Il testo chiarisce che l’atto sessuale è lecito solo quando il consenso è espresso in modo volontario, consapevole e soprattutto presente nel momento in cui il rapporto avviene.
Non basta quindi un assenso dato in precedenza: il consenso deve essere “attuale”, cioè valido e confermato mentre l’atto si compie.
L’emendamento specifica inoltre che l’assenza di opposizione non equivale mai a un sì, e che qualsiasi interazione venuta meno alla libera "autodeterminazione" della persona può configurare il reato di violenza sessuale.
Un cambiamento che avvicina l'ordinamento italiano agli standard applicati in diversi Paesi europei.
Il dibattito resta acceso.
I sostenitori parlano di un "passo avanti nella tutela delle vittime e nella chiarezza normativa".
Le critiche, invece, temono che l’estensione della nozione di consenso possa generare incertezza interpretativa nei processi, soprattutto nei casi privi di riscontri oggettivi.
L’emendamento ora passa al vaglio del Parlamento per l'approvazione definitiva.
Se confermato, rappresenterà uno dei più dirompenti aggiornamenti in materia di reati sessuali degli ultimi anni, con ricadute importanti sia sul piano giuridico sia sul piano sociale.
La vera domanda da porre ai giuristi è questa: durante un rapporto sessuale, per stare tranquilli, basta portarsi un testimone… oppure serve direttamente l’avvocato in studio notarile ?
