in jail. Fourth time, I'mtelling you can go five years is where
you can go. But what happenstwo felons carrying firearms? I mean this

stop it. We've got to stopit by taking things away from people who

aren't committing crimes but living the otherones with Why why isn't there legislation that
says, hey, you know,if you're a felon and you know you
are caught with a firearm and ordisability. We're gonna mandate you do something

the crimes. You need to havea minimum jail sentence, non sexual or

that falls into the prison system,and that's where you need to go.

A fourth degree felony for carrying afirearm under disability carries six to eighteen

and I didn't go through and look, but if I go here and look,
there's no gap in in crime here. If they would have charged gave
him at least twelve months each time, he wouldn't be out and he would
have never had the opportunity to shootat police. And Ed, this is

first felony four and he was chargedseven times. If they would have gave

But the big news was is thatjust you know, I mean this this
the governor of California, Gavin Nuisance. Oh, I mean Newsome. Uh,
you know, like last Tuesday hepassed almost two dozen gun control bills.
He signed off on over almost twodozen. Uh. It just it

just anything to discern the people,It's what he wants to do. But
one of them was a magazine banwhere that banned any magazine in California that
held more than ten rounds of ammunition. So it went up to the United
States District Court and one of myfavorite people in the United States is Judge
Robert Benitez, who truly is foundedin constitutional amendments and truly believes in the

Second Amendment. And basically he saidthat the state of California failed the test
for determining the constitution and the restrictionhe shot it down. So now he
did realize it's going to be appealedautomatically, and he put at ten day
a stay on his ruling. Butyou know, he just said that this

(16:42):
case is about California state law thatmakes it a crime to keep and bear
common firearm magazines typically possessed by lawfor lawful purposes, based on the text
the history, which is really importantbecause the Brewer, they go back and
look at the history, the historyof the addition to the Second Amendment,
this law is clearly unconstitutional. Sohe signed off. Benita signed off on

this pardon me band what knewso signedoff on which the whole state ten round
magazines. So when it came upto the Ninth Circuit Court of Appeals,
which will be the next stop,the previous case had also gone up there
that Benita's assigned, and back thenthe judge Susan Grabber wrote that basically nothing

in the records suggests that restrictions imposedby any more than minimal burden of hardship
on the Second Amendment rights. Sois it minimal on your right to defend
your home to have a ten roundmagazine or less? That's that's no big
deal, she said. But butbut this is you have to hear what
Benita said. It's it's pretty incredible. You found that the government remain as

you broke this. The government remainsfixed on the notion that it alone can
decide that anything larger than a tenround magazine is not suitable for a citizen
to have. But there are noanalogous cases in our history. There are
no cases where the American government dictatedthat lever action rifles were unsuitable because single
shot rifles were good enough, butthat revolvers were unsuitable because daragers were good

(18:18):
enough. The choices have always belongedto the people to decide for themselves how
much firepower they need. In fact, he said that the laws did regulate
ammunition in the Founding Fathers area,but it operated exactly the opposite way.
Said the right to have firearms forsecurity was important at the time the Constitution

(18:41):
was adopted. There are many enemiesof the young nation, and armed citizen
reprovided much needed to turn effect.We think. He mentioned the men of
elections had and conquered assembling as amilitia, fought back against the British who
wanted to take away guns and gunpowder. These are others. These and
other citizen militia laws demonstrate that contraryto the idea of firing capacity upper limit.

(19:07):
There was a legal obligation for theaverage citizen to have at least twenty
rounds available for immediate use. Thatwas a legal obligation back then. There
were no upper limits. There werefloors, and the floors were well above
ten rounds. I'm gonna just includethis, but what he wrote to conclude
it, I think we as Americansreally need to hear this. He concluded,

(19:30):
arguing that the Second Amendment was,and this quote was, was a
freedom decided long ago by our firstcitizens that valued individual rights over subservient security
of a monarchy or the smothering safetyof domestic lawmakers. That freedom, that
this freedom was worth fighting for duringthe revolution and worth preserving today. Our

(19:52):
government solution to a few madmen withguns is a law that makes into criminals
responsible law fighting people wanting larger magazineto apply to protect themselves. The history
and the tradition of the Second Amendmentclearly support state laws against the use or
misuse of firearms with unlawful intent,but not the disarmament of law abiding citizens.

(20:15):
That kind of a solution is aninfringement on the constitutional right of citizens
to keep and bear arms. Nowthose are the words of a federal judge
that I love to hear. AndI'm going to add one thing that I
did not know, but maybe someof you did not know this. They
went back and looked at the dictionariesthat were around in the seventeen hundreds,

(20:36):
even before the Revolutionary War, andthey said, even before the Constitution was
ratified or the Second Amendment was added, the dictionary definitions of the time defined
arms is in the right to keepin their arms as and here's the quote
from the dictionaries any musket and bennettsaber, holster, pistols, carbing,

(20:56):
or any array of arms, andany accruitements necessary for their operation. And
the founding fathers understood that the ammunitionwas obviously the most necessary accruitment for successful
operation of a farm. So basedon that history, I don't see how
any of these magazine bands will standif it gets to the Supreme Court.

(21:18):
Wow, that judge is I mean, he has been thoughtful. I mean
his rulings have been logical. Youjust hope it stands it But you know
what, John, it doesn't.It doesn't even seem to matter. I
mean, these these things make theirway to the Supreme Court, and you
get favorable rulings. Yet these statescontinue to do whatever the heck they want,

(21:40):
and it's like a constant battle ofit being tied up in courts.
Well, it's right right after thishappened in Oregon in a in a circuit
court in Harlem County, a circuitcourt judge, uh, just has heard
closing arguments over organs. They saythey have the most restrictive and I along
the country with what they've included,but they also have the measurement. Uh.

(22:04):
That's it's called Measure one fourteen iswhat their law is called. Similarly,
bands magazines holding more than ten rounds. But he's got sixty days to
make this decision, and I knowhe's going to be considering what Benito said
to the south of him in California. But it didn't stop Washington, the
state above Oregon, and their federaljudge. And guess what judge very dempty

Joe Biden to pointee, would itsurprised you that she's against the firearms.
She denied the motion that was filedup there. What she said was that
large capacity magazines are not arms.Arms of the guns, and they really
aren't arms. So it's okay tonot have said anything. I guess you

could do a one round magazine.But she did do. This really left
the sliver of hope because the judgecalled for a thor Will review of the
historical record of gun regulations and expertreports concerning what prior government viewed as arms
under the Second Amendment. So she'dprobably heard about the Benito thing before she
made that. And it's going okaywith the bruin going back to the history

and we know what the history ofthe country was. It gives me a
glimmer of hope that someone else lawswill fall. Wow. JC, let's

So JC one story that it was. And well, first of all,
before you hit your next story here, you know, we're always talking
about the assault on gun stores andthe gun industry this week, and I'm
just going to give a one lineron this this week. Quick books pop.
Oh you know quick books, right, We use quick books here at
the store for some of our backend accounting. Quick books. They they

came to their senses and said they'reno longer going to disallow gun stores in
the firearms industry to use their product. So for a while there they were
kicking out gun stores and anyone inthe firearms industry because of the industry,
and we're going to set them offfrom using their products. Really, it

didn't it didn't affect us. Wedidn't. We didn't get hit on it,
but we were keeping tabs on it. And they came back and JC
you had more info, and Ithink, well, oh yeah, I
mean they did affect some. That'swhat brought it to Light Texas gun store.
They went to issue paychecks and thenjust shut their whole system down.
And they had they said for weeksthey had to write personal I mean they
had to write checks, paper checks, because without any warning they closed them

down. So it got up,of course to Ted Cruz, Texas,
who happens to be a senior memberon the Senate Finance Committee. I believe
that's the Setate finance. K Anyway, he checked into this and it turns
out that this inuit was being kindof controlled by JP Morgan and the Bank
of America, and they said theBank of America simply said, don't don't

allow gun stores, sellers of gunsare manufacturers to use this product. And
of course the Bank of America deniedit, but said why would we do
it? And we were told no, you gave us an order not to
do that. But apparently JP Morganand a Bank of America, if you're
dealing with those, trying to dealwith another bank because they are truly anti

guns. So anyway, because thatcrew has got involved and they said they're
going to be monitoring what's happening intoit is now that systems up and running
for all store owners. So wow, to see one of the story you
had to get to about. Andthis is a big one. Also California,
as I mentioned, he signed almosttwo dozen and a gun control laws

and one day Gavin Nuisance, Imean Newsome did and this one he signed
a law raising taxes on guns andammunition to pay for what he says is
for school safety. I don't knowhow much we'll go there, but this
is this is a big deal.They will. Part of that bill also
was to ban people from carrying firearmsand most public places in California while doubling

these taxes. So there's already tento eleven It depends on the gun.
I don't know which ones, butthere is it or ten or eleven percent
a federal tax on firearms and ammunition. But he's adding another eleven percent on
top of that, making California theonly state with a separate pass on all

guns and ammunition. This is uh, this just flies in the face of
what the bruined decision made, andall these states of the antigun states are
trying to do every single thing thatthey can to do that. So here's
what he said about it. Heeven said, oh yeah, he said,

I know that that there's a lotof laws out there that I just
signed that they're not signed that survivedthe legal challenge. Now the Supreme Court
has posted a new standard that's brewin. But you know, it may mean
the federal courts are throwing them out, but that's okay. I'm just gonna
go ahead and start passing them anyway. I mean, that's the type of
person there's running for president of theUnited State. He wants to run for

president. He hasn't announced it yet, but I think everybody knows he does
so anyway, So they've already hyou know, the California Rifle and Pistol
Association already assued to block one ofthe new laws, and that was the
