have an airline ticket, you have maybe a trailer they're renting,
or a car hauler, or you have them drive there
and get it now where it's in Wisconsin. And that
is the best way is to use people you know literally,

friend or someone who can get a trailer who wants
to drive out there, or you rent something out there
for a one way to Colorado. That's always the best direct.
One time, I even flew out out and drove my

those are always the best. If you need to transport
though a snowmobile, it's also best in my opinion to
have it in an enclosed trailer and just use a

names similar to national movers.

the internet or names that sound like reputable companies. You
just have to do legwork and make sure you're dealing

it's completely changing the way that the fuel and so
it's designed to work so much more efficiently as well

as there's a lot of rebates that are available to
consumers right now as well. So really it has everything
to do with equipment. Okay, I want to know this
about equipment. There's a move toward heat pumps for some reason.
You know, years ago you never heard about heat pumps
unless you lived in North Carolina or Florida or somewhere
it didn't get real cold. They reverse cycle the AC
and they get heat.

this guy could have had other vehicles in his household
that do have coverage, so there may be coverage available
to help repair her vehicle. So you know, there's a
lot of work to be done here. But I would
absolutely open a claim with her insurance company, just to
let them know that if this guy comes knocking, this

what I can tell you about the accident. There's no harm,
no foul in opening a claim.

Okay, that's what you should do. I mean, you can
take what John says to the bank. He's a great advisor,
he's an attorney at law. He handles these accidents all

To have liability, there's no coverage on your policy for
the property damage to be done. If you get your
car repaired and have to pay out of pocket for that,
the fact that he got a ticket would open the
door for you claiming restitution through the court process and
make him pay for that. But if you do have
a much her property damage, then he can you know,

you can make your claim on your own policy.

And then yet, first what you need to do, Stephanie,
is know exactly what.

Kind of coverage you have.

If you don't have collision coverage, you're not covered in
a collision. But there are coverages for people that can't
afford collision, or don't want collision, or have older cars.
And it's called uninsured motorist property damage. That's different than
regular uninsured motorists. It's what it does is it fixes

your car if someone uninsured runs into it. So do
you have uninsured property damage? I don't know.

you don't, then the only way you're going to get

this property for over twenty two years, and I had
neighbors moved in both on the north and south side.

About now have you been have you been renting there
for twenty two years or.

Ah, this is our own house.

Speaker 4 (43:17):
Okay, okay, So you've been living in your home for
twenty two years.

And what happened.

Speaker 16 (43:24):
So I have neighbors on the north side moved in
about three years ago, and then the same thing on
the south side, and they started doing surveys and pushing
the boundaries of the property.

Speaker 4 (43:39):
Wait, both neighbors, both the north and the south, they've
both been pushing the boundaries.

Speaker 16 (43:46):
Yeah, so yeah, that first the south side woman started,
she's her property is in the corner. So we have
an issue in the entire neighborhood where the property boundaries
are not very or very straightforward. Okay, we had an
angle on the paper, slight angler on the paper, but

(44:09):
in physical boundary, they you know, built or built it
straight line for waterflow and such. So this neighbor on
the south side moved in in twenty twenty two June,
and she started. She put a fence on her side
of the retaining wall without pushing the boundary that October,

(44:30):
but for some reason she went and got to survey
and she pushed the boundary. Property.

Speaker 4 (44:37):
When you say, here's what I don't understand. I just
need a little help here. What do you mean she
pushed the boundary? What does that mean?

Speaker 16 (44:47):
So she put a new fence, she had an existing
fence on the historical boundary in October twenty twenty two,
and then what.

Speaker 4 (44:56):
Do you mean she pushed? So she moved it over
onto your property, on to.

Speaker 16 (45:01):
The one we have been maintaining for sixty years, I
mean before me, my previous Okay, Well, why.

Speaker 5 (45:07):
Didn't you stop?

Why didn't you stop her and tell her that she's
on your property?

We were out of town. She kind of did in
a when we were out of town. So before I
left town, I sent she was doing something. So I
put a test to her saying, please do not trustpass,
do not come on to our property.

Okay, and which one? Which one is this? The one
on the north or the south side?

Speaker 16 (45:35):
So the south side, you know, I'm focusing mostly on
southside until.

Then yeah, so it's the south side's.

So did she put up a new fence or did
she use the old fence?

She put up the new fence in March of twenty
twenty three when we were out of town, and even
though we asked her not to trespass, she put a
new fence, and she, you know, did it overnight.

Well, let me ask you this, Jennifer, if we were
to call this neighbor, would she say that's my property
or would she say, no, it's not my property, do
something about it.

I mean, what would her attitude be.

Speaker 16 (46:15):
Her attitude would be, you know, it's my property. I
don't care if it was maintained by you guys for
fifty years. You know, go figure out and spend all
the money on attorney. That's been her attitude all along.

Okay, well, okay, to some degree, you should have done
something sooner. It's been there since twenty twenty three, and
so you're gonna in just a few months it's going
to be three years that she's had that. You're claiming
you had that property for twenty years or more before that.

Are you the one that put up that fence or
was it there when you moved in?

Speaker 16 (46:56):
I it was there, so there was no offense. When
she bought the property, she put the she put the
fence in Okay, twenty twenty two on her side got
her because she has a dog, and then she moved
it over in March of twenty twenty three, so she
got it. Point, she got two fences until she the
one on her side.

All right, So Jennifer, before that neighbor came. There was
no there was no fence anywhere.

her neighbors on the north and south sides start are
starting to make moves with fencing and stuff to encroach
on her property. The south side neighbor moved her fence

on March of twenty twenty three, and basically she's upset
that the fence is now on her property. Jennifer, in
order to make the claim that the fence is on
your property, you don't have an adverse possession claim right
now because you didn't assert it.

You kind of broke You broke the.

Line of possession by allowing them to put up a
fence and not challenging it three years ago.

What you need to do.

Speaker 4 (49:44):
Now is simply do a lot line of verification with
a surveyor. You have to do it. Visual sightings don't
work even if you have the original monuments. They're called
the that are in the ground, either steal or concrete.
Even if you have those original pins and you can

draw a line from one to the other, a court
would require you to have a certified survey. So if
you believe the fence is on your side, you can
get it moved, but first you need to have that
lot line plotted by a licensed surveyor a real surveyor.

Do you think you can do that?

I have the survey and I hired two attorneys, and
they said, you know, survey always wins in the court.

So, Jennifer, did you hire I just need Did you

year old free by pouring concrete around the roads, and

Because for sixty years we maintained that piece of land
and anchored over twenty thousand dollars of cuss.

My lawyer sent her the letter, and she just she

Yeah, my attorney's told me I can go to quote
and file advert position, but it can go fifty to
fifty and it can count right up to thirty five

Thirty five thousand would be cheap. Here's what I need
to know. How important? How much property are we talking about?
One foot two feet, three feet?

How many feet?

So it starts at one feet in the back to
ten feet in the front, meaning it's at an angle.
So she encroached by one okay.

Partner and okay, how many years have you actually been
there with this property? Not how long it's been maintained
by this But how long have you been did you
say twenty two years?

Yes?

Speaker 4 (53:04):
Yes, okay, so that's all that counts. The previous the
previous owner's own account. So if you maintained a slice
of property for more than twenty two years, do you
have ownership rights?

That's what you're asking, and you would have.

I'm looking up a previous case. This sounds exactly like
a previous case, and I'm thinking that you would have
if you asserted them right when she started encroaching. But
you allowed her to put up a fence. And that's
why your attorney said it can go either way because
it's not an adverse possession claim at this point.

Broke the line of possession by letting her put up
a fence.

should have done by telling her not to. You made
adverse possession hers now. Now, adverse possession means they don't
have permission to do what they're doing. Okay, that's what

have permission. What you should have done is said, I
give you temporary permission while I researched this property line.
Because you don't have you don't have an argument. Let
me just put it that way. Adverse possession is only
if you assert that at the time somebody's trying to

take it away from you, the claim of ownership it

Yes, the law changed in two thousand and eight to
make it more difficult and more costly for somebody trying
to claim adverss possession. So one of the changes was
you have to pay market frame market value for the

the other changes that was made at that time was

that now the address possessor has to have had a
good faith belief that the property was theirs for some reason.

worth it?

But then the legal questions involve several elements that have
to be proven to make a good claim for advers possession,
and the good faith belief that the property was yours
is a question in fact for the judge or jury
to decide. Actually the judge decides this case. It's because

has the believes that the property was hers, but I'm

not sure that she had a good faith reason to
believe that, just not knowing she didn't get a survey
to know one way or the other, and somebody told
her that it was hers.

Whether that was a really brad I thought the whole
idea of adverse possession is that you know it's not
yours and you adversely possess it anyway.

That's what got changed in two thousand and eight. You
could unformately just squat on a property for eighteen years,
just hostiley, Okay, squat and it's yours. But now you
have to have had a good faith belief. For example,
if there was a mistake in a survey, or if
you had a deed that you thought was yours, but
it turned out to be. I mean, I thought they

gave it to you, but it turned out to be defective.
But for that default, thy would have been good.

So basically told me that's how they maintained it. And
he lived there for forty years before me, and so
he said, this is all yours, none of our business.
You maintain it and that's how it has always been.
So he kind of forced us to maintain that, and
nobody got the survey, so we just kind of followed
what was before we moved, right, You just moved in.

You just moved in and continued to maintain that property
believing it was part of your land.

Speaker 17 (01:04:14):
Yes, okay, Well, it is possible that the eighteen years
was satisfied before you even purchased. If that's true, then
you might be able to still claim address possession adverse
possession based on the law how it was before two
thousand and eight, assuming that the eighteen years has met
before July two.

Thousand, Here's what I wanted to know, Brad. If I
moved into a place and the neighbor was maintaining a
piece of property for ten years, would I inherit that
ten years and go another eight years for adverse possession
or does it have to be all eighteen under one owner.

Yes, that's called tacking.

You can tack former owners ownership together with yours and
together to be the eighteen years.

Okay, but right now the fences there, she has to
go to court to have it removed and to own

your claim. It's you still have a claim, but you're
going to have to take them to court.

I mean there's no automatic here. There's no automatic. Get
it removed. You know the police aren't going to come
out there and make them remove it. No one is
going to make them remove it. Now you can try

Well, I mean, if it costs more than thirty five
thousand dollars I have to lay in and worked it
or not. But that's not the whole damage she has
done by she moving that property line to my outside.
The problem my northside has is the same thing. They
were maintaining the same ways, but they were not maintaining.

They just let the weeds grow. But nobody maintained that
same one foot in the back to tempede in the
front land on the other side. So they came in
with their survey and destroyed the retaining wall that was
put on based on historical boundary and built a fence.

And when did they do this? This is the other neighbor.
Now when did they do that?

Speaker 16 (01:06:31):
The other neighbor followed suit with the south neighbor and
did this in July twenty twenty four, just last year.

Okay, well, here's what they're doing. They're saying, you know what,
the survey shows it's our land. We're not recognizing her
right to adverse possession. So they're saying if she doesn't
like it, she can sue. That's what they're doing. They're
simply using their survey to put up their wall and
their fence, and you you have to fight for it, Jennifer.

It's not automatic.

I mean it is automatic in the law that it
reverts to you. But if you do not now go
after it, what will happen?

tech Tom looking at the invoice? What was she in,
what she was charged for, and what she got? What
did you find.

They say that they invoice. If they did they put
it effect the field pump in it, it's not creating
the pressure it needs to should be creating over fifty PSI,
it's only creating twenty.

Speaker 5 (01:15:04):
What else did you find they did wrong or did
not do right?

Speaker 14 (01:15:08):
So, I don't know if they have good justification. They
put in a they put in a crank sensor. I
don't know why they wanted to do that. It doesn't
really stay on there. And then after they had the
full fuel pump in there and it wasn't solving the problem.
They told her that she needed for attle body and
they I guess, they had her get her own prattle bodies.

(01:15:31):
They installed those, it still didn't solve the problem because
it clearly needs a fuel pomp. She had taken it
to the unfity dealer who also took a video of
the fuel pumped pressure test and it clearly shows that
the fuel pump is not creating the pressure. So both
the dealer told her and I told her that they
put in a defective fuel pump before that I could

(01:15:53):
even agree to warranty it.

Speaker 4 (01:15:56):
Yeah, so what do they say, Susan, if you call
this place and said I have a defective fuel pump,
what will American Auto Entire say.

Speaker 12 (01:16:08):
I already went over there and told them that everybody
told me it was a bad pull pump, and they said, Susan,
it is not the bad fuel. Put your throttle body.
So I said for sure to throttle body said yes,
and I said, I can't afford what you guys want
to put it in, but I will buy him to
put him in, because he was definite was the provle body.

And after the throttle body, it didn't fix.

Now, and they told me to get airtake hoses.

Hey, Tom, Tom, wouldn't a throttle body cause the problem
she's having?

A pratle body would not cause the fuel pressure to
drop to twenty pounds?

Now, why would they tell her that? Did they just
not know what they're talking about?

Why would they say it's not your fuel pump, it's
your throttle body.

Where he tried to start convincing me that he had
done thirteen hours of diagnostic work and all sorts of
other items in the vehicle. And what confuses me is
why wouldn't he just put another fuel pressure gauge on it?
Why wouldn't he just run one more fuel pressure. It's
a very simple system. Power goes to the pump, The

(01:17:23):
pump is powered and provides pressure to the front of
the engine. You can put a gauge on there and
take a simple measurement. So I'm not sure what he
was having trouble with. But you know, like I said,
both myself and the dealer rand okay, very clear and
easy to read result.

How much is it going to cost her to get
a car running.

Speaker 7 (01:17:44):
If I were to.

Put a dealership pump in there? And Susan, I sent
this essmate to you I think, But let me see
if I could pull it up and real quick, I
want to say it was like about eight hundred dollars.

Yeah, well a dealership fuel pump installed is one thousand

Once he does the new fuel pump and it fixes it,
you're going to have something to take this place to
small Claims court with. You're going to have a bad
fuel pump that you paid for and you shouldn't have.

As far as the other problems, I mean, it's just
let's just suffice it to say, you don't want to
go back there, Tom, Did you get the impression they
knew what they were talking about when you talk to them.

Not when so. Interesting thing is when I did talk
to them, the tech tried to convince me that I
was wrong about the fuel pump.

Failed in that, I said, well, if I put the
fuel lump in and it solves the problem, would you
guys reimburse her for that cost? And he said he
couldn't make that decision. He sent me back to the
front counter girl. She also said that she could not
make that decision. There was nobody in the building that
could offer a refund or authorize the of the vehicle,

and so they had to wait until they reached out
to the general manager of the corporation to get approval
for that.

And what happened then.

He finally responded, he only authorized for them to redo
the pump at their location. He is not authorizing to
have me do the pumps.

Okay, but they will redo it. Is that the way
it stands right now, they will redo.

Itarly authorizing to do the pump under warranty for her
at their location.

Well, we should at least give them the chance. What

difficult for phone calls. Now, you can make a phone call.
They do have a place where a clinic where you
can call and if they're busy, you leave a message.

but when it comes to healthcare, you put in questions

think works. The thing I want, though, when I hire
a company locally, is a real local presence. I hate
like a lot of these locksmiths.

more than a brand and they call your they'll call

the company doesn't even exist. And I don't like companies
that do that. They do the aggregation. All right, let's

is no one person looking at this company saying okay,
you deserve to be on this site. So if you
want to ship a car, ship, furniture, ship, freight ship,
an appliance, one thing, or many things, you hit book
now and then it has a list of categories but

one and even animals, even livestock and pets. But what
you must know is that they do not vet the movers.
So I want to know what good is that. Now,
if they had a list of movers before they could
come on and bid that they checked out, Well, then
I would do that. But for example, if you want
to move farm equipment, if you want to move a

vehicle or vote boat parts, commercial trucks. I love the way.
And for those who texted me about this, I think
now there's there's three of them, I get it. It's

Adobe Audition, they they come in a suite of of
apps and they're very, very difficult to cancel. In fact,

I remember I didn't have a problem, but I constantly
get notifications to renew it, to to reinstall it. You know,

on open with and it'll open it. That's not a problem.
But Acrobat is still there like a nuisance on my computer.
So just get putting that out.

Well, first of all, it depends on what it is.
If it's something large, and if I'm selling stuff, it

you know, in my security camera, you know view, and
i always had someone else there with me. And I'm
very cautious. No one enters the house, none of that,

out with someone as well. But before we even do that,
we look in a Facebook marketplace. We could really identify
whether this person's history, likely where they are, whether it's
a scam, because there's certainly a lot of scams. But
we've done a lot of transactions, mostly buying, but we've
never had ultimately a problem. We've always checked them out.

Many of these duck cleaning companies will also clean dryer vents.

one right off the bat, but they will clean your
dryer vents. And that's exactly what it sounds like to me.

Well, I only bought the dryer about eight months ago.

I'm not sure if they do dryer vents, but they

done on a car okay, and you're not sure you
trust these people, you need to have it analyzed by

we're going to have you take it somewhere to make
sure that it was shotting. Now here's what happened. This
is an example. Susan went to American Auto and Tire
and Lafayette, spent thirty five hundred dollars for a bunch
of stuff and her car is still not running right.
Turns out she has a defective fuel pump and they

replaced the fuel pump, and Tom Maggio at Hands On Auto,
one of our experts up in meat. He said, look,
they couldn't explain why that they were doing other things
when the first basic repair she had done, the defective
fuel pump was not done correctly. They offered to redo it,
so we told them. We told her to get it redone.

The reason for that is because if someone offers to
fix it, there's no downside to letting him try again.
You can always take in the small claims court after that.
The other thing we had, which is really important, is
on this adverse possession. If you there's a lot of

confusion in this. If you maintain a piece of land openly,
it can't be hidden. It's open adverse possession and you
call it your own for eighteen years, it reverts to you.

But it's better if you'd.

Go and get it done by the courts, because if
someone challenges it, like the original owner, you're going to
end up in court anyway. But it is automatic kind
of after eighteen years, but you have to show continuous use.

And maintenance of that property.

I think adverse possession is one of the most confusing
things in the world because you get it automatic, yet
they can challenge it. The original owner can challenge it
and demand to be paid a fair market value for

of your retirement funds to do a program like this

Yeah, let me explain that to you.

To do any investing with retirement funds, you must do
hands off. You can't have any control over it. It
must be an arms length hands off, and you aren't
allowed to have any loans. So just let me basically explain.
Let's just talk about the normal Vestera turnkey. If you

wanted to be a landlord and you wanted to use
Vestera to help you find the house, manage the house,
and sell the house, you would go to Vestera and
you would invest anywhere from seven to eighty five thousand,
and then they'd get a loan in your name and
you'd buy the house and you would enjoy the profits.
And so far they've had really good returns for their investors.

But if you wanted to use your IRA or four
one K, you could not withdraw that money and put
it into Vestera. It would be considered a disbursement and
you're not allowed to invest in anything that requires a loan.

have set myself up as a third party, and the
way we do it is this. If you have an
IRA or forour to one K, we transfer it to

they make a self directed IRA. Once the money is
in your self directed IRA, then you can invest as
much as you want into Vestra Turnity. And the way
we make it legal and make it acceptable is that

I invest the money, but I take out the loan

our LLC. I take out the loan and I control
the whole thing, and you become a minority partner. So
obviously you wouldn't want you wouldn't invest the whole thing
because you're not going to own the whole thing. You
would only invest your portion of it with your retirement money,

and I would become your partner. Now you can do
with as little as twenty something thousand or as much
as sixty thousand in between. I don't recommend you do
the whole ball of wax because then you would become
a fifty to fifty partner.

or you can put it in other things.

She would have to buy her own share a part
of it. But you could certainly include anyone. The LLC

so your qualified money is legal. If you wanted your
daughter to do it too, then she would take a
percentage from both you and me to be part of it.
So in other words, she would have to buy her
own share. She can't piggyback on yours. You can't put
it in her name. It would be considered a distribution

If you did that.

So when you take out let's just say you take
out thirty grand from your retirement money, and you want
to do a part of a rental. If she wants

as she contributes her own money apart from your qualified money.

but a lot of people report being ripped off at
Facebook Marketplace. One thing is for sure, you do not
want to meet somebody other than a public place. And
if you have them come to your home, you better

pre qualify them. We've had several cases with Craigslist and
with Facebook Marketplace where people had someone come to their
home and was it coincidental or not that all of
a sudden they ended up getting robbed or porch pirated.
So you know, look, I think it's crazy to have

somem come to your home without first pre qualifying them,
and I mean a lot.

You know, I had a chance to think we're taking
the break. So I'm a minority partner in this deal.
What is my percentage of ownership?

It depends on what you buy, So in other words,
it's broken up into the the amount of contribution equals
your percentage of ownership. So you can be ten percent,
you can be twenty percent, you can be there. I mean,
it really depends on what you buy into that's the
percentage of ownership.

Okay, well I was assuming I would go in for
the full eighty or eighty five.

Speaker 4 (02:14:21):
Okay, you can do that. You can't do that with
your retirement money, but you certainly can do that. So
if you do that, you own one hundred percent. I mean,
you do it directly through vest Era. The only reason
I got involved were for people that wanted to do
partial ownership.

They didn't want to do the whole thing.

Speaker 4 (02:14:37):
They either wanted to, you know, like for example, they
didn't want to put in the eighty thousand dollars. They
would rather do twenty thousand, or they would rather do
fifty thousand or they would rather do. I don't think
I did any less than twenty. So then you own
that proportion of ownership depending on the partnership agreement. So
each one is different depending on your contribution.

Okay, Well, so you're saying I can't do the full lady.

Speaker 4 (02:15:05):
Well you can, but you can't do it with your
money because you would have to take a loan out
and you would have to be a landlord, and your
retirement money doesn't allow you to do that. So if
you took your four oh one K money and you
went out and bought a house and rented it out,
you can't do that. It's not allowed.

How much is allowed if I do it with you?

Speaker 4 (02:15:31):
Okay, by the way, you don't even have to do
it with me. You just have to do it with
someone who controls it. All I'm saying is this, you
can do up to forty nine percent. You can't because
with retirement money you can't control the investment. The idea

of qualified retirement money is that first you don't you
don't take out any loans, and you don't control the investment.
So if you went and bought something where you controlled
the investment, it would be disqualified. You're not allowed to
do that. See a lot of people have tried over
the years to use their retirement money to buy a

rental for their kid, or to buy a piece of
art from themselves or from their wife or you know,
you can't do that. There's certain rules to using qualified money,
and one of the rules is it must be an
arms length transaction. In fact, it would be difficult if

you and your wife tried to do it where your
wife had the majority ownership and you had the minority ownership.
It might be looked at a cast. You know, they
might be suspicious of it because it's got to be
a true investment that you do not control. Just like
you don't control the investments in your four oh one
