Two defendants were just sentenced to relatively short prison terms for participating in the attack on the US Capitol on January 6. As reported by the Washington Post, there were two important aspects of the sentencing hearings: first, the defendants both said some version of, "I got swept up in the moment" and "I got carried away." What are the legal implications for the larger insurrection investigation of statements like this by defendants? Second, the Department of Justice prosecutors told the judge that those who "incite riots" and "intend to improperly influence the democratic process . . . will (suffer) consequences."
