Texas Woman Sues After Wrong Coffee Order Leads To Severe Burns

A Houston-area woman is taking on coffee giant Starbucks after their brew allegedly caused first-degree burns.

Mary Simms recently filed a lawsuit seeking $75,000 for the April 14 incident at a Starbucks drive-thru in Tomball, Texas, the Fort Worth Star Telegram reported.

According to the suit, Simms was paying for her order in the drive-thru when the barista handed her the wrong coffee. As Simms handed the coffee back to the barista, somehow the lid popped off and the hot liquid spilled on her lap.

Now she's accusing the coffee company of failing to warn her about "the unreasonably dangerous condition created by the failing lid, hot water and/or liquid of the coffee."

Starbucks is taking the lawsuit seriously and is investigating the claim.

"We take our responsibility to provide a safe environment seriously, and our partners [employees] take great pride in ensuring our beverages are crafted with care and delivered to customers safely," the company said in a statement sent to Insider.

Hot coffee lawsuit are far from new. Last year, a California man sued the coffee chain for something similar. One of the most famous cases it the 1994 McDonald’s hot coffee lawsuit.
