Individuals who purchased a Guinness Extra Stout beer may be entitled to receive a payment under the settlement of a class action lawsuit.
A purchaser of Guinness Extra Stout beer sued Diageo beer Company USA (formerly Diago-Guinness USA, Inc.) and Diageo North America, Inc. on the grounds that the beverage was advertised as being produced and imported from Ireland when it was actually produced and imported from Canada, according to a Kroll Settlement Administration news release.
The parties involved agreed to a settlement to resolve the lawsuit, which is offering individuals who purchased a six-pack or 12-pack in Massachusetts between December 15, 2011 and September 3, 2015 to receive compensation.
"This excludes individuals who purchased Guinness Extra Stout for resale, including distributors and retailers. It also excludes Diageo, any entity in which Diageo has a controlling interest, Diageo’s officers, directors, legal representatives, successors, subsidiaries, or assigns; and any individual who timely and validly opts-out from the Settlement Class," the news release states.
Eligible individuals can submit a claim form to receive $0.50 per six-pack, up to $20 with proof of purchase or $10 without proof of purchase from the class action settlement.
Individuals who submit a valid claim form without proof of purchase may do so by submitting attestation of their purchase of Guinness Extra Stout in Massachusetts between December 15, 2011 and September 3, 2015 under penalty of prejury.
