that down and then and see what he can
find out. Like Mark said, we owe it to at
least find out. It might turn out. Look, there are
a lot of people right now. In fact, I just
got a text saying, you know, I wish I could
get my house for half price. I'd happily pay the taxes.
(01:37:48):
But listen, look, these programs are there for a reason.
Charlotte would otherwise not have a home. And sometimes that's
the difference in someone's life.
Speaker 5 (01:37:58):
Now, think about it, two hundred and fifty more a month,
all of a sudden, it's crazy, No, it is, it is.
But that's that's Polish, that's Mike, that's Mayor Mike and
Polish and the Gallagher Amendment and all that, all of
our property tax every time, listen, easy, every time we
turn around, we're being ripped off and we're being lied to.
When they said the Gallagher Amendment wouldn't raise taxes, doing
(01:38:20):
away with that.
Speaker 1 (01:38:21):
It was so ridiculous. And now right, lie, and now
how about the lie about without raising taxes?
Speaker 4 (01:38:29):
Shall we have a billion dollars?
Speaker 1 (01:38:30):
Yes?
Speaker 4 (01:38:31):
And all it comes stand the same damn loan.
Speaker 5 (01:38:34):
It's like it's like if you've got a fifteen year
mortgage and you get to the very last day, that
very last month, the very last payment, after fifteen years,
and the bank goes, well, we're going to go ahead
and extended another fifteen years.
Speaker 1 (01:38:49):
That's exactly right, cuckoo. Okay, let's keep going here. And basically,
Danny will get started with you. What happened with your
speeding ticket? What tell me what's going on? Danny.
Speaker 17 (01:39:03):
I got an I got a notice in the in
the mail and it says your vehicle was photographed speeding
blah blah blah blah, and uh and I've gotten until
December fifth to pay eighty dollars and that's.
Speaker 1 (01:39:19):
Hey, hold on it. Well, well we'll talk to you
about it coming up, because we've done a lot of

Speaker 4 (01:40:41):
Have we had a busy morning.
Speaker 1 (01:40:42):
Talking about your problems, questions and complaints.
Speaker 4 (01:40:46):
Right now we go to Danny about.
Speaker 1 (01:40:48):
This speeding ticket and basically tell your story. Danny, you
got a photo radar ticket. And first of all, let's
get to the basics. Is it you driving the car?
Is it truly you?
Speaker 9 (01:41:01):
There's no way to tell it. The photographs they sent me.
You can't see who's driving.
Speaker 1 (01:41:06):
Danny, I'm not asking that. That's not what I'm asking.
I'm asking is were you driving? Were you driving your
vehicle at the time.
Speaker 9 (01:41:16):
I have no idea, I don't know what wholl Okay.
Speaker 1 (01:41:18):
Let me ask you another question. Who else drives your vehicle.
Speaker 9 (01:41:23):
To my family?
Speaker 4 (01:41:25):
Okay?
Speaker 1 (01:41:26):
And on the time and date were they driving your
vehicle or were you driving your vehicle?
Speaker 17 (01:41:31):
I don't know. I don't know.
Speaker 10 (01:41:33):
I just got this thing.
Speaker 4 (01:41:34):
And that I think.
Speaker 1 (01:41:36):
Okay, it sounds to me like you're playing games. I
think you do know who is driving. But it's okay.
You can play games and they won't let you. You're
going to have to pay it. Basically, photo radar tickets
are now decriminalized to a point where they can serve
you by mail and they basically accuse you. It's not criminal. Okay,
they did this on purpose. They made it a civil action,
(01:41:58):
and they made it a private civil action, which means
you're not being accused of a crime. You don't have
a right to confront your accuser. You don't get to
go to court. You're either guilty or not guilty. If
you want to dispute it, you can dispute it. So
just do what you say. If you're not driving it
and it's not you, then they may ask you who's driving.
(01:42:19):
You don't have to tell them. You can fight it.
It's an accusation and a request to pay.
Speaker 4 (01:42:26):
That's all it is. That's really all it is.
Speaker 1 (01:42:29):
So you have to decide if you want to pay
it or not.
Speaker 17 (01:42:36):
Okay, what happened to find?
Speaker 9 (01:42:38):
Just ignore it?
Speaker 1 (01:42:39):
Okay, now there's there's a cup. Go ahead, What were
you going to say? If you ignore it?
Speaker 4 (01:42:44):
Go ahead.
Speaker 17 (01:42:46):
Failure to respond may cause the matter to be submitted
to a clust.
Speaker 1 (01:42:51):
That's exactly right, and what they will do is pursue collection.
It's not a law enforcement action, So if you ignore it,
they may send it to a collection agency who will
then take the matter to court to try to prove
you were driving or not. So it's really up to
how much you want to fight this. I'm Tom Martine,
(01:43:13):

Kathy and Kevin want to talk about a home security
camera or or an issue with it.
Speaker 4 (01:44:54):
I guess Kathy, Kevin, Hi, welcome to the show. What's happening?
Speaker 1 (01:45:00):
Hey? Tom?
Speaker 16 (01:45:01):
What's going on? We have a security call through the I, V, I,
N T and VI. We tried to go ahead.
Speaker 1 (01:45:14):
Now go ahead, Yeah, Vivint, it's a it's a security company.
And what do you have to get out of a contract?
Speaker 5 (01:45:21):
You might as well try to solve cancer.
Speaker 1 (01:45:25):
Wow, So Vivint, what kind of security system do you
have with Viviant?
Speaker 16 (01:45:32):
It's a home security cameras?
Speaker 1 (01:45:36):
Just a camera or is it a whole system?
Speaker 16 (01:45:40):
Well, we got two cameras, a little monitor and then
they walk back in life.
Speaker 1 (01:45:46):
Yeah. Does it also have motion? Does it also have
motion detectors or stuff like that or not?
Speaker 9 (01:45:54):
Yes?
Speaker 1 (01:45:55):
Okay, So you have a homes you have a Vivant,
you have a vivid home security system.
Speaker 4 (01:46:00):
What is your question?
Speaker 16 (01:46:03):
Well, we're trying to get out of it. We tried
to call on a couple of days after how.
Speaker 1 (01:46:10):
Long have you had this? How long have you had the.
Speaker 9 (01:46:13):
System since June of this year?
Speaker 1 (01:46:18):
Okay? Now, why do you want to get out of
the contract.
Speaker 18 (01:46:23):
Well, the first thing is we can't make the payments.
And we found out that my brother has got skincap
of the lily bag, I got fletly skin. Answer, and
there's no way that we can come up.
Speaker 4 (01:46:37):
With How much is it? How much is it?
Speaker 16 (01:46:42):
They're saying that the current balance is two thousand, two
hundred and thirty cents.
Speaker 1 (01:46:52):
Wait, hold on a second, Kathy and Kevin, hold on
a second. So when you entered into this contract, were
you leasing the system or buying the system? Or tell
me the situation. What kind of an agreement are you in?
Speaker 16 (01:47:08):
Well, the guys that came out and talked to us,
Tom said that we can cancel it anytime.
Speaker 13 (01:47:15):
And that's not the case that they're they're of.
Speaker 1 (01:47:19):
How lost to the case.
Speaker 4 (01:47:20):
How it's a five go ahead?
Speaker 2 (01:47:23):
Tom?
Speaker 4 (01:47:23):
How do you know that mark?
Speaker 5 (01:47:24):
That's almost every vivance of five year contracted minimum?
Speaker 4 (01:47:27):
Okay?
Speaker 5 (01:47:28):
And the case they roll the price in so of
the camera, So you pay I don't know, fifty one
hundred bucks a months, whatever it is, and some of
that goes towards the lease on the camera itself. So
when she says two thousand dollars, that's probably what they
want for the equipment.
Speaker 4 (01:47:43):
So did you, Kathy?
Speaker 1 (01:47:45):
You asked them what it would take to get out
of the contract, and they told you if you canceled,
you would owe this money. Yeah, how much are the
monthly payments? You still didn't tell me that? What are
the monthly payments?
Speaker 16 (01:48:00):
Well, they're saying amount due now is two hundred and
thirty dollars and sixty.
Speaker 4 (01:48:07):
Yeah, but how much is it?
Speaker 16 (01:48:08):
Jer?
Speaker 4 (01:48:09):
How much? How much?
Speaker 1 (01:48:10):
Every single month? Just do you recall what your monthly
payment is.
Speaker 13 (01:48:20):
Right off hand?
Speaker 9 (01:48:21):
Don't tone?
Speaker 1 (01:48:23):
Okay, okay, but you said you you said you can't
come up with the monthly payments. So that's why I'm asking.
How much are the monthly payments?
Speaker 18 (01:48:34):
Well, like I said them, do now is two hundred?
Speaker 1 (01:48:39):
She just doesn't understand that's right, all right?
Speaker 4 (01:48:42):
Hey, Kathy and Kevin?
Speaker 1 (01:48:43):
Are you are you brother and sister or husband and
wife or just friends.
Speaker 4 (01:48:50):
Your brother and sister? Okay? May I ask something? Okay?
Speaker 1 (01:48:54):
Now, are you guys working or are you on any
kind of disability payments or any kind of social services.
Speaker 4 (01:49:01):
What is your situation?
Speaker 16 (01:49:04):
We're both on the s s I, and what.
Speaker 1 (01:49:08):
What is the nature? What are the nature what's the
nature of your disability? If you're on s SI, well
you're on supplemental income?
Speaker 4 (01:49:17):
What do you have? Disabilities?
Speaker 16 (01:49:20):
Yes, health, both have health problems and as well as
comprehension problems.
Speaker 1 (01:49:30):
Yeah, that's what I was wondering. So you guys live
together alone? Where are your parents? What?
Speaker 4 (01:49:39):
I just want? Okay, I just wanted to know, Mark.
Speaker 1 (01:49:41):
I have a feeling that these two are getting disability
payments or supplemental Security income because they can't work. Oh my,
is that right?
Speaker 4 (01:49:52):
How old are they?
Speaker 5 (01:49:53):
When you asked that, I was thinking they were pretty old,
and I was saying, no.
Speaker 1 (01:49:57):
No, I understand that. No, I unders stand that, but
I don't know how old. I just wanted to know
what the situation was. How old are you guys?
Speaker 16 (01:50:07):
I'm sixty or my brother?
Speaker 1 (01:50:11):
Oh my god? Okay, okay, Now I have a feeling
that they took advantage of these two. Oh that's what
I have a feeling. I have a feeling and I
hate are you you said problems with comprehension Kathy or Kevin.
Do you guys have learning disabilities?
Speaker 9 (01:50:34):
Yes?
Speaker 4 (01:50:36):
What what are you? What is your diagnosis?
Speaker 19 (01:50:41):
Learning?
Speaker 10 (01:50:42):
Learning?
Speaker 16 (01:50:43):
Learning like low learning?
Speaker 1 (01:50:46):
Okay, okay, now here's okay. So you're developmentally challenged a bit? Yes?
Who owns the how did they? Good? Question?
Speaker 4 (01:50:57):
Who owns the house?
Speaker 16 (01:51:00):
Man, Kathy?
Speaker 4 (01:51:02):
Okay, did your parents leave?
Speaker 1 (01:51:06):
No?
Speaker 16 (01:51:07):
The house that we're in is me and my brother
got it? And what if not? Actually we don't actually
own it. We're making payments like a rent to own.
Speaker 4 (01:51:19):
Oh, this is a slam dunk. I mean, just don't
pay the bill.
Speaker 1 (01:51:23):
Okay, hold on, you said rent to own, Kathy, hold
on a second, what do you mean rent to own?
Speaker 16 (01:51:31):
Rent to own is like we're making payments to a
mortgage company.
Speaker 1 (01:51:36):
Oh got it?
Speaker 4 (01:51:37):
Okay, I got it.
Speaker 1 (01:51:38):
So you but you do basically own the house. How
did you find this house to live in?
Speaker 4 (01:51:43):
Was it left you by your parents? Or did you
find it?
Speaker 16 (01:51:48):
My brother found it on the internet?
Speaker 5 (01:51:51):
Okay, so we got to just let's get the property
address at some point, and I'm going to look up
the ownership.
Speaker 1 (01:51:57):
I don't know if they own it. Okay, I think
here's what I want to know. Here's my main question,
how did this Vivant salesperson find you? Did you make
an inquiry or did they knock at your door or
did they email you?
Speaker 4 (01:52:14):
How did they find you?
Speaker 9 (01:52:17):
They they knock the door, They go out from house
to house and they.
Speaker 4 (01:52:21):
Were okay, they took it is this is horrible.
Speaker 1 (01:52:25):
This is they took advantage.
Speaker 4 (01:52:26):
That's right, and that's exactly right.
Speaker 1 (01:52:28):
I have a feeling that they took advantage of you,
and I want someone to kick their ass. I want
someone to call them up and tell them we know
what their game is.
Speaker 5 (01:52:36):
This this reminds me of, and I hate to say it,
the one where the Direct TV reces the salesperson or
the reseller sold the direct TV system to a blind person.
Speaker 1 (01:52:49):
Right, who couldn't use it. So this salesperson was going
door to door, right, yes, sir?
Speaker 4 (01:53:01):
And did they I want to.
Speaker 1 (01:53:03):
Know if they told you you had so they said
you could cancel at any time. Is that right?
Speaker 18 (01:53:11):
The guy that came to the house and talked with
said we can cancel at.
Speaker 5 (01:53:16):
Any time, which is you have which is technically true,
but you have to pay off the equipment.
Speaker 1 (01:53:23):
Now here's what I want to know. The guy that
came to your house. Do you have his name and number?
Speaker 9 (01:53:30):
If I still.
Speaker 7 (01:53:33):
Have his number?
Speaker 1 (01:53:40):
Guy, I can't. I can't tell you how much I
hate Vivid. I can't tell you how much I hate him.
I hate him.
Speaker 5 (01:53:48):
We got honest to God, go out on this scammer, man,
I mean this is crazy. Just just look at who
we're talking to right now. What this is a I
know there's a certain place in hell for a guy
like Debt.
Speaker 1 (01:54:02):
And what is it?
Speaker 16 (01:54:06):
Don't have his first name is James, and my brother
should have is ID number.
Speaker 4 (01:54:18):
Okay, you know what I want to have Bo?
Speaker 1 (01:54:21):
Listen.
Speaker 4 (01:54:22):
I want BO on this for a reason. Let's let's
get there.
Speaker 1 (01:54:26):
Or deputy or deputy D. I mean you want someone
who's gonna I really think this is perfect for BO
and I mean that.
Speaker 4 (01:54:33):
Okay, Okay, good.
Speaker 5 (01:54:34):
Let's get all the information from them you can, Kelly,
mainly the phone number, and Bo's going to reach out.
It's not going to be as simple by any means
as saying email us the information. We've got to dig
deep on this one and find this crook. Well, he's
not a crook, he's a he's an aner or whatever.
He just took advantage.
Speaker 1 (01:54:51):
You can tell you can tell from talking to him, Diane,
what's that?
Speaker 4 (01:54:56):
What's she saying?
Speaker 9 (01:54:59):
And this this guy is still working for him?
Speaker 5 (01:55:01):
Yeah, we're okay, we're going to help you out. But listen,
don't pay anything. Don't pay anything to me.
Speaker 1 (01:55:06):
May I ask? That's a question. I want to ask
a question. Oh, this is curious. How did you know
to call us? Kathy? I'm just curious.
Speaker 16 (01:55:15):
I heard some other friends and I went through.
Speaker 1 (01:55:20):
Google and okay, good, here's your.
Speaker 16 (01:55:23):
Radio station yesterday at your house. I couldn't find it,
So somehow I got the number and.
Speaker 13 (01:55:31):

Speaker 9 (01:55:33):

Speaker 2 (01:55:57):

Speaker 1 (01:55:58):

Speaker 9 (01:55:59):

Speaker 21 (01:56:04):
My attorney convinced me to get.
Speaker 9 (01:56:07):
A restraining order, and which is fine.
Speaker 21 (01:56:11):
There is plenty of pictures to show. But after that,
he was breaking in. He and his friends were breaking
in the department and stealing stuff, and it was driving
me insane. I moved and they're still breaking in okay
at my complex refused to change my locks.
Speaker 4 (01:56:34):
Are you sure?
Speaker 1 (01:56:35):
Are you sure they're break How are they getting into
your part?
Speaker 4 (01:56:39):
Do you actually see them get in or you just
know they were there?
Speaker 20 (01:56:43):

Speaker 2 (01:56:44):
You know?
Speaker 1 (01:56:46):
Yeah?
Speaker 9 (01:56:46):
I know?
Speaker 4 (01:56:47):

Speaker 19 (01:56:50):
They came into my new apartment and opened the safe

it was, took papers out and put papers in from
his last divorce.
Speaker 1 (01:57:05):
And why are they doing this, Diane? Why are they

Speaker 1 (01:57:11):
I don't care, Okay, I mean, are you okay?
Speaker 4 (01:57:17):

Kusterrev and Julius Smith, both in from Europe Plumbing Colorado.
The basic questions I'm getting I summarized here. Who needs repiping?
When we hear about repiping.
Speaker 4 (01:58:43):
Who needs it? Who needs repiping?
Speaker 8 (01:58:47):
So the repiping is going to be needed by people
that are going to experience leaks uh on the pipes
so they can prevent a big demis.
Speaker 1 (01:58:58):
Yeah, but but it isn't it me for people who
never had copper to begin with? We're talking about older homes, right,
the old clay or led stuff.
Speaker 8 (01:59:07):
Or what mostly is the old homes galvanized right, ice,
copper and olibrity lane. It's very leaking pipes.
Speaker 1 (01:59:16):
Okay, So how do they know, like what age of
a home usually needs repiping?
Speaker 4 (01:59:22):
How old of a home.
Speaker 8 (01:59:23):
Usually anything older than twenty years. You can look for it. Pipe,
even pipe, sorry, even copper pipes. They can start leaking,
pink holes, corrosion. You can experience all these and then
(01:59:43):
you can do so.
Speaker 1 (01:59:44):
But it's mostly mostly copper. If it's done properly, it's
gonna last you the life of the home.
Speaker 4 (01:59:52):
Mostly it's usually for places.
Speaker 1 (01:59:54):
That weren't done properly or galvanized pipe or old fashioned homes. Right,
I mean the one who have substandard plumbing. So do
you do a test to see if they have a
lot of problems?
Speaker 4 (02:00:08):
Can you do a test?
Speaker 5 (02:00:10):
I bet it's like I bet it's like a water
heater or a furnace. People never think about it until
they have a big problem in a leak I mean, right,
Or do people call you and go, hey, my house
was built in the fifties, do I need piping?
Speaker 1 (02:00:26):
Yet?
Speaker 8 (02:00:27):
People calling about people are calling coastal and asking we
have a freezing pipes, how we can prevent the freeze right?
And wipes they can expend and then they're going to break.
Speaker 1 (02:00:43):
Yeah. Now, let me ask you though, is there a
test to see if a home is leaking or having
pressure problems?
Speaker 8 (02:00:52):
Yes, we can do a visual inspection on every home
every connection.
Speaker 1 (02:00:59):
Okay, And then and when you repipe? Do you repipe?
Here's what I need to know. Do you repipe to
each appliance? Like, for example, does everything get a new connection?
Speaker 8 (02:01:14):
Everything? Absolutely everything in the house is going to get
new pipes every start from the main water valve up
to the any fixture, including the new anglestar valves, new
supply lines, flexible we even put on you.
Speaker 1 (02:01:32):
And how many how many access holes do you need
to do? I mean, it sounds to me, it sounds
like an instrumountable task. But do you guys make how
many holes do you need around the house to get
into the piping?
Speaker 8 (02:01:46):
Usually we do between ten and twenty depends on the
size of the house.
Speaker 5 (02:01:51):
That's all, yes, and time it takes one day.
Speaker 1 (02:01:57):
Wow, So how do you know where to or how
do you know where to put the holes?
Speaker 8 (02:02:03):
We just inspect the house and we uh know where
the pipes are gonna go in the.
Speaker 1 (02:02:10):
In the wall, and how many like how big are
these access holes?
Speaker 8 (02:02:14):
They're usually two by two feet or three by three.
Speaker 1 (02:02:19):
Okay, And then you go and run pipes through from
one hole to another to the appliance. And then you
do the the final connections. And what kind of piping
do you use? We use the pecks, so there are
no joints or elbows or anything. Really, you just you
can string that stuff along, can't you. It's all one
(02:02:41):
solid piece with the long runs. Right. Uh.
Speaker 8 (02:02:45):
We use some elbows, some teas, but most of it
is going to be a hole, one piece pipe.
Speaker 1 (02:02:53):
Un one run. Yeah. And when you talk about pecks,
talk about how wonderful it is. I mean, well, in
new homes right now, should do nothing butt pecks. Isn't
it flexible enough to withhold under some freezing conditions? Yes?
Speaker 5 (02:03:10):
It is, so it can't freeze or I mean like
negative thirty it would freeze right.
Speaker 1 (02:03:14):
No, no, no, it can freeze, but it doesn't burst, oh,
because it expands. Yes.
Speaker 8 (02:03:21):
And the other good thing is that those pipes, the
connection or with the time, they get even stronger.
Speaker 4 (02:03:28):
Ah, huh.
Speaker 8 (02:03:29):
All right, now that's expansion pecks.
Speaker 1 (02:03:32):
So we are the is the old pipe left in
the walls or do you pull it out?
Speaker 2 (02:03:37):
Oh?
Speaker 8 (02:03:37):
Usually we pull it out if something really is not
the low doesn't low it right?
Speaker 1 (02:03:45):
So where you can? Where you can you pull it out?
Speaker 5 (02:03:48):
Yes, and then you put and I want to make
sure we don't forget this part. And they basically do
it at the rock bottom price out there.
Speaker 1 (02:03:58):
Tom.
Speaker 5 (02:03:58):
In fact, if you see a comercial on TV for
another place that advertises very heavily for whole house repipes,
these are the guys that actually do it. They do
a ton of wholesale work and they pass that on
to the regular consumer, which is crazy.
Speaker 1 (02:04:15):
So you need repiping with older homes, even with copper plumbing.
If you're experiencing a lot of issues, you do ten
or twenty access holes. You use text piping, which is
resistant to freezing. You try to retrieve the old pipe
unless it can't be done in some areas. And after repiping,
(02:04:37):
is there anything else people usually need? When you do
this repiping? You need drywall repair? Do you guys do that?
Speaker 8 (02:04:46):
Yes, we do drywall repair. So the whole process usually
takes about three days. First day we do the plumbing,
the second day is going to be inspection from the city,
and the third day we're gonna finish the drywall.
Speaker 5 (02:05:00):
Please come and when he done, a like a wholesale
retail everything. How many have you done?
Speaker 8 (02:05:06):
Oh we've done thousands, thousands.
Speaker 4 (02:05:09):
Oh my god, I have a feel.
Speaker 1 (02:05:10):
And they know how to do them.
Speaker 8 (02:05:12):
And the other good thing for the and I recommend
the people to reply is because that's going to increase
their home value.
Speaker 1 (02:05:20):

lifetime of the home, right it's gonna And and by

What's going on with your lawyers?
Speaker 20 (02:07:57):
Okay, we're divorced, so they're done. But they he taken
about one hundred and eighty four thousand dollars that I
won in lottery tickets and he took them.
Speaker 1 (02:08:10):
And wait, how did you won one hundred and eighty
four thousand dollars?
Speaker 21 (02:08:17):
Yeah?
Speaker 1 (02:08:18):
Do you have a rek? Do you have an actual
record of that? Did you actually retrieve that money?
Speaker 20 (02:08:24):
No? Because he took it. And when we were winning before.
Speaker 1 (02:08:30):
I'm on Now, how many times did you win? How
many times did you win to get one hundred and
sixty four thousand dollars?
Speaker 20 (02:08:37):
It was all in like two weeks. It was on one.
Speaker 4 (02:08:41):
Ticket, one ticket, okay, well.
Speaker 20 (02:08:45):
Two tickets, it was two tickets, and it over and
over and over they won I get lucky like that.
I want a million dollars before I get communitions?
Speaker 4 (02:08:59):
And what did you What did you do with the
million dollars you want?
Speaker 9 (02:09:05):
We spent it?
Speaker 4 (02:09:08):
I how did you spend a million dollars?
Speaker 20 (02:09:11):
I I, well, I was in Omaha, I got cancer
until we had to go to so all that going on,
I had to go to.
Speaker 1 (02:09:25):
Uh, Diane, what is your diagnosis? You says you're under
care right now for mental problems.
Speaker 4 (02:09:30):
What's your diagnosis?
Speaker 20 (02:09:33):
Multiple sculosis is my big problem? But I had gone to.
Speaker 21 (02:09:42):
Denver Spring for that.
Speaker 13 (02:09:47):
Daily.
Speaker 1 (02:09:48):
Do you have any other diagnoses? Don't you have a
mental illness of some kind?
Speaker 4 (02:09:52):
You were you.
Speaker 7 (02:09:53):
Said, just multiple grosses?
Speaker 1 (02:09:56):
Oh, I'm sorry, I misunderstood you. So you want a
million dollars? You want a million dollars before?
Speaker 20 (02:10:04):
Yes, that was in two thousand and eight. That was
way before. I just get lucky, not in life, just
sometimes in numbers.
Speaker 1 (02:10:12):
So you want a million dollars in two thousand and
eight and you blew through that. And recently you won
one hundred and sixty four thousand in the state lottery.
Speaker 20 (02:10:22):
Yes, on the twenty thousand dollars that one and it
won like four or five times?
Speaker 1 (02:10:30):
Okay? How do you win four or five times on
one ticket? Can someone help me on that? I thought
you once you win, you have to cash it in.
Speaker 20 (02:10:38):
Yes, but I did tickets for multiple dates. Yeah, like
I would do tickets for a month at a.
Speaker 1 (02:10:47):
Time, okay, whatever that means. Okay.
Speaker 20 (02:10:51):
And he's like, I bought a ticket and you can
do it one day or you can do multiple days.
So I'll do thirty.
Speaker 1 (02:11:02):
Like that, okay, and you would pay extra for that,
right right?
Speaker 10 (02:11:08):
Well?
Speaker 20 (02:11:08):
Yeah, two dollars or one.
Speaker 9 (02:11:10):
Dollar is thing per day.
Speaker 5 (02:11:11):
I think she's saying, when you buy a lottery ticket,
it's two bucks. She bought one for I don't know
every day.
Speaker 1 (02:11:18):
Yeah, I guess. So where are your where are your
winning on this one hundred and sixty four thousand dollars?
Speaker 4 (02:11:24):
Where did the money go?
Speaker 20 (02:11:27):
Dale took it?
Speaker 13 (02:11:28):
I didn't sign it.
Speaker 1 (02:11:29):
How can you prove that? How can you prove that
he took your money?
Speaker 20 (02:11:34):
Because I have played those numbers forever and so I
know I called them. You have to have the top
number and the bottom number and you can prove.
Speaker 1 (02:11:47):
Okay, So he does he admit that he took your
money on the bunny Hole or we hoppen. No, no,
he doesn't admit it. So so are you calling because
you want to get your money back from him?
Speaker 20 (02:12:01):
No?
Speaker 1 (02:12:02):
No, no, Then tell me why you're calling today.
Speaker 4 (02:12:06):
Tell me why you're.
Speaker 20 (02:12:07):
Calling the lawyers. The lawyers say.
Speaker 4 (02:12:11):
What lawyers can you give me?
Speaker 20 (02:12:13):
My lawyers said I had for the divorce.
Speaker 4 (02:12:16):
Now we're going back to the divorce.
Speaker 1 (02:12:19):
When did you get divorced?
Speaker 20 (02:12:22):
It was final July twenty.
Speaker 1 (02:12:25):
Okay, how did that just changing? Listen, we went on
a ride here and this has nothing to do with
the lottery. Now, now you're calling because you said no
I okay.
Speaker 20 (02:12:36):
Given him for that? I okay?
Speaker 4 (02:12:39):
How did did Diane?
Speaker 1 (02:12:41):
Diane?
Speaker 4 (02:12:42):
Just tell me one thing real quick?
Speaker 1 (02:12:44):
How did the attorney screw you during their divorce? Tell
me what he did wrong? Just get right to that point.
What did he do wrong?
Speaker 20 (02:12:52):
I told her about the lattering ticket.
Speaker 4 (02:12:55):
Oh it's a her, I'm sorry. Okay, okay.
Speaker 20 (02:12:58):
I told her about the breaking in. I told her.
Speaker 4 (02:13:07):
That what did the attorney do wrong?
Speaker 20 (02:13:10):
Paper?
Speaker 21 (02:13:11):
And he's lying?
Speaker 20 (02:13:12):
Well, she said she wouldn't do anything I asked. I
wanted her to subpoena so I could.
Speaker 1 (02:13:20):
Okay, Diane, Diane, dare we can't help you with that.
You're going to have to go and talk to another attorney. Okay,
we can't help you. I'm serious, Diane, we can't help
you with that. You need to find another attorney to
look at the case and get a second opinion. That's
what I recommend you do. If you feel your attorney
(02:13:41):
is giving you wrong information, the best thing to do
is to go consult with another divorce attorney for a
second opinion.
Speaker 20 (02:13:50):
I thought other attorneys couldn't sue other attorneys.
Speaker 1 (02:13:54):
Well, you're not looking to sue right now. You're just
looking to see if she did something wrong.
Speaker 20 (02:14:00):
Oh, even she even broke her breach of constant confidence.
Speaker 1 (02:14:06):
Okay, Diane, you got to see another attorney. Or you
can go to the Supreme Court Oversight Committee and you
can file a complaint with the Supreme Court Grievance Committee
or the Bar Association, Okay.
Speaker 5 (02:14:22):
Or you can kind of just move on and kind
of just forget about it. I know that sounds hard,
but that might be the best thing to do is
kind of put it in the rear view mirror.
Speaker 9 (02:14:32):
Want my money back, Diane.
Speaker 4 (02:14:35):
I don't think if you want to know the truth, Diane.
Speaker 1 (02:14:38):
You're not. You want the money back you paid the attorney.
Is that what you're talking about?
Speaker 20 (02:14:43):
Yeah?
Speaker 1 (02:14:43):
Or are you talking about or are you talking about
the lottery? Which one?
Speaker 20 (02:14:47):
No, no, I no, I've given up on all that.
Speaker 1 (02:14:50):
How much money? How much money did you pay this attorney?
Because I would go to the Supreme I would go
to the Bar Association Fee Dispute Committee. Remember the name, Kelly,
give it to her off the air. It's the Colorado
Bar Association Fee Dispute Committee. You're saying that she owes
you money back because she didn't do a good job
(02:15:11):
for you.
Speaker 4 (02:15:12):
That's where I would go first.
Speaker 20 (02:15:14):
Yeah, she didn't do anything, I am.
Speaker 4 (02:15:17):
And how much did you pay her in fees?
Speaker 2 (02:15:20):
Oh?
Speaker 20 (02:15:20):
Probably twenty thousand?
Speaker 1 (02:15:23):
Okay, And that's what you wanted. We got to take
this break. We got more coming up.
