New York. Why because they're saying he miscategorized a payment
to Stormy Daniels. What's crazy is this is exactly what

Bragg's legal theory that Trump tried to hide a campaign

pay porn actress Stormy Daniels one hundred and thirty thousand
dollars and alleged hush money before the two sixteen presidential
election would have applied to Clinton when her campaign hit
a payment for the phony Russian dossier against Donald Trump,
and they categorize it as legal fees. Former New York
City police officer and conservative pundit John Cardillo also tweeted

this out. Bill Clinton paid Paula Jones eight hundred and
fifty thousand, and no one cared Toleman tweet in response,
and the Hillary Clinton was actually fine for hiding the
Still dossier payment under legal fees, essentially the same legal
theory on the Stormy Daniels payment. The DA is running
criminal investigation of Trump on that should tell you everything

you need to know. Indeed, the Federal Election Commission in
March of twenty twenty two did in fact fine Larry
Clinton all the way back in twenty sixteen, and that
for that presidential campaign, as well as the Democratic National
Committee for not properly disclosing payments for the so called
Dolcier Still dossier that the DOJ and the FBI relied

on to investigate Trump for alleged Russian collusion. It was
a hoax the entire time. Now campaigns just so you know,
we're supposed to report expenses over two hundred dollars and
disclose the purpose of the expense. Where the Clinton campaign
do well, they knew that they couldn't actually tell America
that they were paying for the dossier, so instead, the

Clinton campaign and the Democratic National Committee funneled their payments
for the dossier, totaling more than a million dollars through
the Democratic law firm Perkins Coy. According to the FEC,
Perkins Coy paid opposition research firm Fusion Gps more than
a million dollars in twenty sixteen for the Steel dossier.

Perkins Coy was then paid one hundred and seventy five
thousand by the Clinton campaign and about eight hundred and
fifty thousand was also paid by the Democratic National Committee
in July and August of twenty sixteen, around the same
exact time that the FBI claimed they opened their investigation
on the Trump campaign. Remember they spied on Donald Trump

and Donald Trump's campaign. The payments were not disclosed until Caspetel,
lead investigator for the then House Intelligence Committee Chairman Devin Unions,
uncovered these payments. That is when the FEC fined the
Clinton campaign a measly eight grand and the DNC one
hundred and five grand nuts chump change, just so you know,

for those two entities for reporting the payments as legal
services and legal and compliance consulting instead of as opposition research.
The FEC sidness statement. George Washington University law professor and
criminal defense attorney Jonathan Turley also noted in a recent
column on the potential indictment against Trump that the Hillary

Clinton faced a not dissimilar campaign finance allegations, saying last
year the Federal Election Commission find the Clinton campaign years
later for funding the Still dossier's a legal expense. The
campaign had previously denied funding the dossier, by the way,
which was used to push false Russian collision claims against
Donald Trump in twenty sixteen, and it buried the funding

in the campaign's legal budget. Yet there was no cry
for this type of prosecution, this type of prosecution in Washington,
DC or New York. So why is it happening now?

could this backfire? Could this be a huge backfire on
the left for them clearly overstepping and going after Donald

Trump to try to get a mug shot. Will it
make people want to vote for Donald Trump even more
on the right if they actually do this, I would

had to say about his possible arrest and a video

Donald Trump putting out that official campaign video rallying the troops,
saying we've won twice. We're gonna win again. Now the
question is if they do indict Donald Trump, and there's

a very good chance this activist DA who is supported
and backed by George Soros, does this, will this be
an all time massive backfire. I would argue yes, there's
a lot of Americans that they see a former president
in handcuffs, or see a former president getting a mug shot. Look,
there's no doubt the left is going to celebrate this. Right,

They're gonna love it. They're gonna they're gonna be like
taking a victory lap. What they may not understand is
this may actually help Donald Trump more than anything else
they've ever done, because there's a certain point where there
are people in this country they're gonna say, you don't.
You don't actually go out there and take and take
mug shots and arrest former presence just because you don't

like them politically. That's not what America is supposed to
be about, especially on these ridiculous charges. Now, there is
a chance, I want to be clear, there's a chance
that you could find a really woke jury in New
York that could convict. Then there would be an appeal,

you would assume, and if you went outside of that area,
is there a chance that it could be overturned. Of
course that could happen. But people are gonna see this
for what it is. They are gonna see this as
a clear and decisive move by the left to try
to put Donald Trump in jail because he's their political opponent.

There's no other reason. That's all all it is. This
is trying to destroy a political opponent. They want to
take down Donald Trump. They've been trying, as he described it,
four different times. Is the fourth time now that they
have tried to take him down? Will it work this time? Well,

it's New York City. It's an activist. DA. I think
there's a very good chance that there will in fact
be a mugshot. They were trying to take down Donald Trump.
Don't forget with the rate of Marlago and that went
off the rails. And the only reason why it went
off the rail is because our President of the United
States America, Joe Biden, being an idiot, did something incredibly stupid.

He kept classified documents for up to forty plus years
of his time in office, dating back to when he
was a senator early on his career. And the other
thing that we have to talk about is how the
media is covering this, MYO, may are they excited? I mean,
this is like a political wet dream for the left.
Donald Trump up and handcuffs, Donald Trump getting ah a

mug shot? This would be amazing. But isn't it an
abuse to power? Yes? Is this totally out of a
left field? Yes? Is this being done by a George
Soros activist? Da? Yes? Is this the politicalization of the
criminal justice system? Yes. Jonathan Turley made that point on
Fox Take a Listen. One of the other things you
point out in this op ed is that Hillary Clinton's

(11:25):
campaign was fined for secretly funding the Steel dossier, which
of course was used to damage Trump with these allegations
of Russian collusion, but there was no prosecution there. So
if Trump is arrested charged, could that give credence, you know,
to concerns that the law is used against some but
not others, that you know, prosecutorial discretions being abused. You know,

of all of the cases that are now threatening Donald Trump,
this is the one he would probably hope would come first.
I mean, this is a case that many of us
find just thoroughly proper and fundamentally weak. So if he
wants to perfect that narrative of the weaponization of the
criminal justice system, Bragg just gave him the perfect case

(12:11):
to do it with. So I think that the timing
here is telling. It has a lot more to do
about Bragg, I think, than Trump. He's being really sort
of hit by all sides. Ironically, he's being accused of
not being aggressive and enforcing laws involving violent offenders. But

(12:33):
he is certainly willing to bring this case, which I
think is a mistake. I think people need to think
seriously of the implications of this type of case. You know,
the politicalization of the criminal justice system is one of
the great scourges of the law. It is something that
we have always rejected in this country. I can't say

(12:54):
that this is the first prosecutor to yield to temptation,
but there are serious flaws and the implications are great.
The implications are basically, are we losing this country and
what it's supposed to be when it comes to we
don't weaponize our justice system to take out our political opponents.
You know, you see all the time in other countries,

(13:15):
I say all the time, but you know third world
countries and where there are coup attempts and things where
you'll have leaders that are put into exile and they
come back to power, they're arrested, they're put in Jailman
as a great example of that, you can go throughout
history and you can see this. This is something that
we should all condemn, the left, the right, everybody in between.

(13:37):
You should never have to worry that running for office
can mean that you're going to be politically persecuted and
put into prison because people are obsessed with you. And
yet Democrats are now coming out and they're saying this
is victory. This is what we needed this is this

(13:58):
is the ball game. Right, he couldn't wait for this
to happen. Over at CNN when this news broke. I
want you to hear what they said. They actually said,
Donald Trump telling people to stand up for what they
believe in and say no to this and go out
there and protest the weaponization of our judicial system. Okay,
they're now saying that he has nothing more than a

domestic terrorist for doing that, and that anybody else is
a domestic terrorist for doing it. Take a listen your
reaction to Trump's claim that he will be arrested Tuesday,
his calls for protests, and by the way, the Manhattan
Day's Office still not confirming that there is any imminent
arrest or indictment that is scheduled for Tuesday. Right, that's

(14:42):
part of the story that he's putting a specific date
on it that the DA's office is not. But obviously
the larger point is the one Fred that you mentioned.
You know, if you are the most sympathetic observer possible
to Donald Trump and you do double backflips, you can
find some credence in his argument on January sixth, he
did not know that his language would lead to violence,

(15:05):
but January sixth has now happened. He knows the effect
of the language that he used that day and how
it led to violence, and here he is coming very
close to that language again. It makes it very hard
to avoid the conclusion that he is willing to use
the threat of violence as part of his political strategy.
And that is just a reminder of the very different

(15:28):
era we are in that we have been at any
point in American history where you have Trump, the leader
of a political movement who is routinely willing to raise
the specter of violence as a way of advancing his goals,
and so many conservative commentators and members of Congress who
have condemned preemptively the possibility of indictment remained silent on

(15:53):
his raising this threat of violence, So that I think
is just enormously significant, any marker of the very different
era that we are in politically that we have ever
been in before. What's unprecedented is not that it's the
way the media is acting, it's the way this rogue

(16:15):
DA is acting. I really do believe this is going
to be the biggest backfire that we've ever seen. I've
talked to people that have said to me, look, I
wasn't going to vote for Trump again this time around.
I think it was time to move on to somebody else. However,
if they do this, if there's a mug shot of
Donald Trump, I will definitely back and support him, if

(16:36):
for no other reason, so that he goes in there
and he cleans house, and then he goes in there
and he completely overhauls the Justice Department and completely overhauls
the deep state in the FBI. If Donald Trump gets reelected,
he has promised that he will do that this time,
something that he didn't do last time. And I think

(16:58):
it is very clear that this environment in our deep
state is so toxic and is so vile and is
so disgusting that if he does win again, I believe
he would have a mandate, a mandate to go in
there and a mandate to say I am going to
do this and there's nothing that you can do to
stop me, because I've been elected by the American people.

(17:20):
In fact, I would run on this right. I wouldn't
hold back on this. I would run on this. I
would make this my mission, my mission in life, to
not back down and to say, look at what they've
done to me. If they can do it, to a
former president, and I would I would make posters and

(17:44):
T shirts of my mug shot, and I would say,
that's what this is, what this election is about. Do
you want to live in a third world country? Do
you want to live in a in a third world
nation where we put into prison into ye are political opponents,
just because there are political opponents. I wouldn't back down

(18:06):
from this. I would own it. And not only would
I own it, I would stand there proudly and say, yes,
I'm a political prisoner. I am persecuted for having my
own beliefs and freedom of speech. I wouldn't stop on this.

(18:27):
I wouldn't back down on this. I would open up
the biggest cannon whoop ay I could find, and I
would run on this and say, this is the country
that the Democrats have created, and it's time that we
get back to what's supposed to happen this country. Yeah.
I've said this before and people are like, oh, lock
her up, lock her up. I'm like, I don't want
to lock up Hillary Clinton unless she actually committed a crime.

(18:49):
And I don't want to lock up any Democrat unless
they've actually committed a crime, and a crime that has
been proven and a jury of their peers. I do
not like the persecute of people on the other side
of the aisle just because of what they say and
or what they believe in. That is wrong. It's always
been wrong, and it's something that we should never advocate. Four.

It's something that we should never not ever should we
sit there and celebrate it, because if they can do
this to a former president, they can do it to you.

that legal double standard where they are now politicizing the
District Attorney's office and they are trying to destroy a
political opponent, trying to make it where he cannot run

for president. That's their goal. They're trying to make it
where he would be ineligible to be president. They believe
that if they can just indict him. They believe if
they can just shut him down and get that mugshot
that his career will be over. I would argue it's
going to be the complete opposite of that. Let's talk

he said on Tuesday. And the crazy part is this
could be an indictment against him for the same thing
that Hillary Clinton was actually fine for doing but never indicted.
Break it all down for us. Gotta say, I think

this podcast coming out is one of the most important
we've ever done because it walks people through what are
really confusing legal issues and really confusing facts. And it's
hard when you're understanding it. You see Democrats and you
see the media celebrating yea, we're finally going to get Trump.
You see people on the right saying, boo, this is terrible,

and it's hard to know, Okay, what really is happening.
What we do in tomorrow Morning's podcast is we walk
you through chapter and verse to understand what's going on.
The long and short of it is, I think this
indictment is garbage. This indictment is this is a political persecution.

It is not, in fact a fair application of the law.
The person bringing the indictment as a guy named Alvin Bragg,
who is Alvin Bragg. He is a George Oros supported
district attorney in Manhattan. He is an elected Democrat. He
is a left wing activist. The main thing Bragg has
been known for in a short tenure as the DA

in Manhattan has been letting violent criminals go. And he
has shifted dramatically. He ran promising to prosecute fewer violent criminals,
to let violent criminals go. George Soros put over a
million dollars behind this campaign to get him elected, and
now he is threatening to arrest on Tuesday Donald Trump.

(24:33):
And this all goes back to twenty sixteen, which obviously
was seven years ago. And in twenty sixteen, Trump allegedly
gave one hundred and thirty thousand dollars in a hush
payment to Stormy Daniels, the stripper and the porn star.
Twenty sixteen was obviously the presidential year, and the allegation

(24:54):
is that he paid her that money to stay quiet
about an adulterous affair they'd had. Now, paying someone to
stay quiet is not in and of itself illegal. It
may not be the most moral thing on earth to do,
but it is typically not a criminal violation. What Alvin
Bragg is doing is using a relatively obscure New York

(25:17):
criminal law, new York Penal Law one seven five dot
oh five, which makes it a crime to essentially keep
a fraudulent business record. And his whole claim is that
the one hundred and thirty thousand dollars that Michael Cohen,
who was Trump's personal attorney at the time, allegedly delivered
to Stormy Daniels, that Trump recorded that on his books

(25:40):
as legal fees, what in fact, it was hush money
to the stripper. Now, this is a tickie tac claim.
This is a claim that has been tried against other politicians.
Member John Edwards, the Democrat senator, ran for president. They
went after him on this. They tried him on this
and they lost. The jury laughed amount of court said
this is stupid and ironically and it's what you open

(26:04):
your show with. Hillary Clinton did the exact same thing
at the same time in the twenty sixteen election, Hillary
Clinton's campaign spent over a million dollars paying for the
Steel dossier, the bogus fake Russia Gate thing where they
hired this guy Steele to compile all sorts of sordid

(26:24):
rumors in about innuendo about Donald Trump, but the million
dollars she paid, she called it legal fees. Did the
exact same thing Trump what did, but instead it was
to dig up dirt and to try to disseminate dirt
on Trump that was false. And yet ironically, the same
Democrats and media that are celebrating going after Trump on

(26:45):
this ridiculous charge were perfectly fine with Hillary not facing
any criminal liability. I want to ask you one of
the other big questions, and we're going to dive into,
obviously a lot of the legal aspects of this verdict
that we just got finished recording. So now a verdict
with Ted Cruz, I get to co host a show
with you. It's a blast listen to it. We do

(27:07):
it three days a week. But the big question people
are saying is okay, and this comes down donald Trump
has a mug shot. Is Donald Trump then at that
point ineligible to run for president or ineligible to become
president of the uniteds America if he is a indicted
or b goes to trial and it's found quote guilty
by a New York jury, which I think in New

(27:29):
York a jury there they can hate Donald Trump as
much as this prosecutor does. Yeah, the short answer is no,
absolutely not. There is no legal prohibition on someone indicted
running for president or serving as president. There's no legal
prohibition on someone convicted running for president or serving as president.
There are political constraints and that if you're a convicted felons,

(27:50):
sometimes that will cause people to vote against you. But
there have been multiple convicted felons elected to federal office previously.
We've had one of the things we talked about in
the podcast, Eugene Debs, who was the Socialist candidate for president,
ran four times. One of the times he ran, he
was in jail and was running for president. In the
United States, the only way to bar someone from running

(28:14):
for president is if they are impeached by the House
and convicted by the Senate by two thirds of the Senate.
And one of the punishments that can be imposed in
impeachment is barring them from running for federal office. The
chances of that happening are zero. There's no chance on
earth it'll happen, and so this is going to be
decided by the voters. But that being said, I gotta say,

(28:37):
if Alvin Bragg goes through with this, if he arrests
Trump on Tuesday, if he brings this bogus charge, I
think it is likely to get laughed at a court.
I think a jury is likely to acquit And if
and when that happens, Alvin Bragg, this left wing Soros
elected DA might have single handedly reelected Donald Trump as president,
which which is more than a little bit of irony.

Every time they seem to go into extreme senator it
backfires on the left when they try to go after
Donald Trump. Even Elon Moss tweeted out basically saying the
same thing that you just said, which is, if you
actually do this, if you're dumb enough to do this,
this will backfire in such a way that it will
guarantee the presidency to Donald Trump. I tend to go

(29:21):
with that assessment that this is going to be seen
by so many Americans as such a political enemies list,
the same type that we see in third world countries.
But the scary part is it's actually quite possible it's
happening here in the United States of America. Well, look,
it is sad, it's dangerous. It's why, as you know,
the latest book I wrote, which just came out a

couple of months ago, is entitled Justice Corrupted. How the
Left has weaponized the legal System, And the entire book
is about what's happening right now. It's about how Joe
Biden has turned the Department of Justice and the FBI
into political weapons to target his enemies. It's about how
Barack Obama turned a Partment of Justice and the IRS
and the FBI and the CIA into political weapons to

target his enemies. It's about George Soros prosecutors. I've got

efforts to go after Donald Trump by these hard partisans.
And I got to say, it is dangerous. The reason

a political weapon to attack your political opponents, but rather
